Dear John:
David Evans and Associates, Inc. (DEA) has reviewed the Trip Distribution Letter prepared by WCE for the
Rooks Development Preliminary Plat and Rezone. The letter is dated February 22°d, 2005.
T'he site is located in the neighborhood south of Broadway Avenue and west of Progress Road. The access
point will be onto Burns Road. Fifteen single family homes are proposed. The project is expected to
generate 15 new PM peak hour trips, and approximately 175 daily trips.
Overall Finding
The project will generate less than 20 PM peak hour trips and can therefore be exempted from concurrency
requirements. It is recommended that a Transportation Concurrency Certificate be issued for the project.

Dear John:
Per State Environmental Policy Act (SEPA) and City of Spokane Valiey
requirements, we have prepar+ed a trip distribution letter for a proposed
residentiai development. This letter wili establish the anticipated trip generation
and distribution for the development as shown on Figure Z, Site Plan, and
detemnine if further study may be required. This report will follow the standards
fior doing traffic distribution letters as r+equired by the City of Spokane Valley.
PROJECT DESCRiPTiON
The project proposes the development of 2.74 acres of vacarrt land into 15 single
family residenfial lots. The prvject will create a private road (Otive Lane) that wiil
temninate with a cul-de-sac. Attached to the cul-de-sac are two private driveways
that serve the back six lots.

The site is listed on the cument comprehensive pian as low dens'ity residential
and currenfly zoned as UR-3.5 (Urban Residential - 3.5 units per acre) with a
request to rezone to UR 7. The project lies on a portion of the SE 1/4 of Secfion
14, T.25N., R.44E., W.M. within the City of Spokane Valley, Spokane County,
Washington. A vicinity map is incruded as Figure 1 and a preliminary copy of the
Site Plan is included as Figune 2, as prepared by Whipple Consulting Engineers
(VIICE), please see the Appendix. The short plat number for the site is

340 feet south of the intersection of Bums Road and Broadway Avenue.
TRIP GENERATION AND DISTRIBUTION
Trip Types
The proposed project is residential, which generates its peak trips during the AM
and PM hours. This comes in#o oonsideration when trying to assess traffic
impacts for residential pr+ojects. ITE has developed data regarding various trip
types that all developments experience. These are fou ~d in several places,
however, for this analysis the Trip Generation Manual 7 Edition as well as the
Trip Generation Handbook were used to develop the criteria for this analysis.
Generally residential developments will be made up of new(destination) trips, but
can also include any of these other trip types: pass-by trips, diverted trips, and
shared (intemal trips). For this project, only new trips were considered, and pass-
by, diverted, and shared trips were determinecl to be negligible.
In order #o better understand the trip types available for land access a description
of each specrfic trip type follows.
New (Destination) Trips - These types of trips occur only to access a specfic
land use such as a new retail development or a new residential subdivision.
These types of trips will travel ta and from the new site and a single other
destinafion such as home or work. This is the only trip type that will result in a
net increase in the total amount of traffic within the study area. The reason
primarily is that these trips represent planned trips to a specific destination that
never took trips to that part of the City prior to the development being constructed
and occupied. This project will develop new trips.
Pass-by Trips - These trips represent vehicles which currently use adjacent
roadways providing primary access to new land uses or projects. These trips,
however, have an urdmate destination other than the project in question. They
should be viewed as drop-in cusfiomers who stop in on their way home from
work. A good example is a quick stop at the grocery stone to pick up an
ingredient for dinner on the way home from work or at a latte stand to grab a
coffee on the way to work. This can make this trip pre-determined, but the stop
is still on the way by, another example would be on payday, where an individual
generally drives by their bank every day without stopping, except on payday. On
that day, this driver would drive into the bank, perform the prerequisite banking
and then corrtinue on home. In this example, the trip started from worlc with a
destination of home, however on the way, the driver stopped at the grocery
store/latte stand and/or bank directly adjacent to their path. Pass-by trips are

most atways associated with commerciaVretail types of developments. Therefore,
no pass by trips will be generated
Diverted (Linked) Trips - These trips occur when a vehicle takes a diiferent
route than normai to access a specfflc facility. Diverted trips are similar to pass-
by trips, but diverted trips ocxur from roadways, which do not provide direct
access to the site. Instead, one or more streets must be utilized to get to and
from the site. For this project, because of the many different routes that can be
taken to and from the site and the distances involved, we believe that these
wauld be difficult to track and verify. Therefore, no diverted trips were
acknowledged for this analysis, even though they most surely exist to some
point.
Shared Trips - These are trips which occur on the site where a
vehicle%nsumer will stop at more than one place on the sfte. For example,
someone desfined for a certain shop at a commercial site may stop at a bank just
before or after they visit the shop that they went to the site to visit. This trip type
reduces the number of new trips generated on the public road system and is
most cornmonly used for commercial or mixed use developments. Determining
these trip types is mor+e diificult to quantify and without specific guidance are
usually determined by engineering judgment on a project by project basis. For
this project no shaned trips were considered given the nature of the development
Trip Generation Characteristics for the Proposed Project
For the proposed project, Land Use Code (LUC) 210, Single Family Detached
Housing, was used to determine the trip generation for this 2.74 acre site. As
noted eadier, trip generation rates are determined by use of the Tiip Generation
Manual, 74h Edrtion published by the Institute of Transqortation EnQineers. The
purpose of the Trip Generation Manual is to compile and quantify ernpirical trip
generation rates for specific land uses within the US, UK and Canada. The trip
generation rates for the proposed development are shovm on Table 1.

The above table shows the trips generated during the respective AM and PM
peak hours. There are 12 trips generated during the AM peak, with 9 of them
exiting the site and 3 trips entering. A total of 15 trips are generated during the
PM peak hour, 10 trips entering the site and 5 trips exiting. A discussion of the
distribution of these trips follows.
TRiP DisTRiBUrIoN
As shown on the vicinity map, the site will be directly accessed from Bums Road
via Valleyway Avenue and Broadway Avenue. It is expected that the residents of
the site will commute to and from work using Broadway Avenue and Adams
Road with routes to/from these arterials using Bums Road and Valley Way.
BroadwaM Avenue extends from Summit Boulevard (northwest of
. downtown Spokane) to Barker Road, senring a mix of residential,
commercial, and industrial uses throughout Spokane and Spokane Valley.
Within the study area Broadway Avenue is a two-way, four lane urban
minor arterial. The posted speed limit in this area is 35 MPH with a 20
MPH speed limit exception near the five school zones that are on or near
Broadway Avenue in the valley. Progress Elementary is the closest school
zone to the site. The intersection of Broadway Avenue and Bums Road is
twaway stop conbrolled.
Burns Road extends from Mission Avenue south to approximately
Valleyway Avenue. Bums Road is a two-way, finro lane local access road
and services the residential uses that sumound it. The posted speed limit
is 25 MPH. The intersection of Bums Road and Valleyway Avenue is a T-
type intersecfion with control on Bums Road.

ValleywaV Avenue extends from Fancher Road east to Fiora Road within
Spakane Valiey. Within the study area, Valleyway Avenue is a finraway,
twalane locai access road that serves the residential uses that bonier its
alignment. The posted speed limit on Valleyway Avenue is 25 MPH. The
intersection of Valleyway Avenue and Adams Road is a T-type
intersection with contr+ol on Valleyway Avenue.
Adams Road extends from Mission Avenue south to 3e Avenue.
Generally, Adams Road serves single family residenfial uses its entire
length with the exception of a commercial anea at the irrtersection of
Sprague Avenue and Adams Road. Adams Road is a two-way, two lane
urban minor arterial with a posted speed limit of 35 MPH. Two school
zones, Sunrise Elementary and St. Maries School have a speed limit of 20
MPH when childnen are present.
Considering many factors such as the surrounding transportation facilities, typical
commuting pattems and existing development in the area, traffic for the proposed
development is anticipated as follows. tt is expected that 40% of the trips to/from
the site will be east on Broadway Avenue tolfrom Sullivan Road. These trips will
be associated with the extensive commercaal amenities located near the Sullivan
Road and Interstate 90 interchange. In association with the Evengreen Road and
Interstate 90 interchange and other uses to the west, 30% will go west on
Broadway Avenue, 20% will go to/from the site on Adams Road to Sprague
Avenue and tum right (westbound) in association with the amenities and
businesses of the Spokane Valley that line Sprague Avenue. The remaining 10%
will go tolfrom the site via Valleyway Avenue to Progress Road where 5% will
continue to Sullivan Road and the other 5% will go south to Sprague Avenue.
Based upon field investigations, there does not appear to be any sight distance
conflicts for this proposed use.
The above-mentioned traffic distribution percentages are based on engineering
judgment and actual traffic observations.

CONCLUSIONS AND RECOMMENDATiONS
It is articipated that this project will generate 12 AM peak hour trips and 15 PM
peak hour trips. A general threshold for requiring add'rtional intersection traffic
analysis is typically 30 peak hour trips per intersection. Based on the low number
of trips generated, we do not believe that additional traffic analysis should be
required.

I need your thoughts on this issue of groundwater up on Glennaire Orive.
I just got off tfie phone with Mrs. Lassman who lives at the irrtersection of Glennaire Drive and Glendora. This
iniersection is the first one on the left at the top of the hill as you come down. Mrs. Lassman's property is the one
with the large "South View" sign in her yard. She is also the one directly below the large "bubblers" (finro catch
basins with DOT grates that water comes out of rather ihan into) near the top of Glennaire Drive. She has had
years of damage due to stormwater and ground water related problems.
There is evidence indicating that ground water in this area is flowing through the backfill of the stormwater pipe
teading to the bubblers. Ground water is flowing to the ground surface behind the curb in the area of the
bubblers .
I have a contraci with Taylor Engineering to prepare drawings for the replacement of curbs and guriers along
Gtennaire Orive to keep stormwater in Glennaire Drive rather then allowing water to flow down the side sVeets
and causing problems. I have a draft copy of these drawings in my office.
Do you think it is the countys responsbility to deal with the ground water conveyed through the stormwater pipe
backfill? Do you think 1he county is liable for damage to Mrs. Lassman's house or property because "our'
stormwater pipe is allowing ground water to flow directly to her properiy? Should I have Taylor look into a
system where we intercept the ground water at ihe bubblers and convey it down the surface of the road along
with the stonnwaterl
As ( write these questions I find myself answering "no" to each one. Do you agree? I know that this ground water
issue is a big one with the City in areas Ifke Moran Prairie. it's an issue we need to have some serious discussion
on soon.

l. Reiinburse Spnkane County for project review and inspection fees as specifiecl in Chapter 9.14 of
the Spokane County Code. Tl,ie fees will be based on aclual salary cosLS incurred by Spokane
County for project reviews and / or inspections plus a ten percent administrative ciiarge, and will
be billed monthly as accrued. Any billing aenounts due, including any expen.ses iiicurred in tlle

Community Congregational Church of Vera, Washington, a corporation,
together with evidence of the identity and authority oi the parties to

FINDI~GS OF FACT ANll CONCLUSIONS
1. The icidividual signing below has fiirther been properly delcgated the responsibiliry for
rendering tlie decision by the Director of Spokane County Division of Building and
Plaiuiing.
2. The proposal is to divide approxitnately 4.7 acres into 4 tracts for 1 existing Church atld 3
ncw residentiallracts.
3. The proposal is located between Progress Road aiid Burns Rnad and approximately 300
feet south of Broadway Avenue in the SE 1/4 of SeCtion 14, Township 25 North, Range
44 E.W.M. Spokane Cnu.nty, Washington.
4. `I'he existing zoning of the property describecl in the application is Urban Rcsidential-3.5
(UR-3.5), which was established in 1991. Pursuant to Revised Code of Waslungton
(RCW) 58.17.195, this proposal conforms to the requirements of the existing UR-3.5
zone.
5. The Spokane Count~ Comprehensive Plan designates this area as Urban. The
development anti uses, as proposed uid conditioned, are in compliance with Ulis
dcsignation.
6. Surrounding uses are prim-cuily single family residcnCes on mixed urban sizc lots.
7. `I'he Spokane County A.rterial Road Plan ideutifies Progress Road and I3urns IZoad a.s
Local Access Roads v,vith a future right-of-way width of 60 feet. The existing right-of-
way width of both is 140 feet. In order to implement the Arterial Road Plan, a strip of
property 10 feet in width along the Progress Roacl and Burns Road froiilage are to be set
aside as Future AcquiSition Areas. Therefore, as condilioned (such as improvement~fi and
acquisition areas) the ~roposal confonns to the Road Plan.
8. The site is loclted wilhin the Public Tran$portation Benefit Area (Y1'Bf1). Tlie Spokane
Transit Authority (STA) Broadway Route no. 18 provides connecting services tn the site.

9. The proposed short plat will be served by a public water system. Waste vvatcr dispnsal
wiIl be as authorized by the Dircctor of Spokane County Division of Utilities.

10. The required public nntice was provideci for Uiis proposal and agencies having a potential
interest in the project were notified and recommentlations solicited.
11. Written commencs were received fram an adjoining properiy nwner who is in favor vf the
proposed short plat.
12. Recognizing the recoznmended conditions and Spokane County developmeUt siandards,
the proposed short plat makes appropriate provisions for the public health, sa1'ety aiid
general weIfare and that the Public use and interest will be served by nlatting the
subdivision.
The subdivision proposal is generally consistent with RCW 58.17 and the Cauilty
subdivision regulations, promoting the public lieAlth, safety and genei•al welfare in
accordance witli standards established by the State and Spokane County. The Counly
Division of Building and Planning hns considered ilie provision af adequate publ ic
faCilities as cited in RCW 58.17.110 (2). More specifically:

District has indicated 'that exisling schonl Faeilities are inadequate to serve the propUSed
short plat and wislies io negotiate with the owncr to provide adequate capital facilities as
required by the Kevisied Code of Washington (RCW) 58.17.110. Iteview by Cnunty
legal counsel indicates the condition requested by the School District can be required for
developments. Appraval of this suort plat sliould include conclitions requiring tllat
provisions for appropriate facilities be in place prior to recording the final short plat in the
form of a written agreement between the ownier and the school district.

Based upon the above noted riiidings of Fact and Concltisions, ShArt I'lat Application SI'-1109-
96 is hereby APPROVEt D for five (5) years, specifically to March 1, 2002 and subject to
conditions noted below. This decision is tinal unless appealed in writing, Consistent with
adapted appeal procedures. ~

All the belAw conditions ilnposed shall be binding on the "Applicant," which term shall include
the owner or owners of the property, heirs, assigns and successors.
SPOI{ANE COUNTY DIVISION OF BUILDING AND PLANNING
1. 'Ibe proposal shall eomply with the Urban Residential-3.5 (UR-3.5) zone and other
applicable Zoning Cocie chapters, as amended.
2. The final short plat shall be designed substan/ially in conformance with the preliminary
plat of rccord. No increase of density or number of tracts shall occur without a change of
condition application Isubmittal and approval.
3. The preliminary suort plat is given conditionat approval tur five (5) years, specificaily to
March 1, 2002. The applicant may submit an extension of time application
approximately thirty (30) days prior to the abnve expiration date. Apptication(s) for
extension of time sball be processed under the provisions af Chapfier 12.100.11$
(Extension of Time) of the Spokane Couaty Subdivision Oxdinance. If the applicant
complies with the criteria of Chapter 12.100.118a the preliminary approval and eonditions
will be Changed to reflect the ad4pted policy and development regulations at the time of
the extension application.
4. Priur tu filing of the tinal short plata the applicant shall submit to the County Division oI'
Building and Plaiuiing Direetor/designee for reviEw any praposed final short plAts to
ensure compliance wtth these Findings and Conditions of Appraval.
5. A survey is required of the subject property prior to filing of the final short plat.
6. Appropriate roacl narne(s) and street address(es) shall be indicated on the final sliort plat
map.
7. Appropriate utility easements shall be indicated on the final short plat map. Writtcn
approval of utility easements by utility coinpanies must bc received prior to iiling of the
final short plat.
The final short plat map shall indicate by a dashed line the required setbacks !'rnm all
private or public roads.

10. T1uee (3) current Certificates of Title shall be Curnished to the County Division of
IIuilding and Planning prior to filing of the FnAI shori plat.
11. 1'he applicant shall contact the Coulity Division of Building and Planning at the cai•licst
possible stage in orcler to be inFormed of code requirements administered/enforced as
authorized by the State Builcling Code Act. Design/development concerns include:
addressing, fire apptuatus access roads, fire hydranUtlnw, approved water systenls,
building accessibiliry, construction type, accupancy classiFcation, exiting, exterior wall
Protection, and energy code regulations.
12. The Spokane County' Division of Building and Planning shall prepare and record wiih the
County Auditor a Tixle Notice specifying a future land acquisition area for road right-of
way and utilities. The reserved future acquisition area Title Notice shall be released, in
full or in pai-t, by the County Division of Buildiug and Placuning. The notice should be
recordcd the same tinhe as the final shori plal and shall provide the following:

acquisition area for additional road right-of-way along Progress Road.
b. A strip of property 10 feet from the existing right-of-way is reserved for future
acquisition area for additional road right-of-way along Burns Road.
c. Future building and other setbacks required by the Spokane County 'Lnning Code
shall be measure4 from tlie reserved future acquisition area.
d. No required landscaping, parking, `208' areas, drainfield or allowed signs should be
located within tlie future acquisition area for road right-of-way and utilities. If any of
the above improwements are made wif.hin this are3, they shall be relocAted at tlle
applicant's expense when roadway improvements are made.
e. The future acquiSition area, until acquired, shall be private property and may he used
as allowed i❑ the zone, except that any improvements (such as landscaping, parking,
surface drainage„ drainfield, signs or others) shall bc considered interim uses.
f. The property owiler shall be responsible For relocating such "interim" improvements
at the time Spokine County makes roadway unprovements after acyuiring said future
acquisition area.

13. No water plan is required, only a simple connection will be needed prior to the sale of
eacli tract and prior to issuance of a building permit for each tract.
14. The owner sha11 negntiate wit11 Central Valley Schnol District aiid submit a recorcied
copy of a voluntary agreement making provisions for public schools prioi• to finalization
and recording of the plat. The agreement shall provide a written description of the
subject property to v+rhich tlle agreement applies and also state the dollar amount and any
other agreed to mitigating measures.
The owner shall also notify any potciitial purchasers who have made an agreement to
purchase properiy within sa.id plat pursuant to the Revised Code of Washington (RCW)
58.17.205, that adequate provisions for school facilities must be made conditioned on a
future agreement bexween the plattor and school district.
Voluntary agreeme#ts between the owner and sehool district shall conform to the
requirements of RCW Chapter 82.02.
SPUKANE COUNTY DIVISION OF ENGM, ERING AND ROADS
1. That conditional approval of the plat by the County Engineer is given subject to the road
systein as indicated in the preliminary plat of record.
2. That plans, profiles and cross sections as designed to County standards showulg proposed
street centerline and curb grades be submitted to the County Engineer for acceptance
priar to construction and/or the filing of a final plat; road plans to be prepared under the
direction of a licensed Professional Civil Engineer.

be submitted to the Co!unty Engineer for acceptance grior to construction andlor the filing

4. No conslruction work is to be perFormed within the existing or proposeti public cight-of-
way until a pernut has been issued by the County Engineer. All work is subject ta
inspection and approval by the County Engineer.
5. The applieant should 'be advised that individual driveway access permits are required
prior to issuance of a building permit for driveway approaches to the County road system.
6. Existing County roao prnviding direct access to the plat shall be paved andlor curbed to
Spnkaiie County staznd~ards.
7. To constcuct the road ~mprovements stateci herein, the applicant niay, with the apprnval of
the Cotuity Engineer, join in and be a willing participant in any petition or resolution
which purposes is the formation of a Road Improvement District (RID) For said
improvements pursuaat to IZCW 36.88, as amended. At such time as an RID is createci or
any Road Improvement Project is sanctioned by Spokalle County, the improvements
' requu•ed (curb, sidewalk, drauiiage controi and paving to existing pavement) N'trill be at the
sole expense of the un;dersigued owner, their heirs, graniees and assigns. This pravision is
applicable to Progress; Road and Burns Road.
8. As an alternative method of constructing the road improvement stalecl herein, the
applicant may, with the approval of the County Engineer, accomplish the ►•oad
improvements statcd herein by joining and participating in a County Road Project (CRP)
to the extent of the required road improvement. At such time as an RID is created or any
Rnad Improvement Project is sanctioned by Spokmie Cnunty, the improvements required
(curb, sidewalk, drai~iage control and paving to existing pavement) will be at the sole
expense of the undersigned owner, their heirs, grantees and assigns. This provision is
applicable to Progress Road and Burns Road.

Improvewent District for impl•ovement of the road(s) described below by
requesting and at}thorizing Spokane County to place their nanie(s) on a petition
for the formation of a Road Improvement Dislrict pursuant to RCW 36.83.050, nr
by requesting and authorizing Spokane County to cast their ballot in favor of a
ItID being formed under the resolution method pursuant to RCW 36.$8.030,
and/or by not filing a protest against the formation of a RID being formed under
the alternative resolution inetllod provided for in RCW 36.$8.065 and Chapier
35.43 RCW.
If a RID is proposed for improvement of the road(s) described below, said
owAner(s) aad successor(s)fiuther agree: (1) that the improvements or constructian
contemplated wigun the proposed RID are feasible and (2) iliat the benefits to be
derived from the, formation of the RID by the property inc;luded therein, together
with the acnount of any County participation, exceeds the cost and expense of
formation of the RID, and (3) that the property within the proposed RID is
sufficiently developed; provided, themselves, thcir heirs, grantees, assigns arid
successor(s) shall cetain the riglit, as authorized under RCW 36.88.090, to object
to any assessment(s) on die property as a result of the improvements called for in
conjunction with the forniation of a RID by either the petition or resalution
method under Chapter 36.88 RCW Qild to appeal to the Supcrior Courc the
decision of the Board of County Commissioners confirniing the final assessment
roll; provided further, it is recognized that actual assessments may V1ry fl'Olll
assessment estimate so long as they do not exceed a figwe equal to the increased

It is furdler acknowledged and agreed that at such time as a RID is created or any
County Road I;mprovement project is authorized by Spokane County, the

within the RID or served by the improvemenis without any monetary participation
by Spokane County.

require the addition Of approximately 5-7 fcet of asphalt along the f'rontage of the
developmcnt. The conscruction of curbing and sidewalk is also required.

1. Pursuailt to the Board~ of County Commissioners Resolution No. 80-0418, the use oi' on-
site sewer disposal systems is hereby authorized. This aucliorization is c;onditiolled in
compliance with all rules and regulations of the Spoknne Regional Health District and is
further conditioned and subjeet to specific appiication approval and issuance of permits
by the Health District.
2. 1'he following statcment shall bc placed in the final plai dedication:
"The owner(s) or successor(s) in interest agree to authorize the County to place
their name(s) on a petition for the formatioa of ULID by petition method pursuant
to RCW 36.94, wliich petition includes the owncr(s)' property; and furcher not lo
object by the signing of a protest petition against the formation oF a ULID by
resotution method piusuant to RCW Chapter 36.94 which includes the owner(s)'
property. PROVIDED, this condition shall not prolubit the owner(s) or
succ:essor(s) from objecting to any assessment(s) on the property as a result of
itnprovements called for in conjunecion with the formation of a ULID by either ~
petition or resolution under RCW Chapter 36.94."
3. The dedicatory language ou the final plat shall state: "Each new dwelling unit shall be
double-plumbed For connection to future area-wide collection systems."
4. Aiiy water service for this project shall be provided in accordance with the Coordinated
Water System Plan for Spnkane County, as amended.

9. The ciedicatory language on the final short plat shall state: "Use of private wells and

The Spokane County Engineering Department has reviewed the above referenced
application. The followihg "Conditions of Approval" are submitted to the
Spokane County Planning Department for inclusion in the "Findings of Fact,
Canclusions and Order/Decision" should the request be approved.

Prior to release of a building permit or uae of property as proposed:
1. That conditional approval of the plat by the County Engineer is given
. subject to dedication of right-of-way and approval of the road system
as indicated in the pzeliminary plat of record.
2. That plans, profiles and cross sections as designed to County standards
showing proposed street centerline and curb grades be submitted ta the
County Engineer for acceptance prior to construction and/or the filing
of a final plat; road plans to be prepared under the direction of a
licensed Professionall Civil Engineer.
. 3. That dxainage plans and design calculations showing the alignment of
dsainage facilities be submitted to the County Engineer for acceptance
prior to construction and/or the filing of the final plat. Drainage
plans to be prepared under the direction of a licensed Professional
Civil Engineer.
4. No construction work is to be performed within the existing or proposed
Public right-of-way until a permit has been issued by the County
Engineer. All work is subject to inspection and approval by the County
. Engineer.
5. The applicant should be advised that individual driveway access permits
are required prior to issuance of a building permit for driveway
approaches to the County road system.
6. Existing County roads providing direct access to the plat shall be
paved and/or curbed to Spokane County standards.

7. To construct the road improvements stated herein, the applicant may,
with the approval of the County Engineer, join in and be a willing
participant in any petition or resolution which purposes is the
formation of a Road xmprovement District (RID) for said improvements
pursuant to RCW 3 6. 8 S,, as annended. At such time as an RID is created
or any Road Improvement Project is sanctioned by Spokane County, the
improvements required (curb, sidewalk, drainage control and paving to
existing pavement) will be at the sole expense of the undersigned
owner, their heirs, grantees and assigns. This provision is applicable
to Progress Road and Burns Road.
8. As an alternative method of constructing the road improvement stated
herein, the applicant may, with the approval of the County Engineer,
accomplish the road improvements stated herein by joining and
participating in a County Road Project (CRP) to the extent of the
required road improvement. At such time as an RID is created or any
Road Improvement Project is sanctioned by Spokane County, the
improvements required (curb, sidewalk, drainage control and paving to
existing pavement) will be at the sole expense of the undersigned
owner, their heirs, grantees and assigns. This provision is applicable
ta Progress Road and Burns Road.
9. That the following statement shall appear within the dedicatory
` language of the final plat:
That in consideration of Mutual Benefits now or to be hereafter
derived, do for themselves, their heirs, grantees, assigns and
successor(s) in interest hereby request and authorize Spokane County to
include the above described property in a Road Improvement District
(RID) and to support the formation of a Road Improvement District for
improvement of the road(s) described below by requesting and
authorizing Spokane County to place their name(s) on a petition for the
` formation of a Road xmprovement District pursuant to RCW 36.88.050, or
by requesting and authorizing Spokane County to cast their ballot in
favor of a RID being formed under the resolution method pursuant to RCW
36.88.030, and/or by not filing a protest against the formation of a
RID being formed under the alternative resolution method provided for
in RCW 36.88.065 and Chapter 35.43 RCW.

or construction contetnplated within the proposed RID are feasible and
(2) that the benef its ta be derived from the formation of the RID by
the property included therein, together with the amount of any County
participation, exceeds the cost and expense of formation of the RID,
and (3) that the property within the proposed RID is sufficiently
developed; provided,, themselves, their heirs, grantees, assigns and
successor(s) shall retain the right, as authorized under RCW 36.88.090,
to object to any assessment(s) on the property as a result of the
improvements called f{or in conjunction with the formation of a RID by
either the petition or resolution method under Chapter 36.88 RCW and to
appeal to the Superior Court the decision of the Board of County
Commissioners confirming the final assessment roll; provided further,
it is recognized that actual aseessments may vary from assessment
estimate so long as they do not exceed a f igure equal to the increased
true and f air value improvement ( s) add ( s) to the property.
. It is further acknowledged and agreed that at such time as a RID is
created or any County Road Improvement project is authorized by Spokane
County, the improvemeInts required shall be at the sole expense of the
owner(s) of property within the RID or served by the improvements
without any monetary participation by Spokane County.
The RID waiver contained in thia agreement shall expire after ten (10)
years from the date of execution below. Thia provision is applicable
to Progress Road and 8urns Road.

10. The County Engineer has designated a Local Access Roadway Section for
the improvement of Burns Road which is adjacent to the proposed
development. This will require the addition of approximately 5-7 feet
of asphalt along the frontage of the development. The construction of
curbing and sidewalk is also required.
11. The County Engineer ~ias designated a Local Access Roadway Section for
the improvement of 8rogress Road which is adjacent to the proposed
• development. This will require the addition of approximately 5-7 feet
of asphalt along thelfrontage af the development. The construction of

12. The proposed plat shall be improved to the standards set forth in
Spokane County Board of Commissioners Resolution No. 95-0498, as
amended, which establishes regulations for roads, approaches, drainage
and fees in new construction.
13. The County Engineer has examined this development proposal and has
determined that the impact of this proposal upon the existing County
Road System warrants the dedication of additional Right of Way and the
roadway improvements herein specified.
14. The applicant shall grant applicable border easements adjacent to
Spokane County 1Right of Way per Spokane County Standards.
