The public streets and/or drainage facilities shown on this plat are hereby dedicated to the
City of Spokane Valley for public use.
The subdividerlsponsor will construct the public and private streets and a11 associated
clrainage facilities in conformance with the approved plans on file in the City Engineer's
Office.
`Jrhat in consideration of Mutual Benefits now or to be hereafter derived, do for
themselves, their heirs, grantees, assigns, and successor(s) in interest hereby request and
authorize the City of Spokane Valley to include the above described property in a Local
Improvement District (LID) and to support the formation of a LID for improvement of
the street(s) described below by requesting and authorizing the City of Spokane Valley to
place their names on a petition for the formation of a LID pursuant to RCW 35.43.120, or
by requesting a.ad authorizing the City of Spokane Valley to cast their ballot in favor of a
LID being formed under the resolution method pursuant to RCW 35.43.140 and.150,
andlor by not filing a protest against the formation of a LID being fonned under the
alternate resolution method provided for in RCW 35.43.
f a LID is proposed for improvement of the street(s) described below, said owner(s) and
successor(s) further agree: (1) that the improvement(s) or construction contemplated
within the proposed LID are feasible and (2) that the benefits to be derived from the
formation of the LID by the property included therein, together with the amount of any
City participation, exceed the cost and expense of formation of the LID, and (3) that the
property within the proposed LID is sufficiently developed; provided, themselves, their
heirs, grantees, assigns and successor(s) shall retain the right, as authorized under RCW
35.43.180, to object to any assessment(s) on the property as a result of the improvements
called for in conjunction with the formation of an LID by either perition or resolution
method under RCW 35.43, and to appeal to the Superior Court the decision of the City
Council confiiming the final assessment roll; provided further, it is recognized that actual
assessments may vary from assessment estimate so long as they do not exceed a figure
equal to the i.ncreased true and fair value improvements add to the property.
Vlt is further acknowledged and agreed tbat at such time as an LID is created or any City
Street Improvement project is authorized by the City of Spokane Valley, the
improvements required shall be at the sole expense of owner(s) of property within the
LID or served by the imprnvements without any monetary parrticipation by the City of
Spokane Valley.
kh'he LID waiver contained in this agreement shall expire ten (10) years from the date of

AThe Border Easement as shown hereon is hereby granted to the City of Spokane Valley and
its authorized agents, and to the public for road purposes, including but not limited to curbs,
sidewalks, drai.aage, signage, and other usage deemed necessary by the City of Spokane
Valley Engineer for the safety and welfare of the public. No fence or portion thereof will be
coastructed within said easement without permission of the City of Spokane Valley
Engineer, nor wi11 any objects be placed in said easement that would obstruct the sight
distance necessary for safe and efficient vehicular movements. Any other easements
granted or dedicated within the Border Easement area will be subordinate to the rights
created by this easement and are subject to the City of Spokane Valley's pemut process
prior to usage.
The private roads and/or common areas shown on this plat are hereby dedicated to the

The City of Spokane Va11ey is hereby granted the right of iagress and egress to all private
roads, common areas andlor drainage easements.
Drainage easements as platted and shown hereon, which are for the purpose of conveying
and storing stormwater runoff, and for installing, operating and maintaining drainage ponds
and drainage facilities which dispose of and treat stormwater runoff, are hereby granted to
the City of the Spokane Valley. The drainage easements are located on Lots 4, 5, 13, and
14 of Block 1.
The Gity of Spokane Valley and its authorized agents are hereby granted the right to
ingress and egress to, over and from all public drainage easements for the purposes of
inspection and emergency maintenance of drainage swales, ponds, ditches, culverts and
other drainage facilities, if not properly maintained by the lot owners. The City of Spokane
Valley does not accept the responsibility to i.nspect or maintain drainage facilities located
outside of public rights-of-way, except in cases where the City of Spokane Valley
specifically assumes that responsibility in writing. Neither does the City of Spokane Va11ey
accept any liability for any failure by the property ovrmers to properly maintain such areas.

A lot is served by a private road when: a. the only road frontage for the lot in the
Development is on the private road, or; b. a lot having frontage on more thari one road
(public or private) constructs an approach to the private road.
The Home
Uwner's Association or their successors in interest sha11 maintain the private roads and
associated drainage facilities in conformance with the approved plans on file in the City
Engineer's Office.
The owner(s) of any lot created by the Develapment or alternation thereof and served by
a private raad shall be responsible for maintenance of said private road, including
associated drainage facilities.
Maintenanee financing nf the private roads and associated drainage facilities shall be in a
manner determined by the
Home Owners Association or their successors in iinterest.
Should the
Iiome Owners Association be tenninated for any reason, the successors in interest shall
be the individual lot owners, or their successors in interest, who are members of the
Home Ovrners Association at the time of said termination.
Owners of lots within the Development who are served by such road, may sue and
recover damages and attorneys' fees from any owner of any lot within the Develapment
which is similarly served who refuses to participate in the road and drainage faciliries,
construction, financing, and maintenance.
WARNING: The City of Spokane Yalley has no responsibilit}r to build, improve, or
maintain or otherwise service the private roads, and associated drainage facilities
contained within or providing senlice to the property described in this Development. By
accepting the Detrelopfnent or subsequentlv by allowing a building perniit to be issued for
property on a pritiiate road, Spokane Vallev assumes no obligation for said pf•iti~ate road
and the owners hereby acknowledge that the City has no obligation of any kind of nattsre
xAhatsoever to establish, examine, survey, construct, alter, repair, improve, maintain,
provide drainuge or snoKr removal on a private road, or ids' assaciuted drainage
facilities.
This covenant and agreement shall run with the land and shall be binding upon the owner,
their heirs, successors or assigns, including the obligation to participate in the
maintenance of the private road and drainage facilities as provided herein.
JThe property owners withun this plat are responsible for keeping open and mai.ntaming the
surface path of natural or man-made drainage flow over and across their respective
pmperties. If the property owners fail to maintain the surface path of natural or man-made

drainage flaw, or drainage facilities on private praperties, a notice af such failure may be
given to the property owners. If not corrected withi.n tbe periad indicated on said notice,
the City af Spokane VaIley has the right to carrect the maintenance failure, ar have it

2. The current closure fails to meet the mapping requirements set by the Subdivision
Ordinance for Sgokane County which has been adopted by the City of Spokane Valley.

THE SPOKANE COUNTY DIVISION OF PLANNING
IN THE MATTER OF AN EXTENSION FINDINGS OF FACT,
OF T1ME REQUEST FOR SP-1116-96 CONCLUSIONS AND
SHORT SUBDIVISION DECISION
THIS MATTER, a request for an extension of time received from Gerald Morse and
decided upon, pursuant to Section 12.100.118 of the Spokane County Subdivision
Ordinance and RCW 58.17.140.
FINDINGS OF FACT AND CONCLUSIONS
1. The individual signing below has been properly delegated the responsibitity for
rendering the decision by the Director of Spokane County Division of Planning.
2. The proposal is to divide approximately 1.46 acres into 4 single family residential
lots.
3. The proposal is located west of and adjacent to Progress Road in #he NE '/o, of
Section 26, Township 25 North, Range 44 E.W.M., Spokane County, Washington.
Assessor's Tax Parcel # 45261.2819.
4. Since preliminary approval of the short subdivision was granted, the
Comprehensive Plan designation changed from Urban (U) to Low Density
Residential (LDR) pursuant to Resolution # 2-0037. As conditioned, the proposal
is consistent with the new LDR category.
5. The existing zoning of the property is Urban Residential-3.5 (UR-3.5) as
established consistent with the Phase I Development Regulations adopted by the
Board of Commissioners on January 15, 2002, pursuant to County Resolution 2-
0037. The zoning in effect prior to the adoption of the Phase I Development
Regulations was Urban Residential-3.5 (UR-3.5). Finalization of the short plat
shall comply with the development standards of the Urban Residential - 3.5 (UR-
3.5) Zone.
6. Spokane County has established specific criteria for considering the extension of
time for the expiration of preliminary subdivisions. These criteria are found in
Section 12.100.118 (Extensions of Time) of the Spokane County Subdivision
Ordinance and have been used as a basis for this decision. Section 12.100.118
states that the Director of the Division of Planning may administratively approve an
extension provided there are no significant changed conditions which would render
filing of the plat or binding site plan contrary to the public heatth, safety or general
welfare, and further provided one or more of the following circumstances are found
to apply:
1) That some portion of the existing preliminary plat has been rinalized since the
/asf exfension was granted and the remaining lots would form a unffied
development consistent with the original approval;

RESPONSE: No portion of the preliminary short subdivision has been
finaliZed.
2) That the preliminary short subdivision remains generally consistent with fhe
original short p/at that was approved, and the sponsor has taken substantial
steps towards rinalizing the p/at or binding site plan, which sha!! include one,
but is not limited to, the following:
a. surveying the lots within lhe development;
b. arranging for public services to the site;
c. obiaining necessary financing for all or a portion of the preliminary
subdivision, short subdivision, or binding site plan;
d. the completion of studies or other requirements which were part of
preliminary subdivision, short subdivision, or binding site p/an approval.
RESPONSE:
The applicant has had discussions with the water and sewer purveyors
regarding their specific requirements and will provide a water plan to the water
purveyor in the near future. The applicant states that the short subdivision
would likely be finalized prior to the end of 2002.
3) That at the time the preliminary plat approval was granted, development of the
proposal was conditioned upon the extension of public services which are not
yet availab/e. This provision shall not apply to public utility extension, which the
project sponsor would normally fund.
RESPONSE: Not applicable.
4) That administrative delays have caused the inabi/ity of the applicant to rina/ize
the plat within ihe f'rve (5) year time period.
REPSONSE: Not applicable.
9. This is the first request for a time extension. The extension request was submitted
in a timely manner consistent with the requirements of the Spokane County
Subdivision Ordinance. The total life of the preliminary plat has been approximately
five (5) years.
10. The proposal has been circulated to all affected agencies and departments for
comment. Additions, deletions and revisions of conditions were submitted to the
Division of Planning.
11. The applicant shall show substantlal progress toward finalizing the subject short
plat and demonstrate compliance with Section 12.100.118 of the Subdivision
Ordinance before an additional extension of time is granted.
12. The County Engineer has examined this development proposal and has
determined that the impact of this proposal upon the existing county road system
warrants the roadway improvements herein specified.

13. The proposed short plat will be served by a public water system. Waste water
disposal will be as authorized by the Director of Spokane County Division of
Utilities.
DECISION
BASED UPON THE ABOVE Findings of Fact and Conciusions, an extension of time
request for application SP-1116-96 is hereby APPROVED until March 1, 2005. The
extension period shall run from March 1, 2002 to March 1, 2005. This approval is subject
to the conditions specified below.
CONDITIONS OF APPROVAL
All the below conditions imposed shall be binding on the "Applicant," which terrn shall
include the owner or owners of the property, heirs, assigns and successors. ltalicized
wording represent new requirements that wece not included with the preliminary
approval of the short plat.
SPOKANE COUNTY DIVISION OF PLANNING
1. The proposal shall comply with the Urban Residential-3.5(UR-3.5) Zone and other
applicable Zoning Code chapters, as amended.
2. The final short plat shall be designed substantially in conformance with the
preliminary plat of record. No increase of density or number of tracts shall occur
without a change of condition application submittal and approval.
3. The preliminary short plat is given canditional approval for five (5) years,
specifically to March 1, 2005. The applicant may submit an extension of time
application a minimum of thirty (30) days prior to the above expiration date.
Application(s) for extension of time shall be processed under the provisions of
Chapter 12.100.118 (Extension of Time) of the Spokane County Subdivision
Ordinance. If the applicant complies with the criteria of Chapter 12.100.118, the
preliminary approval and conditions will be changed to reflect the adopted policy
and development regulations at the time of the extension application. The time
extension nequest must be submitted by noi Iater than January 30, 2005.
Submission of a time extension request following said date will not be accepted
and will r+ander the preliminary plat null and void on March 9, 2005.
4. Prior to filing the final short plat, the applicant shall submit to the Division of
Planning Directorldesignee for review a proposed final short plat to
ensure compliance with these Findings and Conditions of Approval.
5. A survey is required of the subject property prior to filing the final short plat.
6. Appropriate road name(s) and street addresses shall be indicated on the final short
plat map.
7. Appropriate utility easements shall be indicated on the final short plat map. Written
approval of utility easements by utility companies must be received prior to filing the

owner(s) and successor(s)further agree: (1) that the improvements or
construction contemplated within the proposed RID are feasible and (2) that the
benefits to be derived from the formation of the RID by the property inctuded
therein, together with the amount of any County participation, exceeds the cost
and expense of formation of the RID, and (3) that the property within the
proposed RID is sufficiently developed; provided, #hemselves, their heirs,

6. The County Engineer has designated a Local Access Roadway Section for the
improvement of Progress Road which is adjacent to the proposed development.
This will require the addition of approximately 9-11 feet of asphalt along the
frontage of the development. The construction of curbing and sidewalk is also
required.
7. The proposed plat shall be improved to the standards set forth in Spokane County
Board of Commissioners Resolution No. 1-0298, as amended, which establishes
regulations for roads, approaches, drainage and fees in new construction.
8. The applicant shall grant applicable border easements adjacent to Spokane
County right-of-way per Spokane County standards.
9. The proposed driveway shall senre only Tracts "A" "B" and "C" as shown on the
preliminary plat. Tract "D" shall construct its own driveway access to Progress
Road. The use of the proposed driveway by all four lots shall result in the driveway
being constructed to Spokane County Private Road standards which includes
acceptance of road and drainage plans by the County Engineer, and 20 feet of
asphalt surfacing within a 40 foot private road easement.

DECISION
THIS MATTER, an application for subdivision of land from Gerald Morse and M.K. Van
Zyverden has been received and was decided upon, pursuant to Spokane County Subdivision
regulations, on the 19''' day of February, 1997.
FINDINGS OF FACT ANt) CONCLUSIONS
l. The individual signing below has furthcr been properly delegated the responsibility for
rendering the decision by the Director of Spokane County Division of Building and
Planning. ,
2. The proposal is to divide approximately 1.46 acres into 4 residential tracts.
3. The praposal is lncated west of and adjacent to Progress Road in the NE '/4 of Section 26,
Township 25 North, Range 44 E.W.M., Spokane County, Washington.
4. The existing zoning of the property described in the application is Urban Residential-3.5
(UR-3.5), which was established in 1991. Pursuant to Revised Code of Weshington
(RCW) 58.17.195, this proposal conforms ta the requirements of the existing UR-3.5
zone.
5. The Spokane County Comprehensive Plan designates this area as Urban. The
development and uses, as proposed and conditioned, a.re in compliance with the Urban
category.
6. Surrounding uses are primarily single family residences on mixed urban size lots.
7. The Spokane County Arterial Road Plan identifies Progress Road as a Local Access RoQd
v%zth a future right-of-way width of 60 feei. The existing right-of-way widtb is 40 feet.
In order to implement tlie Arterial Road Plan, a strip of praperty 10 feet in width along
the Progress Road frontAge is to be set aside as a Future Acquisition Area. Therefore, as
conditioned (such as improvements, sidewalks and acquisition areas) the propASal
conforms ta the Road Plan.
8. The proposed site is located witlun the Public Transportation Benefit Area (PTBA). The
Spokane Transit Authority (STA) Valley ! 24`h Avenue Route 21 provides connecting
services to the site.
9. The proposed short plat will be served by a Public water system. Waste water dispasal
will be as authorized by the Director of Spokane County Divisian of Utiliiies.
10. The required public notice was provided for this proposAl and agencies having apotential
interest in the project were notified and recommendations solicited.
11. Written comments were received from adjoining property owners who are cancerned
about access to ttte pronosed tracts, the size of each tract, drainage and the adverse impact
additional develorment will have on their neighborhood.
12. In response to the above comments, the intent of the Urban category, wluch this proposal
is located is to provide the opportunity for development of a"citylike" environment.
The resideatial density in the Urban Residential-3.5 (UR-3.5) zone is approximately 3.5
residential units per acre. The smallest lot area the applicant has proposed is
approximately 14,568 sq. ft. ,which exceeds the minimum 10,000 sq. ft. lot area for a
single family residence in the existing UR-3.5 zone. In addition, the Spokane Valley Fire
Department and the County Engineer has conditioned ihis proposal to provide adequate
drainage, access and fire protection to the property.
13. Recognizing the recommended canditions and Spokane County development standards,
tlie proposed short pIat makes appropriate provisions for the public health, safety and
general welfare and that the public use and interest will be served by platting the
subdivision.
The subdivision proposal is generally consistent witli RCW 58.17 and the County
suhdivision regulations, promoting the public liealth, safety and general welfare in
accordance with standards established by the State and Spokane County. The County
Division of Building and Alanning has considered the provision of adequate public
faeilities as cited in RCW 58.17.110 (2). Mnre specifically:
a. open spaces f. sanitary waste disposal
b. drainage ways g. parks and recreation facilities
c. public and/or privace right-of-ways h. playgrounds
d. transit i. schools and school grounds
e. potable water j. sidewalks
14. The project is exempt from environmental review under the State Fnvironmental Policy
Act pursuant to WAC 197-11-800 (6) (a).
15. The Central Valley School District has commented on the proposed Sho:~ Plat. Tile
District lias indicated that existing school facilities are inadequate to serve the proposed
short plat and wishes to negotiate with the awner to provide adequate capital facilities as
required by the Revised Code of Washington (RCW) 58.17.110. Review by County
legal counsel indicates the condition requested by the School District can be required far
developments. Approval of this short nlat sliouid include conditions requiring that
provisions for appropriate facilities be in place prior to recording the final short plat in the
forru of a written agreement between the o~.~+ner and the school district.
DECISION
Based apon the above noted Findings of ract and Conclusions, Short Plat Application
SP-1116-96 is hereby APPROVED for five (5) years, specifically to March 1, 2002 and subject
to conditions noted below. This decision is final unless appealed in wriri-iig, consistent with
adopted appeal pr4cedures.
CONDITIONS AF APPROVAL
All the below conditions imposed shall be binding on the "Applicant," which term shall include
the owner or owners of the property, heirs, assigns and successors.

12. A plan for water facilities adequate for doraestic service and fire protection shall be
approved by the water supplier, fire protection district, Spokane County Division of
Building and Planning and County health authorities. The agencies will certify on the
Water Pian, priort to filing the final short plat or any phase of the preliminary short plat,
that the plan is in conformance with their respective needs and regulations. The Water
Plan and certification will be drafted on a transparency suitable for reproduc•.ion and be
signed by the sponsor.
13. The purveyor will also certif.y on the Water Plan that appropriate contractual
arrangements and schedule of improvements have been made with the sponsor for
construction of the wate: system in accordance with the approved Water Plan. The time
schedule for improvements will provide far completion of the water system and
inspectian by the appropriate health authorities prior to application for building permits
within the final short plat. The arrangements or agreements will include a provision
holding Spokane Count}► and the purveyor harmless from claims by any tract purchaser
cefused a building permit due to the failure of the sponsor to satisfactonly complete the
approved water system.
14. The final short plat dedication will contain the following statement:
"The public water system, purstiant to the Water Plan approved by County and
State Health authorities, the local fire district, County Division of Building and
Planning, and water purveyor, will be installed within this plat, and the applicant
will provide for individual domestic water service as well as f re protection to
each tract prior to sale of each tract and prior to issuance of a building pernvt for
each tract."
15. No building permit will be issued for any tract within the final short plat until certifiecl by
a Washington State-licensed eagineer that "the water system has been installed pursuant
to the anproved Water Plan for the final short plat," signed and s:amped by said engineer.
The certification may he in the form of a letter, 5ut is preferred to be certified on a copy
of the Water Plan as a schematic map showing the "as-built" water system.
16. The Water Plan and the above four (4) conditioas of approval regarding the Water Plan
rnay be waiued by the Caunty I)ivisian of Building and Planning Directorldesignee upon
receipt of letters from the appropriate water purveyor and fire protection district stating
that simple connections to an existing approved water system will provide adequate
domestic and fire protection water to ensure the public health, safety aiid general welfare.
17. The Spokane County Division of Building and Planning shaU prepare and record with the
County Auditor a Title Notice spetiifying a future land acquisition area for road right-of-
way and utilities. The reserved future acquisition area Title Nofiice shall be released, in
fiill or in part, by the County Divisian of Building and Planning. The notice should be
recarded the same time as the final short plat and sllall pravide the fallowing:
a. A strip of property 10 feet from the existing right-of-way is reserved for future
acquisition area for additional road right-of-way along Progress Road.

b. Future building and other setbacks required by the Spokane County Zoning Code
shall be measured from the reserved future acquisition area.
c. No required landscaping, parkiag, '208' areas, drainfield or allowed signs should
be located within the fuhire acguisition area for road right-of-way and utilities. If
any of the above improvements are made within this area, they sliall be relocated
at the applicant's expense when roadway improvements are made.
d. 1'he future acquisition area, until acquired, shall be private property and may be
used as allowed in the zone, except that any improvements (such as landscaping,
parking, surface drainage, drainfield, signs pr others) shall be considered interim
uses.
e. The property owner shall be responsible for relocating such "interim"
improvements at the time Spokane County makes roadway improvements after
acquiring said future acquisition area.
18. The owner shall negotiate with Central Valley School District and submit a recorded

the final short plat. The agreement shall provide a written description of the subject
property to which the agreement applies and also state the dollar amount and any other
agreed to mitigating measures.
Tlie owner shall also notify any potential purchasers vvho have made an agreement to
purchase property within said plat pursuant to the Revised Code of Washington (RCUI)
58.17.205, that adequate provisions far school facilities must be made conditioned on a
future agreement between the applicant and the school district.

• The property owners within this plat shall be held responsible for keeping open and
maintaining the surface path of natural or man-made drainage flow over and across their
respectNe properties. If the property owner(s) fails to maintain the surface path of natural or
man-made drainage flow, or the drainage swale, a notice of such failure may be given to the
property owner(s). If not corrected within the period indicated on said notice, Spokane County
has the right to correct the maintenance failure, or have it corrected, at the expense of the
property owner.
• There may exist properties, located uphill and adjacent to this subdivision, which periodically
discharge stormwater runoff onto individual lots wifihin this plat. Runoff from nearby uphill
properties should be expected, and during snowmelt periods or wet seasons the lots may be
subjected to higher amounts of stormwater runoff that what is normally observed or anticipated.
Because stormwater runoff from adjacent properties have discharged onto this plat prior to
development, stormwater runoff will likely continue to do so after development. It is the
responsibility of the individual lot owners to maintain existing surface paths of runoff through their
respective lots and to grade the lots in accordance with applicable rules and regulations, so as to
prevent property damage.
• Spokane County does not accept the responsibility of maintaining the drainage course on private
lots or floodplain areas within private lots, nor the responsibiliiy for any damage whatsoever,
including, but not limited to, inverse condemnation to any properties due to deficient construction
and/or maintenance of drainage courses in drainage easements on private property.

• Any building that is constructed on a lot in this plat shall be set at such an elevation so as to
provide positive drainage away from any drainage entry point to the building (including but not
limited to a window well, a window unprotected by a window well, or a doorway). Said positive
drainage shall consist of a minimum slope of 3% away from the building for a distance of at
least 10 feet from the building. The lots shall be graded so that either a) all runoff is routed
away from the building, and conveyed over the lot to a natural drainage swale or approved
drainage facility, or b) drainage intercepted on the lot is disposed of on the lot in an approved
drainage facility. The approved drainage facility shall be constructed in accordance with any
applicable accepted plans on file at the County Engineer's Office. Any revisions to the
accepted drainage plans must be accepted by the County Engineer's Office prior to
construction of said revisions.
• That in consideration of Mutual Benefits now or to be hereafter derived, do for themselves,

The Spokane County Engineering Department has reviewed the above referenced
application. The following "Conditions of Approval" are submitted to the
Spokane County Planning Department for inclusion in the "Findings of Fact,
Conclusions and Order/Decision" should the request be approved.
Prior to release of a buildinq per:ait or use of property as proposed:
1. That conditional approval of the plat by the County Engineer is given
subject to approval of the road system as indicated in the preliminary
plat of record.
2. That plans, profiles and cross sections as designed to County standards
showing proposed street centerline and curb grades be submitted to the
County Engineer for acceptance prior to construction and/or the f iling
of a f inal plat; road plans to be prepared under the direction of a
licensed Professional Civil Engineer.
3. That drainage plans and design calculations showing the alignment of
drainage facilities be submitted to the County Engineer for acceptance
prior to construction and/or the filing of the final plat. Drainage
plans to be prepared under the direction of a licensed Professional
Civil Engineer.
4. All construction within the existing or proposed Public right-of-way is
to be completed prior to filing the final plat or a bond in the amount
estimated by the County Engineer to cover the cost of construction of
improvements. construction certification, "As Built" plans and
monumenting the street centerlines shall be filed with the County
Engineer.
5. Existing County roads providing direct access to the plat shall be
paved and/or curbed to Spokane County standards.
6. The word "applicant" shall include the owner(s) of the property,
his/her heirs, assigns and successors.

7. To construct the road improvements stated herein, the applicant may,
with the approval of the County Engineer, join in and be a willing
participant in any petition or resolution which purposes is the
formation of a Road Improvement District (RID) for said improvements
pursuant to RCW 36.88, as amended. At such time as an RID is created
or any Road Improvement Project is sanctioned by Spokane County, the
improvements required (curb, sidewalk, drainage control and paving to
existing pavement) will be at the sole expense of the undersigned
owner, their heirs, grantees and assigns. This provision is applicable
to Progress Road.
8. As an alternative method of constructing the road improvement stated
herein, the applicant may, with the approval of the County Engineer,
accomplish the road improvements stated herein by joining and
participating in a County Road Project (CRP) to the extent of the
required road improvement. At such time as an RID is created or any
Road Improvement Project is sanctioned by Spokane County, the
improvements required (curb, sidewalk, drainage control and paving to
existing pavement) will be at the sole expense of the undersigned
owner, their heirs, grantees and assigns. This provision is applicable
to Progress Road.
9. That the following statement shall appear within the dedicatory
language of the final plat:
That in consideration of Mutual Benefits now or to be hereafter
derived, do for themselves, their heirs, grantees, assigns and
successor(s) in interest hereby request and authorize Spokane County to
include the above described property in a Road Improvement District
(RID) and to support the formation of a Road Improvement District for
improvement of the road(s) described below by requesting and
authorizing Spokane County to place their name(s) on a petition for the
formation of a Road Improvement District pursuant to RCW 36.88.050, or
by requesting and authorizing Spokane County to cast their ballot in
favor of a RID being formed under the resolution method pursuant to RCW
36.88.030, and/or by not filing a protest against the formation of a
RID being formed under the alternative resolution method provided for
in RCW 36.88.065 and Chapter 35.43 RCW.

If a RID is proposed f or improvement of the road (s) described below,
said ov+iner ( s) and successor (s) further agree :(1) that the improvements
or construction contemplated within the proposed RID are feasible and
(2) that the benefits to be derived from the formation of the RID by
the property included therein, together with the amount of any County
participation, exceeds the cost and expense of formation of the RID,
and (3) that the property within the proposed RID is sufficiently
developed; provided, themselves, their heirs, grantees, assigns and
successor(s) shall retain the right, as authorized under RCW 36.88.090,
ta object to any assessment(s) on the property as a result of the
improvements called for in conjunction with the formation of a RID by
either the petition or resolution method under Chapter 36.88 RCW and to
appeal to the Superior Court the decision of the Board of County
Commissioners confirming the final assessment roll; provided further,
it is recognized that actual assessments may vary from assessment
estimate so long as they do not exceed a figure equal to the increased
true and fair value improvement ( s) add ( s) to the property.
It is further acknowledged and agreed that at such ti:ne as a RID is
created or any County Road Improvement project is authorized by Spokane
County, the improvements required shall be at the sole expense of the
owner(s) of property within the RID or served by the improvements
without any monetary participation by Spokane County.
The RID waiver contained in this agreement shall expire after ten (10)
years from the date of execution below. This provision is applicable
to Progress Road.
10. The County Engineer has designated a Local Access Roadway Section for
the improvement of Progress Road which is adjacent to the proposed
development. This will require the addition of approximately 9-11 feet
of asphal-L along the frontage of the development. The construction of
curbing and sidewalk is also required.
11. The proposed plat shall be improved to the standards set forth in
Spokane County Board of Commissioners Resolution No. 95-0498, as
amended, which establishes regulations for roads, approaches, drainage
and fees in new construction.
12. The County Engineer has examined this development proposal and has
determined that the impact of this proposal upon the existing County
Road System warrants the roadway improvements herein specified.
13. The applicant shall grant applicable border easements adjacent to
Spokane County Right of Way per Spokane County Standards.
14. The proposed driveway shall serve only Tracts "A" "B" and "C" as shown
on the prelimi.nary plat. Tract "D" shall construct its own driveway
access to Progress Road. Use of the proposed driveway by all four lots
shall result in the driveway being constructed to Spokane County
Private Raad Standards which includes acceptance of road and drainage
plans by the County Engineer, and 20 feet of asphalt surfacing within a
40 foot private road easement.
