SP-950-94 1 SPOKANE COUNTY , HEARING EXAMIlVER COMMTI'TEE FINDINGS OF FACT. CONCLUSIONS AND ORD _R INTRODUCTION This matter has vome before the Hearing Examiner Committee on November 29, 1990. The raembers of the Committee present are Phil Harris, Chairperson, Verona Southern a.nd Bud Sk.adan.. PROPOSAL The sponsor, Merie Haffner, requests approval of a zone reclassification, File No. ZE-42-90, Multiple Family Suburban (1VFS) to Urban Residential-22 (UR-22) to allow development of an office complex. FINDINGS OF FACT AND CONCLUSIONS 1. The property is generaily located south of I 90 and south of and adjacent to Nora Avenue. The site is approximately 1/4 anile east of Pines Road in Section 10, Township 25 N., Range 44 EVVM, Spokane County, Washington. 2. The committee adopts the Planning Deparment Report as a part of this record. 3. The existing land uses in the area include single family residences, offices and reriremeot agardnents. 4. The Comprehensive Plan designates this site as Urban. Ile Urban category is inoended to provide fvr a vaziety of land uses in an intensive "city like" environment. 5. The Arterial Road Plan designaties Nora Avenue as a local access street, with a recommended rigiit of way wi,dth of 60 feet. 6. The existing zoning of the pmperty described in the applicarion is Multiple Family Suburban, previously established ia 1979. 7. The provisions of RCW 43.21C (The State Environmental Policy Act) have been ' oomplied with and a Detenmination of Nonsignificance was issued. The legal requirements for public notice have been fulfilled. 9. The owners of adjacent lands expressed neither approval or disapproval of the proposed use. 10. 'The proposed use is coinpatible with existing uses in the area. 11. The proposed zoning dQes imple,ment and coaform to the Comprehensive Plan. 12. The applicant has demonstraud that condidons have substantially changed since the original zoning of this area and avcondingly, tbe proposed zone reclassificadon is -justified. . ~ ~ ~ I HEC Order for ZE-42-90 P89e 2 13. The proposed use will not be detrimental to the public health, safety, morals or welfare. CONDITIONS OR CONTINGENCIES APPLIED TO THIS APPROVAL 1. All Condidons imposed by the Hearing Examiner Cornmittee shall be binding on the "Applicant," which term shall include the owoer or owners of the property, heirs, assigns, and successors-in-iaterest 2. The following Conditions of Appr+oval apply to the real property described below: that portaon of tracts 1 I and 12, Assessor's Plat #fi lying southerly of Nora Avenue within the SW 1/4 of Secdon 10, Township 25 N., Range 44 EWM. HEARING EXAMINER COMMITTEE 1. The Spokane County Hearing Examiner Committee added Spokane County Air Pollution Control Authority Condition of Approval l through 4 as oontained herein. COUNTY PLANNING DEPARTMENT 1. A specific development plan shall be submitned for Planning Department review and approval prior to issuance of building permits. Constructioa must be judged as pnxeeding aoconding to the plan or constituce a zoning violadon. 2. Approval is required by the Planning Director/designee of a specific lighring and signing plan for the described property prior to the release of any building penruts. 3. A specific plan, planting schedule and provisions for mainte,aance aoceptable tio the Planning Director/designee shall be submitted with a perfonnance bond for the project prior to release of building pennits. Landscaping shall be installed and maintained so thaz sight distance at acce.ss points is not obscured or unpaired. 4. The existing residence on the site may be converted Zo office use. Existing landsc~ping may be utilitied to satisfy landscaping noquirements until such time that a building permit is reque.sted to ealarge or consuuct additional office space. At that , a site development plan and landscape plan will be required and all requirements of the Urban Residential-22 (UR-22) Zone shall be meL 5. The Planning Department shall file with the Spokane County Auditar, within the same tiaie frame as allowed for an appeal from the final disposition, including lapsing of appeal period, a Tide Notice, which shall generally provide as follows: "Prior tio the issuance of any building permit far any building or any use on the property described herein, the applicant shall be responsible far complying with the provisions of the Zoning Code for Spokane County, Section 14.706 (Aquifer Sensitive Area Overlay Zone). Access pennits for approaches to the county road system shall be obtained from the Spokane County Engineer. 4. Ile applicant shall submit for approval by the Spokane County Engineer road, drainage and access plans. 5. Ile applicant shall submit for approval by the Spokane County Engineer and the Spokane County Health District a detailed combined on-site sewage system plan and surface water disposal plan for the endre project, or portion tbereof, if the development is to be phased. . 6. A parldng plan and tra.ffic cinculation plan shall be submitt,ed and approved by the Spokene County Engineer. The design, location and anangement of parking stalls shall be in aocondance with smndard uaffic engineering practices. Paving or surfacing as approved by the County Engineer, will lx roquired for any pordon of the project which is to be occupied or traveled by vehicles. 7. To consavct the roadway unprovements stated hemin, the applicant may, with the . apprnval of the County Engineer, join in and be willing to participate in any petition or resolution which purpose is the formation of a Road Improvement District (RID) for said 'unprovement, pursuant to RCW 36.88, as aanended. HEC Order for ZE-42-90 Page 4 Spokane County will not pardcipate in the cost of these irnpmvernents. T'his is applicable to Nora Avenue. 8. As an altrernative method of conscructing the road improvements stated herein, the applicant may, with the apprnval of the County Engineer, accomplish the road improvements stat,ed herein by joiniog and participating in a County Road Project (CRP) to the extent of the required improvement. Spokane Caunty will not participate in the cost of the.se improvements. This is applicable to Nora Avenue. 9. The construction of the road unprovements stated herein shall be ac,complished as approved by the Spokane County Engineer. 10. The County Engineer has designated Typical Roadway Section Number One, Local Acxess standand for the improvetnent of Nora Avenue, which is adjacent to the proposed development, This will require the addition of approximately 8-10 feet of asphalt along the frontage of the development The coasunction of curbing and sidewalk is also required. 11. All required improvements shall conform to the current State of Washington Standard Specifications for Road and Bridge Construction and other applicable County standanis and/or adopted resolutions pertaining to Road Standards and Stonnwater Management in effect at tbe date of construction, unless otheiwise approved by the County Engineer. 12. Applicant shall construct a paved and delineated appma,ch(es) to meet the existing pavement on Nora Aveaue. 13. Roadway standards, typical roadway sectioas and drainage plan requirements are found in Spokane Board of County Commissioners Resolution No. 80-1592 as amended and are applicable to this proposal. 14. This snbdivision or develogment proposal is located within a drainage basin which has been identified by the Spokane County Engineces office as having stormwacer iunoff problems. Siace this plat or development pmposal is affected by or is a contributor to stormwater flows, property owners should participate in the planning and implementation of a fu=e basinwide stosmwazer management system. The following statement shall be plaoed ia the plat dedicadon: "The owner(s) or successox(s) in interest agree to join in any County-approved stormwater management pmgram and to pay such rates and charges as may be fixed through public bearings for service or benefit obrained by the planning, design, consnvcting, mainraining or operation of storinwater control facilities." . 15. No construction work shaD be performed widiin the existing or praposed public right-of-way uatil a permit bas been issued by the Couaty Engineer. All work within the public road right-of-way is svbject to inspection and approval by the County Engineer. 16. All required construction within the existing or proposal public right-of-way is to be completed prior to the release of a building pemut, or a bond in an amount .estimated by the County Engineer to cover the cost of construction of improvements shall be filed with the County Engineer. Applicant shall sign and necord Spokane County Notice to the Public No. 6 which specifies the following: The owner(s) or successor(s) in interesst agree to authorize the County to place their name(s) on a petition for the formation of a Road Impruvement District (RID) by the petition method pursuant to Chapter 36.88 RCW, which perition includes the owner(s) property, and further not to object, by the signing of a ballot, the formation of a RID by the resolution method pursuant to Chapter 36.88 RCW, which resolution inclades the owner(s) property. If an RID is formed by either the petition or resolution method, as provided for in Chapter 36.88 RCW, the owner(s) or successor(s) further agree: (a) that the improvement ar construction contemplatted within the proposed RID is feasible; (b) that the benefits to be derived from the formation of the RID by the propeity included therein, together with the amount of any County parncipation, exceeds the cost and expense of formation of the RID; and (c) that the property within the proposed RID is sufficiendy developed. Provided further that the owner(s) or successar(s) shall remin the right, as authorized under RCW 36:88.090, o0 object to any assessment on the property as a re.sult of the improvements called for in conjunction with die formation of the RID by either petition or resolution method under Chapter 36.88 RCVV. This requiremeat applies to Nora Avenue, from which the subject parcel takes access. COUNTY UTILITIES DEPARTMENT 1. Applicant shall make connection to public sewer system Sewer connection permit is required. Plans and specif cations are to be reviewed and appruved by the Utilities DepamnenL COUNTY HEALTH DISTRICT - 1. Sewage disposal method shall be as authoriz,e,d by t6e Director of Utilities, Spokane County. . 2. Water savice shall be coordinated through the Director of Utilities, Spokane County. 3. Wat,er service shall be by an existing public water supply when approved by the Regional Engineer (Spokane), State Depaitnlent of Health. 4. A public sewer system will be made available for the project, and individual service • will be provided to each lodtract prior to sale. Use of individual on-site sewage disposal systems shall not be authorized. HEC Order for ZE-42-90 Page 6 5. Usa of private wells and water systems is prohibited. COUNTY BUILDING AND SAFETY DEPARTMENT 1. The applicant shall contact the Deparnnent of Building and Safety at the earliest possible stage of design/development in order to be infoimed of code requirements adminiswred/enforced by the departinent, e.g., State Building Code Act regulations, such as requirements for fire hydrant/flow, fire appamtus access roads, street address assignment, barrier-free regulations, energy code regulations and geneml coordination with other aspects of project implementation. 2. Requirements of Fire District No. 1 need to be satisfied during the building percYrit process. SPOKANE COUNTY AIR POLLUTION CONTROL AUTHORTTY 1. Air pollution regulations require that dust emissions during demolition, construction and excavatioa projects be-conmolled. This may require nse of water sprays, tarps, sprinklers or suspension of activity during certain weather condidons. Haul roads shonld be treated, and emissions from the u~amsfer of earthen material must be controlled, as well as ermssions from all other construction-related acrivities. 2. All traveled surfaces (ingress, egress, parking areas, access roads) must be paved and kept clean. 3. Measures must be taken to avoid the deposition of dirt and mud from unpaved surfaces onto paved surfaces. If tracking or spills occur on paved surfaces, meastues must be taken innmediately to cleaa these surfaces. 4. Debris geaemted as a result of this project must be disposed of by means other than burning. The SP is bordered on the north by Nora Avenue, south of interstate 90 and east of Pines Road. The existing condition within the short plat boundary consists of ineadow over the majority of the site with scattered trees throughout (c factor used was the average of ineadow and woodland). The westerly lot is cunently an existing residence. The general topography of the area slopes from south to north at grades of approximately 5% to 10% along the north portion and slopes of 35% to 40% along the south portion, as shown on the attached maps. It appears that the majority of the drainage will be sheet flow, however, for analysis purposes we are assuming a concentrated flow. A portion of thz basin is located outside of the plat boundary, therefore a 50 year event is used to analyze the runoff. The basin is approximately 4.3 acres in size and was analyzed using the Rational Method. The resulting nZaximum runoff rate calculated for the existing conditions is 4.48 CFS. The basin for the developed condition analyzed was the same area as the exiscing condition. Since ihe south 80' of the short plat consists of steeper slopes, the surface condition was assumed to be the sacne as the existing case, mixed thin forest and meadow. It was assumed that the developed portion of Parcels B& C would be converted to lawn and roof from meadow and woodland. The resulting maximum runoff rate calculated for this situation was 4.49 CFS. There also does not appear to be a defined drainage way througli any.-of ttie lots,, therefore, drainage easements should not be necessary. The SP is bordered on the north by Nora Avenue, south of interstate 90 and east of Pines Road. The existing condition within the short plat boundary consists of ineadow over the majority of the site with scattered trees tbroughout (c factor used was the averape of ineadow and woodland). The westerly lot is currently an existing residence. The general topography of the area slopes from south to north at grades of approximately S% to 10% along the north portion and slopes of 35 % to 40 % along the south portion, as shown on the attached maps. It appears that the majoriry of the drainage will be sheet flow, however, for analysis purposes we are assuming a concentrated flow. A portion of the basin is located outside of the plat boundary, therefore a SO year event is used to analyze the runoff. The basin is approximately 4.3 acres in size and was analyzed using the Rational Method. The resulting maximum runoff rate calculated for the existing conditions is 4.48 CFS. T'he basin for the developed condition analyzed was the same area as the existing condition. Since the south 80' of the short plat consists of steeper slopes, the surface condition was assumed to be the same as the existing case, mixed thin forest and meadow. It was assumed that the developed portion of Parcels B& C would be converted to lawn and roof from meadow and woodland. The resulting maximum runoff rate catculated for this situation was 4.49 CFS. There also does not appear to,.-be,,a defined drainage way through-any,of -the lots, -therefore; drainage easements should no't- be necessary. A) For any new hard surface area, for an asphaltic roof, or a roof containing HVAC machinery, a drainage plan for the site shall be prepared in compliance with Spokane County "Guidelines for Stormwater Management". At a minimum the plan must contain: 1. Drainage calculations for stormwater volumes generated on site. 2. Calculations for total impervious surfaces contained within the site. 3. Finished grade elevations for structures to be constructed on site. 4. Finished grade elevatians at the top and bottom of the 208 swale. 5. A typical cross section of the 208 swale. 6. Calculations to justify the number and type of drywells proposed. 7. Elevation of drywell inlets where applicable. 8. Copy of the proposed landscape plan. Hinman has eer~~11*M received and decider~ upon, pursuant to Spokane County Subdivision regulations, on the daY of 1~4 1 ~ 1994. , FINDIlVGS OF FACT AND CONCLUSIONS 1. The individual signing below has further been properly delegated the responsibility for rendering the decision by thc Spokane County Director of Planning. 2. The proposal is to divide approximately 2.75 acres into 31ots for 1 existing single family residence and 2 new lots for professional/business offiCes and those uses pennitted in the underlying zone. 3. The proposal is generally located south of and adjacent to Nora Avenue, approximately 1/2 mile east of Pines Road, in the SW 1/4 of Section 10, Township 25 North, Range 44 E.W.M. Spokane County, Washington. 4. The existing zoning of the properry described in the applic:ation is Urban Residential-22. The subject property was rezoned in 1979 from Agricultural (A) to Mulaple Family Suburban (MFS) (file # ZE-116-79C), and redesignated to tTR-22 on January 1, 1991, pursuant to the Program to Implement the Spokane County Zoning Code. Pursuant to RCW 58.17.195 the proposal does conform to the requirements of the existing UR-22 zone. 5. The Spokane County Comprehensive Plan designates this area as Urban. The development and uses proposed are genesally in accorti with this category. 6. Surrounding uses are primarily indusrrial, commercial, single family and mulrifamily residences on mixed urban size lots and open space. The Walk in the Wild Zoo is located approximately 1/2 mile north of the site. 7. The required public nodce was provided fQr this proposal and agencies having a potential interest in the project were notified and recommendations solieired. 8. No written comments were received from any adjoining property owners. 9. The site is located within the Public Transportation Benefit Area (PTBA). The Spokane Transit Authariry (STA) ValleyfI'rentwood Route # 20 provides cannecting services to the site. 10. The proposed short plac will be served by a public water system. Waste water disposal will be as authorized by the Director of Urilities. 11. The Spokane County Parks Department has commented on the proposed short plat. The Parks Department has requested a voluntary agreement be completc;d between the Parks Department and the property owner to mitigate impacts to the County Park system. County 1ega1 counsel has indicated such agreemencs may be required. The Spokane County Planning Department recommends the property owner negoeiate with the Spokane County Parks Department to provide for appropriate capital facilities as required by the Revised Code of Washington (RCW) 58.17.110. Approval of this short plat should include conditions requiring that provisions for appropriate facilities be in place prior to recording this final plat in the form of a written agreement between the owner and the Spokane County Parks Department 12. The Central Valley School District No. 356 has coinmented on the proposed Short Plat. The District has indicated that existing school facilities are inadequate to serve the proposed short plat and wishes to negotiate with the owner to provide adequate capital faciliries as required by the Revised Code of Washington (RCV) 58.17.110. Review by Counry legal counsel ind.icates the condition requested by the School District can be required for developments. Appmval of this short plat should include condiaons requiring that provisions for appropriate facilities be in p1aCe prior to recording the final short plat in the form of a written agreement between the owner and the school district. 13. The proposed short plat has direct access to public right of way at Nora Avenue. No sidewalks were required by the County Engineer for this proposal. . FINDINGS AND DECISION S P-950-94 Page 2 14. Recognizang the recommended conditions and Spokane County development standards, the proposed short subdivision makes appropriate provisions for the public health, safety and general welfare and that the public use and interest will be served by platting the subdivision. The subdivision proposal is generally consistent with RCW 58.17 and tbe County subdivision regulations, promoting the public health, safety and general welfare in accordance with standards establi.shed by the state and Spokane County. The Planning Department has considered the provision of adequate public facilities as cited in RCW 58.17.110 (2). More specifically: a. open spaces b . drai.nage watys c. public andlor private rights-of-way d . transit e. potable water f. sanitary waste disposal g. parks and recreation facilities h . playgrounds i. schools and schoolgrounds j . sidewalks 15. The project is exempt from environmental review under the State Environmental Policy Act pursuant to WAC 197-11-800 (6) (a). 16. The following facts are also relevant: a. Storage structures, detached, private are not permitted in the Urban Residential-22 (UR- 22) zone. b. The existing structures located on Lot "B" labeled "SHED" and "BARN" are nonconforming structures. DECISION Based upon the above noted Findings of Fact and Conclusions, Short Plat Application SP-950-94 is hereby APPROVED until May 1, 1997, subject to conditions noted telow. Most of the conditions of appmval shall be accomplished by► the applicant and/or sponsor prior to finalization of the shore subdivision. This decision is final unless appealed in writing, consistent with adopced appeal procedures. COUNTY PLANNING DEPARTMENT CONDITIONS 1. All conditions imposed by the Planning Department shall be binding on the "Applicant", which term shall include the owner or owners of the property, heirs, assigns and successors. 2. The proposal shall comply with the Urban Residential-22 (UR-22) zone as amended. 3. The final plat shall be designed substantially in conformance with the preliminary plat of record No increase of density or number of lots shall occur without a change of contlition application submittal and approval. 4. The Planning Director/designee shall review any proposed final plat to ensure compliance with these Findings and Condiaons of Approval. 5. The preliminary plat is given conditional approval for three (3) years, specifically to May 1, 1997. The applicant may request an extension of time by submitti.ng a written request approximately farty-five (45) days prior to the above expiration date. 6. TTUrree (3) current cercificates of tide shall be furnished to the Planning Department prior to filing the final plat Appropriate utility easements shall be indicated on copies of the proposed final plat. Written approval of utility easements by appropriate utility campanies shall be received with the submittal of the final plat 8. Appropriate road name(s) shall be indicated. To construct the road improvements stated herein, the applicant may, with the approval of the County Engineer, join in and be a willing participant in any petition or resolution which purpose is the forrnauon of a Road Improvement District (RID) for said improvements, pursuant to RCW 36.88, as amended. At such time as an RID is created or any Road Improvement Project is sanctioned by Spokane County, the improvements required (curb, sidewalk, drainage control and paving to existing pavement) will be at the sole expense of the undersigned owner(s), their heirs, grantees and assigns. This provision is applicable to Nora Avenue. 9. As an alternative method of constructi.ng the road improvements staced herein, the applicant may, with the approval of the County Engineer, accomplish the road improvements stated herein by joining and participating in a County Road Project (CRP) to the extent of the required road improvements. At such time as an RID is created or any Road Improvement Project is sanctioned by Spokane County, the improvements required (curb, sidewalk, drainage control and paving to existi~ng pavement) will be at the sole expense of the undersigned owner(s), their heirs, grantees and assigns. This provision is applicable to Nora Avenue. 10. The following statement shall be placed in the plat dedication: "The owner(s) or successor(s) in interest agree to authorize the County to place their name(s) 0o a petition for the formation of a Road Improvement District (RID) by the petitian method pursuant to Chapter 36.88 RCW, which petition includes the owner(s)' pr+operty, and further not to object, by the signing of a ballot, to the formation of an RID by the resolution method pursuant to Chapter 36.88 RCW, which resolutioo includes the owner(s)' property. If an RID is formed by either the petition or resolution method as provided for in Chapter 36.88 RCW, the owner(s) or successor(s) further agree: (a) that the improvement(s) or construction contemplated within the proposed RID is feasible; (b) that the benefits to be derived from the formation of the RID by the property included therein, together with the a.mount of any Counry participation, exceed the cost and eupense of formation of the RID; and (c) that the property within the proposed RID is suffliciently developed. Provided further that the owner(s) or successor(s) shall retain the right, as authorized under RCW 36.88.090, to object to any assessment(s) on the property as a result of the unprovenlents called for in conjunction with the formation of an RID by either petition or resolution method under Chapter 36.88 RCW, and to appeal to the Superior Court the decision of the Board of County Commissioners affuming the final assessment roll. It is further agreed that at such time as an RID is created or any Road Improvement Project is sanctioned by Spokane County, the improvements required (curb, sidewalk, drainage control and paving) will be at the sole expense of the undersigned owner(s), their heus, grantees and assigns without participation by Spokane County. The RID waiver contained in ttus agreement shall expire after ten (10) years from the date of execution below. However, the owner(s) or successor(s) agree that if said RID waiver eupires without construction of the required improvements, the owner(s) or successor(s) agree to construct the required improvements at their own expense, pay to Spokane County the then esrimated cost of the required improvements to enable the County to complete the same, or furnish a bond or other secure method suitable to the County (which may include the execution of another RID waiver agreement) providing for or securing to the Counry the actual construction of the improvements. All of the requirements of this agreement shaU run with the land and shall be binding upon the owner(s), their successor(s) or assign(s)." This provision is applicable to Nora Avenue. 11. The County Engineer has designated Typical Roadway Section Number One, Local Access Standard for the improvement of Nora Avenue, which is adjacent Co the proposed development. This will require the addition of approximately 8-10 feet of asphalt along the frontage of the development. The construction of curbing and sidewalk is also required. 12. The proposed subdivision shall be irnproved to the standards set forth in Spokane County Board of Commissioners Resolution No. 80-1592, as amended, which resolutioa establishes regulations for roads, approaches, drainage and fees in new construction. . FINDINGS AND-DECISION SP-950-94 Page 5 13. The County Engineer has examined this development proposal and has determined that the impact of this proposal upon the existing counry road system wairants the dedication of additional right-of-way and the roadway improvements berein specified. 14. There may exist utilities, either underground or overhead, affecting the subject property, includ.ing property to be dedicated or set aside for future acquisitioa. Spokane County assumes no financial obligation for adjustments or relocation regarding these utilities. Applicant(s) should check with the applicable utility purveyor and the Spokane County Engineer to deterrmine whether applicant(s) or the utility is responsible for adjustment or relocation costs and to make arrangements for any necessary work. COUNTY HEALTH DISTRICT CONDITIONS 1. The final plat shall be designed as indicated on the preliminary plat of record and/or any attached sheets as noted. 2. Appropriate utility easements shall be indicated on copies of the preliminary plat of record for distribution by the Plann.ing Department to the utility campanies, Spokane County Engineer and the Spokane County Health District. Written approval of the easements by the utility companies musc be received prior to the submittal of the final plat. 3. Sewage disposal method shall be as authorized by the Director of Utilities, Spokane County. 4. Water service shall be coordinated through the Director of Utilities, Spokane County. 5. Water service shall be by an existing public water supply when approved by the Regional Engineer (Spokane), State Deparnnent of Health. 6. Prior to filing the final plat, the sponsor shall demonstrate to the satisfaction of the Spokane County Health District that an adequate and potable water supply is available to each tract of the plat. 7. Prior to filing the final plat, the sponsor shall present evidence that the plat lies within the recorded service area of the water system pruposed to serve the plat. 8. A public sewer system will be made available for the plat, a.nd individual service will be provided to each tracc prior to sa1e. Use of individual on-site sewage disposal systems shall not be authorized. 9. A statement shall be placed in che dedication to the effect that: "A public sewer system will be made available for the plat, and individual service will be provided to each tract prior to sale. Use of individual on-site sewage disposal systems sha11 not be authorized." 10. The dedicatory language on the plat shall state: "Use of private wells and water systems is prohibited." 11. The plat dedication shall contain a statement to the effect that: "The public water system, pursuant to the Water Plan approved by county and state health authorities, the local fire protection district, water purveyor and County Division of Buildings, shall be installed within ttus plat, and the applicant shall provide for individual domestic water service as well as fire protection to each tract prior to sale of each tract and prior to issuance of a building pemnit for each tract" COUNTY DIVISION ()F UTILITIES CUNDITIONS 1. Hinman has been , received and decide~ upon, pursuant to Spokane County Subdivision regulations, on the day of 1 , 1994. FINDINGS OF FACT AND CONCLUSIONS 1. The individual signing below has further been properly delegated the responsibility for rendering the decision by the Spokane Cvunty Director of Planning. 2. The proposal is to divide approximately 2.75 acres into 3 lots for 1 existing single family residence and 2 new lots for professional/business offices and those uses pernutted in the underlying zone. 3. The proposal is generally located south of and adjacent to Nora Avenue, appmximately 1/2 mile east of Pines Road, in the SW 1/4 of Section 10, Township 25 North, Range 44 E.W.M. Spokane County, Washingtan. 4. The existing zoning of the property described in the applicadon is Urban Residential-22. The subject property was rezoned in 1979 from Agricultural (A) to Multiple Family Suburban (MFS) (file # ZE-l 16-79C), and redesignated to UR-22 on January 1, 199 1, pursuant to the Program to Implement the Spokane County Zoning Code. Pursuant to RCW 58.17.195 the proposal does conform to the requirements of the existing UR-22 zone. 5. The Spokane County Comprehensive Plan designates this area as Urban. The development and uses proposed are generally in accord with this category. 6. Surrounding uses are primarily industrial, commercial, single family and multifamily residences on mixed urban size lots and open space. The Wallc in the Wild Zoo is located approximately 1/2 mile north of the site. 7. The requined public notice was provided for this proposal and agencies having a potential interest in the project were notified and recommendafions solicited. 8. No written comments were received from any adjoining property awners. 9. The site is located within the Public Transportation Benefit Area (PTBA). The Spokane Transit Authority (STA) Valley/Trentwood Route # 20 provides conneccing services to the site. 10. The proposed short plat will be served by a public water system. Waste water disposal will be as authorized by the Director of Utilities. 11. The Spokane County Farks Department has commented on the proposed short plat. The Parks Department has requested a voluntary agreement be completed between the Parks Department and the property owner to mitigate impacts to the County Park system. County legal counsel has indicated such agreements may be required. The Spokane County Planning Department recommends the prvperty owner negotiate with the Spokane County Parks Department to provide for appropriate capital facilities as required by the Revised Code of Washington (RCW) 58.17.110. Approval of this short plat should include conditions requiring that provisions for appropnate facilities be in place prior to record.ing this final plat in tbe form of a written agreement between the owner and the Spokane County Parks Department 12. The Central Valley School District No. 356 has cornmented on the proposed Short Plat. The District hAS indicated that existing school facilides are inadequate co serve the propased short plat and wishes to negotiate with the owner to provide adequate capital facilities a.s required by the Revised Code of Washington (RCV) 58.17.110. Review by County legal counsel ind.icates the condition requested by the School District can be required for developments. Approval of this short plat should include conditions requiring that provisions for appropriate facilities be in place prior to recording the final short plat in the form of a written agreement between the owner and the school district, 13. The propoted short plat has direct access to public right of way at Nora Avenue. No sidewalks were required by the County Engineer for this proposal. FINDINGS AND DECISION SP-950-94 Page 2 14. Recognizing the recommended Conditions and Spokane County development standards, the proposed short subdivision makes appropriate provisions for the public health, safery and general welfare and that the public use and interest will be served by platting the subdivision. The subdivision proposal is generally consistent with RCW 58.17 and the County subdivisian regulations, promoting the public health, safety and general welfare in accordance with standards established by the state and Spakane County. The Planning Department has considered the provision of adequate public facilities as cited in RCW 58.17.110 (2). I'he project is exempt from environmental review under the State Environrnental Policy Act pursuant to WAC 197-11-800 (6) (a). 16. The following facts are also relevant: a. Storage strvctures, detached, private are not pernutted in the Urban Residential-22 (UR- 22) zone. b. The exisdng structures lacated on Lot "B" labeled "SHED" and "BARN" are nonconforming structures. DECISION Based upon the above noted Findings of Fact and Conclusions, Short Plat Application SP-950-94 is hereby APPROVED until May l, 1997, subject to conditions noted below. Most of the conditions of approval shall be accomplished by the applicant and/or sponsor prior to finalization of the short subdivision. This decision is final unless appealed in writing, consistent with adopted appeal procedures. COUNTY PLANNING DEPARTMENT CONDITI()NS 1. All conditions imposed by the Planning Department shall be binding an the "Applicant", which term shall include the owner or owners of the property, heirs, assigns and successors. 2. The proposal shall comply with the Urban Residential-22 (UR-22) wne as amended. 3. The final plat shall be designed substantially in confarmance with the preliminary plat of record. No increase of density or number of lots shall occur without a change of condition application submittal and approval. 4. The Planning Director/designee shall review any proposed fnal plat to ensure compIiance with these Findings and Conditions of Approva.l. 5. The preliminary plat is given cond.itional approval for three (3) years, specifically to May 1, 1997. The applicant may request an extension of time bysubmitting a written request approximately forty-fve (45) days prior to the above expiration date. 6. Three (3) current certificates of tide shall be furnished to the Planning Department prior to filing the final plat. 7. Appmpriate utility easements shall be indicated on copies of the proposed final plat, Written approval of utility easements by appropriate utility companies sha.ll be received with the submittal of the final plat. 8. The final plat map shall indicate by a clear, dashed line the required yard setbacks from all private, "Tract X" or public roads. The dedication shall cantain the foliowing statement: "Side yard and rear yard setbacks shall be deternuned at the time building pernnits are requested unless these setbacks are specifically drafted on this final plat. The setbacks indicated on this plat may be varied from if proper zoning approvals are obtained." 10. No water plan is required, and a simple tap is needed at the time of build.ing permit release. 11. The owner shall negotiate with the Counry Parks Department and submit a m.corded copy of a voluntary agreement making provisions for public parks priar to finalization and record.ing of the plat. The agreement shall pravide a written description of the subject property to which the agreenznt applies and also state the dollar amount and any ather agreed to mitigating measures. Drainage plans and design calculations showing the alignment of drainage facilities shall be submitted to the Counry Engineer for appmval prior to construction and/or the filing of the final plat Drainage plans to be prepared under the direction of a licensed Professional Civil Engineer. 3. No construction work is to be perfomned within the exisring or propased public right-of-way until a permit has been issued by the County Engineer. All work is subject to inspection and approval by the County Engineer. 44. Individual driveway access pernuts are required prior to issuance of a building pennit for driveway approaches to the county road system. 5. Dedication of 10 feet of additional right-of-way along Nora Avenue is required. 6. Existing counry roads providing direct access to the plat shall be paved and/or curbed to Spokane County standards. 7. At such time as an RID is created or any Road Improvement Project is sanctioned by Spokane County, the improvements required (curb, sidewalk, drainage control and paving to existing pavement) will be at the sole expense of the undersigned owner(s), their heirs, grantees and assigns. This provision is applicable to Nora Avenue. 9. As an alternadve method of constructing the road improvements stated herein, the applicant may, with the approval of the County Engineer, accomplish the road improvements stated herein by joining and participating in a County Road Project (CRP) to the extent of the required road 'unprovements. At such ti.me as an RID is created or any Road Improvement Project is sanctioned by Spokane County, the improvements required (curb, sidewalk, drainage control and paving to exisdng pavement) will be at the sole expense of the undersigned owner(s), their heirs, grantees and assigns. This provision is applicable to Nora Avenue. 10. The following statement shall be placed in the plat dedication: "The owner(s) or successor(s) in interest agree to authorize the Counry to place their name(s) on a petition for the formadon of a Road Improvement District (RID) by the peddan mechad pursuant to Chapter 36.88 RCW, wbich peation includes the owner(s)' property, and further not to object, by the signing of a ballot, to the fonnation of an R1D by the resalution method pursuant to Chapter 36.88 RCW, which resolution includes the owner(s)' property. 1f an R.ID is formed by either the petition or resolution method as provided far in Chapter 36.88 RCW, the owner(s) or successor(s) further agree: (a) that the improvement(s) or construction contemplated within the proposed RID is feasible; (b) that the benefits to be derived frvm the formaeon af the RID by the property included therein, together with the amount of any County participation, exceed the cost and expense of formation of the RID; and (c) that the property within the proposed RID is sufFciendy developed. The RID waiver contained in this agreement shall expire after ten (10) years from the date of execucion below. However, the owner(s) or successor(s) agree that if said RID waiver expires without construction of the required improvements, the owner(s) or successor(s) agree to construct the requireti improvements at their own expense, pay to Spokane County the then estimated cast af the required improvements to enable the County to complete the same, or furnish a bond or other secure method suitable to the County (which may include the execution of another RID waiver agreement) providing for or securing to the County the actual construction of the improvements. All of the requirements of this agreement shall run with the land and shall be binding upon the owner(s), their successor(s) or assign(s)." This provision is applicable to Nora Avenue. 11. The County Engineer has designated Typical Roadway Section Number One, Local Access Standard for the improvement of Nora Avenue, which is adjacent to the proposed development. Ttus will require the addidon of approximately 8-10 feet of asphalt along the frontage of the development. 'fhe construction of curbing and sidewalk is also required. 12. The proposed subdivision shall be improved to the standards set forth in Spokane County Board of Commissioners Resolution No. 80-1592, as amended, which resalution establishes nguladons for roads, approaches, drainage and fees in new construction. The Counry Engineer has examined this development proposal and has determined that the impact of this proposal upon the existing county road system warrants the dedication of additional right-of-way and the roadway improvements herein specified. 14. There may exist utilides, either underground or overhead, affecting the subject property, including property to be dedicated or set aside for future acquisition. Spokane County assumes no financial obligation for adjustments or relocation regarding these utiliees. Applicant(s) should check with the applicable utility purveyor and the Spokane County Engineer to deternune whether applicant(s) or the utility is responsible fvr adjustment or r+elocation costs and to make arrangements for any necessary work. COUNTY HEALTN DISTRICT CQNDITtqNS 1. The final plat shall be designed as indicated on the preliminary plat of record and/or any attached sheets as noted. 2. Appropriate utiliry easements shall be indicated on copies of the preliminary plat of record for distribution by the Planning Department to the utility companies, Spokane County Engineer and the Spokane County Health District, Written approval of the easements by the utility companies must be received prior to the submittal of the final plac. 3. Sewage disposal method shaU be as authorized by the Director of Utilities, Spokane Counry. 4. Water service shall be coordinated through the Director of Utilities, Spokane County. . 5. Water service shall be by an exisdng public water supply when approved by the Regional Engineer (Spokane), State Department of Health. 6. Prior to filing the final plat, the sponsar shall demonstrate to the sadsfacdon of the Spokane County Health District that an adequate and potable water supply is available to each tract of the plat. 7. Prior to filing the final plat, thc sponsar shall present evidence that the plat lies within the recorded service area of the water system proposed to serve the plat. 8. A public sewet system will be made available for the plat, and individual service will be provided to each tract prior to sale.
