The property owner8 within this Short Plat shall be responsible for
keeping open a.nd maintaining the surface path of natural or man-made
drainage flow over and acrose their respective propertbes. Each
property owner or authorized representative ahall inform each
succeeding purchaser of any drainage easements on the property and
their responsibilfty for maintaining eurface drainage paths and
swales within said easements. If the property owner(s) fails to
maintain the surface path of natural or man-made drainage flow, or
the drainage swale, a notice of such failure may be given to the
property owner(s). If not corrected witbin the period indicated on
saici notice, Spokarae County has the right to correct the maintenance
failure, or h$ve it corrected, at the expense of the property owner.

TEIIS MATTER, an applicativn fnr subdivision of land from Dennis Raugust has been received
and was decided upon, pursuant to Spokane County Subdivision regulations, on the 4''' day of
March, 1997.
FINDINGS OF FACT AND CONCLUSIONS

Planniiig.
2. 'I'lle proposal is to clivide approximately .62 acres into two tracts for single family
residences and lhose uses pennitted in lhe existuig Urban Residential-3.5 (UR-3.5) zane.
3. The proposal is located east of and adjacent lo Marguerite Road in the SE 1/4 of Sectinn
18, Township 25 North, Range 44 E.W.M. Spokane Cownty, Washington.
4. I'lie existing zoning of the property described in the applicalion is UR-3.5, which was
established in 1991. Pursuaiit to Revised Code of Washinglon (RCW) 58.17.195, this
proposal confacnis to the requirements of the existing UR-3.5 zone.
5. The Spokane Caunty Cotalprehensivc Plan designates this arca as Urban. The
development and uses, as proposed and conclitioned, are in compliaiice with this
designation.
6. Sunounding uses are priinarily single fainily residences and commcrcial uses along tIle
Argonne/Mullan Road commercial corridor.
7. 7'he site is lacated within the Public Transportation Benefit Area (P1'BA).

97 is hereby APPROVLll for five (5) years, specifically to April 1, 2002 and subject to
canditions nnted helow. This decisioii is final unless appealed in writing, consistent wiUi
adopted appeal procedtires.
CONDITIONS OF APPROVAL
All the below conditions imposed shail be binding on the "Applicant," which terili sUAll include
the owner or owners of the property, heirs, assigns and successors.
SPOKANE COUNTY DIVISION OF BUILDING AND PLANNING
I. The proposal shall comply with the UR-3.5 zone and otlier applic:able Znnuig ~ode
chapters, as amended.
2. The final plat shall be ciesigned substantialty in conformance with the preliminwy plat nf
record. No incrcase of density or number of tracts shall occur without a change of
corldition application submiital and approval.
3. `I'he preliininary shart plat is given c;onditional approval for five (5) years, specifically to
April l, 2002. The applicant may submit an extension oFtime application approximatcly
tlvrty (30) days prior to the above expiration date. Application(s) for extension of cime
shall be processed under the provisions of Chapter 12.100.118 (Exteiision of `i`iine) ot' the
Spnkane County Subdivision Ordinance. If the applicant cnmplies with the criteria nl'
Chapter 12.100.118, the preliminary approval and conditions will be changed to reflect
the adopted policy and development rcgulations at the time of the extensian application.
4. Prior to filing of the Cnal sliort plat, the applicant shall submit to the County Uivision of
Building and Planning Director/designee for review any proposed final plats to ensure
coinpliance with tliese rindings and Conditions of Approval.
5. A survey is required of the subject property prior to filing of the Fnal shurt plat.
6. Appropriate raad name(s) mici strcet address(es) shall be indicated on the iinal plat map.
7. Appropriale utility easements shall be indicated on the final plat map. Approval of utility
easements by utility compaiiies must be received prior to filing of the final plat.
8. The final short plat map sUall indicate by a dasued line the required setbacks from all
private or public roads. The dedication shall contain the following statement: "Side yard
and rear yard sctbacks shall be determined at the time building pcnnics are requestcd
unless these setUacks are specifically drafted ou this f nal plat. The setbacks tndicateci on
lhis subdivision may be varied from if proper zoning or variance approvals are obtained."
9. Three (3) current certil'icales of title shall be furnished to the Cauniy Division of
Building and Planning prior to Cling of the final plat.
10. The applicant s11a11 contact the County Divisiou of Building and Planning at the earliest
possible stage in order to be informed of code requirenients administered/enfarced as
autlinrized by the State Building Code Act. Desigti/development concerns include:
addressing; fire apparatus aCCess roads; fire hydrant/flow; approved water systems,
building accessibility; construction type, occupancy classification; cxiting; extcrior wall
nrolection; and energy code regulations.
11. A plan fUr water facilities ariequate for doinestic servic:e and fire protection shall be
approved by the water supplier, tire protection districl, Spokane County Division of
Building and Planning and County health authorities. The agencies wiU certify on the
Water Plan, Prior to the Fling of the finai short plat or any phase of the preliminary short
plat, that the plttn is in conformance wiih their respet;tive needs ajtd regulatinns. Tllc
Water Plan arid certification will be drafted on a transparenc:y suitable foi• reprncluctivil
and be signed by the sponsar.
12. The purveynr will also cei-tify on the Wa[cr I'lan thAt appropriate contrlctual
arrangements and schedule of ienprovements have been made with tlie sponsor for
construction of the water syslem in accordance with the approved Water Plaii. Thc time
schedule for improvements will provide fur completion of the wlter system and

within the final sllart plat. Tlie arrangements or agreemcnts will inelude a provisiun
holding Spokane Gowlty and the purveyor harmless froiu claims by any tract purchaser
reftised a builciing permit due to the failure of the sponsor to satisfactorily complete the
approved water system.
13. The final plat dedication will contain the following statement: "The public water system,
pursuant to the Water Plan approved by County and State Healtli autliorilies, the local fire
district, County Division of Builduig and Planning, and waier purveyor, lAill be installed
witllin lhis plat, and the subdivider/sponsor will provide for individual dnmestic water
service as well as Fre pi•otection to each u•act prior to sale of each tract and prior to
issuance of a building permit for each tract."
14. No building permit will be issued far aliy tract within the final short plat until Certified by
a Washington State-licensed engineer that "the water system has been installed pursuant
to the npproved Water Plan for the final short plat," signed and stamped by said engineer.
The certification may be in the form of a letier, but is prefecred ln be certiticd vn a copy
of the Water Plan as a scliematic map showing the "as-built" water system.
15. The Water Plan and the above four (4) conditions of approval regarding the Water Plan
may be waived by the County Division of Building and Planning Director/ciesignce upon
receipt of letlers Crom the appropriale water purveyor and firc protection districi stating
that siniple connectians to an existing approved water systein will provide adequate
domestic aiid fire protectiou water to ensure the public health, safety and general welfare.
16. Nn water plan is rcquired, only a simple connection will be needed privr to the sale of
eack► tract and prior to issuance of a building permit for each tract.
17. The Snokane Couniy Division of Building and Planning shall prepare and record with the
Spokane Caunty Auditor a"Title Notice" notuig tliat the property in yuestion is subject to
a variety of special conclitions imposed as a result of approval of a land use action. I`Iiis
"Title Notice" shall serve as official public notice regarding conditions of approval
