FINDINGS OF FACT AND CONCLUSIONS 1. The individual signing below has further been properly delegated the responsibility for rendering the decision by the Director of Spokaae County Division of Building and Planning. 2. The proposal is to divide approximatelv L9,000 sq. ft. (.44 acres) of an existing duplex into two tracts in order to allow separate ownership of each dwelling unit and each associated portian of the lund in the dupier. 3. The proposal is located north of and adjacent to Valleyway and approximately 800 feet west of Pierce Road in the SW 1/4 of Section 16, Towmship 25 North, Range 44 E. W.M., Spokane County, Washington. 4. The existing zoning of the praperty described in the application is Urban Residential-3.5 (UR-3.5), which was established in 1991. Although, the lot area of the property of 19,000 sq. ft. is less than the minirnum area of 20,000 sq. ft. for duplex units in the UR-3.5 zone, an Applicatian foc Adminiscradve Exception (file no. , AEE-39-91) was approved by the Spokane County Planning Depactment on April 10, 1991, which granted I the owner of the subject property a 1,000 (S%) reduction in the required lot area. Therefore, pursuant to Revised Code of Washington (RCW) 58.17.195, this proposal, with the exception nf the minimum lot area, does conform to the requirements of the existing UR-3.5 zones. 5. The Spokane County Comprehensive Plan designates this axea as Urban. The development and uses, as proposed and conditioned, are in compliance with the Urban category. 6. Surrounding uses are primarily single and multifamily residence. 7. The Spokane County Arterial Road Plan identifies Valleyway as a Coilector Arterial with a future right-of- way width of 70 feet. T'he existing right-of-way width is 40 feet. ln order to implement the Arterial ftoad Plan, a strip of property 12.5 feet in width along the Valleyway frontage is to be set aside as a Future Acquisition Area. 1n addihon, the County Engineer has requested a dedication of 2.5 feet of additional right- I of-way aiong Valleyway. Therefore, as conditioned (such as improvements, dedication, sidewalks and acquisition areas), the proposal conforms to the Road Plan. I S. The proposed site is located within the Public Transportation Benefit Area (PTBA). The Spokane Transit i Authority (STA) University Citv Route No. 12 and Valley/Trenrivood Route No. 20 provides connecting I services to the site. 9. The subject property is bein~ served by a public water system and an on-site sewage disposal system. 10. 1he required public notice was provided for this proposal and agencies having a potential interest in the pruject were notified and recommendations solicited. 11. No written comments were received frnm any adjoining property owners. 12. Recognizing the recommended conditions and Spokane County development standards, the proposed short plat makes appropriate provisions for the public health, safety and general welfare and that the public use and interest will be served by platting the subdivision. The subdivision proposal is generally coasistent tivith RCW 58.17 and the County subdivision regutations, promoting the public health, safzty and general welfare in accordance with standards estabiished by the State and Spokane County. The County Division of Building and Plannin~ has considered the provision of adequate public facilities as cited in RCW 58.17.110 (2). More specifically: a. open spaces f sariitary waste disposal b. drainage ways g. pnrks and recreation facilities c. public and/or private right-of-ways h. playgrounds d. transit i. schoois and school grouads e. potable water j. sidewalks 13. The project is exempt from environmental review under the State Environmental Policy Act pursuant to WAC 197-1 l -800 (6) (a). DECISION Based upon the above noted Findings of Fact and Conclusions, Short Plat Application SP- I 117-96 for Duplzx Division is hereby APPROVED for five (5) years, specifically to August I, 2002 and subject to conditions noted below. This decision is final unless appealed in writing, consistent with adopted appeal procedures. CONDITIUNS OF APPROVAL All the below conditions imposed shall be binding on the "Applicant," which term shall include the awner or owners of the property, heirs, assigns and successors. SPOKANE COUNTY DlVISION OF BUILDING AiYD PLANNING l. The proposal shall comply tivith the Urban Residential-3.5 (UR-3.5) zone and other applicable Zoning Code c6apters, as amended. 2. The final short plat shalI be designed substanciaUy in conformance with the Preliminary Plat of Record. No increase of densiry or number of tracts shall occur withaut approval from Spokane County. 3. The pretiminary short plat is given conditional approval for five (S) years, specifically to August l, 2002. The applicant may submit an extension of time application at least thirty (30) days prior to the above expiration date. Appiication(s) for extensioo of time shall be processed under the provisions of Chapter 12.100.118 (Extension of Time) of the Spokane County Subdivision Ordinance. !f the applicant complies with the criteria of Chapter 12.100.118, the preliminary approval and conditions will be changed to reflect the adopted policy and development regulations at the time of the extension appiication. 4. Prior to recording the final short plat, the applicant shall submit to the County Division of Building and Plaaning Directorldesignee for review any proposed final short plat to ensure compliance with these Findings and Conditions of Approval. 5. A survey is required of the subject property prior to recording the final short plat. 6. Appropriate road name(s) and street address for each tract shall be indicated on the final short plat map. 7. Appropriate utility easements shall be indicated on the final short plat rnap. Written approval of utility easements by utiliry companies must be received prior to recording the final short plat. 8. The final short plat map shall indicate by a dashed Iine the required setbacks from all private or public roads. 9. The final short plat shall include the following statement: "Side yard and rear yard setbacks shall be determined at lhe timc: building permits are requested unless these setbacks are specifically drafted on this final short plaL The setbacks indicated on this subdivision may be varied from if proper zoning or variance approvals are obtained." 10. Prior to recording the final short plat, the applicant shall provide four (4) current Certificates of Title to the Division of Building and Planning. 11. The app[icant shaJl contact the County Division of Buildina and Planninb at the earliest possible stage in order to be informed of code requirements administered/enforced as authvrized by the State Buitding Code Findings and Decision SP- I I t 7-9b 2 Act. Design/development concerns include: addressing, fire apparatus access roads, fire hydrantlflow, approved water systems, building accessibility, construction type, occupancy classification, exiting, exterior wall protection, and energy code regulations. 12. The Spokane County Division of Building and Planning shall prcpare and record with the County Auditor a Title Notice specifying a future land acquisition tuea for road nght-of-way and utilities. 1fie reserved future acquisition area Title Notice shall be released, in full or in part, by the County Division of Buitding and Planning. The notice should be recorded the same time as the final short plat and shall provide the following: a. A scrip of property 12.5 feet in width from the existing right-of-way is reserved for future acquisition area for additioaal road right-of-way along Valleyway. Note: The Counry Engineer required a dedication of 2.5 feet of additional right-of-way width along Valleyway. b. Future building and other setbacks requircd by the Spokane County Zoning Code shall be measured from the reserved future acquisition area. c. No required landscaping, parking, 208' areas, drainfield or allotived signs should be located within the future acquisition area for road nght•of-way and utilities. If any of the above improvements are made within this area, they shall be relocated at the applicant's expense when roadway improvemenks are made. d. The future acquisitinn area, until acquireda shall be private property and may be used as allowed in the zone, except that any improvements (such as laadscaping, parking, surface drainage, drainfield, signs or others) shall be considered interim uses. e. The property owner shali be responsible for relocating such "interim" improvements at the time Spokane Counry makes roadway improvements after acquiring said future acquisition area. 13. No water plan is required, only a simple connection will be needed prior to the sale of each tract and prior to issuance of a building permit for each tract. 14. The duplex common-wall lot line shall be identified as the "Center Duplex Lot Line" and drafted as a continuous "dash-dot-dash" on the final short plat. 15. The final short plat shall include the following statement: "No detached single-family dwellings or manufactured homes are allowed on tract. All tracts with any lot line designated Center Duplex Lot Line shaIl be restricted to one common-wall dwelling unit (one-half [1/2] duplex), provided the duplex common wall is aligned over or with the Center Duplex Lot Line, and provided that each duplex unit (halo is totally on its side the of center lot line when said lot line is extended vertically beyond the roof line." 16.~ The final short plat shall include the following statement: "The owners, heirs or assigns of each dwelling = unit of the dupleY structure do hereby agree to retain the color, texture and type of materials of the duplex exteriorx and further agree that any'change' to said exterior shall have the written mutual approval of both owners of each half of the duplex prior to iailiating constructioa of any such 'chan'e' to the exierior. Any reptacement or addidon to all or part of the duplex structure shall also require mutual approval. This agreement shall run with each associated lot and shall be enforced through Civil Coun, and does exclude Spokane Counry from the terms and enforcement of said agreement." 17. 'I`he final short piat shall include the folluwing statement: "The owners, heirs or assigns of divided duplex lots do herebv agree to equally share the responsibility and cost of maintaining anci operating that portion of the sepric tank and dcainfield system that is jointly shared until each duplex unit (half) ts separately connected to a public sewer system." 18. The final short plat dedication shall inctude the following statement: "Enforcement of the water and sewec systems agreement is a civil matter between each duplex unit owner(s) and not enforced by Spokane County." SPOKANE COUNTY DIVISION OF ENGINEERING AND ROADS l. ne conditional approval of the short plat by the Counry Engineer is given subject to dedication of richt•of- way and approval of the road system as ►ndicated in the Preliminary Plat of Record. Findings and Decision SP-1117-96 3 ~ , 2. The drainage plans and design calculations showing the alignment of drainage facilities be submitted to the County Engineer for acceptance prior to construction aaci/or the recording of final short plat. Drainage plans to be prepared under the direction of a licensed professionat Civil Engineer. 3. No construction work is to be performed within the existing or proposed public right-of-way until plans have been accepted by the County Engineer and a permit has been issued by the County Engineer. Atl work is subject to inspection and approval by the County Engineer. 4. Approach Permits are required for any access to the Spokane County road system. Dedication of 2.5 feet of additional right-of-way width atong Valleyway. 6. The applicant shall grant applicable border easements adjacent to Spokane County right of way per 5pokane County Standards. 7. To construct the road improvements stated herein, the applicant may, with the approval of the County Eagineer, join in and be a willing participant in any petition or resolution which pucpose is the formation of a Road Improvement District (RID) for said unprovements pursuant to RCW 36.88, as amended. At such time as a RID is created or any Road Improvement Project is sancrioned by Spokane County, the improvements requirzd (cvrb, sidewalk, drainage conval and paving tA existing pavement) will be at the sole expense of the undersigned owner, their heirs, grantees and assigns. This provision is applicable to Vatle}nvay. 8. As an alternative method of constructing the road improvement stated herein, the applicant may, with the approval of the County Engineer, accomplish the road improvements stated herein by joining and participating in a County ltoad Project (CRP) to the extent of the required road improvement. At such time as a RID is created or any Road Improvement Project is sanctioned by Spokane County, the improvements required (curb, sidewalk, drainage control aad paving to existing pavement) will be at the sole expense of the andersigned owaer, their heirs, grantees and assigns. This provision is applicable to Valleyway. 9. The final short plat shall include the following statement: "In consideradon of Mucua! Benefits now or to be hereafter derived, do for themselves, their heirs, grantees, a.ssigns and successor(s) in interest hereby request and authorize Spokane County to inciude the above described properry in a Road Improvement District (RID) and to support the formation of a Road Improvement District for improvement of the road(s) described below by requesting and authorizing Spokane County to place their name(s) on a petition for the fdrmation of a Road Improvement District pursuant to RCW 36.88.050, or by requesting and authorizing Spokane County to cast their ballot in favor of a R1D being formed under 1he resolution method pursuant to RCW 36.88.030, andlor by not filing a protest against the formation of a RID being formed under the alternative resolution method provided for in RGW 36.88.065 and Chapter 35.43 RC W. "If a R[D is proposed for improvement of the road(s) described betow, said owDer(s) and successar(s) further agree: (1) that the improvements or construction contemplated within the proposed RID are feasible and (2) that the benefits to be derived from the formation of the R1D by the property included therein, toaether with the amount of any County participation, exceeds the cost and expense of formation of the RID, and (3) that the property within the proposed RID is sufficiendy developed; provided, themselves, their heirs, grantees, assigns and successor(s) shall retain the right, as authorized under RC W 36.88.090, to object to any assessment(s) on the property as a result of the improvements called for in conjunction with the formation of a ItIU by either the petition or resoluiion method under Chapter 36.88 RCW and to appeal to the Superior Court the decision of the Board of County Commissioners confirming the final assessment rall; provided fiuther, it is recognized ttlat accual assessments may vary from assessment estimate so long as they do not exceed a figure equat to the increased true and fair value improvement(s) add(s) to the property. "It is furthec acknowledged and agreed that at such time a.s a RID is created or any Counry Road lmprovement project is authorized by Spokane Counry, the irnprovements required shall be at the sole expense of the oNi+ner(s) of property within the RID or served by the imprnvements without any monetary participation by Spokane County. Findings and Decision SP•1117-96 4 "The R1D waiver contained in this ogreement shall expire after ten (10) years from the date of execution betow. This provision is applicable to Valleyway." 10. The County Engineer has designated a Collector Arterial Roadway Secqon for the improvement of Valleyway which is ndjacent to the prnposed development. This will require the addition of approximately 8.5-10.5 feet of asphalt along the frontrige of the development. The construction of curbing and sidewalk is also required. 11. The proposed plat shall be improved to Ihe standards set forth in Spokane County Board of Commissioners Resolution No. 95-0498, as amended, which establishes regulations for roads, approaches, drainage and fees in new construction. 12. The County Engineer has examined this development proposal and has determined that the impact of this proposal upon the existing Counry Road System warcants the dedication of additional right-of-way and the roadway improvements herein specified. 13. The County Arterial Road Plan identifies Valleyway as a?0 foot Collector Arterial. The existing right-of- way width of 40 feet is not consistent with that specified in The Plan. In order to implement the Arterial Road Plaa it is recommendsd that in addition to the required right-of-way dedication, a strip of property 12.5 feet in width along the Valleyway frontage be set aside in reserve. This property may be acquired by Spokane County at the time when arteriat improvements are made to Valleyway. 14. T'he applicant should be advised that there may exist utilities either underground or overhead affecting the applicant's property, including property to be dedicated or set aside future acquisition. ~ge okane County ~vill assume no financial obligation for adjustments or relocation regarding these utilities. applicant should check with the applicable utilities and Spokane County Engineer to determine whether the applicant ar utility is responsible for adjusanent or relocation costs and to mace arrangements foc any necessary work. SPOKANE COUNTY DIVISION OF UTILITIES l. Any water service for this project shall be provided in accordance with the Caordinated Water System Plan for Spokane County, as amended. SPOKANE REGIONAL HEALTH DISTRICT 1. Sewage disposal method sha11 be as authorized by the Director of the Spokane County Divisian of Utilities. Water service shall be coordinated through the Spokane County Division of Utiiities. 3. The County Engineer has examined this development proposal and has determined that the impact of this proposal upon the existing County Road System warrants the dedication of additional Right of Way and the roadway improvements herein specified. 13. The County Arterial Road plan identifies Valley Way as a 70 foot Collector Arterial. The existing right of way width of 40 feet is not consistent with that specified in The Plan.
