SP-1233-00 ) CONCLUSIONS AND
Juliet Nachman ) DECISION
THIS MATTER, an application for subdivision of land from Juliet Nachman has been received
and was decided upon, pursuant to Spokane County Subdivision regulations, on the 24th day
of March, 2000.
FINDINGS OF FACT AND CONCLUSIONS
1. The individual signing below has further been properiy detegated the responsibility for
rendering the decision, by the Director of Spokane County Division of Pianning.
2. The proposal is to divide approximately 2.42 acres into 4 lots for those uses permitted in
the UR-3.5 ione.
3. The proposai is located at 14317 E. 12thAvenue in the SW'/4 of Section 23, Townshjp 25
North, Range 44 East W.M., Spokane County, Washington.
4. The existing zoning of the property described in the application is UR-3.5, which was
established in 1991. Pursuant to Revised Code of Washington (RCW) 58.17.195, this
proposal conforms to the requirements of the existing UR-3.5 zone.
5. The Spokane County Comprehensive Plan designates this area as Urban. The short
subdivision and uses, as proposed and conditioned, are in compliance with this
category.
6. Surrounding uses are primarily vacant and single family residential.
7. The Spokane County Arterial Road Plan identifies both 12w Avenue East and 10th
Avenue East as Local Access Roads. The existing right-of-way width is 40 feet. In order
to implement the Arterial Road Ptan, 10th Avenue East which would provide access to
proposed Tracts C& D, will require the 25' wide dedication shown on the preliminary
short plat. Therefore, as conditioned with such improvements, dedications, sidewalks,
and future R.O.W. acquisition areas as may be required, the proposal conforms to the
Arterial Road Plan.
8. The proposed site is located within the Public Transportation 6enefit Area (PTBA),
however, public transit services to the site are not available at this time. The nearest
connecting service is located approximately 114 mile east of the site at along Sullivan
Road.
9. The proposed short plat wjll be served by a public water system (Vera Irrigation District
#15). Waste water disposal will be as authorized by the Director of Spokane County
Division of Utilities.
10. The required public notice was provided for this proposal and agencies having a
potential interest in the project were notified and recommendations solicited.
11. No written comments were received from any adjoining property owners.
12. Recognizing the recommended conditions and Spokane County development standards,
the proposed short plat makes appropriate provisions for the public health, safety and
generat welfare and that the public use and interest will be served by platting the
subdivision.
The subdivision proposal is generally consistent with RCW 58.17 and the County
Subdivision regulations, promoting the public health, safety and general welfare in
accordance with standards established by the State and Spokane County. The County
Division of Planning has considered the provision of adequate public facilities as cited in
RCW 58.17.110 (2). More specifically:
a. open spaces f. sanitary waste disposal
b. drainage ways g, parks and recreation facilities

c. pubiic and/or private right-of•ways h. playgrounds
d. transit I. schools and school grounds
e. potable water j. sidewalks
13. The project is exempt from environmental review under the State Environmental Poticy
Act pursuant to WAC 197-11•800 (6) (a).
14. Centrai Vailey School District # 356 was sent notification of the project on February 25th,
2000. No response has been received.
DECISION
6ased upon the above noted Findings of Fact and Conctusions, Short Plat Application
SP-1235-00 is hereby APPROVEO for five (5) years, specifically to March 25, 2005 and subject
to the conditions specified below. This decision is flnal unfess appealed in writing, on or before
4:00 PM on April 7, 2000.
CONDITIONS OF APPROVAL
All the below condjtions imposed shall be binding on the "Applicant," which term shall include
the owner or owners of the property, heirs, assigns and successors.
SPOKANE COUNTY DIVISION OF PLANNING
1. The proposal shall comply with the UR-3.5 zone and other applicable Zoning Code chapters,
as amended.
2. The final short plat shall be designed substantially in conformance with the preliminary
plat of record. No increase of density or number of tracts shall occur without a change of
condition application submittal and approval.
3. The preliminary short plat is given conditional approval for five (5) years, specifically to
March 24, 2005. The applicant may submit an extension of time application NOT LESS THAN
thirty (30) days prior to the above expiration date. Applicatfon for an extension of time shall be
processed under the provisions of Chapter 12.100.118 (Extension of Time) of the Spokane
County Subdivision Ordinance.
4. Prior to filing the final short plat, the applicant may submit to the County Division of Planning
a proposed final short plat to ensure compliance with these Findings, Decision and Conditions
of Approval. r
5. A survey is required of the subject property prior to filing the final short plat.
6. Appropriate road names and street addresses shall be indicated on the final short plat map.
7. Appropriate utility easements shall be indicated on the final short plat map. Approval of
utility easements by utitity companies shall be submitted with the final short plat.
8. The following note shall appear on the face of the final short plat:
"Setbacks shalt be determined at the time building permits are requested unless these
setbacks are specifically drafted on this final short plat. The setbacks indicated on this
short subdivision may be varied from if proper zoning or variance approvals are obtained."
9. Three (3) current Certificates of Title shall be furnished to the County Division of
Planning prior to filing the final short plat.
10. Only one (1) accessory structure (less than 1,000 square feet) is allowed as a teirporary
use on proposed Tract B pursuant to Section 14.616.220 (7-b) of the Spokane County
Zoning Code. All other structures on Tract B must be removed prior to submittal of the final
short plat and be verified by a demolition permit or other documentation.

5. No construction work is to be perforrned within the existing or proposed Public right-of way
