IN THE MATTE R OF ) FINDINGS OF FACT,
SHORT PLAT NO. SP-1091-96 ) CONCLUSIONS AND
DECISION
THIS MATTER, an application for subdivision of land from Jerry a.nd Kathy Stelzer has
been received and decided upon, pursuant to Spokane County Subdivision regulations, on
the 4`h day of October , 1996.
FINDINGS UF FACT AND CONCLUSIONS
1. The individual signing below has further been properly delegated the responsibility
for rendering the decision by the Spokane County Director of Building and
Planning.
2. The proposal is to divide approximately .74 acres into 2 tracts for 1 existing single
faniily residence and 1 new addiiional residential tract.
3. The proposal is locatecl west of and adjacent ta Woodruff Road and approximately
90 feet south of Boone Avenue in the NW 1/4 of Section 17, Township 25 North,
Range 44 E.W.M. Spakane County, Washington.
4. The existing znning of tlie property described in the applicatinn is Urhan
Residential-3.5 (UR-3.5), previously escablished as Agricultural Suburban (AS) (fite
# 3211-53) zoning in 1953 ancl redesignated to UR-3.5 on January 1, 1991,
pursuant to the Program to Implement the Spokane County Zoning Code. Pursuant
to RCW 58.17.195 the proposal does conform to the reyuirements of the existing
UR-3.5 zone.
5. The Spokane Cnunty Comprehensive Plan designates this area as Urban. The
development and uses, as proposed and conditioned, are in conzpliance with this
category.
6. Surrounding uses are Primarily single family residences on mixed urban size lots.
7. The Spokane County Arterial Road Plan identifies Woodruff Road as a Local
Access Road with a future right of way width of 60 feet. The existing riglit of way
width is 40 feet. Ia order to impleaaent the Arterial Road Plan, a strip of property
10 feet in width along the Woodruff Road frontage is to be set aside as a Fucure
Acquisition Area. Therefore, as conditioned (such as improvements, sidewalks ancl
acquisition areas) the proposal coaforms to lhe Raad Plan.
8. The site is located witliin the Public Transportation Benefit Area (PTBA). The
Spokane Transit Authority (STA) University City Limiced Route fi 12 provides
connecting services to the site.
9. The proposed shart plat will be served by a public water system. Waste water
disposal will be as authorized by the Director of Utilities.
10. The required public nocice was provided for this proposal and agencies having a
potential ierterest in the project were notified and i•econunienclations solicitecl.
11. Written cnmments were received from adjoining properry owners who are opposed
to the proposed short plae. The adjacent property owners are concern that
additional residences will bave a adverse effect on their nroperty and neighborhontl.
12. The intent of the Urban category is to provicle the opportuaity for developinent of a
"city-like" environmeat which includes various land uses, intensive resiclential
development, and public facilities and services. Tliis proposal has been conditionecl
to address the potential impact any new clevelopment will have on the existing
public facilicies and services in the area.
13. Recognizing lhe recommended conditions and Spokane County development
standards, the proposed short plat makes appropriate provisions for the public
health, safety and general welFare and that the public use and iaterest will be served
by platting the subdivision.
The subdivision proposal is generally consistent with RCW 58.17 and the County
subdivision regulatians, promoting the public health, safety and general welfare in
accordance with standards established by the state and Spokane County. The
IIuilding and Planning Division has considered the provision of aclequate public
facilities as cited in RCW 5$.17.110 (2). Mvre spcclFcally:

Based upon the above noted Findings of Fact and Conclusions, Short PLat Application SP-
1091-96 is hereby APPROVEi D for five (5) years, specifically to November 1, 2001 and
subject to conditions noted below. Tlus decision is final unless appealeci in writing,
consistent with adopted appeal procedures.
CONDITIONS OT A.PPROVAL
All the aelow conditioas imposed shall be binding on the "Applicant", which term shall
include the owner or owners of the property, heirs, assigns and successors.
COUNTY DIVISION OF BUILDING AND PLANNING
1. The proposal shall coruply with the Urban Residential-3.5 (UR-3.5) zone and other
applicable Zoning Code chapters, as amended.
2. The final plat shall be designed substantially in conformance with the preliminary
plat of record. No increase of density or nunlber of tracts shall occur without a
change of coadition application submittaI and approval.
3. Tlie preliminary short piat is givea conditional approval for five (5) years,
specifically to November 1, 2041. The applicant may submit an extension of time
application approxunately forty-five (45) days prior to the above expiration date.
Application(s) for extension of time shall be processed under the provisions of
Section G of Chapter III of the Spokane County Subdivision Ordinance. If the
applicaat complies with the criteria of Section G, the prelinunary approval and
condicions will be changed to reflect the ariopted policy and cievelopment regulations
at the time of the exteasion application.
4. Prior to filing of the final short pfat, dhe applicant shall submit to the Building ancl
Planning Director/rlesignee for review any proposed final plats to ensure compliance
with these Finclings and Conditions of Approval.
5. A survey is required of the subject property prior to filing of che f nal short plat.
6. Apprupriate road name(s) and screet address(es) shall be indicatetl on the final plat map.
Appropriate utility easements shall be indicateci on the final plat map. Written approval
of utility ec-isements by utility companies must be received prior to filing of che final
plat.
8. The f nal short piat map shall indicate by a dashed line the required setbacks from all
private, Tract X or public roads. The dedication shall contain the following statement:
"Side yard and rear yard setbacks sliall be determined at the time building permits are
requested unless these setbacks are specifically drafted on this final plat. The setbacks
indicated on this subtiivision may be varied from if proper znning or variance approvals
are obtained."

9. Three (3) current certificates of title shall be furnished to the County Division of
Building and Planning prior to filing of the final plai.
10. The applicant shall contact the Division of Builciing and Planning at the earliest possible
stage in order to be informed of code requirements administered/eaforced as authorized
by the State Building Code Act. Design/development concerns include: addressing, fire
apparatus access roads: fire hydrant/flovv: approved water systems; building
accessibility; construction type; occupancy classification; existing; exterior wall
protection; and energy code regulations.

11. A plan for water facili'es adequate for domestic service and f re protection be approvecl
by the water supplier, fire protection district, Spokane County Division of Building and
County health authorities. The agencies will certify on the Water Plan, prior to the
filing of the final short plat or any phase of the preluninary short plat, that the plau is in
conforniance with their respective needs and regulations. The Water Plan and
certification will be drafted on a transparency suitable for reproduction and be signed
by the sponsor.
12. The purveyor will also certify on the Water Plan that appropriate contractual
arrangements and schedule of i.mprovements have been made with the sponsor for
construction of the water system in accordance with the approved Water Plan. The
time schedule for improvemeats wi11 provide for complecion of the water system and
inspection by the appropriate health authorities prior to appiication for building permits
within the final shorl plat. The arrangements or agreements will include aprovision
holding Spokane Counry and the purveyor harmless from claims by any tract purchaser
refused a building permit due to the failure of the sponsor to satisfactorily complete the
approved water system.
13. The final plac dedication will contain the following statement: "The public water
system, pursuant the Water Plan approved by County and State Health authorities, the
local fire disirict. County Division of Building and Planning, and water purveyor, will
be installed within this plat, and the subdivider/sponsor will provide for individual
domestic water serviee as well as fire protection to each tract prior to sale of eacli tract
and prior to issuance of a building permit for each tract."
14. No building permit wiU be issued for any cract within the final short plat until certified
by a Washington state-licensed engi.neer that "the water system has been installed
pursuant to the approved Water Plan for the final sliort plat," signed and stamped by
said engineer. The certification may be in the fotm of a letter, but is preferred to be
certified an a copy of the Water PIan as a schematic map showing the "as-buiit" water
sys(em.
15. The Spokane County Divisian of Building and Planning sball prepare and record witll
the County AudiEor a Tit1e Notice specifying a future land acquisition area for road
right-of-way and utilities. The reserved future acquisition area Title Notice shall be
released, in full or in part, by the Buiiding and Planning Division. The notice should
be recorded the same time as the final plat and shall provide the following:
a. At least 10 feet from the existing right of way is reserved for future acquisition
area for additional road right-of-way along Woodruff Roacl
b. Future building and other setbacks reyuired by the Spokane Caunty Zoaing
Code shall be measured from the reserved future acquisition area.
c. No required landscaping, parking, '208' areas, drainfield or allowed signs
should be located wtthin the future acquisition area for roaci right-of-way and
utilities. If any of the above improvements are made within this area, they shall
be relocated at the applicant's expense when roadway improvements are ,nade.
d. The future acquisition area, until acquired, shall be private property and may be
used as allowed in the zone, except tliat any improvements (such as landscaping,
parking, surface drainage, drainfield, signs or others) shall be considerecl
interim uses.
e. The property owner shall be responsible for relocating such "interim"
improvements at the time Spokane County makes roadway improvements after
acquiring said future acquisition area.

improvements pursuant ta RCW 36.8$, as amended. At svcb time as an RID is created
or any Road Impravement Froject is sanctioned by Spnkane County, the impravemenrs
required (cuxb, sidewal.k, drainage cantrol and paving to existing pavement) will be at
the sale expense of the undersigned awner, tbeir heirs, grantees and assigns. This
provisian is aFplicable ia Waodruff Road and Boone Avenue.
6. As an alternative method of constructing the rvad 'unprvvement stated herein, the
applicant may, with the approwal of the County Engineer, accomplish the road
improvements stated herein by joiaing and participacing ia a County Road Fcoject
(GRF) to the extent of the required road improvement. A►t such time as aii PID is
created ar any Raad Inlprovement Pr4ject %s sanctioned by Spokane Caunty, the
im.provemenCs required (curb, sidewalk, drainage contral and paving to existing
pavement) will be at the sale expense af tlie undersigned owner, their heirs, grantees

The RID waiver contained in this agreement shall expire after ten (lU) years from the
date of execution below. This provision is applicable to Woodruff Road and Boone
Avenue.
8. The County Engineer has designated a Local Access Roadway Section for the
improvement of Woodruff Road which is adjacent to the proposed development. This
will require the addition of approximately 5-7 feet of asphalt along the frontage of the
development. The construccion of curbing and sidewalk is also required.
9. The County Engineer has designated a Local Access Roadway Section for the
improvement of Boone Avenue which is impacted by the proposed development.
10. The proposed plat shall be improved to ttie standards set forth in Spokane County
Board of Commissioners Resolution No. 95-0498, as amended, which establishes
regulations for roads, approaches, drainage and fees in new construction.
11. The County Engineer has examined this develapment proPosal and has determined that
the imgact of this proposat upon the existing County Road System warrants roadway
unprovements herein specified.
12. The applicant shall grant applicable border easements adjacent to Spokane County
Right of Way per Spokane County Standards.
COUNTY DIVISION OF UTILITIES
1. Pursuant to the Board of County Commissioners Resolution No. 80-0418, the use of
on-site sewer disposal systems is hereby authorized. This authorization is
conditioned in compliance with all rules and regulations of the Spokane County
Health District and is further conditioned and subject to specific application
approval and issuance of pernuts by the Health Discrict. 2. The following statement shall be placed in the plat dedication:
"The owner(s) or successor(s) in interest agree to authorize the County to place
their name(s) on a petition for the formation of ULID by petition method pursuant
to RCW 36.94, which petition includes the owner(s)' property; and further not to
object by the signing of a protest petition against the formation of a ULID by
resolution method pursuant to RCW Chapter 36.94 v+►hich includes the owner(s)'
property. PROVIDED, this condition shall not prohibit the owner(s) or
successor(s) from objecdng to any assessment(s) on the property as a result of
improvements called for in conjunction with the formation of a ULID by either
petition or resolution under RCW Chapter 36.94."
3. The dedicatory language on the plat shall state: "Each new dwelling unit shail be
double-plumbed for corunection to future area-wide collection systems."
4. Tract "B" shall be doubled plumbed to Boone Avenue.
5. Sewer easement sliall be shown on the face of die plac as " Sewer and Utilities
Easement" prior to filing of the final plat.
6. Any water service for this project shall be provided in accordance with the
Coordinated Water System Plan for Spokane Counry, as amended.
SPQKANE, COUNTY HEALTH DISTRICT
1. The final plat shall be designed as indicated on Che preliminary plat of record andlor
any attached sheets as noted.
2. Appropriate utility easements shall be indicated on copies oF the preliminary plat of
record For distribution by the Building and Planning Division to the utility
companies, Spokane County Engineer and the Spokane County Healch District.
Written approval of the easements by the utility companies must be received prior to
the submittal of the final plat.
3. Sewage disposal method sUall be as authorized by Che Director of the Spokane
Couuty Division of Utilities.

4. Water service shall be coordinatetl through the Spokane County Division of
Utilities.
5. Water service shall be by an existing public water supply when approved by the
Regional Engineer (Spokane), State Department of Health.
6. Prior to filing the final plat, the sponsor shall demonstrate to the satisfaction of the
Spokane County Health District that an adequate and potable water supply is
available to each tract of the plat.
7. Prior to filing the final plat, the sponsor shall present evidence that the plat lies
within the recorded service area of the water system proposed to serve the plat.
8. Prior to filing the fnal ptat, the sponsor shall demonstrate to the satisfaction of the
Spokane County Health District that suitable sites for on-site sewage disposal
systems are available on Tract "B" .
9. Subject to specific appiication approval and issuance of permits by the Health
Officer, the use of individual on-site sewage disposal systems may be authorized.
10. The dedicatory language of the plat will state: "Subject to specific application
approval and issuance of permits by the Health Officer, the use of individual on-site
sewage systeni.s may be authorized. "
11. The dedicatory language on the plat shall state: "Use of private wells and water
systems is prohibited."

The Spokane County Engineering Department has reviewed the above referenced
application. The following "Conditions of Approval" are submitted to the
Spokane County Planning Department for inclusion in the "Findings of Fact,
Conclusions and Order/Decision" should the request be approved.
Prior to release of a buildinq permit or use of property as proposed:
1. That conditional approval of the plat by the County Engineer is given
subject to approval of the road system as indicated in the preliminary
' plat of record.
2. No construction work is to be performed within the existing or proposed
Public right-of-way until a permit has been issued by the County
Engineer. Al1 work is subject to inspection and approval by the County
Engineer.
3. The applicant should be advised that individual driveway access permits
are required prior to issuance of a building permit for driveway
approaches to the County road system.
4. Existing County roads providing direct access to the plat shall be
paved and/or curbed to Spokane County standards.
5. The word "applicant" shall include the owner(s) of the property,
his/her heirs, assigns and successors.

6. To construct the road improvements stated herein, the applicant may,
with the approval of the County Engineer, join in and be a willing
participant in any petition or resolution which purposes is the
formation of a Road Improvement District (RID) for said improvements
pursuant to RCW 36.88, as amended. At such time as an RID is created
ar any Road Improvement Project is sanctioned by Spokane County, the
improvements required (curb, sidewalk, drainage control and paving to
existing pavement) will be at the sole expense of the undersigned
owner, their heirs, granteea and assigns. This provision is applicable
to Woodruff Road and Boone Avenue.
7. As an alternative method of constructing the road improvement stated
herein, the applicant may, with the approval of the County Engineer,
accomplish the road improvements stated herein by joining and
participating in a County Road Project (CRP) to the extent of the
required road improvement. At such time as an RID is created or any
Road Improvement Project is sanctioned by Spokane County, the
improvements required (curb, sidewalk, drainage control and paving to
existing pavement) will be at the sole expense of the undersigned
owner, their heirs, grantees and assigns. This provision is applicable
to Woodruff Road and Boone Avenue.
e. That the following statement shall appear within the dedicatory
language of the final plat:
That in consideration of Mutual Benefits now or to be hereafter
derived, do for themselves, their heirs, grantees, assigns and
successor(s) in interest hereby request and authorize Spokane County to
inclu3e the above described property in a Road Improvement District
(RID) and to support the formation of a Road Improvement District for
improvement of the road(s) described below by requesting and
. authorizing Spokane County to place their name(e) on a petition for the
formation of a Road Improvement District pursuant to RCW 36.88.050, or
by requesting and authorizing Spokane County to cast their ballot in
favor of a RID being formed under the resolution method pursuant to RCW
36.88.030, and/or by not filing a protest against the formation of a
RID being formed under the alternative resolution method provided for
in RCW 36.88.065 and Chapter 35.43 RCW.

' If a RID is proposed for improvement of the road(s) described below,
said owner ( s) and successor (s) f urther agree :(1) that the improvement s
or construction contemplated within the proposed RID are feasible and
(2) that the benef its to be derived from the formation of the RID by
the property included therein, together with the amount of any County
participation, exceeds the cost and expense of formation of the RID,
and (3) that the property within the proposed RID is sufficiently
developed; provided, themselves, their heirs, grantees, assigns and
successor(s) shall retain the right, as authorized under RCW 36.88.090,
to object to any assessment(s) on the property as a result of the
iinprovements called for in conjunction with the formation of a RID by
either the petition or resolution method under Chapter 36.88 RCW and to
appeal to the Superior Court the decision of the Board of County
Commissioners confirming the f inal assessment roll; provided further,
it is recognized that actual asaessments may vary from assessment
estimate so long as they do not exceed a figure equal to the increased
true and f air value improvement ( s) add ( s) to the property.
It is further acknowledged and agreed that at such time as a RID is
created or any County Road Improvement project is authorized by Spakane
County, the improvements required shall be at the sole expense of the
owner(s) of property within the RID or served by the improvements
without any monetary participation by Spokane County.
The RID waiver contained in this agreement shal l expire after ten (10)
years,from the date of execution below. This provision is applicable
to Woodruff Road and Boone Avenue.
9. The County Engineer has designated a Local Access Roadway Section for
the improvement of Woodruff Road which is adjacent to the proposed
development. Thia will require the addition of approximately 5-7 feet
of asphalt along the frontage of the development. The construction of
curbing and sidewalk is also required.
10. The County Engineer has designated a Local Access Roadway Section for
. the improvement -of Boone Avenue which is impacted by the proposed
development.
11. The proposed plat shall be improved to the standards set forth in
Spokane County Board of Commissioners Resolution No. 95-0498, as
amended, which establiahes regulations for roads, approaches, drainage
and fees in new construction.
12. The County Engineer has examined this development proposal and has
, determined that the impact of this proposal upon the existing County
Road System warrants roadway improvements herein specif ied.
13. The applicant shall grant applicable border easements adjacent to
Spokane County Right of Way per Spokane County Standards.
