Avenue. The property has a small house and garage with tawn and pasture. The ground
has a slight slope toward Tschirley as shown on copy of Short Plat.
The pre-development condition has a calculated Q of 0.84 cfs. Developed condition with

Gentlemen:
Based on the date of the initial plan submittal for this project, and in accordance with the
Spokane County Engineer's Policy Memorandum dated April 1, 1996, this project is governecl
by ebe application process outlined in the edition of the Spokane County Standards for Road and
Sewer Construction effective 15 May 1995.
We are returning this submittal urueviewed. We note that the following items have not yet been
accomplished:
The Fee Agreement, signed by the Praject Sponsor, has not yet been provided
The Fee Agreement is reyuirexi, as Plan Review services are not supported by either the General Funel
or the Raad Fund.
~ The Pre-Design eouference between the Sponsor's Design Engineer ancl the
County Engineer's staff representative has aat yet been condueted
Amang other things, the application and review prncess in this edition af the Staadards requires that a
Pre-design conference between the Spnasnr°s Design Engi.neer and the County Engine.er's staff
representative be conducted to ensure that the Coaditions af Approval aze understood, and that there is
caacurrence as to the drainage concept and the design parameters far the drainage concept. This is
intended to minimize dra.stic; Changes in raad layouts and draiaage eoneepts during the plan review phase
di the proje;t.

We have reviewed this letter which you submitted in an attempt to provide certification of
construction for drainage facilities on this project. We will not ac.cept this l+etter as certification,
as it dve.s not bear a signed, daced stamp of a Washington State-licensed Professional Engineer.
You should be aware that the Washington Administcative Code requires that such items bear a
P.E. stamp.
We also did not receive plans stanlped as "Record Drawings" a nor have vve received any Daily
Inspection Reports. We also note that the asphalt restoration which was promised by you to be
completeti in Spring of 1996 is still not completed (as stated in your letter), and we are now past
mid-Summer. Please refer also to Dennis Scott's letter of January 10, 1996 (which you agreed
to).

Richard and Barbara Richard Jr. } DECISION
THIS MATTER, an application for subdivision of land, from Richard and Barbara Richard
Jr. and decided upon, pursuant to Spokane County Subd.ivision regulations, oa the
day of May, 1996.
FINDINGS OF FACT AND CONCLUSIONS
1. The individual signing below has further been properly delega,ted the responsibilitv 1e:
rendering the decision by the Spokane County Director of Building and Planning.
2. The proposal is to divide approacimately 1.8 acres into 41ots for 1 exi.sting residence
and 3 new residential lots or those uses permitted in the Urban Residential-3.5 (UR-
3.5) zone.
3. The proposal is lacated at the nortbeast corner of the intersection of Sixth Avenue and
Tschirley Road, in the NW 1/4 of Section 19, Township 25 North, Range 45 E.W.M.
Spokane County, Washington.
4. The existing.ZOtung of the property described in the application is Urban Residential-
3.5 (JR-3.5) zone. The subject property was previously established a.s Agricultural in
1957 (File No. 286-57), and redesignated to Urban Residential-3.5 (UR-3.5) on
January 1,1991, pursuant to the Program to Implement the Spokane County Zoning
Code. Pursuant to RCW 58.17.195 the proposal does coaforrn to the requirements of
the existing zone.
5. The Spokane County Comprehensive Plan designates this area as Urban. 1'he
development and uses, as proposed and conditioned are in compliance with this
category.
6. Surrounding uses consist of residential uses.
7. The required public notice was provided for this proposal and agencies baving a
potential interest in the project were notified aad recommendations solicited. No
comments were received from adjacent pmperty owners.
8. The Spokane County Arterial Road PIan identi5es Sixth Avenue as a Local Access with
a future right of way width of 60 feet. The existing right of way width of 50 feet is not
consistent with that specified in The Plan. In onier to implement the Arterial Road
Plan, a strip of property 5 feet in width along the Sixth Avenue frontage shall be set
aside in reserve as Future Acquisition Area (FAA). This property may be acquired by
Spokane Couaty at the time when Arterial Improvements are made to Sixth Avenue.
As conditioned, the proposal coaforms to the Plan.
The County Engineer has designated a Minor Arterial Roadway Section for the
improvemeat of Sixth Avenue. This wilI require the addition of approximately 5-7 feet
of asphait along the frontage of the development. The construction of curbing and
sidewalk is also required. As cond.itioned, the proposal confonns to the Plan.
9. The Spokane Couaty Arterial Roa ' ntifies Tschirley Road as a Local Access
with a future right of way width 6 e ej ' ht of way width of 40 feet

provisions for appropriate facilities be in plaz prior to recording the final short plat in
the form of a written agreement between the owner and the school district,

welfare and that the public use and interest will be served by platting the subdivision.
14. The subdivision proposal is generaUy consistent with RCW 58.17 and the County
subdivision regulations, promoting the public health, safety and general welfare in
accordance with standards established by the state and Spokane County. The Division
of Planning has considered the provision of adequate public facilicies as cited in RCW
58.17.110 (2). More specifically:

b. drainage ways g. parks aad recreation facilities
c. public aad/or private rights-of-way h. playgrounds
d. transit i. schools aad schoolgrounds
e. potable water j. sidewalks
DECISION
Based upon the above noted Findings of Fact and Conclusions, Short Plat Application
SP 1073-96 is hereby APPROVED until June 1, 2001, subject to conditions aoted below.
This decision is fiaal unless appealed in writing, consistent with adopted appeal procedures.
All below coaditions imposed shall be binding on the "Applicant," which term sball include the
owner or owners of the property, heirs, assigns and successors.
COUNTY DIVISION OF BUILDING AND PLANNING CONDITIONS
1. The proposal and future development of this property shall comply with the Urban
Residential-3.5 (UR-3.5) zone, as ameaded.
2. The final plat shall be designed substandally in conformance with the preliminary plat
of record. No increase of density or number of lots shall occur without a change of
condition applicaaon submittal and approval.
3. The Planning Director/designee shall review any proposed final plat to ensure
compliance with these Findings and Conditions of Approval.
4. The prelirninary plat is given conditional approval for five (5) yeazs, specifically to June
1, 2001. The applicant may request an extension of time by submitting a written
request approximately forty-five (45) days prior to the above expiration date.
5. Three (3) current certificates of title shall be furnished to Spokane Division of
Planning prior to filing the final plat.
6. Appropriate utility easements shall be indicated on copies of the proposed final plat.
Written approval of utility easements by appropriate utility companies shall be received
with the submittal of the final plat.
7. Prior to filing of final plat, the appropriate road aame(s) and street address(es) shall be
indicated.

9. The Spokane County Division of Planning shall prepare and recor+d with the County
Auditor a Tide Notice specifying a future land acquisition area for road right-of-way
and utilities. The reserved future acquisition area Title Notice shall be relea.sed, in full
or in part, by the Division of Planning. The notice s6ould be recorded alth tbe final
plat and shall provide the following:
a. A strip of praperty 5 feet in width from the existing right of way along the Sixth
Avenue frontage is to be set aside as Futwe Acquisltion Area (FAA) for
additional road right of way.
b. A strip of property 10 feet in width from the existing right of way along the
Tschirley Road froatage is to be set aside as Future Acquisition Area (FAA) for
addidonal road right of way.
c. Futune building and other setbacks required by the Spokane County Zoning
Code shall be measur+ed from the reserved future acquisition area
d. No required landscaping, parking, `208' areas, drainfield or allowed signs
should be located witlv.n the future acyuisition area for road right of-way and
utilities. If any of the above improvements are made within this area, they shall
be relocated at the applicant's expense when roadway improvements are made.
e. The future acquisition anea, until acquired, shall be private property and may be
used as allowed in the zone, except that any improvements (such as
landscaping, parking, surface drauiage, drainfield, signs or others) shall be
considered interim uses.
f. The property owner shall be responsible for relocating such "interim"
improvements at the time Spokane County makes roadway improvements after
acquiring sa.id future acquisition area
10. A plan for water facilities adequate for domesdc service and fire protection shall be
approved by the water purveyor, appropriate fire protection district, County Division of
Buildings and Couaty Health District. The agencies will certify on the Water Plan,
prior to the filing of a final plat, that the plan is in conforniance with their respective
needs and regnlations. The Water Plan and certification shall be drafted on a
transparency suitable for reproduction and be sigaed by the plat sponsor.
11. The water purveyor shall certify that appropriate contractual arrangements and schedule
of improvements have been made with the plat sponsor for construction of the water
system in accordance with the approved Water Plan. The time schedule shall provide
for completioa of the water system and inspection by the appropriate health authorities
prior to application for building permits within the fiual plat. The arrangements or
agreements shall include a provision holding Spo.kane County and the purveyor
harmless from clairas by any lot purchaser refused a building permit due to the failure
of the subdivision sponsor to satisfactorily complete the approved water system.
12. The final plat dedicadon shall contain the following statement;
"The public water system, pursuant to the Water Plaa approved by county and state
health authorities, the local fire protecdon distirict, water purveyor and Spokane County
Division of Buildings, shall be iastalled within this subdivision, and the applicant shall
provide for individual domestic watler service as well as fire protection to each [tract/lot]
prior to sale of each [tract/lot] and prior to issuance of a building permit for each
[tracVlot].11
13. No building permit will be issu+ed for aay lot within the final plat until certified by a
Washington state-licensed eagineer that "the water system has been installed pursuant
to the approved Water Plan for the final plat" i.acluding a sigaed license stamp. The
certification may be in the form of a letter, but is preferned to be certified on a copy of
the Water Plan as a schematic map showing the "as-constructed" water system,

15. The owner shall negotiate with the Central Valley School District and submit a recorded
copy of a voluntary agreement making provisions for public schools prior to
finalization and recording of the plat. The agreement shall provide a writtea description
of the subject property to which the agreement applies and also state the dollar amount
and any other agreed to mitigating measures.
The owner shall also notify any potential purchasers who have made an agreement to
pnrchase property within said plat pursuant to the Revised Code of Washington (RCW)
58.17.205, that adequate provisions for school facilities must be made conditioned on a
future agreement between the plattor and school district.
Voluntary agreements between the awner aad school district shall conform to the
requimments of RCW Chapter 82.02.
16. The final plat map shall identify each lot (e.g. Tract/Lot 1, 21 31,4).
17. The applicant shall contact the Division of Building and Planning at the earliest possi'ble
stage in order to be informed of code mquu-ements administered/enforced as authorized
by the StaLe Building Code Act. Design/development conceras iaclude: ADDRESSING,
FIRE APPARATUS ACCESS ROADS; FIRE HYDRANT/FL.OW; APPROVBD WATER

COUNTY DIVISION OF ENGINEERING AND ROA►DS CONDITIONS
1. That conditional approval of the plat by the County Engineer is given subject to
approval of the road system as indicated in tbe preliminary plat of record.

facilities be submitted to the County Engineer for acceptance prior to construction

and authorize Spokane County to include the above described property in a Road
Improvement District (RID) and to support the forniation of a Road Improvement
District for improvement of the road(s) described below by mquesting and authorizi.ng
Spokane County to plaoe their name(s) on a petition for the formation of a Road
Improvement District pursuant to RCW 36.88.050, or by requesting aad authorizing
Spokane County to cast their ballot in favor of a RID being fonned under the
resolution method pursuant to RCW 36.88.030, and/or by not filing a protest aga.inst
the formation of a RID being formed under the alternative resolution method provided
for in RCW 36.88.065 and Chapter 35.43 RCW.
If a RID is proposed for improvement of the road(s) described below, said owner(s)
and successor(s) further agree: (1) that the improvements or construction contemplated
within the proposed RID ane feasible, (2) that the benefits to be derived from the
forination of the RID by the property included therein, together with the amount of any
County participation, exceeds the cost and expense of formation of the RID, and (3)
that the property within the proposed RID is sufficiendy developed; provided,
themselves, their heirs, grantees, assigns and successor(s) shall retain the right, as
authorized umder RCW 36.$8.090, to object to any assessment(s) on the property as a
result of the improvements called for in conjunction with the formation of a RID by
either petition or resoiution method under Chapter 36.88 RCW, and to appeal to the
Superior Court the decision of the Boazd of Counry Commissioners confirming the
final assessment roU; provided further, it is recognized that actual assessments may
vary from assessment estimate so long as they do not exceed a figrune equal to the
increased true and fair value improvement(s) add(s) to the property.
It is further acknowledged and agreed that ai such time as a RID is created or any
County Road Improvement project is authorized by Spokane County, the
improvements required shaU be at the sole expense of the owner(s) of property within
the RID or served by the improvements without any monetary participation by
Spokane County.
The RID waiver contained in this agreement shall expire after ten (10) years from the
date of execution below. Tb.is provision is applicable to Tschirley Road and Sixth
Avenue.
9. T'he County Engineer has designated Local Access Roadway Section for the
improvement of Tschirley Road which is adjacent to the proposed development. This
will require the addition of approximat,ely 5-7 feet of asphalt along the froatage of the
developmeaL The coastruction of curbing and sidewalk is also required.
10. The Cou.aty Engineer has designated Local Access Roadway Section for the
impmvement of Sixth Avenue which is adjaceDt to ihe proposed development. This
will require the addition of approxi.mately 5-7 feet of asphalt along the frontage of the
development. The construction of curbing and sidewalk is also required.
11. The proposed plat shall be improved to the standazds set forth in Spokane Counxy
Board of Commissioners Resolution No. 95-0498, as amended, which resolution
establishes regulations for roads, approaches, drainage and fees in new construeaon.
12. The County Engineer has examined this development proposal and has determined that
the unpact of this proposal upon the existing County Road System warrants the
roadway improvements herein specified.
13. The applicant shall grant applicable border easements adjacent to Spokane County
Right of Way per Spokane County Standards.
COUNTY HEALTH DISTRICT CONDITIONS
1. The final plat shall be designed as iadicated on the prelinunary plat of record andlor any
attached sheets as noted.
2. Appropriate utility easements shall be iadicated Qn copies of the pr+eliminary plat of
record for d.istribution by the Plann.ing Department to the utility companies, Spokane
County engineer and the Spokane County Health District. Writtea approval of the
easements by the utility companies must be received prior to the submittal of the final
plat.

3. Sewage disposal method shall be as authorized by the Director of Utilities, Spokane
County.
4. Water service shail be coordinated thnough the Dinector of L'tilities, Spokane Couaty.
5. Wacer service shall be by an cxisting public wazer supply when appmved brti• the
Regional engineer (Spokane), State Department of Health.
6. Prior to filing the final plat, the sponsor shall demonsvate to the satisfaction of the
Spokaae County Health District that an adequate and potable water supply is available
to each lot of the plat.
7. Prior to filing the final plat, the spoasor shaU present evidence that the plat lies within
the recorded service area of the water system proposed ta serve the plat.
8. Prior to filing the final plat, the sponsor shaU demonscrate to the satisfaction of the
Spokane County Health District that suitable sites for on-site sewage disposal systems
are available on all tracts not curnently developed.
9. Prior to filing the final plat, the sponsor shall demonstrate to the satisfaction of the
Sgokaae County Health District that the existing system serving the residence located
on the developed tract is wholly located within the boundaries of the tract.
10. Subject to specific application approval and issuance of permits by the Health Offcer,
the use of individual on-site sewage disposal systems may be authorized.
11. The dedicatory language of the plat will state: "Subject to specific application approval
and issuance of permits by the Health Officer, the use of individual on-site sewage
disposal systems may be authorized."
12. The dedicatory language on the plat shall state: "ITse of private wells and water
systems is prohibited."
13. The plat dedication shaU contain a statement to the effect that: '"The public water

name(s) oa a petition for the formaaon of a ULID by petition method pursuant to
RCW 36.44 which the petition includes the Owner(s) property and further not to
object by signing of a protest petition against the formation of a UI.,ID by resolution
method pursuaat to RCW 36.94 which includes the Owner(s) property.
PROVIDED, this condition shall not grohibit the Owner(s) or Successor(s) from
objection to any assessment(s) on the property as a result of improvements called
for in the conjunction with the formation of a tJLID by either petidon or resolution
under RCW 36.94.
3. Each new uait shaU be double plumbed for connection to future area-wide collection
system.
4. Water service shaU be provided in accordance with the Coordinated Water System Plan
for Spokane County, as amended.

The new Washington State law, "Regulatory Reform" ESHB 1724 (RCW 36.70B), went into
effect March 31, 1996. The Board of County Commissioners adopted an interim process, which
establishes vdministrative rules for processing applications. The new law has required many
changes to our past procedures.
This letter is to inform you of a procedural changes regarding submittal of documents for a Fina1
Short Plat, Final Subdivision or Final Bind.ing Site Plan reviews. Past procedure was to allo«r
"piece meeall" submittal of required documents to different departments at different times, weeks and
even moaths apart. The change is that AI.L DOCUMENTS required by conditioas of approval or by
regulatioa must be submitted together as one packet to the Planning Section of the Building and
Planning Division of Spokane Counry Public Works Department.
The final review packet must be Co[1N1ER CoNeLETE before it can be circulated and reviewed.
To be counter complete all of the applicable document must be submitted with the appropriate fees.
The following ane typically required documents for a Final review:
1. PROFOSED FIIVAL, nine (9) copies of the proposed Final map with dedication;
2. PLAT CERTMCATE, three (3) copies for Final from a Title Company (not older than 6
montbs of filing the Final);
3. ASSESSOR'S MAP, current map(s) showing rhe Final outlined in red by Surveyor within
the accuracy of the County map;
4. WATER PL.AN signed by Applicant, Water Distzict, Fire District and Health District;

SUBJECT: SHORT PLAT # 1073-96 / RIC'HARD, BARBAR.A & RICHARD JR
The foilowing "Conditions of Approval" for the above referenced subdivision
are submitted to the Spokane County Planning Department for inclusion in the
"Findings and Order" should the short plat be approved.
E 1 That conditional approval of the plat by the County Engineer ia given subject to
approval of the road system as indicated in the preliminary plat of record.
E 3 That drainage plans and design calculations ahowing the alignment of drainage
facilities be submitted to the County Engi.neer for acceptance prior to conetruction
and/or the filing of the final plat. Drainage plans to be prepared under the
direction of a licensed Profeasional Civil Engi.neer.
E 6 No construction work is to be performed within the existing or propoaed Public
Right-of-Way until a permit has been issued by the County Engineer. All work is
subject to inspection and approval by the County Engineer.
E12 The applicant should be advised that individual driveway access permita are required
prior to issuance of a building permit for driveway approaches to the County road
system.
E16 Exiating County roads providing direct access to the plat shall be paved
and/or curbed to Spokane County standards.
E20 To conetruct the road improvementa atated herein, the applicant may, with the approval
of the County Eagineer, join in and be a willing participant in aay petition or
, resolution which purpoaee is the formatioa of a Road Improvement District (RID) for
eaid improvemente pureuant to RCW 36.68, as ameaded. At auch time as an RID is created
or any Road Improvement Project is sanctioned by Spokane County, the improvements
required (curb, aidewalk, drainage coatrol and paving to existing pavement) will be at
the sole expenae of the undersigned owner, their heirs, grantees a.nd assigns. This
provision is applicable to Tschirley Road and 6th P,venue.
E21 As an altemative method of conetructing the road improvement stated herein, the
applicant may, with the approval of the County Engineer, accompliah the road
improvements etated herein by joining and participating in a County Road Project (CRP)
to the extent of the required road improvement. At auch time as an RID is created or
any Road Improvernent Project is sanctioned by Spokane County, the improvementa required
(curb, sidewalk, drainage control and paving to existing pavement) will be at the sole

E22 That the following etatement shall appear within the dedicatory language of the final
plat:
T_-at in coneideration of Mutual Benefits now or to be hereafter derived, do for
themselves, their heire, grantees, assigns and successor(s) in interest hereby request
and authorize Spokane County to include the above described property in a Road
Improvemeat District (RID) and to aupport the formatioa of a Road Improvement Diatrict
for improvement of the road(s) described below by requesting and authorizing Spokane
County to place their name(a) on a petition for the formation of a Road Improvemant
District pursuant to RCW 36.88.050, or by requesting and authorizing Spokane County to
cast their ballot in favor of a RID being formed under the resolution method pursuant
• to RCW 36.88.030, and/or by not filing a protest against the formation of a RID being
formed under the alternative resolution method provided for in RCW 36.88.065 and
Chapter 35.43 RCW.
If a RID ia proposed for improvement of the road(s) described below, said owner(s) and
successor (s) further agree: (i) that the improvements or construction contemplated
within the proposed RID are feasible and (2) that the benefite to be derived from the
formation of the RID by the property included therein, together with the amount of any

County participation, exceeds the cost and expense of formation of the RID, and (3)
trLat the property within the proposed RID is sufficiently developed; provided,
p themselves, their heirs, grantees, assigns and successor(s) shall retain the right, as
authorized under RCW 36.88.090, to object to any assessment(s) on the property as a
result of the improvements called for in conjunction with the fcrmatfon of a RID by
either the petition or resolution method under Chapter 36.88 RCW and to appeal to the
Superior Court the deciaion of the Board of County Commissioners coafirming the final
assessment roll; provided further, it is recognized that actual asaeasments may vary
from asaessment eatimate so long as they do not exceed a figure equal to the increased
true and fair value improvement ( s) add ( s) to the property.
, It is further acknowledged and agreed that at such time as a RID is created or any
County Road Improvement project ia authorized by Spokane County, the improvemente
required ehall be at the sole expense of the owner(s) of property within the RID or
served by the improvemente without any monetary participation by Spokane County.
The RID waiver contained in this agreement shall expire after ten (10) yeara from the
date of execution below. This provision is applicable to Techirley Road and 6th
Avenue.
E24 . The Couaty Engineer has deeignated a I,ocal Accees Roadway Section for the improvement
of Tschirley Road which ia adjacent to the propoaed development. This will require
the addition of approximately 5-7 feet of asphalt along the frontage of the
dAvelopment. The construction of curbing and sidewalk is also required.
E24 The County Eagineer has designated a Local Access Roadway Section for the improvement
of 6th Avenue which is adjacent to the proposed development. This will require the
addition of approximately 5-7 feet of asphalt along the frontage of the development.
The construction of curbing and sidewalk is also required.
E32 The proposed plat shall be iniproved to the standards set forth in Spokane County Board
of Commiseionere Resolution No. 95-0498, aa amended, which eatablishes regulations for
roads, approaches, drainage and fees in new construction.
E33 The Couaty Engineer has examined this development proposal and has determined that the
impact of this proposal upon the existing County Road System warrants the roadway
improvements herein epecified.
SPECIAL CONDITION: The applicant shall grant applicable border eaeementa adjacent to Spokane
County Right of Way pez Spokane County Standarda.
