DECISI4N
THIS MA1"TER, an application for short subdivision from Saundra K. Barker has been received and
was decided upon, pursuant to Spokane County Subdivision regulatinns, on the 26t1i day of N[arch, 1999.
FINDINGS OF FAC'I' AND CONCLUSIONS
1. The individua) signing below has further been delegated the responsibiliry far r-endering clecisions
by the Uirector of Spokane County Division of Building and Plannin,.
2. The proposal is to divide approximately 13,260 square feet into ? lots for the diWision of an
existing duplex pursuant to Chapter 14.818 of the Spokane County Zoning Code.
Tlie proposal is generally located north of and adjacent to 28th Avenue and approximately 300 feet
east of Bowdish Road in the SW of Seciion 28, Township 25 N., Range 44 EWNI. Spokane
County, Washington.
4. The existing zoning of the property described in the application is Urban Residential-3.5 (UR-3.5),
established in 1991, and previously classified as Agricultural Suburban (AS) in 1958. The existing
duplex on the site was constructed in 1984 in conformance with the development standards of the
Agricultural Suburban (AS) zone. The property consists of lots 17 and 18, Block 40 of Kokumo
Tow-nsite. The existing duplex straddles the individual lots, and the purpose of the requested
dupleac division is to allow separate ownership's for the legally esiablished duplex. This site is
13,160 square feet in size And is less than the 20,000 square foot minimurn lat size of the Urban
Residential-3.5 (UR-3.5) zone. However, the duplex and the exisiina lots were legally established
in conformance with the devclopment standards in place at the rzspective times.
5. The Spokane County Comprehensive P}m1 designates this arca as Urban. 7`Ize development and
uses, as conditioned, are in accord with the Urban category. The proposal is also compatible with
tlte surrounding uses which are primarily single family and rivo familv residential uses.
6. The Spokane County Arterial Road Plan identifies 23th Avenue as a Local Access Street with an
existing right-of-way width of 70 feet. The Spokane County Di vision of Engineerincr and Roads is
not requesting any dc:diCation or future acquisition area (FAA) to be set aside. The proposal is
consistent with the Arierial Road Plan.
7. The proposal is located within the Public Transportation Beneft Area (P`I`I3A). The Spukane
Transit Autharity (STA) Raute #22 provides conneciing services to the south of the site alon¢ 32nd `
Avenue.

8. The propased divided duplex will be served by a public water system and a public sewer sysiem.
9. The required public notice and comment period was provided far this proposal. ln addition, those
acrencies having a potentia) interest in the proposal were notified and comments solicited. No
written comments were received.
10. Recognizin~ the recommended conditions and Spokaoe County development standards. the
proposed cJivided duplex makes appropriate provisions for the public health, safen• and general
welfare and the public use and interest will be served bv platting the subdivision. The subdivision
proposal is eenerally consistent with RCW 58.17 and the County subdivision rcgulatiuns.

the provision ofadequate public facilities as cited in RCW 58.17.1 10(2). More specifically:

d. transit i. schools and school grounds
e. potable water j. sidEwalks
1 l. Pursuant to the Washington State Administrative Code (WAC) 197-110-800 (6) (a), this proposed
divided duptex is exempt frum the State Environmental Policy Act (SEPA) environmental review.
DFCISIAN
Based unon the above-noted Findings of Fact and Conclusions, Short Plat Application SP-1208-99 for a
Dup1eY Division is hereby APPROVED for five (5) years, specifically to April 1, 2004 and subject to
conditions noted below. This dzcision is final unless appealed in writing, consistent with adopted appeal
procedures.
CONDITIUNS OF APPRUVAI.
All the below conditions imposed shall be binding on the "Applicant," which term shall include the
owner or owners of the property, heirs, assigns and successors.
SPOKANE COUNTY DIVISIUN OF BUILAING ANA PL4NNING
l. The proposal shall comply with the Urban Residential-3.5 (UR-3.5) zone, Chapter 14.818 of the
Spokane County Zonins Code, and atl otlier applicable "Loning Code chapters, as amended.
The final short plat shal) be designed substantially in conformance with the preliminary plat of
record. No increase of density or number of tracts shall occur withuut a change of conditions
applicatiun submittal and approval.
3. The preliminary sliart plat is given conditional approval for five (5) years; specifically to April l,
2004. The applicant may submit an e:ctension of time application at least thirty (30) days prior to
the above expiration date. Application(s) for extension of time shall be processed under the
provisions of Chapter 12.100.118 (Extension of Time) of the Spol.ane County Subdivision
Ordinance. If the applicant complies with the criteria of Chapter 12.100.118, the preliminary
appror•al and conditions will he changcd to reflect the adapted palicy and development regulations
at the time of the extension application.
4. Prior to recording the final shoR plat, the applicant shall submit to the County Division of E3uilding
and Planning Director/designee for review ot any propased final short plats to ensure com,pliance
with these Findings and Conditians of Approval.
5. A survey is required of the subject property prior to recording the Fnal short plat.
6. Appropriate road name(s) and street address for each tract shall be indicated on the final short plat
map.
7. Appropriate utility easements shall be indiCated on the final short plat map. Writtrn approval of
utility easements by utility companies must be received prior ta recording the final short plal.
8. The Einal short plat map shall indicate by a dashed line tlie required setbacks from all private or
public roads.

9. Thc final short plat dedication shall contain the following statement: "Side yard and rear yard
setbacks shall be determined at the time building permits are requested unless these setbacks are
specifically drafted on this short plat. The setbacks indicated on this plat mav be varied from if
proper zoning or varianc:e approvals are obtained."
10. Prior to recording the final short plat, the applicant shall provide four (4) eurrent Certificates of
Titlc to the Division of Building and Planning.
11. The applicant shall contact the County Division of Building and Planning at the earliest possible
stage in order tA be informed of code requirements administered/enforced as authorized by the
State Building Code Act. Design/development concerns include: addressing, fire apparatus access
rnads, fire hydrant/now, approved water systems, building accessibility, construction type,
accupancy classification, exiting, exterior wall protection, and enerey cnde regulatians.
13. No water pian is required, only a simple connection will be needed priur to the sale ot' each tract
and prior to issuance of a building permit for each tract.
133. The duplex common-wall lot line shall be identified as the "Center Duplex Lat Line" aiid drafted
as a continuous "dash-dot-dash" on the final short plat.
14. The final short plat map shal) include the follawing statement: "No detached single-family
dwelling,s or manufactured homes are allowed on any tract. All tracts with any lot line designated
Center Duplex Lot Line shall be restricted to ane common-wall dwelling unit (one-half [1/2]
duplex), provided the duplex common wall is aligned over or with the Center Duplex Lot Line, and
provided that each duplex unit (half) is totally on its side of the center lot line wlien said lot line is
eYtended vertically beyond the roof line."
15. The final short plat shall include the following statement: " The ow-ners, heirs pr assigns of each
dwelling unit of the duplex structure do hereby agree to retain the color, texture and type of
materials of this duplex exterior, and further agree that any `change' to said exterior shall have the
written mutual approval of both owners of each half of the duplex prior to initiating cnnstruction of
any such `change' to the exterior. Any replacement or addition to all or part ot' the dupleY
structure shall also require mutual approval. This agreement shall run with each associated lot and
shall be enforced through Civil Court, and does exclude Spokane County from tbe terms and
enforcement of said agreement."
16. The final short plat dedication shall inctude the fallowing statement: "Enforcement of the water
and sewer systems agreement is a civil matter between each duplex unit owner(s) and not enforced
by Spokane Caunty."
17. The final short plat dedication shall include the following statement: Jn the event it is necessary to
replace more than fifty (50%) of either dwelling unit camprising the duplex for any reason
whatsoever, including but not necessariiy limited to fire, expiosion or other destructive forces, said
dwelling unit shall be rebuilt or restored as a dupicx."
18. Prior to finalization of the final short plat, the applicant shall demonstrate to the satisfaction of the
Division of Building and Planning that each dwelling unit comprising a duplex has individual
utility systems and separate residen'al systems as would be required of any single family dwelling.
19. Prior to finalization of the final short plat, the applicant shull demonstrate to the satisfaction of tlle
Divisidn of Building and Planning that the existing dwelling was constructed with a common wall
(fire wall) beriveen each duplex unit and that said wall complies with aU provisions of the Uniform
IIuildin~ Code (UBC).
SPOKANE COUNTY DIVISION OF ENGINEERING AND ROADS

1. The conditional approval of the short plat by the County Engineer is given subject to approval of
the road system as indicated in the Preliminary Plat of Record.
2. Following final plat review by Spnkane Cdunty, drainage language will be drafted by Spokane
County and provided to the Sponsor's Engineer or Surveyor for inclusion with the final plat
document.
3. The applicant shall grant applicable border easements adjacent to Spokane County Right of Way
per Spokane Cpunty standards.
4. No construction work is to be performed within the existing or proposed public right-of-way until
plans have been accepted by the County Engineer and a permit has been issued bv the County
Engineer. All work is subject to inspection and approval by the County Engineer.
5. Approach permits are required for any access to the Spokane Gounty Road System.
6. The propased plat shall be improved to the standards set forth in Spokane Cnunty Board af
County CommissiQners Resolution No. 95-0498, as amended, which establishes regulations for
roads, approaches, drainage and fees in new construction.
SPOKANE COUNTY DIVISION OF UTTLITIES
SEWER SERVICE
1. The dedication shall include the following statement: A public sewer system will be made
available for the plat, and individual services will be provided to eaeh lot prior to sale. Use nf
individua) on-site disposal systems shall not be nuthorized.
The dedication shall state: Individual tracts shall be subject to payment of current applicable sewer
eonnection charges and/or general facilities charges prior to the issuanee of a sewer connection
permit.
3. The applicant shall submit eYpressly to Spokane County Division of Utilities "under separafe
cover", only those plan sheets showing sewer plans and specifications for the public sewer
connections and facilities for review and approval. Commercial developments shall submit
historical and or estimated water usage as part of the sewer pian submittal.
4. Sewer plans acceptable to the Division of Utilities shall be submitted prior to the finalization of
the project.
VVATER SERVICE
1. Any water service for this project shall be provided in accordance with the Coordinated VVater
System Plan for Spokane County, as amended.
SPOKANE REGIONAL HEALTH DISTItICT
1. Sewage disposal metllod shall be as authorized by the Director of the Spokane County Division of
Utilities.
2. Water service shall be coardinated ttirougli the Spokane County Division of Utilitics.
3. Water service shall be by an existing public water supply when approved by the Regionai Engineer
(Spokane), State Department of Nealth.

4. Prior to recording the final short plat, the applicant sha11 demonstrate to the satisfaction af the
Spokane Regional Health District that an adequate and potable water supply is available to each
tract of the p1at.
5. Prior to recording the fnal short plat, tlie applicant shall present evidence that the plat lies ~vithi»
the rec:orded service area of the water system proposed ta serve the plat.
6. The final ptat shall be designed as indicated an the preliminary plat of record and/or any attaclied
sheets as noted.
7. Appropriate utility easements shall be indicated on copies of the preliminary plat of record for
distributian by lhe Division of Building and Planning to the utility companies, Spokane County
Engineer, and the Spokane Regional I-Iealth DisVict. Written approval of the easements by the
utilitv companies shall be received prior to the submittal af the final p1at.
8. A statement shall be placed in the dedicatiun ta the effect that :"A public sewer system will be
made available for the plat and individual service wiil be provided to each tract prior to sale. tJse
of individual on-site sewage disposal systems shall not be authorized.
9. The final shart plat dedication shall contain the following statement: "Use of private wells and
water systems is prohibited."
10. Tlle final short plat dedication shall contain the following statement: "The public water system,
pursuant to the Water Plan approved by County and State health authorities, the iocal fire district,
County Division of Building and Planning, and water purveyor, shall be installed within this short
plat, and the applicant shall provide for individual domestic water service as well as fire proteCtion
tn each tract pnor to sale of each tract and prior to issuance of a building permit for each tract."
