DETERMINATION: The City of Spokane Valley adopted Ordinance No. 48, effective March 31, 2003, that
implemented on an interim basis the Spokane Environmental Ordinance, effective November 19, 2002 and its provisions.
The lead agency has determined that this proposal does not have a probable significant adverse impact on the
environment, if mitigated as stipulated below. An Environmental Impact Statement (EIS) is not required under RCW
43.21C.030(2)(c). This decision was made after review of a completed environmental checklist and other information on
file with the lead agency. This information is available to the public on request.
This MDNS is issued pursuant to WAC 197-11-340(2); the lead agency will not act on this proposal for fourteen (14)
calendar days from the date issued(below). Comments must be received by this department no later than 5:00 p.m.,

1. Upon any discovery of potential or known archaeological resources at the subject properties prior to or during
future on-site construction, the developer, contractor, and/or any other parties involved in construction shall
immediately cease all on-site construction, shall act to protect the potential or known historical and cultural
resources area from outside intrusion, and shall notify, within a maximum period of twentyfour hours from the time
of discovery, the City of Spokane Valley Community Development Department of said discovery.
2. A Temporary Erosion and Sedimentations Control (TESC)plan, prepared by a Washington State licensed
Professional Engineer, shall be prepared and submitted with the site construction plans. The TESC plan is

to follow 1998 Spokane County Guidelines for Stormwater Management. The TESC structures (such as silt
ponds, silt traps) are to be installed prior to the start of site work; and the TESC measures are to be
implemented and maintained throughout the duration of construction and until the site has stabilized.
3. A Professional Engineer, licensed in the State of Washington, shall submit final street and drainage plans and a
drainage report including calculations that conform to the 2001 Edition of the Spokane County Standards for Road
and Sewer Construction (or as amended), the 1998 Spokane County Guidelines for Stormwater Management (or as
amended), and all other applicable standards.
4. Traffic concurrency will be reviewed at the time of commercial building permit application.
APPEAL: An appeal of this determination must be submitted to the Community Development Department within
fourteen(14)calendar days after the date issued. This appeal must be written and make specific factual objections to the
City's threshold determination. Appeals shall be conducted in conformance with Section 11.10.170 (Appeals) of the
City's Environmental Ordinance, and the $1,000.00 dollar fee pursuant to the City's adopted Fee Schedule shall be paid
at time of appeal submittal. Pursuant to Section 11.10.170.3 of the City's Interim Environmental Ordinance, appeals
shall be limited to a review of a fmal threshold determination.

punishable under chapter 9A.20 RCW, without having obtained a written permit from the
Director of the Washington State Office of Archaeology and Historic Preservation for such

1. The site is located approximately 180 feet west of University Street and a mile south of Sprague

the applicant is advised of the following requirements as mitigation measures: (1) Temporary
Erosion and Sedimentations Control(TESC)plan,prepared by a Washington State licensed
