l. Drainage easements, as platted and shown hereon, which are for dhe purpose of
installing, operating and maintaining drainage swales and drainage facilities, as conditions
of plat approval, are hereby granted to the public.
Spokane County and its authorized agents are heceby granted the right of ingress and
egress to, overa and from said easements for the purpose of inspection and emergency
maintenance of water qual ity treatment swales ("208 swales and other drainage
facilities, if not properly maintained by the property owner. Spokane County does not
accept the responsibility to inspect or maintain the drainage easements or draiaage
swales, nor does the County accept any liability for any fa.ilure by the lot owner(s) to
properly maintain such areas.
~3. ~ The property owners within this Plat shall be held responsible for keeping open and
~ maintaining the surface path of natural or man-made drainage flow over and across their
respective properties.
4. The property owners within this Plat shall maintain all water quality treatment swales
('208 swales") and drainage ditches situated on their respective properties, and any
portion of a?08 swale situated in the public right-of-way adjacent to their respective
properties, with a permanent ground cover as speciied on the currenc approved plans on
file ac ct►e County Engineer's Office. The pxoperty owners may install approved
shrubbery andlor aees which do not obstruct the flow and percolation of storm drainage
water in the 208 swale and drainage ditches, as indicated by the current approved plans
vn file with the County Engineer's Office.
5. The property owner or his representative shall inform each succeeding putchaser of all
drainage easements on the properry and of his responsibilit}r for maintaining surface
drainage paths and swales within said easements.
6. Spokane County does not accept the responsibility of maintaining the drainage course on
private lots within drainage easements or floodplain areas, nor the responsibility 1'or any
damage whatsoever, including, but not limited to, inverse condemnation to any properties
due to deticient canstruction and or maintenance of drainage courses in drainage
easements on private propecty.

7. If the property owner fails to maintain the surface path of natural or man-made drain
flow, or the drainage swaie, a notice of such failure may be given to the property own
If not corrected within the period indicated on said notice, Spokane County has the rij
to correct the maintenance failure, or have it corrected, at the expense of the prope=
awner.
G8 Any building that is constructed on a lot in this Plat shall be set at such an elevation
as to provide positive drainage away from any drainage entry point to the buildig
(including buc not limited to a window well, a window unprotected by a window we4
or a doorway). Said positive drainage shall consist of a minimum slope of 3% away frqm
the building for a distance of at least 10 feet from the building. The lots shall be gradtJ
so that either a) all runoff is routed away from the building, and conveyed over the 61

10. Development within this Plat shall conform the requiremencs of the National Flood
Insurance Program, and Chapter 3.20 of the Spokane County Code. The lowest floor,
including basement floor, for any structure shall be constructed in accordance with the
requirements of the Spokane County Flood Zone Regulations in eifect at the time a
building permit is issued. Purchasers of property in this subdivision are warned of
passible flooding or ponding and the of the potential requirement to purchase Fiood
Insurance. This warning sha!l be carried in each and every deed to transfer ownership
of any and all properry within this plat in the Area of Special Flood Hazard.

THIS MATTER, an applicadon for subdivision of land, from Leanae Karras has been received
and decided upon, pursuant to Spokane County Subdivision regulations, on the f~~1iay of March,
1994.
FINDINGS OF FACT APVD CONCLUSIONS
1. The individual signing below has further been properly delegated the responsibility for
rendering the decision by the Spokane C:ounty Director of Planning.
2. The proposal is to divide approximately 1.36 acres inta 2 lots for 1 exisang single family
I residence and 1 additional residential lot and those uses permitted in the underlying zone.
3. The proposal is generally located aorth of and adjacent to Alki Road, approximately 550 feet
east of Barker Road in the SW 1/4 of Section 17, Township 25 North, Range 45 E.W.M.
Spokane County, Washington.
4. The existing zoning of the property described in the application is Urban Residential-3.5 (LJR-
3.5), previously establisbed as Agncultural (A) (file # 225-57 zoning in 1957 and
redesignated to UR-3.5 on January 1, 1991, pursuant to the Program to Implement the
Spokane County Zoning Code. Pursuant to RCW 58.17.195 the proposal does conform to
the requirements of the existing UR-3.5 zone.
5. The Spokane County Comprehensive Plan designates this area as Urban. The development
and uses proposed are generally in accord with this category.
6. Suaounding uses are primarily single and multifamily residences on mixed urban size lots,
industrial and commercial facilities and various areas of open space.
7. T'he required public notice was pmvided for this proposal and agencies havi.ng a potenaal .
intere.st in the project were notified and recommendations solicited.
8. No written comments were received from any adjoining property owners.
9. The site is located within the Public Transportation Benefit Area (P'TBA). The Spokane
Transit Authority (STA) Broadway Route # 18 provides connecting services to the site.
10. The prvposed short plat will be served by a public water system. Waste water disposal will be
as authorized by the Director of Utilities.
11. The Spokane County Pazks Department has commented on the praposed short plat. The
Parks Deparnnent has requested a voluntary agreement be completed between the Parks
Deparmaent and the property owner to nutigate impacts to the County Park system. County
legal counsel has indicated such agreements may be reqaired. The Spokane County Planning
Department recommends the property owner negotiate with the Spokane County Parks
Department to provide for appropriate capital facilities as required by the Revised Code of
Washington (RCW) 58.17.110. Approval of this short plat should include conditions
requiring that provisions for appropriate facilities be in place prior to recording this final plat in
the form of a written agreement betwe,en the owner and the Spokane County Pazks Deparanent
12. The Central Valley School District No. 356 has commented on the proposed Short Plat. The
District has ind.icated that existiing school facilities are inadequate co serve the proposed short
plat and wishes to negotiate with the owner to provide adequate capital facilities as required by
the Revised Code of Washington (RCW) 58.17.110. Review by County legal counsel
indicates the condition requested by the School District can be required for developments.
Approval of this short plat shauld include conditions requiring that provisions for appropriate
facilities be in place prior to recording the final short plat in the form of a written agreement
between the owner and the school district.
13. The proposed short plat has direct access to public right of way at Alki Avenue. No sidewalks
were required by the County Engineer for this proposal.
14. Recognizing the recommended conditions and Spokane County development standards, the
proposed short subdivision makes appropriate provisions for the public health, safety and
general welfare and that the public use and iriterest will be served by platting the subciivision.

The subdivisioa proposal is generally consistent with RCW 58.17 and the County subdivision
re,gulatians, promoting the public health, safety and general welfare in accordance with
standards established by the state and Spokane County. The Planning Department has
considered the provision of adequate public facilities as cited in RCW 58.17.110 (2). More
specificallY:
a. open spaces
b. drainage ways
c. public and/or private rights-of-way
d . transit
e. potable water
f. sanitary waste disposal
g. parkS and recreation faeilities
h . playgrounds
i. schools and schoolgrounds
j . sidewalks
15. Tbe project is exempt firom environmental review under the State Environmental Policy Act
pursuant to WAC 197-11-800 (6) (a).
16. The following facts are also relevant:
a. The proposed Short Plat is a replat of a portion of Lot 5, Block 1, of Garwood
Subdivision of Corbin Addition to Greenacres, which was recarded as a final plat on
September 14, 1946.
b. One storage structure, detached, private, is permitted inside the Urban Impact Area (UTA)
boundary, limited in area to 1,500 square feet and provided setbacks and maximum building
covera►ge standards are met.
c. The Urban Residential-3.5 (iJR-3.5) zone does allow duplexes for lots which are twice
the minimum lot size required for single family units or 20,000 square feet. Lot "B" has the
potential for a duplex.
d. This proposal was received by the Planning Deparnnent prior to January 1,1994 and the
irnplementation of new Washington State Board of Health regulations on the use of on-site
sewage disposal systems.
DECISTON
Based upon the above noted Findings of Fact and Conclusions, Short Plat Application SP-943-93
is hereby APPROVED until April l, 1997, subject to conditions noted below. Most of the
conditions of approval shall be accomplished by the applicant and/or sponsor prior to finalization
of the short subdivision. This decisioa is final unless appealed in wnang, consistent with adopted
appeal procedur+es.
COUNTY PLANNING DEPARTMENT CONDITIONS
1. All conditions imposed by the Planning Department shall be binding on the "Applicant",
which term shall include the owner or owners of the property, heirs, assigns and successors.
2. The proposal shall comply with the Urban Residential-3.5 (UR-3.5) zone as amended.
3. The final plat shall be desigaed substantially in confarmance with the preliminary plat of
recard. No increase of density or number of lots shall occur without a change of condition
application submittal and approval.
4. The Planning Director/designee shall review any proposed final plat to ensure compliance with
these Findings and Conditions of Approval.
5. The preliminary plat is given conditional approval for three (3) years, specifically to April l,
1997. The applicant may request an extension of ti.me by subuutting a written request
appraxunately forty-five (45) days prior to the above expiration date.

8. Appropriate road name(s) shall be ind.icated.
9. The final plat map shall indicate by a clear, dashed line the required yani setbacks from all
private, "Tract X" or public roads. The dedication shall contain the following statement:
"Side yard and rear yaxd setbacks shall be determined at the time building permits are
requested unless these setbacks are specifically drafted on this final plat The setbacks
indicated on this plat may be varied from if proper zoning approvais are obtained."
10. A plan for water facilides adequate for domestic service and fire protection shall be approved
by the water purveyor, appropriate fire protection district, County 1?ivision of Boildings and
County Health District. The agencies wili certify on the Water Plan, priar to the filing of a
final plat, that the plan is in confoimance with their respective needs and regulations. The
Water Plan and certification shall be draftted on a transparency suitable for reproduction and be
signed by the plat sgonsor.
11. The water purveyor shall certify that appmpriate contractual anangements and schedule of
unprnvements have been made with the plat sponsor for construction of the water system in
accordance with the approved Water Plan. The time schedule shall provide for completion of
the water system and inspection by the appropriate health authorities prior to application for
building perrmits within the final plaL The arrangements or agreements shall include a
provision holding Spokane County and the purveyor harmless fram claims by any lot
purchaser refused a building permit due to the failure of the subd.ivision sponsor to
satisfactorily complete the approved water system.
12. The final plat dedication shall contain the following statement:
"The public water system, pursuant to the Water Pla.n approve.d by county and state health
authorities, the local fire prot,ection district, water purveyor and Spokane County Division of
Buildings, shall be installed within this subd.ivision, aad the applicant shall provide for
individual domestic water service as well as fire protection to each lot prior to sale of each lot
and prior to issuance of a building permit for each lot."
13. No building permit will be issued for any lot within the final plat until certified by a
Washington state-licensed engineer that "the water system has been installed pursuant to the
approved Water Plan for the final plat" including a signed license stamp. The cemfication may
be in the fomn of a letter, but is preferned to be certified on a copy of the Water Plan as a
schematic map showing the "as-built" water system.
14. The Wat,er Plan and the above four (4) conditions of approval regarding the Water Plan may
be waived by the Planning Director/designee upon receipt of letters from the appropriate water
purveyor and fire protection district stating thal° simple conneecions to an existing, approved
water system will pnovide adequate domestic and fixe protectioo water to ensure the public
health, safety and general welfare.
15. The owner shall negotiate with the County Parks Department and submit a recorded copy of a
voluntary agreement making provisions for public parks prior to finalization and recording of
the plat. 1'he agreement shall provide a written description of the subject property to which the
agreement applies and aLso state the dollar amount aad any other agreed to mitigating
measures.
The owaer shall also notify any potential purchasers who have made an agreement to purchase
groperty within said plat pursuant to the Revised Code of Washington (RCW) 58.17.205, that
adequate provisions for park facilities must be made conditioned on a future agreement
between the plattor and Spokane County Parks DepartmenL
Voluntary agreements between the owner and Spokane County Parks Department shall
conform to the requirements of RCW Chapter 82.02.
16. The owner shall negotiate with Cebtral Valley School District and submit a recorded copy of a
volnntary agreement making provisions for public schools prior to finalization and reconding
of the plat. The agreement shall provide a written description of the subject pmperty to which

the agreement applies and also state the dollar amount and any other agreed to mitigating
measures.
The owner shall also notify any potential purchasers who have made an agreement to pwnchase
property within said plat pursuant to the Revised Code of Washington (RCW) 58.17.205, that
adequate provisions for scbool facilities must be made conditioned on a future agreement
between the plattor and schooi district.
Voluntary agreements between the owner and school district shall conform to the requirements
of RCW Chapter 82.02.
17. A survey is required prior to the filing of a final plat.
18. Prior to filing of the final plat, each lot shall be addressed in accorda.nce with RCW
58.17.280.
COUNTY DIVISION OF ENGINEERING AND ROADS CONDITI4NS
1. The conditional approval of the plat is given by the County Engineer subject to dedication of
right-of-way and approval of the road system as indicated in the preliminary plat of record.
2. No construction work is to be perfotmed within the existing or praposed public right-of-way
until a pernut has been issued by the Counry Engineer. All work is subject to inspection and
approval by the County Engineer.
3. Individual driveway access permits are required prior to issuance of a build.ing pernut for
driveway appraaches to the counry road system.
4. Ded.ication of ZO feet of additional right-of-way along Broadway Avenue is required.
5. Dedication of 5 feet of additional right-of way along Alki Avenue is required.
b. Existing county roads providing direct access to the plat shall be paved and/or curbed to
Spokane County standards.
7. The word "applicant" shall include the owner or owners of the property, his heirs, assigns and
successors.
8. To construct the road improvements stated herein, the applicant may, with the approval of the
County Engineer, join in and be a willing participant in any petition or resolution which
purpose is the formaiioa of a Road Improvement District (RID) for said improvements,
pursuant to RCW 36.88, as amended. At such time as an RID is created or any Road
Improvement Project is sanctioned by Spokane County, the improvements required (curb,
sidewalk, drainage control and paving to existing pavement) will be at the sole expense of the
undersigned owner(s), their heirs, grantees and assigns. This provision is applicable to
Broadway Avenue and Alki Avenue.
9. As an alternarive raethod of constructing the road improvements stated herein, the applicant
may, with the approval of the County Eagineer, accomplish the road improvements stated
herein by joining and participating in a County Road Project (CRP) to the extent of the
required road improvements. At such time as an RID is created or any Road Improvement
Project is sanctioned by Spokane County, the improvements required (curb, sidewalk,
drainage control and paving to exisang pavement) will be at the sole expense of the
undersigned owner(s), their heirs, grantees and assigns. This provision is applicable to
Broadway Avenue and Alki Avenue.
10. The following statement shall be placed in the plat dedication:
"The owner(s) or successor(s) in interest agree to authorize the County to place their name(s)
an a petition for the formation of a Road Improvement District (RID) by the pedtion method
pursuant to Chapter 36.88 RCW, which petition includes the owner(s)' property, and further
not to object, by the signing of a ballot, to the formation of an RID by thc resolution method
pursuant to Chapter 36.88 RCW, which resolution includes the owner(s)' property. If an
RID is fomaed by either the petition or resolution method as pmvided for in Chapter 36.88
RCW, the owner(s) or successor(s) further agree:

(a) that the improvement(s) or construction contemplated within the proposed RID is
feasible;

(b) that the benefits to be derived from the formation of the RID by the property included
therein, together with the amount of any County participation, exceed the cost and expense of
formation of the RID; and
(c) that the property within the proposed RID is sufficiendy developed.
Provided further that the owner(s) or successor(s) shall retain the right, as authorized under
RCW 36.88.090, to object to any assessment(s) on the property as a result of the
improvements called for in coajunctioa with the formation of an RID by either petition or
resolution method under Chapter 36.88 RCW, and to appeal to the Superior Court the
decision of the Board of Counry Commissioners aiffirming the final assessment roll.
It is further agreed that at such time as an RID is created or any Road Improvement Project is
sanctioned by Spokane County, the improvements required (curb, sidewallc, drai.nage control
~ and paving) will be at the sole expense of the undersigned owner(s), their heus, grantees and
assigns without participation by Spokane County.
The RID waiver contained in this agreement shall expire after ten (10) years from the date of
execution below. However, the owner(s) or successor(s) agree that if said RID waiver
expires without construction of the required improvements, the owner(s) or successar(s) agree
to construct the required improvements at their own expense, pay to Spokane County ttie then
estimated cost of the required improvements to enable the County to complete the same, or
furnish a bond or other secure method suitable to the County (which may include the

13. The proposed subdivision shall be unproved to the standards set forth in Spokane County
Board of Gommissioners Resolution No. 80-1592, as amended, which resolution establishes
regulations for roads, approaches, drainage and fees in new construction.

impact of this proposal upon the existing county road system warrants the dedication of
additional right-of-way and the roadway improvements herein specified

5. Water service shall be by an existing public water supply when approved by the Regional
Engineer (Spokane), State Deparnnent of Health.
6. Prior to filing the final plat, the sponsor shall demonstrate to the satisfaction of the Spokane
County Health District that an adequate and potable water supply is available to each tract of
tbe plat.
7. Prior to filing the final pIat, the sponsor shall present evidence that the plat lies within the
recorded service azea of the water system proposed to serve the plat.
8. Prior to filing tbe final plat, the sponsor shall demonstrate to the satisfaction of the Spokane
County Health District that suitable sites for on-site sewage disposal systems are available on
lot "B,'.
9. Subject to specific apglication approval and issuance of pennits by the Health Officer, the use
af individual on-site sewage disposal systems may be autharized.
lU. The dedicatory language of the plat will stnte: "Subject to specific application appraval and

12. The plat dedication shall contain a statement to the effect that: "The public water syst+em,

protection district, water purveyor and County Division of Buildings, sball be installed within
this plat, and the applicant shall provide for individual domesric water service as well as fire
protection to each lot prior to sale of each lot and priar to issuance of a building permit for

COUNTY DIVISION OF UTILTTIES CONDITIONS
1. Pursuant to the Board of County Comnussioners Resolution No. 80-0418, the use of on-site
sewer disposal systems is hereby authorized. This authorization is conditioned on compliance
with all rules and regulations of the Spokanc County Health District and is further condidoned
and subject to specific application approval and issuance of petmits by the Health District.
2. The dedication shall state:
"The ownes(s) or successor(s) in interest agree to authorize the County to place their name(s)
on a petition for the formation of ULID by petition method pursua.nt to RCW 36.94, which
perition includes the owner(s)' property; and further not to object by the signing of a protest
petidon against the formation of a ULID by resolucion method pursuant to RCW Chapter
36.94 which includes the owner(s)' property. PROVIDED, this condirion shall not prohibit
the owner(s) or successar(s) from objecting to any assessment(s) on the prope°rty as a result of
unprovements called for in conjunction with the formation of a ULID by either petition or
resolntion method under RCW Chapter 36.94."
3. Any water service for this project shall be provided in accordance with the Coordinated Water
System Plan for Spokane County, as amended.
4. The dedication shall state: "Each new dwelling unit shall be double-plumbed for connection to

E22 That the following statement shall appear within the dedicatory language
of the final plat:
The owner(s) or successor(s) in interest agree to authorize Spokane

sole expense of the undersigned owner, their heirs, grantees and
assiqns without participation by Spokane County.
The RID waiver contained in this agreement shall expire after ten
(10) years from the date of execution below. However, the owner(s)
or successor(s) agree that if said RID waiver expires without
construction of the required improvements, the owner(s) or
successor(s) agree to construct the required improvements at their own
expense; pay to Spokane County the then estimated cost of the required
improvements to enable the County to complete the same; or furnish a
bond or other secure method suitable to the County (which may include
the execution of another RID waiver agreement), providing for or
securing to the County the actual construction of the improvements.
