1. Reimburse Spokane County for project review and inspectian fees as specified in Chapter
9.14 of the Spokane County Cade. The fees will be based on actuai salary costs incurred
by Spakane County fnr project reviews and / or inspections pius a ten percent
adininistrative charge, and will be billed manthly as accrued. Any billing amounts due,
including any expenses incurred in tlte coilection of an Qverdue account, must be paid
prior to the County's acceptance of the project for filing. If a project is approveci and/or
filed with a balance stifl owing, the unpaid balance shall be paid within 30 days of the
invoice date.
2. The undersigned agrees lhat these fees are due and payable uppn receipt oi' the billing as
specified abAVe.
3. Any invoices not paid within 30 days of the invoice date will be cansidered delinquent.
If any outstanding balance on the accaunt for this project is nnt paid within 30 days of
the invaice date, no futther reviews of the project documents will be conducted until the
entire account balance is paid. Any balance on the account for this project not paid
within 65 days of the invoice date may resuit in legal action or the initiation of other
collection procedure.s, including referral to a coliection agency. The Sponsor will be
liahte for any and aft expenses incurred by the County for the collection of overdue
accounts.

THIS MATTER, an application for subdivision of land, from Habitat for Humanity and
decided upon, pursuant to Spokane County Subdivision regulations, on the day of
April, 1996.
FINDINGS OF FACT AND CONCLUSIONS
1. The individual sigaing below has fiuther been properly delegated the responsibility for
rendering the decision by the Spokane County Director of Building and Planning.
2. The proposal is to divide approximately 1/2 acre into 21ots for nesidential uses and
those uses permitted in the Urban Residential- 7(UR-7) zone. There is currently an
existing house on proposed Lot A.
3. The proposal is located South of adjacent to 9th Avenue, approximately 170 feet East of
University Road in the SW 1/4 of Section 21, Township 25 North, Range 44 E.W.M.
Spokane County, Washington.
4. The existi.ng zoning of the property described in the application is Urban Residential - 7
(UR-7). The subject property was previously established as Agricultural in 1950 (File
No. 181-50), redesignated to Urban Resideatial - 3.5 (UR 3.5) on January 1, 1991,
pursuant to the Program to Implement the Spokane County Zoning Code, and recently
rezoned to Urban Resideatial - 7(UR-7) in February, 1996 (File No. ZE-1-96).
Pursuant to RCW 58.17.195 the proposal does conform to the requirements of the
existing zone.
5. An Administrative Exception (AEE-17-96) was granted in relation to the subject short
plat pursuant to Chapter 14.506 of the Spokane County Zoning Code. T'he applicant
sought a 3 foot relief from the 65 foot frontage requirement for proposed Lot B in order
to establish a lot line that would not be situated within the existing driveway.
6. The Spokane County Comprehensiwe Plan designates this area as Urban. The
development and uses, as proposed and conditioned are in compliaace with this
category.
7. Surrounding uses consist of residential uses with some duplexes.
8. The required public notice was provided for this proposal and agencies baving a
potential interest in the project were notified and recommendations solicited. No
comments were received from adjacent property owners.
9. The Spokane County Arterial Road Plan identifies Ninth Avenue as a Local Access
with a future right of way width of 60 feet and an existing right of way width of 60
feet. Therefore, the proposal confomas to the Plan. The County Engineer has
designated a Local ,kccess Roadway Section for tbe improvement of Ninth Avenue
wtuch is adjacent to the proposed development. This will require the addition of
approximately 5-7 feet of asphalt along the frontage of the development. The
construction of curbing and sidewalk is also required.
10. The site is located within the Public Transportation Benefit Area (PTBA).
11. The proposed short plat will be served by a public water sysLem. Waste water disposal
will be as anthorized by the Director of Utilities.
12. No conunents were received from the Central Valley School District.
13. Recognizing the recomaleaded conditions and Spokane County deveiopment standards,
appropriate provisions should be made ta ensure the public health, safety and general
welfare and that the public use and interest will be served by platting the subdivision.
14. The subdivision proposal is generally consistent with RCW 58.17 and the County
subdivision regulations, promoting the public health, safety and general welfare in
accordance wlth standards established by the state and Spokane County. The Division
af Planning has considered the provision of adequate public facilities as cited in RCW
58.17.110 (2). More specifically:

DECISION
Based upon the above noted Findings of Fact and Conclusions, Short Plat Application
SP-1067-96 is hereby APPROVED until May 1, 2001, subject to conditions noted below.
Most of the condidons of approval shall be accomplished by the applicant andlor sponsor prior
to finalization of the short subdivision. This decision is final unless appealed in wrihng,
consistent with adopted appeaI procedures.
The following conditions shall be binding on the "Applicant," wluch term shall include the
owner or owners of the property, heirs, assigns and successors.
COUNTY DIVISION OF BUILDING AND PLANNING CONDITIONS
1. The pmposal and future development of this property shall comply with the Urban
Residential - 7(UR-7) zone, as amended, and the conditions of approval for Zone
Reclassification ZE-1-96.
2. The final plat shall be designed substantially in conforrnance with the preliminary plat
of record. No increase of densiry or number of lots shaU occur without a change of
condition application submittal and approval.
3. The Planning Duector/de.sigae.e shall review any proposed final plat to ensure
compliance with these Findings and Conditions of Approval.
4. The preliminary plat is given conditional approval for five (5) years, specifically to May
1, 2001. The applicant may request an exteasion of time by submitting a written
request approximately forty-five (45) days prior to the above expiration date.
5. Three (3) current certificates of title shall be fiu-nished to Spokane Division of
Planning prior to filing the final p1at.
6. Appropriate utility easements shall be indicated on copies of the proposed fin.al plat.
Wntten approval of utility easements by appropriate utility companies shall be received
with the submittal of the final plat.
7. Prior to filing of final plat, the appropriate road name(s) and street address(es) shall be
indicated.
8. The fiaal plat map shall indicate by a clear, dashed line the required yard setbacks from
all private, "Tract X" or public roads. The dedicatioa shall contain the following
statement:
"Side yard and rear yard setbacks shall be detennined at the time building permits are
requested unless these setbacks are specifically drafted on this final plat. The setbacks
indicated on this plat may be varied from if proper zoning approvals are obtained."
9. A plan for water facilities adequate for domestic service and fire protection shall be
approved by the water purveyor, appropriate fire protection distnct, County Division af
Buildings and County Health District. The agencies will certify on the Water Plan,
prior to the filing of a final piat, that the plan is in conformance with their respective
needs and regularions. The Water Plan and certification shall be drafted on a
transparency suitabie for reproduction and be signed by the plat sponsor.
10. The water purveyor shall certify that appropriate contractual arrangements and schedule
of improvements have been made with the plat spoasor for construction of the water
system in accordance with the approved Water Plan. The time schedule shall provide
for completion of the water system and inspection by the appropriate heaith authorities
prior to application for building pennits within the final plat. The arrangements or

agreements shall include a provision holding Spokane Caunty and the purveyor
haimless from claims by any lot purchaser refused a buil'ding permit due to the failure
of the subdivision spoasor to satisfactorily complete the approved water system.
11. The final plat dedication shail contain the following statepnent:
" ,
The public water system, pursuant to the Water Plan agproved by county and state
health authorities, the local fire protection district, water purveyor and Spokane County
Division of Buildings, shall be installed within this subd.ivision, and the applicant shall
provide for individual domestic water service as well as fire protection to each [tractllot]
prior to sale of each [tracdlot] and prior to issuance of a building pernut for each
[tract/lot]."
12. No building permit will be issued for any lot within the final plat until certified by a
Washington state-licensed engineer that "the water system has been installed pursaant
to the approved Water Plan for the final plat" including a signed license stamp. The
certification may be in the form of a letter, but is preferned to be certified on a copy of
the Water Plan as a schematic map showing the "as-constructed" water system.
13. The Water Plan and the above four (4) condidons of approval regarding the Water Plan
may be waived by the Planning Director/designee upon receipt of letters from the
agpropriate water purveyor and fue protection district stating that simple connections to
an existing, approved water system will provide adequate domescic and fire protec'on
water to ensure the public health, safety and general welfare.
14. A survey is requir+ed prior to the filing of a final plat.
15. The applicant shall contact the Division of Building and Planning at the earliest possible
stage in order to be inforined of code requirements administered/enforced as authorized
by the State Building Code Act. Design/development concerns include: ADDRESSING,
FIRE APPARATUS ACCESS ROADS; FIRE HYDRANT/FLOW; APPROVED WATER
SYSTEMS; BUII.DING ACCESSIBII.I'I'Y; CONSTRUCTTON TYPE; OCCUPANCY
CLASSIFICATION; EXITING; EXTERIOR WALL PROTECTION; AND ENERGY CODE
REGULA'IZONS. (Note: The Division of Building and Planning reserves the right to
confum the accual address at the time of building permit.)
COUNTY DIYISION OF ENGINEERING AND ROADS CONDITIONS
1. That conditional approval of the plat by the County Engineer is given subject to
approval of the road system as indicated in the prelimi.aary plat of record.
2. No construction work is to be performed within the existing or proposed Public Right-
of-Way until a perm.it has been issued by the County Engineer. All work is subject to

Improvement District (RID) and to support the formation of a Road Improvement
District for improvement of the road(s) described below by requesting and authorizing
Spokane County to place their name(s) oa a petition for the formadon of a Road
Improvernent District pursuant to RCW 36.88.050, or by requesting and authorizing
Spokane County to cast their ballot in favor of a RID being formed under the
resolution method pursuant to RCW 36.88.030, and/or by not filing a protest against
the formation of a RID being formed under the alternative resolution method provided
for in RCW 36.88.065 and Chapter 35.43 RCW.
If a RID is proposed for improvement af the road(s) described below, said owner(s)
and successor(s) fuY-ther agree: (1) that the unprovements or construction contemplated
within the proposed RID are feasible, (2) that the benefits to be derived from the

8. The Counry Engineer ha,s designated a Local Access Roadway Section for the
improvement of 9th Avenue which is adjacent to the proposed development. This will
require the addition of approximately 5-7 feet of asphalt along the fiontage of the
development. The construction of curbing and sidewalk is also required.
9. The proposed subdivision shall be improved to the standards set forth in Spolcane
County Board of Commissioners Resolution No. 95-0498, as amended, which
resolution establishes regulations for roads, approaches, drainagc and fees in new
construction.
10. The County Engineer has examined this development proposal and has determined that
the impact of this proposal upon the existing County Road System warrants the
roadway improvements herein specified.
11. The applicaat shall grant applicable border easements adjacent to Spokane County
Right of Way per Spokane County Standards.
COUNTY HEALTH DISTRICT CONDITIQNS
1. The final plat sha11 be designed as indicated on the preliminary plat of record andlor any
attached sheets as noted.
2. Appropriate utility easements shall be indicated on copies of the preliminary plat of
record for distribution by the Planning Department to the utility companies, Spokane
County engineer and the Spokane County Health District. Written approval of ttie
easements by the utility companies must be received priar to the submittal of the final
