My clients object to SP 1069-96 for the reason the applicant has not dedicated ~ 20 feet for the right of way for Carnine Street. 1'he owners on the west side of the subject parcel did dedicate 20 feet for Carnine and it was anticipated that at a future date 20 feet zvould be dedicated for Caraine from the west boundary of the subject parcel. The dedication of 20 feet shouid be a condition to the short plat. luly clients awn the property to the north "Armstrong Estates" and a six-foot liigh noise barrier fence should be installed along applicant's north line. 1VIy clients also dedicated 25 feet on Maia Street north of subject property and installed curb and black top on the 25 feet which adjoins their property. The applicant should likewise be required to make a similar installation. There should also be landscaping between the proposed fence barrier and the curb linc. The County was very adamant that my clients install the blacktop aad curb on their 25 feet of Main Street. The aforesa.id are the only objections my clients have to SP 1069-96. SP-1069-96 ) CON ONS AND Shelley Development Company ) DECSION THIS MA'I"TER, an application for subdivision of land, from the Shelley Development Cqm y and decided upon, pursuant to Spakane County Subdivision regulations, on the day of May, 1996. FINDINGS OF FACT AND CUNCLUSIONS I. The iadividual signing below has further been properly delegated the responsibility for rendering the decisioa by the Spokane County Director of Buzlding and Planning. 2. The proposal is to divide appro3cimately 8.95 acres into 41ots for commerciai uses and those uses pernutted in the Community Business (B-2) zone. 3. The praposal is located north of ancl adjacent to Sprague Avenue, approximately 650 feet east of the intersection of Sprague Aveaue and Conklin Road, in the SE 1/4 of Section 13, Township 25 North, Range 44 E.W.M. Spokane County, Washington. 4. The existing zoning of the property described in the applicatioa is Community Business (B-2). The subject property was previously established as Agricultural in 1942 (File No. 60-42), and redesignated to Community Business (B-2) on January 1,1991, pursuant to the Program to Implement the Spokane County Zoaing Code. The subject property is currently processing for a zone reclasSification from Community Business (B-2) to Regional Business (B-3). Pursuant to RCW 58.17.195 the proposal does conform to the requirements of the existing zone. 5. The Spokane Counry Comprehensive Plan designates this area as Major Commercial. The deveiopment and uses, as proposed aad condiUoned are in compltance with this category. 6. Surrouading uses consist of commercial uses along Sprague Avenue and residential uses to the north of the subject property. 7. The required public notice was provided for this proposal and agencies having a potential interest in the project were notified and recomrnendations solicited. 8. Comments were received by one adjacent property owner. Said property owner had the foliowing comments: 1) the dedication of 20 feet of right-of-way for Carnine Street should be a condition of the short plat; 2) "Armstrong Estates" lies to the north of the subject short plaL Thus, a six-foot high noise barrier fence should be installed along the northern border of the subject short plat; 3) there should also be landscaping between tbe proposed fence barrier and the curb li.ae; and 4) the applicant of the subject short plat should be required to dedicate 25 feet on Main Avenue and install curb and blacktop on the 25 feet which adjoins their property; 9. The following is a response to the above noted comments: a. According to the County Engineer, Carnine Street will be used as a utiliry easement only and, therefore, additional dedication will not be required. b. The following facts are relevant regardi.ng comraents #2 and #3: i. Chapter 14.806 of the Spokane County Zoning Code prescribes laaciscaping and screenirtg standards for new development. The sbort plat process pertains to the division of land only and not new development and those reguiauons specifically regulating new development. A condidoa of the subject short glat, however, is that future development shall comply with the Commuaity Business (B-2) zone, as amended, which includes landscaping and screening standards. ii. "Annstrong Estates," a residential development, received appraval in 1994. At that time, the subject property was already designated Community Business (B-2). c. See Finding #11 in regard to comment #4. d. The B-2 to B-3 zone reclassification currently being processed may provide the appropriate forum to request: 1) a condition for a noise barrier fence; and 2) the dedication of 25 feec on Main Avenue and the iastallation of curb and blacktop on the 25 feet which adjoins the applicant's property. 10. The Spokane County Arcerial Road Plan identifies Sprague Avenue as a 130 foot Principal Arterial. The existing right of way width of 85 feet is not consistent witb that FINDINGS AND DECISION SP-1069-96 Page 2 specified in The Plan. In order to implement the Arterial Road Plan, the County Engineer bas recomtnended that in addition to the required right of way dedication, a strip of property 10 feet in width along the Spragve Avenue frontage be set aside in reserve. This property may be acquired by Spokane County at the time when Arterial Improvements are made to Sprague Avenue. As conditioned, ths proposa►1 conforms to the Plan. The County Engineer has also designated a Special Roadway Secaon for the improvement of Sprague Avenue. This will require the addition of varying $mounts of asphalt along the frontage of the development. The construction of curbing and sidewalk is also required. 11. The Spokane County Arterial Road P1an identifies Main Avenue as a Local Access with a future right of way of 60 feet. The existing right of way width of 50 feet is not consistent with that specified in The Plan. In order to implement the Arterial Road Plan, a strip of property 5 feet in width along the Main Avenue frontage shall be set aside in reserve as Future Acquisition Area (FAA). This property may be acquired by Spokane County at the time when Arterial Improvements are inade to Ma.in Avenue. As conditioned, the proposal conforms to the Plan. The County Engineer has requested that access to Main Avenue be prohibited until such time as specifically authorized by the Spokane County Engineer. The County Engiaeer has desigaated, however, a Local Access Roadway Section for the improvement of Main Avenue. This will require the addition of 5-7 feet of asphalt along the frontage of the development. The construction of curbi.ng and sidewalk is also required. 12. The site is located within the Public Transportation Benefit Area (PTBA). 13. The propvsed short plat will be served by a public water system. Waste water disposal will be as authorized by the Director of Utilities. 14. Recogaizing the recommended conditions and Spokane County development standards, appropriate provisions should be made to ensure the public healih, safety and general welfare and that the public use and interest will be served by platting the subdivision. 15. The subdivision proposal is generally consistent with RCW 58.17 and the Connty subdivision reguladons, promoting the public health, safety and general welfare in accordancc with standards established by the state aad Spokane Counry. The Division of Planning has considered the provision of atiequate public facilities as cited in RGW 58.17.110 (2). More specifically: a. open spaces f. sanitary waste disposal b. drainage ways g. garks and recreation facilides c. public andlor private rights-of•way h. playgrounds d. traasit i. schools and schoolgrounds e. potable water j. sidevvalks DECISION Baxed upon the above noted Findings of Fact and Conclusions, Short Plat Application SP-1069-96 is hereby APPROVED unLil June 1, 2001, subject to conditions noted below. Most of the condidons of approval shall be accomplished by ihe applicant and/or sponsor prior to finalization of the short subdivision. This decision is final unless appealed in wnting, consistent with adopted appeal procedures. The following cond.icions shall be binding on the "Applicant," which terna shall include the owner ar owners of the property, heirs, assigns and successors. COUNTY DIVISIUN OF BUILDING AND PLANNING CONDITIONS 1. The proposal and future development of this property shall comply with tbe Commuaity Business (B-2) zone, as amended. FINDINGS AND DECISION SP-1069-96 Page 3 2. The final plat shall be designed substantially in conformance with the preliminary plat of record. No increase of density or number of lots shall occur without a change of condition application submittal and approval. 3. The Planning Director/designee shall review any proposed final plat to ensure compliaace with these Findings and Cond.itions of Approval. 4. 1'he preliminary plat is given conditional approval for five (5) years, specifically to June 1, 2001. The applicant may request an extensioa of time by submitting a written request approxi.mately forty-five (45) days prior to the above expiration date. 5. Three (3) current ccrtificates of titie shall be fiunished to Spokane Division of Planning prior to filing the final plat. 6. Appropriate utiliry easements shaU be indicated on copies of rhe proposed final plat. Written approval of utility easements by appropriate utility compaaies shall be received with the submittal of the final plat. 7. Prior to filing of fiaal plat, the appropriate road name(s) and street address(es) shaU be indscated. 8. The final plat map shalI indicate by a clear, dashed line the required yard setbacks from all private, "Tract X" or public raads. The dedication shall contain the following statement: "Side yard and rear yard setbacks shall be detemzi.ned at the time building permits are requested unless these setbacks are specifically drafted on this final plat. The setback.s ind.icated on this plat may be varied from if proper zoning approvals are obtained." 9. The Spokane County Division of Planniag shall prepare and record with the County Auditor a Title Notice specifying a future land acquisi[ion area for road right-of-way and utilities. The reserved future acquisition area Title Notice shall be released, in full or in part, by the Divisioa of Planuing. The notice should be recorded with the final plat and shall provide the following: a. A strip of property 10 feet in width from the existing right of way along the Sprague Avenue frontage is to be set aside as Future Acquisition Area (FAA) for additional road nght of way. b. A strip of property 5 feet in width from the existing right of way along the Main Avenue frontage is to be set aside as Future AcquisiUon Area (FAA) for additional i•oad right of way. c. Future building and other setbacks required by the Spokane County Zoning Code shaU be measured from the reserved future acquisition area. d. No requi.red landscaping, parking, '208' areas, drainf'ield or allowed signs should be located within the future acquisition area for road right-of-way and utilities. If aay of the above improvements are made within ttus azea, they shall be relocated at the appticant's expense when roadway improvements are made. e. The future acquisition area, until acquined, shall be private property and may be used as allawed in the zone, except that aay improvements (such as landscaping, parking, surface drainage, drainfield, signs or others) shall be considered interi m uses. f. The property owner shall be responsible for relocatiag such "interim" improvements at the time Spokane County rnakes roadway improvements after acquiring said future acquisition area. 10. A plan for water facilities adequate for domestic service and fue protecdon shaU be approved by the water purveyor, appropriate fire protection dismct, County Division of Buildings and County Health Distnet. The agencies will certify on the Water Plan, prior to the filing of a final plat, that the plan iLs in coofonnance with their respective needs and regulations. As an altemative method of constructing the road improvement stated herein, the applicant may, with the approval of the County Engineer, accomplish the road improvements stated hereun by joining and participating in a County Road Project (CRP) to the extent of the reqwred road improvement. At such time as an RID is created or any Road Improvemeat Project is sanctioned by Spoicane County, the improvements required (curb, sidewalk, drainage control and paving to existing pavement) will be at the sole expense of the undersigned owner, their heirs, grantees and assigns. This provision is applicable to Sprague Avenue and Main Avenue. 10. That the following statement shall appear within the dedicatory language of the final plat: That in consideration of Mutual Benefits now or to be hereafter derived, do for themselves, their heirs, grantees, assigns and successor (s) in interest hereby request annd authorize Spokane County to include the above described property ia a Road Improvement District (RID) and to support the forrnation of a Road Improvement District for improvement of the road(s) described below by requesting and authorizing Spokane County to place their name(s) on a petition for the fornlation of a Road Improvement District pursuant to RCW 36.88.050, or by requesting and authorizing Spokane County to cast their ballot in fauor of a RID being fonned under the resolution method pursuant to RCW 36.88.030, and/or by not filing a protest against the formation of a RID being formed under the alternative resolution method provided for in RCW 36.88.065 and Chapter 35.43 RCW. If a RID is proposed for improvement of the road(s) described below, said owner(s) and successor(s) further agree: (1) that the improvements or construction contemplated within the proposed RID are feasible, (2) that the benefits to be derived from the formation of the RID by the property included therein, together with the amount of any County participatioa, exceeds the cost and expense of formation of the RID, and (3) that the progerty within the proposed RID is suf~iciently developed; provided, themselves, their heirs, grantees, assigns and successor(s) shail retain the right, as authorized under RCW 36.88.090, to object to any assessment(s) on the property as a nesult of the improvements called for in conjunction with the formation of a RID by either petition or resolution method under Chapter 36.88 RCW, and to appeal to the Supenor Court the decision of the Board of County Comm.issioners confirming the final assessment roll; provided further, it is recognized that actual assessments may vary from assessment estirnate so long as they do not exceed a figure equal to the increased true and fair value improvement(s) add(s) to che property. The County Engineer has examined this development proposal and has determined that the impact of this proposal upon the existing Couaty Road System warrants the roadway impr+ovements herein specif ed. 14. Access to Main Avenue shall be prohibited until such time as specifically authorized by the Spokane Couaty Engiaeer. 15. In order to implement the Arterial Road Plan it is recommended that in addition to the required right of way dedicatioa, a strip of property 10 feet in width along the Sprague Avenue frontage be set aside in reserve.
