Basis of Design of Storm water System
1.00 Introduction
The iatent of this design brief is to determine the peak storm water runoff resulting from the
development a thrze lot subdivision located south of 12' Avenue and east of Marigold Street in
Spokane County, Washington (SE~! , Section 23, T 25N, R44E WM). (See attached Project Location
Sheet).
2.00 Drainage Area Summary
The praject area slopes generally from the east to the west and consists of an existing residence, open
meadow/pasture land; and several outbuildings. The proposed development proposes to keep the
exiscing residence intact. This residence is currentty accessed from 12' Avenue. The remaining two
tots will be developed from the land remaining to the south and are proposed to be accessed from an
extension of 13°' Avenue off Marigold Street. In accordance with the facts of findings, no paveci
roadway construction is proposed at this time.
Based on topographical data as well as a field visit, it does not appear that any significant offsite flows
enter the project site.
Soils in the area consist of Garrison Very Stony Loam (GmB) and is shown on the attached SCS soils
map for Spokane County, Washington.
3.00 Summary of Storm water Calculations
Attached are wotksheets which determine the peak storm water runoff for Pre and Post-Development
conditions for each Basin as well as for the entire project. In each case, the rational method (Q=CIA)
is used to determine the peak stormwater runoff based on a 10 year design frequency. The time of
concentration (Tc) for each case is determiaed using the method outlined in the "Guidelines for Storm
water Management", Spokane County, WA. Using the Intensity-Duration Curve for the Spokane area,
the carrespanding intensity (I) is determined for each time of concentration.
Using the surface types and areas existing and anticipated within the drainage basin, a weighted ntnoff
coefficient (C) is calculated for each drainage basin.
The determined peak IUYR stocmwater runoff (Qpeak) for the overall project area is 0.69 cfs (pre-
development) and 0.60 cfs (post development). This change nccurs primarily due to the change in
surface cover from a meadow and pasture land to a lawn. This surface has a lower coefficient of
runoff (C) which reduces the weighted CA for the basin(s). A summary of the pre and post
development runoff for eacb lot as well as the entire project are sununarized below.

The calculations indicate that the post development flows for the proposed basias A, B. and C are less
than or equal to the pre-developinent runoff. Basia D calculations indicate that post developmeat flows
will be apProximately .02 cfs greater than pre-development flows. This is considered negligible.
Because the calculated post development flows are less than or equal to the pre development flows and
since no roadway construction is anticipated as part of this project, no '208' swales or stortnwater
disposal structures are proposed. At such time that 13' Avenue is extended and paved, the necessary
`208' swales and disposal structures will have to be designed and installed.
Even tllough no new roadway construction is proposed with the development of this property, the
grading of the stormwater runoff from each roaf area and driveways should be graded toward grassed
areas where possible to achieve some level of stormwater treatment.

During conscruction on the southern two lots, the inlets of the existing stormwater catch basins located
on 13' Avenue should be protected from siltatioa by installing siIt fencing and/or hay bale check dams
both around the structures and on the lots.
4.00 Summary/Conclusions
The storm water runoff generated by post-development conditions of the project site will generally
result in flows that are lewss than or equal to pre-devetopment conditions. The only exception is in Basin
D which will have a negligible increase of .02 cfs (9 gpm) during a 10 year event.
In addition, no paving is proposed for this project.
For the above two reasons, no stormwater disposal system or `208' pond is required or proposed for
this project. At such a time that 13' Avenue is extended and paved, the necessary `208' swales and
stormwater disposal system(s) will have to be designed and constructed.

There may be a need in the future to construct a public road to serve the lands herein described.
Said road shall be constructed in accordance with the then adopted Spokane County Road
Standards for public roads. Said road to foltow, as near as practicable, the existing County road
right of way.
If additional right of way is required, the owners, their heirs and/or assigns agree to deliver to
Spokane County a properly signed and executed Right of Way Deed covering the required
additional right of way.
The owners or successors in interest agree to authorize Spokane County to include the below

If an RID is proposed for improvement of the road(s) described below, said owners and
successors further agree: (1) that the improvements or construciion contemplated within the
proposed RID are feasible, and (2) that the benefits to be derived from the formation of the RID
by the property included therein, together with the amount of aay County participatioa, exceed
the cost and expense of formation of the RID, and (3) that the property within the proposed RID
is sufficiently developed; provided, the owners or successors shall retain the right, as authorized
under RCW 36.88.090, to object to any assesstflent(s) on the property as a result of the
unprovements called for in conjunction with the formatioa of a RID by either the petition or
resolution method under Chapter 36.88 RCW and to appeal to the superior court ihe decision of
the Board of County Commissioners confuming the final assessment roll; provided further, it is
recognized that actual assessments may vary from assessment estimate so long as they do not
exceed a figure equal to the increased true and fair value the improvement add to the property.
By allowing a building permit to be issued on property having access from an unmaintained
Counfiy road, Spokane County assumes no obligation for said road, and the owners hereby
acknowledge that the County has no obligation of any kind or nature whatsoever to establish,
exami.ne, survey, construct, alter, repair, improve, maintain, provide draiaage or snow removal
on said road. The requirement is and shall run with the land and sha11 be binding upon the
owners, their heirs, successors or assigns, until said road is improved to Spokane County Road
Standards and accepted by the County for maintenance. ~

The undersigned owners, their heirs, successors or 'assigns hereby release Spokane County, and ~
atl its bfficers, employees and agents from any responsibility or liability for any damage
whatsoever to ihe hereinabove described lands and improvements thereon as a result of allowing
a building permit to be issued on property which is served by a unmaintained County road.

OF TIME FOR SP-984-94, AN APPROVED ) CUNCLUSIONS AND
PRELIMINARY SHORT PLAT ) DECISION
THIS MATTER, a requesi for an extension of time from Floyd L. Wakefield has been r►eceived and was
decided upon, pursuant to the Spokane County Subdivisian regulations, on the 22nd day of Jnnuary,
1998.
FINDINGS OF FACT AND CONCLUSIONS
1. The individual signing below has been properly detegated the responsibility far rendering tliis
decision by the Director of Spokane County Division of Building and Planning.
2. The proposal was to divide approximately 10 acres into 2 tracts for 1 exisring single family
residence and 1 new additiona) residential tract.
3. The subject preliminary short plat was approved by Spokane County Planning Department on
December 7, 1994. '
4. The proposal is located at the northeast corner of Wagon Road and Russel Road, in the NW %4 of
Section 2, Township 27 North, Range 43 E.«I.M., Spokane County, Washington.
5. The existing zoning of the property is Semi Rural Residential-5 (SRR-5), which has remained the
same since the original preliminary sUort plat approval.
6. The proposal is tocated in an area designated as Urban by the Spokane County Comprehensive
Plan, which has remained the same since the original prelimmary suort plat approval.
7. The property is located outside Spokane Gounty's Interim Urban Growth Areas (IUGA),, which
were adopted on April 8, 1997 by the Board of County Commissioners. However, this proposal
was given preliminary approval on December 7, 1944, prior to the adoption of the ILJGA and
Interim Development Regulations.
8. Spokane County has estabtished specifie criteria for considering the ea~tension of time for the
expiration of preliminary plats, short piats, or binding site plans. These critcria arc f4und in
Chapter 12.100.118 (Extension of Time) of the Spokane County Subdivision Ordinance and have
been used as a basis for this decision. The follow-ing is the relevaat section of Chapter 12.100.118:

9. In response to the above, a proposed final short plat was received by the Division of Building and
Planning prior to this request for an extension of time. Moreover, the proposal still conforms to
the existing zoning and comprehensive plan designation. Therefore, this request for an extension
of time, as conditioned, represents no significant change in the approved original preliminary short
plat and will not be adverse to the public health, safety and general welfare.
10. Those agencies of jurisdiction having a potentiai interest in the proposed short plat were natified
and commeats solicited. No updated conditions were received or recommended by the various
reviewing agencies.
11. This is the first reyuest for a time extension. The total life of the preliminary short plat bas been
approaimately 3 years.
12. The applieant should show substaatially greater progress toward complying with Chapter
12.100.118 (Extension of Time) of the Spokane Counfiy Subdivision Ordinance before requesting
an additional extension of time.
13. All previous Findings of Fact and Conclusions still apply, except as noted above.
DECISION
Based upon the above Findings of Fact and Conclusions, an extension of time request for SP-984-94 is
hereby APPROVED for three (3) years, specifically until January l, 2001. All conditions imposed shall
be binding on the "Applicant," whicb term shall include the owner or owners of the property, heirs,
assigns and successors. This decision is fmal unless appealed in writing, consistent with adopted appeal
pcocedures.
CONDITIONS OF APPROVAL
A11 previous imposed Conditions of Approval specified in the Spokane County Planning Department's
Findings of Fact, Gonclusion and Decision of December 7, 1994 still apply, together with the following
updated conditions:
SPOKANEi COUNTY DIVLSION OF BUILDING AND PLANNING (UPDATED)
1. 'Tliis time eYtension is approved until January l, 2001. The applicant may submit another
extension of time at leasi thirty (30) days prior to the above expiration date. However, any
subsequent request for extension of time shall only be approved upon a finding of substantial
compliance with Chapter 12.100.118 (Extensions of Time) of the Spokane County Subdivisian
Ordinance; otherwise the preliminary short plat approval will become null and void.
2. Prior to recording the final short plat, the applicant shall provide four (4) current Gertificates of
Title to the Division of Building and Planning.
3. The applicant shail contact the Division of Building and Planning at the earliest possible stage in
order ta be informed of code requirements administered/enforced as authorized by the State
Buitding Code Act. Design/development concerns include: addressing; fire apparatus access
roads= fire Iiydranbflow; approved water systems; building accessibility; construction type;
occupancy classification; exiting; exterior wall protection; and energy code regulations.
4. Appropriate road name(s) and street address for each tract shall be indicated on the fmal short plat
map.

Standard Drainage Language for Short Plats
Spokane County, May 1997
The property o«uers Evithin t}us plat shall be held ressponsible for keeping open and maintaining the surface
path of aatural or man-made drainage flow over aad across their respective properties. If the property
owner(s) fails to maintain the surface path of rlatural or man-made drainage flow, or the drainage swale, a
notice of such failure may be given to the property owner(s). If nat cornected within the period iadicated on
said notice, Spokane County has the right to cornect the maintenance failure, or have it corrected, ai the
expense of the property owner.
Any naiural drainage Ghannels, craeks with intemuttent or constaat flow, or weU-defined natural draws
periodically subject to concentrated flow of storm%%rater, shall be placed writhin an easement granted to
Spokane County. No buildings shall be constructed within the easement, and no fill placed within the
easemeni -vrithout the expressed written oonsent of the Spokane County Engineer. The easemcnt shaU be of
sufficient width to encompass the stormwater flow width and allow for emergency maintenanoe, but in ao
case shall the easement be lcss than 10 ft. in width.
There may exist properties located uphill aad adjacent to this subdivision %tiiiich periodically discharge
stormwater runoff onto individual lots -vvithin this plat. Runoff from nearby uphill properties should be
expected, and during sno«melt periods or wet seasons the lots may be subjected to higher amounts of
storm«°ater runoff that what is nornnally observed or anticipated. Becausc stormwater runoff from adjacent
pmperties have discharged onto this plat prior to development, stonmwater runoff wyll likely continue to do so
after develnpment. It is the responsibility of the individual lot ovmers to maintain el.isting surfaoe paths of
runoff through their respective lots and to grade the lots in accordance with applicable rules and regulatians,
so as to prevent property damage.
Anv building that is constructed on a lot in this plat shall be set at such an elevation so as to provide positive
drainage away from any drainagc entry poiat to the building (including but not limited to a window wcll, a
window unprotected by a window %vell, or a doommy). Sa.id positive drai.aage shall consist of a n~inimum
slopc of 3% away from the building for a distanoe of at lcast 10 feet from the building. 'Ihe lots shall be
graded so thai either a) all nuioff is routed away from the bwlding, and oonveyed over the lot to a natural
drainage siva.le or approved drainage facility, or b) drainage i.ateroepted on the lot is disposed of on the lot in
an approved drainage facility. The approved drainage facility shall be constructed in accordance with any
applicable aceepted plans on file at the County Engineer's Office. Any revisioas to the accepted drainage
plans must be accepted by the County Engineer's Office prior to construction of said revisions.
Applicable to Short Plats Within the ASA
This short plat is located within the Aquifer Sensitive Area (ASA). Treatment of storm runoff
from driveways shall be provided. The preferred method of treatment is to have the runoff from
driveways sheet flow over lawn turf or native-type grasses. If a ditch is to be used to collect
runoff from driveways, thea the ditch is to be grass-lined.

The Spokane County Engineering Department has reviewed ihe above referenced application. The following
"Conditions of Approval" are submitted to the Spokane County Planaing Department for inclusion in the
"Findings of Fact, Conclusions and Order/Decision" for the Extension of Time/Change of Condition Request.
1. That conditional approval of the plat by the County Engineer i9 given
subject to dedication of right-of-way and approval of the road system
as indicated in the preliminary plat of record.
2. That drainage plans and design calculations showing the alignment of
drainage facilitiea be submitted to the County Engineer for acceptance
prior to construction and/or the filing of the final plat. Drainage
plans to be prepared under the direction of a licensed Professional
Civil Engineer.
3. No construction work is to be performed within the existing or proposed
Public right-of-way until plans have been accepted by the County
Engineer and a permit has been issued by the County Engineer. All work
is subject to inspection and approval by the County Engineer.
4. All construction within the existing or proposed Public right-of-way is
to be completed prior to filing the final plat or a bond in the amount
estimated hy the County Engineer to cover the cost of construction of
improvements. Construction certification, "Record Drawings" and
monumentation of the street centerlines shall be filed with the County
Engineer.
5. Approach Permits are required for any access to the Spokane County road
system.
6. Dedication of 10 feet of additional right-of-way along Twelfth Avenue.

7. Dedication of 50 feet of additional right-of-way for the extension of

8. The applicant shall grant applicable border easements adjacent to
Spokane County Right of Way per Spokane County Standards.
9. The following statement(s) shall be placed in the dedicatory language
of the f inal plat :
10. To construct the road improvements stated herein, the applicant may,
with the approval of the County Engineer, join in and be a willing
participant in any petition or resolution which purposes is the
formation of a Road Improvement District (RID) for said improvements
pursuant to RCW 36.88, as amended. At such time as an RID is created
or any Road Improvement Project is sanctioned by Spokane County, the
improvements required (curb, sidewalk, drainage control and paving to
existing pavement) will be at the sole expense of the undersigned
owner, their heirs, grantees and assigns. This provision is applicable
to Twe 1 f th Avenue and 13 th Avenue.
11. As an alternative method of constructing the road improvement stated
herein, the applicant may, with the approval of the County Engineer,
accomplish the road improvements stated herein by joining and
participating in a County Road Project (CRP) to the extent of the
required road improvement. At such time as an RID is created or any
Road Improvement Project is sanctioned by Spokane County, the
improvements required (curb, sidewalk, drainage control and paving to
existing pavement) will be at the sole expense of the undersigned
owner, their heirs, grantees and assigns. This provision is applicable
to Twe 1 f th Avenue and 13 th Avenue.
12. That the following statement shall appear within the dedicatory
language of the final plat:
That in consideration of Mutual Benefits now or to be hereafter
derived, do for themselves, their heirs, grantees, assigns and
successor(s) in interest hereby request and authorize Spokane County to
include the above descri.bed property in a Road Improvement District
(RID) and to support the formation of a Road Improvement District for
improvement of the road(s) described below by requesting and
authorizing Spokane County to place their name(s) on a petition for the
formation of a Road Improvement District pursuant to RCW 36.88.050, or
by requesting and authorizing Spokane County to cast their ballot in
favor of a RID being formed under the resolution method pursuant to RCW
36.88.030, and/or by not filing a protest against the formation of a
RID being formed under the alternative resolution method provided for
in RCW 36.88.065 and Chapter 35.43 RCW.

If a RID is proposed for improvement of the road(s) described below,
said owner ( s) and successor (s) further agree :(1) that the improvements
or construction contemplated within the proposed RID are feasible and
(2) that the benef its to be derived f rom the forcnation of the RID by
the property included therein, together with the amount of any County
participation, exceeds the cost and expense of formation of the RID,
and (3) that the property within the proposed RID is sufficiently
developed; provided, themselves, their heirs, grantees, assigns and
successor(s) shall retain the right, as authorized under RCW 36.88.090,
to object to any assessment(s) on the property as a result of the
improvements called for in conjunction with the formation of a RID by
either the petition or resolution method under Chapter 36.88 RCW and to
appeal to the Superior Court the decision of the Board of County
Commissioners confirming the final assessment roll; provided further,
it is recognized that actual assessments may vary from assessment
estimate so long as they do not exceed a figure equal to the increased
true and f air value improvement ( s) add ( s) to the property.
It is further acknowledged and agreed that at such time as a RID is
created or any County Road Improvement project is authorized by Spokane
County, the improvements required shall be at the sole expense of the
owner(s) of property within thz RID or served by the improvements
without any monetary participation by Spokane County.
The RID waiver contained in this agreement shal l expire af ter ten (10)
years from the date of execution below. This provision is applicable
to Twel f th Avenue and 13 th Avenue.
13. The County Engineer has designated a Local Access Roadway Section for
the improvement of Twelfth Avenue which is to be constructed within the
proposed development. This will require the installation of 7-9 feet
of asphalt. The construction of curbing is also required.
14. The County Engineer has designated a Local Access Roadway Section for
the improvement of 13`h Avenue which is adjacent to the proposed
development. This will require the addition of approximately 30 feet
of asphalt along the frontage of the development. The construction of
curbing and sidewalk is also required.
15. The proposed plat shall be improved to the standards set forth in
Spokane County Board of Commissioners Resolution No. 95-0498, a9
amended, which establishes regulations for roads, approaches, drainage
and fees in new construction.
16. The County Engineer has examined this development proposal and has
determined that the impact of this proposal upon the existing County
Road System warrants the dedication of additional Right of Way and the
roadway improvements herein specif ied.

Public No.4" which allows the construction of a private driveway in the

gravel standard and is not required to be paved at this time. The
applicant shall also make application to cross the 1 foot strip at the
end of 13 `h Avenue prior to f il ing of the f inal plat.

THIS MATTCR, an application for subdivision of land, from Larry & Mary Honegger has been
received and decided upon, pursuant to Spokane County Subdivision regulations, on April
1994.
FINDINGS OF I+'ACT AND CONCLUSIONS
1. The individual signing below has further been properly delegated the responsibility for
rendering the decision by the Spokane County Director of Planning.
2. The proposal is to divide approximately 1 ac;re into 3 lots for 1 existing single fttrnily residence
and 2 additional residendal lots and those uses permitted in the underlying zone.
3. The proposal is generally located 220 feet east of the intersection of Marigold Street and 12th
Avenue in the SE 1/4 of Section 23, Township 25 North, Range 44 E.W.M. Spokane
County, Washington.
4. The existing zoning of the property described in the application is Urban Residential-3.5 (UR-
3.5), previously established as Agricultural (A) (file # 60-42) zoning in 1942 and redesignated
to UR-3.5 on January 1, 1991, pursuant to the Prognam to Implement the Spokane County
Zoning Cade. Pursuant to RCW 58.17.195 the proposal does eonform to the requirements 4f
the existing UR-3.5 zone.
5. The Spokane County Comprehensive Plan designates this area as Urban. The development
and uses proposed are generaUy in accord with this category.
6. Surrounding uses are primarily single family residences on mixed urban size lots and open
space. Adams Elementary School, Central Valley High School and Evergreen Junior I4igh
School are located within approximately 1!8 mile radius af the site.
7. The required public noace was provided for this proposal and agencies Ilaving a potential
interest in the project were notified and recommendations solicited.
8. Written comments were received from mi adjaining property owner regarding increased traffic
and limited visibility. Marigold Street, a local accesS street, has adequate design and as-built
capacity to accommodate the additional trafffic which may be generated. There are no "clear
view" restrictions at the interSection of 13th Lane and Marigold Street.
9. The site is located within the Public Transportation Benefit Area (PTBA). The Spokane
Transit Authority (STA) Valley/24th Avenue Route # 21 and Valley/32nd Avenue Route # 22
provides connecting services to the site via the Pence-Cole Valley Trinsit Center.
10. The proposed short plat will be served by a public water system. Waste water disposal will be
as authorized by the Director of Uulities.
11. The Spokane County Parks Department has commented on the proposed short plat. The
Parks Department has requested a voluntary agreement be completed between the Parks
Department and the property owner to mitigate impacts to the County Park systetn. County
legal counsel has indicated such agreements may be required. The Spokane County Alammng
Department r+ecommends the property owner negotiate with the Spokane County Parks
Department to provide for appropriate capital facilities as required by the Revised Code oi'
Washington (RCW) 58.17.110. Approval of this short plat should inclucie conditions
requiring that provisions for appropriate facilitics be in place prior to recarding this final piat in
the form of a writcen agreement between the owner and the Spakane Caunty Parks
Department.
12. The Cenual Valley School District No. 356 has commented on the proposeci Short Plat. 'I'he
District has indicated that existing school facilities are inadequate to serve the proposed short
plat and wishes ta negodate with the owner to provide adequate capital facilities as required by
the Revised Code of Washington (RCW) 58.17.110. Review by County legal counsel
indicates the condition requested by the School Distriet can be required for developments.
Approval of this short plat should include conditions requiring that provisions for appropriate
facilities be in place prior ta recording the final short plat in the farm of a written agreement
between the owner and the school district.

13. The proposed short plat has direct access to pubiic right of way at 12th Avenue. Thirteenth
Avenue will be extended to the east to serve Tracts B& C and the adjacent Hiliberry property
within the preliminary short plat SP-911-93, approved March 16, 1994. No sidewalks were
requested by the Counry Engineer regarding this proposal.
14. Recognizing the recommended conditions and Spokane County development standards, the
praposed short subdivision makes appropriate provisions for the public health, safety and
general welfare and that the public use and interest will be served by platting the subdivision.
The subdivision proposal is generally consistent with RCW 58.17 and the County subdivisioQ
regulations, promoting the public health, safety and general welfare in accordnnce with
standards established by the state and Spokane County. The Planning Department has
considered the provision of adequate public facilities as cited in RCW 58.17.110 (2). More
specifically:
a. open spaces
b. drainage ways
c. public andlor private rights-of-way
d. transit
e. potable water
f. sanitary waste disposal
g. parks and recreadon faciliries
h . playgrounds
i. sthpolt and schoolgrotinds
j . sidewalks
15. The project is exempt from Environmental review under the State Environmental Palicy Act
pursuant to WAC 197-11-8()() (6)(a).
16. The following facts are also relevant:
a. The proposed Short Plat is a replat of Lot "B" of Short Plat 82-214, which was recorded
as a final plat an December 14, 1982.
b. One storage stnicture, detached, private, is permitted inside the Urban lmpact Area (LJIA)
boundary, limited in area to 1,500 square feet and provided setbacks and maximum
building coverage standarris are met.
c. Subdivision of properry should not allow the creation of nonconforming setbacks i'or
existing structures. Compliance with setback standards in the UR-3.5 zone may require
either an adjuscment of the property lines ar removal of the potential nonconforming
structure.
DECISIqN
Based upon the abave noted Findings of Fact and Conclusions, Short Plat Application SP-948-94
is hereby APPROVED until April 1, 1997, subject to condirions noted below. Most oE tile
conciitions of approval shall be accomplished by the applicant and/or sponsor prior to rnalization
of the short subdivision. This decision is final unless appealed in writing, consistent with adopted
appeal procedures.
COUNTY PLANNING DEPARTMENT CONDITIqNS
1. All canditions imposed by the Planning Department shall be binding on the "Applicant",
which term shall include the owner or owners of the property, heirs, assignS and successors.
2. The proposal shall comply with the Urban Residential-3.5 (UR-3.5) zone as a.mended.
3. The final plat shall be designed substantially in conformance with the preliminary plat of
record. No increase of density ar number of lots shail occur without a change of conditian
apptication submittal and approval.

4. The Planning Director/designee shall review any proposed final plat to ensure complianCe with ~
these Findings and Condidons of Approval.

5. The preliminary plat is given conditional approval for three (3) ye,ars, specifically to May 1,
1997. The applicant may request an extension of time by submicting a written request
approximately forty-five (45) days prior to the above expiration date.
6. Three (3) current certificates of title shall be furnished to the Planning Department prior to
filing the final plat.
7. Appropriate ucility easements shall be indicated on copies of the proposed final plaL Written
approval of utility easements by appropriate uality companies shall be received with the
submittal of the final plat.
8. Appropriate road name(s) shall be indica(ed.
9. The final plat map shall indicate by a clear, dashed line the required yard setbacks from all
private, "Tract X" or public roads. The dedication shail contain the following statement:
"Side yard and rear yard setbacks shall be determined at the time building permirs are
r+equested unless these setbacks are specificAlly drafted on tbis final plat. 7'he setbacks
indicated on this plat may be varieti frdm if proper zoning approvals are obtained."
10. A plan for water facilities adequate for domesac service and fire protecrion shall be approved
by the water purveyor, appropriate fire pratection district, County Division of Buildings and
County Health District. The agencies will certify on the Water Plan, prior to the filing of a
final plat, that the plan is in conformance with their r+espective needs and regulaaons. The
Water Plan and certificadon shall be draf'ted on a transparency suitable for reproductian and be
signed by the plat sponsor.
11. The water purveyor shall certify that appropriate contractual arrangements and schedule of
improvements have been made with the pl:it sponsor for construction of the water system in
accordance with the approved Water Plan. The rime schedule shall provide for compledon of
the water system and inspecdon by the appropriate health authorities prior to application for
building permits widiin the final plat. The arrangements or agreements shall include a
provision holding Spokane County and the purveyor harmless from claims by any lot
, pur+chaser refused a building permit due to the failtue of the subdivision sponsor to
satisfactorily complete the approved water system.
12. The final plat dedication shall contain the following statement:
"The public water system, pursuant ta the Water Plan approved by county and state health
authorities, the loca] fire protecdon disa-ict, water purveyor and Spokane Counry Division oC
Buildings, shall be installed within this subdivision, and the applicant shall provide for
individual domestic water service as well as fire protection to each tracc prior to sale of each
tract and prior to issuance of a building permit for each tract."
13. No building permit will be issued for any lot within the final plat until certified by a
Washington state-licensed engineer that "the water system has been installed pursuant to the
approved Water Plan for the final plat" including a signai license stamp. The certificatian may
be in the form of a letter, but is preferred to be certified on a copy of the Water Plan as a
schemadc map showing the "as-built" water system.
14. The Water Plan and the above four (4) conditions of approval regarding the Water Plan may
be waived by the Planning Director/designee upon receipt of letters from the appropriate water

CqUNTY DIVISI0IV OF ENGINEERING AND ROADS CONDITTONS
1. The conditional approval of the plat is given by che County Engineer subject to dedication of
right-of-way and approval of the rpad system as indicateri in the pr+eliminary plat of record.
2. Plans, profiles, and cross-sections as designed to County standards showing proposed street
centerline and curb grades shall be submitted to the County Engineer for approval prior to
construction and/or the filing af each final plat; road plans to be prepared under the direction of
a licensed Professianal Civil Engineer.
3. Drainage plans and design calculations showing the alignment of drainage facilities shall be
submitted to the County Engineer for approval prior to construction and/or the filing of the
final plat. Drainage plans to be prepared under the directian af a licensed Professional Civil
Engineer. ;
4. No construction work is to be perfornied within the existing or proposed public right-of-way
until a permit has been issued by the County Engineer. All work is subject to inspection and
approval by the County Enbineer.
5. Individual driveway access permits are required prior to issuance of a building pemiit far
driveway approaches to the county road system.
6. 1'he applicant shall dedicate 10 feet of additianal right af way along Twelfth Avenue.
7. Existing county roads providing direct access to the plat shall be paved and/or curbed to
Spokane County standru-ds.
8. The ward "applicant" shall include the owner or owners of the property, his heirs, assigns and
successors.
9. To construct the road improvements stated herein, the applicant may, with the approval of the
Counry Engineer, join in and be a willing participant in any petiaon or rzsoludon which
purpose is the formation of a Road Improvement District (RID) for said improvements,
pursuant to RCW 36.88, as amended. At such time as an RID is createci or any Road
Improvement Project is sanctioned by Spokane County, the improvements required (curb,
sidewalk, drainage control and paving to existing pavement) will be at the sole expense of the
undersigned owner(s), their heirs, grantees and assigns. This provision is applicable to
Twelfth Avenve.
10. As an alternative method of constructing the road improvements stated herein, the applicant
may, with the approva.l of the Count}► Engineer, accomplish the rodd improvements stated
herein by joining and participating in a County Road Project (CRP) to the extent of the

required road improvements. At such time as an RID is created or any Road Improvement
Project is sanctioned by Spokane County, the improvements required (curb, sidewalk,
drainage coatrol and paving to existing pavement) will be at the soIe expense of the
undersigned owner(s), their hei.rs, grantees and assigns. This provision is applicable to
Twelfth Avenue.
11. The following statement shall be placed in the plat dedication:
"The owner(s) or successor(s) in interest agree to authorize the County to place tbeir name(s)
on a peation for the fornQation of a Road Improvement District (RID) by the petition method
pursuant to Chapter 36.88 RCW, which pepdon includes the owner(s)' property, and further
not to object, by the signing of a ballot, to the fonnation of an RID by the resoludon method
pursuant to Chapter 36.$8 RCW, which resolution includes the owner(s)' property. If an
RID is formed by either the petition or resoluaon methad as provided for in Chapter 36.88
RCW, the owner(s) or successor(s) further agree:
(a) that the improvement(s) or construction contemplated within the pmposed RID is
feasible;
(b) that the benefits to be derived from the formation of the R.ID by the property included
therein, together with the amount of any Counry participation, exceed the cost and expense of
formation of the RID; and
(c) that the property within the proposed RID is sufficiendy developed.
Provided further that the owner(s) or successor(s) shall r+etain the right, as authorized under
RCW 36.88.090, to object to any a.ssessment(s) on the property as a result of the
improvements called for in conjunction with the formation of an RID by either petition or
resolution method under Chapter 36.88 RCW, and to appeal to the Superior Court the
decision of the Board of Counry Commissioners affirming the final assessment roll.
It is further agmed that at such time as an RID is created or any Road Improvement Project is
sanctioned by Spokane County, the improvements required (curb, sidewalk, drainage control
and paving) will be at the sole expense of the undersigned owner(s), their heirs, grantees and
assigns without participation by Spokane County.
The RID waiver contained in this agreement shall expire after ten (10) years from the date of
execution below. However, the owner(s) or successor(s) agree that if said RID waiver
expires without canstruction of the required improvements, the owner(s) or successor(s) agree
to construct the required improvements at their own expense, pay to Spokane County the then
escimated cost of the required improvements to enable the County to complete the same, or
furnish a bond or other secure mediod suitable ta the County (which may include the
execution of another RID waiver agreement) providing for or securing to the County the acnial
construction of the improvements.
All of the requirements of this agreement shall run with die land and shall be binding upon the
owner(s), their successor(s) or assign(s)." This provision is applicable to Twelfth Avenue.
12. The County Engineer has designated Typical Roldway Section Number Two, Local Access
Standard for the improvement of Twelfth Avenue, which is adjacent to the proposed
development. 'fhis will require the addition of approximately 7-9 feet of asphalt along the
frantage of the development. The construction af curhing is alsa required.
13. The proposed private road(s) as shown an the preliminary plac serving 2 lots with extension to
serve 8 or fewer lots is apnroved by the County Engineer.
14. Private road(s) shall be improved ta Spokane County standard for an urban private road
standard serving 41ots, and is subject to approval under Section 10.207 of the Spokane
County Fire Code.
15. All vested awners shall sign and record private road documents as prescribed by the Spokane
County Engineer. These documents shall be reviewed and approved by the Spokane County
EnSineer prior to recording with the Spokane Caunty Auditor. Re4ording numbers shAU be '
referenced in the dedicatary language of the plat.
16. The following statement shall be placed in the p1at declicaaQn:
"WARNING: Spokane Coanty has no responsibility to build, improve, maintain ar otherwise

property on a private road, Spokane County assumes no obligaaon for said private road, and

provide drainage or snow removal on a private road. This requirement is and shall run with
the land and shall be binding upon the owner(s), their heirs, successors or assigns, i.ncluding
the obligadon to participate in the maintenance of the private road as provided herein."
17. The proposed plat shall be improved to the standards set farth in Spokane County Board of
Commissioners Resolution No. 80-1592, as amended, which r+esolution establishes
regularions for roads, approaches, drainage and fees in new construction.
18. The County Engineer has examined this development proposal and has determined that the
impact of this proposal upon the existing county road system warrants the dedicaaon of
additional right-of-way and the roadway unpmvements herein specified.
19. The follovving statement shall be placed in the final plat dedication: "The private road as
shown hereon is an easement which provides a means of ingress and egress for those lots
within the subdivisian having frontage thereon."
20. There may exist uriliaes, either underground or overhead, affecting che subjecc property,
including property to be dedicated or set aside for future acquisition. Spokane County
assumes no financial obligation for adjustments or relocation regarding these udlities.
Applicant(s) should check with the applicable utility purveyor and the Spokane County
Engineer to determine whether applicant(s) or the utility is respQnsihle for adjustment ar
reiocation costs and to malce arrangements for any necessary work.
21. The applicant shall provide documeotation to the satisfaction of the County Engineer that the
local fire district will approve a turnaround for the preliminary plat. The Caunty Engineer
shall also review and approve the proPosed turnaround.
22. The applicant shall construct a paved private road along the frontage of the plat within the
Tract "X" easeruent. Paving shall extend to edge of pavement on 13th Avenue. Road and
drainage plans shall be reviewed and approved by the County Engineer.
23. The applicant shall sign and record a"Spokane County Notice ta the Public No. 1" for the
Tract "X" agreement for 13t1i Avenue.
24. Prior to finalization of the plat the applicant shall make applicarion for the removal of the 1 foot
strip of property, knawn as Lot 5 Block 2, located at the terminus Qf 13th Avenue.
COUNTY HEALTH DISTRICT CONDITIONS
1. The final plat shall be designed as indicated on the preliminary plat of rccord and/or any
attached sheets as noted.
2. Appropriate utility ea.tiements shall be indicated on copies of the preliminary plat of record for
distribution by the Planning Department to the utility companies, Spokane County Engineer
and the Spokane Counry Health DistricL Written approval of the easements by the utility

CQUNTY DIVISION OF UTILITIES CONDITIONS
l. Pursuant to the Board of County Commissioners Resolution No. 80-0418, the use of on-site
sewer disposal systems is hereby authorized. This authorization is conditioned on compliance
with all rules and reguladons of the Spokane County Health District and is further condidoned
and subject to specific application approval and issuance of permits by the Health District.

THIS MATTER, an application for subdivision of land, from Lany & Mary Honegger has been
received and decided upon, pursuant to Spokane County Subdivision regulations, on April
1994.
FINDINGS OF FACT AND CONCLUSIONS
1. The individual signing below has further been properly delegated the responsibiliry for
rendering the decision by the Spokane County Director of Planning.
2, The proposal is to divide approximately 1 ac.re into 31ots for 1 existing single family residence
and 2 additional residential lots and thase uses permitted in the underlying zone.
3. The proposal is generally Iocated 220 feet east of the intersection of Marigold Street and 12th
Avenue in the SE 1/4 of Section 23, Township 25 Narth, Range 44 E.W.M. Spokane
County, Washington.
4. The existing zoning of the property described in the application is Urban Residential-3.5 (UR-
3.5), previously established as Agricultural (A) (file # 60-42) zoning in 1942 and redesignated
to UR-3.5 on January l, 1991, pursuant to the Program to Implement the Spokane County
Zoning Code. Pursuant to RCW 58.17.195 the proposal does conform to the requirements of
the existing UR-3.5 zone.
5. The Spokane County Comprehensive Plan designates this area as Urban. The developmen t
and uses proposed are generally in accord with this category.
b. Surrounding uses are primarily single family residences on mixed urban size lots and open
space. Adams Elementary School, Central Valley High School and Evergreen 7unior High
School are located withiri approximately 1/8 mile rathus of the site.
7. The required public notice wa,s provided for chis proposal and agencies havi,ng a potentidl
i.nterest in the project were norified and recommendations solicited.
8. Written comments were received from an adjoining property owner regarding increased traffic
and limited visibility. Marigold Street, a local access street, has adequate design a.nd as-built
capacity to accommodate the additional traffic which may be generated. There are no "clear
view" restrictions at the intersection of 13th Lane and Marigold Street.
9. The site is located within the Public Transportadon Benefit Area (PTBA). The Spokane
Transit Authority (STA) Valley%24th Aveaue Route # 21 and Valley/32nd Avenue Route # 22
provides connecting services co the site via the Fence-Cole Valley Transit Center.
10. The proposed short plat will be served by a public water system. Waste water disposal will be
as authorized by the Director of Utilities.
11. The Spokane Couaty Parks Department has commented on the proposed short plat. The
Parks Departrrient has requested a voluntary agxeemenc be completed between the Parks
Deparnnent and the property owner to mitigate impacts to the County Park system. County
legal counsel has indicated such agreements may be required. The Spokane County Planning
Department recomrnends the property owner negodate with the Spokane County Parks
Department to provide for appropriate capital facilities as required by the Revised Code of
Washington (RCW) 58.17.110. Approval of this short plat should include conditions
requiring that provisions for appropriate facilities be in place prior to recording this final plat in
the foroa of a written agreement between the owner and the Spokane County Parks I
Depar[ment.
12. The Central Valley School District No. 356 has commented on the proposed Short Plat. The
District has iadicated that existing schoal facilities are inadequate to serve the proposed short
plat and wishes to negotiate with the owner to provide adequate capital facilities as required by
the Revised Code of Washington (RCV) 58.17.110. Review by County legal counsel indicates the condition requested by the School District can be required for developments.
Approval of this short plat should include condicions requiring that provisions far appropriate
facilities be in place prior to recording the final short plat in the form of a written agreement
between the owner and the school district.

13. The proposed short plat has d.irect access to public rigbt of way at 12th Avenue. Thirteenth
Avenue will be extended to the east to serve Tmcts B& C and the adjacent Hillberry property
within the preliminary short plat SP-911-93, approved March 16, 1994. No sidewalks were
requested by the County Engineer regarding this proposal.
14. Recognizing the recommended canditions and Spokane County development standards, the
proposeti short subdivision makes appropriate provisions for the public health, safety and
general welfare and that the public use and interest will be served by platting the subdivision.
The subdivision proposal is generally consistent with RCW 58.17 and the County subdivision
regulations, promoting the public health, safety and general welfarz in accordance with
standards established by the state and Spokane County. The Planning Department has
considered the provision of adequate public facilities as cited in RCW 58.17.110 (2). More
specificauy:
a. open spaces

c. public and/or private rights-of-way

15. The project is exempt from Environmental review under the State Envi.ronmental Policy Act
pursuant to WAC 197-11-800 (6)(a).
16. The following facts are also relevant:
a. The proposed Short Plat is a replat of Lot "B" of Short Plat 82-214, which was recorded
as a final plat on December 14, 1982.
b. One storage structure, detached, private, is permitted inside the Urban Lnpact Area (UTA)
boundary, limited in area to 1,500 square feet and provided setbacks and maximum
building coverage standards are met.
c. Subdivision of property should not allow the creauan of nonconforming setbacks for
existing structures. Compliance with setback standards in the UR-3.5 zone may require
either an adjustment of the properry lines or removaI of the potenaa] nonconforming
structure.
DECTSIQN
Based upon the above noted Finclings of Fact and Conclusions, Short Plat Application SP-948-94
is hereby APPROVED unril April 1, 1997, subject to condiaons noted below. Most of the
conditions of approval shall be accomplished by the applicant and/or sponsor prior to finalization
of the short subdivi.sion. This decisian is final unless appealed in writi.ng, consistent with adopted
appeal procedures.
COUNTY PLANNING DEPARTMENT CQNDITIUNS
1. A,11 condiaons imposed by the Planning Deparnnent shall be bind.ing on the "Applicant",
which term shall include the owner or awners of the property, heirs, assigns and successors.
2. The proposal shall comply with the Urban Residenual-3.5 (LJR-3.5) zone as amended.
3. T'he final plat shall be designed substandally in conformance with the preliminary plae of
record. No increase af density or number of lots shall occur without a change of condition
application submittal and approval.
4. The Planning Director/designee shall review any proposed final plat to ensure compliance with
these Findings and Condiaons of Approva].

5. T'he preliminary plat is given conditioaal approval for three (3) years, specifically to May 1,
1997. 1'he applicant may request an extension of time by submitting a written request
approximately forty-five (45) days prior to the above expuation date.
6. Three (3) current certificates of dtle shall be furnished to the Planaing Deparanenc prior to
filing the final plat.
7. Appropriate utility easements shall be indicated on copies of the proposed final plat. Written
approval of utility easements by appropriate utility companies shall be received with the
submittal of the final plat.
8. Appropriate road name(s) shall be ind.icated.
9. The final plat map shall indicate by a clear, dashed line the required yard setbacks from all
private, "Tract X" or public raads. The dedication shall contain the following statement:
"Side yard and rear yard setbacks shall be determineti ac the time building permits are
requested unless these setbacks are specificalIy drafted on this 5na1 pIat. The setbacks
indicated on this plat may be varied from if proper zoning approvals are obtained."
10. A plan for water facilities adequate for domestic service and fire protection shall be approved
by the water purveyor, appropriate fire protection distriet, County Division of Buildings and
County Health District. The agencies will certify on the Water Plan, priar to the filing of a
final plat, that the plan is in conformance vvith their respective needs and reguladons. The
Water Plan and certification shall be drafted on a transparency suitable for reproduction and be
signed by the plat sponsor.
11. The water purveyor shall Ger[ify that appropriate contractual arrangements and schedule of
improvements have been made with the plat sponsor for construction of the water system in
accordance with the approved Water Plan. The tune schedule shall provide far compleaon of
the water system and inspecaon by the appropriate health authorities priar to application for
building permits within the final plat. The arrangements or agreemencs shall include a
provision holding Spokane Connty and the purveyor hamaless from claims by any lot
purchaser refused a building permit due to the fai.lure of the subdivisioo sponsor to
satisfactorily complete ttie approved water system.
12. The final plat dedication shall contain the following scatement:
"The public water system, pursuant to the Water Plan approved by county and state health
authonties, the local fire protection district, water purveyor and Spokane County Division of
Buildings, shall be installed within this subdivision, and the applicant shall provide for
individual domestic water service as weU as fire protection to each tract prior to sale of each
tract and prior to issuance of a building petYnic for each tract."
13. No building peimit will be issued for any lot within the final plat until certified by a
Washington state-licensed engineer that "the water system has been installed pursuanc to the
approved Water Plan for the final plat" including a signed license stamp. The certification may
be in the form of a letter, but is preferred to be certified on a copy of the Water Plan as a
schematic map showing the "as-built" water system.
14. The Water Pian and the above four (4) conditions of approval regarding the Water Plan may
be waived by the Planning Director/designee upon receipt af letters from the appropriate water
pwveyor and fire protection district stating that sunple connections to an existing, approved
water system will provide adequate domea-tic and fire protec;don water to ensure the public
health, safecy and general welfare.

1. The conditional approval of the plat is given by the County Engineer subject to dedication of

2. Plans, profiles, and cross-sections as designed to County standards showing proposed street
centerline and curb grades shall be submitted to the County Engineer for approval prior to
construction andlor the filing of each final plat; road plans to be prepared under tbe direction of
a licensed Professional Civil Engineer.
3. Drainage plans and design calculations showing the alignment of drainage facilities shall be
submitted to the County Engineer for approval prior to construction and/or the filing of the

until a pernut has been issued by the County Engineer. All work is subject to inspection and

may, with the approval of the County Engineer, accomplish the road improvements stated
herein by joining and participaring in a County Road Project (CRP) to the extent of the

11. The following statement shall be placed in the plat dedication:
"The owner(s) or successor(s) in interest agree to authorize the County to place their name(s)
on a petition for the formatioa of a Road Improvement District (RID) by the petition method
pursuant to Chapter 36.88 RCW, which petition includes the owner(s)' property, and furthec
not to object, by the signing of a ballot, to the formation of an RID by the resolution method
pursuant to Chapter 36.88 RCW, which resolution includes the owner(s)' property. If an
RID is forcned by either the petition or resolution method as provided for in Chapter 36.88
RCW, the owner(s) or successor(s) further agree:
(a) that the improvement(s) or construction contemplated within the praposed RID is
feasible;
(b) that the benefits to be derived from the formation of the RID by the property included
therein, together with the amount of any County participation, exceed the cosc and expense of
formation of the RID; and
(c) tha[ the property within the proposed RID is sufficiendy developed.
Provided further that the owner(s) or successor(s) sha11 retain the right, as authorized under
RCVV 36.88.090, to object to any assessment(s) on the property as a result of the
impzovements called for in conjunction with the formation of an RID by either petieon or
resolution method under Chapter 36.8$ RCW, and to appeal co the Supe.rior Court the
decision of the Board of County Commissioners affirming the final assessment roll.
It is further agxeed that at such time as an RZD is created or any Road Improvement Project is ~

assigns without participation by Spokane County. '
Ttie RID waiver contained in this agreement shall expire after ten (ln) years from the date af
execution below. However, the owner(s) ar successor(s) agree that if said RID waiver
expires without construction of the required improvements, the owner(s) or successor(s) agree
to construct the required improvements at their own expense, pay to Spokane Counry the then
estimated cast of the required improvements to enable the County to complete the same, or
fumish a bond or other secure method suitable to the County (which may include the
execution of another RID waiver agreement) providing for or securing to the County the actual
construction of the improvements.
All of the requirements of this agreement shall nin with the land and shall be binding upon the
owner(s), their successor(s) or assign(s)." This provision is applicable to Twelfth /lvenue.
12. The County Engineer has designated Typical Roadway Section Number Two, Local Access
Standard for the improvement of Twelfth Avenue, which is adjacent to the proposed
development. This will require the addition of approximacely 7-9 feet of asphalt along the
frontage of the development. The construction of curbing is also required.
13. The praposed private road(s) as shown on the preliminary plat serving 21ots with extension to
serve 8 or fewer lots is approved by the County Engineer.
14. Private road(s) shall be improved to Spokane County standard for an urban private road
standard serving 4 lots, and is subject to approval under Section 10.207 of the Spokane
County Fire Code.
15. All vested owners shall sign and record private road documencs as prescribed by the Spokane
County Engineer. These documents shall be reviewed and approved by the Spokane County
Engineer pnor to recording with the Spokane County Auditor. Recording numbers shall be
referenced in the ded.icatory language of the plat.
16. The following statement shall be placed in the plat dedication:
"WARNING: Spokane County has no responsibiliry to build, improve, maintain or otherwise
service the private roads contained within or provicing serviGe to the property described in chis

provide drainage or snow removal on a private road. This requirement is and shall run with

17. The proposed plat shall be improved to the standards set forth in Spokane County Board of
Commissioners Resolution No. 80-1592, as amended, which resoludon establishes
regulations for roads, approacbes, drainage and fees in new construction.
18. The County Engineer has examined this development proposal and has determined that the
impact of this proposal upon the existing county road system warrants the dedication of
additional right-of-way and the roadway improvements herein sgecified.
