1. That drainage plans and design calculalions shawing the alignnnent of drainage facilities
be submitted to the County Engineer for acceptance prior to canstruction and/or the filing
of the final plat. I)rainage plans to be prepared under the direction of a licensed

be bitled monthly as accrued. Any billing amounts due, inclucfing any expenses incurred in tlle
collection of an overcfue account, must be paid prior tn the County's acceptance of the project for
filing. If a project is aprroved and/ar filed with a balance still owing, the unpaid balance sliall he
paid witiiin 30 days af ttie invaice date.

being the owners of the following described lands in consideration of Mutual Benefits to be hereafter derived do for
themselves, their heirs, grantees and assigns, hereby agree to the following:
There may be a need in the future to construct a public road to serve the lands herein described. Said road ahall be
constructed in accordance with the then adopted Spokane County Road Standards for public roads. Said road to
follow, as near as practicable, the existing County road right of way.
If additional right of way is required, the owners, their heirs and/or assigns agree to deliver to Spokane County a
property signed and executed Right of Way Deed covering the required additional right of way.
The owners or succecsors in interest Agree to authorize Spokane County to include the below described property
in a Road Improvement District (RID) and to support the formation of a Road Improvement District for
improvement of the road(s) described below by requesting and authorizing Spokane County to p1aGe their name on
a petition for formation of a Road Improvement District pursuant to RCW 36.88.050, or by requesting and
auihorizing Spokane County to cast their ballot in favor of aRID being formed under the resolution method pursuant
to RCW 36.88.030, and/or by not filing a protest against the formation of a RID being formed under the alternative
resolution method provided for in RCW 36.88.065 and Chapter 35.43 RCW.
If a RID is proposed for impravement of the road(s) described below, said owners and successors further agtee: (1)
that the improvements or Gonstruction contemplated within the proposed RID are feasible, and (2) that the bene6ts
to be derived from the formation of the RID by the property included therein, together with the amount of any County participation, exceed the cost and expense of formation of the RID, and (3) that the property within the
proposed RID is sufficiently developed; provided, the owners or successors shall retain the right, as authorized under
RCW 36.88.0901 to object to any assessment(s) on the property as a result of the improvements called for in
conjunction with the formation of a RID by either the petition or resolution method under Chapter 36.88 RCW and
to appeal to the superior court the decision of the Board of County Commissioners confirming the final assessment
roll; provided further, it is recognized that actual assessments rnay vary from assessment estimate so tong as they do
not exceed a figure equal to the increased tnie and fair value the improvement add to the property.
By allowing a building perrnit to be issued on property having access from an unmaintained County road, Spokene
County assumes no obiigation for said road, and the owners hereby acknowledge that the County has no obligation
of any kind or nature whatsoever to establish, examine, survey, construct, alter, repair, improve, maintain, provide
drainage or snow removal on said road. The requirement is and shall run with the land and shall be binding upon the
owners, their heirs, successors or assigns, until said road is improved to Spokane County Road Standards and
accepted by the County for maintenance.
The undersigned owners, their heirs, successors or assigns hereby release Spokane County, and all its officers,
employees and agents from any responsibility or liability fbr any damsge whatsoever to the hereinabove described
lands and improvements thereon as a result of allowing a building permit to be issued on property which is served
by a unmaintained County road.
These requirements are and shall run with the land and shall be binding upon the owners, their heirs, successora or
assigns. This agreement shall expire after ten (10) years from the date of execution below.

SHORT PLAT NO. SP-1063-96 ) CONCLUSIONS AND ~
DECISION 0~ e~►

THIS MATTER, an application for subdivision of land from John and Lynn Neace has been
received and decided upoa, pursuant to Spokane County Subd.ivision regulations, on the
j day of April, 1996.
FINDINGS OF FACT AND CUNCLUSIONS
1. The iadividual signing below has further been properly delegaterl the responsibility for
rendering the decision by the Spokane County D'uector of Building and Planning.
2. The proposal is to divide approximately 1.9 acres into 2 tracts for 1 existing single
fanaily residence and 1 new additioaal residential tract and those uses germitted in the
Urban Residential-3.5 (UR-3.5) zone.
3. The propasal is located between Blake Road and Mamer Road and approximately 804
feet south of Missioa Avenue in the NE 1/4 of Section 15, Township 25 North, Range
44 E.W.M. Spokane County, Washington.
4. The existing zoning of the property described in the applicadon is Urban Residential-
3.5 (UR-3.5), previously established as Agricultural (A) (file # 60-42) zoning in 1942
and redesigaated to UR-3.5 on Jaauary 1, 1991, pursuant to the Program to Implement
the Spokane County Zoning Code. Pursuant to RCW 58.17.195 the proposal does
conform to the requirements of the existing UR-3.5 zone.
5. The Spokane County Comprehensive Plan designates this area as URBAN. The
development and uses, as proposed and conditioned are ia compliance with this
category.
6. Surrounding uses are primarily single family residences on mixed urban size lots.
7. The Spokane County Arterial Road Plan identifies 1Vlamer Road as a Local Access Road
with a future right of way width of 60 feet. The existiag right of way width is 40 feet.
In order to implement the Arterial Road Plan, a strip of property 10 feet in width along
the Mamer Road frontage is to be set aside as a Futune Acquisition Area. In addition,
the Spokane County Arterial Road Plan identifies Blake Road as a Local Access Road
with a future right of way width of 60 feet. The existing right of way width is 30 feet.
In order to implement the Arterial Road Plan, the County Engineer has requested a
dedicadon of 30 feet of additional right of way along Blake Road. Therefore, as
coaditioned, (such as improvements, dedication aad acquisition areas) the proposal
coaforms to the Road Plan.
8. The site is located within the Public Transportation Benefit Area (PfiBA). The Spokane
Transit Authority (STA) Valleyfi'rentwood, Route #20 provides connecting services to
the site.
9. The proposed short plat will be served by a public water system. Waste water disposal
will be as authorized by the Director of Utilities.
10. The required public notice was pravided for this proposal and agencies having a
poteatial interest in the project were notified and recommendations sol.icited. No
comments or conditions were provided by the County Pazks Department regazding this
proposal. Presently, che Board of County Commissioners and the Pazks Department
are in the process of reevaluati.ng the continued use of Park and Recreation Voluntary
Mitigation Agreements while the Parks Plan is being updated.
11. No written comments were received from any adjoining property owners.
12. Recognizi.ng the recommended conditions and Spokane County development standards,
the proposed short plat makes appropriate provisions for the public health, safety and
general welfare and that the public use and interest will be served by platting the
subdivision.

The subdivision proposal is generally consistent with RCW 58.17 and the County
subdivision regulations, promoting the public health, safery and general welfare in
accordaace with standards estabIished by the state and Spokaae County. The Building
and Planning Division has considered the provision of adequate public facilities as cited
in RCW 58.17.110 (2). More specifically:
a. open sgaces
b. drainage ways
c. public and/or private aghts-of-way
d. transit
e. potable water
f. sanitary waste disposal
g. parks aad recreation facilities
h. playgrounds
i. schools and schoolgrounds
j . sidewallcs
13. The project is exempt from environmental review under the State Environmental Policy
Act pursuanc to wAC 197- i i-800 (6) (a).
14. The Central Valley Scbool District has commented on the proposed Short Plat. The
District has indicated that existing school facilities are inadequate to serve the groposed
short plat and wishes to negotiate with the owaer to provide adequate capital facilities as
required by the Revised Code of Washingtoa (RCW) 58.17.110. Review by County
legal counsel indicates the condition requested by the School District can be required for
developments. Approval of this short plat should include cond.itions requiring that
provisions for apgropriate facilities be in place prior to recording the final short plat in
the fonn of a wricten agreement between the ovvner and the school district.
DECISI4N
Based upon the above noted Findings of Fact and Coaclusioas, Short Plat Application SP-
1463-96 is hereby APPROVED for five (5) years, specifically to May l, 2001 and subject to
conditions noted below. This decision is final unless appealed in writing, consistent with
adopted appeal procedures. All the below cond.idons imposed shall be binding oa the
"Applicant", which term sball include the owner or owaers of the property, heirs, assigns and
successors.
COUNTY DIVISION OF BUILDING AND PLANNING C-ONDITIONS
1. The proposal shall comply with the Urban Residential-3.5 (UR-3.5) zone, as amended.
2. 1'he final plat shall be designed svbstantially in conformance with the preliminary plat
of record. No increase of density or number of tracts shall occur without a change of
condition application submittal and approvai.
3. The Building and Planning Directorldesignee shall review any proposed final plat to
ensure compliance with these Findings and Conditions of Approval.
4. The preliminary plat is given conditional approval for five (5) years, specifically to May
1, 2001. 1'he applicant may request an extension of time by submitting a written
request appro3cimately forty-five (45) days prior to the above expiration date.
5. Three (3) current certificates of title shall be furnished to the Build.ing and Planning
Division prior to filing the final plat.
6. Appropriate ufiility easements shall be indicated on copies of the proposed final plat.
Written approval of utility easements by appropriate utility companies shall be received
with the submitta] of the final plat.
7. Prior to filing of final plat, the appropriate road name(s) and street address(es) shall be
tndicated.
8. The final plat map shall indicate by a clear, dashed line the required yard setbacks from
all private, "Tract X" or public roads. The dedication shall contain the following
Findings and Decision SP-I063-96 2
statement:
"Side yard and rear yazd setbacks shall be determined at the time building pennits are
requested unless these setbacks are specifically drafted on this final plat. The setbacks
indicated on this plat may be varied from if proper zoning approvals are obtained."
9. The Spokane County Division of Building and Planning shall prepare and record with
the County Auditor a Title Notice specifying a future land acquisition area for road
right-of-way and utilities. The neserved future acquisition area Title Notice shall be
released, in full or in part, by the Build.ing and Planning Division. The notice should
be recorded the same time as the final plat aad shall provide the following:
a. A strip of property 10 feet in width from the existing right of way is reserved
for future acquisition area for additional road night-of-way along Mamer Road
b. Future build.ing and other setbacks required by the Spokane County Zoning
Code shall be measured from the reserved future acquisition area.
c. No required landscaping, parking, '208' areas, drainfield or allowed signs
should be located within the future acquisition area for road right-of-way and
utilities. If any of the above improvements are matte within this area, they shall
be relocated at the applicant's expense when roadway improvements are made.
d. The future acquisition area, until accluired, shall be private property and may be
used as allowed in the zone, except that any improveraeots (such as
Iandscaping, parking, surface drainage, drainfield, signs or others) shall be
considered interim uses.

e. The property owner shall be responsible for relocating such "interim"
impravements at the time Spokane County makes roadway improvements after
acquiring said future acquisition area.
10. A plan for water facilities ttdequate for domestic service and fire protection shall be
approved by the water purveyor, appropriate fue protection district, County Division of
Buildings and Counry Health District. The agencies wiil certify on the Water Plan,
prior to the filing of a fiaal plat, that the plan is in conformance with their respective
needs and tegulations. The Water Plan and certificatioa shall be drafted on a
transparency suitable for reproduction and be signed by the plat sponsor.
11. The water purveyor shall certify that appropriate contractual arrangements and schedule
of imFrovements have been made with the glat sponsor for construction of the water
system in accordance with the approved Water Plan. The time schedule shall provide
for completion of the water system and inspection by the appropriate health authorities
prior to application for building permits within the final plat. The arrangements or
agreements shall include a provision holdi.ng Spokane Couaty and the purveyor
harmless from claims by any tract purchaser refused a building permit due to the failure
of the subdivision sponsor to satisfactorily eomplete the approved water system
12. The final plat ded.ication shall contain the following statement:
"The public water system, pursuant to the Water Plan approved by County and State
health authorities, the local fire protection district, water purveyor and Spokane County
Divisioa of Buildiag and Planning shall be installed within this subdivision, and the
applicant shaU provide for individual domestic water service as well as fire protection to
each tract prior to sale of each tract a.ad prior to issuance of a building peunit for each
tracG11
13. No building permit will be issued for aay tract withixi the final plat uatil certified by a
Washington state-licensed engineer that "the water system has been installed pursuaat
to the approved Water Plan for the final plat" including a signed license stamp. The
certificaaon may be in the form of a letter, but is preferned to be certified on a copy of
the Water Plan as a schematic map showing the "as-constructed" water system.
14. The Water Plan and the above four (4) conditions of approval regarding the Water Plan
may be waived by the Planning Directorldesignee upoa receipt of letters from the
appropriate water purveyor and fire protection distriet stating that simple connections to
an existing, approved water system will provide adequate domestic and fue protection
water to ensure the public health, safety aad general welfare.
15. The owner sha11 negotiate with Central Valley School District and submit a recorded
copy of a voluntary agreement making provisions for public schools prior to

finalization and recording of the plat. The agreement shall provide a written description
of the subject property to which the agreement applies and also state the dollar amount
and any other agreed to mitigating measures.
-/The owner shall also notify any potential purchasers who have made an agreement to
purchase pmperty within said plat pursuant to the Revised Code of Washington (RCV)
58.17.205, that adequate provisions for school facilities must be made conditioned oa a
future agreecnent between the plattor and school district.
Voluntary agreements between the owner aad school district shall conform to the
requirements of RCW Chapter 82.02.
16. A survey is required prior to the filing of a fina►1 plat.
17. The applicant shall contact the Division of Buildiag aad Planning at the earliest possible
stage in order to be informed of code requirements administered/enforced as authorized
by the State Building Code Act. Desiga/development concerns include:
ADDRESSING, FIRE APPARATUS ACCESS ROADS; FIRE HYDRANT/F'LOW;
APPROVED WATER SYSTEMS; BUILDING ACCESSIBILTTY; CONSTRUCTION
TYPE; OCCUPANCY CLASSIFICATION; EXITIlVG; EXTERIOR WALL
PROTECI'ION; AND ENERGY CODE REGULATIONS. (Note: The Division of
Building and Planning reserves the right to confirm the actual address at the time of

prior to construction andJor the filing of each final plat; road plans to be prepared under the

way unti] a pennit has been issued by the County Engineer. All work is subject to

The RID waiver contained in this agreement shall exp.ire after ten (10) years from the

10. The County Engineer has desigaated Loca1 Access Roadway Section for the improvement
of Mamer Road, which is adjacent to the proposed development. This will reguire the
addition of approximately 46 feet of asphalt along the frontage of the development. The
construction of curbing and sidewalk is also required.
11. The Counry Engineer has designated Local Access Roadway Secdon for the improvement
of Blake Road, wluch is adjacent to the proposed developxnent. This will require the
addition of approximately 27 feet of asphalt along the frontage of the development. The
construction of curbing and sidewalk is also required.
12. The proposed plat shall be improved to the standards set forth in Spokane County Board of
Commissioners Resolution No. 95-0498, as amended, which resolution establishes
regulations for roads, approaches, drainage and fees in new construction.
13. The County Engineer has examined this development proposal and has determ.ined that the
impact of this proposal upon the existing couaty road system warrants the dedication of
additional right-of-way and the roadway improvements herein specified.
14. There may exist utilities, either underground or overbead, affecting the subject property,
including property to be dedicated or set aside for future acquisition. Spokane County
assumes no fiaancial obligation for adjustments or relocation regarding these utilities.
Applicant(s) should check with the applicable utility purveyor and the Spokane County
Engineer to determine whether applicant(s) or the utility is respoasible for adjustment or
relocation costs and to make arrangements for a.ay necessary work.
15. The applicant shall grant applicable border easements adjacent to Spokane County Right of
Way per Spokane County Staridards.

COUNTY DIVISION OF UTILITIES CONDITIONS
1. Pursuant to the Board of County Commissioners Resolution No. 80-0418, the use of
on-site sewer disposal systems is hereby authorized. This authorization is conditioned
in compliance with all rules aad regulations of the Spokane County Health District and
is further conditioned and subject to specific application approval and issuance of
permits by the Health District.
2. The following statement shall be placed in the plat dedication:
"The owner(s) or successor(s) in interest agree to authorize the County to place their
name(s) on a petition for the formation of ULID by petition method pursuant to RCW
36.94, which petition iacludes the owoer(s)' property; aad further not to object by the
sigtung of a protest petition against the fornriation of a ULID by resolution method
pursuant to RCW Chapter 36.94 which includes the owner(s)' property. PROVIDED,
tb.is condition shall not prohibit the owner(s) or successor(s) from objecting to any
assessment(s) on the property as a result of unprovements called for in coajunction
with the formation of a ULID by either petition or resolution under RCW Chapter
36.94."
3. The dedicatory language on the plat shall state: "Each new dwelling unit shall be
double :plumbed for connection to future area-wide collection systems."
4. Sewer easement shall be shown on the face of the plat as, "Sewer and Utilities
Easement."
5. The applica.nt/owner shall submit expressly to the Division of Utilities "Under separate
cover", only those plan sheets showing sewer plans and specifications for pouble
Plumbing for review and approval by the Utilities Division prior issuance of permit to
conuect.
6. Any water service for this project shall be provided in accordance with the Coordinated
Water System Plan for Spokane County, as amended.
COUNTY HEALTH DISTRICT CONDITIONS
1. The fnal plat shall be designed as indicated on the preliminary plat of record and/or any
attached sheets as noted.
2. Appropriate utility easements shall be indicated on copies of the greliminary plai of
record for distribution by the Building and Planning Division to the utility companies,
Spokane County Engineer and the Spokane County Health District. Written approval
of the easements by the utiliry companies must be received prior to the submittal of the
final plat.
3. Sewage disposal method shall be as authorized by the Director of the Spokane County
Division of Utilities.
4. Water service shall be coordinated through the Spokane County Division of Utilities.
5. Water service shall be by an existing public water supply when approved by the
Regional Engineer (Spokane), State Department of Healrh.
6. Prior to filing the final plat, thc sponsor shall demonstrate to the satisfaction of the
Spokane County Health District that aa adequate and potable water supply is available
to each tract of the plat.
7. Prior to filing the final plat, the sponsor shaU present evidence that the plat lies within
the recorded service area of the water system proposed to serve the plat.
8. Prior to filing the final plat, the sponsor shall demonstrate to the saiisfaction of the
Spokane County Health District that suitable sites for on-site sewage disposal systems
are available on Tract "B".
