THIS MATTER, an applicntion for short subdivision of land from Gerald Morse has beea received and was
decided upon, pursuant to Spokane County Subdivision regulations, on the 300, day of luly 1997.
FINDINGS OF FACT A@YD COIVCLUSIONS
1. The individual signing below has fucther been properly delegated the responsibility for rendering the decision
by the Director of Spokane County Division of Bvilding and Planning.
2. The proposal is to divide approximntely 22,576 sq. ft. (.52 acres) of an existing duplex into two tracts in
order to allow separate ownersliip of each dwelling unit and each associated portion of the land in the duplex.
3. The proposal is located east of and adjacent to the terminus at 14' Avenue and approximacely 200 feet west
of Bowdish Road in the SW of Section 21, 1'ownship 25 North, Range 44 E.W.M., Spokane Counry,
Washington.
4. The eacisting zoning of the prnperty described in the application is Urban Residential-3.5 (UR-3.5), which
was established in 1991. Pursuant to Revised Code of Washington (RCVI) 58.17.195, this proposal conforms
to the requirements of the existing UR-3.5 zones.
5. The Spokane County Comprehensive Plan designates tbis area as Urban. 1fie deWelopment and uses, as
proposed and conditioned, are in compliance with the Urban category.
6. Surrounding uses are primarily single and multifamily residence.
7. The Spokane County Arterial Road Plan identifies 14" Avenue as a Loca1 Access Road with a future right-of-
way width of 60 feet. There is no existing right-of-way width. 1n order to implement the Arterial Road Plan,
the County Engineer has requested a dedication of 30 feet af right-of-way width for the extension of 14`h
Avenue along the ftontage of property. Therefore, as conditioned (such as improvements, dedication and
sidewalks), the proposal conforms to the Road Plan.
8. The proposed site is located within the Fublic Troinsportation Benefit Area (PTBA). The Spokane Transit
Authority (STA) Valley / 20 Avenue Route No. 21 provides connectino services to the site.
9. The subject property is being served by a pubtic water system and an on-site sewage disposa9 system.
10. The required public notice was provided for this proposal and agencies having a potential interest in the
projecs were notified and recommendations solicited.
11. No written comments were received from any adjoining property owners.
12. Recognizing the recomrnended conditidns and Spokane County development standards, the proposed short
plat mal:es appropriate provisions for the public health, safery and generat welfare and that the public use and
interest will be served by platting the subdivision.
The subdivisian proposal is generaily consistent with RCW 58.17 and the County subdivision regulations,
promoring the public health, safery and general welfnre in accordance with standards established by the State
and Spokane Gounty. The County Division of Building and Planning 6as considered the provision of
adequate public facilities as cited in RCW 58.17.110 (2). Mnre specifically:
a. open spaces f. sanitary waste disposal
b. drainage ways g. parks and recreation facilities
c. public andr'or private right-of-ways h. playgrounds
d. transit i. schools and school grounds
e. potable water j. sidewalks

13. The project is exempt from environmental review under the State Environmental Policy Act pursuant to
WAC 197-11-800 (6) (a).
DECISION
Based upon the above noted Findings of Fact and Conclusions, Short Plat Application SP-1118-96 for Duplex
Division is hereby APPROVED fnr five (5) years, specifically to August 1, 2002 and subject to conditions noted
below. This decision is final unless appealed in writing, consistent with adopted appeal procedures.
CONDITTONS OF APPROVAL
All the below conditions imposed shall be binding on the "Applicant," which term shall include the owner or
owners of the properry, heirs, assigns and successors.
SPOKANE COUNTY DIVISIOIV OF BUILDING AhD PLANIYING
I. The proposal shall comply with the Urban Residential-3.5 (UR-3.5) zone and other applicable Zoning Code
chapters, as amended.
2. The final short plat shall be designed substantially in conformance with the Preliminary Plat of Record. No
increase of density or number of tracts shail occur withaut approval from Spokane County.
3. The preliminary short plat is given conditional approval for five (5) years, specifically to August l, 2002.
The applicant may submit an extension of time application at least thirty (30) days prior to the above
expiration date. Appiication(s) for extension of time shaU be processed under the provisions of Chapter
12.100.118 (Extension of Time) of the Spokane County Subdivision Ordinance. If the applicant complies
with the criteria of Chapter 12.100.118, the preliminary approval and conditions will be changed to reflect
the adopted policy and development regulations at the time of the extension application.
4. Prior to recording the final short plat, the applicant shall submit to the County Division of Building and
Planning Director/designee for revieNv any proposed final short plat to ensure compliance with these Findings
and Conditions of Approval.
5. A survey is required of the subject property prior to recording the finai short plat.
6. Appropriate road name(s) and street address for each tract shall be indicated on the final short plat map.
7. Appropriate udtity easements shall be indicated on the final short plat map. Written approval of utiliry
easements by utiliry cnmpanies must be received prior to recording the final short plat.
8. The final short plat map shall indicate by a dashed line the required setbacks from all private or public roads.
9. The final short plat shall include ihe following sEatement: "Side yard and rear yard setbacks shall be
determined at the time building permits are requested unless these setbacks are specifically drafted on this
final short plaL The setbacks indicated on this subdivision may be vacied from if proper zoning or variance
approvals aze obtained."
10. Prior to recording the final short plat, the applicant shall provide four (4) current Certificates of Title to the
Division of Building and Planning.
11. The applicant shall cantact the County Division of Building and Planning at the earliest possible stage in
order to be informed of code requirements administered/enforced as authorized by the State Building Code
Act. Design/development concerns include: addressing, fire apparatus access roads, fire hydranVflow,
approved water systems, building accessibil'sty, construction type, occupancy classification, exiting, exterior
wall protectian, and energy code regulations.
12. No water plan is required, only a simple connection will be needed prior to the sale of each tract and prior to
issuaace of a building permit for each tract.
13. The duplex common-wall lot line shall be identified as the "Center Duplex Lot Line" and drafted as a
continuous "dnsh-dot-dash" on the final short plat.

14. T7ie final short plat shall include the following statement: "Nn detnched single-family dwellings or
manufactured homes are allowed on trnct. All tracts with any !ot line designated Center Duplex Lot Line
shaJl be restricted to one common-wall dwelling unit (one-half [1t2] duplex), provided the duplex cornmon
wall is aligned over or with the Center Duplex Lot Line, and provided that each duptex unit (half) is totalJy
on its side the of center Iot line when said lot liae is extended vertically beyond the roof line."
15. The final short plat shall inctude the following statement: "The owners, heirs or assigns of each dwelling
unit of the duplex structure do hereby agree to retain the color, texture and rype of materials of the
duplex exterior, and further agree that any 'change' to said exterior shall have the written mutual approval
of both owners of each half of the duplex priar to initiating construetivn of any such 'change' to the
extzrior. Any replacement or addition to all or part of the duplex structure shall also require mutual
approval. This agreement shall run with each associated lot and shaU be enforced through Civii Court,
and does exclude Spokane County from the terms and enforcement of said agreement."
16. The final short plat shall inctude the followint', statement: "The owners, heirs or assigns af divided duplex
lots do hereby agree to equally share the responsibility and cost oi maintaining and operating that portion of
the septic tank and drainfield system that is jointly shared until each duplex unit (halt) is separately connected
to a pubiic sewer system."
17. The finai short plat dedication shaU include the following statemenr "Enforcement of the water and sewer
systems agreement is a civil matter between each duplex unit owner(s) and not enforced by Spokane
Counry."
SPOK.r+►NE COUNTY DIVISIOIV OF ENGLNEERING AND ROADS
1. The conditional npproval of the short plat by the County Engineer is given subject to dedication of right-of-
way and approval of the road system as indicated in the preliminary plat of record.
2. The drainage plans and design calculations showing the alignment of drainage facilities be submitted to the
County Engineer for acceptance prior to construction and/or the fiJing of the final short plat. Drainage plans
to be prepared uader the direction of a licensed professional Civil Engineer.
3. No construction work is to be performed within the existing or proposed public right-of-way until plans have
been accepted by the County Engineer and a pennit has been issued by the County Engineer. AU work is
sub}ect to inspection and approval by the County Engineer.
4. Approach Permits are rzquired for any access to the Spokane County road system.
5. Dedication of 30 feet of right-of-way for the extension of 14" Avenue is required. Iu addition to the right-of-
way dedication, that appropriate provision be made thnt the following described property be held in trust until
the continuatioa af the streets be dedicated or deeded: A 1 faot strip at the ends or edges of all streets that
terminate or border the plat boundary.
6. The appticant shall grant applicable border easements adjacent to Spokane County right-of-way per Spokane
County Standards.
7. To construct the road improvements stated herein, the appficant may, with the approval of the County
Engineer, join in and be a willing participant ia any petition or resolution which purpose is the formation of a
Road Impcovement District (RID) for said improvements pursuant to RCW 36.88, as amended. At such time
as an RID is created or any Road lmprovement Project is sanctioned by Spol:ane County, the improvements
required (curb, sidewalk, drainage control and puving to existing pavement) will be at the sole expense of the
undersigned owner, their heirs, grantees and assigns. This provision is applicable to 14'" Avenue.
8. As aa alternarive method of constructing the road improvement stated herein, the applicant may, with the
approval of the County Engineer, accomplish the road improvements stated herein by joining and
participating in a County Road Project (CKP) to the extent of the required road improvement. At such time
as an RID is created or any Road lmprovement Project is sanctinned by Spokane Counry, the improvements
required (curb, sidewalk, drainage control and paving to existing pavement) wiii he at the sole expense of the
undersigned owner, their heirs, grantees and assigns. This provision is applicable to 14' Avenue.
9. The final short plat shall include the following statement:

"1n consideration of Mutual Benefits now or to be hereafter derived, do for themselves, their heirs,
grantees, assigns and successor(s) in interest hereby request and authorize Spokane County to
include the above described property in a Road Improvement DisUict (RID) and to support the
formation of m Road Improvement District for improvement of the road(s) described below by
requesting and authoriziag Spokane County to place their name(s) on a petition for the formation of
a Road Improvement District pursuant to RCW 36.88.050, or by requesting and authorizing
Spokane County to cast their ballot in favor of an RID being formed under the resolution method
pursuant to RCW 36.88.030, ancUor by not filing a protesi against the formation of a RID being
formed under the alternative resolution method provided for in RCW 36.88.065 and Chapter 35.43
RCW.
"If an RID is proposed for improvement of the road(s) described below, said owner(s) and
successor(s)further agree: (1) that the improvements or construction contemplated within the
proposed RID are feasible and (2) that the benefits to be derived from the formation of the RID by
the property included therein, together with the amount of any County participation, exceeds the
cost and expense of formation nf the R1D, and (3) that the property witbin the proposed R[D is
sufficiently developed; provided, themselves, their heirs, grantees, assigns and successor(s) shall
retain the right, as authorized under RCW 36.88.090, to object to any assessment(s) on the property
as a result of the improvements called for in conjunction with the forrnation of a RID by either t6e
petition or resolution method under Chapter 36.88 RCW and to appeal to the Superior Court the
decision of the Board of Counry Commissioners confirming the final assessment roll; provided
further, it is recogniaed that actual assessments may vary from assessment estimate so long as they
do not exceed a figure equal to the increased true and fair value improvement(s) add(s) to the
ProPertY•
"It is further acknowledged and agreed that at such time as a RID is created or any Counry Road
Improvement project is authorized by Spokane County, the improvements requiced shal) be at the
' sole expense of the owner(s) of pmperty within the RID or served by the improvements without any
monetary participatioa by Spokane County.
"The RID waiver contained in this a,greement shall expire after ten (10) years from the date of
execution below. This provision is applicable to 14' Avenue."
10. The Couary Engineer has designated a Local Access Roadway Section for the improvement of 101 Avenue
which is adjacent to the proposed development. This will require the addition of approximately 15 feet of
asphalt from centerline aloag the frontage of the development. The construction of curbing and sidewalk is
also required.
11. Tbe proposed plat shall be improved to the standards set forth in Spol:ane County Board of Commissioners
Resoiution 1Vo. 95-0498, as amended, which establishes regulations for roads, approaches, drainage and fees
in new construction.
12. The County Engineer has examined this development proposal and has detennined that the impact of this
proposal upon the existing County Road System warrants the dedication of additional right-of-way and the
roadway improvements herein specified. ,
13. The appIicant should be advised that there may exist utilities either underground or overhead affecting the I
appiicant's property, inciuding property to be dedicated or set aside future acquisition. Spokane Counry wili
assume no financial obligation for adjustments or relocation regarding these utilities. ?he apQlicant should
check with the applicabie utilities and Spokane County Engineer to determine whether the applicant or utility
is responsible for adjustrnent or relocation costs and to make arraagements for any necessary work.
14. Applicant shall sign a"Spokane Counry Notice to the Public No. 4" which allows the construction of a I
driveway in the public right-of-way.

SPOKANE COUNTY DIVISION OF UTILITIES
1. Pursuant to the Board of County Commissioners Resolutian No. 80-0418, the use of on-site sewer disposal
systems is hereby authorized. This authorization is cnnditioned in compliance with all rules and regulations
of the Spokane Regional Health District and is further conditioned and subject to specific application
approvai and issuance of permits by the tIeatth District.
2. The final short plat shall include the following statement: "Each new unit shall be double-plumbed for
connection to firture area-wide collectidn systems."

The Spokane County En gineering Department has reviewed the above referenced application. The following
"Cond.itions of Approval" are subnutted to the Spokane County Planning Department for inclusion m the

is required. In addition to the right of way dedication, that

7. To construct the road improvements stated herein, the applicant may,
with the approval of the County Engineer, join in and be a willing
participant in any petition or resolution which purposes is the
formation of a Road Improvement District (RID) for said improvements
pursuant to RCW 36.88, as amended. At such time as an RID ia created
or any Road Improvement Project is sanctioned by Spokane County, the
improvements required (curb, sidewalk, drainage control and paving to
existing pavement) will be at the sole expense of the undersigned
owner, their heirs, grantees and assigns. This provision is applicable
to 14`'' Avenue.
8. As an alternative method of constructing the road improvement stated
herein, the applicant may, with the approval of the County Engineer,
accomplish the road improvements stated herein by joining and
participating in a County Road Project (CRP) to the extent of the
required road improvement. At such time as an RID is created or any
Road Improvement Project is sanctioned by Spokane County, the
improvements required (curb, sidewalk, drainage control and paving to
existing pavement) will be at the sole expense of the undersigned
owner, their heirs, grantees and assigns. This provision is applicable
to 14`h Avenue.
9. That the following statement shall appear within the dedicatory
language of the final plat:
That in consideration of Mutual Benef its now or to be hereafter
derived, do for themselves, their heirs, grantees, assigns and
successor(s) in interest hereby request and authorize Spokane County to
include the above described property in a Road Improvement District
(RID) and to support the formation of a Road Improvement District for
improvement of the road(e) described below by requesting and
authorizing Spokane County to place their name(s) on a petition for the
formation of a Road Improvement District pur9uant to RCW 36.88.050, or
by requesting and authorizing Spokane County to cast their ballot in
favor of a RID being formed under the resolution method pursuant to RCW
36.88.030, and/or by not filing a protest against the formation of a
RID being formed under the alternative resolution method provided for
in RCW 36.88.065 and Chapter 35.43 RCW.

If a RID is proposed for improvement of the road(s) described below,
said owner ( s) and successor (s) further agree :(1) that the improvements
or construction contemplated within the proposed RID are feasible and
(2) that the benef its to be derived from the formation of the RID by
the property included therein, together with the amount of any County
participation, exceeds the cost and expense of formation of the RID,
and (3) that the property within the proposed RID is 9uff iciently
developed; provided, themselves, their heirs, grantees, assigns and
successor(s) shall retain the right, as authorized under RCW 36.88.090,
to object to any assessment(s) on the property as a result of the
improvements called for in conjunction with the formation of a RID by
either the petition or resolution method under Chapter 36.88 RCW and to
appeal to the Superior Court the decision of the Board of County
Commissioners confirming the f inal assessment roll; provided further,
it is recognized that actual assessments may vary from assessment
estimate so long as they do not exceed a figure equal to the increased
true and fair value improvement(s) add(s) to the property.
It is further acknowledged and agreed that at such time as a RID is
created or any County Road Improvement project is authorized by Spokane
County, the improvements required shall be at the sole expense of the
owner(s) of property within the RID or served by the improvements
without any monetary participation by Spokane County.
The RID waiver contained in this agreement shall expire af ter ten (10)
years from the date of execution below. This provision is applicable
to 14`h Avenue.
10. The County Engineer has designated a Local Access Roadway Section for
the improvement of 14`b Avenue which is adjacent to the proposed
development. This will require the addition of approximately 15 feet
of asphalt from centerline along the frontage of the development. The
construction of curbing and aidewalk is also required.
11. The proposed plat shall be improved to the standards set forth in
Spokane County Board of Commisaioners Resolution No. 95-0498, as
amended, which establishes regulations for roads, approaches, drainage
and fees in new construction.
12. The County Engineer has examined this development proposal and has
determined that the impact of this proposal upon the existing County
Road System warrants the dedication of additional Right of Way and the
roadway improvements herein specified.
13. The applicant should be advised that there may exist utilities either
underground or overhead affecting the applicants property, including
property to be dedicated or set aside future acquisition. Spokane
County will assume no financial obligation for adjustments or
relocation regarding these utilities. The applicant should check with
the applicable utilities and Spokane County Engineer to determine
whether the applicant or utility is responsible for adjustment or
relocation costs and to make arrangements for any necessary work.

I received the above referenced project application on June 20, 1997. The SCS Soils Map identifies tlhis area as
being Garrison Gravely Loam soi{s. The soii survey in this ar+ea is known to be accurate. Therefore, since this is
an approved soil for stormwater disposal, no concept drainage pian is required. We have no information that says
there are any critical areas on this site.
This application in not technicalty complete. An agreement to pay fees needs to be submitted. When it is
submitted it will be technically complete.
No drainage plan will be required for this proposal.

show the location of all existing structures, existing septic systems, exlsting and abandoned

Topagraphy information should be included if any slopes on site exceed 10%. Also, the map
1 shoutd show the location of any easements (existing or proposed) and utility lines along with the
( Iocation of the nearest tire hydrant (if applicable). The design of the preliminary map must
I conform to approved plat format standards.
