THIS MATTER, an application for subdivision of land from Mary Jane Clark has been received
and was decided upon, pursuant to Spokane County Subdivision regulations, on the 25t' day of
May 2001.
FINDINGS OF FACT AND CONCLUSI4NS
1. The individual signing below has further been properly delegated the responsibility for
rendering the decision by the Director of Spokane County Division of Planning.
2. The proposal is to divide approximately 0.83 acres into two (2) lots of approximately
10,000 and 26,326 square feet in size for those uses permitted in the Urban Residential
3.5 (UR-3.5) zone.
3. The proposal is tocated west of and adjacent to Evergreen Road, and south of and
adjacent to 21 s' in the NE of Section 27, Township 25 North, Range 44 East W.M.,

4. The existing zoning of the property described in the application is Urban Residential-3.5

subdivision and uses, as proposed and conditioned, are in compliance with the Urban
category of the Comprehensive Plan.
6. This proposal is compatible with the suROUnding uses which are primarily single family
residences on urban sized paroels.
7. The County Arterial Road plan identifies Evergreen Road as a 100 foot Principal Arterial.
The existing right of way width of 34 feet, measured from the centerline of the road, is not
consistent with that specified in the plan. In order to implement the Arterial Road Plan it
is recommended that a strip of property 16 feet in width along the Evergreen Road
frontage be set aside in reserve. This property may be acquired by Spokane County at
the time when arterial improvements are made to Evergreen Road.
8. The proposed site is located within the Public Transportation Benefit Area (PTBA).
The Spokane Transit Authority (STA) Route No. 97 provides transit service in the
vicinity of the short subdivision.
9. The proposed short plat will be served by a public water system (Vera Imgation District
#15). Waste water disposal will be as authorized by the Director of Spokane County
Division of Utilities.

10. The required public notice was provided for this proposal, and agencies having a
potential interest in the project were notified and recommendations solicited.
11. One comment from an adjoining parcel owner was received requesting a clarification on
the proper designation of the parcel as identified in the Notice of Application.
12, Recognizing the recommended conditions and Spokane County development standards,
the proposed short plat makes appropriate provisions for the public health, safety and
general welfare and that the public use and interest will be served by platting the
subdivision.
The subdivision proposal is generally consistent with RCW 58.17 and the County
Subdivision regulations, promoting the public health, safety and general welfare in
accordance with standards established by the State and Spokane County. The County
Division of Planning has considered the provision of adequate public facilities as cited in
RCW 58.17.110 (2). More specifically:
a. open spaces f. sanitary waste disposal
b. drainage ways g. parks and recreation facilities
c. public and/or private right-of-ways h. playgrounds
d. transit i. schools and school grounds
e. potable water j. sidewalks
13. The project is exempt from environmental review under the State Environmental Policy
Act pursuant to WAC 197-11-800 (6) (a).
14. Central Valley School District # 356 was sent notification of the project on May 4, 2001.
No response has been received.
15. The preliminary short plat lies within the Aquifer Sensitive Area (ASA) Overlay Zone and
the Priority Sewer Service Area (PSSA). ASA Overlay Zone standards for residential
development activities, as defined in Section 14.706.100 of the Spokane County Zoning
Code, shall apply to the proposed residential development of the site.
16. The project site lies within the Interim Urban Growth Area (IUGA) boundary established
by Board of County Commissioners' Resolution No. 97-0321 in response to RCW
36.70A, the Growth Management Act. The development of the site, as proposed, is in
accordance with Resolution No. 97-0321 and the Interim Development Regulations
designated to implement the IUGA.
17. The preliminary short plat lies within the Conical Area (CA) of the Airport Overlay (AO)
Zone. AO Overlay Zone General Use Restrictions, as defined in Section 14.702.060 of
the Spokane County Zoning Code shall apply to the proposed development of the site.
18. The project site is part of an original four (4) lot Short Plat (SP-741-92) that was filed
with the county Auditor on November 10, 1992.

Based upon the above noted Findings of Fact and Conciusions, Short Plat Application SP-1280-
01 is hereby APPROVED for five (5) years, specifically to May 25, 2006 and subject to the
conditions specified below. This decision is final unless appealed in writing, consistent with the
adopted appeal procedures.
CONDITIONS OF APPROVAL
All the below conditions imposed shall be binding on the "Applicant," which term shall include
the owner or owners of the property, heirs, assigns and successors.
SPOKANE COUNTY DIVISION OF PLANNING
1. The proposal shall comply with the Urban Residential-3.5 (UR-3.5) zone, Airport Overlay
(AO) zone, Aquifer Sensftive Area Overlay (ASA) zone, and other applicable Zoning
Code chapters, as amended.
2. The final short plat map shall be prepared in accordance with Section 12.300 af the
Spokane County Subdivision Ordinance.
3. The final short plat shall be designed substantialty in conformance with the preliminary
short plat of record. No increase of density or number of tracts shall occur without a
change of condition apptication submittal and approval.
4. The preliminary short plat is given conditional approvat for five (5) years, specifically to
' May 25, 2006. The applicant may submit an extension of time application at least thirty
(30) days prior to the above expiration date, but no later than April 25, 2006. An
application for an extension of time shall be processed under the provisions of Chapter
12.100.118 (Extension of Time) of the Spokane County Subdivision Ordinance. If the
applicant complies with the criteria of Chapter 12.100.118, the preliminary approval and
conditions will be changed to reflect the adopted policy and development regulations at
the time of the extension application.
5. Prior to filing the final short plat, the applicant shall submit to the County Division of
Planning Director/designee for review any proposed final short plat to ensure compliance
with these Findings and Conditions of Approval.
6. A survey is required of the subject property prior to filing the final short plat.
7. Appropriate road names and street addresses shall be indicated on the final short plat
map.
8. Appropriate utility easements shall be indicated on the final short plat map. Approval of
utility easements by utifity companies shall be submitted with the final short plat.
9. The final short plat dedication shall include the following statement:
"Setbacks shall be determined at the time building permits are requested unless these
setbacks are specifically drafted on this final short plat. The setbacks indicated on this

short subdivision may be varied from if proper ioning or variance approvals are
obtained."
10. Four (4) current Certificates of Title shall be fumished to the County Division of Planning
prior to filing the final short plat.
11. The Spokane County Division of Planning shall prepare and record with the County
Auditor a Title Notice specifying a future land acquisition area for road right-of-way
and utilities. The Title Notice shall state the following:
a. A strip of property 16 feet in width from the existing right-of-way is reserved for
future acquisition area for additional road right-of-way width along Evergreen
Road.
b. Future building and other setbacks required by the Spokane County Zoning
Code shall be measured from the resenied future acquisition area.
c. No required landscaping, parking, '208' areas, drainfield or allowed signs
should be located within the future acquisition area for road right-of-way and
utilities. If any of the above improvements are within the area, they shall be
relocated at the applicant's expense when roadway improvements are made.
d. The future acquisition area, unit acquired, shall be private property and may be
used as allowed in the zone, except that any improvements (such as
landscaping, parking, surface drainage, drainfield, signs or others) shall be
considered interim uses.
e. The property owner shall be responsible for relocating such "interim°
improvements at the time Spokane County makes roadway improvements after
acquiring said future acquisition.
SPOKANE COUNTY DIVISION OF UTILITIES
1. Spokane County does not own or operate a regional stormwater conveyance system. As
a result, the project proponent is responsible for providing on-site control of stormwater
runoff from newly constructed impervious surfaces.
2. Drainage shall not be diverted andlor released to a downstream property at points not
receiving drainage prior to the proposed development.
3. This proposal is located within the Spokane-Rathdrum Prairie Aquifer Sensitive Area
(ASA). In order to mitigate the potential for groundwater degradation, all stormwater
runoff from land developed within the ASA shall be treated prior to discharge to a drywell
or other approved disposal point. The preferred method of treatment is through a
bioinfiltration swale (formerly referred to as a°208° swale or a grassed percolation area).
4. Easements and/or separate tracts shall be provided for all drainage facilities (natural
channels, bio-infiltration swales, storm pipes and ditches, etc.) located outside of County
right-of-way. These easements and/or tracts shall be identified on the Final Short Plat
and any subsequent construction plans.
5. The dedication shall state: Public sewers shall be constructed to provide for the
connection of each parcel to the County's system of sewerage. Uses on properties

within the project sha11 be required to connect to the sewer and pay appticable charges
per the County Sewer Ordinance. Sewer connection permits shall be required.
6. Applicant shall submit expressly to Spokane County Division of Util'rties "under separate
cover", only those plan sheets showing sewer plans and specifications for the public
sewer connections and facilities for review and approval. Commercial developments
shall submit historical and or estimated water usage as part of the sewer plan submittal.
7. Sewer plans acceptable to the Division of Utilities shall be submitted prior to the
finalization of the project.
8. Any water service for this project shall be provided in accordance with the Coordinated
Water System Plan for Spokane County, as amended.
SPOKANE COUNTY DIVISION OF ENGINEERING & ROADS
1. Conditional approval of the plat by the County Engineer is given subject to approval of the
road system as indicated in the preliminary plat of record.
2. A Professional Engineer, licensed in the State of Washington, shall submit final road and
drainage plans, a drainage report and calculations that conform to the April 3, 2001 Edition
of the Spokane County Standards for Road and Sewer Construction and the current
edition of the Spokane County Guidelines for Stormwater Management and all other
standards and laws that are applicable to this project if road improvements are required.
Final drainage plans and a drainage report shall receive the County Engineer's
acceptance prior to release of a construction or building permit or approval of the final plat.
3. No construction work is to be performed within the existing or proposed public right-of-way
until plans have been accepted by the County Engineer and a permit has been issued by
the County Engineer. All work is subject to inspection and approval by the County
Engineer.
4. Approach Permits are required for any access to the Spokane County road system.
5. To construct the road improvements stated herein, the applicant may, with the approval of
the County Engineer, join in and be a willing participant in any petition or resolution which
purposes is the formation of a Road Improvement District (RID) for said improvements
pursuant to RCW 36.88, as amended. At such time as an RID is created or any Road
Improvement Project is sanctioned by Spokane County, the improvements required (curb,
sidewalk, drainage control and paving to existing pavement) will be at the sole expense of
the undersigned owner, their heirs, grantees and assigns. This provision is applicable to
21 'It Avenue and Evergreen Road.

6. As an alternative method of constructing the road improvement stated herein, the applicant
may, with the approval of the County Engineer, accomplish the road improvements stated
herein by joining and participating in a County Road Project (CRP) to the extent of the
required road improvement. At such time as an RID is created or any Road Improvement
Project is sanctioned by Spokane County, the improvements required (curb, sidewalk,
drainage control and paving to existing pavement) will be at the sole expense of the
undersigned owner, their heirs, grantees and assigns. This provision is applicable to 21 St
Avenue and Evergreen Road.
7. The applicant shall grant applicable border easements adjacent to Spokane County Right
of Way per Spokane County Standards.
8. The following statements shall be placed in the dedicatory language of the final plat:
• No direct access shall be allowed from lots to Evergreen Road.
• The property owners within this plat shall be held responsible for keeping open and
maintaining the surface path of natural or man-made drainage flow over and across their
respective properties. If the property owner(s) fails to maintain the surface path of natural
or man-made drainage flow, or the drainage swale, a notice of such failure may be given
to the property owner(s). If not corcected within the period indicated on said notice,
Spokane County has the right to correct the maintenance failure, or have it corrected, at
the expense of the property owner.
~ There may exist properties, located uphill and adjacent to this subdivision, which periodically
discharge stormwater runoff onto individual lots within this piat. Runoff from nearby uphill
properties should be expected, and during snowmelt periods or wet seasons the lots may be
subjected to higher amounts of stormwater runoff that what is normally obsenred or
anbcipated. Because stormwater runoff from adjacent properties have discharged onto this
plat prior to development, stormwater runoff will likely continue to do so after development.
It is the responsibility of the individuat lot owners to maintain existing surface paths of n,inoff
through their respective lots and to grade the lots in accordance with applicable rules and
regulations, so as to prevent property damage.
• Spokane County does not accept the responsibility of maintaining the drainage course on
private lots or floodplain areas within private lots, nor the responsibility for any damage
whatsoever, including, but not limited to, inverse condemnation to any properties due to
deficient construction and/or maintenance of drainage courses in drainage easements on
private property.

• Any building that is constructed on a lot in this plat shall be set at such an elevation so as
to provide positive drainage away from any drainage entry point to the building (including
but not limited to a window well, a window unprotected by a window well, or a doorway).
Said positive drainage shall consist of a minimum slope of 3% away from the building for a
distance of at least 10 feet from the building. The lots shall be graded so that either a) all
runoff is routed away ftom the building, and conveyed over the lot to a natural drainage
swale or approved drainage facility, or b) drainage intercepted on the lot is disposed of on
the lot in an approved drainage facility. The approved drainage facility shall be
constructed in accordance with any applicable accepted plans on file at the County
Engineees Office. Any revisions to the accepted drainage plans must be accepted by the
County Engineer's Office prior to construction of said revisions.
• That in consideration of Mutual Benefits now or to be hereafter derived, do for themselves,
their heirs, grantees, assigns and successor(s) in interest hereby request and authorize
Spokane County to include the above described property in a Road Improvement District
(RID) and to support the formation of a Road Improvement District for improvement of the
road(s) described below by requesting and authorizing Spokane County to place their
name(s) on a petition for the formation of a Road Improvement District pursuant to RCW
36.88.050, or by requesting and authorizing Spokane County to cast their ballot in favor of
a RID being formed under the resolution method pursuant to RCW 36.88.030, and/or by not
filing a protest against the formation of a RlD being formed under the aitemative resolution
method provided for in RCW 36.88.065 and Chapter 35.43 RCW.
If a RID is proposed for improvement of the road(s) described below, said owner(s) and
successor(s)further agree: (1) that the improvements or construction contemplated within
the proposed RID are feasible and (2) that the benefits to be derived from the formation of
the RID by the property included therein, together with the amount af any County
participation, exceeds the cost and expense of formation of the RID, and (3) that the
property within the proposed RID is sufficiently developed; provided, themsefves, their
heirs, grantees, assigns and successor(s) shall retain the right, as authorized under RCW
36.88.090, to object to any assessment(s) on the property as a result of the improvements
called for in conjunction wfth the formation of a RID by either the petition or resolution
method under Chapter 36.88 RCW and to appeal to the Superior Court the decision of the
Board of County Commissioners confinning the final assessment roll; provided further, it is
recognized that actual assessments may vary from assessment estimate so long as they
do not exceed a figure equal to the increased true and fair value improvement(s) add(s) to
the property.
It is further acknowledged and agreed that at such time as a RID is created or any County
Road Improvement project is authorized by Spokane County, the improvements required
shall be at the sole expense of the owner(s) of property within the RID or served by the
improvements without any monetary participation by Spokane County.
The RID waiver contained in this agreement shall expire after ten (10) years from the date
of execution below. This provision is applicable to 21 st Avenue and Evergreen Road.
9. The County Engineer has designated a Local Access Roadway Section for the
improvement of 21st Avenue which is adjacent to the proposed development. Roadway
improvements have been performed except for the construction of curbing and sidewalk,

which is also required.
10. The County Engineer has designated a 3-Lane Principal Artedal Roadway Section for the
improvement of Evergreen Road which is adjacent to the proposed devetopment. This will
require the addition of approximately 5-7 feet of asphalt along the frontage of the
development. The construction of curbing and sidewalk is also required.
11. The proposed plat shall be improved to the standards set forth in Spokane County Board of
Commissioners Resolution No. 01-298, as amended, which establishes regulations for
roads, approaches, drainage and fees in new construction.
12. The County Engineer has examined this development proposal and has detennined that
the impact of this proposal upon the existing County Road System warrants the roadway
improvements herein specified.
13. The County Arterial Road plan identifies Evergreen Road as a 100 foot Principal Arterial.
The existing right of way width of 34 feet, measured from the centerline of the road, is not
consistent with that specified in the pfan. In order to implement the Arterial Road Plan it is
recommended that a strip of property 16 feet in width along the Evergreen Road frontage
be set aside in reserve. This property may be acquired by Spokane County at the time
when Arterial Improvements are made to Evergreen Road.
14. uThe applicant is advised that there may exist utilities efther underground or overthead
effecting the applicant's property, including property to be dedicated or set aside future
acquisition. Spokane County will assume no financial obligation for adjustments or
relocation regarding these utilities." °The applicant should contact the applicable utilities
regarding responsibility for adjustment or relocation costs and to make arrangements for
any necessary work."
15. If road improvements are necessary, additional drainage language will be required.
SPOKANE DIVISION OF BUILDING & CODE ENFORCEMENT
1. The applicant shall contact the Division of Building and Code Enforcement at the earliest
possible stage in order to be informed of code requirements administeredlenforced as
authorized by the State Building Code Act, Design/development concems include
addressing, fire apparatus access roads, fire hydrant flow, approved water systems,
building accessibility, construction type, occupancy cfassification, existing exterior wall
protection and energy code requirements.
2. Prior to the issuance of the initial building permit(s), the applicant shall submit to the
Division of Building and Code Enforcement documentation signed by the water purveyor
and the applicable fire district stating that the public water system has been installed,
tested and accepted as operational pursuant to the approved water plan.
SPOKANE REGIONAL HEALTH DISTRICT
1. The final plat shall be designed as indicated on the preliminary plat of record and/or any
attached sheets as noted.

2. Appropriate utility easernents shall be indicated on copies of the preliminary piat of
record for distribution by the Planning Department to the utility companies, Spokane
County Engineer, and the Spokane Regional Heaith District. Written approval of the
easements by the utility companies shall be received prior to the submittal of the final
plat.
3. Sewage disposal method shall be as authorized by the Director of Utilities, Spokane
County.
4. Water service shall be coordinated through the Director of Utilities, Spokane County.
5. Water service shall be by an existing public water supply when approved by the
Regional Engineer (Spokane), State Department of Health.
6. Prior to filing the final plat, the sponsor shall demonstrate to the satisfaction of the
Spokane Regional Health District that an adequate and potable water supply is available
to each tract of the plat.
7. Prior to filing the final plat, the sponsor shall present evidence that the plat lies within the
recorded service area of the water system proposed to serve the plat.
8. A public sewer system will be made available for the plat and individual service witl be
provided to each tract prior to sale. Use of individual on-site sewage disposal systems
shall not be authorized.
9. A statement shall be placed in the dedication to the effect that: pA public sewer system
will be made available for the plat and individual service will be provided to each tract
pcior to sale. Use of individual on-site sewage disposal systems shall not be authorized.p
10. The dedicatory language on the plat shall state: "Use of private wells and water systems .
is prohibited."
11. The final plat dedication shall contain the following statement: "The public water system,
pursuant to the Water Plan approved by county and state health authorities, the local fire
protection district, County Building and Safety Department and water purveyor, shall be
installed within this subdivision and the applicant shall provide for individual domestic
water service as well as fire protection to each tract prior to sale of each tract and prior
to issuance of a building permit for each tract."

• Any building that is constructed on a lot in this plat shall be set at such an elevation so as to

• That in consideration of Mutual 6enefits now or to be hereafter derived, do for themselves, their
heirs, grantees, assigns and successor(s) in interest hereby request and authorize Spokane
County to include the above described property in a Road Improvement District (RID) and to
support the formation of a Road Improvement District for improvement of the road(s) described
below by requesting and authorizing Spokane County to place their name(s) on a petition for the
formation of a Road Improvement District pursuant to RCW 36.88.050, or by requesting and
authorizing Spokane County to cast their ballot in favor of a RID being formed under the
resolution method pursuant to RCW 36.88.030, and/or by not filing a protest against the
formation of a RID being formed under the alternative resolution method provided for in RCW
36.88.065 and Chapter 35.43 RCW.
If a RID is proposed for improvement of the road(s) described below, said owner(s) and
successor(s)further agree: (1) that the improvements or construction contemplated within the
proposed RI D are feasible and (2) that the benefits to be derived from the formation of the RI D
by the property included therein, together with the amount of any County participation, exceeds
the cos# and expense of formation o# the RI D, and (3) that the property within the proposed RI D
is sufficiently devefoped; provided, themselves, their heirs, grantees, assigns and successor(s)
shall retain the right, as authorized under RCW 36.88.090, to object to any assessment(s) on
the property as a result of the improvements called for in conjunction with the formation of a RID
by either the petition or resolution method under Chapter 36.88 RCW and to appeal to the
Superior Court the decision of the Board of County Commissioners confirming the final
assessment roll; provided further, it is recognized that actual assessments may vary from
assessment estimate so long as they do not exceed a figure equal to the increased true and fair
value improvement(s) add(s) to the property.
It is further acknowledged and agreed that at such time as a RID is created or any County Road
Improvement project is authorized by Spokane County, the improvements required shall be at
the sole expense of the owner(s) of properiy within the RID or served by the improvements
without any monetary participation by Spokane County.
The RID waiver contained in this agreement shall expire after ten (10) years from the date of
execution below. This provision is applicable to 215` Avenue and Evergreen Road.

9. The County Engineer has designated a Local Access Roadway Section for the improvement of
211 Avenue which is adjacent to the proposed development. Roadway improvements have
been performed except for the construction of curbing and sidewalk, which is also required.
10. The County Engineer has designated a 3-Lane Principal Arterial Roadway Section for the
improvement of Evergreen Road which is adjacent to the proposed development. This will
require the addition of approximately 5-7 feet of asphalt along the frontage of the development.
The construction of curbing and sidewalk is also required.
11. The proposed plat shall be improved to the standards set forth in Spokane County Board of
Cammissioners Resolution No. 01-298, as amended, which establishes regulations for roads,
approaches, drainage and fees in new construction.
12. The County Engineer has examined this development proposal and has determined that the
impact of this proposal upon the existing County Road System warrants the roadway
improvements herein specified.
13. The County Arterial Road plan identifies Evergreen Road as a 100 foot Principal Arterial. The
existing right of way width of 34 feet, measured from the centerline of the road, is not consistent
with that specified in the plan. In order to implement the Arterial Road Plan it is recommended
that a strip of property 16 feet in width along the Evergreen Road frontage be set aside in
reserve. This property may be acquired by Spokane County at the time when Arterial
Improvements are made to Evergreen Road.
14. "The applicant is advised that there may exist utilities either underground or overhead effecting
the applicant's property, including property to be dedicated or set aside future acquisition.
Spokane County will assume no financial obligation for adjustments or relocation regarding
these utilities." "The applicant should contact the applicable utilities regarding responsibility for
adjustment or relocation costs and to make arrangements for any necessary work."

This proposal fies in an area of approved soils. No concept drainage plan is required. The application is technically
compiete.
I recommend the following conditions of approval:
• A Professional Engineer, licensed in the State of Washington, shall submit final road and drainage
plans, a drainage report and calculations that conform to the April 3, 2001 Edition of the Spokane
County Standards for Road and Sewer Construction and the current edition of the Spokane
County Guidelines for Stormwater Management and ail other standards and laws that are
applicabie to this project if road improvements are required. Final drainage plans and a drainage
report shall receive the County Engineer's acceptance prior to release of a construction or
building permit or approval of the final plat.
• The following drainage language shall appear on the plat:
The property owners within this plat shall be held responsible for keeping open and maintaining the
surface path of natural or man-made drainage flow over and across their respective properties. If the
property owner(s) fails to maintain the surface path of natural or man-made drainage flow, or the
drainage swale, a notice of such failure may be given to the property owner(s). If not corrected within
the period indicated on said notice, Spokane County has the right to correct the maintenance failure,
or have it corrected, at the expense of the property owner.
There may exist properties, located uphill and adjacent to this subdivision, which periodically
discharge stormwater runoff onto individual lots within this plat. Runoff from nearby uphill properties
should be expected, and during snowmelt periods or wet seasons the lots may be subjected to higher
amounts of stormwater runoff that what is normally observed or anticipated. 6ecause stormwater
runoff from adjacent properties have discharged onto this plat p(or to development, stormwater
runoff will likely continue to do so after development. It is the responsibility of the individual lot
owners to maintain existing surface paths of runoff through their respective lots and to grade the lots
in accordance with applicable rules and regulations, so as to prevent property damage.
