FINDINGS OF FACT AND CONCLUSIONS 1. The individual signing below has been properly delegated the responsibility for rendering the decision by the Director of Spokane County Division of Planning. 2. The application proposes to short subdivide a 24,900 square foot tract into 2 tracts, each intended for a single family dwelling. 3. The proposal is located adjacent to and south of 4th Avenue approximately 235 feet east of the intersection of Pines Road and 4`h Avenue in the northwest'/ of Section 22, Township 25 north, Range 44 E.W.M. (Assessor's Tax Parcel No. 45222.1736). 4. The existing zoning of the property is Urban Residential-3.5 (UR-3.5) which was established in 1991. The conditions of approval specified below require that development of the lots be consistent with the County Zoning Code. Sufficient area exists on each tract to accommodate a single family dwelling. Tract A has insufficient frontage on 4' Avenue. Said Zoning Code Section 14.616.315 requires 80 (eighty) feet of frontage and only 75.9 feet is provided in the application. An administrative exception must be granted in order for Tract A to retain the existing lot frontage. Pursuant to Section 58.17.195 of the Revised Code of Washington (RCVI), this proposal together with the conditions of approval specified below conforms to the requirements of the existing UR-3.5 Zone. 5. The Spokane County Comprehensive Plan designates the eastem 80 percent of the short subdivision site as Urban and the westem 20 percent as Commercial. The development and use proposed for this short subdivision and conditions attached hereto are in accordance with the Urban Designation. The Urban designation is intended to provide the opportunity for development ofi a"citylike" environment with intensive residential development including single family, two-family, and multi-family dwellings. The Urban category also promotes °fill-in° development in areas with public services available such as water, sewer, storm sewer, transit and fire protection. This proposal is essentially a"fill-in° development having nearly all of said services available to it. The Commercial designation occupies a north-south siiver at the westem edge of the subject site. The project site is located within the Interim Urban Growth Area (IUGA) and is consistent with the Spakane County Interim Urban Growth Area policies as set forth in Spokane County Resolution 97-0321. This proposal is compatible with the surrounding uses, which are primarily single family residential. 7. The short subdivision site fronts on 4'h Avenue. The County Arterial Road Plan identifies this portion of 4t' Avenue as a 70 foot Collector Artedal. The existing right of way width of 40 feet is not consistent with that specified in the plan. In order to implement the Arterial Road Plan an additional 15 feet of right of way is needed at the location of the project site. 8. The short subdivision sit~e is located within the Public Transportation Benefit Area (PTBA). The Spokane Transit Authority (STA) Route 96 (Spokane Valley-East Sprague Loop Route) provides services to the general vicinity of the short subdivision site. . 9. The project site is located within Critical Water Supply Service Area No. 3. The proposed Short Subdivision will be served by a public water system provided by Modem Electric Water Company. 10. The project site lies over the Spokane-Rathdrum Aquifer. The project site is inside the Priority Sewer Senrice Area and the County General Sewer Service Area. The county sewer system will serve the wastewater disposal needs of the short subdivision. 11. The required public notice and comment period was provided for consistent with the Spokane County Subdivision Code. In addition, those agencies having a potential interest in the proposal and adjacent property owners were notified and comments solicited. No comment was received from owners of land located adjacent to the project site. 12. In consideration of the application of performance conditions specified below and the application of Spokane County development standards, the proposed Short Subdivision makes appropriate provisions for the public health, safety and general welfare and that the public use and interest will be served by short subdividing the subject parcel. The short subdivision proposal is generally consistent with Washington State Subdivision Statute RCW 58.17 and the Spokane County Subdivision Ordinance. The County Division of Planning has considered the provision of adequate public facilities as cited in RCW 58.17.110(2). More specifically: a. open spaces f. sanitary waste disposal b. drainage ways g. parks and recreation facilities c. public and/or private right-of-ways h. playgrounds d. transit i. schools and school grounds e. potable water j. sidewalks 13. The short subdivision is exempt from the environmental review under the State Environmental Policy Act pursuant to WAC 197-11-800 (6) (a). 14. This short subdivision lies over the Spokane-Rathdrum Aquifer and is in a designated aquifer sensitive area (ASA). The County Guidelines for Stormwater Management require that impervious area within the ASA must drain to grassed percolation area (GPA) swales. The appiicant or tract owners may need to conform to these requirements when a building permit is obtained. Findings and Decision SA-1230-00 2 15. This proposed short subdivision is located within a drainage basin which has been identified by the Spakane County Engineers and Utilities offices as having stormwater runoff problems. Since this proposed short subdivision is affec#ed by or is a contributor to stormwater flows, property owners should participate in the planning and implementation of a future basinwide stormwater management system. 16. The County Engineer has examined this development proposal and has determined that the impact of this proposal upon the existing County Road System warrants the dedication of additional Right of Way and the roadway improvements herein specified. DECISION Based upon the above noted Findings of Fact and Conclusions, Short Subdivision Application SP-1230-00 is hereby GRANTED PRELIMINARY APPROVAL for five (5) years, specifically to April 19, 2005 and is subject to the conditions specified below. This decision is final unless appealed in writing, consistent with appeal procedures set forth in County Subdivision Ordinance, Section 12.100.126. CONDITIONS OF APPROVAL All the below conditions imposed shall be binding on the "Applicant,° which term shall include the owner or owners of the property, heirs, assigns and successors. SPOKANE COUNTY DIVlSION OF PLANNING 1. The proposal shall comply with the Urban Residential-3.5 (UR-3.5) Zone requirements and all other applicable County Zoning Code requirements and the Spokane County Subdivision Ordinance, as amended. 2. The final short subdivision shall be designed substantially in confoRnance with the approved preliminary short subdivision of record. No increase of density or number of tracts shall occur without a change of condition application submittal and approval. 3. The short subdivision is given conditional preliminary approval for five (5) years, specifically to April 19, 2005. The applicant may submit an extension of time application at least thirty (30) days prior to the above expiration date, or no later than March 19, 2005. Application(s) for extension of time shall be processed under the provisions of Chapter 12.100.118 (Extension of Time) of the Spokane County Subdivision Ordinance. If the applicant complies with the criteria of Chapter 12.100.118, the preliminary short subdivision approval and conditions thereto will be changed to reflect the adopted policy and development regulations in effect at the time of the extension application. No time extensions will be granted if application for such extension is submitted after the above specified deadline. 4. Prior to filing of the frnal short subdivision, the applicant shall submit to the County Division of Planning Director/designee for review the proposed final short subdivision to ensure compliance with these Findings and Condftions of Approval. Findings and Decision SP-1230-00 3 r 5. Four (4) curfent certificates of titfe shall be fumished to the County Division of Pianning prior to filing of the final short subdivision. 6. A survey is required ofi the subject property prior to filing of the finai short plat. e, 7. Appropriate road names and street addresses shall be indicated on the final short plat map. 8. Appropriate utility easements shall be indicated on the final short plat map. Written approval of utility easemerrts by utility purveyors must be received at the time the proposed final short subdivision is presented for interagency review. 9. The dedication shatl contain the following statement: "Front Yard, side yard and rear yard setbacks shall be determined at the time building permits are requested.° 10. The Spokane County Division of Planning shalt prepare and r+ecord with the Spokane County Auditor a"TiUe Notice" noting that the property in question is subject to a variety of speciai conditions imposed as a result of the land use action herein. This "Title Notice" shall serve as official public notice regarding conditions of approval affecting the property in question. The 'Title Notice" shall be recorded wfthin fifteen (15) days of Final Plat approval and shall only be extinguished by the Spokane County Division of Planning. 11. Tract B shall satisfy the lot firontage requirement in Section 14.616.315 of the County Zoning Code. This provision will be satisfied with the due south extension of the driveway access easement 80 feet into Tract B. This driveway extension shall also satisfy the fire apparatus road standards. 12. Prior to final short subdivision approval the applicant shall apply for and receive approval of an administrative exception pursuant to Section14.506.020 (6)(a) and Section 14.506.040 of the County Zoning Code bringing Tract A into compliance with the minimum road frontage requirement of said zoning code. ` 13. The Spokane County Division of Planning shall prepare and record with the County Auditor a Title Notice specifying a future land acquisition area for road right-of-way. The reserved future acquisition area Title Notice shall be released, in full or in part, by the Division of Planning. The notice should be recorded within the same time frame as an appeal and shall provide the following: a. At least 12.5 feet of reserved future acquisition area for road right-of-way, in addition to the newly dedicated right-of-way along 4th Avenue. NOTE: The County Engineer has required 2.5 feet of new right of way dedicatiort. b. Future building and other setbacks required by the Spokane County Zoning Code shall be measured from the reserved future acquisition area. c. No required landscaping, parking, '208' areas, drainfield or allowed signs should be located within the future acquisition area for road right-of-way and utilities. If any of the above improvements are made within this area, they shall be relocated at the applicant's expense when roadway improvements are made. Findiags and Decision SP-1230-00 4 4p ~ . d. The future acquisition area, untit acquired, shall be private property and may be used as allawed in the zane, except that any improvements (such as landscaping, parking, surface drainage, drainfield, signs or others) shall he cansidered interim uses. e. This provisian is applicable to 4~' Avenue. ~ Findings and Decision SP-1230-00 9. As an altemative method of constructing the road improvement stated herein, the appiicant may, with the approval of the County Engineer, accomplish the road improvements stated herein by joining and participating in a County Road Project (CRP) to the extent of the • required road improvement At such time as an RID is created or any Road Improvement Project is sanctioned by Spokane County, the improvements required (curb, sidewalk, drainage control and paving to existing pavement) will be at the sole expense of the undersigned owner, their heirs, grantees and assigns. This provision is applicable to 0 Avenue. 10. The following statements shall be placed in the dedicatory language of the final plat: °That in consideration of Mutual 8enefrts now or to be hereafter derived, do for themselves, their heirs, grantees, assigns and successor(s) in interest hereby request and authorize Spokane County to include the above described property in a Road Improvement District (RID) and to support the formation of a Road Improvement District for impravement of the road(s) described beiow by requesting and authorizing Spokane County to place their name(s) on a petition for the formation of a Road Improvement District pursuant to RCW 36.88.050, or by requesting and authorizing Spokane County to cast their ballot in favor of a RID being formed under the resolution method pursuant to RCW 36.88.030, and/or by not filing a protest against the fomnation af a RID being formed under the altemative resolution method provided for in RCW 36.88.065 and Chapter 35.43 RCW. If a RID is proposed for improvement of the road(s) described below, said owner(s) and successor(s)further agree: (1) that the improvements or consbvction contemplated within the proposed R1D are feasible and (2) that the benefits to be derived firom the formation of the RID by the property included therein, together with the amount of any County participation, exceeds the cost and expense of formation of the RID, and (3) that the property within the proposed R1D is sufficiently developed; provided, themselves, their heirs, grantees, assigns and successor(s) shall retain the right, as authorized under RCW 36.88.090, to object to any assessment(s) on the property as a result of the improvements called for in conjunction with the formation of a RID by either the petition or resolution method under Chapter 36.88 RCW and to appeal to the Superior Court the decision of the Board of County Commissioners confirming the final assessment roll; provided further, it is recognized that actual assessments may vary from assessment estimate so long as they do not exceed a figure equal to the increased true and fair value improvement(s) add(s) to the property. It is further acknowledged and agreed that at such time as a RID is created or any County Road Improvement project is authorized by Spokane County, the improvernents required shall be at the sole expense of the owner(s) of property within the RID or served by the improvements without any monetary participation by Spokane County. The RID waiver contained in this agreement shall expire after ten (10) years from the date of execution below. This provision is applicable to 0 Avenue." 11. The County Engineer has designated a Collector Arterial Roadway Section for the improvement of 4'" Avenue which is adjacent to the proposed development. This will require the addition of approximately 8.5-10.5 feet of asphalt along the frontage of the development. The construction of curbing and sidewalk is also required. Findings and Deeision SP-1230-00 6 4t ~ 12. The proposed short subdivision shail be improved to the standards set forth in Spokane County 6oard of Commissioners Resolution No. 99-0265, as amended, which establishes regulations for roads, approaches, drainage and fees in new construction. 13. The County Arterial Road plan identifies 4th Avenue as a 70 foot Collector Arterial. The existing right of way width of 40 feet is not consistent with that specified in the plan. in order to Tmplement the Arterial Road Plan it is recommended that in addition to the required right of way dedication, a strip of property 12.5 feet in width along the 4th Avenue frontage be set aside in reserve. This property may be acquired by Spokane County at the time when Arterial Improvements are rnade to 0 Avenue. 14. The applicant should be advised that there may exist utilities either underground or overhead affecting the applicants property, including property to be dedicated or set aside for future acquisition. Spokane County will assume no financial obligation for adjustments or relocation regarding these utilities. The applicant should check with the applicable utiljties and Spokane County Engineer to determine whether the applicarrt or utility is responsible for adjustment or relocation costs and to make aRangements for any necessary work. SPOKANE COUNTY DIVISION OF UTILITIES 1. The short plat dedication shall state: Public sewers shall be constructed to provide for the connection of each tract to the County's system of sewerage. Uses on properties within the project shall be required to connect to the sewer and pay applicable charges per the County Sewer Ordinance. Sewer connection permits shall be required. 2. The dedication shall state: A public sewer system will be made available for the short plat, and individual services will be provided to each tract prior to sale. Use of individual on-site disposal systems shall not be authorized. 3. The dedication shall state: Individual tracts shall be subject to payment of current applicable sewer connection charges and/or general facilities charges prior to the issuance of a sewer connection permit. 4. Applicant shall submit expressly to Spokane County Division of Utilities "under separate cover", only those plan sheets showing sewer plans and specifications for the public sewer connections and facilities for review and approval. 5. Sewer plans acceptable to the Division of Utilities shall be submitted pdor to the finalization of the project. 6. Any water service for this project shall be provided in accordance with the Coordinated Water System Plan for Spokane County, as amended. 7. The following language shall be placed in the short subdivision dedication: "The Tract owners may be required to conform to the County Guidelines for Stormwater Management prior to the issuance of a building pennit.° Findings and Decision SP-1230-00 7 a SPOKANE REGtONAL HEALTH DISTRICT 1. Appropriate utility easements shall be indicated on copies of the proposed final subdivision for distribution by the Pianning Division to the utility companies, Spokane County t. Engineer, and the Spakane Regional Health District. Written approval of the easements by the utility companies shall be received at the time the proposed final short subdivision is submitted for interagency review. 2. Sewage disposal method shall be as required by the Oirector of Utilities, Spokane County. 3. Water service shall be coordinated through the Director of Utilities, Spokane County. 4. Water service shall be by an existing public water supply when approved by the Regional Engineer (Spokane), State Department of Health. 5. Prior to filing the final short subdivision, the sponsor shall demonstrate to the satisfaction of the Spokane Regional Health District that an adequate and potable water supply is available to each tract of the plat. 6. Prior to filing the final short plat, the sponsor shall present evidence that the short plat lies within the recorded senrice area of the water system proposed to seroe the plat. 8. A plan for water facilities adequate for domestic use, domestic irrigation use and fire protection use shall be approved by the water purveyor. Said water plan must be approved by the fire protection district and the appropriate health authorities. The health authorities, water supplier (purveyor) and the fire protection district will certify, prior to recording the final short plat, on the faCe of said water plan that the plan is in conformance with their requirements and will adequately satisfy their respective needs. Said water plan and certification will be drafted on a transparency suitable for reproduction. 9. The purveyor will also certify prior to recording the final short plat on a copy of said water plan that appropriate contractual arrangements have been made with the short plat applicant for construction of the water system, in accordance with the approved plan and time schedule. The time schedule will provide, in any case, for completion of the water system and inspection by the appropriate heaith authorities prior to application for building permits within the short plat. The contractual arrangements will include a provision holding Spokane County, Spokane Regional Health Distric# and the purveyor harmless from claims by any tract purchaser refused a bullding permit due to failure of the short plat applicant to satisfactorily complete the approved water system. 12. The dedicatory language on the short plat shall state: "Use of private wells and water systems is prohibited." 13. The final short plat dedication shall contain the following statement: "The public water system, pursuant to the Water Plan approved by county and state health authorities, the local fire protection district, County Building and Safety Department and water purveyor, shall be installed within this subdivision and the applicant shall provide fior individual domestic water service as well as fire protection to each tract prior to sale of each tract and prior to issuance of a building permit for each tract." Findings and Decision SP-1230-00 8 FIRE DISTRICT No.1 1. The Spokane Valley Fire Department will require the installation of an approved fire apparatus tumaround for access to Tract B. To construct the road improvements stated herein, the applicant may, with the approval of the County Engineer, join in and be a willing participant in any petition or resolution which purposes is the formation of a Road Improvement District (RID) for said improvements pursuant to RCW 36.88, as amended. The RID waiver contained in this agreement shall expire after ten (10) years from the date of execution below. This provision is applicable to 4' Avenue. 11. The County Engineer has designated a Collector Arterial Roadway Section for the improvement of 4`h Avenue which is adjacent to the proposed development. This will require the addition of approximately 8.5-10.5 feet of asphalt along the frontage of the development. The construction of curbing and sidewalk is also required. 12. The proposed plat shall be improved to the standards set forth in Spokane County Board of Commissioners Resolution No. 99-0265, as amended, which establishes regulations for roads, approaches, drainage and fees in new construction. 13. The County Engineer has examined this development proposal and has determined that the impact of this proposal upon the existing County Road System warrants the dedication of additional Right of Way and the roadway improvements herein specified. 14. The County Arterial Road plan identifies 4" Avenue as a 70 foot Collector Arterial. The existing right of way width of 40 feet is not consistent with that specified in the plan. In order to implement the Arterial Road Plan it is recommended that in addition to the required right of way dedication, a strip of property 12.5 feet in width along the 4'h Avenue frontage be set aside in reserve. This property may be acquired by Spokane County at the time when Arterial Improvements are made to 4' Avenue. a .Page 4 02/18/2000 1230 15. The applicant should be advised that there may exist utilities either underground or overhead affecting the appiicants property, including property to be dedicated or set aside future acquisition. Spokane County will assume no financial obligation for adjustments or relocation regarding these utilities. The applicant should check with the applicable utilities and Spokane County Engineer to determine whether the applicant or utility is responsible for adjustment or relocation costs and to make arrangements for any necessary work.
