FINDINGS OF FACT AND CONCLUSI4NS 1. The individual signing below has further been properly delegated the responsibility for rendering the decision by the Director of Spokane County Division of Planning. 2. The proposal is to divide approximately 0.83 acres into two (2) lots of approximately 10,000 and 26,326 square feet in size for those uses permitted in the Urban Residential 3.5 (UR-3.5) zone. 3. The proposal is tocated west of and adjacent to Evergreen Road, and south of and adjacent to 21 s' in the NE of Section 27, Township 25 North, Range 44 East W.M., Spokane County, Washington. Assessor's Tax Parcel # 45271.9050 4. The existing zoning of the property described in the application is Urban Residential-3.5 (UR-3.5), which was established in 1991. Pursuant to Revised Code of Washington (RCV1) 58.17.195, this proposal conforms to the requirements of the existing UR-3.5 zone. 5. The Spokane County Comprehensive Plan designates this area as Urban. The short subdivision and uses, as proposed and conditioned, are in compliance with the Urban category of the Comprehensive Plan. 6. This proposal is compatible with the suROUnding uses which are primarily single family residences on urban sized paroels. 7. The County Arterial Road plan identifies Evergreen Road as a 100 foot Principal Arterial. The existing right of way width of 34 feet, measured from the centerline of the road, is not consistent with that specified in the plan. In order to implement the Arterial Road Plan it is recommended that a strip of property 16 feet in width along the Evergreen Road frontage be set aside in reserve. This property may be acquired by Spokane County at the time when arterial improvements are made to Evergreen Road. 8. The proposed site is located within the Public Transportation Benefit Area (PTBA). The Spokane Transit Authority (STA) Route No. 97 provides transit service in the vicinity of the short subdivision. 9. The proposed short plat will be served by a public water system (Vera Imgation District #15). Waste water disposal will be as authorized by the Director of Spokane County Division of Utilities. ~ 10. The required public notice was provided for this proposal, and agencies having a potential interest in the project were notified and recommendations solicited. 11. One comment from an adjoining parcel owner was received requesting a clarification on the proper designation of the parcel as identified in the Notice of Application. 12, Recognizing the recommended conditions and Spokane County development standards, the proposed short plat makes appropriate provisions for the public health, safety and general welfare and that the public use and interest will be served by platting the subdivision. The subdivision proposal is generally consistent with RCW 58.17 and the County Subdivision regulations, promoting the public health, safety and general welfare in accordance with standards established by the State and Spokane County. The County Division of Planning has considered the provision of adequate public facilities as cited in RCW 58.17.110 (2). The project is exempt from environmental review under the State Environmental Policy Act pursuant to WAC 197-11-800 (6) (a). 14. Central Valley School District # 356 was sent notification of the project on May 4, 2001. No response has been received. 15. The preliminary short plat lies within the Aquifer Sensitive Area (ASA) Overlay Zone and the Priority Sewer Service Area (PSSA). ASA Overlay Zone standards for residential development activities, as defined in Section 14.706.100 of the Spokane County Zoning Code, shall apply to the proposed residential development of the site. 16. The project site lies within the Interim Urban Growth Area (IUGA) boundary established by Board of County Commissioners' Resolution No. 97-0321 in response to RCW 36.70A, the Growth Management Act. The development of the site, as proposed, is in accordance with Resolution No. 97-0321 and the Interim Development Regulations designated to implement the IUGA. 17. The preliminary short plat lies within the Conical Area (CA) of the Airport Overlay (AO) Zone. AO Overlay Zone General Use Restrictions, as defined in Section 14.702.060 of the Spokane County Zoning Code shall apply to the proposed development of the site. 18. The project site is part of an original four (4) lot Short Plat (SP-741-92) that was filed with the county Auditor on November 10, 1992. DECISION Findings and Decision SP-1280-01 2 . / Based upon the above noted Findings of Fact and Conciusions, Short Plat Application SP-1280- 01 is hereby APPROVED for five (5) years, specifically to May 25, 2006 and subject to the conditions specified below. This decision is final unless appealed in writing, consistent with the adopted appeal procedures. SPOKANE COUNTY DIVISION OF UTILITIES 1. Spokane County does not own or operate a regional stormwater conveyance system. As a result, the project proponent is responsible for providing on-site control of stormwater runoff from newly constructed impervious surfaces. 2. Drainage shall not be diverted andlor released to a downstream property at points not receiving drainage prior to the proposed development. 3. This proposal is located within the Spokane-Rathdrum Prairie Aquifer Sensitive Area (ASA). In order to mitigate the potential for groundwater degradation, all stormwater runoff from land developed within the ASA shall be treated prior to discharge to a drywell or other approved disposal point. The preferred method of treatment is through a bioinfiltration swale (formerly referred to as a°208° swale or a grassed percolation area). 4. Easements and/or separate tracts shall be provided for all drainage facilities (natural channels, bio-infiltration swales, storm pipes and ditches, etc.) located outside of County right-of-way. These easements and/or tracts shall be identified on the Final Short Plat and any subsequent construction plans. 5. The dedication shall state: Public sewers shall be constructed to provide for the connection of each parcel to the County's system of sewerage. Applicant shall submit expressly to Spokane County Division of Util'rties "under separate cover", only those plan sheets showing sewer plans and specifications for the public sewer connections and facilities for review and approval. Commercial developments shall submit historical and or estimated water usage as part of the sewer plan submittal. 7. Sewer plans acceptable to the Division of Utilities shall be submitted prior to the finalization of the project. 8. Any water service for this project shall be provided in accordance with the Coordinated Water System Plan for Spokane County, as amended. SPOKANE COUNTY DIVISION OF ENGINEERING & ROADS 1. Conditional approval of the plat by the County Engineer is given subject to approval of the road system as indicated in the preliminary plat of record. 2. A Professional Engineer, licensed in the State of Washington, shall submit final road and drainage plans, a drainage report and calculations that conform to the April 3, 2001 Edition of the Spokane County Standards for Road and Sewer Construction and the current edition of the Spokane County Guidelines for Stormwater Management and all other standards and laws that are applicable to this project if road improvements are required. At such time as an RID is created or any Road Improvement Project is sanctioned by Spokane County, the improvements required (curb, sidewalk, drainage control and paving to existing pavement) will be at the sole expense of the undersigned owner, their heirs, grantees and assigns. This provision is applicable to 21 St Avenue and Evergreen Road. 7. The applicant shall grant applicable border easements adjacent to Spokane County Right of Way per Spokane County Standards. 8. The following statements shall be placed in the dedicatory language of the final plat: • No direct access shall be allowed from lots to Evergreen Road. • The property owners within this plat shall be held responsible for keeping open and maintaining the surface path of natural or man-made drainage flow over and across their respective properties. If the property owner(s) fails to maintain the surface path of natural or man-made drainage flow, or the drainage swale, a notice of such failure may be given to the property owner(s). If not corcected within the period indicated on said notice, Spokane County has the right to correct the maintenance failure, or have it corrected, at the expense of the property owner. ~ There may exist properties, located uphill and adjacent to this subdivision, which periodically discharge stormwater runoff onto individual lots within this piat. Runoff from nearby uphill properties should be expected, and during snowmelt periods or wet seasons the lots may be subjected to higher amounts of stormwater runoff that what is normally obsenred or anbcipated. Because stormwater runoff from adjacent properties have discharged onto this plat prior to development, stormwater runoff will likely continue to do so after development. It is the responsibility of the individuat lot owners to maintain existing surface paths of n,inoff through their respective lots and to grade the lots in accordance with applicable rules and regulations, so as to prevent property damage. • Spokane County does not accept the responsibility of maintaining the drainage course on private lots or floodplain areas within private lots, nor the responsibility for any damage whatsoever, including, but not limited to, inverse condemnation to any properties due to deficient construction and/or maintenance of drainage courses in drainage easements on private property. Findings and Decision SP-1280-01 6 r • Any building that is constructed on a lot in this plat shall be set at such an elevation so as to provide positive drainage away from any drainage entry point to the building (including but not limited to a window well, a window unprotected by a window well, or a doorway). Said positive drainage shall consist of a minimum slope of 3% away from the building for a distance of at least 10 feet from the building. The lots shall be graded so that either a) all runoff is routed away ftom the building, and conveyed over the lot to a natural drainage swale or approved drainage facility, or b) drainage intercepted on the lot is disposed of on the lot in an approved drainage facility. The County Engineer has designated a 3-Lane Principal Artedal Roadway Section for the improvement of Evergreen Road which is adjacent to the proposed devetopment. This will require the addition of approximately 5-7 feet of asphalt along the frontage of the development. The construction of curbing and sidewalk is also required. 11. The proposed plat shall be improved to the standards set forth in Spokane County Board of Commissioners Resolution No. 01-298, as amended, which establishes regulations for roads, approaches, drainage and fees in new construction. 12. The County Engineer has examined this development proposal and has detennined that the impact of this proposal upon the existing County Road System warrants the roadway improvements herein specified. 13. The County Arterial Road plan identifies Evergreen Road as a 100 foot Principal Arterial. The existing right of way width of 34 feet, measured from the centerline of the road, is not consistent with that specified in the pfan. In order to implement the Arterial Road Plan it is recommended that a strip of property 16 feet in width along the Evergreen Road frontage be set aside in reserve. If a RID is proposed for improvement of the road(s) described below, said owner(s) and successor(s)further agree: (1) that the improvements or construction contemplated within the proposed RI D are feasible and (2) that the benefits to be derived from the formation of the RI D by the property included therein, together with the amount of any County participation, exceeds the cos# and expense of formation o# the RI D, and (3) that the property within the proposed RI D is sufficiently devefoped; provided, themselves, their heirs, grantees, assigns and successor(s) shall retain the right, as authorized under RCW 36.88.090, to object to any assessment(s) on the property as a result of the improvements called for in conjunction with the formation of a RID by either the petition or resolution method under Chapter 36.88 RCW and to appeal to the Superior Court the decision of the Board of County Commissioners confirming the final assessment roll; provided further, it is recognized that actual assessments may vary from assessment estimate so long as they do not exceed a figure equal to the increased true and fair value improvement(s) add(s) to the property. The County Engineer has designated a Local Access Roadway Section for the improvement of 211 Avenue which is adjacent to the proposed development. Roadway improvements have been performed except for the construction of curbing and sidewalk, which is also required. 10. The County Engineer has designated a 3-Lane Principal Arterial Roadway Section for the improvement of Evergreen Road which is adjacent to the proposed development. This will require the addition of approximately 5-7 feet of asphalt along the frontage of the development. The construction of curbing and sidewalk is also required. 11. The proposed plat shall be improved to the standards set forth in Spokane County Board of Cammissioners Resolution No. 01-298, as amended, which establishes regulations for roads, approaches, drainage and fees in new construction. 12. The County Engineer has examined this development proposal and has determined that the impact of this proposal upon the existing County Road System warrants the roadway improvements herein specified. 13. The County Arterial Road plan identifies Evergreen Road as a 100 foot Principal Arterial. The existing right of way width of 34 feet, measured from the centerline of the road, is not consistent with that specified in the plan. In order to implement the Arterial Road Plan it is recommended that a strip of property 16 feet in width along the Evergreen Road frontage be set aside in reserve. I recommend the following conditions of approval: • A Professional Engineer, licensed in the State of Washington, shall submit final road and drainage plans, a drainage report and calculations that conform to the April 3, 2001 Edition of the Spokane County Standards for Road and Sewer Construction and the current edition of the Spokane County Guidelines for Stormwater Management and ail other standards and laws that are applicabie to this project if road improvements are required. Final drainage plans and a drainage report shall receive the County Engineer's acceptance prior to release of a construction or building permit or approval of the final plat. • The following drainage language shall appear on the plat: The property owners within this plat shall be held responsible for keeping open and maintaining the surface path of natural or man-made drainage flow over and across their respective properties. If the property owner(s) fails to maintain the surface path of natural or man-made drainage flow, or the drainage swale, a notice of such failure may be given to the property owner(s). If not corrected within the period indicated on said notice, Spokane County has the right to correct the maintenance failure, or have it corrected, at the expense of the property owner. There may exist properties, located uphill and adjacent to this subdivision, which periodically discharge stormwater runoff onto individual lots within this plat. Runoff from nearby uphill properties should be expected, and during snowmelt periods or wet seasons the lots may be subjected to higher amounts of stormwater runoff that what is normally observed or anticipated. 6ecause stormwater runoff from adjacent properties have discharged onto this plat p(or to development, stormwater runoff will likely continue to do so after development. It is the responsibility of the individual lot owners to maintain existing surface paths of runoff through their respective lots and to grade the lots in accordance with applicable rules and regulations, so as to prevent property damage. Any building that is constructed on a lot in this plat shall be set at such an elevation so as #o provide positive drainage away from any drainage entry point to the building (including but not limited to a window well, a window unprotected by a window well, or a doorway).
