PURPOSE OF CHECICLIST
The State Environmental Policy Act (SEPA), chapter 43.21C RCW, requires all governmental agencies
to consider the environ.mencal inlpacts of a proposal befare making decisions. An environmental
impact statement (EIS) must be prepared for all proposals with probable significant adverse impacts on
the quality of che enviranment. The purpose of this Checklist is to provide information to help you
:ind the agency identify impact from your prnposal (and to reduce or avoid impacts from the proposal,
if it can be done) and to help the agency decide whether an EIS is required.
INSTR UCTIONS FOR APPLICANTS
This environmental checklist asks you to describe some basic information about your proposal.
Governmental agencies use this checklist to determine whether the envuonmental impacts or your
proposal are significant, requiring preparation of an EIS. Answer the questions briefly, with the most
precise informauon known, or give the best description you can.
You must answer each question accurately and carefully, to the best of your knowledge. In inost
cases, you should be able to answer the questions from your own observations or project pla.as
without the need to hire eYperts. If you really do not know the answer, or if a question does not
apply to your proposal, wrice "do not know" or "does not apply". Complete answers to the questions
now may avoid unnecessary delays later.
Some questions ask about governmental regulations, such as zor,ing, shoreline, and landmark
designations. Answer these question if you can. If you have prohlems, the governmental agencies can
assist you.
The checklist quescions apply to all parts of your proposal, even if you plan to do them over a period
of time or on different parcels of land Attach any additional information that will help descrihe your
proposal or its environmental effecu. The agency to which you submit this checklist may ask you to
explain your answers or provide addiCional information reasonably related ca determin.ing if there may
be significant adverse impact.

IN THE MATTER OF SHORT ) FINDINGS OF FACT,
PLAT; SP-1220-99 ) CONCLUSIONS AND
DECISION
THIS MATTER, an application for short subdivision from Michael Walker, Executive Committee
Investments, LLC has been received and was decided upon, pursuant to Spokane County
Subdivision regulations, on the 3rd day of December, 1999.
FINDINGS OF FACT AND CONCLUSIONS
1. The individual signing below has been properly delegated the responsibility for rendering
the decision by the Director of Spokane County Division of Building and Planning.
2. The proposal is to divide 30,375 sq. ft. Tract °A" of Final Short Plat 85-407 into 2 tracts for
1 existing single family residence and 1 new additional residence (small existing residence
and garage to be removed).
3. The proposal is located one block west of the Town of Millwood, northeast of and adjacent
to the intersection of Liberty and Dick Roads in the SW % of Section 6, Township 25
North, Range 44 E.W.M., Spokane County, Washington, being tax parcel number
45063.3031 with a site address of 8101 E. Liberty Ave.
4. The existing zoning of the property is Urban Residential-3.5 (UR-3.5) which was
established in 1991. The application specifies that duplexes will be constructed on each
lot, but the Environmental Checklist specifies that single family dwellings witl be
constructed on each (ot. The conditions of approval specified below require that
development of the lots be limited to one single family residence per lot due to the
operation of the density requirements of the County Zoning Code. Pursuant to Section
58.17_195 of the Revised Code of Washington (RCV11), this proposal together wfth the
conditions specified herein conforms to the requirements of the existing zone.
5. The Spokane County Comprehensive Plan designates this area as Urban. The
development and uses proposed for this Short Plat and conditions attached thereto are in
accordance with the Urban land use Category. This proposal is also compatible with the
surrounding uses, which are primarily single family residential. The Short Plat is consistent
with the Spokane County Growth Management Act Interim Urban Growth Area
requirements.

6. The Spokane County Arterial Road Plan identifies Liberty Avenue and Dick Road as local
access roads with a future right-of-way width of 60 feet The existing right-of-way widths
for both sfreets is 50 feet. As conditioned below the proposal conforms to the County
Road Plan. The County Engineer has examined this short plat proposal and has
determined that its impact upon the existing County Road System warrants the roadway
improvements specified in the conditions beiow.
7. The short plat site is located within the Public Transportation Benefit Area (PTBA). The
Spokane Transit Authority (STA) Route 91(MissionRrent Route) provides services directly
to the site. •
8. The proposed Short Plat will be served by a public water system. The water service wiU
be provided by Orchard Avenue tRigation District #6. Waste water disposal wil{ be by
individual on site sewage disposal systems as authorized by the Spokane Regional Health
District, Environmental Heafth Division.
9. The required public notice and comment period was provided for consistent with the
Spokane County Subdivision Code and County Environmental Qrdinance. In addition,
those agencies having a potential interest in the praposal and adjacent property owners
were notfied and cornments solicited. No comments were received from any adjoining
property owners regarding this proposal.
10. In consideration of the perfoRnance conditions specified below and ihe application of
Spokane County development standards, the proposed Short Piat makes appropriate
provisions for the public health, safety and general welfare and that the public use and
interest will be served by short platting the subject land parcel.
11. The subdivision proposal is generally consistent with Washington State Subdivision Statute
RCW 58.17 and the Spokane County Subdivision Ordinance, promoting the public health,
safety and general welfare in accordance with standards established by Washington State
and Spokane County. The County Division of Building and Planning has considered the
provision of adequate public facilities as cfted in RCW 58.17.110(2). More specifically:
a. open spaces f. sanitary waste disposal
b, drainage ways g. parks and recreation facilities
c. public and/or private Oght-of-ways h. playgrounds
d. tfansit i. schoofs and school grounds
e. potable water j. sidewalks
12. The short ptat is exempt from the environmental review under the State Environmental
Policy Act pursuant to WAC 197-11-800 (6) (a).
13. This short subdivision lies over the Spokane-Rathdrum Aquifer.
14. The project is within Critical Water Supply Service Area #3 and also within the service
area of Orchard Avenue Wa#er District. Water supply will be provided by a public water
system.
Findings and Decision SP-1220-99 2
15. The project is inside the Spokane County Comprehensive Wastewater Management Area,
inside the General Sewer Service Area, and inside the Priority Sewer Service Area
recommended in the '201' Study. The method of sewage disposal is subject to approval of
the Director of Utilities, Spokane County, pursuant to County Resolution 80.0418. The
topography and soils in the area are generally suitable for use of individual on-site sewage
disposal systems. The tracts are not of the proper dimensions to peRnit the use of both
individual wells and sewage system. Surface soils are classed by the U.S. Soil
Conservation Service as Garrison Gravelly Loam with 0% to 5% slopes. They have a
septic tank filter field limitation of slight. There is also possib{e contamination of
groundwater. This soil would be classified as a Type fV which would require a minimum
gross land density of 18,000 sq. ft. per tract. Geologically, the soils are glaciofluvial
deposits. These geological structures generally yield moderate to very large amounts of
water. Data from wells in the area shows they are from 30' to 505' deep and have static
water levels varying from 5' to 200' below the surface. The Orchard Avenue Irrigation
District has indicated that it can supply domestic use water for the project upon compfetion
of agreements with the short plat applicant.
14. The proposal is within the Aquifer Sensitive Area (ASA). The Guidelines for Stormwater
Management requires that impervious area within the ASA must drain to grassed
percolation area (GPA) swales. The applicant and lot owners may need to conform to
these requirements as a condition of the issuance of a building permft.
DECISION
Based upon the above noted Findings of Fact and Conclusions, Short Plat Application SP-1220-
99 is hereby APPROVED for five (5) years, specifically to December 3, 2004 and subject to
conditions specified below. This decision is final unless appealed in writing, consistent with
appeal procedures set forth in County Subdivision Ordinance, Section 12.100.126.
CONDITIONS OF APPROVAL
All the below conditions imposed shall be binding on the "Applicant,° which term shall include
the owner or owners of the property, heirs, assigns and successors.
SPOKANE COUNTY DIVISION OF BUILDING AND PLANNING
1. The proposal shall comply with the Urban Residential-3.5 (UR-3.5) Zone and all other
applicable County Zoning Code requirements and the Spokane County Subdivision
Ordinance. Since each lot lacks the minimum area for duplex dwellings as specified by
said Zoning Code. such dwellings are not allowed.
2. The final short plat shall be designed substantially in conformance with the preliminary
short plat of record. No increase of density or number of tracts shall occur without a
change of condition application submittal and approval.
3. The preliminary short plat is given conditional approval for five (5) years, specifically to
December 3, 2004. The applicant may submit an extension of time application fortyfive
(45) days prior to the above expiration date. Application(s) for extension of time shall be
processed under the provisions of Chapter 12.100.118 (Extension of Time) of the Spokane

County Subdivision Ordinance. If the applicant compiies with the criteria of Chapter
12.100.118, the preliminary approval and conditions wiil be changed to reflect the adopted
policy and development regulations at the time of the extension application.
4. Prior to filing of the finai short piat, the applicant shall submit to the County Division of
Building and Planning Directorldesignee for review the proposed final plat to ensure
compliance with these Findings and Conditions of Approval.
5. Four (4) current certificates of title shall be fumished to the County Division of Building
and Planning prior to filing of the final plat.
6. A survey is required of the subject property prior to filing of the final short plat.
7. Appropriate road names and street addresses shall be indicated on the final short plat
map.
8. Appropriate utility easements shall be indicated on the final short plat map. Written
approval of utitity easements by utility purveyors must be received prior to filing of the final
short plat.
9. The final short ptat map shall indicate by a dashed line the required structure setbacks
from all private or public rights of way.
10. The dedication shall contain the following statement: "Side yard and rear yard setbacks
shall be determined at the time building permits are requested. The setbacks indicated on
this subdivision may be varied from if proper zoning or variance approvals are obtained."
11. The Spokane County Division of Building and Planning shalt prepare and record with the

Spokane County Auditor a'Title Notice~~ noting that the property in question is subject to a
variety of special conditions imposed as a result of the land use action herein. This "Title
Notice" shall serve as afficial public notice regarding conditions of approval affecting the
property in question. The "Title Notice" shall be recorded within fifteen (15) days of Final
Plat approval and shall only be extinguished by the Spokane County Division of Building
and Planning. The'Title Notice" shall generally provide as follows:
The parcel of property legally described as follows: (description is taken from the
Final Plat map) SITUATED IN THE COUNTY OF SPOKANE, STATE OF
WASHINGTON is the subject of a land use action imposing a variety of special
development condftions by a County Administrative Dfficial on November 30th
day of 1999 and as may be amended, altered or supplemented by official action
or as already changed. File No. SP-1220-99 is available for inspection and
copying in the Spokane County Division of Building and Planning.
SPOKANE COUNTI( DIVISION OF ENGINEERING AND ROADS
1. Conditional approval of the preliminary short plat by the County Engineer is given subject to
dedication of right-of-way and approval of the road system as indicated in the preliminary
plat of record.

2. No construction work is to be perFormed within the existing or proposed Public right-of way
until plans have been accepted by the County Engineer and a permit has been issued by
the County Engineer. All work is subject to inspection and approvai by the County
Engineer.
3. Approach Permits ane required for any access to ihe Spokane County road system.
4. The applicant shall grant applicable border easements adjacent to Spokane County Road
Right of Way per Spokane County Road and Right of Way Standards.
5. To construct the road improvements stated herein, the applicant may, with the approval of
the County Engineer, join in and be a willing participant in any petition or resolution which
has as ifs purpose the formation of a Road Improvement District (RID) for said
improvements pursuant to RCW 36.88, as amended. At such time as an RID is created or
any Road Improvement Project is sanctioned by Spokane County, the improvements
required (curb, sidewalk, drainage control and paving to existing pavement) will be provided
at the sole expense of the undersigned owner, their heirs, grantees and assigns. This
provision is appf icable to Liberty Avenue and Dick Road.
6. As an altemative method of constructing the road improvement stated herein, the applicant
may, with the approval of the County Engineer, accomplish the road improvements stated
herein by joining and participating in a County Road Project (CRP) to the extent of the
required road improvement. At such time as an RID is created or any Road Improvement
Project is sanctioned by Spokane County, the improvements required (curb, sidewalk,
drainage control and paving to existing pavement) will be provided at the sole expense of
the undersigned owner, their heirs, grantees and assigns. This provision is applicable to
Liberty Avenue and Dick Road.
7. The following statements shall be placed in the dedicatory language of the final plat:
The owner(s) or successor(s) in interest agree to join in any County-approved
stormwater management program and to pay such rates and charges as may be
fixed through puhlic hearings for service or benefd obtained by the planning,
design, constructing, maintaining or operation of stormwater control faalities.
That in consideration of Mutual Benefits now or to be hereafter derived, do for
themselves, their heirs, grantees, assigns and successor(s) in interest hereby
request and authorize Spokane County to include the above described property in a
Road Improvement District (RID) and to support the fonnation of a Road
Improvement District for improvement of the road(s) described below by requesting
and authorizing Spokane County to place their name(s) on a petition for the
formation of a Road Improvement District pursuant to RCW 36.88.050, or by
requesting and authorizing Spokane County to cast their ballot in favor of a RID
being formed under the resolution method pursuant to RCW 36.88.030, and/or by
not filing a protest against the formation of a RID being formed under the altemative
resolution method provided for in RCW 36.88.065 and Chapter 35.43 RCW.

If a RID is propased for improvement of the road(s) described below, said owner(s)
and successor(s)further agree: (1) that the improvements or construction
contemplated within the proposed RID are feasible and (2) that the benefrts to be
derived from the fomiation of the RID by the property included therein, together with
the amount of any County partlcipation, exceeds the cost and expense of formation
of the RID, and (3) that the property within the proposed RID is sufficiently
developed; provided, themselves, their heirs, grantees, assigns and successor(s)
shall retain the right, as authorized under RCW 36.88.090, to object to any
assessment(s) on the property as a result of the improvements called for in
conjunction with the formation of a RID by e'ither the petition or resolution method
under Chapter 36.88 RCW and to appeai to the Superior Court the decision of the
Board of County Commissioners confirming the final assessment roll; provided
further, ft is recognized that actual assessments may vary from assessment
estimate so long as they do not exceed a figure equal to the increased true and fair
value improvement(s) add(s) to the property.
It is further acknowledged and agreed that at such time as a RID is created or any
County Road Improvement project is authorized by Spokane County, the
improvements required shall be provided at the sole expense of the owner(s) of
property within the RID or served by the improvements without any monetary
participation by Spokane County.
The RI D waiver contained in this agreement shall expire aRer ten (10) years from the
date of execution below. This provision is applicable to Liberty Avenue and Dick
Road.
8. The County Engineer has designated a Local Access Roadway Section for the
improvement of Liberty Avenue which is adjacent to the propased development This will
require the addition of approximately 5-7 feet of asphalt along the frontage of the
development. The construction of curbing and sidewalk is also required.
9. The County Engineer has designated a Local Access Roadway Section for the
improvement of Dick Road which is adjacent to the proposed development. This will
require the addition of approximately 6-8 feet of asphalt atong the frontage of the

10. The proposed plat shall be improved to the standards set forth in Spokane County Board of
Commissioners Resolution No. 99-0265, as amended, which establishes regulations for
roads, approaches, drainage and fees in new construction.
11. The proposed short plat is located within a drainage basin which has been identified by the
Spokane County Engineer's office as having stornnwater runoff problems. Since this
proposed subdivision or development proposal is affected by or is a contributor to
stormwater flows, praperty owners should participate in the planning and impfementation of
a future basinwide stormwater management system. The following statement shall be
placed in the final short plat dedication:

water management program and to pay such rates and charges as may be fixed
through public hearings for service or benefit obtained by the planning, design,
constructing, maintaining or operation of stormwater control facilities.
SPOKANE COUNTY DIVISION OF UTILiTIES
1. Pursuant to the Board of County Commissioners Resolution No. 80-0418, the use of
on-site sewer disposal systems may be authoriied. This authorization is conditioned
on compliance with all rules and regulations of the Spokane County Heaith District and
is further conditioned and subject to specific application approval and issuance of
permits by the Health District.
2. The final plat shall include in its dedicatory language the following wording:
To facilitate connection to the future public sewer system, each new building
shall be double plumbed with a dry side sewer for connection to future area-
wide wastewater coltection systems. NOTE: Plans acceptable to the Division
of Utilities may be required.
3. Any water service for this project shall be provided in accordance with the
Coordinated Water System Plan for Spokane County, as amended.
SPOKANE REGIONAL HEALTH DISTRICT
1. Appropriate utility easements shall be indicated on copies of the preliminary plat of record
for distribution by the Planning Department to the utilfty companies, Spokane County
Engineer, and the Spokane Regional Health District. Written approval of the easements
by the utility companies shall be received prior to the submittal of the final plat.
2. Sewage disposal method shall be as required by the Director of Utilities, Spokane County.
3. Water service shall be coordinated through the Director of Utilities, Spokane County.
4. Water service shall be by an existing public water supply when approved by the Regional
Engineer (Spokane), State Department of Health.
5. Prior to filing the final plat, the sponsor shall demonstrate to the satisfaction of the Spo-
kane Regional Health District that an adequate and potable water supply is available to
each tract of the plat.
6. Prior to filing the final plat, the sponsor shall present evidence that the plat lies within the
recorded service area of the water system proposed to serve the plat.
7. Prior to filing the final plat, the sponsor shall demonstrate to the satisfaction of the Spo-
kane Regional Health District that a suitable site for an on-site sewage disposal system is
available on tract A.

3. Any water service for this project shall be provided in accordance with the
Coordinated Water System Plan for Spokane County, as amended.
SPOKANE REGIONAL HEALTH DISTRICT
1. Appropriate utility easements shall be indicated on copies of the preliminary plat of record
for distribution by the Planning Department to the utility companies, Spokane County
Engineer, and the Spokane Regional Heaith District. Written approval of the easements
by the utility companies shall be received prior to the submittal of the final plat.
2. Sewage disposal method shall be as required by the Director of Utilities, Spokane County.
3. Water service shall be coordinated through the Director of Utilities, Spokane County.
4. Water service shall be by an existing public water supply when approved by the Region-
al Engineer (Spokane), State Department of Health.
5. Prior to filing the final plat, the sponsor shall demonstrate to the satisfaction of the
Spokane Regional Health District that an adequate and potable water supply is available
to each tract of the plat.
6. Prior to filing the final plat, the sponsor shall present evidence that the plat lies within the
recorded service area of the water system proposed to serve the plat.
7. Prior to filing the final plat, the sponsor shall demonstrate to the satisfaction of the Regional
Health District that a suitable site for an on-site sewage disposal system is available on
Tract A.

Spokane Regional Heaith District that the existing systems serving the residence located
on tract B is wholly located within the boundaries of the tract. The Spokane Regionai Heaith
District does not have a record of the on-site disposal system for this address.
9. Subject to specific application approval and issuance of permits by the Health Officer,
the use of individual on-site sewage disposal systems may be authorized.
10. The dedicatory language of the plat will state: "Subject to specific application approval and

The Spokane County Engineering Department has reviewed the above referenced application. The
following "Conditions of Approval" are submitted to the Spokane County Planning Department for
inclusion in the "Findings of Fact, Conclusions and 4rder/Decision" should the request be approved.
1. Conditional approval of the plat by the County Engineer is given subject to dedication of right-of-
way and approval of the road system as indicated in the preliminary plat of record.
2. No construction work is to be performed within the existing or proposed Public right-of-way until
plans have been aecepted by the County Engineer and a permit has been issued by the County
Engineer. All work is subject to inspection and approval by the County Engineer.
3. This proposed subdivision or development proposal is located within a drainage basin which has
been identified by the Spokane County Engineer's and Utilities offices as having stormwater
runoff problems. Since this proposed subdivision or development proposal is affected by or is a
contributor to stormwater flows, property owners should participate in the planning and
implementation of a future basinwide stormwater management system.
4. Approach Permits are required for any access to the Spokane County road system.
5. The applicant shall grant applicable border easements adjacent to Spokane County Right of
Way per Spokane County Standards.
6. To construct the road improvements stated herein, the applicant may, with the approval of the
County Engineer, join in and be a willing participant in any petition or resolution which purposes
is the formation of a Road Improvement District (RID) for said improvements pursuant to RCW
36.88, as amended. At such time as an RID is created or any Road Improvement Project is

herein by joining and participating in a County Road Project (CRP) to the extent of the required

resolution method pursuant to RCW 36.88.030, and/or by not filing a protest against the
formation of a RID being formed under the alternative resolution method provided for in RCW
36.88.065 and Chapter 35.43 RCW.
If a RID is proposed for improvement of the road(s) described below, said owner(s) and
successor(s)further agree: (1) that the improvements or construction contemplated within the
proposed RID are feasible and (2) that the benefits to be derived from the formation of the RID
by the property included therein, together with the amount of any County participation, exceeds
the cost and expense of formation of the RI D, and (3) that the property within the proposed RI D
is sufficiently developed; provided, themselves, their heirs, grantees, assigns and successor(s)
shall retain the right, as authorized under RCW 36.88.090, to object to any assessment(s) on
the property as a result of the improvements called for in conjunction with the formation of a RID
by either the petition or resolution method under Chapter 36.88 RCW and to appeal to the
Superior Court the decision of the Board of County Commissioners confirming the final
assessment roll; provided further, it is recognized that actual assessments may vary from
assessment estimate so long as they do not exceed a figure equal to the increased true and fair
value improvement(s) add(s) to the property.
It is further acknowledged and agreed that at such time as a RID is created or any County Road
Improvement project is authorized by Spokane County, the improvements required shall be at
the sole expense of the owner(s) of property within the RID or served by the improvements
without any monetary participation by Spokane County.

The RID waiver contained in this agreement shall expire after ten (10) years from the date of
execution below. This provision is applicable to Liberty Avenue and Dick Road.
9. The County Engineer has designated a Local Access Roadway Section for the improvement of
Liberty Avenue which is adjacent to the proposed development. This will require the addition of
approximately 5-7 feet of asphalt afong the frontage of the development. The construction of
curbing and sidewalk is also required.
10. The County Engineer has designated a Local Access Roadway Section for the improvement of
Dick Road which is adjacent to the proposed development. This will require the addition of
approximately 6-8 feet of asphalt along the frontage of the development. The construction of
curbing and sidewalk is also required.
11. The proposed plat shall be improved to the standards set forth in Spokane County Board of
Commissioners Resolution No. 99-0265, as amended, which establishes regulations for roads,
approaches, drainage and fees in new construction.
12. The County Engineer has examined this development proposal and has determined that the
impact of this proposal upon the existing County Road System warrants the roadway
improvements herein specified.

PURPOSE OF CHECKLIST
The Stare Eavironmencal Policy Acc (SEPA), chapcer 43.21C RCW, requires all governmental agencies
to consider the environmental impacts of a proposal before rnaking decisions. An environmental
impact statement (EIS) musL bc preparcd for all proposals with probable signiFicant adverse impacts on
the quality of the environment. The purpose of chis checklist is to provide information to help you
and the agency identify impact from your proposal (and to reduce or avoid impacts from the proposal,
if iL c:ui be done) and to help the agency decide whecher an EIS is reqwred.
INSTR UCTIOrVS F4R APPLICANTS
This environmental checklist asks you to describe some basic information about your proposal.
Governmental ageacies use this checklist to determine whethec the eavironmeatal impacts or your
proposal are significant, requiring preparation of an EIS. Answer the quesFions briefly: a ith the mosL
precise inEormation known, oz give the besc description you can.
You must answer each question accurately and carefully, to the best of your knowledge. In most
cases, you should be able to answer the questions from your own observations or project plans
wichout the need to hire experes. If you really do not know the answer, or if a question does not
apply to your proposal, write "do noc know" or "does not apply". Complete answers to the questions
now may avoid unnecessary delays later.
Some questions ask about governmental regulations, such as zoning, shoreline, and landmark
designations. Answer these question if you c1n. If you have problems, the governmental agencies can
assist you.
The checklist questions apply to alI pares of yaur proposal, even if you plan to do them over a pe: iod
of time or on different parcels of land. Attach any additional information that will help c3escribe your
proposal or its environmental effects. The agency to which you submit this checklist may ask you to
explain your ans-wers or provide additional information reasonably rclaced to determining if there may
be significant adverse impact.
