driveway, may sue and recover damaqes and attorneys' fees from any

who refuses to participate in the driveway and drainage facilities

6. WARNING: Spokane County has no responsibility to build,
improve, or maintain or otherwise service the private driveways and
associated drainage facilities contained within or providinq
service to the property described in this Development. By
accepting this development or subsequently by allowinq a building
permit to be issued for property on a private driveway, Spokane
County assumes no obliqation for said private driveway and the
owners hereby acknowledqe that the County has no obliqation of any
kind or nature whatsoever to establish, examine, survey, construct,
alter, repair, improve, maintain, provide drainage or snow removal
on a private driveway or its associated drainage facilities.
7. Whenever the Lot Owners or th rUuccebsors in interest fail to
maintain the drainaqe facilities in conformance with Spokane County
drainaqe standards, a notice w be qiven to the lot owners or
their successors in interest by the County. If not corrected after
10 days, the County has the right to correct the maintenance
failure or have it corrected at the expense of the lot owriers or
their successors in interest or lots in the development.
8. Spokane County does not accept the re8ponsibility of maintaining
the drainage course on private lots within drainage easements or
floodplain areas, nor the responsibility for any drainage,
whatsoever, including but not limited to inverse condemnation to
any properties due to deficient construction and/or maintenance of
drainage courses in drainaqe easements on private property.
9. This covenant and aqreement shall run with the land and shall be
binding upon the owner, their heirs, successors or assigns,
includinq the obligation to participate in the maintenance of the
private driveway and drainage facilities as provided herein.

1. Reimburse Spokane County for prdject review and inspectinn fees as specified in Chapter

SHORT PLAT N4. SP-1075-96 ) CONCLUSIONS AND
DECISIUN
THIS MATTER, an application for subdivision of land from Vern Olson has been received
and d ided upon, pursuant to Spokane County Subdivision regulations, oa the
.~~1~?~ day of June, 1996.
FINDINGS OF FACT AND CONCLUSIONS
1. The individual signing below has further been properly delegated the responsibility for
rendering the decision by the Spokane County Director of Building and PIanning.
2. The proposal is to divide approximately 1.4 acres into 3 tracts for 1 existing single
family residence and 2 new additional residential tracts and those uses permitted in the
Urban Residential-3.5 (UR-3.5) zone.
3. The proposal is located north of and adjacent to Sprague Avenue and approximately
750 feet west of Barker Road in the SE 1/4 of Section 18, Tovvnship 25 North, Range
45 E.W.M. Spokane County, Washington.
4. The existing zoning of the property described in the applicadon is Urban Residential-
3.5 (iJR-3.5), previously established as Agricultural (A) (file # 376-58) zoning in 1958
and redesignated to UR-3.5 on January 1, 1991, pursuant to the Program to Implement
the Spokane County Zoning Code. Pursuant to RCW 58.17.195 the proposal does
conform to the requirements of the existing UR-3.5 zone.
5. The Spokane County Comprehensive Plan designates this area as URBAN. The
development and uses, as proposed and conditioned are in compliance with this
category.
6. Surrounding uses are primarily commercial, industrial and single family residences on
mixed urban si2e lots.
7. The Spokane County Arterial Road Plan identifies Sprague Avenue as a Minor Arterial
with a fuhue right of way width of 80 feet. Tbe existing right of way width is 60 feet.
In order to implement the Arterial Road Plan, a stdp of property 8 feet in widtb along
the Sprague Avenue frontage is to be set aside as a Future Acquisition Area. In
addition, the County Engineer has requested a dedication of 2 feet of addidonal right of
way along Sprague Avenue. Therefore, as conditioned, (such as improvements,
dedication, sidewalks and acquisition areas) the proposal conforrms to the Road Plan.
8. The site is located within the Public Transportation Benefit Area (P'TBA). T'he Spokane
' Transit Authority (STA) East Sprague Route # 9 provides connecting services to the
site.
9. The proposed short plat will be served by a public water system. VWaste water disposal
will be as authorized by the D'uector of Utilities.
10. The reguir+ed public notice was provided for this proposal and agencies having a
potential interest in the project were notified and reconunendations solicited.
11. No written comments were received from anny adjoiaing property owners.
12. Recognizing the recommeaded conditions and Spokane County development standards,
the proposed short plat makes appropriate provisions for the public health, safety and
general welfare and that the public use and interest will be served by platting the
subdivision.
The subdivision proposal is generally consistent with RCW 58.17 and the County
subdivision reguladons, promoting the public heaith, safety and general welfare in
accordance with standards established by the state aad Spokane Couaty. The Building
and Planning Division has considered ihe provision of adequate public facilities as cited
in RCW 58.17.110 (2). Mone specifically:

b. drainage ways g. parks and recreagon facilities
c. public and/or private rights-of-way h. playgrounds
d. transit i. schools and schoolgrounds
e. potable water j. sidewalks
13. The project is exempt from environmental review under the State Environmental Policy
Act pursuaat to WAC 197-11-800 (6) (a).
14. The Central Valley School District has commented on the proposed Short Plat. The
District has ind.icated that existing school facilities are inadequate to serve the proposed
short plat and wishes to negodate with the owner to provide adequate capital facilities as
required by the Revised Code of Washington (RCW) 58.17.110. Review by County
legal couasel indicates the condition requeste,d by the School District can be required for
developments. Approval of this short plat should include conditions requiring that
provisions for appropriate facilities be in place prior to recording the final sbort plat in
the form of a written agreement between the owner aind the school district.
DECISION
Based upon the above noted Findings of Fact and Conclusions, Short Plat Application SP-
1075-96 is hereby APPROVED for five (5) years, specifically to July 1, 2001 and subject to
conditions noted below. This decision is final uoless appealed in writing, consistent with
adopted appeal procedures. All the below conditions imposed shall be binding on the
"Applicant", which term shall include the owaer or owners of the property, heirs, assigns and
successors.
COUNTY DIVISION OF BUILDING AND PLANNING CONDITIONS
1. The proposal shall comply with the Urban Residential-3.5 (UR-3.5) zonea a.s ameaded.
2. The final plat shall be designed substantially in conformance with the prelimi.nary plat
of record. No increase of deasity or number of tracts shall occur without a change of
condition application subrtuttal and approval.
3. The Building and Planning Director/designee shall review any proposed final plat to
ensure compliance with these Findings and Conditions of Approval.
4. The pr+eliminary plat is given conditional approval for five (5) years, specifically to July
1, 2041. The applicant may request an extension of time by submitting a written
request approximately forcy-five (45) days prior to the above expiration date.
5. Three (3) current certificates of tide shall be furnished to the Building and Planning
Division prior to filing the final plat.
b. Appropriate utility easemeats shall be indicated an copies of the proposed final plat.
Written approval of utility easements by appropriate utility companies shall be received
with tbe submittal of the final plat.
7. Prior to filing of final plat, the appmpriate road aame(s) and str+eet address(es) shall be
indicated.
8. The final plat mag shall indicate by a clear, dashed line the required yard setbacks from
all private, "Trnct X" or pubIic roads. The dedication shall contain the fnllowing
statement:
"Side yard and rear yard setbacks shall be determined at the time build.ing permits ace
requested unless these setbacks are specifically drafted on this final plat. The setbacks
indicated on this plat may be varied from if proger zoning approvals are obtained."
9. The Spokane County Division of Building and Planning shall prepare and record with
the County Auditor a Title Notice specifying a future land acqwsition area for road
right-of-way and utilities. The reserved future acquisition area Tide Notice shaill be
released, in full or in part, by the Building and Planning Division. The notice should
be recorded the same time as the final plat and shall provide tile following:

a. A strip of property 8 feet in width from the exisdng right of way is reserved far
future acquisition area for additional road right•of-way along Sprague Avenue.
b. Future build.ing and other setbacks required by the Spokane County Zoning
Code shall be measured from the reserved future acquisition area.
c. No required landscaping, parking, '208' areas, drainfield or allowed signs
- should be located withia the future acquisitioa area for road right-of-way and
utilities. If any of the above improvements are made within this area, they shall
be relocated at the agplicant's expense when roadway iznprovements are made.
d. The future acquisition area, until acquir+ed, shall be private pnoperty and may be
used as aUowed in the zone, except that any improvements (such as
landscaping, parking, surface drainage, drainfield, signs or others) shall be
considered interim uses.
e. The property owner shaU be responsible for relocatiang such "iaterim"
improvements at the time Spokane Cocinty makes roadway improvements after
acquiring said future acquisition area. .
10. No water ptan is required, only a simple connection will be needed prior to the sale of
each tract and prior to issuance of a building permit for each tract.
11. The owner shall negotiate witb Central VaUey School District and submit a recorded copy of a voluntary agr+eement making provisions for public schools prior to
fin,alizarion and recording of tbe plat. The agreement shall provide a writren description
of the subject property to which the agreement applies and also state the dollar amount
and any other agreed to mitigatiag measures.
The owner shall also notify any potential purchasers who have nlade an agreement to
puichase property within said plat pursuant to the Revised Code of Washington (RCV)
58.17.205, that adequate provisions for school facilities must be made conditioned on a
future agreement between the plattor and school district.
Voluntary agreemeats between the owner and school district shall confonn to the
requirements of RCW Chapter 82.02. -
12. A survey is required prior to the filing of a final plat.
13. The applicant shall contact the Division of Building and Planning at the earliest possible
stage in order to be informed of code requisements admi.nistered/enforced as authorized
by the State Building Code Act. Design/development concerns include:
ADDRESSING, FIRE APPARATUS ACCESS ROADS; FIItE HYDRANT/FLOW;
• APPROVED WATER SYSTEMS; BUILDING ACCESSIBILITY; CONSTRUCTION
TYPE; OCCUPANCY CLASSIFICATION; EXITING; EXTERIOR WALL
PROTECTION; AND F;NERGY CODE REGULATIONS. (Note: The Division of
Building and Planning reserves the right to conf'um the actual address at the time of
buildiag pemait.) .
COUNTY DIVISION OF ENGINEERING AND ROA►DS CQNDITIONS
1. The conditional approval of the plat is given by the County Engineer subject to dedication
of right-of-way and approval of the road system as indicated in the preliminary plat of
record.
2. Drainage plans and design ca]culations showing the aiignment of drainage facilities shall be
submitted to the County Engineer for acceptance prior to construction andlor the filing of
the final plat. Drainage plans to be prepared under the d.irection of a liceased Professional
Civil Engineer.
3. No constructi4n work is to be performed within the existing or proposed public right-of-
way until a pemut has been issued by the County Engineer. All work is subject to
inspection and approval by the County Engineer.
4. Individual driveway access pennits are required prior to issuaace of a building permit for
driveway approaches to the County road system.
5. Dedication of 2 feet of additional right-of-way along Sprague Avenue is required.

8. To construct the road improvements stated herein, the applicant may, with the approval of

purpose is the formation of a Road Impmvement District (RID) for said improvements,
pursuant to RCW 36.88, as amended. At such time as an RID is created or any Road
Improvement Project is sanctioned by Spokane Counfiy, the improvements requined (curb,
sidewalk, drainage control and paving to existing pavement) will be at the sole expense of
the undersigned owner(s), their heirs, grantees and assigns. This provision is applicable to
Sprague Avenue.
9. As an alternative method of constructing the road improvements stated herein, the applicant
may, with the approval of the County Engineer, accomplish the road improvements stated herein by joining and participating in a County Road Project (CRP) to the extent of the
required road improvements. At such time as an RID is created or aay Road Improvement
Project is sanctioned by Spokane County, the improvements required (curb, sidewalk,
drai.nage control and paving to existing apavement) wllI be at the sole expense of the
' undersigned owner(s), their heirs, grantees and assigns. This provisioa is applicable to
Sprague Avenue.
10. The following statement shall be placed in the plat dedication:
In consideration of Mutaal Benefits now or to be hereafter derived, do for themselves, their
' heirs, grantees, assigns and successor(s) in interest hereby request and authorize Spokane
Gouaty to include the above described property in a Road Improvement District (RID) and
to support the formation of a RID for improvement of the road(s) described below by
requesting and authorizing Spokane County to place their name(s) on a pedtion for the
formation of a RID pursuant to RCW 36.88.050, or by requesting and authorizing
Spokane County to cast their ballot in favor of a RID being formed under the resolution
method pursuant to RCW 36.$8.030, and/or by not fili.ng a protest against the formation of
a RID being forrned uader the alternative resolution method provided for in RCW
36.88.065 and Chapter 35.43 RCW.
If a RID is proposed for improvement of the road(s) described below, sa.id owaer(s)
aad successor(s) further agree: (1) that the improvements or consvruction
contemplated within the proposed RID are feasible aad (2) that the benefits to be
derived from the formation of the RID by the properry included ther+ein, together with
the amount of anny County participation, exceeds the cost and expense of foimation of
the RID, and (3) that the property within the proposed RID is sufficiently developed;
provided, themselves, their heirs, graatees, assigns and successor(s) shall retain the
right, as authorized under RCW 36.88.090, to object to any assessment(s) on the
property as a result of the improvements called for i.n conjunction with the fornLation
of a RID by either the petition or resolution method under Chapter 36.88 RCW and to
appeal to the Superior Court the decision of the Board of County Commissioners
confuming the final assessment roll; provided further, it is recognized that actual
assessments may vary from assessment estimate so long as they do not exceed a
figure equal to the increased true and fair value improvement(s) add(s) to the
property.
It is further acknowledged and agreed that at such time as a RID is created or any
County Road Improvement project is authorized tiy Spokane County, the
improvements required shall be at the sole expense of the owner(s) of property within
the RID or served by the improvements without aay monetary participation by
Spokane County.
The RID wa.iver contaiaed in this agreement shall expire after ten (10) years from the
date of executioa below. This provision is applicable to Sprague Avenue.
11. ' The County Engineer has designated a Minor Arterial Roadway Section for the
improvement of Sprague Avenue, which is adjacent to the pmposed development. This
will require the addition of approximately 18-20 feet of asphait aloag the frontage of the
developmenG The construction of curbing and sidewallc is also required.
12. The proposed plat shaU be improved to the standards set forth in Spokane County Board of
Comnnissioners Resolution No. 95-0498, as amended, which resoiution establishes
regulations for roads, approaches, drainage and fees in new construction.

13. The County Engineer has examined this development proposal and has detenmined that the
impact of this progosal upon the existing county road system warrants the dedication of
additional right of-way and the roadway improvements herein specified.
14. The County Arterial Road Plan identifies Sprague Avenue as a 80 foot Minor ArteriaL The
existing right-of-way width of 60 feet is not consistent with that specified in the Plan. In
order to implement the Arterial Road Plan, in addition to the required right-of-way
dedication, a strip of property 8 feet in width along the Sprague Avenue frontage shall be
set aside in reserve. This property may be acquired by Spokane County at the time when
arterial improvements are made to Sprague Aveaue.
15. There may exist utilities, either underground or overhead, affecting the subject property,
including property to be dedicated or set aside for futiu+e acquisition. Spokane County
assumes no financial obligation for adjustments or relocation regarding these utilities.
Applicant(s) should check with the applicable utility purveyor and the Spokane County
Engineer to deternune whether applicant(s) or the utiliry is responsible for adjustinent or
relocntion costs and to make arrangements for any necessary work.
16. The applicant shaU grant applicable border easements adjacent to Spokane County Right of
Way per Spokane County Standards.
CUUNTY DIVISION OF UTILITIES CONDITIONS
1. Pursuant to the Board of County Commissioners Resolution No. 80-04I8, the use of
on site sewer disposal systems is hereby authorized. This authorization is conditioned
in compliance with all rules and regulations of the Spokane County Health District and
is further condidoned and subject ta spec'ific applicadon approval and issuance of
pemnits by the Health District.
2. The following statement shall be placed in the plat dedication:
"The owaer(s) or successor(s) in interest agree to authorize the County to place their
name(s) on a petition for the formation of ULID by petition method pursuant to RCW
36.94, which petition includes the owner(s)' property; and further not to object by the
signing of a protest petition against the formation of a ULID by resolution method
pursuant to RCW Chapter 36.94 which includes the owner(s)' property. PROVIDED,
ttus condition shaU not prohibit the owner(s) or successor(s) from objecting to any
assessment(s) on the property as a result of improvements called for in conjunction
with the formation of a ULID by either petition or resolution under RCW Chapter
36.94."
3. The ded.icatory language on the plat shall state: "Each new unit shall be double
plumbed for connection ta future area-wide collection systems."
4. Sewer easement shall be shown on the face of the plat as "Sewer and Utilities
Easement".

successor(s) shall retain the right, as authorized under RCW

of the owner(s) of property within the RID or served by the
improvements without any monetary participation by Spokane County.
The RID waiver contained in this agreement shall expire after ten
(10) years from the date of execution below. This provision is
applicable to Sprague Avenue.
24 The County Engineer has designated a Minor Arterial Roadway Section
for the improvement of Sprague Avenue which is adjacent to the
proposed development. This will require the addition of approximately
18-20 feet of asphalt along the frontage of the development. The
constructian of curbing and sidewalk is also required.
32 The proposecl plat shall be improved to the standards set forth in
Spokane County 8oard of Commissioners Resolution No. 95-0498, as
amended, which establishes regulations for rcads, approaches, drainage
and fees in new construction.
33 The County Engineer has exarnined thia development proposal and has
determined that the impact of this proposal upon the existing County
Road System warrants the dedication of additional Right of Way and the
roadway improvements herein specif ied.
61 The County Arterial Road plan identifies Sprague Avenue as a 80 foot
Minor Arterial. The existing right of way width of 60 feet is not
consistent with that specif ied in The Plan. In order to implement che
Arterial Road Plan it is recommended that in addition to the required
right of way dedication, a strip of property e feet in width along the
Sprague Avenue frontage be set aside in reserve. This property may be
acquired by Spokane County at the time when Arterial Improvements are
made to Sprague Avenue.
