The following "Conditions af Approval" are subrrtitted to the Spokane Caunty Planning Departmer:t for inclusion in the "Fi-ndings of Fact, Canclusions and Order/Decisior_" should the request be approved. 1. Conditional approval af the plat by the County Enginzer is given subject to approval of the road system as andicated in the preliminary plat of record. 2. A Professional Engineer, licensed in the State of Washington, shall submit final road and drainage plans, a drainage report and calculations that conform to all standards and laws governing stormwater management in Spokane County. Final drainage plans and a drainage report shall receive the County Engineer's acceptance prior to release of a construction or building permit or approval of the land action. Following plan acceptance by the Spokane County Engineer, drainage language will be drafted by Spakane County and provided to the Sponsor's Engineer or Surveyor for inclusion with the final plat document. 3. Construction within all proposed private roads shall be gErfarmed under the direct supervision of a licensEd engineer/surveyor, wnQ shail furnish the County Engineer with "Record prawings" and certificdtion which states the following, "I have reviewed the construction and to my knowledge find it to be in substantial conformance w*ith approved certified plans and Standard Specificatians except as noted." No construczion work is to be performed within the 2xisting or proposed Public right-of-Way until plans have been accepted by the County Engineer and a permit has been issued by the County EnginEer. All wcrk is subject to inspection and approval by the County Engineer. 5. Approach Permits are required for any access to the Spokane County road system. 6. The applicant shall grant applicable border easements adjacent to Spokane County Right af Way per Spokane County Standards. 7. The following statement(s) shall be placed in the dedicatory languaqe of the final plat: • "No direct access snall be allowed from lots to Evergreen Road." • WARNING: Spokane County has no responsibility to build, improve, maintai-n or otherwise service the private roads contained within or providing service to the property described in this plat. By accepting this plat or subsequently by allowing a building permit to be issued on property on a private road, Spokane County assumes no obligation for said private road and the owners hereby acknowledge that the County has no obliqation of any kind or nature whatsoever to establish, examine, survey, construct, alter, repair, improve, maintain, provide drainage or snow removal on a privatP road. This requirement is and shall run with the land and shall be binding upon the owner, their heirs, successors or assigns including the obligation to participate in the maintenance of the private road as provided herein. 8. That all public rflads within the plat be designed and constructpd to Spokane County standards. 9. To construct the road improvements stated herein, the applicant may, with the approval of the County Engineer, join in and be a willing part?cipant in any petition or resolution which purposes is the formation of a Road Improvzment District (RID) for said improvements pursuant to RCW 36.88, as amendEd. At such time as an RID is created or any Road Improvement Froject is sanctioned by Spokane County, the inprovements required (curb, sidewalk, drainage control and Daving to existing pavement) will be at the sole expense of the undersigned owner, their heirs, grantees and ass?gns. 'Page ~ 02/12/99 I2C2 It is further acknowledged and agreed that at such time as a RID is created or any County Road Improvement project is authorized by Spakane County, the improvements required shall be at the sole expense of the owner(s) of property within the RID or served by the improvements without any monetary participation by Spakane Caunty. The RID waiver contained in this agreement shall expire after ten (10) years from the date of execution below. This provisior. .is applicable to Evergreen Road. 12. The County Engineer has designated a 3 Lane Minor Arterial Roadway Section ior the improvement of Evergreen Road which is adjacent to the proposed development. This will require the additian of approximatzly 13.5-15.5 feet of asphalt alang the f rontage of the development. The Gonstructian of curbing and sidewalk is also required. 13. The private road shall be improved to adopted Spokane County Road and Sewer Standards for private roads. 14. All vested owners shall sign and record private road documents as prescribed by the Spokane County Engineer. These documents shall be reviewed and approved by the Spokane County Engineer prior to recording with the Spakane County Auditar. Recording numbers shall be referenced in the dedicatory language of the plat. 15. The proposed plat sha11 be improved to the standards set forth in Spokane County Board of Comm?ssioners Resolution No. 95-0498, as amended, which establishes regulations for roads, approaches, drainage and fees in new construction. 16. The County Engineer has examined this development proposal and has determined that the impact of this proposal upon the existinq County Road System warrants the roadway improvements herein specified. 17. The County Arterial Road plan identifies Evergreen Road as a 100 foot Princapal Arterial. The existing right of way width of 34 feet, measured from centerline, is not ce??sistent with that specified in the Plan. In order to implement the Arterial Road Pian ?t is recommended that in additicn to the required riqht of way dedication, a strip of property 16 ieet in width along the EvPrgreen Road frontage be set , aside in reserve. This property may be acquired by Spokane County at I the time when Arterial Improvements are made to Evergreen Road. 'Page 5 03/I2/99 1202 19. The applicant should be advised that there may exist utilities either underground or overhead affecting thE applicants property, including property to be dedicated or set aside future acquisition. Spokane County will assume no financial obligatian for adjustments ar relocation regarding these utilities. The applicant should check with thz applicable utilities and Spokane Couraty Er.gineer to determine c,ahether the applicant or utility is responsible for adjus±ment or relocation costs and to make arrangements for any necessary work.
