received and was ciecided upan, nur5uant to Spakane Caunty Subdivisioa regulations. on the 1 Gth day of
March 1999.
FINDINGS OF FACT AND CONCLUSIONS
1. The individual signing below has further been properlw delegated the rzsponsibility for rznderine
the decision by the Director of Spokane County Division of Buildiiig and Planning.
2. The proposal is to divide apprpximately 1.33 acres into 4 tracts for one existing single family
residence and three new additional residential tracts.
3. The proposal is located west of and adjacent to Dick Road and approximately 140 feet south af
Alki Avenue, in the SW'/a of Section 18, Township 25 North, Range 44 F.W.M., Spokane County.

4. The existing zpning of the property described in the application is Urban Residential-3.5 (tJR-3.5),
whieh was established in 199 1. I'ursuant to Section -i8.17.195 of the Revised Code of Washington
(RGVI), this proposal confurms to the requircments ofthe existing UR-3.5 zone.
5. The Spvkane Caunry Comprchensive Plan desienates this area as Urban. The developmeat and
uses, as proposed and conditioned are in accord wiih the tlrban Category. This proposal is also
compatible with the surrounding uses, which are primarily single family residences.
6. The Spokane County Arterial Road Plan icientities Dick Road as a Local Access Road with a fiiture
righi-of-way width of 60 Feet. Tlie existing right-of-way width is 40 feet. In order to implement
the Arterial Road Plan, a I 0-foot wide strip of the subject property alonQ the frontage of Dick Raad
is to be set aside as a Future Acquisition Area. Therefore, as conditioned, the praposal confornis ta
the Road Plan.
7. The proposed site is loeated within the Public Transportation Benefit Area (PTBA). The Spokane
Transit Autharitv (S'I'A) Raute 90 (Spra~ue) provides connecting services to tlle site.
8. The proposed short plat will be served by a public water system. Waste water disposaJ will be as
authorized by the Uirector of Spokane Cauntv Division of Utilities.
9. The required public notice and comment period was provided far this propasal. ln addition those
at-tencies havinty a potentiai interest in the proposal were notified and comments solicited. Na
written eommentS were received fcnm any adjoining property owncr(s) regarding this proposal.
10. Reconnizing tlle recommended conditions and Spokane County development standards, the
proposed shnri plat makes appropriate prnvisions for the public health, safety and aeneral welfare
and that the pubtic use and interest will be served by platting the subdivision. The subdivisian
propasal is generally consistent with RCW 58.17 and the Count}' subdivision rzgulations,
prumotino the public health, safetv and general welfare in accordance with standards established
by the State and Spokane C'ounty. The Cuunty Division of Building and Planning has considered
the provision ot adequate public facilities as cited in IZCW 58.17.110(2). More specifically:

DECISIAN
Baseci upon the above-noted Findinas of Fact and Conclusions, Short Plat Application SP-1205-99 is
hereby APPRQVED for five (5) vears, specitically to April 1, 2004, and subject to conditions noted
below. This decision is tinal unless appealed in writing, consistent with adopted appeal procedures.
CUNDITIONS OF APPR0VAL
Ali the below conditians imposed shall be bindino on the "Applicant," which term shall include the
owner or awners of'tlie prapcrty, heirs, assigns and successors.

1. The propasal shall comply with the Urban Residential-3.5 (UR-3.5) zonc and other applicable
Zoning Code chapters, as amended.
The final short plat shall be designed substantially in conformance with tlie preliminar%• plat of
record. No increase of density or number of tracts shall occur without a change of canditinn
application submittal and approval.
3. The preliminary short plat is given conditional approval for five (5) years, specitically ta April 1,
2004. The applicant mkv submit an et-tension af time application at least tliirty (30) days prior to
the above expiration date. Application(s) for extension of time shall be processcd under the
prnvisions of Chapter 12.100.11 8 (Extension of "time) of the Spokaae County Subdivision
Ordinance. If the applicant complies with the criteria of Chapter 12.100.118, the preliminary
apprnval and conditions will be changecl ta reilecr the adopted palic:y and develapment regulaticros
at the time of the eatension applicatian.
4. Prior to recording the final short plat, the applicant shall submit 1o the Cnunty Divisian caf Building

5. A survey is required of the subject property prior ta recarding the final short plat.
6. Appropriate road name(s) and street address for each tract shall be indicated on the final short plat
map.
7. Appropriate utility easemenis shaU be indicated on the final shurt plat map. Written approval of
utility easements by utility companies must be received prior to recording the final short plat.
8. The final short plat map shall indicate by a dashed linc the required seibacl:s from aIl private or
public roads.

10. Prior to recnrding the final shnrt plat, the applicant shall provide four (4) current Certificates of
Tiile to the Division of Building and Planning.
11. Tlle applicant shall contact the County Division uF Building and Planning at the earliest possible ~
stage in order to be informed of cade requirements administered/enforced as autharizec] by the
State Building Code Acl. Desion/development concerns include: addressing, fire apparatus access
roads, fire hydranUflnw, approved water systems, building accessibility, construction type,

I?. The Spokane County Division of Building and Planning shall prepare and record with the County
Eluditor a TitJe Notice specifyinc, a future land aCquisition area far ruad right-of-Nvay and utilitics.
The Title Notice shall state the following:
a. A strip of property 10 feet in width from the existing riaht-ol=wav is reserved for fiiture
acquisition area far additional road right-ot=way width along Dick Road.
b. Ftature building and other setbacks required by the Spokane County Zoning Code shall be
measured fcom the reserved future acquisition area.
c. No required landscaping, parking, '208' areas, drainfeld or allowed signs shoulcl be Iocated
within the future acquisition area for road right-of-way and utilities. If any of the abave
improvements are made within this area_ they shall be relocated at the applicant's expense
when roadway improvements are made.
d. The future acquisition area, until acquired, shall be private pruperty and mkv be used as
allowed in the zone, except that any improvements (such as landscaping, parkingx surface
drainage, drainfield, signs or athers) shall be considered interim uses.
e. The property owner sha11 be responsible for relocating such "interim" improvements at the
time Spakane County mal:es roadway improvements after acquiring said future acquisition
area.

not filing a protest against the farmation of an RID being formed under the alternative
resolution method provided for in RCW 36.88.065 and Chapter 35.43 RCW.
"If an RID is proposed for imprcavement of the road(s) described below, said awner(s) and
successor(s)further agree: (1) that the improvements or cunstniction cojitemp(ated within
the proposed RID are feasible and (2) that the benefits to be derived from the formation of
the RID bv tlle propertv included therein, together with the arnount of any Ccaunty
participatinn, exceeds the Cost and eYpense of formation of the RID, and (3) that the
property within the proposed R1D is sufficiently deti►eloped: provided, themselves, tlieir

is recognized that actual assessments may vary from assessment estimate so lang as they

Dick Street which is adjacent to the proposed development. This will require the addition of
approximatelv 7-9 feet of asphalt along the frontape of the devclopment. The CcrostructiUn of
curbing and sidcwalk is also required.
10. The proposed driveway easement as shown shall sense only Lots "B". '.C" and "D." Use of the
drivewav easement by Lot '°A" wil1 require acccptanCe: 6f road and drainaQe plans and otlier
documentation as prescribed by Ihe C'nuntv Engineer.

of this propasal upon the existing County Road System warrants the raadway improvements herein
specified
SPOKANE COUNTY DIVISION OF UTILIfiIES
1. fhe finat short plat dedication shall contain the following statement: "Public seNvers shali `be
constructed to provide far the connection of each parcel to the County's system af sewerage. Uses
on properties within the project shall be required to connect to the sewer and pay applicable
charges per the Countv Sewer Ordinance. Sewer connection permits shall be required."
The final short plat dedication shall cantain the following statement: "A public sewer system will
be made available to the short plat, and individual services will be pravided ta eaeh tract priUr to
sale. Use of individuai on-site disposal systems shall not be authoriZed."
3. The final short plat cledication shall contain the following statement: "lndividual tracts shall be
subject to payment of current applicable sewer connection charges and/or general facilities charges
prior ta the issuance of a sewer connection perm it."
4. The applicant shall submit expressly to the Division of Utilities, "under separate cover," only those
plan sheets showing sewer plans and specification5 for the public sewer conncctions and facilities
for review and approval. Commercial developments shall submit historical and or estimated water
usage as part of the sewer plan submittal.
5. Sewer plans acceptable to the Division of Utilities shall be submitted prior ta the recording of the
final short plat.

SPOKANE REGIONAL HEALTH DISTRICT
1. Sewage disposal method shall be as autharized by the Director of the Spokane Count} Division of
Utilities.
2. Water service shall be coordinateci throu~h the Spokane County Di~+isian of Utilities.
3. Water service shall be by an existing public Lvater supply when approved by the Regional Enp-ineer
(Spokane), State Department of Health.
4. ['rior to recording the fnal short ptata the applicant shall demonstrate to the satisfaction a!' the
Spokane Re,iunal Healtli District that an adequate and potable ~vater supply is available ta each
tract of the plat.
S. Prior to recording the fina) short plat, the applicant shall present evidence that the plat lies within
the recorded service area of the water system proposed to serve the plat.
6. A plan far water facilities adequate for domestic use, domestic irrigation use and tire prolection
use shall be approved by the water purvcyor. Said water plan must have becn approved by the fire
protection district and the appropriate heatth authorities. The health authorities, water supplier
(purveyor) and the fire protection district wi11 certify, prior to recording the final sliort plai, on the
face of said water plan t1lat the plan is in conformance with their requirements and will adequatelv
satisY~ their respective neecls. Said water plan and certification will be drafted on a transparency
suitable for reproduction.
7. The purveyor will alsn certify prior to recording the final short plat on a copy of said water plan
that appropriate contractual arrangements have been made with the plat applicant for construction

of the water system, in accordance with the approved plan and time schedule. The iime schedule
will provide, in any case, for completion of the water sysiem and inspection by the appropriate
health authorities prior to application for building permits within the piat. The contractual
arrangements will include a pravision holding Spokane Caunty, Spokane Regional Health District
and the purveyor harmless fram claims by any tract purchaser refused a building permit due'to
failure of the plat applicant to satisfactorily comptete the approved water system. ,

The Spokane County Engineering Department has reviewed the above referenced
application. The following "Ccnditions of Approval" are submitted to the
Spokane County Planning Department for inclusion in the "Findings of F'act,
