PLAT SP-1194-98 ) CONCLUSIONS AND
DECISION
THIS MATTER, an application for short subdivision from Robert Peetz has been received and was
decided upon, pursuant to Spokane County Subdivision regulations, on the 16th day of November, 1998.
FINDINGS OF FACT AND CONCLUSI4NS
1. The individual signing below has further been delegated the responsibility for rendering decisions
by the Director of Spakane County Division of Building and Planning.
2. The proposal is to divide approximately 1.28 acres into riyo (2) residential tracts, one for an
existing duplex residence and one for a proposed duplex residence, in the Urban Residential-3.5
(UR-3.5) zone.
3. The proposal is located west of and adjacent to Felts Road and approximately 730 feet south of
Mission Avenue in the N%2 of Section 17, Township 25 N., Range 44 EWM, Spokane Countya
Washington.
4. The existing zoning of the property described in the application is Urban Residential-3.5 (UR-3.5),
established in 1991. Pursuant to Section 58.17.195 of the Revised Code of Washington (RCW),
this proposal conforms to the requirements of the existing Urban Residential-3.5 (UR-3.5) zone.
5. The Spokane County Comprehensive Plan designates this area as Urban. The development and
uses, as conditioned, are in accord with the Urban category. The proposal is also compatible with
the surcounding uses which are primarily single family and two family residential uses.
6. The Spokane County Arteria! Road Plan identifies Felts Road as a Local Access Street with a
future right-of-way width of 60 feet. The existing right-of-way width is 40 feet. The Spokane
County Division of Engineering and Roads is not requesting any dedication or future acquisition
area (FAA) to be set aside. Therefore, as conditioned, the proposal conforms to the Road Plan.
7. The proposed site is located within the Public Transportation Benefit Area (P'I`BA). The Spokane
Transit Authority (STA) Route # 12 provides connecting services to the nnrth of the site along
Mission Avenue.
8. The proposed short plat will be served by a public water system. Waste water disposal will be as
authorized by the Uirector of Spokane County Division of Utilities.
9. The required pubiic notice and comment period was provided for this proposal. In addition, those
ageneies having a potential interest in the proposal were notified and comments solicited. No
written comments were received from any adjoininb property owner regarding this proposal.
10. Recognizing the recommended conditions and Spokane County development standards, the
proposed short plat makes appropriate provisions for the public health, safety and general welfare
and the public use and intetest will be served by platting the subdivision. The subdivision proposal
is generally consistent with RCW 58.17 and the County subdivision regulations, promoting the
public health, safety and general welfare in accordance with standards established by the State and
Spokane County. The County Division of Building and Planning has considered the provision of
adequate public facilities as cited in RCW 58.17.110(2). More specifically:

10. Prior to recording the final short plat, the applicant shall provide four (4) curreot Certificates of
Title to the Division of Building and Planning.
11. The applicant shall contact the County Division of Building and Planning at the earliesi possible
stage in order to be informed of code requirements administered/enforced as authorized by the
State Building Code Act. Design/development concerns include: addressing, fire apparatus access
roads, fire hydrandflow, approved water systems, building accessibility, construction type,
occupancy classification, exiting, exterior wall protection, and energy code regulations.
SPOKANE COUNTY DIViSI4N OF ENGINEERING AND ROADS
1. The conditional approval of the shart plat by the County Engineer is given subject to approval of
the road system as indicated in the Preliminary Plat of Record.
2. No construction tivork is to be performed within the existing or proposed public right-of-wav until
plans have been accepted by the County Engineer and a permit has been issued by the County
Engineer. All work is subject to inspection and approval by the County Engineer.
3. The applicant shall grant applicable border easements adjacent to Spokane County Right of Way
per Spokane County standards.
4. To construct the road improvements stated herein, the applicant may, with the approval of the
County Engineer, join in and be a willing participant in any petition or resolution which purposes
is the formation of a Road Improvement District (RID) for said improvements pursuant to RCW
36.88, as amended. At such time as an RID is created or any Road Improvement Project is
sanctioned by Spokane County, the improvements required (curb, sidewalk, drainage control and
paving to existing pavement) will be at the sole expense of the undersigned ownera their heirs,
grantees and assigns. This provision is applicable to Felts Road.
5. As an alternative method of construciing the road improvement stated herein, the applicant may,
with the approval of the County Engineer, accomplish the road improvements stated herein by
joining and participating in a County Road Project (CPR) to the extent of the required road
improvement. At such time as an R1D is created or any Road Improvement Project is sanctioned
by Spokane County, the improvements required (curb, sidewalk, drainage control and paving to
existing pavement) will be at the sole expense of the undersigned owner, their heirs, grantees and
assigns. This provision is applicable to Felts Road.
6. That the following staiement shall appear within the dedicatory language of the final plat:
That in consideration of Mutual Benefits now or to be hereafter derived, do for themsclves, their
heirs, grantees, assigns and successor(s) in interest hereby request and authorize Spokane County
to include the above described property in a Road Improvement District (RID) and to support the
formatioa of a Road Improvement District for improvement of the road(s) described below by
requesting and authorizing Spokane County to place their name(s) on a petition for the formation
of a Road Improvement Disvict pursuant to RCW 36.88.050, or by requesting and authorizing
Spokane County to cast their batlot in favor of an RJD being formed under the resolution method
pursuant to RGW 36.88.030, and/or by not filing a protest against the formation of a RID being
formed under the alternative resolution method provided for in RCW 36.88.065 and Chapter 35.43

If a RID is proposed for improvement of the road(s) described below, said owner(s) and
successor(s) further agree: (1) that the improvements or construction contemplated within the
proposed RID are feasibie and (2) that the benefits to be derived from the formation of the RID by
the property included therein, together with the amount of any County participation, exceeds the
cost and expense of formation of the RID, and (3) that the property within the proposed RID is
sufficiently developed; provided, themselves, their heirs, grantees, assigns, and successor(s) shall
retain the right, as authorized under RCW 36.88.090, to object to any assessment(s) on the property
as a result of the improvements called for in conjunction with the formation of an RID by either
petition or resolution method under Chapter 36.88 RCW and to appeal to the Superior Court the
decision of the Board of County Commissioners confirming the final assessmen[ roil; provided
further, it is recognized that actual assessments may vary from assessment estimate so long as they
do not exceed a figure equal to the increased true and fair vatue improvement(s) add(s) to the
property.
[t is further acknowledged and agreed that at such time as an RID is created or any County Road
[nlprovement project is authorized by Spokane County, the improvements required shali be at the
sole expense of the owner(s) of property within the RID or served by the improvements without
any monetary participation by Spokane County.
The RID waiver contained in this agreement shall expire after ten (10) years from the date of
execution betow. This provision is applicable to Felts Road.
7. The County Engineer has designated a Local Access Roadway Section for the improvement of
Felts Road which is adjacent to the proposed development. This will require the addition of
approximately 5-7 feet of asphalt along the frontage of the development. The construction of
curbing and sidewalk is also required.
8. The proposed plat shall be improved to the standards set forth in Spokane Gounty Board of
Commissioners Resolution No. 95-0498, as amended, which establishes regulations for roads,
approaches, drainage and fees in new construction.
9. The County Engineer has examined this development proposal and has determined that the impact
of this proposal upon the existing County Road System warrants the dedication of additiona! Right
of Way and the roadway improvemeaLs herein specified.
SPOKANE COUNTY DMSION OF UTILITIES
SEWER SERVICE
1. The dedication shall include the following statement: Each new building shall be double plumbed
with a dry side sewer for connection to future area-wide wastewater collection systems. Note:
Plans acceptable to the Division of Utilities may be required.
2. The dedication sball include the following statemenL The double plumbed dry side sewer shall be
extended to the public right-of-way or as required by the Division of Utilities. To facilitate

sewrer disposal systems may be authorized. This authorization is conditioned in compliance
with all rules and regulations of the Spokane County Health District and is further conditioned
and subject to specific applicatidn approval and issuance of permits by the Health District.

4. Side sewer easement with a width acceptable to the Division of Utilities shall be shown on the
face of the plat as "Sewer and Utilities Easement".
WATER SERVICE
l. Any water service for this project shall be provided in accordance with the Coordinated Water
System Plan for Spokane County, as amended.
SPOKANE REGIONAL HEALTH DISTRICT
1. Sewage disposal method shall be as authorized by the Director of the Spokane County DiWision of
Utilities.
2. Water service shall be conrdinated through the Spokane County Division of Utilities.
3. Water service shall be by an existing public water supply when approved by the Regional Engineer
(Spokane), State Department of Health.
4. Prior to recording the final short plat, the applicant shall demonstrate to the satisfaction of the
Spokane Regional Health District that an adequate and potable water supply is available to each
tract of the plat.
5. Prior to recording the final short plat, the applicant shall present evidence that the plat lies within
the recorded service area of the water system proposed to serve the plat.
6. Prior to filing the final plat, the sponsor sha]1 demonstrate to the satisfaction of the Spokane
Regional Health District that the eYisiing system serving the residence located on tract 2 is wholly
located within the boundaries of the tract. Records indicnted the existing system is encroaching on
tract l.
7. Prior to the filing the final plat, the sponsor shall demonstrate to the satisfaction of the Spokane
Regional Health District that a suitable site for an on-site sewage disposal system is available on
tract 1.
8. The final plat shall be designed as indicated an the pretiminary plat of recnrd and/or any attached
sheets as noted.
9. Appropriate utility easements shall be indicated on copies of the preliminary plat of record for
distribution by the Division of Building and Planning to the utility companies, Spokane County
Engineer, and the Spokane Regional Health District. Written approval of the easements by thc

It is further acknowledged and agreed that at such time as a RTD i5
created or any County Road Improvement projzct is author;zed by Spokane
County, the improvements required. shall be at the sole c-xpense of the
owner(s) of property w?thin the RID or served by the improvements
without any monetary participation by Spokane County.
The RID waiver contained in this agreement shall expire after ten (10)
years from the date of execution below. Thi-s provisicn is applicable
to F'elts Road.
7. The County Engineer has designatea a Loc«1 P.cces5 Rcaaway Slectien for
the improvement of Felts Road which is adjacent tc; the proposed
development. This will require the addition or- approximately 5-7 feet
of asphalt along the frontaaE ot the development. The consr.r:u: tion a;
curbing and sidewalk is also reauired.
8. The praposed plat shall be ?mproved -to the standards set forth in
Spokane County Board of Commissioners Resolutian No. 95-0498, as
amended, which establishes rc-gulations for roads, appraaches, dra-ic:age
and fees in new construction.
9. The County Engineer has examined this deveiopment proposa~ ar►d r=as
determined that the impact of this pragosal upQn trz existing Caunty

That the individuals and parties named tierein as having an interest in the above describecl property or project
agree Eo the following:
1. Reimburse Spokane Cnunty for project review and inspectinn fees as specified in Chapier
9.14 of the Spokane County Code. The fees will be based on actual salary costs incurred
by Spokane County for projeet reviews and / or inspections plus a ten perceat
administrative charge, and will be billed monthly as acceued. Any billing ainounts due,
including any expenses incurrerl in the callection of an overdue account, must be paid
prior to the County's acceptance of the project for filing. If a project is approved and/or
filed with a balance still owing, the uopaid balance shall be paid wiihin 30 days of the
invoice date.
2. Tiie undersignecl agrees tliat tliese fees are due and payable upon receipt oF the billing as
speciFed above.
3. Any invoices not paid witliin 30 days of the invoice date will be cocisidered delinquent.
If any nutstanding balance on the acCOUnt fnr tltis project is not paid within 30 days of
the invoice date, iio further reviews of the project docunients will be conducted until the
entire accouot balance is paid. Any balance oa the account for this project not paid
within 65 days of the invoice date tnay result in legal action or the initiation of other
collection procedures, including referral to a collection agency. The Sponsor will be
liable for any and all expenses incurred by the Caunry for the collection of overdue
accounts.
