LEGAL NOTICE MICHAEL HUFFMAN being first duly sworn on oath deposes and says that he is the EDITOR of the Spokane Valley News Herald, a weekly newspaper. That said newspaper is a legal newspaper and it is now and has been for more than six months prior to the date of publication hereinafter referred to, published in the English language continually as a weekly newspaper in Spokane County, Washington, and it is now and during all of said time was printed in an office maintained at the aforesaid place of publication of said newspaper, which said newspaper had been approved as a legal newspaper by order of the Superior Court of the State of Washington in and for Spokane County. Note: On July 26, 2011 the application was returned to the applicant for modification based on the revised location of the Ordinary High Water Mark (OHWM). of the river located north of the site, and application of the regulations of the City of Spokane Valley Shoreline Master Program to the revised location of the OHWM. Location of Proposal: Parcel No(s). 45044.1530 and 45045.1604, located 400 'feet east of the intersection of Rivercrest Do and Coyote Rock Dr., situated in the SE of Section 4, Township 25 North, Range 44 East, Willamette Meridian, Spokane County, Washington. Approval Criteria: Spokane Valley Munici- pal Code (SVMC) 19.60.010 (Commercial Standards). SVMC Title 20 (Subdivisions), and SVMC Title 21 (Environmental Con - 1 trots), the City of Spokane Valley Street Standards, the Spokane Regional Storm - water Manual, and the Spokane Regional Health District regulations. Hearing Process and Appeals: The Hear - Ing Examinerwill conduct the hearing pursu- ant to the rules of procedure adopted in Idle 18 (Boards and Authorities) of the SVMC. All interested persons may testify at the public hearing and may submit written comments and documents before or at the hearing. The Hearing Examiner may limit the time given to speakers. Any appeal of the Hear- ing Examiner's decision will be based on the record established before the Hearing Examiner, pursuant to Chapter 17.90 (Ap- peals) of the SVMC. All hearings will be conducted in facilities that are accessible to persons with physical disabilities. Environmental Determination: The City issued a Determination of Non -Significance (DNS) on February 4, 2011 pursuant to the State Environmental Policy Act (SEPA) policies and regulations and lige 21 (En- vironmental Controls) of the SVMC. The SEPA threshold determination comment period expired on February 18, 2011. There was no appeal received. Staff Report and Inspection of File: A staff report will be available for inspection seven (7) calendar days before the hearing. The staff report and application file may be inspected at the Community Development Department Permit Center, located at the City of Spokane Valley City Hall, Ste 106, 11707 E Sprague Ave, between 8:00 am and 5:00 pm, Monday -Friday, excluding holidays.
