THIS MATTER, an application for subdivision of land, from James W. Hughes has been
received and decided upon, pursuant to Spokane County Subd.ivision regulations, on June
1994.
FINDINGS UF FACT AND CONCLUSIUNS
1. The individual signing below bas further been properly delegated the responsibility for
rendering the decislon by the Spokane County Director of Planning.
2. The praposal is to divide appraximately .62f acres into 21ots for single family uses and
those uses permitted in the underlying Urban Residential-3.5 (UR-3.5) zone.
3. The proposal is generally located at the Southeast corner of the intersectinn of 19th and
Felts Road in the NE 1/4 of Section 29, Township 25 Nonh, R1nge 44 E.W.M. Spokane
County, Washington.
4. The existing zoning of the property described in the application is Urban Residential-3.5
(UR-3.5), previously established as Agriculturai zoning in 1952 and redesignated to
Urban Residential-3.5 (UR-3.5) on January 1, 1991 consistent with the Program to
Implement the Spokane County Zoning Code. Fursuant to RCW 58.17.195 the proposal
does conform to the requirements of the existing Urban Residential-3.5 (UR-3.5) zone.
5. The Spokaae County Comprehensive Pla.n designates this area as Urban. The
develapment and uses propos+ed are generally in accord with this category.
6. The site is currently occupied by a single family r+esidence and one detached accessory
structure. The accessory structure has the appearance and character of a small barn,
however; it appears to be used solely for storage as there aze no animals being kept on site
at this time. The surnounding uses are all single family includ.ing some large aaimal
keeping (horses). T'he Chester Terrace Subdivision borders the property to the west and
has typically smaller lots than the Chester Hills subdivision of which the proposed short
plat is a part. The Chester Hills Community Swimming pool and some of Water District
#3's facilities are located approximately 300 feet south of the site.
7. The requir+ed public nodce was provided for this proposal and agencies having a potential
interest in the project were notified and recommendarions solicited.
g. Written comments were received from ad joining property owners expressing concerns for
the possibility of a duplex being constructed on one or both lots, the size of the parcels
being created relative to the neighborhood character, increased a-affic on Felts Road in this
area and the suitability of the site in area and location over the aquifer far a septic system,
especially given that the area is subject to an approved ULID for sewer.
The Spokane County Planni.ng Department has also received a petidon from property
owners immediately adjoining or neighboring the site under consideration. Their concerns
are similar and they i.nclude a perveived change in character with regards to size of lots
which represents a significant departure from what has been in Chester Hills. The
petidooers are also opposed to duplexes which current zoning allows and they are
concemed that the location of another driveway cut near the intersection of 19th and Felts
Road would further add to the congestion at that intersection. The peationers have
expressed concerns as well for the viability of on-site sewage disposal for a new dwelling
unit, the availa.ble building space given the required setbacks and the possible avoidance of
sewer changes pursuant to the ULID by reducing the lot size to 1 acre or less.
~ 9. The site is locateci vvithin the Public Transit Benefii Ar+ea (PTSA). Route #22,
Valley/32nd Avenue feeder, provides service to the Pence-Cole Valley Transit Center at
4th Avenue & Universiry.
10. The Spokane County Arterial Road Plan identifies Felts Road as a Local Access Street
with an existing Right of way width of 60 feet.
11. The proposed short plat will be served by a public water system. Waste water d.isposal
will be as authoriz.ed by the Director of Utilities.
12. The Cenual Valley School District No. 356 has commented on the proposed short plat.
The District has indicated that existing school facilides are i.nadequate to serve the
propased short plat and wishes to negotiate with the owner to provide adequate capital
facilities as required by the Revised Code of Washington (RCW) 58.17.110. Review by
county legal counsel indicates the condition requested by the School District can be
required for developments. Approval of this short plat should include conditions requiring
that provisions for appropriate facilities be in place prior to recording this final short plat in
the form of a written agreement between the property owner and the school district.
13. The Spokane County Parks Department has commented on the proposed short plaL The
Parks Department has requested a voluntary agreement be completed between the Parks
Deparmnent and the property owner to rrungate impacts to the County Park system.
Counry legal counsel has indicated such agreements can be required. The Spokane
County Planning Departinent recommends the property owner negotiate with the Spokane
County Parks Department to provide for appmpnate capital facilities as required by the
Revised Code of Washington (RCVV) 58.17.110. Approval of this short plat should
include conditions requiring that provisions for appropriate facilides be in place prior to
recording this final plat in the fonn of a written agreement between the owner and the
Spokane County Parks Deparcment.
14. The proposed short plat is located in Spokane County Water District #3 which provides
service to the site. A potable water supply must be provided to each 1ot prior to final plat
approval.
15. Recognizing the recomineaded cond.itions and Spokane County development standards,
the proposed short subdivision makes appropriate provisions for the public health, safety
and generral welfare and that the public use and interest will be served by platting the
proposed short subdivision.
The subdivision proposal is generally consistent with RCW 58.17 and the Counry
subdivision regulations, promoting the public health, safety and general welfare in
accordance with standards established by the state and Spokane County. The Planning '
Department has considered the provision of public facilities as cited in RCW 58.17.110
(2). More spwifically:

16. The project is exempt from environmental review under the State Environmental Policy
Act pursuant to WAC 197-11-800 (6) (a).
17. There is a 10' udlity easement, established by the plat of Chester Hills Addition, adjacent
to the west property line of this proposal
18. The accessory structure on Lot 1 is built on the udlity easement and is non-confonning
with regards to the required rear yard setback, as shown on the preliminary plat it is built
on or against the west property Iine.
One storage structure, detached, private, is permitted inside the Urban Impact Area (UTA)
boundary, limited in area to 1,500 square feet and provided setbacks and maximum
building coverage standards are met.
Subdivision of property should not allow the creation of nonconfornung setbacks for
existing structures. compliance with setback standards in the UR-3.5 zone may require
either an adjustment of the property lines or removal of the potendal nonconfonning

19. The proposed Lot 1 as submitted on the preliminary plat of 7une 13, 1992 does not
conform to the minimum requirements of Chapter 14.616.310 of the Zoning Code of

Spokane County Washington. The aforementioned citatian speaks to the Minimum Lot
are of the Urban Residential-3.5 (UR-3.5) zone wbich riequires 10,000 square feet
minimum for siagle family residences. ~
20. The buildable are.a of Lot 1 is extremely limited due to the Configuration of the lot rand the I~
applicable setback requirements of the existing Urban Residential-3.5 (UR-3.5) zone.
21. The site is currently subject to a zoning enforcement action, Fi2e # CV 103-94.
DECISIQN
Based upon the above noted Findings of Fact and Conclusions, Short Plat Application SP-
953-94 is hereby APPROVED until July l, 1997, subject to conditions noted below.
Most of the conditions of approval shall be accomplished by the applicant and/or sponsor
prior to finalization of the short subdivision. This decision is final unless appealed in
writing, consistent with adopted appeal procedures.
PLANNING DEPARTMENT CONDITIONS
1. All conditions imposed by the Planning Department shall be bindi.ag on the "Applicant",
which term shall include the owner or owners of the property, heirs, assigns and
successors.
2. The proposal shall comply with the Urban Residential-3.5 (UR-3.5) zone as amended.
3. The final pIat shall te designed substantially in conformance with the preliminary plat of
record. No increase in density or number of lots shaU occur without a change of condition
application submittal and approvai.
4. The Planning Director/designee shall review any proposed final pl-At to ensure compliance
with these Findings and Conditions of Approval.
5. Appropriate road name(s) shall be ind.icated.
6. The preliminary plat is given condiaonal approval for three (3) years, specifically to July
1, 1997. The applicant may request an extensian of rime by submitting a written request
appraximately forty-five (45) days prior to the above expiration date.
7. Appropriate utility easements shall be indicated on copies of the proposed final plaL
Written approval of utility easements by appropriate utility companies shall be received
with the submittal of the final plat.
8. T'hree (3) current certificates of dde shall be furnished to the Planning Department prior to
filing the finai plat.
9. The final plat map shall indicate by a clear, dashed line the required yard setbacks from alI
private, "Tract X" or public roads and side and rear property lines. The dedication sball
cantain the following statement:
"Side yard and rear yand setbacks shall be deternuned at the time building perrnits are
requested unless these setbacks are specificaily drafted oa t6is final piat. The setbacks
indicated on this plat may be varied from if proper zoning approvals are obtained."
10. A plan for water facilities adequate for domestic service and fire protection shall be
approved by the water punreyor, appropriate fire protection district, County Building &
Safety Department and County Health DistricG The agencies will certify on the Water
Plan, prior to the filing of a final plat, that the plan is in conformance with their respective
needs and regulations. The Water Plan and certification shall be drafted on a transparency
suitable for reproduction and be signed by the plat sponsor.
11. The water purveyor Shall certify that appropriate contractual arrangements and schedule of
improvements have been made with the plat spoasor for construcdon of the water system
in accordance with the approved Water Plan. The time schedule shall provide for
completion of the water system and inspection by the appropriate health authoriaes prior to
application for building permits within the final plat. The arrangements or agreements

shall include a provision holding Spokane County and the purveyor harmless from Claims
by any lot purchaser refused a building pennit due to the failure of the subdivision sponsor
to satisfactorily complete the appmved water system.
12. 1'he final plat dedication shall contain the following statement:
"The public water system, pursuant to the Water Plan approved by county and state health
authorities, the local fire protection district, County Building & Safety Departmeat aad
water purveyor, shall be installed within this subdivision, and the applicant shall provide
for individual domestic water service as well as fire protection to each lot prior to sale of
each lot and prior ta issuance of a building pernut for each lot."
13. No building permit will be issued far any lat within the final piat until certified by a
Washington state-licensed engineer that the water systera has been installed pursuant to
the approved Water Plan for the final plat" including a signed license staznp. The
cerdfication may be in the farm of a letter, but is preferred to be certified on a copy of the
Water Plan as a schematic map showing the "as-built" water system.
14, The Water Plan and the above four (4) condidons of approval regarding the Water Plan
may be waived by the Planning Director/designee upon receipt of letters from the
appropriate water purveyor and fire protection district stating that simple connections to an
existing, approved water system will provide adequate domestic and fire protection water
to ensure the public health, safety and general welfare.
15. A survey is required prior to the filing of a final ptat.
16. The owner shall negotiate with Centi~al Valley School District and submit a recorded copy
of a voluntary agreemeni making provisions forpublic schools prior to finalization and
recording of the plaL The agreement shall provide a written description of the sabject
property to which the agneement applies and also state the dollar aznount and any other
agreed to midgating measures.
The owner shall also notify any potential purchasers who have made an agreement to
purchase property within said plat pursuant to the Revised Code of Washington (RCW)
58.17.205, that adequate provisions for school facilities must be made conditioned on a
futime agreement between the plattor and school district.
Voluntary agreements between the owner and school district shall conform to the
requirements of RCW Chapter 82.02.
17. The owner shall negotiate with the County Parks Department and submit a recarded copy
of a voluntary agreement making provisions for public parks prior to finalization and
recor+ding of the plat. The agreement shall provide a written description of the subject
property to which the agreement applies and also state the dollar amount and any other
agreed to mitigating measures.
The owner shall also notify any potential purchasers who have made an agreement to
purchase property within said plat pursuant to the Revised Code of Washington (RCVV)
58.17.205, that adequate pr+ovisions for park faciliaes must be made conditioned on a
future agreement between the plattor and Spokane County Parks Department.
Voluntary agreements between the owner and Spokane County Parks Department shall
conform to the requirements of RCW Chapter 82.02.
18. The final plat sball be addressed in accordance with the provisions of RCW 58-17-280 aad
applicable local nequirements.
19. The accessory structure on proposed Lot 1 shall be moved or removed prior to filing of the
fiaal p1aG If the accessory structure is moved to a conforming Iocation, storage or use will
not be allowed undl a pnmary pernutted use is established pursuant to the Urban
Residential-3.5 (UR-3.5) zone.
20. Each lot created by this proposal shall have a minimum lot area of no less than 10,000
square feeL
21. The 10' utility easement on the west property line of the proposed short plat shall be

COUNTY ENGINEER'S DEPARTMENT CONDITIONS
1. No construction work is to be perfarmed within the exisdng or proposed public right-of-
way until a permit has been issued by the County Engineer. All work is subjecc to
inspection and approval by the County Engineer.
2. Individual driveway access pennits are required prior to issuance of a building permit for
driveway approaches to the counry road system.
3. The word "applicant" shall inciude the owner or owners of the praperty, his heirs, assigns
and successors.
4. The County Engineer has designated Typical Roadway Section Nuaaber 2, Local access
scandard for the unprovement of Felts Road which is adjacent to the proposed
developmenL
5. The proposed subdivision shall be improved to the standards set forth in Spokane County
Board of Commissioners Resolution No. 80-1592, as amended, which resolution
establishes regulations for roads, approaches, drainage and fees in new consuuction.
6. The County Engineer has examined this development proposal and has determined that the
impact of this praposal upon the existing county road system daes nor warrant the
clcclirntinn nfadditinn;il nght-of-w:iy.
COUNTY HEALTH DISTRICT CUNDITIUNS
1. The finral plat shall be designed as indicated on the preliminury plat nf rr,c;ord and/or any
attached sheets as noted.
2. Sewage disposal method shall be as authorized by the Director of Utiiitiec, Spokane
County.
3. Water seivice shall be coordinated through the Director of Utilities, Spokane County.
4. Water service shall be by an existing public water supply when approved by the Regional
~ Engineer (Spokane), State Department of Heaith.
5. Prior w filing the final plat, the sponsor shall demonstrate to the satisfaction of the
Spokane Counry Health District that an adequate and potable water supply is available to
each tract of the plat.
6. Prior to fili.ng the final plat, the sponsor shall present evidence that the plat lies within the
recorded service area of the water system proposed to serve the plac.
7. Prior to filing the final plat, the spoasor shall demonstrate to the satisfaction of the
Spokkanne County Health District that a suitable site(s) for on-site sewage disposal system is
available on tract 1.
g. Subject to specific application approval and issuance of pernuts by the health officer, the
use of (an) individual on-site sewage disposal system(s) may be authorized.
9. The dedicatory language of the plat will state: "Subject to specific application approval and
issuance of permits by the Health Officer, the use of (an) on-site sewage system(s) may be
authorized."
10. The dedicatary language on the piat shall state: "Use of private wells and water systems is
prohibited."
11. The final plat dedication shall contain the following statement: "The public water system,
purswant to the water plan approved by county and state health authorities, the local fire
protection d.istrict, County Building and Safety Department, and water purveyar, shall be
installed within this subdivision and the applicant shall provide for individual domestic
wat,er service as well as fire protection to each lotltract prior to sale of each 1ot/tract and
prior to issuance of a building pennit for each tracL"

COUNTY UTILITIES DEPARTMENT CONDITIONS
1. Any water service for this project shall be provided in accordanee with the Coordinated
Water System Plan for Spokane County, as amended.
2. Pursuant to the Board of County Commissioners Resolution No. 80-0418, the use of on-
site sewer disposal systems is hereby authorized. This authorization is conditioned in
compliance with all rules and regulations of the Spokane County Health Disuict and is
further conditioned and subject to specific application approval and issuance of pernuts by
the Health DistricL
3. The owner(s) or successor(s) in interest agree to authorize the County to place their
name(s) on a petidon for the formation of ULID by petition method pursuant to RCW
36.94, which petition includes the owner(s)' property; and further not to object by the
signing of a protest petition against the fonnation of a ULID by resolution method
pursuant to RCW Chapter 36.94 which includes the owner(s)' property. PROVIDED,
this condition shall not prohibit the owner(s) or successor(s) from objecting to any
assessment(s) on the propertyy as a result of improvements called for in conjunction with
the formadon of a iJLID by either petition or resolution under RCW Chapter 36.94.
4. Each dwelling unit shall be double-plumbed for connection to future areawide collection
systems.
DIVISION OF BUILDING CONDITTONS
1. The applicant shall contact the Departrnent of 8uildings at the earliest possible stage in
order to be informed of code requirements adrrunisteredlenforced as authorized by the
State Building Code Act. Design/development concerns include: Addressing; fire
apparatus access roads; fire hydrant/IIow; approved water systems; building accessibility;
construction type; occupancy classificadon; exiting; exterior wall pirotection; and energy
code regulations. (Note: The Department of Buildings reserves the right to confirm the
actual address at the time of building permit.)
