Stormwater Drainage Report for Short Plat 1120-96
1. SCiMMARY:
This project is Iocated north of Eight Avenue and west of Felts Road. The plat will consist of two lots with
duplexes and an access road.
The site was corisidered as two basins. The north basin (Tract `B's) flows northwest, and the south basin(Tract
"A" + Driveway) flovvs northwest and south. The Rational Method vvas used to calculate the peak stormwater
runoff for each basin in the pre-developed cnndition and tbe post-developed condition. In the pre-developed
condition, each bas'ia is composed of a vacant grass/weed lot. in the post-developed condition, each basin is
composed of two sub-basins; a) impervious roofs, concrete driveways, and b) grass lawns. Comparing the
pre-developed runoff with the post-developed runoff for each basin shows that there will be a small decrease in
runoff. Therefore, we recommend no installation of any drainage facilities afi this time.
Figure 2, page 6-3, of the "Guidelines for Stormwater Management", by Spokane Count-y Engineers, was used
for rainfall infiensiry and durarion occurri.ng at 14-year storm.
In accordance with "Soil Survey, Spokane County, VVashington,", 1968, the sail is categorized as:

Stormwater Drainage Report for Shoct Plat 1120-96
1. S Y:
This project is located north of Eight Avenue and west of Felts Road. The plat will consist of two lots with
duplexes and an access road.
The site was considered as two basins. The north basin (Tract "B") flows northwest, aad the south basin(Tract
"A" + Driveway) flows northwest and south. The Rational Method was used to calculate the peak stormwater
runoff for each basin in the pre-developed condition and the post-developed condition. In the pre-developed
condition, each basin is composed of a vacant grassJweed lot. In the post-developed condition, each basin is
composed of two (2) sub-basins; a) impervious roofs, concrete driveways, and b) grass lawns. Comparing the
pre-developed runoff with the post-developed runoff for each basin shows that there will be a negligible increase
in tunoff. Therefore, we recommend ao installarion of aay drainage facilities at this time.
Figure 2, page 6-3, of the "Guidelines for Stormwater Management", by Spokane County Engineers, was used
for rainfall intensity and duration occwrring at 10-year storm.

DECISIUN
TffiS MATTEIt, an application for subdivision of land from Belle Terre, Inc. has been received
and was decided upon, pursuant to Spokane Couniy Subdivision regulations, on the 24"' ciay of
February, 1997.

TINDINGS OF FACT AND CONCLUSIONS
1. The individual signing below has further been properly delegated the responsibility for
rendering the decision by the Director of Spokane County Division of Building and
Planning.
The proposal is to divide approwmately 1 acre into 2 residential tracts.
3. The praposal is located north of and adjacent to Eighth Avenue and approximately 280
feet west af Fetts Road in the NE of Section 20,Township 25 North, Range 44 E.W.M.,
Spokane County, Washington.
4. The existing zoning of the property described in the appiication is Urban Residential-3.5
(UR-3.5), which was established in 1991. Pursuant to Revised Code of Washington
(RCW) 58.17.195, this proposal conforms to the requirements of ihe existing UR-3.5
zone.
5. The Spokane County Comprehensive Plan designates this area as Urban. The
development and uses, as proposed and conditioned, are in compliance with the Urban
category.
6. Su.rrounding uses are primarily single family residences on mixed urban size lots.
7. The Spokane County Arterial Road Plan identifies Eighth Avenue as A1 Minor Arterial
with a future right-of-way width of 80 feet. The existing right-of-way width is 60 feet.
In order to implement the Arterial Road Plan, the Caunty Engineer reauires a strip of
praperty 5 feet in width along the Eighth Avenue frontage is to be set aside as a Future
Acquisition Area. In addition, the County Engineer requires that a dedication of right•of-
way along Eighih Avenue shall equal 35 feet from centerline. Therefore, as conditioned
(such as improvements, dedication, rnlewalks and acquisition areas) the rroposal
conforms to the Road Plan.
8. The proposed site is located within the Public Transportation Benefit Area (PTBA). The
Spokane Transit Authority (STA) Valley / Millwood Route 19 provides connecting
services to the site.
9. The proposed short plat wiil be served by a public water system. Waste water disposal '
wiil be as authorized by the Director of Spokane County Division of Utilities.
10. The required pubiic natice was provided for tlus proposal and agencies having a potential
interest in the praject were notified and recommendations solicited.
12. Written comments were received from an adjoining property owner is opposed to the
proposed short plat. The adjoining property owners are concerned about possible
septic and drainage problems this proposal will have on their property. In Addition,
the adjoining property owner is concerned abAUt the number annd type of units that
will be developed.
13. In response to the above comments, the Spokane Regional Heaith District witl
evaluate soils within the proposed short plat t4 determine suitability oi specific soii
types for on-site sewage disposal. The County Engineer has conditioned this proposal
tlzat a drainage plan be required as a means to reduce or control surface, ground and
run-off water. Moreover, the type of residential units permitted in the Urban
Residential-3.5 (UR-3.5) zone are single family dwellinss, which require a minimum
lot area of 10,000 sq. ft. and duplex dwellings, vvhich require a minimum lot area of
20,000 sq. ft. Multifamily dwellings (3 or mare units) are nat permitted in the UR-
3.5 zone.
14. Recognizing the recommended conditions and Spokane County development standa.r.rds,
the proposed short plat makes appropriate provisions for the public health, safety and
general welfare and that tbe public use and interest will be served by platting the
subdivision.
The subdivision proposal is generally consistent with RCW 58.17 and the County
subdivision regulations, promodng the public healdi, safety and generat welfare in
accordance with standards established by the State and Spokane County. The County
Division of Building and Planning has considered the provision af adequate public
facilities as cited in ,ItCW 58.17.110 (2). More specifically:
a. open spaces f. sanitary waste disposal
b. drainage ways g. parks and recreation facilities
c. public and/or private right-of-ways h. playgrounds
d. transit i. schools and schooi grounds
e. potable water j. sidewalks
15. The project is exempt fram environmeatal review under the State Environmental Policy
Act pursuant to WAC I 97-11-800 (6) (a).
16. The Central Valley School District bas commented on the proposed Short Plat. The
District has indicated that existing school facilities are inadeguate to serve the proposed
short plat and wishes to negotiate with the owner to provide adequate capital facilities as
required by the Revised Code of Waslungion (RCV) 58.17.110. Review by Gounty
legal counsel indicates the condidon requested by the School District can be required far
developments. Approval of this short plat should include conditions requiring that
provisions for appropriate faciiities be in ptace prior to recording the final short plat in the
form of a written agreement between the owner and the school district.
DECISION
~ Based upon the above noted Findings of Fact and Conclusions, Short Plat Application
SP-1120-96 is hereby APYROVED for five (5) years, specifically to March 1, 2002 and subject
to conditions noted below. This decision is final unless appealed in writing, consistent with
adopted appeal procedures.
CUNDITI4NS OF APPROVAL
All the below conditions imposed shatl be binding on the "Applicant," which term shall include
the owner or oumers of the property, heirs, assigns and successors.
SPOI{AN.C COUNTY DIVISION OF BUILDING AND PLANNING
l. The proposal shall comply with the Urban Residential-3.5 (UR-3.5) zone and other
applicable Zoning Code chapters, as amended.
2. The final short plat shall be designed substantiatty in conformance with the pretiminary
plat of record. No increase of density or number of tracts shall occ«r without a change of
condition application submittal and approval.
3. The preliminary short plat is given conditionat approval for five (5) years, specifically to
Marcli 1, 2002. The applicant may subcnit an extension of time application
approximately thirty (30) days prior to the above expiration date. Application(s) for
extension of time shall be processed under the provisions of Chapter 12.100.118
(Extension of Time) of the Spoka.cie Couaty Subdivision Ordinance. If the appiicant
complies with the criteria of Chapter 12.100.118, the preliminary approval and conditions
will be changed to retleet the Adppted policy and development regulations at the time of
the extension application.
4. Prior to filing the finat short plat, the applicant shatl submit to the County Division of
Building and Planning Director/designee for review any proposed final shart plats to
ensure eompliance with these Findings and Conditions of Approval.
5. A survey is required of the subject property prior to filing the final short plat.

6. Appropriate road name(s) and street address(es) shall be indicated on the final short plat
map.
7. Appropriate utility easements shall be indicated on the final short plat map. Written
approval of utility easements by utility companies must be received prior ta filing the
final short plat.
8. The final short plat map shall indicate by a dashed line the required setbacks from all
private or pubtic roads.
9. The dedication shail contain the following statement:
"Side yard and rear yard setbacks shall be determined at the time building pernlits
are requested unless these setbacks are specifically dra.fled on this final short plat.
The setbacks indicated on this subdivision may be varied from if proper zoning or
variance approvals are obtained."
10. Three (3) current Certificates of Title shall be fumished to the County Division of
IIuilding and Planning prior to filing the final short plat.
11. The applicant shall contact the County Division of Building and Planning at the earliest
possible stage in order to be informed of code requirements administered/enforced as
auihorized by the State Building Code Act. Design/development concems include:
addressing, fire apparatus access roads, fire hydrailt/flow, approved wrater systems,
building accessibility, construction type, occupancy classification, exiting, exterior wall
protection, and energy code regulations.
12. A plan far water facilities adequate for domestic service and fire protectian shall be
approved by the water supplier, fire protection district, Spokane County Division of
Building and Planning and County health authorities. The agencies will certify on the
Water Plan, prior to filing the final short plat or any phase of tlie preliminary short plat,
that the plan is in conformance with their respective needs and regulations. The Water
Plan and certification will be drafted on a transparency suitable for reproduction and be
signed by the sponsor.
13. The purveyor will also certify on the Water Flan that appropriate contractual
arrangements and schedule of improvements have been made vvith the sponsor far
construction of the water system in accordance with the approved Water Plan. The time
schedule for improvements will provide for completion of the water system and
inspection by the appropriate health authorities prior to application for building permits
within the iinal short plat. The arrangements or agreements will include a provision
holding Spokane County and the purveyor liarmless from claims by aay tract purchaser
refused a building permit due to the failure of the sponsor to satisfactorily complete the
approved water system.
14. The final short plat dedication will contain the following statement:
"The public water system, pursuant to the Water Plan approved by County and
State Health authorities, the local fire district, County Diviston of Building and
Planning, and water pucveyor, will be installed within this plat, and the applicant
will provide for individual domestic water service as well as fire protection to
each tract prior to sale of each tract and prior to issuance of a building permit for
each tract."
15. No building nermit will be issued for any tract within the final short plat until certified by
a Washington State-licensed engineer that "the water system has been installed pursuant
to the approved Water Plan for the final short plat," signed and stamped by said engineer.
The certification may be in tbe form of a letter, but is preferred to be cerrified on a copy
of the Water Plan as a schematic map showing the "as-built" water systern.
16. The Water Plan and the above four (4) conditions of approval regarding the Water Plan
may be waived by the County Division of Building and Planning Director/designee upon
receipt of letters from the appropriate water purveyor and fire protection district stating
that simple connections to an existing approved water system will provide adequate
domestic and fire protection water to ensure the public health, safety and general welfare.
17. The Spokane County Division of Building and Planning shall prepare and record with the
County Auditor a Tiile Notice specifying a future land acquisition area for road right-of-

way and utilities. Tlie reserved future acquisition area Title Notice shall be released, in
full or in part, by the County Division of Building and Planning. The notice sliould be
recorded Uhe same time as tlie final short plat and shall provide the following:
a. A strip of property 5 feet from die existing right-of-way is reserved for future
acquisition area for additional road right-of-way along Eigllth Avenue. Note:
The County Engineer required a dedication of right-of-way equal to 35 feet from
the centerline of Eighth Avenue.
b. Tuture building and ather setbaclcs required by the Spokane County Zoning Code
shall be measured from the reserved future acquisition area.
c. Na required tandscaping, parking, '208' areas, drainfield or allowed signs should
be located within the future acquisition area for road right-of-way and utilitics. If
any of the above improvements are made witlun this area, they shall be relocated
at the applicant's expense when roadway improvements are made.
d. The future acquisition area, until acquired, shall be private property and may be
used as allowed in the zone, except that any improvements (such as landscaping,
parlcing, surface dxainage, drainfield, signs or others) shall be considered interim
uses.
e. The property owner shall be responsible for relocating such "interim"
improvements at the time Spokane County makes roadway improvements after
acquiring said future acquisition area.
18. The owner shail negotiate with Central Valley School District and submit a recorded
copy of a voluntary agreement making provisions for public schools prior to recording of
the final short plat. The agreement shall provide a written description of the subject
property to which the agreement applies and also state the dollar amount and any other
agreed to mitigating measures.
The owner shall also notify any potential purchasers who have made An agreement to
purchase property within said plat pursuant to the Revised Code of Washington (RCV)
58.17.205, that adequate provisions for school facilities must be made conditioned on a
future aSreement between the applicant and the schoai disfirict.
Voluntary agreements between the owner and school district shall conform to the
requirements of RCW Chapter 82.02.
SPOKANE CUUNTY DIVISION OF ENGINEERING AND ROADS
l. That canditional approval of the plat by the County Engineer is given subject to
dedication of right-of-way and approval of the road system as indicAted in the preliminary
plat af record.
2. That drainage plans and design calculatrons showing the alignment of drainage facilities
be submitted to the County Engineer for acceptance prior to construction and/or the filing
of the final plat. Drainage plans to be prepared under the direction of a licensed
professional Civil Engineer.
3. No construction work is to be performed within the existing or proposed Public right-of-
way until a permit has been issued by the Gounty Engineer. All work is subject to
inspection and appraval by the County Engineer.
4. The applicant should be advised that individual driveway access permits are required
prior to issuance of a building permit for driveway approaches to the County road system.
5. Dedicacion of right-of-way along Eighth Avenue shali equai 35 feet from centerline.
6. To construct the road improvemeots stated herein, the applicant may, with the approval of
the County Engineer, join in and be a willing participant in any petition or resalutian
which purposes is the formation of a Road Improvement District (RID) for said
improvements pursuant to RCW 36.88, as amended. At such time as an R.ID is created or
any Road Improvement Project is sanctioned by Spokane County, the improvements
required (curb, sidewalk, drainage control and paving to existing pAVement) will be at the
sole expense of the undersigned ovrmer, their heirs, grantees and assigns. This provision is
applicabie to Eighth Avenue.

7. As an alternative method of constructing the road improvement stated herein, the
applicant may, witb the approval of the County Engineer, accomplish the road
improvements stated herein by joining and participating in a County Road Praject (CRP)
to the extent of the required road 'unprovement. At such time as a RID is created or any
Road Improvement Project is sanctioned by Spokane County, the improvements required
(curb, sidewalk, drainage control and paving to existing pavement) will be at the sole
expense of the undersigned owner, their heirs, grantees and assigns. This pravision is
applicable to Eighth Avenue.
8. That the following statement shall appear within the dedicatory language of the final
short plat:
"That in consideration of Mutual Benefits now or to be bereafter derived, do for
themselves, their heirs, grantees, assigns and successor(s) in interest hereby
request and authori2e Spokane County to include the above described property in
a Road Jmprovement District (RID) and to support the formation of a Road
Improuement District for improvement of the road(s) described below by
requesting and authorizing Spokane County to Flace their name(s) on a petition
for the formation of a Road Improvement District pursuant to RCW 36.88.050, ar
by requesting and authorizing Spokane Couaty to cast their ballot in flvor of a
RID being formed under the resolution method pursuant to RCW 36.88.030,
and/or by not Iiling a protest against the formation of a RID being formed under
the alternative resolution method provided for in RCW 36.88.065 €ind Chapter
35.43 RCW.
"If a RID is proposed for improvement of the road(s) described below, said
owner(s) and successor(s)further agree: (1) tUat the improvements or construction
contemplated within the proposed RID are feasible and (2) that the benefits to be
derived from the formation of the RID by the property included tilerein, togefiher
witll the amount of any County participation, exceeds the cost and expense of
formation of the RID, and (3) that the property within the proposed RID is
sufficiently developed; provided, themselves, their heirs, grantees, assigns and
successor(s) sliall retain the right, as authorized under RCW 36.88.090, to object
to any assessment(s) on the property as a result of the improvemenLs called for in
conjunction with the formation of a RID by eitber the petition or resolutian
method under Chapter 36.88 RCW and to appeal to the Superior Court the
decision of 1he Board of County Coramissioners confirrning the final assessment
roll; provided further, it is recognized that actual assessments may vary from
assessment estimate so long as tlley do not exceed a figure equal to the increased
true and fair value improvement(s) add(s) to the property.
3`tt is further acknowledged and agreed that at sucli time ns a RID is created or any
County iZoad Improvement project is authorized by Spokane County, the
improvements required shall be at the sole expense of the owner(s) of property
within the RID or served by the improvements without any monetary participation
by Spokane County.
"The RID waiver contained in tlus agreement shall expire afier tien (10) years
from the date of execution below. This provision ts applicable to Eighth
Avenue."
9. The County Engineer has designated a 5-lane Minor Arterial Roadway Section for the
improvement of Eighth Avenue which is adjacent to the proposed development. This
will require the addition of approximately 16-18 feet of asphalt along the frontage of the
development. The construction of curbing and sidewalk is also required.
10. The proposed plat shall be improved to the standards set forth in Spokane County Board
of Commissioners Resolution No. 95-0498, as amended, which establishes regulations for
rnads, approaches, drainage and fees in new construction.
11. The County Engineer has examined this development proposal and has determined that
the impact of this proposal upan the existing County Road System warrants the
dedication of additional right-of-way and the roadway improvements herein specified.

12. The County Arterial Road plan identifies Eighth Avenue as an 80 foot Minor Arterial.
The existing right-of-way width of 30 feet fram centerline is not cansistent with that
specif ed in The Plan. In order to implement fihe Arterial Road Plan it is recommended
that in addition to the required right of way dedication, a strip of property 5 feet in w2dth
along the Eiglitli Avenue frontage be set aside in reserve. This property may be acquired
by Spokane County at the time when Arterial Improvements are mAde to Eighth Avenue.
13. The applicant should be advised that there may exist utilities either underground or
overhead affecting the applicants property, including property to be dedicated or set aside
future acquisition. Spokane County will assume no financial obligation for adjustments
or relocation regarding these utilities. The applicant should check with the applicable
utilities and Spokane County Engineer ro determine whether the applicant or utitity is
responsible for adjustmeni or relocatian costs and to make arrangements for any
necessary work.
14. The applicunt shall grant applicable border easements adjacent to Spokane County right-
af-way per Spvkane County Standards.
SI'OKANE COUNTY DIVISION Or UTILITIES
l. A wet (live) sewer connection to the existing area wide Pubiic Sewer System is to be
constructed. Sewer connection permit is required.
Prior to filing the final short plat, the applicant shall submii to the Division of Utilities
"under separate cove,» far review and approval only those plan sheeis showing sewer

The Spokane County Engi.neering Department bas reviewed the above referenced application. The following
"Conditions of Approval" are submitted to the Spokane Gounty Planning Department for inclusion in the
"Findings of Fact, Conclusions and Order/Decision" should the request be approved.
1. That conditional approval of the plat by the County Engineer is given
subject to dedication of right-of-way and approval of the road system
as indicated in the preliminary plat of record.
2. That drainage plans and design calculations showing the alignment of
drainage facilities be submitted to the County Engineer for acceptance
prior to construction and/or the filing of the final plat. Drainage
plans to be prepared under the direction of a licensed Profeasional
Civil Engineer.
3. No construction work is to be performed within the existing or proposed
Public right-of-way until a permit has been issued by the County
Engineer. All work is subject to inspection and approval by the County
Engineer.
4. The applicant should be advised that individual driveway access permits
are required prior to isauance of a building permit for driveway
approachea to the County road system.
5. Dedication of right-of-way along 8th Avenue shall equal 35 feet from
centerline.

6. To construct the road improvements stated herein, the applicant may,
with the approval of the County Engineer, join in and be a willing
participant in any petition or resolution which purposes is the
formation of a Road Improvement District (RID) for said improvements
pursuant to RCW 36.88, as amended. At such time as an RID is created
or any Road Improvement Project is sanctioned by Spokane County, the
improvements required (curb, sidewalk, drainage control and paving to
existing pavement) will be at the sole expense of the undersigned
owner, their heirs, grantees and assigns. This provision is applicable
to 6`h Avenue.
7. As an alternative method of constructing the road improvement stated
herein, the applicant may, with the approval of the County Engineer,
accomplish the road improvements stated herein by joining and
participating in a County Road Project (CRP) to the extent of the
required road improvement. At such time as an RID is created or any
Road Improvement Project is sanctioned by Spokane County, the
improvements required (curb, sidewalk, drainage control and paving to
existing pavement) will be at the sole expense of the undersigned
owner, their heirs, grantees and assigns. This provision is applicable
to 8`h Avenue.
8. That the following statement shall appear within the dedicatory
language of the final plat:
That in consideration of Mutual Benefits now or to be hereafter
derived, do for themselves, their heirs, grantees, assigns and
successor(s) in interest hereby request and authorize Spokane County to
include the above described property in a Road Improvement Diatrict
(RID) and ta support the formation of a Road Improvement District for
improvement of the road(s) described below by requesting and
authorizing Spokane County to place their name(s) on a petition for the
formation of a Road Improvement District pursuant to RCW 36.88.050, or
by requesting and authorizing Spokane County to cast their ballot in
favor of a RID being formed under the resolution method pursuant to RCW
36.86.030, and/or by not filing a protest against the formation of a
RID being formed under the alternative resolution method provided for
in RCW 36.88.065 and Chapter 35.43 RCW.

If a RID is proposed for improvement of the road(s) described helow,
said owner(s) and succeasor(s)further agree: (1) that the improvements
or construction contemplated within the proposed RID are feasible and
(2) that the benefits to be derived from the formation of the RID by
the property included therein, together with the amount of any County
participation, exceeds the cost and expense of formation of the RID,
and (3) that the property within the proposed RID is suff iciently
developed; provided, themselves, their heirs, grantees, assigns and
successor(s) shall retain the right, as authorized under RCW 36.88.090,
to object to any assessment(s) on the property as a result of the
improvements called for in conjunction with the formation of a RID by
either the petition or resolution method under Chapter 36.88 RCW and to
appeal to the Superior Court the decision of the Board of County
Commissioners confirming the final assessment roll; provided further,
it is recognized that actual assessments may vary from assessment
estimate so long as they do not exceed a f igure equal to the increased
true and f air value improvement ( s) add ( s) to the property.
It is further acknowledged and agreed that at such time as a RID is
created or any County Road Improvement project is authorized by Spokane
County, the improvements required shall be at the sole expense of the
owner(s) of property within the RID or served by the improvements
without any monetary participation by Spokane County.
The RID waiver contained in this agreement shall expire af ter ten (10)
years from the date of execution below. This provision is applicable
to 8 Avenue.
9. The County Engineer has designated a 5 Lane Nlinor Arterial Roadway
Section for the improvement of 8`" Avenue which is adjacent to the
proposed development. This will require the addition of approximately
16-18 feet of asphalt along the frontage of the development. The
construction of curbing and sidewalk is also required.
10. The proposed plat shall be improved to the standards set forth in
Spokane County Board of Commissioners Resolution No. 95-0498, as
amended, which establishes regulations for roads, approaches, drainage
and fees in new construction.
11. The County Engineer has examined this development proposal and has
determined that the impact of this proposal upon the existing County
Road System warrants the dedication of additional Right of Way and the
roadway improvements herein specified.
12. The County Arterial Road plan identif ies S`'' Avenue as an 80 f oot Minor
Arterial. The existing right of way width of 30 feet from centerline
is not conaistent with that specified in The Plan. In order to
implement the Arterial Road Plan it is recommended that in addition to
the required right of way dedication, a strip of property 5 feet in
width along the 8`h Avenue frontage be set aside in reserve. This
property may be acquired by Spokane County at the time when Arterial
Improvements are made to 8' h Avenue.

13. The applicant should be advised that there may exist utilities either
underground or overhead affecting the applicants property, including
property to be dedicated or set aside future acquisition. Spokane
County will assume no financial obligation for adjustments or
relocation regarding these utilities. The applicant should check with
the applicable utilities and Spokane County Engineer to determine
whether the applicant or utility is responsible for adjustment or
relocation costs and to make arrangements for any necessary work.
14. The applicant shall grant applicable border easements adjacent to
Spokane County Right of Way per Spokane County Standards.
