DECISION
THIS MATTER, an application for subdivisioa of land from Robert S. Adams has been
received and decided upon, pursuant to Spokane County Subdivision regulations, on the
, day of April, 1996.
FINDINGS OF FACT AND CONCLUSIONS
1. The individual signing below has further been properly delegated the responsibility for
rendering the decision by the Spokane County Duector of Building and Planning.
2. The proposal is to divide approximately 1.96 acres into 3 tracts for 1 existing single
family residence and 2 new additional residential tracts and those uses permitted in the
Urban Residential-3.5 (UR-3.5) zone.
3. The proposal is lacated between Murbach Road and Sullivan Road and approximateiy
620 feet south of 24th Avenue in the SE 1/4 of Section 26, Township 25 North, Range
44 E.W.M. Spokane County, Washington.
4. The existing zoning of the property described in the application is Urban Residential-
3.5 (UR-3.5), previously established as Agricultural (A) (file 3 60-42) zoning in 1942
and redesignated to UR-3.5 on January 1, 1991, pursuant to the Program to Implement
the Spokane County Zoning Code. Pursuant to RCW 58.17.195 the proposa] does
conform to the requirements of the existing UR-3.5 zone.
5. The Spokane County Comprehensive Plan designates this area as UR.BAN. The
development and uses, as proposed and cond.itioned are ia compliance with this
category.
6. Surrounding uses are primarily single family residences on m,ixed urban size lots.
7. The Spokane County Arterial Road Plan identifies Sullivan Road as a Principal Arterial
with a future right of way width of 100 feet. The existing right of way width is 60 feet.
In order to implement the Arterial Road Plan, a strip of property 20 feet in width along
the Sullivan Road frontage is to be set Aside as a Future Acquisition Area. In add.ition,
the Spokane Connty Arterial Road Plan identifies Murbach Road as a Local Access
Road with a future right of way width of 60 feet. The existing right of way width is 30
feet. In order to ixnplement the Arterial Road Plan, a strip of property 10 feet in width
along the Murbach Road frontage is to be set aside as a Future Acquisition Area. Note:
The County Engineer has requested a dedication of 20 feet of additional right of way
along Murbach Road. Therefore, as conditioned, (such as improvements, dedication,
sidewalks and acquisition areas) the proposal confortns to the Road Plan.
8. The site is located within the Public Transportation Benefit Area (PTBA). The Spokane
Transit Authority (STA) Valley/32nd Avenue, Route 22 provides connecting services to
the site.
9. The proposed short plat will be served by a public water system. Waste water disposal
will be as authorized by the Director of Utilities.
10. The required public notice was provided for this proposal and agencies having a
potential interest in the project were notified and recommendations solicited. No
comments or conditions were provided by the County Parks Department regarding this
proposal. Presently, the Board of County Commissioners and the Parks Department
are m the process of reevaluating the continued use of Park and Recreation Voluntary
Mitigation Agreements while the Parks Plan is being updated.
11. A signed petition and written comments were received from adjoining property owners
who are concerned about the additional traffic this proposal will generate in their
neighborhood. In addition, the adjoining property owners have requested, for reasons
of safety, air pollution and noise, that the groposed driveway adjacent to Mwbach Road
be moved from the north end to the soutll end of the site.
In regards to the above comments, the County Engineer has addressed the issue of
access and has cond.itioned this proposal to comply with current road standazds. The
applicant met with adjoining property owners and agreed to move the proposed
driveway from the north to the south boundary of the property.
12. Recognizing the reconunended conditions and Spokane County development standards,
the proposed short plat makes appropriate provisions for the public health, safety and
geaeral welfare and that the public use and interest will be served by platting the
subd.ivision.
The subdivision proposal is generally cansisrent with RCW 58.17 and the County
subdivision regulations, promoting the public health, safety and general welfare in
accordance wlth standards establi.shed by the state and Spokane Couaty. The Building
and Planning Division has considered the provision of adequate public facilities as cited
in RCW 58.17.110 (2). More specifically:
a. open spaces f. sanitary waste disposal
b. drainage ways g. parks and recreation facilities
c. public and/or private rights-of-way h. playgrounds
d. transit i. schools and schoolgrounds
e. potable water j. sidewalks
13. The project is exempt from environmental review under the State Environmental Policy
Act pursuaat to WAC 197-11-800 (6) (a).
14. The Central VaUey School District has comnaented on the proposed Short Plat. The
District has indicated that exi.sting school facilities are inadequate to serve the proposed
short plat and wishes to negotiate with the owner to provide adequate capital facilities as
required by the Revised Code of Washington (RCW) 58.17.110. Review by County
legal counsel indicates the condition requested by the School District can be required for
developments. Approval of this short plat should include coaditions requiring that
provisions for appropriate facilities be in place prior to recording the final short plat in
the form of a wntten agreement between fihe owner and the school district.
15. The following facLs are also relevant:
a. This proposal is the applicant's second attempt to short plat the subject property.
On the first attempt the applicant was given preliminary approval by the Spokane
County Planaing Department on July 1, 1992 to short plat the property (file # SP-
762-92) by August 1, 1995. The first attempt failed because the applicant did not
finalize the plat or request an extension of tYme before the Augvst 1, 1995
expiration date.
DECISION
Based upon the above noted Findings of Fact and Conclusions, Short Piat Application SP-
1064-96 is hereby APPROVED for five (5) years, specifically to May 1, 2001 and subject to
conditions noted below. This decision is final unless appealed in writing, consistent with
adopted appeal procedures. All the below conditions imposed shall be binding on the
"Applicant", which term shall include the owner or owners of the property, heirs, assigns and
successors.
COUNTY DIVISION OF BUILDING AND PLANNING CONDITIONS
1. The proposal shail comply with the Urban Residential-3.5 (UR-3.5) zone, as anended.
2. The final plat shall be designed substantially in conformance with the preliminary plat
of recorti. No increase of density or number of tracts shall occur without a chaage of
condition application submittal and approval.
3. The Building aad Plan.aing DirectorJdes.igaee shall review any proposed final plat to
ensure compliance with these Findings and Cond.itions of Approval.

4. The preliininary plat is given conditional approval far five (5) years, specifically to May
1, 2001. The applicant may request an extension of time by submitting a written
request approximately forty-five (45) days prior to the above expiration date.
5. Three (3) current certificates of title shall be fumished to the Build.ing and Planning
Division prior to filing the final plat.
6. Appropriate utility easements shall be indicated on copies of the proposed final plat.
Written approval of uti.lity easements by appropriate utility comparues shaU be received with the submittal of the final plac.
7. Prior to filiag of final plat, the appropriate road name(s) and stneet address(es) shall be
inciicated.
8. The final plat map shall indicate by a clear, dashed line the required yard setbacks from
all private, "Tract X" or public roads. The dedication shaU contain tbe following
statement:
"Side yard and rear yard setbacks shaU be determined at the time building permits are
requested unless these setbacks are specifically drafted on this final plat. The setbacks
indicated on this plat may be varied from if groper zoning approvals are obtained."
9. The Spokane County Division of Building and Planning shaU prepare and record with
the Counry Auditor a Tide Notice specifying a futjue land acqwsition area for road
right-of-way and utilities. The reserved future acquisition area Title Notice shaU be
released, in full or in part, by the Building a►nd Planning Division. The notice should
be recorded the same time as the final plat and shall provide the following:
a. A strip of property 10 feet in width from the existing right of way is reserved
for future acquisition area for additioaal road right-of-way along Murbach
Rond.
b. A strip of property 20 feet in width from the existing right of way is reserved
for future acqui.sition area for additional road right-of-way along Sullivan Road
c. Future building and other setbacks required by the Spokane County Zoning
Code shall be measiu►ed from the reserved future acquisicion area.
d. No required landscaping, parking, '208' areas, drainf'ield or allowed signs
should be located within the future acquisition azea for road right-of-way and
utilities. If any of the above improvements are nlade within this area, they shaU
be relocated at the applicant's expease when roadway improvements are made.
e. The future acquisition area, until acquired, shall be private property and may be
used as allowed in the zone, except that a►ny improvements (such as
landscaping, parking, surface draiaage, drainfield, signs or others) sha11 be
considered inCerim uses.
f. The property owner shall be responsible for relocating such "interim"
improvements at the time Spokane County makes roadway improvements after
acquiring said future acquisition area.
10. No water plan is required, and a simple connection is needed prior to the sale of edch
tract and prior to issuance of a building permit for each tract.
11. The owner shall negntiate with Central ValleySchool District anci submit a reeorded
copy of a voluntary agreemeat making provisions for pubIic schools prior to
finalization and recording of the plat. The agreement shaU provide a wntten description
of the subject property to whicb the agreement applies and also state the dollar amount
and any other agreed to mitigati.ag measures.
The owner shall also notify any potential purchasers who have made an agreement to
purchase property within said plat pursuant to the Revised Code of Washington (RCW)
58.17.205, that adequate provisions for school fa+cilities must be made conditioned on a
future agreement between the plattor and school district.
Voluntary agreemeats between the owner and school district shall conforin to the
requirements of RCW Chapter 82.02.

12. A survey is required prior ta the filing of a final plat.
13. The applicant shall contact the Division of Buildi.ng and Planaing at the earliest possible
stage in order to be informed of code requirements administered/enforced as authonzed
by the State Btuld.ing Code Act. Design/development concerns i.aclude:
ADDRESSING, FIItE AP'PAR.ATUS ACCESS ROADS; FIRE HYDRANTiFLOW;
APPROVED WATER SYSTEMS; BUII.DING ACCESSIBII.TTY; CONSTRUCTION
TYPE; OCCUPANCY CLASSIFICATION; EXITING; FXTERIOR WALL
PROTECTION; AND ENERGY CODE REGULATIONS. (Note: The Divisioa of Builcling and Planning reserves the right to confirm the actual address at the time of
building permit.)
COUNTY DIVISION OF ENGINEERING AND ROADS CONDITIONS
1. The conditional approval of the plat is given by the County Engineer subject to dedication
of right-of-way and approval of the road system as indicated in the prelinunary plat of
record.
2. No constructioa work is to be performed within the e3usting or proposed public right-of-
way until a pernut has been issued by the County Engineer. All work is subject to
inspection aad approval by the County Engineer.
3. Individual driveway access pennits are required prior to issuance of a building permit for
driveway approaches to the county road system.
4. Dedication of 20 feet of additional right-of-way aloDg Murbach Road is required.
5. Exis[ing county roads providing direct access to the plat shall be paved and/ar curbed to
Spokane Counry standards.
6. Sidewallcs are required along the arterial on Sullivan Road.
7. To construct the road improvements stated herein, the applieant may, wit,h the approval of
the County Engineer, join in and be a willing participant in any petition or resoluuoa which
purpase is the formauon of a Road Improvemeat Distnct (RID) for said improvetnents,
pursuant to RCW 36.88, as anended. At such time as an RID is created or any Road
Imgrovement Project is sanctioned by Spokane County, the improvemeats required (curb,
sidewalk, drainage control and paving to existing pavement) will be at the sole expense of
the undersigned owner(s), their heirs, grantees and assigns. This provision is applicable to
Sullivaa Road and Murbach Road.
8. As an alternative method of constructi.ag the road improvements stated herein, the applicant
may, with the approval of the County Engineer, accomplish the road improvements stated
herein by joining and participating in a County Road Project (CRP) to the extent of the
required road improvements. At such time as an RID is created or any Road Improvement
Project is sanctioned by Spokane County, the improvements required (curb, sidewalk,
rlrauaage control and paving to existing pavement) will be at the sole expense of the
undersigned owner(s), their heirs, grantees and assigns. This provision is applicable to
Sullivann Road and Murbach Road.
9. The following statement shall be placed in the plat dedication:
In consideration of Mutual Benefits now or to be hereafter derived, do for themselves, their
heirs, grantees, assigns and successor(s) in interest hereby request and authorize Spokaae
Couaty to include the above described property in a Road Improvement District (RID) and
to support the forniation of a RID for improvement of the road(s) clescribed below by
requesting and authorizing Spokane County to place their name(s) on a petition for the
forrnation of a RID pursuant to RCW 36.88.050, or by requesting and authorizing
Spokane County to cast their ballot in favor of a RID bemg forrned under the resolution
method pursuant to RCW 36.88.030, andlor by not filing a protest against the focmation of
a RID being formed under the alternative resolution method provided for in RCW
36.8$.065 and Chapter 35.43 RGW.
If a RID is proposed for improvement of the road(s) described below, said owner(s)
aad successor(s) further agree: (1) that the improvements or construction
contemplated within the proposed RID are feasible aad (2) that the benefits to be
derived from the fornaation of the RID by the property inGluded therein, together with
the amount of any County participation, exceeds the cost and expense of formation of
the RID, and (3) that the property within the proposed RID is sufficiently developed;

provided, themselves, their heirs, granntees, assigns and successor(s) shall retain the
right, as authorized under RCW 36.88.090, to object ta any assessment(s) on the
property as a result of the improvements called for in conjunccion with the formation
of a RID by either che petition or resolution method under Chapter 36.88 RCW and to
appeal to the Superior Court the decision of the Board of County Commissioaers
confirnung the final assessment roll; provided further, it is recognized that actual
assessments may vary from assessment estimate so long as they do not exceed a
figure equal to the increased true and fair value improvement(s) add(s) to the
property.
It is further acknowledged and agreed that at such time as a RID is created or any
County Road Improvement project is authorized by Spokane County, the
improvements requireti shall te at the sole expense of the owner(s) of property witbin
the RID or served by the unprovemeats without any monetary participaUon by
Sgokane Counry.
The RID waiver con[ained in this agreement shall expire after ten (10) years from the
date af execution below. This provision is applicable to Sullivan Road and Murbach
Road.
10. The County Engineer has designated a Special Roadway Section for the improvement of
Sullivan Road, which is adjacent to the proposed development. This will require the
addition asphalt to be determined by engineering road plans along the frontage of the
development. The construction of curbing and sidewallc is also required.
11. The County Engineer has desi,gnated a Local Access Roadway Section for the improvement
of Murbach Road, which is adjacent to the progosed developraent. This will requue the
addition of approximately 30 feet of asphalt along the frontage of the development. The
construction of curbing and sidewalk is also required.
12 The proposed plat shall be improved to the standards set forth in Spokane County 8oard of
Commissioners Resolution No. 95-0498, as amended, which resolutian establisbes
regulations for roads, approaches, drainage and fees in new coastruction.
13. The County Engineer has examined ttus development proposal and has determined that the
impact of this proposal upon the existinng county road system wamants the dedicatioa of
additioaal right-of-way and the roadway improvements herein specified.
14. The County Arterial Road Plan identifies Sullivan Road as a 100 foot Frincipal Arterial.
The existing right-of-way width of 60 feet is not consistent with that specified in the Plan.
In order to implement the Arterial Road Plan, A strip of property 20 feet in width along the
Sullivan Road frontage shall be set aside in reserve. Ttus property may be acquired by
Spokane Counry at the time when arterial improvements are made Co Sullivan Road.
15. There raay exist utilities, either underground or overhead, affecting the subject property,
includ.ing property to be dedicated or set aside for future acquisition. Spokane County
assumes no financial obligation for adjustments or relocation regarding these utilities.
Applicaat(s) should check with the applicable utility purveyor and the Spokane Couaty
Engineer to determine whether applicant(s) or the utility is responsible for adjustrnent or
relocation costs and to make arrangements for any necessary work.
16. The applicant shall sign and record a"Spokane County Notice co Public No. 4", which will
allow the construction of a private driveway within the public right of way. The driveway
shall be constructed to Spokane County Standards.
COUNTY DIVISION OF UTILITIES COND►ITIONS
1. Pursuant to the Board of County Commissioners Resolution No. 80-041 g, the use of
on-site sewer disposal systems is hereby authorized. This autborization is conditioned

COUNTY HEALTH DISTRICT CONDITIONS
1. The final plat shall be designed as indicated on the preliminary plat of record and/or any
attached sheets as noted.
2. Appropriate utility easements shall be indicated on copies of the preliminary plat of
record for distribudon by the Building and Planning Division to the utiliry companies,
Spokane County Engineer and the Spokane County Health District. Written approval
of the easements by the utility companies must be received prior to the submittal of the
final plat.
3. Sewage disposal method shall be as authorized by the Director of the Spokane County
Division of Utilities.
4. Water service shall be coordinated through the Spokane County Division of Utilities.
5. Water service shall be by an existing public water supply when approved by the
Regional Engineer (Spokaae), State Department of Health.
6. Prior to filing the final plat, the sponsor shall demonstrate to the satisfactioa of the
Spokane Couaty Health District that an adequate and potable water supply is available
to each tract of the plat.
7. Prior to filing the final plat, the sponsor shall present evidence that the plat lies within
the recorded service area of the water system proposed to serve the plat.
8. Prior to fili.ag the final plat, the sponsor shall demonstrate to the satisfaction of the
Spokane Counry Health District that suitable sites for oa-site sewage disposal systems
are available on Tracts "B" and "C".
9. Prior to filing the final plat, the sponsor shall demonstrate to the satisfaction of the
Spokane County Health District that the existing on-site sewage disposal system
serving the residence located on Tract "A" is wholly located within the boundaries of
the tract.
10. Subject to specific application approvai and issuance of permits by the Health Officer,
the use of individual on-site sewage disposal systems may be authorized.
11. The ded.icatory language of the plat will state: "Subject to specific application approval

The following "Conditions of Approval" for the above referenced subdivision
are submitted to the Spokane County Planning Department for inclusion in the
"Findings and Order" should the short plat be approved.
E 1 Tuat conditional approval of the plat by the County Engineer is given subject to
dedication of Right-of-Way and approval of the road system as indicated in the
preliminary plat of record.
8 6 No construction work is to be performed within the existing or proposed Public
Right-of-way until a permit has been issued by the County Engineer. All work is
subject to inspection and approval by the County Engineer.
E12 The applicant should be advised that individual driveway access permits are required
prior to iasuance of a building permit for driveway approachea to the County road
system.
E13 • Dedication of 20 feet of additional Right-of-Way along Murbach Road.
E16 Existing County roads providing direct access to the plat shall be paved
and/or curbed to Spokane County standards.

to the extent of the required road improvement. At such time as an RID is created or
any Road Improvement Project is sanctioned by Spokane County, the improvements required
(curb, sidewalk, drainage control and paving to existing pavement) will be at the aole
expense of the undersigned owner, their heirs, grantees and assigns. This provision
is applicable to Sullivan Road and Murbach Road.
E22 That the following statement shall appear within the dedicatory language of the final
plat:
That in consideration ot Mutual Benefits now or to be hereafter derived, do for
themselves, their heirs, grantees, assigns and successor{s} in interest hereby request
a:iLd authorize Spokane County to include the above described property in a Road
Improvement District (RID) and to support the formation of a Road Improvement Dietrict
for improvement of the road(s) described below by requesting and authorizing Spokane
County to place their name(s) on a petition for the formation of a Road Improvement
District pursuant to RCW 36.88.050, or by requesting and authorizing Spokane County to
cast their ballot in favor of a RID being formed under the resolution method pursuant
to RCW 36.88.030, and/or by not filing a protest against the formation of a RID being
formed under the alternative resolution method provided for in RCW 36.88.065 and
Chapter 35.43 RCW.
If a RID ie proposed for improvement of the road(s) described below, said owner(s) and

successor (s) further agree: (1) that the improvements or conatruction contemplated
within the proposed RID are feasible and (2) that the benefits to be derived from the
formation of the RID by the property included therein, together with the amount of any
County participation, exceeds the cost and expense of formation of the RID, and (3)
that the property within the proposed RID is sufficiently developed; provided,
themselves, their heirs, grantees, assigns and euccessor(s) shall retain the right, as
authorized under RCW 36.86.090, to object to any assessment(s) on the property as a
result of the improvements called for in conjunction with the formation of a RID by
either the petition or resolution method under Chapter 36.88 RCW and to appeal to the
Superior Court the decision of the Board of County Commissioners confirming the final
assessment ro11; provided further, it is recognized that actual assessments may vary
from asaeasment estimate so long as they do not exceed a figure equal to the increased
true and fair value improvement(s) add(s) to the property.
It is further acknowledged and agreed that at such time as a RID is created or any
County Road Intprovement project is authorized by Spokane County, the improvemeata
required shall be at the sole expense of the owner(s) of property within the RID or
served by the improvements without any monetary participation by Spokane County.
The RID waiver contained in this agreement shall expire after ten (10) years from the
date of execution below. This provision ie applicable to Sullivan Road and Murbach
Road.
E24 The County Engineer has deaignated a Spcial Roadway Section for the improvement of
Sullivan Road which is adjacent to the propoaed development. This will require the
' addition of asphalt to be determined by engineered road plans along the frontage of the
development. The conatruction of curbing and sidewalk is also required.
E24 T'he County Engineer has designated a Local Access Roadway Section for the improvement
of Murbach Road which is adjacent to the proposed development. This will require the
addition of approximately 30 feet of aephalt along the frontage of the development.
The construction of curbing and sidewalk is also required.
E32 The proposed plat ehall be improved to the standards set forth in Spokane County Board
of Commissioners Resolution No. 95-0498, as amended, which establishes regulations for
roads, approaches, drainage and fees in new construction.
E33 The County £ngineer haa examined this development proposal and has determined that the
impact of this proposal upon the existing County Road System warrants the dedication
o,. additional Right of way and the roadway improvements herein specified.
$61 The County Arterial Road plan identifies Sullivan Road as a 100 foot Principal
Arterial. The existing right of way width of 60 feet is not consistent with that
specified in The Plan. In order to implement the Arterial Road Plan it is recommended
that a strip of property 20 feet ia width along the Sullivan Road frontage be set aside
in reserve. This property may be acquired by Spokane County at the time when Arterial
Improvements are made to Sullivan Road.
E90 The applicant should be advised that there may exist utilities either underground or
overhead affecting the applicants property, including property to be dedicated or aet
aside future acquieition. Spokane County will assume no financial obligation for
adjustments or relocation regarding these utilities. The applicant ahould check with
the applicable utilities and Spokane County Engineer to deternune whether the applicant
or utility is respoasible for adjuatment or relocation costs and to make arrangements
for any necessary work.
SPBCIAL CONDITION: The applicant shall sign and record a"Spokane County Notice To Public
No. 4" which will allow the construction of a private driveway within the public right
of way. The driveway ahall be constructed to Spokane County Standards.

We the undersigned object and pefition to short plat appiication af SP-1064-96 due to traffic,
noise, safety issues (close proximitjr of road to existing homes) etc. The proposed road is less
than 15 feet from the homes of lots 4, 5. 6, 8 7 of the Pleasant Cove Devefopment. Chiidren are
piaying in the backyard. Cars are always coming into Pleasant Cove trying to get thru on 26th
Ct This is a cuf de sac street and is fenced at the end. The cars have to tum around & go back
out. The high school is nearby. Yaung drivers drive faster and sometimes are not as careful.
The drivers attempt to come from both 26 Court as well as 26 Avenue to find a thru straet.
The proposed street on this short plat attaches !0 26th Avenue and would be used to come
into proposed road. We will have these drivers trying to get thru on this proposed road and then
will have to tum around and get out.
We are worried about accidents ending up in our backyards with children playing there. The
statements we make to our children that it is safer to play in the backyard now becomes a myth.
Dead end signs DO NOT work. Drivers miss the signs on 26th Court and still try to get thru.
Snow removal is another concem. With the proposed road less than 15 feet from our
backyards. People use snow plows and the snow drifts. Last winter, we had 3 feet of snow
against our houses. If we have more pited up, there"II be more in our yards. We already have
some etder(y people that are ill and unabte to struggle with snow.
We request that the proposed road be moved to the SOUTH END of the property away from
our backyards and existing homes.
We have all worked very hard to get these nice homes and ask that homes of equal value be
built on this proposed site so as not to devalue our homes. The pleasant cove site homes, near
this short plat, range from $174,000.00 to 200,000.00
We respectfully request a public hearing on this matter.
