While the predominant land uses in the area are single- family residences, higher density residential zoning and uses can be found along University Road near the site and at various locations north and south of the site. The Spokane Transit Authoritv University Park and R.ide facility is located one-balf block north of the subjecl property south of Fourth Awenue. 1'he University City Mall is located at the southwest corner of Spraguc Avenue and University Road, approximately four blocks north of the site. Sprague Avenue is a major east-west traffic comdor in the Spokane Valley area. Projeet Description: Application to rezone a 1.1 acre site to the UR-22 zone for development of 16 multi-family residences. The site plan iUustrates the site divided into four parcels each with a two-story four-plex unit and six parking spaces, plus a total of four extra parking spaces for recreaiional vehicles. Division of the site as configured would require subdivision approval. Access for the easterly two four-plexes would be via University Road, vvhile access for the westerly two four-plexes would be via Oberlin Road. The site will be served with public setiver. C. ZONE RECLASSIFICATION ANALYSIS: In considering a rezone application, Washington case law generally provides that (1) there is no presumption in favor of the rezone, (2) the applicant for the rezone must prove that conditions have substantially changed in the area since the last zoning of the property, and (3) the rezone proposal must bear a substantial relationship to the public health, safety or welfare. Parkridee v. Seattle, 98 Wn. 2d 454, 462 (1978); Biarnson v. Kitsan Countv, 78 Wn. App. 840 (1995). Spok3ne County Zoning Code Section 14.402.020 (1)(2) indicates that consistencv with the Comprehensive Plan, detriment to the public welfare and changed circumstances are relzvant criteria to consider when a site-specific rezone is sought. The proposed rezone must also be consisient with the Spokane County Zoning Code, the State Environmental Policy Act, the County's Local Environmental Ordinance, and other applicable Iand use regulations. Conditions may be imposed to assure the consistency of the proposal with applicable re?ulations. The following findings of fact and conclusions are made: 1. The nronosal eenerallv conforms with the Spokane County Generalized Comprehensive Pian. A county's camprehensive plan provides guidance to the hearing body in makinQ a rezone decision. BelGher v. Kitsao CGuntv, 60Wn. App. 949, 953 ( I 991). Deviation from a comprehensive plan does not necessarily render a rezone illegal, only general conformance is required. Bassani v. Countv Commissioners, 70 Wn. App. 389, 396 (1993). The Building and Planning Division Staff Report found that the application was aenerally consistent with the Comprehensive Plan. The Comprehensive Plan category for the site is LTrban. The Urban category is intended to provide the opportunity for development of a "citylike" environment, which includzs various land uses and intensive residential development served by a high level of public facilities and services (i.e. paved roads, public sewer and water, stornn water systems, police and fire protection and other features). It is primarily a residential category of sinele-familya two-family, multifanuly and condominium buildinQs. The LJrban category also contemplates some neighborhood commercial, light industrial uses, and public and recreational facilities. The Urban category allows for a vast range of residential densities; generally from one unit per acre to 17 units per acre. The category promotes the concept that single-family uses will be isolated from the noise and heavy traffic, while the more intensive uses such as licrht industrial and neighborhood commercial will be located near the heavily traveled streets. Muitifamilv uses will usually (but not always) be atransitional use located between single-family residential and more intensive areas. The Urban categorv indicates that the base net density for multi-family dwellin~ areas ma~~ be increased beyond 17 dwellinQ units per acre through "bonus allowances" or "bonus densities", within developed areas where utilities, arterials, schools, and communitti• facilities have alreadv been established. Comprehensive Plan, Decision Guideline 1.1.2. HE Findinas, Conclusions and Decision 7,E-17-96 payz 3 . ~ The Urban Residential-22 (UR-22) zone generally provides for residential densities up to 22 units per acre. Under certain circumstances, the Zoning Code ailows "bonus densities" in the UR-22 zone for multifamily housing up to 27 dwelling units per acre. Zoning (;ode Chapter 14.820. In this case, the applicant proposes to rezone a 1.1. acre site to the UR-22 zone to allow development of 16 dwelling units at a density of approximately 13 units per acrc. This is well within the density range recormmended in the Urban categary and considerably less than the maximum residential density allowed in the UR-22 zone. The purpose and intent section of the UR-22 zone, Zoning Code 14.622.100, states as follows: The purpose of the UR-22 Zone is to sei standards for the orderly deveiapment of residential property in a manner that provides a desirable living environment that is compatible with surrounding land uses and assures the protection of property values. It is intended that this zone be used to add to the variety of housing types and densities, and as an implementation tool fnr the Comprehensive Plan Urban Category. General characteristics of these areas include paved roads, public sewer and water, accessibility to schools and libraries, and a full line of public senrices including manned fire protection and public transit accessibility. Offices are perrnitted in the UR-22 zone in orcier to provide some of the service needs generated by high-intensity land uses. The hi2hest densitv residential zone. [Emphasis added] The proposal implement.s the locational criteria for multi-family housing in the UR-22 zone beeause it is located along a Principal Arterial, a major arterial, and is close to public transit facilities. The Urban catejorv of the Comprehensive Plan indicates that higher-densit _y developments such as multi-family dwelling areas should be located with near or direct access to thz major arterial systems rather than on interior neighborhood streets". Comprehensive Plan, Objective l. l.b. Decision Guideline 1.1.3 of the Urban category recommends that multi-family dwelling structures exceeding three dwelling units be located adjacent to designated arterials, and also near existing or planned public transit routes. `Vhilz the westerly half of the project accesses onto local access streets, traffic can teadily access Universifiy Road within a few blocks by proceeding either (a) south on Oberlin Road ane bloek. then east on 61" Avenue for one block, or (b) west on 5h Avenue for one block, south on Ravmond for one block, then easi on 6~' Avenue for two blocks. It is also significant that the applicant is not proposing the extension of 5~' Avenue through the site to University, which could subject the residential neighborhood west of the site to even more traffic than the proposal «ould generate. There is no indication in the record that the local access streets to the tivest cannot support the additional traffic from the proposal. The proposal is also located close to employment, shoppin~ and major transportation, as recommended for multi-family housing in the UR-22 zone. The site is also located in an area aloncy IJniversity Road south oFSpralaue Avenue tbat is in transition from single-farnily residential uses to higher density housing, office uses and neighborhood commercial uses. The HE Findinas, Conclusions and Decision ZE-17-96 pa`e 4 . property immediately north of the site is zoned UR-22 and is improved with a community residential facility, which property extends the same distance west of University Road as the current site. Further to the north along the west side of University Road is ]aod zoned UR-22 and Regional Business (B-3). The property inunediately south of site is zoned UR-3.5 but is used for a hair salon. Furiher to the south on the west side of University Road, between 6'" Avenue and 8' Aveaue, is a parcel zoned Urban Residential-7 (UR-7). Directly across from the site, along the east side of University Road, is land zoned UR-22. The proposal also implements the policies of the Urban category which promote fill-in development in established development areas having adequate power supplies, water, sanitary sewer and drainage systems, arterials and community facilities have been established. See Comprehensive Plan, Objective l.l.a and Decision Guidelines 1.1.1 and 1.1.2. The proposal is within an estabiished development axea where utilities, arterials, schools and community facilities already exist. The area around the siie has already been developed for residential purposes. The applicant is wilUng to enter into a voluntary agreement with the school district to mitigate the impact of the proposal on schools. Balfour Park is located less than a mile north of the site, and University High School with its considerable playfields is less than a mile south of the proposal. The referenced Urban category policies encourage higher density residential development where the fill-in eriteria is met, to economically support public service systems by increasing the cost-effectiveness of extending utilities and public sewer and facilicies, and to lunit new unsewered development over the Spokane Aquifer. See Comprehensive Pian, Glossary, definition of "fill-in development". The higher density requested by the applicant will facilitate the extension of public sewer and water to the site. The project is located within the Aquifer Sensitive Area, where the extension of public sewer is highly encoura~ed. Objective 1.5.e of the Urban category states that when a neighborhood experiences pressure for change in character, such change shall be permitted upon appropriate review. Objective l. l.c and Decision Guideline 1.1.3 of the Urban category indicate that when multi-family dwellings are located adjacent to single-family areas, careful consideration must be givea to the density and designs of the multi-family development to ensure protection of the amenities of the single-family areas. Objective 1.5.f states that the prof le, especially the height of the • existing neighborhood should be considered when evaluating multi-family developments. The structural height of the proposal, in relation to the structure height of nearby structures, and whether new structures witl have a positive or negalive impact upon a neighborhood's architectural character, are considered important factors in this regard. See Comprehensive Pla.n, Decision Guideline 1.5.8. The proposal generally implements the above-referenced policies. The density of the project is much low•er than the maximum residential density pennitted in the UR-22 zone. The site plan indicates the height of the four-plex buildings at nvo stories, and the HearinQ Examiner has limited the building height of such structures to 23 feet. The Hearing Examiner has also added a requirement that a six-foot-hi?h sight obscuring fence as required by Section 14.622.365 be shown along the west property line of the proposal, adjacent to the adjacent Urban Residential-3.5 zone. Thz residential neighborhood wesE of the site is an older neighborhood, and could experience some renewal from development of the project. The design of the proposal also keeps parl:ing and circulation to the interior of the site. HE Findings, Conclusions and Decision ZE-17-96 pa, gg e 5 i . , 2. Conditions in the area in which the propertv is located have chanRed substantiallv since the pronertv was last zoned. In applying the changed circumstances test, courts have looked at a variety of factors, including changed public opinion, changes in land use patterns in the area of the re7one proposal, and changes on the property itself. The Zoning Code references changes in "econnmic, technological or land use conditions" as factors that arill support a rezone. Spokanz Caunty Zoning Code Section 14.402.020 (2). Washington courts have not required a"strnn.P" showina of change. The rule is flexible, and each case is to be judgred on its own facts. Bassani v. Countv Commissioners. 70 Wn. App. 389, 394 (1993). Recent cases have held that changed circumstances are not required for a rezone if the proposed rezone implements policies of a comprehensive plan. Biarnson. at 846; Save Our Rural Environment v. Snohamish Countv, 99 Wn.2d 363, 370-371 (1983). A number of changes have occurred in the area that support the rezone proposal. The last zoning of the properiy may be considered as the original zoning of the property in 1958 under the County Zoning Ordinance, since the area -wide rezone that took place in Spokane County under the Zoning Code between 1986 and 1991 was not site speci5c. Such changed conditions include the extension of public sewer to the area supportive of higher density housing, the wideninu of University Road south of Sprague Avenue to four lanes, and increased growth in the Spokane Valley area. 3. SP-1221-99 ) CONCLUSIONS AND DAVID KATCHER ) DECISION THIS MATTER, an appiication for subdivision of land from David Katcher has been received and was decided upon, pursuant to Spokane County Subdivision regulations, on the 29' day of November, 1999. FINDINGS OF FACT AND CONCLUSIONS 1. The individual signing below has further been properly delegated the responsibility for rendering the decision by the Director of Spokane County Division of Building and Planning. 2. The proposa) is to divide approximately .94 acres into 3 residential lots. : . 3. The proposal is located west of, and adjacent to, University Road, approximateiy 400 feet south of 4"' Avenue in the Northeast Y< of Section 20, Township 25 North, Range 44 E.W.M., Spokane County, Washington. The proposal is more commoniy known as Parcel No. 45201.1030 or 512 South University Road. 4. The existing zoning of the property described in the application is Urban Residential-22 (UR-22), which was established through ZE-17-96. Previously, the zoning of the property was Urban Residential-3.5 (UR-3.5), which was established 1991. A boundary (ine adjustment was applied for and approved through CE-247-99, increasing the property size from .73 acres to .94 acres, on June 16, 1999. Pursuant to Revised Code of Washington (RCW) 58.17.195, this propasal conforms to the requirements of the existing UR-22 zone. 5. The Spokane County Comprehensive Plan designates this area as Urban. The development and uses, as proposed and conditioned, are in compliance with the Urban category. 6. Surrounding uses are primarily residential. 7. The Spokane County Arterial Road Plan identifies University Road as a Principfe Arterial Road with a future right-of way width of 100 feet. The existing right-of-way width varies from 36.5 feet to 40.7 feet, measured from centerline. In order to implement the Arterial Road Plan, a strip of property varying from 13.5 feet to 9.3 feet in width along the University Road frontage should be set aside in reserve. Therefore, as conditioned (such as improvements, dedication, sidewalks and acquisition areas) the proposal conforms to the Road Plan. 8. The proposed site is located within the Public Transportation Benefit Area (PTBA). The Spokane Transit Authority (STA) provides connecting services to the site the intersection of 4'" Avenue and University Road, the Valley (Pence Cole) Transit Center. 9. The proposed short plat will be served by a public water system, being Modern Electric Water Company. Wastewater disposal will be as authorized by the Director of Spokane County Division of Utilities. 10. The required public notice was provided for this proposal and agencies having a potential interest in the project were notified and recommendations solicited. 11. Recognizng the recommended conditions and Spokane County development standards, the proposed r short plat makes appropriate provisions for the public health, safety and general welfare and that the public use and interest will be served by platting the subdivision. The subdivision proposal is generally consistent with RCW 58.17 and the County subdivision regulations, promoting the public health, safety and general welfare in accordance with standards established by the State and Spokane County. The County Division of Building and Planning has considered the provision of adequate pubiic facilities as cited in RCW 58.17.110 (2). More specifically: a. open spaces f. sanitary waste disposal b. drainage ways g. parks and recreation facilities c. public and/or private right-of-ways h. playgrounds d. transit i. schools and school grounds e. potable water j. sidewalks 12. The project is exempt from environmental review under the State Environmental Policy Act pursuant to WAC 197-11-800 (6) (a). 13. The Centra( Valley School District No. 356, Stormwater Utility, Spokane County Fire District No. 1, Modem Electric Water Company, Spokane Regional Transportation Council, and the Boundary Review Board were all sent notification of the project on October 15", 1999. No responses have been received. DECISION Based upon the above noted Findings of Fact and Conclusions, Short Plat Application SP-1221-99 is hereby APPROVED for five (5) years, specifically to November 29, 2004 and subject to conditions noted below. This decision is final unless appealed in writing, consistent with adopted appeal procedures. CONDITIONS OF APPROVAL All the below conditions imposed shall be binding on the "Applicant," which term shall include the owner or owners of the property, heirs, assigns and successors. SPOKANE COUNTY DIVISION OF BUILDING AND PLANNING 1. The proposal shall comply with the Urban Residential-22 (UR-22) zone and other applicable Zoning Code chapters, as amended. 2. The final short plat shall be designed substantially in conformance with the preliminary plat of record. No increase of density or number of tracts shall occur without a change of condition application submittal and approval. 3. The preliminary short plat is given conditional approval for five (5) years, specifically to November 29'", 2004. The applicant may submit an extension of time application approximately forty-five (45) days prior to the above expiration date. Application(s) for extension of time shall be processed under the provisions of Chapter 12.100.118 (Extension of Time) of the Spokane County Subdivision Ordinance. If the applicant complies with the criteria of Chapter 12.100.118, the preliminary approval and conditions will be changed to reflect the adopted policy and development regulations at the time of the extension application. Findings and Decision SP-1221-99 2 4. Prior to filing the final short plat, the applicant shall submit to the County Division of Building and ' Planning Director/designee for review any proposed final short piats to ensure compliance with these Findings and Conditions of Approval. 5. A survey is required of the subject property prior to filing the final short plat. 6. Appropriate road names and street addresses shall be indicated on the final short plat map. 7. Appropriate utility easements shall be indicated on the final short plat map. Approval of utility easements by utility companies must be received prior to filing the final short plat. 8. The dedication shall contain the following statement: "Setbacks shall be determined at the time building pernnits are requested. The setbacks may be varied from if proper zoning or variance approvals are obtained." 9. Four (4) current Certificates of Title shall be fumished to the County Division of Buiiding and Planning prior to filing the final short plat. SPOKANE COUNTY OIVISION OF ENGINEERING AND ROADS 1. Conditional approval of the plat by the County Engineer is given subject to approval of the road system as indicated in the preliminary plat of record. 2. This short plat shall comply with Zone Reclassification File No. ZE-17-96. 3. Any building permit applications on this property shall be required to meet the version of the Spokane County Guidelines for Stormwater Management. Following plan acceptance by the Spokane County Engineer or before the final pla# is drafted, drainage language will be drafted by Spokane County and provided to the Sponsors Engineer or Surveyor for inclusion with the final plat document. 4. This proposed subdivision or development proposal is located within a drainage basin which has been identified by the Spokane County Engineer's and Utilities offices as fiaving stormwater runoff problems. Since this proposed subdivision or development proposal is affected by or is a contributor to stormwater flows, property owners should participate in the planning and implementation of a future basinwide stormwater management system. 5. The proposed plat shall be improved to the standards set forth in Spokane County Board of Commissioners Resolution No. 99-0265, as amended, which establishes regulations for roads, approaches, drainage and fees in new constnuction. 11. SPOKANE COUNTY DIVISION OF UTILITIES 1. The dedication shall state: "Public sewers shall be constructed to provide for the connection of each parcel to the County's system of sewerage. Uses on properties within the project shall be required to connect to the sewer and pay applicable charges per the County Sewer Ordinance. Sewer connection permits shall be required.° 2. The dedication shall state: "lndividual tracts shall be subject to payment of current applicable sewer connection charges and/or general facilities charges prior to the issuance of a sewer connection permit." 3. Applicant shall submit expressly to Spokane County Division of Utilities "under separate cover', only those plan sheets showing sewer plans and specifications for the public sewer connections and facilities for review and approval. Commercial developments shall submit historical and or estimated water usage as part of the sewer plan submittal. 4. Sewer plans acceptable to the Division of Utilities shall be submitted prior to the finalization of the project. 5. Arrangements for payment of applicable sewer charges must be made prior to issuance of sewer connection permit. Sewer charges may include special connection charges and general facilities charges. Charges may be substantial depending upon the nature of the development. 6. Any water service for this project shall be provided in accordance with the Coordinated Water System Plan for Spokane County, as amended. Findings and Decision SP-1221-99 4 • SPOKANE REGIONAL HEALTH DISTRICT . 1. The final plat shall be designed as indicated on the preliminary plat of record and/or any attached sheets as noted. 2. Appropriate utility easements shall be indicated on the final plat of record for distribution by the County Division of Building and Planning to the utility companies, Spokane County Engineer, and the Spokane Regional Health District. Written approval of easements by the utility companies shall be received prior to the submittal of the final plat 3. Sewage disposal method shall be as authorized by the Director of the Spokane County Division of Utilities. 4. Water service shall be coordinated through the Spokane County Division of Utilities. 5. Water service shall be by an existing public water supply when approved by the Regional Engineer (Spokane), State Department of Health. 6. Prior to filing the final short plat, the sponsor shall demonstrate to the satisfaction of the Spokane Regional Health District that an adequate and potable water supply is available to each tract of the ptat. 7. Prior to filing the final short plat, the sponsor shall present evidence that the plat lies within the recorded service area of the water system proposed to serve the plat. 8. A public sewer system will be made available for the plat and individual service will be provided to each tract prior to sale. Use of individual on-site sewage disposal systems shall not be authorized 9. The final short plat dedication will contain the following statement: "The public water system, pursuant to the Water Plan approved by County and State Health authorities, the local Fire District, County Division of Building and Planning, and water purveyor, shall be installed within this subdivision, and the applicant shall provide for individual domesuc water service as well as fire protection to each tract prior to sale of each tract and prior to issuance of a building permit for each tract." 10.
