FINDINGS OF FACT AND CONCLUSI4NS 1. The individual signing below has further been delegated the responsibility for rendering decisions by the Director of Spakane County Division of Building and Planning. 2. The proposal is to divide approximately 1.28 acres into riyo (2) residential tracts, one for an existing duplex residence and one for a proposed duplex residence, in the Urban Residential-3.5 (UR-3.5) zone. 3. The proposal is located west of and adjacent to Felts Road and approximately 730 feet south of Mission Avenue in the N%2 of Section 17, Township 25 N., Range 44 EWM, Spokane Countya Washington. 4. The existing zoning of the property described in the application is Urban Residential-3.5 (UR-3.5), established in 1991. Pursuant to Section 58.17.195 of the Revised Code of Washington (RCW), this proposal conforms to the requirements of the existing Urban Residential-3.5 (UR-3.5) zone. 5. The Spokane County Comprehensive Plan designates this area as Urban. The development and uses, as conditioned, are in accord with the Urban category. The proposal is also compatible with the surcounding uses which are primarily single family and two family residential uses. 6. The Spokane County Arteria! Road Plan identifies Felts Road as a Local Access Street with a future right-of-way width of 60 feet. The existing right-of-way width is 40 feet. The Spokane County Division of Engineering and Roads is not requesting any dedication or future acquisition area (FAA) to be set aside. Therefore, as conditioned, the proposal conforms to the Road Plan. 7. The proposed site is located within the Public Transportation Benefit Area (P'I`BA). The Spokane Transit Authority (STA) Route # 12 provides connecting services to the nnrth of the site along Mission Avenue. 8. The proposed short plat will be served by a public water system. Waste water disposal will be as authorized by the Uirector of Spokane County Division of Utilities. 9. The required pubiic notice and comment period was provided for this proposal. In addition, those ageneies having a potential interest in the proposal were notified and comments solicited. Any billing ainounts due, including any expenses incurrerl in the callection of an overdue account, must be paid prior to the County's acceptance of the project for filing. If a project is approved and/or filed with a balance still owing, the uopaid balance shall be paid wiihin 30 days of the invoice date. 2. Tiie undersignecl agrees tliat tliese fees are due and payable upon receipt oF the billing as speciFed above. 3. Any invoices not paid witliin 30 days of the invoice date will be cocisidered delinquent. If any nutstanding balance on the acCOUnt fnr tltis project is not paid within 30 days of the invoice date, iio further reviews of the project docunients will be conducted until the entire accouot balance is paid. Any balance oa the account for this project not paid within 65 days of the invoice date tnay result in legal action or the initiation of other collection procedures, including referral to a collection agency.
