THIS MATTER, an application for subdivision of land, from Gordon and Lavina Knj'ght
and decided upon, pursuant to Spokane County Subdivisivn reQulations. on the ~ da%of May, 1996.
FINDINGS OF FACT AND COtiCLL'SIOtiS
1. The individual signing below has further been properly delegated the respoasibility for
rendering the decision by the Spokane County Director of Building and Planning. ~
2. The proposal is to divide approximately 1.4 acres into 2 lots for I existin sidence
and 1 new duplex or those uses perrnitted in the Urban Residential-3.5 ( ) zone.
3. The proposal is located at the southeast corner of the intersection of Eighch Avenue and
Progress Road, in the SE 1/4 of Section 23, Township 25 North, Range 44 E.W.M.
Spokane County, Washington.
4. The existing zoni.ng of the property described in the application is Urban Residentia]-
3.5 (UR-3.5) zone. The subject property was previously established as Agricultural in
1942 (File No. 60-42), and redesignated to Urban Residential•3.5 (UR-3.5) on
January 1, 1991, pursuant to the Program to Implement the Spoka.ne County Zoning
Code. Pursuant to RCW 58.17.195 the proposa] does conform to the requirements of
the existing zane.
5. The existing garage on Tract A wiU be within the new setback area as a non-confonning
use, and therefore, will not have to be removed.
b. The Spokane County Comprehensive Plan designates this area as Urban. The
development and uses, as proposed and conciitioned are in compliance with this
category.
7. Surroundi.ng uses consist of residential uses.
8. The required public notice was provided for this proposal and agencies having a
potential interest in the project were notified and recommendations solicited. No
comments were received from adjacent property owners.
9. The Spokane Counry Arterial Road Pla.n identifies Eighth Avenue as a Minor Arterial
with a future right of way width of 80 feet. The existi.ng rigbt of way width of 45 feet
is not consistent with that specified in The Plan. In order to unplement the Arterial
Road Plan, ihe County Engineer has recommeaded dedication of 7.5 feet of additional
Right-of-Way along Eighth Avenue. The County Engineer has also recommended that a
strip of property 12.5 feet i.a width along the Eighth Avenue frontage be set asside in
reserve as Future A,cquisition Area (FAA,). This property may be acquired by Spokane
County at the time when Arterial Improvements are made to Eighth Avenue.
In addition to the requ.ired right of way dedication, the County Engineer has designated
a Minor Arterial Roadway Section for the impmvement of Eighth Avenue. This will
require the addition of approximately 12.5-14.5 feet Af asphalt along the frontage of the i
development. Tbe construction of curbing and sidewalk is also required. As
conditioned, the proposal confornis to the Plan.
10. The Spokane Counry Arterial Road Plan identifies Progress Road as a Local Access
with a future right of way width of 60 feet. The exi.sting right of way width of 40 feet
is not consistent with that specified in The Plan. In order to implement the Arterial
Road Plan, a strip of property 10 feet in width along the Progress Road frontage shall
be set aside i.n reserve as Future Acquisition Area (FAA). This property may be
acquired by Spokane County at the time when Arterial Improvements are made to
Progress Road.
The County Engineer has also designated a Local Access Roadway Section for the
improvement of Progress Road. Tlus will require the additioo of approximately 4-6
feet of asphalt along the firontage of the development. The construction of curbing and
sidewalk is also required. As conditioned, the proposal confonns to the Plan.

11. The site is located within the Public Transportation Benefit Area (PTBA).
12. The proposed short plat will be served by a public water system. Waste water disposal
will be as authorized by the Director of UUlities.
13. No comments or conditions were provided by the County Parks Department regarding
this proposal. Presently, the Board of County Commissioners and the Parks
Department are in the process of reevaluating the continued use of Park and Recreation
Voluntary Mitigation Agreements.
14. No comments were received by the Central Valley School District
15. Recognizing the recommended conditioas and Spokane Counry development standards,
appropriate provisions should be made to ensure the public health, safety and general
welfare and that the Public use and interest will be served by platting the subdivision.
16. The subdivision proposal is generally coasistent with RCW 58.17 and the County
subdivision regulations, promoting the public health, safety and genera] weifare in
accorda.ace with standards established by the state and Spokane County. The Division
of Planning has considered the provision of adequate public facilities as cited in RCW
58.17.110 (2). More specifically:

b. drainage ways g. parks and recreadon facilities
c. public aad/or privaie rights-of-way h. playgrounds
d. transit i. schools and schoolgcounds

DECISION
Based upon the above noted Findiags of Fact and Conclusions, Short Plat Application
SP-10? 1-96 is hereby APPROVED wn.iil June 1, 2041, subject to conditions noted below.
This decisioa is final unless appealed in writing, consisteat with adopted appeal procedures.
All below conditions imposed shall be binding on the "Applicant," which term shaU include the
owner or owners of the property, heirs, assigns and successors.
COUNTY DIVISION OF BUILDING AND PLAN1vING CONDITIONS
1. 1'he proposal and future development of this property shall comply with the Urban
Residential-3.5 (LJR-3.5) zone, as amended.
2. The final plat shall be designed subscantially in confononance with the preliminary plat
of cecord. No increase of density or number of lots shall occw without a change of
condition application submittal and approval.
3. Ttle Planning Directoddesignee shall r+eview any propased final plat to ensure
compliance with these Findings and Conditions of Approval.
4. The pneliminary plat is given conditional approval for five (5) years, specifically to June
1, 2001. The applicant raay request an extension of time by submitting a written
request approximately forty-five (45) days prior to the above expiration date.
5. Thnee (3) current certificates of title shall be furnished to Spokane Division of
Planning prior to filing the final plat.
6. Appropriate utility easements shall be indicated on copies of the proposed final plat.
Written approval of utility easements by appropriate utility companies shall be received
with tbe submittal of the finai plat.
7. Prior to filing of final plat, the appropriate road name(s) and street address(es) shall be
indicated. -
8. The final plat map shall indicate by a clear, dashed line the required yard setbacks from
all private, "Tract X" or public roads. The dedication shall contain the following
,

statement:
"Side yard and rear yard setbacks shall be deterntined at the time building permits are
requested unless these setbacks are specifically drafted on this final plat. The setbacks
indicated on this plat may be varied from if proper zoning approvals are obtained."
h. The Spokane Caunty Division of Planning shall pnepare and record with the County
Auditor a Title DVotice specifying a future land acquisition area for road right-of-way
and utilities. The reserved future acquisition area Tiile Notice shall be released, in full
or in part, by the Division of Planning. The notice should be recorded with the final
plat and shall provide the following:
a. A strip of property 12.5 feet in width from the existing ng.ht or %•a•i n:o:_ :hd

b. A strip of property 10 feet in width from the eJtisting right of way along the

c. Future building and other setbacks required by the Spokane County Zoning
Code shall be measured from the reserved future acquisition area.
d. No required laadscaping, pazking,'2(38' areas, drainfield or allowed signs
should be located within the futune acquisition area for road right-of-way a.nd
ualities. If any of the above improvements are made withi.n this area, they shall
be relacated at the applicant's expense when roadway improvements are made.
e. The future acquisition area, until acquired, shall be private property and may be
used as allowed in the zone, except that any improvements (such as
landscaping, parking, surface drainage, drainfield, signs or others) shall be
considered interim uses.
f. T'he property owner shall be responsible for relocating such "interi.m"
unproveinents at the time Spokane Counry makes roadway improvements after
acquiring said future acquisition area.
10. A plan for water facilities adequate for domestic service and fire protection shall be
approved by the water purveyor, appropriate fm protection district, County Division of
Buildings and County Health District. The agencies will certify on the Water Plan,
prior to the fili.ng of a final plat, that the plan is in coaformance with their respective
aeeds and regulations. The Water Plan and certification sha11 be drafted on a
transparency suitable for reproducdon and be signed by the plat sponsor.
11. The water purveyor shall certify that appropriate contractnal arraagemenLs and schedule
of improvements have been made with the plat sponsor for construction of the water system in accordance with the approved Water Plan. The time schedole shall provide
for completion of the water system end inspection by the approgriate health authorities
prior to application for building permits within the final plat. The arrangements or
agreements shall include a provision holding Spokane County and the purveyor
hazmless from claims by any lot purchaser refused a building perimit due to the failure
of the subdivision sponsor to satisfactorily complete the approved water system.

12. The final pIat dedication shall contain the following statement:
"The public water system, pursuant to the Water Plan approved by county and state
health authorities, the local fire protection district, water purveyor and Spokane County
Division of Buildings, shall be installed vvithin this subdivision, and the applicant shall
provide for individual domestic water serrice as well as fire protection to each [tracVlot]
prior to sale of each [tracVlot] and prior to issuance of a building permit for each
[tracVlot]."
13. No building perxnit will be issued for any lot within the final plat until certified by a
Washington state-licensed engineer that "the water system has been installed pursuant
to the approved Water Plan for the final plat" including a signed license stamp. The
certif cation may be in the form of a letter, but is preferned to be certified on a copy of
the Water Plan as a schematic map showing thiz "as-constructed" water system.
14. The Water Plan and the above four (4) conditions of approval regarding the Water Plan
may be waived by the Planning Director/designee upon receipt of letters from the
appropriate water purveyor and fire protection district stating that simple connections to

an existing, approved water system will provide adequate domestic and fire protection
water to ensure the public health, safety and general w►elfare.
15. A survey is required prior to the filiag of a final plat.
16. The applicant shall contact the Divisioa of Building and Planning at the earliest possible
stage ia order to be irtformed of code requirements administered/enforced as authorized
by the State Building Code Act. Design/development concerns include: ADDRESSIlVG,
FIRE APPARATUS ACCESS ROADS; FIRE HYDRANTIFLOW; APPROVED WA'I'ER
SYSTEMS; BUII.DING ACCESSIBILITY; CONSTRUCTION TYPE; OCCUPANCY
CLASSIFICATION; EXTTING; EXTERIOR WALL PROTECTION; AND ENERGY CODE
REGULATIONS. (Note: The Division of Building aad Planning reserves the right to
confirm the actual address at the time of building pernvt.)
COUNTY DIVISION OF ENGINEERING AND ROADS CONDITIONS
1. That conclidooal approval of the plat by the County Engineer is given subject to
dedication of Right-of-Way and approval of the road system as indicated in the
preliminary glat of record.
2. No coastxuction work is to be performed within the existing or proposed Public R.ight-
of-Way until a penmit has been issued by the County Eagineer. All work is subject to
inspection and approval by the County Engineer.
3. The applicant should be advised that ind.ividual driveway access permits are required
prior to issuance of a building permit for driveway approaches to the County road
system.
4. Dedication of 7.5 feet of additional Right-of-Way along Eighth Avenue.
5. Applica.nt shall dedicate the applicable radius on Eighth Avenue and Progress Road.
6. Existiag County roads providing direct accesS to the plat shall be paved andior curbed
to Spokane County standards.
7. That Sidewalks are required along the arterial on Eighth Avenue.
8. The word "applicant" shall include the owaer(s) of the property, his/her heirs, assigns
and successors.
9. To construct the road improvements stated herein, the applicant may, with the
approval of the County Engineer, join in and be a willing participant in any peation or
resolution which purposes is the fornnation of a Road Improvement District (RID) for
said improvements pursuant to RCW 36.88, as amended. At such time as aa RID is
created or aay Road Improvemeat Project is sanctioned by Spokane County, the
impravemeats required (curb, sidewalk, drainage control and paving to eJCisting
pavement) will be at the sole expense of the undersi,gaed owner, their heirs, graatees
and assigns. This provision is applicable to Eighth Avenue and Progress Road.
10. A►s an altemative method of constructing the road improvement stated herein, the
applicant may, vvith the approval of the Couaty Engineer, accomplish the road
improvements stated herein by joining and participating in a County Road Project
(CRP) to the extent of the required road 'unprovement. At such time as an RID is ,
created or any Road Improvement Project is sanctioned by Spokaae County, the
unprovements requimd (curb, sidewalk, drainage control and paving to existing
pavement) will be at the sole expense of the undersigned owner, their heirs, grantees
and assigns. This provision is applicabie to Eighth Avenue and Progress Road.
11. That the foUowing statement shaU appear within the dedicatory language of the final
plat:
That in consideration of Mutual Benefits aow or to be hereafter derived, do for
themselves, their heirs, grantees, assigns and successor (s) in interest hereby request
and autborize Spokane County to i.aclude the above described property in a Road
Improvement District (RID) and to support the formation of a Road Improvement
District for improvement of the road(s) described below by requesting and authorizing
Spokane County to place their name(s) on a petition for the formation of a Road
Improvement District pursuant to RCW 36.88.050, or by requesting and authorizing

Spokane County to cast their ballot in favor of a R.ID being formed under the
resolution method pursuant to RCW 36.88.030, and/or by not filing a protest against
che fornation of a RID being fonned under the alternative resolution method provided
for in RCW 36.88.065 and Chapter 35.43 RCW.
If a RID is proposed for improvement of the road(s) described below, said awner(s)
and successor(s) further agree: (1) that the improvements or construction contemplated
within the proposed RID ane feasible, (2) that the benefits to be derived from the
formation of ihe RID by the property included therein, together with the amount of any
County participation, exceeds the cost and expense of formation of the RID, and (3)
that the property within the proposed RID is sufficiendy developed; provided,
themselves, theu heirs, grantees, assigns and successor(s) shall retain the right, as
authorized under RCW 36.88.090, to object to any assessment(s) on the property as a
result of the improvements called for in conjanction with the formation of a RID by
either pedtion or resolutioa method under Chapter 36.88 RCW, and to appeal to the
Superior Coart the decisioa of the 8oard of County Comrnissioners conffrming the
final assessment roll; provided further, it is recogaized that actual assessments may
vary from assessment estimate so long as they do not exceed a figure equal to the
increased true and fair val.ue improvement(s) add(s) to the property.
It is ftuther acknowledged and agreed that at such time as a RID is created or any
County Road Improvement project is authorized by Spokane County, the
improvements required shall be at the sole expense of the owner(s) ot property within
the RID or served by the improvements without any monetary participation by
Spokane County.
The RID waiver coatained in this agreement shall expire after ten (10) years from the
date of execution below. T'his provisian is applicable to Eighth Avenue and Progress
Road.
12. The County Engineer has desigaated a Minor Arterial Roadway Section for the
improvement of Eighth Avenue which is adjacent to the proposed development. Ttus
will require the addition of approximately 12.5-14.5 feet of asphalt along the frontage
of the developrnent. The construction of curbing and sidewalk is also required.
13. The Counry Engineer has designated a Local Access Roadway Section for the
unprovement of Progress Road which is adjacent to the proposed development. This
will require the addition of approximately 4-6 feet of asphalt along the frontage of the
development. The construction of curbing and sidewallc is also requimd.
14. The proposed plat shall be improved to the standards set forth in Spokane Counry
Board of Commissioners Resolution No. 95-0498, as amended, which resolution
establishes regulations for roads, approaches, drainage and fees in new construction.
15. The County Engineer has examined this development proposal and has determined that
the impact of this proposal upon the ex.isting County Road System warrants the
dedication of additional R.ight of Way and the madway improvements herein specified.
16. The County Arterial Road plan identifies Eighth Avenue as a 80 foot Minor Arterial.

Plan. In order to implement the Arterial Road Plan it is recommended that in addition

17. The applicant should be advised that there may exist utilities either underground or
overhead affecting the applicants property, including pmperty to be dedicated or set
aside for future acquisition. Spokane County will assume no fuiancial obligation for
adjustments or relocation regarding these utilities. The applicant should check with the
applicable utilities and Spokane County Eagi.aeer to deternune whether the applicant or
utility is responsible for adjustment or relocation costs and to make arrangements for
any necessary work.
18. The applicant shall grant applicable border easements adjacent to Spokane County
Right of Way per Spokane County Standards. ;

CUUNTY HEALTH DISTRICT CONDITIONS
1. The f n.al plat shaU be designed as indicated on the preliminary plat of record and/or any
attached sheets as noted.

record for distribution by the Planning Department to the utility companies, Spokane
County engineer and the Spokane County Health District. Written approval of the
easements by the utility companies must be received prior to the subnuttal of the final
plat.

2. Utility companies which will service the subdivision must provide a letter to the Planning
Department that satisfactory arrangements for utiliaes have been made. You or youir
surveyor will need to contact the utilines company and provide them with the necessary
2nformadon for their review.
3. If conditioned for a water plan, a copy of the water plan, signed by the puiveyar, is reqnired
to be submitted to the Planning Deparcment, in accordance with the conditions of approval.
4. Ln order that yotu finai shart plat can be recorded, the Treasurer's office must verify that
required taxes are paid. For short plats, all taxes must be current at the time of recording.
Soffie plats require that advance taxes be paid. Contact the Treasurer's office at 456-5746
with the tax parcel numbers to determine whether taxes are required with filing.
5. The la.st step in filing a final plat is recordation in the County Auditor's office. A filing fee
must be paid at the time of recordation. Current filing fees are $53 for the first page and $5
per addidonal page; make checks payable to the Spokane County Auditar. The Planning
Department will record the approved documents.
6. You or your surveyor should nunimally maintain contact with the following departments to

The new Washington State law, "Regulatory Reform" ESHB 1724 (RCW 36.70B), went into
effect March 31, 1996. The Board of County Commissioners adopted an interim process, which
establishes adrninistrative rules for processing applicadons. The new law has required inany
changes to our past procedures.
This letter is to inform you of a procedural changes regarding submittal of documents for a Final
Short Plat, Final SubdivisioD or Final Bind.ing Site Pian reviews. Past procedure was to allow
"piece meal" submittal of required documents to different departTnents at different times, weeks and
even months apart. The change is that ALL DOC'.U►MENTS reguired by cond.itions of approval or bv
regulation must be submitted together as one packet to the Planning Section of the Building and
Planning Division of Spokane County Public Works Departmeat.
The final review packet must be CO[1N'IM COMPI,.EIE before it can be circulated and reviewed.
To be counter complete all of the applicable document must be submitted with the appropriate fees.
The following are typically required documents for a Final review:
1. PRAPOSED FIlVAL., nine (9) copies of the proposed Final map with dedicatioa;
2. PI.AT CERTIFICATE, three (3) copies for Final from a Title Company (not older than b
months of filing the Final);
3. ASSESSOR'S MAP, current map(s) showing the Fiaal outlined in red by Surveyor within
the accuracy of the County map;
4. WATER PL.AN signed by Applicant, Water District, Fire District and Health District;
5. LETTERS OF EASEMENT ACCEPTANCE from utility purveyorsw phone, water, gas,
electricity, sewer, and/or other;

Ttus preliminary conference fonn documeats the infonnation required for acceptance of your
application by the Spokaae County Division of Building aad Plaaning. It also provides
information concenung your particular proposal aad issues and concerns that can affect your
application. You will need to maintai.a contact with the Division of Building and Planning as new
infonnatioa becomes available during the application and review process which may change your
proposal or affect the requirements for your short plat. Professioaal planners are available for
assistance and advice concerning your short plat. Many applications require fees and coinpliance
with regulations other than those of the Division of Building and Planniag. This document will
provide general information and refer you to other agenciesldepartmeats.

Engineer section maps are available at the Couaty Engiaeer's office.
PRELIMINARY SHOItT PLAT MAPS
Submit IQ blueline copies and one 8 1/2" x 11" reduction of the preliminary short plat
map, with a written legal descripdon, prepared by a licensed land surveyor. The preliminary
short plat map shall illustrate:
a. The property to be subdivided and the location of the property lines for the proposed
lots.
b. Exfsting buildings and other improvements; indicate which ones are to
remain, which ones are to be removed. c. Location of exiscing and proposed easements providing access.
d. Septic systems.
e. Existing and abandoned well sites.
f. Natural features such as wooded areas, streams, drainage ways, ridgelines, hilltops and
wetlands.
g. Topographic information, if any slopes exceed 10 percent.
h. vicinity map (no scale required) of the surrounding neighborhood.
Proposed lots shall show:
a. Applicable front/Aanking setbacks.
b. Future Acquisition Area, if applicable.
c. The locadon of any easements existing and proposed (access for utilities, power,
phone, water, sewer, other).
d. Tbe location of the nearest fire hydrant, if applicable.
The design of the preliminary map must conform to the approved plat forniat standards in the
Spokane County Short Plat Ordinance.
i~ ENVIRONMENTAL CHECKLIST
A completed environmental checklist is the minimum requirement for all zone changes,
plaaned unit developments and subdivision requests. Short plats, binding site plans and
other land use applications may require a checklist under SEPA rules unless exempted by
WAC 197-11-800. All environmental information required for a SEPA checklist shall be
containe.d on a cbecklist provided by the Division of Building and Plaaning. Note: If
previous environmental checklist exists for the property, it may be adequate to address
enviroamental issues.

charge fees in conjunction with your proposal. Please contact these departments for their
