Plat Dedication
The property owners within this plat shall be held responsible for keeping open and
maintaining the surface path of natural or man-made drainage flow over and across
their respective properties. If the property owner(s) fails to maintain the surface path of
natural or man-made drainage flow, or the drainage swale, a notice of such failure may
be given to the property owner(s). If not corrected within the period indicated on said
notice, Spokane County has the right to correct the maintenance failure, or have it
corrected, at the expense of the property owner.
There may exist properties located uphill and adjacent to this subdivision which
periodically discharge stormwater runoff onto individual Iots within this plat. Runoff
from nearby uphill properties should be expected, and during snowmelt periods or wet
seasons the lots may be subjected to higher amounts of stormwater runoff that what is
normally observed or anticipated. Because stormwater runoff from adjacent properties
have discharged onto this plat prior to development, stormwater runoff will likely
continue to do so after development. It is the responsibility of the individual lot owners
to maintain existing surface paths of runoff through their respective lots and to grade
the lots in accordance with applicable rules and regulations, so as to prevent property
damage.
Any building that is constructed on a Iot in this plat shall be set at such an elevation so
as to provide positive drainage away from any drainage entry point to the building
(including but not limited to a window well, a window unprotected by a window well, or a
doorway). Said positive drainage shall consist of a minimum slope of 3% away from
the building for a distance of at least 10 feet from the building. The lots shall be graded
so that either a) all runoff is routed away from the building, and conveyed over the lot to
a natural drainage swale or approved drainage facility, or b) drainage intercepted on
the lot is disposed of on the lot in an approved drainage facility. The approved
drainage facility shall be constructed in accordance with any appticable accepted plans
on fle at the County Engineer's Office. Any revisions to the accepted drainage plans
must be accepted by the County Engineer's Office prior to construction of said
revisions.

DECISION
THIS MATTER, an application for preliminary short subdivision approval from Colvin Harwood
Properties has been received and was decided upon, pursuant to Spokane County Subdivision
regulations, on the 18th day of February, 2000.
FiNDINGS OF FACT AND CONCLUSIONS
1. The individual signing below has been properly delegated the responsibility for rendering
the decision by the Interim Director of Spokane County Division of Current Planning.
2. The application proposes to short subdivide 49,971 square feet of property into four (4)
single family residential tracts. Specifically, the applicant is proposing that each tract be
occupied with a single family dwelling and associated accessory structures.
3. The project is located in the NE of Section 17, Township 25 North, Range 44 EWM
located, generally near the northeast comer of the intersection of Felts Road and
Broadway Avenue.
4. The existing ioning of the property is Urban Residential-3.5 (UR-3.5) which was
established in 1991 upon implementation of the new Spokane County Zoning Code. The
conditions of prefiminary approval specified below require that development of the lots be
limited to one single family residence per tract due to the operation of the density
requirements of the County Zoning Code. Pursuant to Section 58.17.195 of the Revised
Code of Washington (RCV1/), this proposal, together with the application of the conditions
of preliminary approval specified herein, confomns to the requirements of the existing
zone.
5. The Spokane County Comprehensive Plan designates this area as Urban. The
development and uses proposed for this short subc•'vision and conditions attached thereto
are in accordance with the Urban land use Category. The Urban category is intended to
provide the opportunity for development of a"citylike° environment with intensive
residential development including single family, two-family, and multi-family dwellings.
The Urban category also promotes "fiil-in° development in areas with public services
available such as water, sewer, storm sewer, transft and fire protection. This proposed
short subdivision will have public water, police, fire protection and public transit services.
The Short Subdivision is also consistent with the Spokane County lnterim Urban Growth
Area requirements as set forth in Spokane County Resolution 97-0321 and RCW 36.70A,
the Washington State Growth Management Act. This proposal is compatible with the
surrounding uses, which are primarily single family residential.
6. The subdivision site is served by Broadway Avenue and Felts Road. Tract A will
have direct access to Broadway Avenue and Tracts B, C and D wili be accessed ii ui-r1
Feits Road. The Spokane County Arterial Road Plan identifies Broadway Avenu~ ~
Principal Arterial without controlled access. The Plan recommends that Broadway Averis re
have 100 feet of right-of-way width. The existing road dght-of-way width is 60 fooi
Insufficient right-of-way exists for this Principal Arterial at the subdivision site. Felts Road
is designated a Local Ac,cess Roadway and its paved surface width at the location of ihe
subdivision site is less than county standards.
7. The short subdivision site is Iocated within the Public Transportation Benefit Area (PTBA).
The Spokane Transit Authority (STA) Route 94 (Spokane Valley Route) provides services
directly to the subdivision site.
8. The short subdivision site is served by the water system owned and operated by Modern
Electric Water Company. The Company will provide adequate water to meet the potable
and fire flow needs of the subdivision.
9. The Spokane County Sewer System will serve the wastewater disposal needs of the
subdivision, as it currently has a sewer collection line with adequate capacity serving the
subdivision site.
10. The required public notice of the proposed short subdivision and comment period was
provided for consisient with the Spokane County Subdivision Code. In addition, those
agencies having a potential interest in the proposal and adjacent property owners were
notified and their comments solicited. One comment from an adjacent landowner was
received stating that there are already too many homes in the area. 11. In consideration of the application of performance conditions specified below and the
application of Spokane County development standards, the proposed Short Subdivision
makes appropriate provisions for the public health, safety and general welfare and that the
public use and interest will be served by short subdividing the subject land parcel. The
short subdivision proposal is generally consistent with Washington State Subdivision
Statute RCW 58.17 and the Spokane County Subdivision Ordinance. The County Divisian
of Current Planning has considered the provision of adequate public facilities as cited in
RCW 58.17.110(2). More specifically:
a. open spaces f. sanitary waste disposal
b. drainage ways g. parks and recreation facilities
c. public and/or private right-of-ways h. playgrounds
d. transit i. schools and school grounds
e. potable water j. sidewalks
12. The short subdivision is exempt firom the environmental review requirements under the
State Environmental Policy Act pursuant to WAC 197-11-800 (6) (a).
13. The proposal is within the Aquifer Sensitive Area (ASA). The Spokane County Guidelines
for Stormwater Management require that impervious areas within the ASA must drain to
grassed percolation area (GPA) swales so that impurities in the water are filtered out before
the water enters the underfying aquifer. The underiying aquifer is the sole source of
potable water for almost all of the greater Spokane urban area.

14. The short subdivision site is located within a drainage basin which has been identified by
the Spokane County Engineer's and Utilities offices as having stormwater runoff problems.
14. Tract B has 27 feet of frontage on Felts Road. The County Zoning Code requires 80
feet of frontage. In order for Tract B to be approved in its current proposed
confrguration the applicant must successfully obtain an administrative exceptien from
the Division of CuRent Planning pursuant to Section 14.504.020 (6)(c). The preliminary
approvaf of this short subdivision granted in this document does not constitute approval
ot the substandard lot frontage pertaining to Tract B.
16. Condition 12 below in the County Engineer and Road Section of this document
requires reserving the front 20 feet of Tract A for future road construction. It is
necessary and appropriate in furtherance of the public health and safety that the
building front yard setback required in Section 14.616.325(A) be measured from the
boundary of said road reserve area. Once said building front yard setback is
established on the final short plat the existing single family home will be in
noncompliance with this setback. Further improvements of the existing dwelling that
cause it to expand into the required front yard setback shall not be permitted.
DECISION
Based upon the above noted Findings of Fact and Conclusions, Preliminary Short Subdivision
Application SP-1222-99 is hereby APPROVED for five (5) years, specifically to February 18,
2005 and subject to conditions specified below. This decision is final unless appealed in writing,
consis#ent with appeal procedures set forth in County Subdivision Ordinance, Section
12.100.126.
CONDITIONS OF APPROVAL
All the below conditions imposed shall be binding on the "Applicant,° which term shall include
the developer, owner or owners of the property, heirs, assigns and successors.
SPOKANE COUNTY DIVISION OF CURRENT PLANNING
1. The proposal shall comply with the Urban Residential-3.5 (UR-3.5) Zone and all other
applicabie County Zoning Code requirements and the Spokane County Subdivision
Ordinance.
2. The final short plat shall be designed substantially in conformance with the preliminary
short subdivision of recard. Only one (1) single family dwelling and associated accessory
structures, consistent with the County Zoning Code, are permitted on each tract. No
increase of density or number of tracts shall occur without a change of conditions or
preliminary subdivision application submitted and approved consistent with the
requirements of the County Subdivision Ordinance.
3. The preliminary short subdivision is given conditional preliminary approval for five (5) years,
specifrcally to February 18, 2005. The applicant may submit an extension of time

application thirty (30) days prior to the above expiration date. Application(s) rr, ,
of time shall be processed under the provisions of Chapter 12.100.118 (Exter - `
of the Spokane County Subdivision Ordinance. If the applicant complies with rr
Chapter 12.100.118, the preliminary approval extension will be granted ai
attached to preliminary subdivision approval will be changed to reflect the ado;,
and development regulations applicable the date the time extension aPP11GJt,L ,
submitted.
4. Prior to fiiing of the final short plat, the applicant shall submit to the County ')ir►i=;ic i1Current Planning for review the proposed final plat to ensure compliancE

5. Four (4) current certificates of title shall be fumished to the County Division of Ctirrerit
Planning prior to filing of the final plat.
6. A survey is required of the subject property and the tracts therein prior to filing of the final
short plat.
7. Appropriate road names and street addresses shall be indicated on the final shart plat map.
8. Appropriate utility easements shall be indicated on the final short plat map. Written
approval of utility easements by utility purveyors must be received prior to filirig of the final
short plat by the Division of Current Planning.
9. The dedication shall contain the following s#atement: "Side yard and rear yard setbacks
shall be determined at the time building permits are requested."
10. The Spokane County Division of Current Planning shall prepare and record with ihe
Spokane County Auditor a"Title Notice" noting that the property in question is subject
to a variety of special conditions imposed as a result of the land use action herein.
This "Title Notice" shall serve as official public notice regarding conditions of approval
affecting the property in question. The "Title Notice" shall be recorded within fifteen
(15) days of Final Plat approval and shall only be extinguished by the Spokane County
Division of Current Pfanning.
11. The private ddveway serving Tracts B, C and D shall be constructed in substantial
conformance with the standards established by the Division of Building and Code
Enforcement, Spokane County.
12. The Spokane County Division of Current Planning shall prepare and record with the
County Auditor a Title Notice and shall be released, in full or in part, only by the Divisian af
Current Planning. The notice should be recorded within the same time frame as an appeal
of the approval granted herein and shall provide the following:
a. At least twenty (20) feet of future acquisition area is reserved on Tract A adjacent to
and parallel to Broadway Avenue for road right-of-way and utilities.

b. Future building front yard setbacks required by the Spokane Zoning and
Development Codes shall be measured from the reserved future acquisition area as
depicted on the finai short plat map.
c. No required landscaping, parking, '208' drainage areas, drainfield or allowed signs
should be located within the future acquisition area for road right-of-way and
utilities. If any of the above improvements are made within this area, they shall be
relocated at the applicant's or tract owner expense when roadway improvements
are made.
d. The future acquisition area, until acquired, shall be private property and may be
used as allowed in the zone, except that any improvements (such as landscaping,
parking, surface drainage, drainfield, signs and others) shafl be considered interim
uses.
e. The property owner shall be responsible for relocating such "interim" improvements
at the time Spokane County makes roadway improvements after acquiring said
future acquisition area.
13. The eastern boundary of the turnaround terminating the private road serving Tracts, 6,
C and D shall be extended north 21 feet to assure that Tract D complies with the
minimum lot frontage of 80 feet required in Section 14.616.315 of the County Zoning
Code.
14. The applicant shall satisfy the !ot frontage requirement in Section 14.616.315 of the
County Zoning Code pertaining to Tract B prior to final short plat approval. This
condition may be satisfied by applying for and receiving an administration exception
pursuant to Section 14.504.020(6)(c). Since access to Broadway Avenue is denied for
Tracts B, C and D the administration exception is the only option available to satisfy
the minimum frontage requirement for Tract B.
15. The Preliminary Short Subdivision erroneous{y specifies that 20 feet exists between
the centerline of Broadway Avenue and the front lot tine of Tract A. The actual
distance is 30 feet and this distance shall be accurateiy depicted on the final plat map.
16. The final plat map shall c?early show the location of the front yard set back line as
required by the County Zoning Code, Section 14.616.325(A). Said setback line shall
be measured from the boundary of the future road reseroe area as required by the
County Division of Engineering Roads below in condition 12. All future construction
on Tract A shall not encroach on the required seiback area.
SPOKANE COUNTY DIVISION OF ENGINEERING AND ROADS
1. Conditional approval of the plat by the County Engineer is given subject to approval of the
road system as indicated in the preliminary short plat of record.

2. No construction work is to be perfoRned within the existing or proposed public riyi; .
until plans have been accepted by the County Engineer and a permit has been
the County Engineer. A!I work is subject to inspection and approval by thE°
Engineer.
3. Approach Permits are required for any access to the Spokane County road system.
4. Direct access to Broadway Avenue is allowed for Tract "A" as shown on the prEfl;
plat. Tracts "B", "C" and "D° shall take direct access to Felts Road via the ingress/E9.,m
easement as shown on the preliminary short subdivision.
5. The applicant shall grarrt applicable border easements adjacent to Spokane County
of Way per Spokane County Standarcis.
6. To construct the road improvements stated herein, the appticant may, with the approval of
the County Engineer, join in and be a willing participant in any petition or resolution which
purposes is the formation of a Road Improvement District (RID) for said impravenierits
pursuant to RCW 36.88, as amended. At such time as an RID is created or any Roaci
Improvement Project is sanctioned by Spokane County, the improvements requirFd (ctir b,
sidewalk, drainage control and paving to existing pavement) will be at the sole expF, risE. oi
the undersigned owner, their heirs, grantees and assigns. This provision is applicable tn
Felts Road.
7. As an altemative method of constructing the road improvement stated herein, the applicant
may, with the approval of the County Engineer, accomplish the road improvements stated
herein by joining and participating in a County Road Project (CRP) to the extent of the
required road improvement. At such time as an RID is created or any Road Impravement
Project is sanctioned by Spokane County, the improvements required (curb, siclewalk,
drainage control and paving to existing pavement) will be at the sole expense af the
undersigned owner, their heirs, grantees and assigns. This provision is applicable to Felts
Road.
8. The following statements shall be placed in the dedicatory language of the final plat:
"The owner(s) or successor(s) in interest agree to join in any County-approved stormwater
management program and to pay such rates and charges as may be fixed through public
hearings for service or benefit obtained by the planning, design, constructing, maintaining
or operation of stormwater control facilities."
"No direct access shall be allowed from Tracts "B", uCu and °D" to Broadway Avenue."
That in consideration of Mutual Benefrts now or to be hereafter derived, do for themselves,
their heirs, grantees, assigns and successor(s) in interest hereby request and authorize
Spokane County to include the above described property in a Road Improvement Uistrict
(RID) and to support the formation of a Road Improvement District for improvement of the
road(s) described below by requesting and authorizing Spokane County to place their
name(s) on a petition for the formation of a Road Improvement Disirict pursuant to RCW
36.88.050, or by requesting and authoriiing Spokane County to cast their ballot in favor of
a RID being formed under the resolution method pursuant to RCW 36.88.030, andlor by not

filing a protest against the formation of a R1D being formed under the aiternative resolution
method provided for in RCW 36.88.065 and Chapter 35.43 RCW.
If a RID is proposed for improvement of the road(s) described belaw, said owner(s) and
successor(s)further agree: (1) that the improvements or construction contemplated within
the proposed RID are feasible and (2) that the benefits to be derived from the formation of
the RID by the property included therein, together with the amount of any County
participation, exceeds the cost and expense of formation of the RID, and (3) that the
property within the proposed RID is sufficiently developed; provided, themselves, their
heirs, grantees, assigns and successor(s) shall retain the right, as authorized under RCW
36.88.090, to object to any assessment(s) on the property as a result of the improvements
I called for in conjunction wfth the formation of a RID by either the petition or resolution
method under Chapter 36.88 RCW and to appeal to the Superior Court the decision of the
Board of County Commissioners confirming the final assessment roll; provided further, it is
recognized that actual assessments may vary from assessment estimate so long as they do

9. The County Engineer has designated a Local Access Roadway Section for the improvement
of Felts Road which is adjacent to the proposed development. This will require the addition
of approximately 5-7 feet of asphalt along the frontage of the development. The
construction of curbing and sidewalk is also required.
10. The proposed plat shall be improved to the standards set forth in Spokane County Board of
Commissioners Resolution No. 99-0265, as amended, which establishes regulations for
roads, approaches, drainage and fees in new construction.
11. The County Engineer has examined this development proposal and has determined that the
impact of this proposal upon the existing County Road System warrants the roadway
improvements herein specified.
12. The County Arterial Road plan identifies Broadway Avenue as a Principal Arterial requiring a
right-of-way width of one hundred (100) feet. The existing one half right of way width
measured from centerline of 30 feet is not consistent with that specified in the plan. In order
to implement the Arterial Road Plan a strip of property 20 feet in width along the Broadway
frontage shall be set aside in reserve and shall be depicted on the frnal short plat map. This
property may be acquired by Spokane County at the time when arterial improvements are
made to Broadway Avenue.

13. The applicant should be advised that there may exist utilities either underground or av., : c rt : id
affecting the applicants property, including property to be dedicated or set asicir,
acquisition. Spokane County will assume no financial obligation for adjustnrr•il,
relocation regarding these utilities. The applicant shouid check with the applicable
and Spokane County Engineer to determine whether the applicant or utility is respon~
adjustment or relocation costs and to make arrangements for any necessary work.
14. A Professional Engineer, licensed in the State of Washington, shall submit final road ~i 0
drainage plans as may be applicable in accordance with the plat conditions af appraval, a
drainage report and calculations that conform to the current 1999 standards and laws
governing road design and/or stormwater management in Spokane County. Final drainage
plans and a drainage report shall receive the County Engineer's acceptance prior to release
of a construction or building permit, or approval of the land action. Following plan
acceptance by the Spokane County Engineer, drainage language will be drafted by
Spokane County and provided to the Sponsor's Engineer or Surveyor for inclusion wiih ihe
final plat document.
15. The applicable stormwater management systems and roads for this short subdivision shall
be constructed and certified to be constructed in accordance with the accepted road and
drainage plans, or all the required improvements must be bonded for in accordance wEih
Spokane County regulations, prior to the recording of the final short plat. Record drawinys
and all construction docurnentation shall be submitted with the proper certification
statement.
16. This proposed short subdivision is located within a drainage basin which has been identified
by the •Spokane County Engineer's and Utilities offjces as having stormwater rurioff
probfems. Slnce this proposed subdivision is affected by or is a contributor to stormwater
flows, property owners should participate in the planning and implementation of a future
basinwide stormwater management system. The following statement shall be placed ir1 the
plat dedication:
"The owner(s) or successor(s) in interest agree to join in any County-approved
stormwater management program and to pay such rates and charges as may be fixed
. through public hearings for service or benefit obtained by the planning, design,
constructing, maintaining or operation of stormwater control facilities."
SPOKANE COUNTY DIVISION OF UTILITIES I
1. The final short plat's dedication language shall state: Public sewers shall be
constructed to provide for the connection of each parcel to the County's system of
sewerage. Uses on properties within the project shafl be required to connect to ihe
sewer and pay applicable charges per the County Sewer Ordinance. Sewer connection
permits shall be required.
2. The dedication shall state: Individual tracts shall be subject to payment of current
applicable sewer connection charges and/or general facilities charges prior to the issuance
of a sewer connection permit.

3. The Applicant shait submit to Spokane County Division of Utilities "under
separate covee", only those plan sheets showing sewer plans and specifications fc,
public sewer connections and facilities for review and approval.
4. Sewer plans acceptable to the Division of Utilities shall be submitted prior to the
finalization of the project.
5. Water service for this project shall be provided in accordance with the Coordinated Mir, s•
System Plan for Spokane County, as amended. Water service shall be coordinated
through the Director of Utilities, Spokane County.
SPOKANE REGIONAL HEALTH DISTRICT
1. Prior to recording the fina,l short plat, the applicant shall demonstrate to the satisfaction of
the Spokane Regional Health District that an adequate and potable water supp{y is
available to each tract of the short subdivision.
2. Prior to recording the final short plat, the applicant shall present evidence that the plai lies
within the recorded service area of the water system proposed to serve the plat.
3. A plan for water facilities adequate for domestic use, domestic irrigation use and fire
protection use shall be approved by the water purveyor. Said water plan must have Vol I
approved by the fire protection district and the appropriate health authorities. The health
authorities, water supplier (purveyor) and the fire protection district will certify, prior to
recording the final short plat, on the face of said water plan that the plan is in confarrnance
with their requirements and will adequately satisfy their respective needs. Said water plan
and certification will be drafted on a transparency suitable for reproduction.
4. The purveyor will also certify prior to recording the final short plat on a copy of said water
plan that appropriate contractual arrangements have been made with the plat applicant for
construction of the water system, in accordance with the approved plan and time schedule.
The time schedule will provide, in any case, for completion of the water system and
inspection by the appropriate health authorities prior to appfication for building permits
within the plat. The contractual arrangements will include a provision holding Spokane
County, Spokane Regionel Health District and the purveyor harmless from claims by any
trac# purchaser refused a building pennit due to failure of the plat applicant to satisfactorily
complete the approved water system.
5. A public sewer system will be made available for the plat, and individual service will be
provided to each tract prior to sale. Use of individual on-site sewage disposal systems
shall not be authoriied.
6. The final short plat shall contain the following statement: "A public sewer system will be
made available for the plat, and individual service will be provided to each tract prior to
sale. Use of individuaf on-site sewage disposal systems shall not be authorized."
7. Water service shall be by an existing public water supply when approved by the County
Engineer and the State Department of Health. The final short plat dedication shall contain
the following statement: "Use of private wells and water systems is prohibited."

The Spokane County Engineering Department has reviewed the above referenced application. The
following "Conditions of Approval" are submitted to the Spokane County Planning Department for
inclusion in the "Findings of Fact, Conclusions and Order/Decision" should the request be approved.
1. Conditional approval of the plat by the County Engineer is given subject to approval of the road
system as indicated in the preliminary plat of record.
2. Prior to the filing of a final plat drainage language will be drafted by Spokane County and
provided to the Sponsor's Engineer or Sunreyor for inclusion with the final plat document.
3. This proposed subdivision or development proposal is located within a drainage basin which has
been identified by the Spokane County Engineer's and Utilities offices as having stormwater
runoff problems. Since this proposed subdivision or development proposal is affected by or is a
contributor to stormwater flows, property owners should participate in the planning and
implementation of a future basinwide stormwater management system.
4. No construction work is to be performed within the existing or proposed Public right-of-way until
plans have been accepted by the County Engineer and a permit has been issued by the County
Engineer. All work is subject to inspection and approval by the County Engineer.
5. Approach Permits are required for any access to the Spokane County road system.
6. Direct access to Broadway Avenue is allowed for Tract "A" as shown on the preliminary plat.
Tracts "B", "C" and "D" shall take direct access to Felts Road via the ingress/egress easement
as shown on the preliminary plat.
7. The applicant shall grant applicable border easements adjacent to Spokane County Right of
Way per Spokane County Standards.

8. To constnuct the road improvements stated herein, the applicant may, with the approval of the
County Engineer, join in and be a willing participant in any petition or resolution which purposes
is the formation of a Road Improvement District (RID) for said improvements pursuant to RCW
36.88, as amended. At such time as an RID is created or any Road Improvement Project is
sanctioned by Spokane County, the improvements required (curb, sidewalk, drainage control
and paving to existing pavement) will be at the sole expense of the undersigned owner, their
heirs, grantees and assigns. This provision is applicable to Felts Road.
9. As an alternative method of constructing the road improvement stated herein, the applicant
may, with the approval of the County Engineer, accomplish the road improvements stated
herein by joining and participating in a County Road Project (CRP) to the extent of the required
road improvement. At such time as an RID is created or any Road Improvement Project is
sanctioned by Spokane County, the improvements required (curb, sidewalk, drainage control
and paving to existing pavement) will be at the sole expense of the undersigned owner, their
heirs, grantees and assigns. This provision is applicable to Felts Road.
10. The following statements shall be placed in the dedicatory language of the final plat:
• "The owner(s) or successor(s) in interest agree to join in any County-approved stormwater
management program and to pay such rates and charges as may be fixed through public
hearings for service or benefit obtained by the planning, design, constructing, maintaining or
operation of stormwater control facilities."
• "No direct access shall be allowed from Tracts "B", "C" and "D" to Broadway Avenue."
• That in consideration of Mutual Benefits now or to be hereafter derived, do for themselves, their

County to include the above described property in a Road Improvement District (R1D) and to
support the formation of a Road Improvement District for improvement of the road(s) described
below by requesting and authorizing Spokane County to place their name(s) on a petition for the
formation of a Road Improvement District pursuant to RCW 36.88.050, or by requesting and
authorizing Spokane County to cast their ballot in favor of a RID being formed under the
resolution method pursuant to RCW 36.88.030, and/or by not filing a protest against the
formation of a RID being formed under the alternative resolution method provided for in RCW
36.88.065 and Chapter 35.43 RCW.

If a RID is proposed for improvement of the road(s) described below, said owner(s) and

proposed RID are feasibie and (2) that the benefits to be derived from the formation of the RID
