When our firm submitted and had accepted the street and storm drainage plans for Riverwalk
9"AddiUon (P1414-H) in March, '1998, the plans included an area labeled Tract "D", with
frontage on Riverway Lane. The original designation for the tract on the preliminary plat was
.RV 'storage -for the overall Riverwalk plat. Since the Riverwalk preliminary plat has been
divided among a number of sponsors and subsequeni'Hameowners' Associations, the owner of
the Riverwalk 91 plat has requested that the Tract "D" area be short platted to gain an
additional lot (Lot 1, Block 1).
In recent conversation_ with you, 'I had indicated that a portion of impervious parking area
within 'Tract "D" had been -incorporated into the "208" andAesign storm calculations. I have
enclosed Page 3, of the Riverwalk 91 drainage report, which summarizes the basin total and
impervious..areas. The impervious area shown on Table. 1, Page 3 lists 11,277 square feetof
impervious area to be treated. The 'street area is -approximately 8000 square feet, with the
remaining 3277 square,feet was assumed to be a paved area within the RV storage area. With
the proposed,short plat finalization, the residential lot is not included in "208" treatment. The
Therefore, the "208" aad design storm calculations included in the Itiverwalk 9"drainage
report are adequate for the chaage 'in'.use for Tract "D".

Within each basin the streets are divided into sub-basins by high and low roadway profiles.
These facilities capture upstreain stormwatcr runoff from the impervious street surface and direct
the runoff into grassy `208' ponds. As shown on the '208' calculation worksheets included, the
'208' storage volume provided is adequate to perform '208' treatment for the runoff created by the
first half inch of rainfall.
Curb inlets and Catch Basin Calculatioas
It is necessary to check the adequacy of the curb inlets, inlets or catch basins provided to divert
tbe runoff from the gutter into the '208' poads. Should these be required, the curb inlet
calculation sheets included show the required lengths of curb openings, as well as the adequacy
of the inlet grates or cafich basin grates. For curb inlets greater than 4.0', either multiple curb
inlets are added or the curb inlets are lengthened as required.

Calculations have been included for Drainage Basin corisiderations such as Peak Flow, Time of
Goncentration, "208" sizing, dryweU requirements, inlet sizing and curb inlets, as well as culverts

Dear Susan,
As a summary to our phone cAnversations regarding this short plat, I'd like to list the
items the County Engineers will require for the drainage portion of the process:
1. An easement to drain into Tract A of Riverwalk 9`hmust be secured by this plat.
2. This lot needs to be a member of the Riverwalk 9`h Homeowners Association, due to
the benefits gained by the iot draining into Tract A. Drainage language demonstrating
its inclusion in the homeAwners association will need to be shown on the plat.
Because of the excess storage aiready provided by the Pond A, drainage calculations will
not be required far the short plat loto

HOMEOWNERS ASSOCIATION
THiS MATTER, an application for subdivision of land from Riverwalk 9' Homeowners Association
has been received and was decided upon, pursuant to the Spokane County Subdivision Ordinance,
on the 1g` day of December, 1998.
FINDINGS OF FACT AND CONCLUSIONS
1. The individual signing below has further been properly delegated the responsibility for rendering
this decision by the Director of Spokane County Divrsron of Building and Planning.
2. The proposal is to divide approximately 29,000 square feet into finro (2) lots. One of the proposed
lots, Tract "A" is approximately 5,600 square feet in size and the other proposed lot, Tract "BQ is
approximately 23,700 square feet in size. Tract uA" is proposed as a common area lot and Tract
"6' is proposed for residential use.
3. The proposal is located approximately 204 feet east of Barker Road and south of and adjacent to
Rivervvay Lane (a private road) in the SW %d of Section 8, Township 25 North, Range 45 East
W.M., Spokane County, Washington.
4. The existing zoning of the property is Urban Residential-7 (UR-7). The applicant has requested
approval of the short plat for the purpose of developing a single family residence and common
open space lot which are pemnitted uses in the UR-7 zone. Pursuant to Revised Code of
Washington (RC111) 58.17.195, this propasal conforms to the requirements of the existing UR-7
zone.
5. The Spokane County Comprehensive Plan designates this area as Urban. The Urban category is
intended to provide for the development of single family, two family and multi-family residential
development with densities ranging from 1 to 17 units per acre. The development and uses, as
proposed and conditioned, are consistent with the purpose and intent of the Urban category.
6. The proposal is located inside the Interim Urban Growth Area (IUGA) boundary adopted by the
Spokane Board of County Commissioners on April 11, 1997.
7. The subject property is cuRently designated as a drainage pond as part of the subdivision of
Riverwalk 90 Addition, per plat recorded in Book 25 of Plats, Page 40 and 41. The surrounding
area is primarily urban in nature and developed with single family residences on urban sized lots.
The Spokane River is also located north of the proposal. The proposal is generally compatible with
the surrounding land uses.
8. The project is loca#ed adjacent to Riverway Lane which is a private road owned and maintained by
a pnvate homeowners association. Provisions for roadway improvements are contained in the
conditions of approval submitted by the Spokane County Division of Engineering and Roads.
9. The property is located inside the Public Transportation Benefit Area (PTBA).
10. The proposed short plat will be served by public water. Waste water disposal will be handled by a
public sewer system.
11. The required public notice was provided for this proposal and agencies having a potential interest
in the project were notifred and recommendations solicited.
12. A notice of applica#ion which included a 14-day public comment penad was mailed to adjacent
property owners an November 4, 1998. No pubfEC comments were received iR respanse to the
notice of application.
13. Recognizing the recammended canditians of approval and Spokane County development
s#andards, the propased shar# plat makes appropriate provisians for the public hea1#h, safety and
general welfare and the public use and interest will be served by apprauing the short plat.
The short pfat propvsal is generally consistent with RCV11 58.17 and the Spokane Caunty
subdivision regulations, promo#ing the publFC health, safety and general welfare in accordance vtirith
standards estab}ished by #he State and Spokane Coun#y, The Division of Building and P[anning
has c.onsidered the provision of adequate public facilities as cited {n RC1N 58.17.110 (2). More
specifically:

14. An Environmental Impact S#atement (ElS) was prepared and completed for the deveIopmen# of
Riverway Villa of which the subject property is a part. The EIS addressed a propvsed developmen#
of 118 acres for a3f5 unit manufactured hame subdivisian. The EIS adequately identified and
mitigated po#ential adverse impacts fram development of the subject praperty. The ElS was
adopted for fhis proposai oR Navember 23, 1998.
DECISIOId
Based upon the abave Findings of Fact and Conclusians, Shar# Plat Application SP-1197-98 is
hereby APPROVED for five (5) years, specifically to December 1, 2003 and subject ta cQnditions
no#ed below. This decision is final unless appealed in wri#ing, cansistent wi#h adopted appeal
procedures.
COMDITIONS OF APPRaVAL
All the below conditions impased shall be binding an the "Applicant,n which term shall include the
awner or owners of the prapertyt heirs, assigns and successars.

1 . The proposal shall comply wi#h the Urban Residential-7 (UR-7) zone and other applicable Zoning
Code chapters, as amended. The final short plat shall compfy wi#h the Spokane County
Subdivision Orclinance.
The final shvrt plat shall be designed substantially in conformance wi#h #he preliminary plat of
record.
3. The preliminary short plat is given conditional appraval far five (5) years, speciTrcally to December
i, 2003. The applicant may submit an extensian of time applicatign thirty (30) days prior to the
above expiratian date_ Application(s) far extensioR of #ime shalJ be pracessed under the prflvisians
of Chapter 12.100.118 (Ex#ension of Time) of the Spokane County Subdivisian Ordinance.
4. Prior to fiIing the final short plat, #he appficant shall submit to the CauRty Divisian of Building and

these Findings and Condifions of Approval.
5. A survey is required of the subject property prior #o filing the final shQrt plat.

7. Appropriate utility easements shall be indicated on the final short plat map. Approval of utility
easements by utility companies must be received prior to filing the final short plat.
8. The dedication shall contain the following statement:
"Setbacks shall be determined at the time building permits are requested unless setbacks are
specifically drafted on this final short plat. The setbacks indicated on this subdivision may be
varied from if proper zoning or variance approvals are obtained."
9. The dedication shall contain the following statement:
"Tract °A" is a common open space lot only. Development of said tract may not occur without
review and approval of the standards of the underlying zone by Spokane County Division of
Building and Planning.'
10. The dedication shall contain the following statement:
"This short plat and its conditions of approval supersede the requirements and conditions of the
final plat of Riverwalk 9"' Addition, per plat recorded in Book 25 of Plats, Page 40 and 41, as they
relate to the property located within the boundaries of this short plat.°
11. Four (4) current Certificates of Title shall be fumished to the County Division of Building and
Planning prior to filing the final short plat.
12. The Spokane County Division of Building and Planning shall prepare and record with the Spokane
County Auditor a'Title Notice" noting that the property in question is subject to a variety of special
conditions imposed as a resutt of apQroval of a land use action. This "Title Notice" shall serve as
official public notice regarding conditions of approval affecting the property in question. The "Title
Notice" shall be recorded within fifteen (15) days of final disposiUon of the approved land use action
and shall only be extinguished by the Spokane County Division of Building and Planning. The "Title
Notice" shall generally provide as follows:
The parcel of propecty legally described as (lega/ description and tax parce/ number) is the
subject of a land use action, imposing a variety of special development conddions, by a Spokane
County Hearing Body or Administrative Official on (date) and as maybe amended, altered or
supplemented by official action or as already changed. File No. SP-1197-98 is available for
inspection and copying in the Spokane County Division of Building and Planning.
SPOKANE COUNTY DIVISION OF ENGINEERING AND ROADS
1. Conditional approval of the plat by the County Engineer is given subject to approval of the road system
as indicated in the preliminary plat of record.
2. Drainage plans and design calculations showing the alignment of drainage facilities be submitted to the
County Engineer for acceptance prior to construcfion andlor the filing of the final plat. Drainage plans to
be prepared under the direction of a licensed Professional Civil Engineer.
3. All construction within the existing or proposed Public right-of-way is to be completed prior to filing the
final plat or a bond in the amount estimated by the County Engineer to cover the cost of construction of
improvements. Construction certification, "Record Drawings" and monumentation of the street
centerlines shall be filed with the County Engineer.
4. All vested owners shall sign and record private road documents as prescribed by the Spokane County
Engineer. These documents shall be reviewed and approved by the Spokane County Engineer prior to
recording with the Spokane County Auditor. Recording numbers shall be referenced in the dedicatory
language of the plat.
5. The following statement(s) shall be placed in the dedicatory language of the final plat:

• WARNING: Spokane County has no responsibility to build, improve, maintain or otherwise service the
private roads contained within or providing service to the property described in this plat. By accepting
this plat or subsequently by allowing a bwlding permit to be issued on property on a pnvate road,
Spokane County assumes no obligation for said pnvate road and the owners hereby acknowledge that
the County has no obligation of any kind or nature whatsoever to estabfish, examine, survey, construct,
alter, repair, improve, maintain, provide drainage or snow removal on a private road. This requirement is
and shall run with the land and shall be binding upon the owner, their heirs, successors or assigns
including the obligation to participate in the maintenance of the private road as provided herein.
6. The proposed plat shall be improved to the standards set forth in Spokane County Board of
Commissioners Resolution No. 95-0498, as amended, which establishes regutations for roads,
approaches, drainage and fees in new construction.
SPOKANE COUNTY DIVISION OF UTILITIES
1. The dedication shall state: Public sewers shall be constructed to provide for the connection of each
parcel to the County's system of sewerage. Uses on properties within the project shall be required
to connect to the sewer and pay applicable charges per the County Sewer Ordinance. Sewer
connection permits shall be required.
2. The dedication shall state: A public sewer system will be made available for the plat, and individual
services will be provided to each lot prior to sale. Use of individual on-site sewage disposal
systems shall not be authorized.
3. The dedication shall state: Individual tracts shall be subject to payment of current applicable sewer
connection charges and/or general facilities charges prior to the issuance of a sewer connection
permit.
4. Any water service for this project shall be provided in accordance with the Coordinated Water
System Plan for Spokane County, as amended.
SPOKANE REGIONAL HEALTH DISTRICT
1. The final plat shall be designed as indicated on the preliminary plat of record and/or any attached
sheets as noted.
2. Appropriate utility easements shall be indicated on copies of the preliminary plat of record for
distribution by the Building and Planning Division to the utility companies, Spokane County
Engineer and the Spokane Regional Health District. Written approval of the easements by the
utility companies must be received prior to the submittal of the final plat.
3. Sewage disposal method shall be as authorized by the Director of Utilities, Spokane County.
4. Water service shall be coordinated through the Director of Utilities, Spokane County.
5. Water service shall be by an existing public water supply when approved by the Regional Engineer
(Spokane), State Department of Health.
6. Prior to filing the final plat, the sponsor shall demonstrate to the satisfaction of the Spokane
Regional Health District that an adequate and potable water supply is available to each tract of the
plat.
7. Prior to filing the final plat, the sponsor shall present evidence that the plat lies within the recorded
service area of the water system proposed to serve the plat.
8. A public sewer system will be made available for the plat and individual service will be provided to
each tract prior to sale. Use of individual on-site sewage disposal systems shall not be authorized.
9. A statement shall be placed in the dedication to the effect that: "A public sewer system will be
made available for the plat and individual service will be provided ta each tract prior to sale. Use of

11. The final plat dedication shall contain the following statement: "The public water system, pursuant

County Building and Safety Department and water purveyor, shall be installed within this
subdivision and the applicant shall provide for individual domestic water service as well as fire
protection to each tract prior to sale of each tract and prior to issuance of a building permit for each
tract."
SPOKANE COUNTY AIR POLLUTION CONTROL AUTHORITY
1. The proposal shall comply with the conditions of the Spokane Caunty Air Pollution Control Authority
dated November 4, 1998 within the Spokane County Division of Building and Planning file, which
are incorporated herein by reference.
