Drainage easements, as platted and shown hereon, which are for dhe purpose of installing, operating and maintaining drainage swales and drainage facilities, as conditions of plat approval, are hereby granted to the public. Spokane County and its authorized agents are heceby granted the right of ingress and egress to, overa and from said easements for the purpose of inspection and emergency maintenance of water qual ity treatment swales ("208 swales and other drainage facilities, if not properly maintained by the property owner. FINDINGS OF FACT APVD CONCLUSIONS 1. The individual signing below has further been properly delegated the responsibility for rendering the decision by the Spokane C:ounty Director of Planning. 2. The proposal is to divide approximately 1.36 acres inta 2 lots for 1 exisang single family I residence and 1 additional residential lot and those uses permitted in the underlying zone. 3. The proposal is generally located aorth of and adjacent to Alki Road, approximately 550 feet east of Barker Road in the SW 1/4 of Section 17, Township 25 North, Range 45 E.W.M. Spokane County, Washington. 4. The existing zoning of the property described in the application is Urban Residential-3.5 (LJR- 3.5), previously establisbed as Agncultural (A) (file # 225-57 zoning in 1957 and redesignated to UR-3.5 on January 1, 1991, pursuant to the Program to Implement the Spokane County Zoning Code. Pursuant to RCW 58.17.195 the proposal does conform to the requirements of the existing UR-3.5 zone. 5. The Spokane County Comprehensive Plan designates this area as Urban. The development and uses proposed are generally in accord with this category. 6. Suaounding uses are primarily single and multifamily residences on mixed urban size lots, industrial and commercial facilities and various areas of open space. 7. T'he required public notice was pmvided for this proposal and agencies havi.ng a potenaal . intere.st in the project were notified and recommendations solicited. 8. No written comments were received from any adjoining property owners. 9. The site is located within the Public Transportation Benefit Area (P'TBA). The Spokane Transit Authority (STA) Broadway Route # 18 provides connecting services to the site. 10. The prvposed short plat will be served by a public water system. Waste water disposal will be as authorized by the Director of Utilities. 11. The Spokane County Pazks Department has commented on the praposed short plat. The Parks Deparnnent has requested a voluntary agreement be completed between the Parks Deparmaent and the property owner to nutigate impacts to the County Park system. County legal counsel has indicated such agreements may be reqaired. The Spokane County Planning Department recommends the property owner negotiate with the Spokane County Parks Department to provide for appropriate capital facilities as required by the Revised Code of Washington (RCW) 58.17.110. Approval of this short plat should include conditions requiring that provisions for appropriate facilities be in place prior to recording this final plat in the form of a written agreement betwe,en the owner and the Spokane County Pazks Deparanent 12. The Central Valley School District No. 356 has commented on the proposed Short Plat. The District has ind.icated that existiing school facilities are inadequate co serve the proposed short plat and wishes to negotiate with the owner to provide adequate capital facilities as required by the Revised Code of Washington (RCW) 58.17.110. Review by County legal counsel indicates the condition requested by the School District can be required for developments. Approval of this short plat shauld include conditions requiring that provisions for appropriate facilities be in place prior to recording the final short plat in the form of a written agreement between the owner and the school district. 13. The proposed short plat has direct access to public right of way at Alki Avenue. No sidewalks were required by the County Engineer for this proposal. 14. Recognizing the recommended conditions and Spokane County development standards, the proposed short subdivision makes appropriate provisions for the public health, safety and general welfare and that the public use and iriterest will be served by platting the subciivision. FINDIlNGS AND DECISION SP-943-93 Page 2 The subdivisioa proposal is generally consistent with RCW 58.17 and the County subdivision re,gulatians, promoting the public health, safety and general welfare in accordance with standards established by the state and Spokane County. The Planning Department has considered the provision of adequate public facilities as cited in RCW 58.17.110 (2). More specificallY: a. open spaces b. drainage ways c. public and/or private rights-of-way d . transit e. potable water f. sanitary waste disposal g. parkS and recreation faeilities h . playgrounds i. schools and schoolgrounds j . sidewalks 15. Tbe project is exempt firom environmental review under the State Environmental Policy Act pursuant to WAC 197-11-800 (6) (a). 16. The following facts are also relevant: a. The proposed Short Plat is a replat of a portion of Lot 5, Block 1, of Garwood Subdivision of Corbin Addition to Greenacres, which was recarded as a final plat on September 14, 1946. b. One storage structure, detached, private, is permitted inside the Urban Impact Area (UTA) boundary, limited in area to 1,500 square feet and provided setbacks and maximum building covera►ge standards are met. c. The Urban Residential-3.5 (iJR-3.5) zone does allow duplexes for lots which are twice the minimum lot size required for single family units or 20,000 square feet. Lot "B" has the potential for a duplex. d. This proposal was received by the Planning Deparnnent prior to January 1,1994 and the irnplementation of new Washington State Board of Health regulations on the use of on-site sewage disposal systems. DECISTON Based upon the above noted Findings of Fact and Conclusions, Short Plat Application SP-943-93 is hereby APPROVED until April l, 1997, subject to conditions noted below. Most of the conditions of approval shall be accomplished by the applicant and/or sponsor prior to finalization of the short subdivision. This decisioa is final unless appealed in wnang, consistent with adopted appeal procedur+es. COUNTY PLANNING DEPARTMENT CONDITIONS 1. All conditions imposed by the Planning Department shall be binding on the "Applicant", which term shall include the owner or owners of the property, heirs, assigns and successors. 2. The proposal shall comply with the Urban Residential-3.5 (UR-3.5) zone as amended. 3. The final plat shall be desigaed substantially in confarmance with the preliminary plat of recard. No increase of density or number of lots shall occur without a change of condition application submittal and approval. 4. The Planning Director/designee shall review any proposed final plat to ensure compliance with these Findings and Conditions of Approval. 5. The preliminary plat is given conditional approval for three (3) years, specifically to April l, 1997. A plan for water facilides adequate for domestic service and fire protection shall be approved by the water purveyor, appropriate fire protection district, County 1?ivision of Boildings and County Health District. The agencies wili certify on the Water Plan, priar to the filing of a final plat, that the plan is in confoimance with their respective needs and regulations. The Water Plan and certification shall be draftted on a transparency suitable for reproduction and be signed by the plat sgonsor. 11. The water purveyor shall certify that appmpriate contractual anangements and schedule of unprnvements have been made with the plat sponsor for construction of the water system in accordance with the approved Water Plan. The time schedule shall provide for completion of the water system and inspection by the appropriate health authorities prior to application for building perrmits within the final plaL The arrangements or agreements shall include a provision holding Spokane County and the purveyor harmless fram claims by any lot purchaser refused a building permit due to the failure of the subd.ivision sponsor to satisfactorily complete the approved water system. 12. The final plat dedication shall contain the following statement: "The public water system, pursuant to the Water Pla.n approve.d by county and state health authorities, the local fire prot,ection district, water purveyor and Spokane County Division of Buildings, shall be installed within this subd.ivision, aad the applicant shall provide for individual domestic water service as well as fire protection to each lot prior to sale of each lot and prior to issuance of a building permit for each lot." 13. No building permit will be issued for any lot within the final plat until certified by a Washington state-licensed engineer that "the water system has been installed pursuant to the approved Water Plan for the final plat" including a signed license stamp. The cemfication may be in the fomn of a letter, but is preferned to be certified on a copy of the Water Plan as a schematic map showing the "as-built" water system. 14. The owaer shall also notify any potential purchasers who have made an agreement to purchase groperty within said plat pursuant to the Revised Code of Washington (RCW) 58.17.205, that adequate provisions for park facilities must be made conditioned on a future agreement between the plattor and Spokane County Parks DepartmenL Voluntary agreements between the owner and Spokane County Parks Department shall conform to the requirements of RCW Chapter 82.02. 16. As an alternarive raethod of constructing the road improvements stated herein, the applicant may, with the approval of the County Eagineer, accomplish the road improvements stated herein by joining and participating in a County Road Project (CRP) to the extent of the required road improvements. At such time as an RID is created or any Road Improvement Project is sanctioned by Spokane County, the improvements required (curb, sidewalk, drainage control and paving to exisang pavement) will be at the sole expense of the undersigned owner(s), their heirs, grantees and assigns. This provision is applicable to Broadway Avenue and Alki Avenue. 10. The following statement shall be placed in the plat dedication: "The owner(s) or successor(s) in interest agree to authorize the County to place their name(s) an a petition for the formation of a Road Improvement District (RID) by the pedtion method pursuant to Chapter 36.88 RCW, which petition includes the owner(s)' property, and further not to object, by the signing of a ballot, to the formation of an RID by thc resolution method pursuant to Chapter 36.88 RCW, which resolution includes the owner(s)' property. If an RID is fomaed by either the petition or resolution method as pmvided for in Chapter 36.88 RCW, the owner(s) or successor(s) further agree: ~ ~ (a) that the improvement(s) or construction contemplated within the proposed RID is feasible; i FINDINGS AND DECISION SP-943-93 Page 5 (b) that the benefits to be derived from the formation of the RID by the property included therein, together with the amount of any County participation, exceed the cost and expense of formation of the RID; and (c) that the property within the proposed RID is sufficiendy developed. Provided further that the owner(s) or successor(s) shall retain the right, as authorized under RCW 36.88.090, to object to any assessment(s) on the property as a result of the improvements called for in coajunctioa with the formation of an RID by either petition or resolution method under Chapter 36.88 RCW, and to appeal to the Superior Court the decision of the Board of Counry Commissioners aiffirming the final assessment roll. It is further agreed that at such time as an RID is created or any Road Improvement Project is sanctioned by Spokane County, the improvements required (curb, sidewallc, drai.nage control ~ and paving) will be at the sole expense of the undersigned owner(s), their heus, grantees and assigns without participation by Spokane County. The RID waiver contained in this agreement shall expire after ten (10) years from the date of execution below. However, the owner(s) or successor(s) agree that if said RID waiver expires without construction of the required improvements, the owner(s) or successar(s) agree to construct the required improvements at their own expense, pay to Spokane County ttie then estimated cost of the required improvements to enable the County to complete the same, or furnish a bond or other secure method suitable to the County (which may include the execution of another RID waiver agreement) providing for or securing to the Connty the actual construction of the improvements. All of the requirements of this agreement shall run with the land and shall be binding upon the owner(s), their successor(s) or assign(s)." This provision is applicable to Broadway Avenue and Alki Avenue. 11. The County Engineer has designated Typical Roadway Secdon Nnmber One, Local Access Standard far the improvement of Broadway Avenue, which is adjacent to the proposed develapment. This will require the addition of approximately 10-12 feet of asphalt along the frontage of the development. The construction of curbing and sidewalk is also requined. 12.
