for the sole purpose of construction, installing, operatin8, m~intaining, repairing, nrplacing,
removing, aad all other uses or purposes which are or may be reJated to a sewer system. It is
aqresslY understood and agreed that Spokane Couaty or their suacwsors and assigas shall
have the right of ingress and egress from the property described above For the purposes
expmsly statad herein.
Spokane Counfiy, thcir successars and assigus at all dme hereaasRer, at thear own cast and
pcpmse, may reinave all craps, brush, grass or trees that may interfm arith the oonstructing,
instaltio8, oPe,rating, maintaining, rePairing, rePlaciag, removing, and all other usea or
Purposes which are or may be relWed to a sewer systeni.
The Graator(s) reserve(s) the right ta use and enjoy that pnoperty which is the subject of tbis
easement for purposes which will noi iaterfere with the County's fuU enjoyment of the rights
hereby granted. Frovided, the Grantor(s) shall noi erect or construct any buildiag or other
structure or drill on the easement or diminish or substantiialty adid to the ground cover over the
easement.
The Fascment described herein above is tro and shall run with the land. No modification of the
boundaries of said Easement can be ma,de without the prior qpmval of Spokau►e County.
In the event the aforementioned Basement oeases to be used for tbe express purposes
r+~fe~c~ertced hereici, it shall automatically become null snd void and will cease Lo be an
encumbraace upon the above ref~'erenoed real prnperty.
Spokane County upon acoeptanve of this easement, eapressly agraes to indemnify and hold
harml+ess the Property Owner and any of its offieers, agents, emplayees ar otherwise, from any
all liab'ility, loss or damage that Property Owaer or any of its officers, agents, employees or
otherwise may suffer as a result of claims, demands, arctions, damagea or injuries of tvesy kind
or nahm whatsoever, by or to any and all person or gmperty, ar judgement against the

out of or are in any way connected with the design, constcuWon, maintenance or aperation of

IN THE MATTER OF SHORT ) FINDINGS OF FACT,
SUBDMSION; SP-1278-01 ) CONCLUSIONS AND
DECISION
THIS MATTER, an application for preliminary short subdivision approval from Jeffrey and Sarah
Crawford has been received and was decided upon, pursuant to Spokane County Subdivision
regulations, on the 15th day of June, 2001.
FINDINGS OF FACT AND CONCLUSIONS
1. The individual signing below has been properiy delegated the responsibility for rendering
the decision by the Director of Spokane County Division of Planning.
2. A pneliminary short subdivision to divide approximately 1.18 acres into 2 lots for those
uses allowed in the existing Urban Residential-3.5 (UR-3.5) Zone.
3. The site is generally Iocated approximately 700 feet north of the intersection of Bowdish
Road and Boone Avenue, approximately 316 feet west of Bowdish Road in the Northwest
of Section 16, Township 25 North, Range 44 E.W.M., Assessors Tax Parcel
No.45162.0523.
4. The existing zoning of the property is Urban Residential-3.5 (UR-3.5) which was
established in 1991 consistent with the Program to Implement the Spokane County Zoning
Code. Pursuant to Secction 58.17.195 of the Revised Code of Washington (RCVII), this
proposal, together with the conditions of preliminary approval specified herein, confoRns to
the requirements of the existing zone.
5. The Spokane County Comprehensive Plan designates this area as Urban. The
development and uses proposed for this short subdivision and conditions attached thereto
are 1n accorclance with the Urban land use category. The Urban category is intended to
provide the opportunity for development of a"cityliken environment with intensive
residential development including single family, two-family, and multi-family dwellings.
The Urban category also promotes "fill-in° development in areas with public services
available such as water, sewer, storm sewer, transit and flre protecaon. This proposed
short subdivision will essentlally be a"fill-in° development since the surrounding area is
comprised of urban density single family dwellings. The short subdivision will be served
by public water, public sewers, police, fire protecbion, solid waste collection and public
transit seroices.
6. The short subdivision is located in the Interim Urban Growth Area (IUGA) established by
Spokane County Resolution 97-0321 The propasal is consistent with the requirements of
said Resolution 97-0321.
7. Access to the site is provided by a private road which connects to Bowdish Road. The
private road serving the subjeat short subdivision also services adjacent Short Subdivision
SP-1051A-96. The Spokane County Arterial Road Plan designates Bowdish Road as a
Minor Arterial requiring 80 feet of right-of-way width. The private road easement providing
access to the subject short subdivision must be improved to County private road standards
neoessary to safely accommodate automobile traffic generated by the short subdivision
lots and to accommodate emergency vehicle access.

9. A statement shall be placed in the dedication to the effect that: °A public sewer system will
be made available for the plat and individual service will be provided to each tract prior to

10. The dedicatory language on the short plat shall state: "Use of private wells and water
systems is prohibited."
11. The final short plat dedication shall contain the following statement: "The public water
system, pursuant to the Water Pfan approved by county and state health authorities, the
local fire protection district, County Division of Building and Code Enforcement and the
water purveyor, sha11 be insta(led within this subdivision and the applicant shall provide for
individual domestic water service as well as fire protection to each tract prior to sale of each
tract and prior to issuance of a building permit for each tract."

1. The applicant shall install a fire hydrant at the comer of Sinto Lane and Bowdish Road.
DIVISION OF BUILDING AND CODE ENFORCEMENT
1. The applicant shall contact the Division of Building and Code Enforcement at the earliest
possible stage of desigNdevelopment to be informed of code requirements
administer8d/enforced by the department; e.g., State Building Code Act regulations
such as requirements for construction type, occupancy classification, fire
hydrantlflow, fire apparatus access roads, accessibility, energy code regulations,
and general coordination with other aspects of project implementation.
2. Prior to the issuance of the initial building permit(s), the applicant shall submit to the Division
of Building and Code Enforcement documentation signed by the water purveyor and the
applicable fire district stating that the public water system has been installed, tested and
accepted as operational pursuant to the approved water plan.

The perpetual exclusive easement granted to Spokane County, their successors and assigns is
for the sole purpose of construction, installing, operaling, mainlaining, repairing, replaeing,
removing, and all other uses or purposes which are or may be related to a sewer system. It is
expressly underslood and agreed that Spokane County or their successors and assigns shall
have the right of ingress and egress from the property described above for the purposes
expressly stated herein.
Spokane County, theic successors and assigns at all time hereinafter, at their own cost and
expense, may remove all crops, bivsh, grass or trees that may inierfere with the construciing,
instalfing, operating, maintaining, rcpairing, replacing, removing, and all otller uses or
purposes which are or may be relaled to a sewer system.
The Grantor(s) reserve(s) the right to use and enjoy ttiat property wliich is the subject of this
easement for purposes which will not interfere with the County's full enjoyment of the rights
hereby granted. Provided, the Grantor(s) shall not erect or canstrucl any buifding or other
structure nr drill on the easement or diminish or substantially add to lhe ground cover over the
easement.
The Easement described herein above is to and shall run with the land. No modificalion Qf the
aoundaries of said Easement can be made without the prior approval of Spokane County.
fn the event the aforementioned Ea:senient ceases to be useci fnr the express purposes
referencedi herein, it shall automaacally become null and void and will cease to be arti
encumbrance uQon the above referenced real property.

SUBDIVISION; SP-1278-01 ) CONCLUSIONS AND
DECISION
THIS MATTER, an application for preliminary short subdivision approval from Jeffrey and Sarah
Crawford has been received and was decided upon, pursuant to Spokane County Subdivision
regulations, on the 15th day of June, 2001.
FINDINGS OF FACT AND CONCLUSIONS
1. The individual signing below has been properly delegated the responsibility for rendering
the decision by the Director of Spokane County Division of Planning.
2. A preliminary short subdivision to divide approximately 1.18 acres into 2 lots for those
uses allowed in the existing Urban Residential-3.5 (UR-3.5) Zone.
3. The site is generally located approximately 700 feet north of the intersection of Bowdish
Road and Boone Avenue, approximately 316 feet west of Bowdish Road in the Northwest
'/4 of Section 16, Township 25 North, Range 44 E.W.M., Assessor's Tax Parcel
No.45162.0523.
4. The existing zoning of the property is Urban Residential-3.5 (UR-3.5) which was
established in 1991 consistent with the Program to Implement the Spokane County Zoning
Code. Pursuant to Section 58.17.195 of the Revised Code of Washington (RCV11), this
pcoposal, together with the conditions of preliminary approval specified herein, conforms to
the irequirements of the existing zone.
5. The Spokane County Comprehensive Plan designates this area as Urban. The
development and uses proposed for this short subdivision and conditions attached thereto
are in accordance with the Urban land use category. The Urban category is intended to
provide the opportunity for development of a°citylike" environment with intensive
residential development including single family, two-family, and multi-family dwellings.
The Urban category also promotes Till-inA development in areas with public services
available such as water, sewer, storm sewer, transit and fire protection. This proposed
short subdivision will essentially be a"fill-in° development since the surrounding area is
comprised of urban density single family dwellings. The short subdivision will be served
by public water, public sewers, police, fire protection, sofid waste collection and public
transit services.
fi. The short subdivision is Iocated in the Interim Urban Growth Area (IUGA) established by
Spokane County Resolution 97-0321 Thc proposal is consistent with the requirements of
said Resolution 97-0321.
7. Access to the site is provided by a private road which connects to Bowdish Road. The
private road serving the subject short subdivision also services adjacent Short Subdivision
SP-1051A-96. The Spokane County Arterial Road Plan designates Bowdish Road as a
Minor Arterial nequiring 80 feet of right-of-way width. The private road easement providing
access to the subject short subdivision must be improved to County private road standards
necessary to safely accommodate automobile traffic generated by the short subdivision
lots and to accommodate emengency vehicle access.

8. The subject property is located within the Public Transportation Benefit Area (PT6A). The
Spokane Transit Authority (STA) Routes 96 and 97 provides transit service in the vicinity
of the short subdivision.
9. The subject parcel is served by the Modern Electric Water Company water system. The
Company is willing and able to provide adequate water to meet the potable and fire flow
needs of the short subdivision.
10. The Spokane County sewer system will serve the wastewater requirements of the short
subdivision.
11. The required public notice of the proposed short subdivision and comment period was
provided consistent with the Spokane County Subdivision Ordinance. In addition,
comment was requested from those agencies having a potential interest in the proposal.
No comment was received from any landowners or taxpayers in the vicinity of the short
subdivision.
12. In consideration of the application of performance conditions specified below and the
application of Spokane County development standards, the proposed short subdivision
makes appropriate provisions for the public health, safety and general welfare and that the
public use and interest will be served by short subdividing the subject parcef. The proposal
is generally consistent with Washington State Subdivision Statute RCW 58.17 and the
Spokane County Subdivision Ordinance. The Division of Planning has considered the
provision of adequate public facilities as cited in RCW 58.17.110(2). More specifically:
a. open spaces f. sanitary waste disposat
b. drainage ways g. parks and recreation facilities
c. public and/or private right•of-ways h. playgrounds
d. transit i. schools and school grounds
e. potable water j. sidewalks
13. The proposai is exempt from the environmental review requirements under the
State Environmental Policy Act pursuant to WAC 197-11-800(6)(a).
14. The County Engineer has examined this development proposal and has determined that
the impact of this proposal upon the existing County Road System waITants the roadway
improvements specified herein.
15. This proposal is located within the Spokane-Rathdrum Prairie Aquifer Sensitive Area (ASA).
Spokane County does not own or operate a regional stormwater conveyance system. As a
result, the applicant is responsible for providing on-site control of stornnwater nunoff from
newly constructed impervious surfaces.
DECISION
Based upon the above noted Findings of Fact and Conclusions, preliminary short subdivision
application SP-1278-01 is hereby APPROVED for five (5) years, specifically to June 15, 2006

and subject to conditions specified below. This decision is final uniess appealed in writing,
consistent with appeal procedures set forth in Section 12.100.126 of the Spokane County
Subdivision Ordinance.
CONDITIONS OF APPROVAL
All the below conditions imposed shall be binding on the "Applicant," which term shall include
the developer, owner or owners of the property, heirs, assigns and successors.
SPOKANE COUNTY DIVISION OF PLANNING
1. The proposal shall comply with the Urban Residential-3.5 (UR-3.5) Zone and all other
applicable Spokane County Zoning Code requirements and the Spokane County
Subdivision Ordinance, as amended.
2. The final short subdivision shall be designed substantially in conformance with the
preliminary short subdivision of record.
3. The preliminary short subdivision is given conditional preliminary approval for five (5) years,
specifically to June 15, 2006. The applicant may submit an extension of time application
thirty (30) days prior to the above expiration date. Application(s) for extension of time shall
be processed under the provisions of Chapter 12.100.118 (Extension of Time) of the
Spokane County Subdivision Ordinance. If the applicant complies with the criteria of
Chapter 12.100.118, the preliminary approval extension will be granted and conditions
attached to preliminary subdivision approval will be changed to reflect the adopted policies
and development regulations applicable the date the time extension application is
submitted. Submission of a time extension request following May 16, 2006 will not be
accepted and the preliminary short plat will be null and void on June 15, 2006 if the
final short plat is not recorded in the County Auditor's Offlce.
4. Prior to filing of the final short plat, the applicant shall submit to the Division of Planning for
review the proposed final short plat to ensure complianve with these Conditions of
Approval.
5. Four (4) current certificates of title shall be fumished to the Division of Planning prior to
filing of the final plat.
6. A survey is required of the subject property and the lots therein prior to filing of the final
short plat.
7. Appropriate road names and street addresses shal( be indicated on the final short plat map.
8. Appropriate utility easements shall be indicated on the final short plat map. Written
approval of utility easements by utility purveyors must be received prior to filing of the final
short plat by the Division of Planning.
9. The dedication shall contain the following statement: "Side yard and rear yard setbacks
shall be determined at the time building permits are requested.°

10. The Spokane County Division of Planning shall prepare and record with the Spokane
County Auditor a"Titie Notice" noting that the property in question is subject to a
variety of special conditions imposed as a result of the land use action herein. This
'T'~tle Notice" shall serve as official public notice regarding conditions of approval
affecting the property in question. The "Title Notice" shall be recorded within fifteen
(15) days of Final Plat approval and shall only be extinguished by the Spokane County
Division of Planning.
11. The Division of Planning shall file with the Spokane County Auditor, within the same time
frame as allowed for an appeal from the final disposition, including lapsing of appeal period,
a Title Notice, which shall generally provide as follows:
"Prior to the issuance of any building permit for any building or any use on the
property described herein, the applicant shall be responsible for complying with the
provisions of the Zoning Code for Spokane County, Section 14.706 (Aquifer
Sensitive Area Overlay Zone). The property which is the subject of this notice is
more particularly described as follows: (insert legal description of the short
subdivision from Division of Planning file # SP-1278-01
SPOKANE COUNTY DIVISION OF ENGINEERING AND ROADS
1. Conditional approval of the plat by the County Engineer is given subject to approval of the
road system as indicated in the preliminary short subdivision of record.
2. A Professional Engineer, licensed in the State of Washington, shall submft final road and
drainage plans, a drainage report and calculations that conform to the April 3, 2001 Edition
of the Spokane County Standards for Road and Sewer Construction and the current edition
of the Spokane County Guidelines for Stormwater Management and all other standards
and laws that are applicable to this project if road improvements are required. inal
drainage plans and a drainage report shall receive the County Engineer's acceptance prior
to release of a construction or building permit or approval of the final short plat.
3. Construction within all proposed public/private roads shall be performed under the direct
supervision of a licensed engineer/surveyor, who shall fumish the County Engineer with
"Record Drawings" and certification which states the following, "I have reviewed the
construction and to my knowledge find it to be in substantial conformance with approved
certified plans and Standard Specifications except as noted."
4. No construction work is to be performed within the existing or proposed public right-of-way
until plans have been accepted by the County Engineer and a permit has been issued by
the County Engineer. All woric is subject to inspection and approval by the County Engineer.
5. Approach permits are required for any access to the Spokane County road system.

6. The following statements shall be placed in the dedicatory language of the final short plat:
The property owners within this plat shall be held responsible for keeping open and
maintaining the surface path of natural or man-made drainage flow over and across their
respective properties. If the property owner(s) fails to maintain the surface path of natural
or man-made drainage flow, or the drainage swale, a notice of such failure may be given to
the property owner(s). If not corrected within the period indicated on said notice, Spokane
County has the right to correct the maintenance failure, or have it corrected, at the expense
of the property owner.
There may exist properties, located uphill and adjacent to this subdivision, which periodically
discharge stoRnwater nanoff onto individual lots within this short plat. Runoff from nearby
uphill properties should be expected, and during snowmelt periods or wet seasons the lots
may be subjected to higher amounts of stormwater nanoff that what is normally observed or
anticipated. Because stormwater runoff from adjacent properties have discharged onto this
plat prior to development, stormwater runoff will likefy continue to do so after development. It
is the responsibility of the individual lot owners to maintain existing surface paths of n,inoff
through their respective lots and to grade the lots in accordance with applicable rules and
regulations, so as to prevent property damage.
Any building that is constructed on a lot in #his short plat sha11 be set at such an elevation
so as to provide positive drainage away from any drainage entry point to the building
(including but not limited to a w(indow well, a window unprotected by a window well, or a
doorway). Said positive drainage shall consist of a minimum slope of 3% away from the
building for a distance of at least 10 feet from the building. The lots shall be graded so that
either a) all runoff is routed away from the building, and conveyed over the lot to a natural
drainage swale or approved drainage facility, or b) drainage intercepted on the lot is
disposed of on the lot in an approved drainage facitity. The approved drainage facility shall
be constructed in accordance with any applicable accepted plans on file at the County
Engineer's Office. Any revisions to the accepted drainage plans must be accepted by the
County Engineers Office prior to construction of said revisions.
Spokane County does not accept the responsibility of maintaining the drainage course on
private lots or floodplain aneas within private lots, nor the responsibility for any damage
whatsoever, including, but not limited to, inverse oondemnation to any properties due to
deficient construction andlor maintenance of drainage courses in drainage easements on
private property.
u WARNING: Spokane County has no responsibility to build, improve, maintain or
otherwise servioe the private roads contained within or providing senrioe to the property
described in this plat. By accepting this plat or subsequently by allowing a building permit
to be issued on property on a private road, Spokane County assumes no obligation for
said private road and the owners heceby acknowledge that the County has no obligation
of any kind or nature whatsoever to establish, examine, survey, construct, alter, repair,
improve, maintain, provide drainage or snow removal on a private road. This requirement
is and shall run with the land and shall be binding upon the owner, their heirs, successors
or assigns including the obligation to participate in the maintenance of the private road as
provided herein."

7, The private raad shall be improved to adopted Spokane County Rvad and Sewer Standards
for private roads.
8. All vested owners shall sign and record private road documents as prescribed by the
Spokane Coun#y Engineer. These docurnents shall be reviewed and appraved by the
Spokane County Engineer prior to recotding with the Spakane Coun#y Audi#or. Recording
numbers shall be referenced in the dedicatory language of the short plat.
9. The preposed shor# pla# shalf be improWed to #he standards set f+vrth in Spokane County
Board of Cornmissianers Resolution Na. 1-0298, as amended, which establishes regulations
for roads, appraaches, drainage and fees in new canstruction.
10. The County Engineer has examined this deuelopment praposal and has determined that the
impact af this proposal upon the existing County Raad System warrants the roadway
improvements herein sRecified.
11. The applicant is advised that there may exist utifities either underground or overfiead
effecting the applicant's property, including property to be dedicated or se# aside future
acquisitian, Spakane County will assume no financial abiigation for adjustments vr
relocativn regarding these utili#ies. The applicant should contact the applicable utilities
regarding responsihility for adjustment ar relacativn costs and to make arrangements for any
necessary wark.
12. The private raad easement which is proposed to senre #racts "A" &"B" also provides
access to parcels in SP-1051A --96. Priar to filing a final shart plat, the applicant shall
provide documentation to the satisfaction of the County Engineer, demonstrating access to
Bawdish Road. The private road, inctuding the new segment, shall be constructed according
to the total amount af lots the easement serves. The applicant is advised that 10 feet of
maintenance and utiiity easement is required on both sides of the private raad, see Tabfe
3.03 of the Spolcane Counfy Standards for Road and S+ewer Cvnstruction for private road
cQRStructian standards.
SPOKANE CaUNTY DIV'ISION OF UTILITIES
1. The dedication shall state: Public sewers shall be cons#ructed to provide far ihe Connection
af each parcel to the County's system of sewerage. Uses on properties within the project
shall be required to cannect to the sewer and pay applicable charges per the County Sewer
Ordinance. Sewer connectian permits shall be required.
2. Applicant shall submit expressly to Spokane County Qivisian of Utifities "under separate
caver, I only thase plan sheets showing sewer plans and specifcattons for the publie sewer
connectians and facilities for rerriew and approval.
3. Sewer plans acceptable to the Division af Utilities shall be submitted prior to the finaliaatian of

The Spokane County Engineering Department has reviewed the above referenced application. The
following "Conditions of Approval" are submitted to the Spokane County Planning Department for

7. The private road shall be improved to adopted Spokane County Road and Sewer Standards for
private roads.
8. All vested owners shall sign and record private road documents as prescribed by the Spokane
County Engineer. These documents shall be reviewed and approved by the Spokane County
Engineer prior to recording with the Spokane County Auditor. Recording numbers shall be
referenced in the dedicatory language of the plat.
9. The proposed plat shall be improved to the standards set forth in Spokane County Board of
Commissioners Resolution No. 1-0298, as amended, which establishes regulations for roads,
approaches, drainage and fees in new construction.
10. The County Engineer has examined this development proposal and has determined that the
impact of this proposal upon the existing County Road System warrants the roadway
improvements herein specified.
11. uThe applicant is advised that there may exist utilities either underground or overhead effecting
the applicant's property, including property to be dedicated or set aside future acquisition.
Spokane County will assume no financial obligation for adjustments or relocation regarding
these utilities." "The applicant should contact the appiicable utilities regarding responsibility for

12. The private road easement which is proposed to serve tracts "A" &"B" also provides access to
parcels in SP-1051 A-96. Prior to filing a final plat, the applicant shall provide documentation to
the satisfaction of the County Engineer, demonstrating access to Bowdish Road. The private
road, including the new segment, shall be constructed according to the total amount of lots the
easement serves. The applicant is advised that 10 feet of maintenance and utility easement is
required on both sides of the private road, see Table 3.03 of the Spokane County Standards for
Road and Sewer Construction for private road construction standards.

• A Professional Engineer, licensed in the State of Washington, shall submit
final road and drainage plans, a drainage report and calculations that conform
to the April 3, 2001 Edition of the Spokane County Standards for Road and
Sewer Construction and the current edition of the Spokane County Guidelines
for Stormwater Management and all other standards and laws that are
applicable to this project if road improvements are required. Final drainage
plans and a drainage report shall receive the County Engineer's acceptance
prior to release of a construction or building permit or approval of the final
plat.
• The following drainage language shall appear on the plat:
