If the property owner(s) fails to maintain the surface path of natural or man-made drainage flow, or the drainage swafe, a notice of such failure may be given to the property owner(s). If not corrected within the period indicated on said notice, Spokane County has the right to correct the maintenance failure, or have it corrected, at the expense of the property owner. There may exist properties located uphill and adjacent to this subdivision which periodically discharge stormwater runoff onto individual lots within this plat. Runoff from nearby uphill properties should be expected, and during snowmelt periods or wet seasons the lots may be subjected to higher amounts of stormwater runoff that what is normally observed or anticipated. Because stormwater runoff from adjacent properties have discharged onto this plat prior to development, stormwater runoff will likely continue to do so after development. It is the responsibility of the individual lot owners to maintain existing surface paths of runoff through their respective lots and to grade the lots in accordance with applicable rules and regulations, so as to prevent property damage. Any building that is constn.icted on a lot in this plat shall be set at such an elevation so as to provide positive drai,nage away from any drainage entry point to the building (including but not limited to a window well, a window unprotected by a window well, or a doorway). Said positive drainage shall consist of a minimum slope of 3% away from the building for a distance of at least 10 feet from the building. The lots shall be graded so that either a) all runoff is routed away from the building, and conveyed over the lot to a natural drainage swale or approved drainage facility, or b} drainage intercepted on the lot is disposed of on the lot in an approved drainage facility. The approved drainage facility shall be constructed in accordance with any applicable accepted plans on file at the County Engineer's Office. Any revisions to the accepted drainage plans must be accepted by the County Engineer's Office prior to construction of said revisions. Spokane County does not accept the responsibility of maintaining the drainage course on private lots or floodplain areas within private fots, nor the responsibility for any damage whatsoever, including, but not limited to, inverse condemnation to any properties due to deficient construction and/or maintenance of drainage courses in drainage easements on private property. The owner(s) or success4r(s) in interest agree to join in any County-approved stormwater management program and to pay such rates and charges as may be fixed through public hearings for service or benefit obtained by the planning, design, constructing, maintaining or operation of stormwater control facilities. Prior to the issuance of an approach permit and building permit for Tract B, the applicant shall provide art engineered drainage plan for Tract B that meets the recommendations as contained in the March 1, 2000 letter from Jerry Storhaug and any other requirements that may be contained in the Stormwater Control Ordinance for the Central Park and Glenrose Planning Area, if applicabie to this tract. Following the review and acceptance of the drainage plan by Spokane County for the lot, a building permit and approach permit may be issued for this lot. FINDINGS OF FACT AND COIVCLUSIONS i. The individual signing below has fiuther been delegated the responsibility for rendering decisions by the Directar of Spokant, County Division of Ptanning. 2. The proposal is to divide a 40,109 square foot pamel into 2 single-family residential lots and for those uses allowed in the Urban Residential-3.5 (UR-3.5) zone. One lot has an existing house with detached garage and a second lot has an existing garage. 3. The proposal is generally located approximately 150 feet east of Wardson Street at the southeast end of 19th Avenue, a cul-de-sac, in the NE 1/4 of Section 26a Tawnship 25N, Range 43E.W.M. Spokane County, Washington. 4. The existing zoning of the prvperty described in the application is Urban Resideniial-3.5 (IJR-3.5), established in 1991, and previously classified as Residential-1 (R-1) in 1973. The property consistts af parcel No. 35261.0402, Heather Park Addition. 5. The Spokane County Comprehensive Plan designates this area as Urban. The development and uses, as conditioned, are in accord with tbe Urban Category. The proposal is also compatible with the surrounding uses, tvhich are primarily single family residential uses. fi. In this scenario we have estimated that approximately. .10 cfs of runoff (10 year storm ) would be added to the drainage system of 19'h Avenue. It is our recommendation that the site is graded at the time of house construction to minimize the amount of stormwater directed to 19`h Avenue and slope the site to south (similar to the exysting condition). During site grading it is recammended that the portion of the site which currently slopes toward the adjacent neighbor is redirected to the south. In summary, it is our opinion that the proposed subdivisioo is of negligible impact to the eristing drainage conditions. Calculations prepared to formulate our opinion are attached. T6osath Drainage Analysis Project DescriQtion: The area under consideration is the southeast corner of "Tract B" located at the cul-de-sac on 19d' Avenue. The existing parcel which is proposed to be subdivided to create this parcel has a street address of 5706 E 19da Spokane, Washington 99212. The basin is thinly forested and slopes to the southea.st at an average of 7.5°fo. DrainaQe Concept and Su.mmary: Post devetopment considerations include the preserrce of a 1200 sq. ft. house along with an attached garage. Upon construction of this house, it has been assumed that the site wi 11 be graded in a manner that ca.uses runoff from the north half of the roof and the driveway to flow to the north onto 19`h Avenue. Also, runoff from the south half of the roof shall fluw southeast as in the pre development case. Subsequent calculations using the rational method predict a pre development 10-year design flow of 0.23 cfs to the southeast corner of Basin Pre A. Portions of the site near the street currently drain toward the adjacent house east of the subject project. These stormwaters eventually end up draining to a vacant pasture ! meadow which is south of the property. The post development calculations predict a 10-year flow uf 0.12 cfs to the southeast carner (Basin Post A), and a flow of 0.10 cfs to the north orrto 19`h Avenue (Basin Post B). The current "Agreement to Pay Fees" w3s authorized through Resolution No. 80-1592 that was adopted by the Spokane County Commissioners on December 22. 1980. Thc ResolutiAn autliorizes the Cuunty Engineer to collect a fee for time that is expended by Spokane County personnel who are ehnrged with review and inspection duties that are required ta be performed tor the applicabie devclapment proposals. The fee agreement is based on the individuals actuul time spent plus 10%. These costs are bilted out on a monthty basis. The amount of time speat on revieiv of a project will be directly proportional to the compiexity of the proposai and the quality of the submittals from the appllcant and his agents. lt is the goal of Spakaae County to minimi2e as much As possible our review and inspection time on a project. lf tbe ahplicant selects agents to represent him who are familiar with the process and submitiaUnsJtection requirements and these requirements are fAllowed, there should be a savings in fees that are charged to him by the County. 2. When cia 1 need to submit the Aercement to Pav fees? ror all pi-its and only those zone changes tliat will require a cnncept drainage plan, the fee agreement sliould be submitted with the project application as per Spokane County ResAlution No. 96-093. Failure to submit the required agreement will canse the Div[sion of Enginecring to have to issue an immediate notice that the application is technica)lv incomplete. The fee agreement that is submitted sllould be aproperly executed original. Faxed copies are not acceptable. Unnecessary deiay to the review process can be avoided by submitting the agreement with the application. Wlien the agreement is received, Spok3ne Countv personnel can begin the revietiv otthe application material. 3. If 1 do not like the fee aereement what else can i do? At tlte present time the fee agreement is the anly mechanism for cost recovery that we are authorized tA emplay.
