If the property owner(s) fails to maintain the surface path of natural or man-made drainage flow, or the drainage swale, a notice of such failure may be given to the property owner(s). If not corrected within the period indicated on said notice, Spokane County has the right to correct the maintenance failure, or have it corrected, at the expense of the property owner. There may exist properties located uphill and adjacent to this subdivision which periodically discharge stormwater runoff onto individual lots within this plat. Runoff from nearby uphill properties should be expected, and during snowmelt periods or wet seasons the lots may be subjected to higher amounts of stormwater runoff that what is normally observed or anticipated. Because stormwater runoff from adjacent properties have discharged onto this plat prior to development, stormwater runoff will likely continue to do so after development. It is the responsibility of the individual lot owners to maintain existing surface paths of runoff through their respective lots and to grade the lots in accordance with applicable rules and regulations, so as to prevent property damage. Any building that is constructed on a lot in this plat shall be set at such an elevation so as to provide positive drainage away from any drainage entry point to the building (including but not limited to a window well, a window unprotected by a window well, or a doorway). Said positive drainage shall consist of a minimum slope of 3% away from the building for a distance 4f at least 10 feet from the building. The lots shalt be graded so that either a) all runoff is routed away from the building, and conveyed over the lot to a natural drainage swale or approved drainage facility, or b) drainage intercepted on the lot is disposed of on the lot in an approved drainage facility. FINDINGS OF FACT AND CONCLUSIONS 1. The individual signing below has been properly delegated the responsibility for rendering the decision by the Director of Spokane County Division of Planning. 2. The application proposes to short subdivide a 45,000 square foot parcel into 2 tracts, each intended for the construction of a duplex dwelling and associated accessory structures as allowed by the Spokane County Zoning Code. The Spokane County Arterial Road Plan identifies Woodlawn Road as a local access road with a planned right-of-way width of 60 feet. The ewsting right-of-way width is 50 feet. An additional 10 feet of road reserve area is needed. As conditioned below the proposal conforms to the County Road Plan. The County Engineer has examined this short subdivision proposal and has determined that its traffic impact upon the existing County Road System warrants the roadway improvements specified in the conditions below. 8. The short subdivision site is located within the Public Transportation Benefit Area (PTBA). The Spokane Transit Authority (STA) Route 90 (Spokane Valley-East Sprague Route) provides services to the general vicinity of the short subdivision site. . 9. The project site is located within Critical Water Supply Service Area No. 3. The proposed Short Subdivision will be served by a public water system provided by Modern Electric Water Company. 10. Waste water disposal will be by individual on site sewage disposal systems as authorized by the Spokane Regional Health District, Environmental Health Division. Each unit of each duplex to be constructed on each tract will be double plumbed to a facilitate hooking up to sanitary sewers when they become available to the short subdivision site. 11. The required public notice and comment period was provided for consistent with the Spokane County Subdivision Codee In addition, those agencies having a potential interest in the proposal and adjacent property owners were notified and comments solicited. One comment was received from a person living in the area supporting the application. 12. In consideration of the appfication of performance conditions specified below and the application of Spokane County development standards, the proposed Short Subdivision makes appropriate provisions for the public health, safety and general welfare and that the public use and interest will be served by short subdividing the subject parcel. The short subdivision proposal is generally consistent with Washington State Subdivision Statute RCW 58.17 and the Spokane County Subdivision Ordinance. The County Division of Current Planning has considered the provision of adequate public facilities as cited in RCW 58.17.110(2). More specifically: a. open spaces f. sanitary waste disposal b. drainage ways g. parks and recreation facilities c. pubiic and/or private right-of-ways h. playgrounds d. transit i, schools and school grounds e. potable water j. sidewalks 13. The short subdivision is exempt from the environmental review under the State Environmental Policy Act pursuant to WAC 197-11-800 (6) (a). 14. This short subdivision lies over the Spokane-Rathdrum Aquifer and is in a designated Findings and Decision SP-1??8-00 2 aquifer sensitive area (ASA). The County Guidelines for Stormwater Management require that impervious area within the ASA must drain to grassed percolation area (GPA) swales. The applicant or tract owners may need to conform to these requirements when a building permit is obtained. DECISION Based upon the above noted Findings of Fact and Conclusions, Short Subdivision Application SP-1228-00 is hereby GRANTED PRELIMINARY APPROVED for five (5) years, specifically to March 31, 2005 and is subject to conddions specified below. This decision is final unless appealed in writing, consistent with appEal procedures set forth in County Subdivision Ordinance, Section 12.100.126. CONDITIONS OF APPR4VAL All the below conditions imposed shall be binding on the "Applicant,° which term shall include the owner or owners of the property, heirs, assigns and successors. SPOKANE COUNTY DIVISION OF PLANNING 1. The proposal shall comply with the Urban Residential-3.5 (UR-3.5) Zone and all other applicabie County Zoning Code requirements and the Spokane County Subdivision Ordinance, as amended. 2. The final short subdivision shall be designed substantially in conformance with the approved preliminary short subdivision of record. No increase of density or number of tracts shall occur without a change of condition application submittal and approval. 3. The preiiminary short subdivision is given conditional approval for five (5) years, specifically to March 31, 2005. The applicant may submit an extension of time application no less than thirty (30) days prior to the above expiration date, or March 1, 2005. Application(s) for extension of time shall be processed under the provisions of Chapter 12.100.118 (Extension of Time) of the Spokane County Subdivision Ordinance. lf the applicant complies with the criteria of Chapter 12.100.118, the preliminary short subdivision approval and conditions thereto will be changed to reflect the adopted policy and developrnent regulations at the time of the extension application. No time extensions will be granted if application for such extension is submit#ed after the above specified deadline. 4. Prior to filing of the final short subdivision, the applicant shall submit to the County Division of Planning Directorldesignee for review the proposed final subdivision to ensure compliance with these Findings and Conditions of Approval. 5. Four (4) current certificates of title shall be furnished to the County Division of Planning prior to filing of the final short subdivisian. 6. A survey is required of the subject property prior to filing of the final short plat. Findings and Decision SP-1228-00 3 7. Appropriate road names and street addresses shall be indicated on the final short plat map. 8. Appropriate utility easements shall be indicated on the final short plat map. Written approval of utility easements by utility purveyors must be received at the time the proposed final short subdivision is presented for interagency review. 9. The dedication shall contain the following statement: "Front Yard, side yard and rear yard setbacks shall be determined at the time building permits are requested." 10. The Spokane County Division of Planning shall prepare and record with the Spokane County Auditor a"Title Notice" noting that the property in question is subject to a variety of special conditions imposed as a result of the land use action herein. This 'Title Notice" shall serve as official public notice regarding conditions of approval affecting the property in question. The "Title Notice" shall be recorded within frfteen (15) days of Final Plat approval and shall only be extinguished by the Spokane County Division of Planning. 11. Tract B shall satisfy the lot frontage requirement in Section 14.616.315 of the County Zoning Code pertaining to minimum lot frontage prior to final short subdivision approval. This provision will be satisfied with the due west extension of the driveway access easement 80 feet into Tract B. 12. A strip of property 10 feet in width from the existing right-of-way (front lot line of Tract A) is reserved for future acquisition area for additional road right-of-way width along Woodlawn Road. Future building and other setbacks required by the Spokane County Zoning Code shall be measured from the reserved future acquisition area. No required landscaping, parking, '208' areas, drainfield or allowed signs should be located within the future acquisition area for road right-of-way and utilities. If any of the above improvements are within the area, they shall be relocated at the tract owner's expense when roadway improvements are made. The future acquisition area, unit acquired, shall be private property and may be used as allowed in the zone, except that any improvements (such as landscaping, parking, surface drainage, drainfield, signs or others) shall be considered interim uses. The property owner shall be responsible for relocating such "interim" improvements at the time Spokane County makes roadway improvements after acquiring said future acquisition. SPOKANE COUNTY DIVISION OF ENGINEERING AND ROADS 1. Conditional approvai of the short subdivision by the County Engineer is given subject to approval of the road system as indicated in the preliminary plat of record. 2. No road plans are required for this preliminary short subdivision at this time. Drainage language will be drafted by Spokane County and provided to the sponsor's engineer or surveyor for inclusion in the final plat document Findin~:s and Decision SP-1 228-00 4 3. This proposed short subdivision or development proposal is located within a drainage basin which has been identified by the Spokane County Engineer's and Utilities offices as having stormwater runoff problems. Since this proposed subdivision or development proposal is affected by or is a contributor to stormwater flows, property owners should participate in the planning and implementation of a future basinwide stormwater management system. 4. No construction work is to be performed within the existing or proposed Public right-of-way until plans have been accepted by the County Engineer and a permit has been issued by the County Engineer. All work is subject to inspection and approval by the County Engineer. 5. Approach Permits are required for any access to the Spokane County road system. 6. The applicant shall grant applicable border easements adjacent to Spokane County Right of Way per Spokane County Standards. 7. To construct the road improvements stated herein, the applicant may, with the approval of the County Engineer, join in and be a willing participant in any petition or resolution which purposes is the formation ofi a Road lmprovement District (RID) for said improvements pursuant to RCW 36.88, as amended. At such time as an RID is created or any Road Improvement Project is sanctioned by Spokane County, the improvements required (curb, sidewalk, drainage control and paving to existing pavement) will be at the sole expense of the undersigned owner, their heirs, grantees and assigns. This provision is applicable to Woodlawn Road. 8. As an alternative method of constructing the road improvement stated herein, the applicant may, with the approval of the County Engineer, accomplish the road improvements stated herein by joining and participating in a County Road Project (CRP) to the extent of the required road improvement. At such time as an R1D is created or any Road Improvement Project is sanctioned by Spokane County, the improvements required (curb, sidewalk, drainage control and paving to existing pavement) will be at the sole expense of the undersigned owner, their heirs, grantees and assigns. This provision is applicable to Woodlawn Road. 9. The following statements shall be placed in the dedicatory language of the final plat: "The owners or successors in interest agree to join in any County-approved stormwater management program and to pay such rates and charges as may be fixed through public hearings for service or benefit obtained by the planning, design, constructing, maintaining or operation of stormwater control facilities." Findinas and Decision SP-1~8-00 5 That in consideration of Mutual Benefits now or to be hereafter derived, do for themselves, their heirs, grantees, assigns and successor(s) in interest hereby request and authorize Spokane County to include the above described property in a Road improvement District (RID) and to support the formation of a Road Improvement District for improvement of the road(s) described below by requesting and authorizing Spokane County to place their name(s) on a petition for the formation of a Road Improvement District pursuant to RCW 36.88.050, or by requesting and authorizing Spokane County to cast their ballot in favor of a RID being formed under the resolution method pursuant to RCW 36.88.030, andlor by not filing a protest against the formation of a RID being formed under the altemative resolution method provided for in RCW 36.88.065 and Chapter 35.43 RCW. If a RID is proposed for improvement of the road(s) described below, said owner(s) and successor(s)further agree: (1) that the improvements or construction contemplated within the proposed RID are feasible and (2) that the benefits to be derived from the formation of the RID by the property included therein, together with the amount of any County participation, exceeds the cost and expense of formation of the RID, and (3) that the property within the proposed RID is sufficiently developed; provided, themselves, their heirs, grantees, assigns and successor(s) shall retain the right, as authorized under RCW 36.88.090, to object to any assessment(s) on the property as a result of the improvements called for in conjunction with the fomnation of a RID by either the petition or resolution method under Chapter 36.88 RCW and to appeal to the Superior Court the decision of the Board of County Commissioners confirming the final assessment roll; provided further, it is recognized that actual assessments may vary from assessment estimate so long as they do not exceed a figure equal to the increased true and fair value improvement(s) add(s) to the property. It is further acknowledged and agreed that at such time as a RID is created or any County Road Improvement project is authorized by Spokane County, the improvements required shail be at the sole expense of the owner(s) of property within the RID or served by the improvements without any monetary participation by Spokane County. The RID waiver contained in this agreement shall expire after ten (10) years from the date of execution below. This provision is applicable to Woodlawn Road. 10. The County Engineer has designated a Local Access Roadway Section for the improvement of Woodlawn Road which is adjacent to the proposed development. Th'ts will require the addition of approximately 30 feet of asphalt along the frontage of the development. The construction of curbing and sidewalk is also required. 11. The proposed short subdivision shall be improved to the standards set forth in Spokane County Board of Commissioners Resolution No. 99-0265, as amended, which establishes regulations for roads, approaches, drainage and fees in new construction. 12. The County Engineer has examined this development proposal and has determined that the impact of this proposal upon the existing County Road System warrants the roadway improvements herein specified. 13. Drainage language will be drafted by Spokane County and provided to the Sponsor's Engineer or Surveyor for inclusion with the final short subdivision document. Findings and Decision SP-1228-OU 6 SPOKAN VISION OF UTILITIES 1. Pursuant to the Board of County Commissioners Resolution No. 80-0418, the use of on-site sewer disposal systems may be authoriied. This authorization is conditioned on compiiance with all rules and regulations of the Spokane County Health District and is further conditioned and subject to specific application approval and issuance of permits by the Health District. 2. A wet (live) sewer connection to the area-wide Public Sewer System is to be constructed. Sewer connection permit is required. 3. Any water service for this project shall be provided in accordance with the Coordina#ed Water System Plan for Spokane County, as amended. 4. Wording shall be placed in the short subdivision dedication that the tract owners may need to conform to the County Stormwater Management Guidelines at the time a building permit is obtained. SPOKANE REGIONAL HEALTH DISTRICT 1. Appropriate utility easements shall be indicated on copies of the proposed final subdivision for distribution by the Planning Department to the utility companies, Spokane County Engineer, and the Spokane Regional Health District. Written approval of the easements by the utility companies shall be received at the time the proposed final short subdivision is submitted for interagency review. 2. Sewage disposal method shall be as required by the Director of Utilities, Spokane County. 3. Water service shall be coordinated through the Director of Utilities. Spokane County. 4. Water service shall be by an existing public water supply when approved by the Regional Engineer (Spokane), State Department of Health. 5. Prior to filing the final short subdivision, the sponsor shall demonstrate to the satisfaction of the Spokane Regional Health District that an adequate and potable water supply is available to each tract of the plat. 6. Prior to filing the final short plat, the sponsor shall present evidence that the short plat lies within the recorded service area of the water system proposed to serve the plat. 7. Prior to filing the final short plat, the sponsor shall demonstrate to the satisfaction of the Regional Health District that a suitable site for an on-site sewage disposal system is available on Tract B. Test holes examined on these lots will limit the number of bedrooms to four per duplex or a total of eight bedrooms for the short subdivision. 8. A plan for water facilities adequate for domestic use, domestic irrigation use and fire protection use shall be approved by the water purveyor. Said water plan must be approved by the fire protection district and the appropriate health authorities. The health authorities, Findings and Decision SP-1228-00 7 r water supplier (purveyor) and the fire protection district will certify, prior to recording the final short plat, on the face of said water plan that the plan is in conformance with their requirements and will adequately satisfy their respective needs. Said water plan and certification will be drafted on a transparency suitable for reproduction. 9. The purveyor will also certify prior to recording the final short plat on a copy of said water plan that appropriate contractual arrangements have been made with the short plat applicant for construction of the water system, in accordance with the approved plan and time schedule. The time schedule will provide, in any case, for completion of the water system and inspection by the appropriate health authorities prior ta application for building permits within the short plat. The contractual arrangements will include a provision holding Spokane County, Spokane Regional Health District and the purveyor harmless from claims by any tract purchaser refused a building permit due to failure of the plat applicant to satisfactorily 10. Subject to specific application approval and issuance of permits by the Health Officer, the use of individual on-site sewage disposal systems may be authorized. 11. The dedicatory language of the short plat will state: "Subject to specific application approval and issuance of permits by the Health Officer, the use of individual on-site sewage disposal systems may be authorized." 12. The dedicatory language on the short plat shall state: "Use of private wells and water systems is prohibited." 13. The final short plat dedication shall contain the following statement: "The public water system, pursuant to the Water Plan approved by county and state health authorities, the local fire protection district, County Building and Safety Department and water purveyor, shall be installed within this subdivision and the applicant shall provide for individual domestic water service as well as fire protection to each tract prior to sale of each tract and prior to issuance of a building permit for each tract." Conditional approval of the plat by the County Engineer is given subject to approval of the road system as indicated in the preliminary plat of record. 2.
