This matter has come before the Hearing Examiner Committee on October 21, 1993.

1. The property is generaily lorited north of and adjacent to 6th Avenue approximately
200 feet east of Farr Ro7d in che NW 1/4 of Section 20, Township Norch. Range
44 EWM, Spokane County, Wasliington.

dedicated west of Farr Road thcre is no further requirement for the dedication of 10 feet
along Fourch Avenue, all other conditions of approval are applicable.
2. The request for change of conditions for ZE-106-72 lb, the County Engineer waives
any funher requirement for riaht of way dedicarion on Woodruff Road. 50 feet of righc
of way was dedicated by the original property owner.

County standards andlor adopted resoludons pertaining to Road Standards and
Storrnwater Management in effect at the ddte of construction, unless otherwise
approved by the County Engineer.
12. Access to Woodruff Road shall be prohibited until such rime as specificallv
authorized by the Spokane County Engineer. .

maintaining the surface pAtb of natural or man-made drainage flow over and across their
respective properties. If the property owner(s) fails to maintain the surfACe path of natural
or man-made drainage tlow, or the drainage swale, a notice of suc6 failure may be given to
the property owaer(s). lf not corrected within t6e period indicated on said notice, Spokane
County has the right to correct the maintenance failure, or hstve it corrected, at the expense

Tuere may exist properties located uphill and adjacent to this subdivision whicb
periodically discharge siormwater runoff oDto individual lots within this plnt. Runoff from
nearby uphill properties should be expected, and during snowmelt periods or wet seasons
the lots may be subjected to higher amouats of stormwater runoff' t6at what is oormally
observed or aaticipated. Because stormwater ruaoff from adjacent properties has
discharged onto this p1At prior to development, stormwater runoff wiU tikely continue to do
so after development. it is the respoasibility of the individual lot owners to maintain
existing surface paths of runotT through their respective lots and to grade the lots in

PLAT SP-1216-99 ~ DECISION
THIS MATTER, an appiication for short subdivision from Woodruff Heights Limited Parhlership has
been received and was decided upon, pursuant to Spokane County Subdivision regulations, on the 14th
day of October, 1999.
, FINDIlITGS OF FACT AND CONCLUSIONS
'I l. The individual signing below has further been properly delegated the responsibility for rendering
the decision by the Director of Spokane County Division of Building and Planning.
2. The proposal is to divide approximately 3.2$ into two (2) tracts for residential uses in the existing
Urban Residential-22 (UR-22) zone.
3. The proposal is located at the northwest corner of the intersection of 6th Avenue and Woodruff
Road in the N1/2 of Section 20, Township 25 N., Range 44 EWM, Spokane County, Washington.
4. The existing zoning of the praperly described in the application is Urban Residential-22 (UR-22),
which was established in 1991. Pursuant to Section 58.17.195 of the Revised Code of WashineCon
(RCV), this proposal conforms to the requirements of the eacisting Urban Residential-22 (UR-22)
zone.
5. The Spokane County Comprehensive Plan designates this area as Urban. The development and
uses, as proposed and conditioned are consistent with the Urban category. This proposal is aIso
compatible with the surrounding uses which are primarily residential and vacant, undeveloped
land.
6. The subject property is located within the Interirn Urban Growth Area (1UGA) adopied by the
Board of County Commissioners (BOCC) Resolution #97-0321.
7. The proposed site is located inside the Public Transportation Benefit Area (PTBA). The nearest
public transit service is located west of the site along Uishman-Mica Road.
8. The proposed short plai will be served by both a public water and public sewer system.
9. The required public notice and comment period was provided for this proposal. In addition, those
agencies having a potential interest in the proposal were notified and comments solicited. No
written comments were received from any adjoining propertv owner regarding this proposal.
10. Recognizing the recommended conditions and Spokane County development standards, the
proposed short plat mal:es appropriate provisions for the public health, safety and general welfare
and that the public use and interest will be served by platting the subdivision. The subdivision
proposal is generally consisteat with RC1►V 58.17 and the County subdivision regulations,
promoting the public health, safety and general welfare in accordance with standards established
by the State and Spokane County. The County Division of Building and Planning has considered
the provision of adequate public facilities as cited in RCW 58.17.110(2). More specifically:

c. public and/or private right-of-ways h. playgrounds

plat is exempt from the State Environmental Policy Act (SEPA) environmental review.

hereby APPROVED for five (S) years, specifically to November I, 2004 and subject to conditions noted

CONDITIONS OF APPROVAL
All the below conditions imposed shall be binding on the "Applicant," which term shall include the
owner or owners of the property, heirs, assigns and successors.
SPOKANE COUNTY DIVISION OF BUILDING AND PLANNIhG
1. 1'he proposal shall comply with the Urban Residential-22 (UR-22) zone and other applicable
Zoning Code chapters, as amended.
2. The final short plat shall be designed substantially in conformance with the preliminary plat of
record. No increase of density or number of tracts shall occur without a change of conditions
application submittal and approval.
3. The preluninary short plat is given conditional approval for five (5) years, specifically to
November 1, 2004. The applicant may submit an extension of time application at least thirty (30)
days prior to the above expiration date. Application(s) for extension of time shall be processed
under the provisions of Chapter 12.100.118 (Extension of Time) of the Spokane County
Subdivision Ordinance. If the applicant complies with the criteria of Chapter 12.100.118, the
prel'uninary approval and conditions will be changed to reflect the adopted policy and development
regulations at the time of the extension apptication.
4. Prior to recording the final short plat, the applicant shall submit to the County Division of Building
and Planning D'uector/designee for review any proposed final short plats to ensure compliance
with these Findings and Conditions of Approval.
S. A survey is required of the subject properry prior to recording the final short plat.
6. Appropriate road name(s) and street address for each tract shall be indicated on the final short plat
map.
7. Appropriate utility easements shall be indicated on the final short plat map. Writtzn approval of
utility easements by utility companies must be received prior to recording the final short plat.
8. The final short plat map shail indicate by a dashed line the required setbacks from all private or
public roads.
9. The finai short plat dedication shall contain the following statement: "Side yard and rear yard
setbacks shall be determined at the time building permits are requested unless these setbacks are
specifically drafted on this short plat. The setbacks indicated on this plat may be varied from if
proper zoning or variance approvals are obtained."
10. Prior to recording the final short piat, the applicant shall provide four (4) current Certificates of
Title to the Division of Building and Planning.

11. The applicant shall contact the County Division of Building and Planning at tfie earliest possible
stage in order to be informed of code requirements admuustered/enforced as authorized by the
State Buildiag Code Act. Design/development concerns inetude: addressing, fire apparatus access
roads, fire hydrant/flow, approved water systems, building aecessibility, construction type,
occupancy classification, exitmg, exterior vvall protection, and energy code regulations.
SPUK;ANE COUNTY DIVISION OF ENGINEERING AND ROADS
l. Conditional approval of the plat by the Countar Engineer is given subject to dedication of right-of-
way and approval of the road system as indicated in the preliminary plat of record.
2. Applicant shall comply with F.ngineering Conditions of Approvai for ZE-59A-72/ZE-106A-72.
3. Drainage and grading plans have been prepared and accepted at the location of this proposal in
conjunction with County Engineering Permit File 098190. Any modifications to the drainage
plan rriust be accepted by the County Eneineer prior to filing of a final plat. Following plan
acceptance by the Spokane County Engineer or before the final plat is drafted, drainage language
will be drafted by Spokane County and provided to tUe Sponsor's Engineer or Surveyor for
inclusion with the final plat document.
4. Prior to the filing of a final plat the applicant shall demonstrate to the satisfaction of the County
Enaineer that reciprocal easements for ingresslegress and drainage facilities have been provided
for.
5. This proposed subdivision or development proposal is loGated within a drainage basin which has
been identified by the Spokane County Engineer's and Utilities offices as having stonnwater runoff
problems. Since this proposed subdivision or development proposal is affected by or is a
contributor to stormwater flows, property owners should participate in the planning and
implementation of a future basinwide stormwater management system.
6. The following statement shall be ptaced in the plat dedication: "The owner(s) or successor(s) in
interest agree to join in any County-approved stormwater management program and to pay such
rates and charges as may be fixed through public hearings for service or benefit obtained by the
planning, design, construciing, maintaining or operation of stormwater control facilities."
7. No construction work is to be performed within the existing or proposed Public right-of-way until
plans have been accepted by the County Engineer and a permit has been issued by the County
Engineer. All work is subject to inspection and approval by the County Engineer.
8. All construction within the existing or proposed Public right-of-way is to be completed prior ta
filing the final plat or a bond in the amount estimated by the County Engineer to cover the cast af
construction of improvements. Construction certification, "Record Drawings" and monumentation
af the street centerlines shall be filed with the County Engineer.

10. Access to Woodruff Road shall be prohibited until such time as specifically authori.zed by the

12. To construct the road improvements stated herein, the applicant may, with the approval of the
County Engineer, join in and be a willing participant in any petition or resolution which purposes
is the formation of a Road Improvement District (RID) for said improvements pursuant to RCW
36.88, as amended. At such time as an RID is created or any Road Improvement Project is
sanctioned by Spokane County, the improvements required (curb, sidewalk, drainage control and
paving to existing pavement) will be at the sole expense of the undersigned owner, their heirs,
grantees and assigns. This provision is applicable to Woodruff Road.
13. As an alternative method of constructing the road improvement stated herein, the applicant may,
with the approval of the County Engineer, accomplish the road improvements stated herein by
joining and participating in a County Road Project (CRP) to the extent of the required road
improvement. At such time as an RID is created or any Road Improvement Projecc is sanctioned
by Spokane County, the improvements required (curb, sidewalk, drainage control and paving to
existing pavement) will be at the sole expense of the undersigned owner, their heirs, grantees and
assigns. This provision is appticable to Woodruff Road.
14. The fotlowing statement shall be placed in the dedicatory language of the final plat:
That in consideration of Mutual Benefiis now or to be hereafter derived, do for themselves, their
heirs, grantees, assigns and successor(s) in interest hereby request and authorize Spokane County
ta include the above described property in a Road Improvement District (RID) and to support the
formation of a Road Improvement Distnct for improvement of the road(s) described below by
requesting and authorizing Spokane County to place their name(s) on a petition for the formation
of a Road Improvement District pursuant to RCW 36.88.050, or by requesting and authorizing
Spokane County to cast their bailot in favor of a RID being formed under the resolution method
pursuant to RCW 36.88.030, and/or by not filing a protest against the formation of a RID being
formed under the alternative resolution met6od provided for in RCW 36.88.065 and Chapter 35.43

16. The proposed plat shall be improved to the standards set forth in Spokane County Board of
Commissioaers Resolution No. 99-0265, as amended, which establishes regulations for roads,
approaches, drainage and fees in new construction.
17. The County Engineer has examined this development proposal and has determined that the impact
of this proposal upon the existing County Road System warrants the dedication of additional R.ight
of Way and the roadway improvements herein specified.
SPOKANE C4IJNTY DIVISION OF UTILITIES
1. The dedication shall state: Public sewers shall be constructed to provide for the connection of
each parcel to the County's system of sewerage. Uses on properties within the project shall be
required to connect io the sewer and pay applicable charges per the County Sewer Ordinance.
Sewer connection permits shall be required.
2. The dedication shall state: Individual tracts shall be subject to payment of current applicable sewer
connection c6arges and/or general facilities charges prior to the issuance of a sewer connection
perm it.
3. Applicant shall submit expressly to Spokane County Division of Utilities "under separate cover",
onty those plan sheets showing sewer plans and specifications for the public sewer connections
and facilities for review and approval. Commercial devetopments shall submit historical and or
estimated water usage as part of the sewer plan submittal.
4. Sewer plans acceptable to the Division of Utiiities shall be submitted prior to the finalization of the
project.
5. Any water service for this project shall be provided in accordance wiih the Coordinated Water
System Plan for Spokane County, as amended.
SPOKANE REGIONAL HEALTH DISTRICT
~
l. Sewage disposal method shall be as authorized by the Director of the Spokane County Division of
Utilities.
2. Water service shall be coordinated through the Spokane County Division of Utilities.
3. Water service shall be by an existing public water supply when approved by the Regional Engineer
(Spokane), State Department of Health.
4. Prior to recording the final short plat, the applicant shall demonstrate to the satisfaetion of the
Spokane Regional Health District that an adequate and potable water supply is available to each
tract of the plat.
5. Prior to recording the final short plat, the applicant shall present evidence that the plat lies within
the recvrded service area of the water system proposed to serve the plat.
6. The final plat shall be designed as indicated on the preliminary plat of record and/or any attached
sheets as noted.
7. Appropriate utility easements shall be indicated on copies of the preliminary plat of record for
distribution by Building and Planning to the utiliry companies, Spokarae County Engineer, and the
