RE: Short Plat #SP1100-96, drainage and road conditions
Dear Mr. Hemming
Per our recent conversation, I axn writing this letter regarding drainage at short plat
#SP 1100-96. The addresses of the plat are E. 18832, 18902, 18914, and 18910 Second
Avenue in Greenacres, Washington (see attached copy of short plat). This property is
being developed with three new homes, in addition to the one existing. As homeowner's
nn the existing Second Avenue, we wrote a leiter requesting the road be completed where
these new home are being built and that dra.inage be adequate, since there exists a large
pool of water in from of this parcel due to lack of drainage. The builders have done some
grading in front of E. 18914 Second (we think this is for draanage of some kind), but they
have not done anything about the existing drainage problem in front oF E. 18832 Second,
where a standing pool of water always forms. The attached copy of the short plat has the
problem drainage area highlighted for your reference. The existing road is only single
lane with two-way traffic accessing it. This poses a great safety hazard with all the new
developments on Second Avenue. We request that the City Engineering department do
an inspection of the proposed and existing drainage and road conditions to be sure that
they comply with cunent building requirements.
Please advise us of the outcome of your investigation. We are confident that you are as
concerned as we are that the new development is done properly.

There rnay be a need in the future to construct a public road to serve the lands herein described.
Said road sha11 be 6structed in accordance with the then adopted Spokane County Road
Standards for publie roads. Said roaci to foilow, as near as practicable, the existing County road
right of way.
If additional right of way is required, the owners, their heirs and/or assigns agree to delivec to
Spokane County a properly signed and executed Right of Way Deed covering the required
additional right of way.
The owners or successars in intcrest agree to suthorize Spokane County to include the below
described property in a Roaci Improvement District (RID) and to support the formation of a Road
Improvement District for improvement of the road(s) described below by requesting and
authorizing Spokane County to place their name on a petition for formation of a Road
Lnprovement District ptusuant ta RCW 36.88.050, or by cequesting and authorizing Spokene
County to cast their ballot in favor of a RID being formed under the resolution method pursuant
to RCW 36.88.030, andlor by not fiiing a protest against the formation of a RID being formed
under the alternative resolution method provided for in RCW 36.88.065 and Chapter 35.43

is sulTicienlly developed; provided, the owners or successors shall retain the right, as authorized
under RCW 36.88.090, to object to any assessfhent(s) on the property as a result of the
improveinents called for in canjunctian with the formation of a RID by either the petition or
resolution metllod under Chapter 36.88 RCW and to appeal to the superior court the decision of
the Board of Caunty Commissioners confirming the fnal assessment roll; provided further, it is
recognized Ulat actual assessments may vary from assessmenl estimate so long as they do not
exceed a figure equal to the increased true and fair value the improvement add to the property.
By allowing a building permit to be issued on property having access from an unmaintained
County road, Spokane County assumes no obligation for said road, and the owners hereby
acknowledge that the Counly has no obligatinn of any kind or nature whatsoever to establish,
examine, survey, cunstruct, alter, repair, improve, maintain, provide drainage or snow removal
on said road. The requireinent is anci shall run with the land and shall be binding upon the
owners, tlieir heirs, successors or a,ssigns, until said road is improved to Spokane County Road
Slandards ancl accepted by ihe County For maintenance.

That the individuais and parties named herein aS Iiaving an interest in the abave clescribed praperty ar project agree
to the following:
t. Reimburse Spakane County for project review and inspectian fees as specified in Chapter 9.14 oF
tlie Spokane County Code. Tlie fees will be ba.sed on actual salary costs incurred by Spokane
County for project reviews and / ar inspections plus a ten percent administrative charge, ancl will
be billed monthly as accrued. Any billing amaunts due, including any expenses incurred in the
collection of an overdue account, must be paid prior to the County's acceptance of the project i'ar
filing. If a project is approved and/or filed with a balance still owing, the unpaid balance shatl he
paid wilhin 30 days of the invaice date.
2. The undersigned agrees that these Fees are due and payable upon receipt af the billing as specified
above.
3. Any invoices npt naid within 30 days of the invaice date wilt be considered delinquent. If any
outstanding balance an the accaunt far this project is not paid within 30 days of the invoice ciate,
na furtlier reviews of tiie projeet dacumentS will be conducted until the entire account balance is
paid. Any balance on the account for this project not paid within 65 days of the invoice date may
result in legal action ar the initiation of ather collection procedures, including referral ta a
colleetion agency. The Sponsor will be liabte far any anei all expenses incurred by the Cnunty far
the collection of overdue accounts.

Any buildfng that is constructed on a lot in thia Short Plat shall
be at auch an elevation so ae to provide posftive drainage from any
drainage entry point to the building (including but not limited to a
window well, a window unprotected by a window well, or a doorway).
Said pasitive drainage shall conaist of a minimum slope of 3% away
from the building for a distance of at least 10 feet from the
building. The lots shall be graded so that either a) all runoff is
• routed away from the. building, and conveyed aver the lots to _a
natural drainage swale or approved drainage facility, ar b) drainage
intercepted on the lot is disposed of on the lot in an approved
drainage facility. The approved drainage facility ehall be
constructed in accordance with any applicable accepted plans on file
at the County Engineer's Office. Any revfsions to the accepted
drainage plans must be accepted by the County Engineer's Office prior
to construction of said revisiona.
The property owners within this Shart Plat shall be responaible for
keeping open and maintaining the surface path of natural or man-made
drainage flow over and aczoss their reapective properties. Each
property owner or authorized representaCive shall inform each
succeeding purchaser of any drainage easementa on the property and
their responsibility for maintaining aurface drainage patha and
swales within said easemente. If the property owner(s' fails to
maintain the aurface path of natural or man-made drainage flow, or
the drainage swale, a notice of such failure may be given to the
' property owner(s). If not corrected within the period indicated on
said notice, Spokane County has the right to correct the maintenance
failure, or have it corrected, at the expense of the praperty owner.
This short plat is located within the Aquifer Sansitive Area (ASA)
Treatment of storm runoff from driveways shall be provided. The
preferred method of treatment is to have the runoff from drivewaye
sheet flow over lawn turf or native-type grasses. If a ditch is to
be used to collect runoEf from driveways, then the ditch is to be
grasa-lined.

The Border Easements as shown hereon are hereby granted to
Spokane County and its authorized agents, and to the public for
road purposes, including but not limited to curbs, sidewalks,
drainage, signage, and other usage deemed necessary by the
Spokane County Engineer for the safety and welfare of the Public.
No fence or portian thereof will be constructed within said
easement without permisaion of the Spokane County Engineer, nor
will any objects be placed in said easement that would obstruct
the sight distance necessary for safe and efficient vehicular
movement. Any other easements granted ar dedicated within this

SHORT PLAT NO. SP-1100-96 ) CONCLUSIONS AND
DECISION
THIS MATTER, an application for subdivisioa of land from Pavel Burlakov has been
received and was decided upon, pursuant to Spokane County Subdivision regulations, on the
21 g` day of February, 1997.
FINDINGS OF FACT AND CONCLUSIONS
1. The individual signing below has further been properly delegated the responsibility
for rendering the decision by tUe Director of Spokane County Division of Building
and Planning.
2. The proposal is to divide approximately 2.29 acres into 4 tracts for 1 existing single
family residence and 3 new additional residential tracts.
3. The subject property is a replat of Tract A of Short Plat 86-463, which was previously
exempted from the State Envirotunental Policy Act (SEPA) process and recorded as a
f inal shorl plat on March 23, 1987.
4. The proposal is located south of and adjacent to Second Avenue and approximately
650 feet east of Barker Road in the NW 1/4 of Section 20, Townslup 25 North, Range
45 E.W.M. Spokane County, Washington.
5. The cxisting zoning of tlie property described in the application is Urban Residential-
3.5 (UR-3.5) , which was established in 1991. Pursuant to Revised Code of
Washington (RCW) 58.17.195 the proposal does conform to the requirements of the
existing UR-3.5 zone.
6. The Spokane County Coniprehensive Plan designates this area as Urban. The
development and uses, as proposed and conditioned, are in compliance with the
Urban calegory.
7. Surrounding uses are primarily single family residences oa mixed urban size lots.
8. The Spokane County Arterial Road Plan identifies Second Avenue as a Locat Access
Road with a future right-of-way width of 60 feet. 17ie existing right-of-way width is
50 feet. In order to unplement the Arierial Road Plan, a strip of property 5 feet in
width along the Second Avenue frontage is to be set aside as a Future Acquisition
Area. Therefore, as conditioned (such as improvements and acquisition areas) the
proposal conforms to ttle Road Plan.
9. The site is located witlun the Public Transportation Beaefit Area (PTBA). I-iowever,
public transit services to the site are not available at this fiime. The nearest conneciing
service is located approximately 2 miles west of the site.
10. The proposed short plat will be served by a public water system. Waste water
disposal will be as authorized by the Directar of Utilities.
11. The required public notice was provided for this proposal and agencies having a
potential interest in the project were notified and recommendatioas solicited.
12. A petition and written comments were received from adjoining property owners whn
are opposed to the proposed short plat. The adjoining property owners are concerned
about additional devetopment, sewage, drAinage and flooding in the area.
13. In response to the above comments, the Spokane Regional Health District will
evaluate soils within the proposed short plat to determine suitability of specific soil
tynes for on-site sewa$e disposal. The County Engineer has conditioned this proposal
that a dra.inage pIan be required as a means to reduce or control surface, ground and
run-off wAter. Moreover, the inlent of the Urban category, which this proposal is
located is to provide the opportunity for development of a"citylike"environment.

The residential density in the Urban Residential-3.5 is approximately 3.5 residential
units per acre.
14. Recagnizing the recommended conditions and Spokane County development
standards, the proposed short plat makes appropriate provisions for the public Ilealth,
safety aad general welfare and that the public use and interest will be served by
platting the subdivision.
The subdivision proposal is generally consistent with RCW 58.17 and the County
subdivision regulations, promoting the public health, safety and general welfare in
accordance with standards established by the state and Spokaae County. The
Division of Building and Planning has considered the provision of adequate public
facilities as cited in RCW 58.17.110 (2). More specifically:
a. open spaces f sanitary waste disposal
b. drainage ways g. parks and recreation facilities
c. public and/or private right-of-ways h. playgrounds
d. transit i. schools and schoal grounds
e. potable water j. sidewalks
15. An Environmental Checklist was submitted by the sponsor mid was reviewed by the
Spokane County Division of I3uilding and Planning. The review considered the
specifics of the proposal, other available information, County ordinances, other
regulations and laws, possible standard Conditions of Approval, the Generalized
Comprehensive Plan, and other County policies and guidelines. The Division nf
Building and Planning has determined that "No probable significant adverse impacts"
would result from the proposal being developed and issued a Determinalion of
Nonsienificance ("DNS") on January 17, 1997.
The "DNS" was circulated for review and comments to those agencies/departments
affected by this proposal and future development. The "DNS" comment period ended
on February 3, 1997 and was advertised 15 calendar days before said date in the
newspaper. Comments were received from Spokane County Air Pallulion Control
Authority.
16. The Central Valley School District has commented on the proposed Short Plat. The
District has indicated that existiag school facilities are inadequate to serve the
proposed short plat and wishes to negotiate with the owner to provide adequate
capital facilities as required by the (RCV) 58.17.110. Review by County legal
counsel indicates the condition requested by the School District can be required for
developments. Approval of ihis short plat should include conditions requiring that
provisions for appropriate facilities be in place priur to recording the final short plat ui
the form of a written agreement between the owner and the schonl ciistrict.
DECISION
Based upon the above noted Findings of Fact and Conclusions, Short Plat Application
SP-1100-96 is hereby APPROVED for five (5) years, specifically to March 1, 2002 and subject
to conditions noted below. This decision is final unless appealed in writing, consistent witli
adapted appeal procedures.

l. The proposal shall comply with the Urban Residential-3.5 (UR-3.5) zone and other

2. The final short plat shall be designed substantially in conformance with the
preliminary plat of record. No increase of density oc number of tracts shall occur
without a change of condition applica'on submittal and approval.
3. Tlie prelitninary short plat is given conciitional apprnval for five (5) years, specifically to
March l, 2002. The applicant may submit an extension of time applica[ion

approximately Uurty (30) days prior to the above eXpiration dnte. Application(s) for
extension of time shall be processed under the provisions of Chapter 12.100.118
(Extension of Time) of the Spokane County Subdivision Ord.inance. If the applicant
complies with the criteria of Chapter 12.100.118, the preliminary approval and conditions
will be changed to reflect the adopted policy and development regulations at the tinie of
the extension application.
4. Prior to filing the final short plat, the applicant shall submit to the Division of Building
and Planning Director/designee for review Any proposed final plats co ensure compliance
with these Findings and Conditions of Approval.
5. A survey is required of the subject prvperty prior to filing the final short plat.
6. Appropriate road name(s) and street address(es) shall be vidicated on the final short plat
map.
7. Apprnpriate udlity ea.sements shall be indicated on the final short plat map. VVritten
approval of utility easemeuts by utility companies musc be received prior to filing of the
final short plat.
8. The final short plat map suall indicate by a dashed line the required setbacks from all
private or public roads.
9. The dedication shall contaul the following statement:
"Side yard and rear yard setbacks shall be determined at the time building permits
are requested unless these setbacks are speciGcally drafted on this final plat. The
setbacks indicated on this subdivision may be varied from if proper zoning or
variance approvals are obtained."
10. Three (3) current Certificates of Title shall be fumished to the County Division of
Building and Planning prior to filing of the final shorc plat.
11. The applicant shall contact the Division of Building and Planning at the earliest possible
stage in order to be infonned of code requirements administered/enforced as authorized
by the State Building Code Act. Design/development concerns include: addressing, fire
apparatus access roads, fire hydrandflow, approved water systems, building accessibility,
construction rype, occupancy classification, exiting, exterior wall protection, and energy
code regulations.
12. A plan for water facilities adequate for domestic service and fire protection shall be
approved by the water supplier, fue protection district, Spokane County Division of
Building and Plarining and County health authorities. The agencies will certify on the
Water Pla.a, prior to fiting the fioal short plat or any phase of the preliminary short plat,
that the plan is in conformance with their respective needs and regulations. Tlie Water
Plan and certification will be drafted on a transparency suitable for reproduction and be
signed by the sponsor.
13. Thc purveyor wiU also certify on the Water Plan that appropriate contractual
azrangements and schedule of iniprovements have been made with the sponsor for
construction nf the water system in accordance with the approved Water Plan. The time
schedule for improvements will provide for completion of the water system and
inspection by the appropriate health authorities prior to application for building permits
within the final sbort plat. The arrangements or agi•eecnents will include aprovision
holding Spokane County and the purveyor harmless from clauns by any tract purcliaser
refused a building permit due to the failu.re of the sponsor to satisfactorily complete the
approved water system.
14. The Fnal short plat dedicatian wiU contain the following statement: "The public water
system, pursuant the Water Plan approved by County and State Health authorities, the
local fire district, County Division of Building and Planning, and water purveyor, will Ue
installed within this plat, and the applicant will provide for individual domestic water
service as well as fire proteclion to each tract prior to sale of each tract and prior ta
issuance of a building permit for each tract."
15. No build.ing permit will be issued for any tract within the final short plat until certified by
a Washington State-licensed engineer that "the water system has been instalIcd pursuant
to the approved Water Plan for the final short plat," signed and stamped by said engineer.

The certification may be in the fomi of a letter, but is preferred to be cereified on a copy
of the Water Plan as a schematic map showing the "as-built" water system.
16. 'I'he Water Plan and the above four (4) conditions of approval regarding the Water Plan
may be waived by the Division of Building and Planning Director/designee upon receipt
of lctters from the appropriate water purveyor and fire protection district stating that
simple connections to an existing approved water system will provide adequate donlestic
and fire protection water to ensure the public health, safety and general welfare.
17. The Spokane County Division of Building and Planning shall prepare and record with the
County Auditor a Title Notice specifying a future land acquisition area for road right-of-
way and utilities. The reserved future acquisition area Title Notice shall be released, in
full or in part, by the Building and Planning Division. The notice should be recorded the
same time as the final short plat and shall provide ihe following:
a. A strip of property 5 feet fram the existing right-of-way is reserved for future
acquisition area for additional road right-of-way along Second Avenue.
b. Future building and other setbacks required by the Spokane County Zoning Code
shall be measured from the reserved future acquisition area.
c. No required landscaping, parrlcing, '208' areas, drainfield or allowed signs shnuld
be located within the future acquisition area for road right-of-way and utilities. If
aay of the above improvemenis are made wiUun this area, they shall be relocated
at the applicant's expense when roadway improvements are made.
d. The future acquisition area, until acquired, shall be private property and niay be
used as allowed in the zone, except that any improvements (such as landscaping,
parking, surface drainage, drainfield, signs or others) shall be considered interim
uses.
e. The property owaer shall be responsible for relocating sucb "interim"
improvements at the time Spokaue County makes roadway improvements after
acquiring said future acquisition area.
18. The ovmer shall negotiate with Central Valley School District and submit a recorded
copy of a voluntary agreement making provisions for public schools prior to filing the
final shori plat. The agreement shall provide a writien description of the subject property
to which the agreement applies and also state the dollar amount and any other agreed to
mitigating measures.
The owner shall also notify any potential purchasers who have made an agreement to
purchase property within said plat pursuant to RCW 58.17.205, thal adequate provisions
for school facilities must be made conditioned on a future agreement between the
applicant and school district.
Voluntary agreements between the owner and sc:hool district shall conform to the
requirements of RCW Chapter 82.02.
COUNTY DIVISIUN OF ENGINEERING AND ROADS CONllITIONS
1. That conditional approval of the plat by the County Engineer is given subject to approval
of the road system a.s indicated in the preliminary plat of record.
2. That plans, profiles and cross sections as designed to County standards showing proposed
street centerline and curb grades be submitted to the County Engineer for acceptance
prior to construction and/or the filing of afinal plat; road plans to be prepared undec tlle
direction nf a licensed professional Civil Engineer.
3. That drainage plans and design calculations showing the alignment of drainage facilities
be submitted to the County Engineer for acceptuice prior to coastruction and/or the filing
of the final short plat. Drainage plans to be prepared wider the direction of a licensed
professionaI Civil Engineer.
4. Construction within the proposed public slreets and easements shall be performed under
the direct supervision of a licensed engineer/surveyor, who shall furnish the County
Engineer with "as built" plans and a certificate in wTiting that all improvements were
installed to the lines and grades shown on the approved construction plans and that all
disturbed monuments liave been replaced.

5. No construction work is to be performed within the ex.isting or proposed public right-of-
way until a permit has been issued by the County Engineer. All work is subject to
inspection and approval by the County Engineer.
6. The applicant should be advised that individual driveway access permits are required
prior to issuance of a building permit for driveway approaches to the County road system.
7. Existing County roads providing direct access to the plat silall be paved and/or curbed tn
Spokane County standards.
8. To construct the road improvements stated herein, the applicant rriay, with the approval of
the County Engineer, join in and be a willing participant in any petition or resolution
which purposes is the formation of a Road Improvement District (RID) for said
improvements pursuant to RCW 36.$8, as amended. At such time as an RID is created or
any Road Improvement Project is sanetioned by Spokane County, the improvements
required (curb, sidewalk, drainage control and paving to existing pavement) will be at the
sole expense of the undersigned owner, iheir heirs, grantees and assigns. This provision is
applicable to Second Avenue.
9. As an alternaiive method of constructing the road improvement stated herein, the
applicant may, with the approval of the County Engineer, accomplish the road
improvements stated herein by joining and participating in a County Road Project (CRP)
to the extent of the required road improvement. At such time as an RID is created or any
Road Improvement Project is sanctianed by Spokane County, the improvements required
(curb, sidewalk, drainage control and paving to existing pavement) will be at the sole
expense of the undersigned ownera their heirs, grantees and assigns. This provision is
applicable to Second Avenue.
10. That the following statement sha11 appear within the dedicatory language of the final
short plat:
"That in consideration of Mutual Benefits now or to be hereafter derived, do for
themselves, their heirs, grantees, assigns and successor(s) in interest hereby
request and authorize Spokane County to include the above described property in
a Road Improvement District (RID) and to support the formation of a Road
Improvement District for improvement of the road(s) described below by
requesting and authorizing Spokane County to place their name(s) on a petition
for the formation of a Road Improvement District pursuant to RCW 36.88.050, or
by requesting and authorizing Spokane County to cast their ballot in favor of a
RID being formed under the resolution method pursuant to RCW 36.88.030,
and/or by not filing a protest against the formation of a RID being formed under
the alternative resolution method provided for in RCW 36.88.065 and Chapter
35.43 RCW.
"If a RID is proposed for improvement of the road(s) described below, said
nwner(s) and successor(s)further agree: (1) that the improvements or construction
contemplared witlun the proposed RID are feasible and (2) that the benefits to be
derived from the formation of the RID by the property included therein, togethcr
with the amount of any County participation, exceeds the cost and expense of
formation of the RID, and (3) lhat the property within the proposed RID is
sufficiently developed; provided, lhemselves, their heirs, grantees, assigns and
successor(s) shall retain the right, as authorized under RCW 36.88.090, to object
to any assessment(s) on the property as a result of the improvemenis called for in
conjunction with the fonnation of a RID by either the petition or resolution
method under Chapter 36.88 RCW and to appeal to the Superior Court the
decision of the Board of County Commissioners confirming the final assessment
roU; provided further, it is recngnized that actual assessments may vary from
assessment estimate so long as they do not exceed a figure equal to the increased
true and fair value improvement(s) add(s) to the nroperty.
"It is fiuther acknowledged and agreed that at such time as a RID is created or any
County Road Improvement project is aurhorized by Spokane County, the
improvements required shall be at the sole expense of the owner(s) of property
withiri the RID or served by the ituprovecnenis without any monetary participation
by Spokane County.

from the date of execution below. This provision is applicable to Second
Avenue."
11. The County Engineer has designated a Local Access RoadwAy Section for the
improvement of Second Avenue which is adjacent to the proposed development. This
will i-equire an additiona] X number of feet of asphalt atong the frontage of tlic
development. The construction of curbing and sidewalk is also required.
12. The proposed plat shall be improved ta the standards set forth in Spokane County Board
of Commissioners Resolution No. 95-0498, as ameaded, whi.cb establishes regulacians for
roads, approaches, drainage and fees in new construction.
13. The applicannt shall sign and record a"Spokane County Notice to the Public No. 4.
Execution of the document will allow use of the unmaintained riglit-of-way as access to
the proposal. Private road plans aze not required for this project. Road plans were
approved for SP-877-93. The applicant shall enter into the existing maintenance
agreement for the private road.
14. The County Engineer has examined this development proposal and has determined that
the impact of this proposal upon the existing County Road System warrants the roadway
iinprovecnents herein specified.
15. The applicant shall grant applicable border easements adjacent to Spokane County right-
of-way per Spokane County Standards.
16. The 20 foot driveway easement shall only serve lots "2" and "3" as shown on the
preliminary plat. If lots "1" and "4" use tlie driveway easement than it shall conform to
Spokane County Private Road Standards.
SPOKANE COUNTY DIVISION OF UTILITIES
1. Pursuant to the Board of County Commissioners Resolution No. 80-0418, the use of on-
site sewer disposal systems is hereby authorized. This authorization is conditioned in
campliance with all rules and regulations of the Spokane Regional Health District a.nd is
furtlier conditianed and subject to specific applieation approval and issuance of permits
by the Health District.
2. The follawing statement shall be placed in the plat dedication:
"The owner(s) or successor(s) in interest agree to authorize the County to place
their name(s) on a petition for the formation of ULID by petition method pursuant
to RCW 36.94, which petition includes the owner(s)' propetty; and further not to
object by the signing of a protest petition against the formation of a ULID by
resolution method pursuant to RCW Chapter 36.94 which includes the owner(s)'
properry. PROVIDED, this condition shall not prohibit the owner(s) or
successor(s) from objecting to any assessnient(s) on the property as a result of
improvements called for in conjunction with the formation of a ULID by either
petition or resolution under RCW Chapter 36.94."

Water System Plan for Spokane County, as amended.

DESCRIPTION OF PROPOSAL: The Spokane County Division of Building and Planning
has received a Preliminary Short Plat Application to divide approximateIy 2.29 acre parcel
of land into 4 tracts for 1 existing singie family residence and 3 new additional residential
tracts in Urban Residential-3.5 (UR-3.5) zone.
APPLICANT: Pavel Burlakov, 18902 E. Second Avenue, Greenacres, WA., 99016
LOCATION OF PROPOSAL: The proposed site is located south of and adjacent to
Second Avenue and approximately 650 feet east of Barker Road in the NW 1/4 of Section
20, Township 25 North, Range 45 E.W.M., Spokane County, Washington. The address of
the site is 18902 E. Second Avenue, Greenacres, WA., 99016.
LEAD AGENCY: Spokane County Division of Building and Planning
DETERMINATION: The lead agency for this proposal has determined that it does not
have a probable significant adverse impact on the environment as conditioned and as
regulated under the present local and State regulations. An Environmental Impact
Statement (EIS) is not required under RCW 43.21C.030(2)(c). This decision was made
after review of a completed Environmental Checklist and other information (adopted
policies, plans, regulations and added conditions, ete.) on file with the lead agency. This
information is ava.ilable to the public on request.
This DNS is issued under WAC 197-11-340(2); the lead agency will not act on this proposal
for at least 15 days from the date issued (below). Comments regarding this DNS must be
submitted by January 27, 1997 if they are intended to alter the DNS.

' The Spokane Caunty Engineering Department has reviewed the above referenced
application. The following "Conditions of Approval" are submitted to the
Spokane County Planning Department for inclusion in the "Findings of Fact,
Conclusions and Order/Decision" should the request be approved.
Prior to release of a buildinq permit or use of property as proposed:
1. That conditional approval of the plat by the County Engineer is given
- subject to approval of the road system as indicated in the preliminary
plat of record.
2. That plans, profiles and cross sections as designed to County standards
showing proposed street centerline and curb grades be submitted to the
County Engineer for acceptance prior to construction and/or the filing
of a final plat; road plans to be prepared under the direction of a
licensed Professional Civil Engineer.
• 3. That drainage plans and design calculations showing the alignment of
drainage facilities be submitted to the County Engineer for acceptance
prior to construction and/or the filing of the final plat. Drainage
plans to be prepared under the direction of a licensed Professional
Civil Engineer.
4. Construction within the proposed public streets and easements shall be
performed under the direct supervision of a licensed engineer/surveyor,
who shall furnish the County Engineer with "As Built" plans and a
• certificate in writing that all improvements were installed to the
lines and grades shov+m on the approved construction plans and that all
disturbed monuments have been replaced.
5. No construction work is to be performed within the existing or proposed
Public right-of-way until a permit has been issued by the County
Engineer. All work is subject to inspection and approval by the County
Engineer.

6. The applicant should be advised that individual driveway access permits
are required prior to issuance of a building permit for driveway
approaches to the County road system.
7. Existing County roads providing direct access to the plat shall be
paved and/or curbed to Spokane County standards.
8. To construct the road improvements stated herein, the applicant may,
with the approval of the County Engineer, join in and be a willing
participant in any petition or resolution which purposes is the
formation of a Road Improvement District (RID) for said improvements
pursuant to RCW 36.88, as amended. At such time as an RID is created
or any Road Improvement Project is sanctioned by Spokane County, the
improvements required (curb, sidewalk, drainage control and paving to
existing pavement) will be at the sole expense of the undersigned
owner, their heirs, grantees and assigns. This provision is applicable
to Second Avenue.
9. As an alternative method of constructing the road improvement stated
herein, the applicant may, with the approval of the County Engineer,
accomplish the road improvements stated herein by joining and
- participating in a County Road Project (CRP) to the extent of the
required road improvement. At such time as an RID is created or any
Road Improvement Project is sanctioned by Spokane County, the
improvements required (curb, sidewalk, drainage control and paving to
existing pavement) will be at the sole expense of the undersigned
owner, their heirs, grantees and assigns. This provision is applicable
to Second Avenue.
10. That the following statement shall appear within the dedicatory
- language of the final plat:
That in consideration of Mutual Benefits now or to be hereafter
derived, do for themselves, their heirs, grantees, assigns and
successor(s) in interest hereby request and authorize Spokane County to
include the above described property in a Road Improvement District
(RID) and to support the formation of a Road Improvement District for
improvement of the road(s) described below by requesting and
authorizing Spokane County to place their name(s) on a petition for the
• formation of a Road Improvement District pursuant to RCW 36.88.050, or
by requesting and authorizing Spokane County to cast their ballot in
favor of a RID being formed under the resolution method pursuant to RCW
36.88.030, and/or by not filing a protest against the formation of a
RID being formed under the alternative resolution method provided for
in RCW 36.88.065 and Chapter 35.43 RCW.

If a RID is proposed for improvement of the road (s) described below,
said owner(a) and successor (s) further agree: (1) that the improvements
or construction contemplated within the proposed RID are feasible and
(2) that the benefits to be derived from the formation of the RID by
the praperty included therein, together with the amount of any County
participation, exceeds the cost and expense of formation of the RID,
and .(3) that the property within the proposed RID is sufficiently
developed; provided, themselves, their heirs, grantees, assigns and
successor(s) shall retain the right, as authorized under RCW 36.88.090,
to object to any assessment(s) on the property as a result of the
improvements called for in conjunction with the formation of a RID by
either the petition or resolution method under Chapter 36.88 RCW and to
appeal to the Superior Court the decision of the Board of County
Commissioners confirming the final assessment roll; provided further,
it is recognized that actual assesaments may vary from assessment
estimate so long as they do not exceed a figure equal to the increased
true and fair value improvement(s) add(s) to the property.
It is further acknowledged and agreed that at such time as a RID is
created or any County Road Improvement project is authorized by Spokane
County, the improvements required shall be at the sole expense of the
owner(s) of property within the RID or served by the improvements
without any monetary participation by Spokane County.
The RID waiver contained in this agreement ahal l expire af ter ten (10)
yeara from the date of execution below. This provision is applicable
to Second Avenue.
11. The County Engineer has designated a Local Access Roadway Section for
the improvernent of Second Avenue which is adjacent to the proposed
development. This will require the addition of approximately X feet of
asphalt along the frontage of the development. The construction of
curbing and sidewalk is also required.
12. The proposed plat shall be improved to the standards set forth in
Spokane County Board of Commissioners Resolution No. 95-0498, as
amended, which establishes regulations for roads, approaches, drainage
and fees in new construction.
13. The applicant shall sign and record a"Spokane County Notice to the
Public No.4. Execution of the document will allow use of the
unmaintained right of way as access to the proposal. Private road
plans are not required for this project. Road plans were approved for
SP-877-93. The applicant shall enter into the existing maintenance
' agreement for the private road.
14. The County Engineer has examined this development proposal and has
determined that the impact of this proposal upon the existing County
Road System warrants the roadway improvements herein specified.
15. The applicant shall grant applicable border easements adjacent to
Spokane County Right of Way per Spokane County Standards.
