"Bud" Aalcer has been received and was decided upon, pursuant to Spokane County Subdivision regulations, on the 11 i>> day of June, 1999. FINDINGS OF FACT AND CONCLTJSIONS 1. Thz individual signing below has further heen properly delegated the responsibility for rencierine the decision by the Director nf Spokane County Division af Building and Planning. 2. The proposal is to divide approacimately 1 acre into 2 residential tracts. 3. '1"he proposal is located west of and adjacent to Sullivan Road and approximately 500 feet south of 16th Avenue, in the NEY~ of Section 26, Tawnship 25 North, Range 44 E.W.M.. Spokane County, Washington. ~ 4. Tiie existinQ zoning af the property desc;ribed in the application is Urban Residential-3.5 (UR-3.5), wllich was establisbed in 1991. Pursuant ta Sectiun 58.17.195 of the Revised Code of Washins#on (RCVV), this proposal confanns to the reyuirements of thc existing UR-3.5 zonc. 5. The Spokane County Comprehensive P1an designates this area as Urban. The devetopment anci uses, as proposed and conditioned are in accord with tile Urban Category. This propusal is also compatible with the surrounding uses, which are primarily sin~le family residences. 6 The Spvkane County Arteriai Road Plan icleritifieS Sullivan Itnad as a Principal Arterial, without controlled accessa with a future right-of-wav width of 100 feet. Tlie e.cisting nght-of-way width is 60 feet. In arder to implement the 1lrtenal Road Plan, the County Engineer requires a 20-foot widc strip of the subject property along SuUivan Road be dedicated to tlie County for additional right-of-way. Therefore, as canditioned, (such as improvemeats, sidewal.ks, and dedications) the prnposal conforms ta the Road P1an. 7. The prapused site is lacated within the f'ublic Transportation Beiiefit Arca (P I I3A). Thc Spvkanc Transit Authoriry (STA) Routc 97 (Suutb Valle•-) provides connecting services to thc site. 8. The proposed short plat will be served by apuhlic water system. Waste water disposal will he as authorized by the Director of Spnkane County Division of Utilities. 9. The required public notice and commcrtt period was provided for this proposal. In addition thnse agencies having a potemial interest in the proposal tivere notified and comments solicited. No written eomments were received from anr adjoining propertti• ovvner regarding this proposal. 10. Recognizinc, the recommended conditions and Spokane County development standards, the proposed shurt plat makes appropriate provisions for the public health, safety and general welfare and that the public u$e and interest will be serwed by platting the subdivision. 'I'he subdivision proposal is Qenerally consistent with RCVV' 58.17 and the County subdivision regulations, promoting the public healthx safety and general tivelfare in accordane;e with standards established by the State and Spokane Courity. Pursuant to the Washington Administracivz Cnde (WAC) 197-11-800 (6) (a), this proposed short piat is exempt from the Skate Environmental Policy Act (SEPA) envirUnmental review. DECISION Based upon the above-noted Findings af Fact and Conclusions, Short Plzt Application SP-1214-99 is hereby APPROVED for five (5) years, specifically to July 1, 2004, and subject to conditions noted below. This decision is final unless appealed in writing, consistent with adupted appeal procedures. CONDTTIONS OF APPROVAL AU the below conditions imposed shall be binding on the "Applicant," wbich term shall inciude the owner or ownecs of the property, heirs, assians and successors. SPOKAN7E COUNTY DIVISION OF BUILDING AND PL.ANNIlVG 1. The proposal shall comply with the Urban Itesidential-3.5 (I1R-3.5) zone and other applicable Zoning Code chapters, as amended. 2. The final short plat shall be designed substaritially in coilformance witli !he preliminary plat of record. No increase of density or riumber nf tracts shall occur withoul a change of condition application submittal and approval. 3. ThE preliminary short plat is given conditional approval for five (5) years, specifically to July l, 2004. The applicant ma_y submit an extension of time application at least thirty (30) days prior to the above espiration date. Application(s) for extension of time shall be prvicessed under thc provisioas of Chapter 12.100.118 (Extension of Time) of the Spokane Countv Subdivision Ordinance. If the applicant complies with the criteria of Chapier 12.100.118, the preliminaryw appraval and conditions will be changrd w reflect the adopted policy and development regulations at the time of the extension application. 4. Prior to recording the final short plat, tlie appliCant shall siibmit to the County Division of Buildina and Planning Director/desienee for revie~v any proposed fnal shart plats to ensure corrpliance with these Findings and Conditions of Approval. 5. A survey is required of the subject property prior to recording ttie final sliort plat. 6. Appropriate road name(s) and strect address fer each tract shall be indicated un the final short plat map. 7. Appropriate utility easements shall be inclicated on the t;na) short plat map. The final short plat map shall indicate by a dashed line the required setbacks from all private or public roads. 9. Prior to recording the final short plat, the applicant shall provide four (4) current Certificates of Title to the Division of Building and Plaaning. 11. The applicant shall contact the County Division of Building and Planniag at the earliest possibie stage in order to be informed of code requirements administered/enforced as authorized by the Siate Building Code Act. Design/development concerns include: addressiag, fire apparatus access roads, fire hydrandflow, approved water systems, building accessibility, consbvction type, occupancy classification, exiting, exterior wall protection, and energy code regulations. SPOKANE COUNTY DIVISION OF ENGINEERING AIVD ROADS l. Conditional approval of the short plat by the County Engineer is given subject tca dedication of right-of-way and approval of the road system as indicated in the preliminary shart plat of record. 2. A Professionai Engineer, licensed in the State of Washington, shall submit final road and drainagE plans, a draiaaae report and calculations that conform to all standards and la~,.,s governing stormwater inanagement in Spokane County, if road improvements are required to be built for this project. Finnl drainage plans and a drainage report, if required, shall receive the County Engineer's acceptance prior to release of a construction or building permit or approval of the land action. Following plan acceptance by the Spokane County Engineer or before the final short plat is drafted, drainage language vvill be drifted by Spokane County and provided to tbe Sponsor's Engineer or Surveyor for inclusion with the final plat document. 3. This proposed subdivision or devetopment proposal is located within a drainage basirl which haS been identified by ihe Spokane County Engineer's and Utilities offices as having stormwater runoff problems. Since this proposed subdivision or developmeat proposal is affected by or is a contributor to stormwater flows, property owners should participate in the planning and implementation of a future basinwide stormwater management system. The final short plal dedication shall contain the following statement: "The owner(s) or successor(s) in interest agree to join in any County-approved stormwater management program and to pay such rates annd charges as may be fixed through public hearings for service or benefit obiained by the planning, design. constructing, maintaining or operation of stormwater control facilities." 4. Drainage plans and design calculations showing the alignment of drainage far;ilities bc submitted to the County Engineer for acceptance prior to construction and/or recording of the final short plat. Drainaee plans to be prepared under the clirection of a licensed professional Civil Enqineer. 5 No constcuction work is to be performed within the existing or proposed puhlic right-of-wav untii plans have been accepted by the County Engineer and a perinit has been issued hy the Count~~ En3ineer. All ~vork is subject to inspection and approval by~ the Cnunty Engineer. ~ 6. Approach Permits are required for any access to the Spokane Couniy road system. i. Dedication of 20 feet of right-of-way along Sullivan Road is required. The applicant shall grant applicable border easements adjacent to Spokane County right-of-way per Spol:ane Count)• Standards. 8. To construct the road improvements stated lterein, the applicant may, with the approval of 1he County Engineer, join in and be a willing participant in any petitiun or resolution which purpuses is the formation of a Road Improvement Districi (RLD) for said improvements pursuant to RCW 36.83, as amended. At such time as an RID is created or anv Road Impravement Projeet is sanctioned by Spokane County, the improvements required (curb, sidewalk, drainage conNol and paving to existing pavement) will be at the sole expense of the undersigned owner, their heirs, grantees and assigns. This provision is applicable to Sullivan Road. Findings and Decision SF'-121 4-99 3 1 e ~ 9. As an alternative method of constructing the road improvement stated herein, the applicant may, with the approval of the County Engineer, accomplish t6e road improvements stated herein by joining and participating in a County Road Project (CRP) to the extent of the required road improvement. At such time as an RID is created or any Road Improvement Project is sanctioned by Spokane County, the improvements required (curb, sidewalk, drainage control and paving to existing pavement) will be at the sole expense of the undersigned owner, their heirs, grantees and assigns. This provision is applicable to Sullivan Road. 10. The final short plat dedication shall contain the following statement: "In consideration of Mutual Benefits now or to be hereafter derived, do for themselves, tlieir heirs, grantees, assigns and successor(s) in interest hereby request and authorize Spokane County to include thz above described property in a Road Improvement District (RID) and to support the formation of a Road Improvement District for improvement of the road(s) described below by requesting and authorizing Spokane County to place their name(s) on a petition for the formation of a Road lmprovement District pursuant to RCW 36.88.050, or by requesting and authorizing Spokane County to cast their ballot in favor of a RID being formed under the resolution method pursuant to RCW 36.88.030, arid/or by not filing a protest against the formation of a R1D being formed under the alternative resolution method provided for in RCW 36.88.065 and Chapter 35.43 RCW. "If a RID is proposed for improvement of the road(s) described betow, said owner(s) and successor(s)further agree: (1) that the improvements or construction contemplated within the proposed RID are feasible and (2) that the benefits to be derived from the formation of the RID by the property included therein, together with the amount of any County participation, exceeds the cost and expease of formation of the RID, and (3) that the properry within the proposed RID is sufficiently developed; provided, themselves, their heirs, grantees, assigns and successoc(s) shall retain the right, as authorized under RCW 36.88.090, to object to any assessment(s) on the property as a result of the improvements called for in conjunction with the formation of a RID by either the petition or resolution method under Chapter 36.88 RCW and to appeat to the Superior Caurt the decision of the Board of County Commissioners confirming the final assessment roll; provided further, it is recognized that actual assessments may vary from assessment estimate so long as they do not exceed a figure equal to the increased true and fair value improvement(s) add(s) to tiie property. "It is further acknowledged and agreed that at such time as a R1D is created or any Countv Road Improvement project is authorized by Spokane County, the improvements required shall be at the sole eYpense of the owner(s) of praperty within the R1D ur served by the improvements without any monetary participation bv Spokane County. "The RID waiver contained in this agreement shall expire after ten (10) years from the date ofexecution below. This provisinn is applicablc to Sullivan Road." 11. The County Engineer has designated a 5 Lane Principal Arterial Roadway Section for the improvement of Sullivan Road which is adjacent to the proposed development. This will require the addition of varying amounts of asphalt along the frontage of the development. The constructian of ctirbing and sidcwalk is also required. l?. The proposed plat shall be improved to the standards set forth in Spokane County Board of Commissioners Resolution No. 99-0265, as amended, which establishes regulatiuns for roads, apprnaches, drainage ancl fees in new construction. 13. Thc County Engineer has examined this development proposal and has determined that the impact of this proposal upon the existing Caunty Road System warrants the dedication of additional right- of-way and the roadway improvements herein specified.
