3. Any invpices not paid within 30 days of the invaice date will be cansidered delinquent.
If any outstanding balance oa the account far this praject is not paid within 30 days of
the invoice date, no fwther reviews of the project documenLs wili be conducted until the
entire account balance is paid. Any balance an the account for this project not paid
within 65 days of the invoice date may result in legal action or the initiation of other
collection procedures, including referral to a collectican agency. The Spansor will be
liable for any and all expenses incurred by the County for the collection of overdue
accounts.

THIS MATTER, an application for subdivision of land, from Tony and Angela Mal s ina
and decided upon, pursuant to Spokane County Subdivision regulations, on the ~ fb~ day
of March, 1996.
FINDINGS OF FACT AND CONCLUSIONS
1. The individual signing below has further been properly delegated the r+esponsibility for
rendering the decision by the Spokane Counry Director of Building and Planning.
2. The proposal is to divide approximately 1 acre into 21ots for residential uses and tliose
uses permitted in the Urban Residential - 3.5 (UR 3.5) zone. There is currendy an
existing house on Lot 1.
3. The proposal is located at the northwest corner of Eighth Avenue and Adams Road, in
the NW 1/4 of Section 23, Township 25 North, Range 44 E.W.M. Spokane County,
Washington.
4. The exi.sting zoning of the properiy described in the application is Urban Residential -
3.5 (UR 3.5). The subject property was previously established Agricultural Suburban
in 1963 (File No. 13-63) and redesignated to Urban Residential - 3.5 (UR 3.5) on
January l, 1991, pursuant to the Program to Implement the Spokane County Zoning
Code. Pursuant to RCW 58.17.195 the proposai does conform to the requirements of
the existing zone.
5. The Spokane Counry Comprehensive Plan designates this ar+ea as Urba.a. The
development and uses, as proposed and condirioned are in compliance with this
category.
6. Surrounding uses consist of residendal uses.
7. The required public notice was provided for this proposal and agencies having a
potenaal interest in the project were notified and recommendadons soliCited. No
comments were received from adjacent property owners.
8. The Spokane County Arterial Road Plan identifies Eighth Avenue as a Minor Arterial
with a future right of way width of 80 feet. The existing right of way width is 54 feet,
with a centerline at 20 feet from the property. In order to implement the Plan, the
County Engineer has requested dedication of 7.5 feet of additional Right-of-Way along
Eighth Avenue. In addition, the County Engineer has requested that a strip of property
12.5 feet in width along the Eighth Avenue frontage be set aside in reserve. This
property may be acquired by Spokane County at the time wheo Arterial Improvements
are made to Eighth Avenue.
The County Engineer has also designated a Minor Arterial Roadway Section for the
improvement of Eighth Avenue. This will require the addition of approximately 16.5-
18.5 feet of asphalt along the frontage of the development. The construction of curbing
and sidewalk is also required. As conditioned, the proposal conforms to the Plan.
10. The Spokane County Arterial Road Plan identifies Adams Road as a Minor Arcerial
with a future right of way width of 80 feet. The existing right of way width is 45 feet,
with a centerline at 20 feet from the property. In order to implement the Plan, the
County Engineer has requested dedication of 7.5 feet of additional Right-of-Way along
Adams Road. In adtlition, the County Engineer has requested that a strip of property
12.5 feet in w7d[h along the Adatns Road frontage be set aside in reserve. This
property may be acquiretl by Spokane County at the time whea Arterial Improvements
are made to Adams Road.
The County Engineer has also designated a Minor Arterial Roadway Section for the
improvement of Adams Road. This will require the addition of approximately 16.5-
18.5 feet of asphalt along the frontage of the development. The consavcdon of

Plan.
11. The site is located within the Public Transportation Benefit Area (PTBA).

12. The proposed short plat will be served by a public water system, requiring only simple
connections. Waste water disposal will be as authorized by the Director of Utilities.
13. The Central Valley School District has commented on the proposed Short PlaL The
District has indicated that existing school facilities ane inadequate to serve the proposed
short plat and wishes to negotiate with the owner to provide adequate capital facilities as
required by the Revised Code of Washington (RCW) 58.17.110. Review by County
legal counsel iadicates the condition requested by the School Disdrict can be required for
developments. Approval of ttus short plat should include condirions requiring that
provisions for appropriate facilides be in place grior to recording the final short plat in
the forai of a written agmment between the owner and the school districL
14. Recognizing the recommended condidons and Spokane County development standards,
~ appropnate provisions should be made to ensure the public health, safety and general
welfare and that the public use and interest will be served by platting the subdivision.
15. The subdivision proposal is generally consistent with RCW 58.17 and the County
subd.ivision regulations, promoting the public health, safety and general welfare in
accordance with standards established by the state and Spokane Counry. The Division
of Planning has considered the provision of adequate public facilides as cited in RCW
58.17.110 (2). More specifically:
a. open spaces f. sanitary waste disposal
b. drainage ways g. parks and recreation facilities
c. public and/or private rights-of-way h. playgronnds
d. nansit i. schools and schoolgrounds
e. potable water j. sidewalks
DECISION
Based upon the above noted Findings of Fact and Conclusions, Short Plat Application
SP-1062-96 is hereby APPROVED undl April 1, 2001, subject to conditions noted below.
Most of the conditions of approval shall be accomplished by the applicant and/or sponsor prior
to finalization of the short subdivision. This decision is fin.al unless appealed in wridng,
consistent with adopted appeal procedures.
The following conditions shall be binding on the "AppliCant," which term shall include the
owner or owners of the property, heirs, assigns and successors.
COUNTY DIVISION OF BUILDING AND PLANNING CONDITIONS
1. The proposal and future development of this progerty shall comply with the Urban
Residential - 3.5 (UR 3.5) zone, as amended.
2. The final plat shall be designed substantially in conforniance with the preliminary plat
of record. No increase of densiry or number of lots shall occur without a change of
condition application submittal and approval.
3. The Planning Director/designee shall review any pr+oposed final plat to ensure
cornpliance with these Findings and Condidons of Approval.
4. The preliminary plat is given conditional approval for five (S) years, specifically to
April l, 2001. The applicant may request an extension of time by submitting a written
request apprnximately forty-five (45) days prior to the above expiration date.
5. Three (3) current certificates of title shall be furnished to Spokane Division of
Flanning prior to filing the final plat.
6. A utility easemenu shall be indicated on copies of the proposed flinal pldt.

7. Prior to filing of final plat, the appropriate road nanae(s) and street address(es) shall be
indicated.
8. The final plat map shall indicate by a clear, dashed line the m,quired yard setbacks from
all private, "Tract X" or public roads. The dedicadon shall contain the following
statement:
"Side yard and rear yard setbacks shall be determined at the time building permits are
requested unless these setbacks are specifically drafted on this final plat. The setbacks
ind.icated on this plat may be varied from if proper zoning approvals are obtained."
9. The Spokane County Division of Planning shall prepare and record with the County
Auditor a Tide Notice specifying a future land acquisidon area for raad right-of-way
and ntilities. The reserved future acquisition area Title Nodce shall be releaserl, in full
or in part, by the Division af Planning. The notice should be reconied with the final
plat and shall provide the following:
a. A strip of prioperty 12.5 feet in width from the existing right of way along the
Eighth Avenue and AdanLS Road frontage is to be set aside as Futime
Acquisition Area (FA.A) for additional road right of way.
, b. Future build.i.ng and other setbacks required by the Spokane County Zoning
' Code shall be measured from the reserved future acquisition area.
c. No required landscaping, parking, '208' areas, drainfield or allowed sigas
should be located widiin the future acquisition area for road right-of-way and
utilities. If any of the above i.mprovements are made within this area,, they shall
be relocated at the applicant's expense when roadway improvements are made.
d. The future acquisition area, until acquired, shall be private property and may be
used as allowed in the zone, except that any improvements (sucb as
landscaping, parking, surface drainage, drainf'ield, signs or others) shall be
considered interim uses.
.
e. The property owner shall be responsible for relocating such flinterimlf
improvements at the time Spokane Couniy makes roadway improvements after
acquiring said future acquisition area.
10. A survey is re.quired prior to the filing of a final plaL
11. The owner shall negotiate with the Central Valley School District and submit a recorded
copy of a voluntary agreement making provisions for public schools prior to
finalizadon and rrecording of the plaL The agreement shall provide a written description
of the subject property to which the agreement applies and also state the dollaz amount
and any other agreed to midgating measures.
The owner shall also notify any potendal purchasers who have made an agreement to
purchase property within sa.id plat pursuant to the Revised Code of Washington (RCV)
58.17.205, that adequate provmons for school facilides must be made conditioned on a
future agreement between the plattor and school district.
Voluntary agreements between the owner and school district shall confonn to the
requirements of RCW Chapter 82.02.
12. The agplicant shall contact the Division of Building and Planning at the earliest possible
stage in order to be infornned of code requirements administered/enforced as authorized
by the State Building Code AcL Design/development concerns include: ADDRESSDVG,
FIRE APPARATUS ACCESS ROADS; FIRE HYDRANT/FLOW; APPROVED WATER
SYSTEMS; BUII,DWG ACCESSIBII.ITY; CONSTRUCTTON TYPE; OCCUPANCY
CLASSIFICATION; EXTITNG; EXTERIOR WALL PROTECTION; AND ENERGY CODE
REGULATIONS. (Note: The Division of Build.ing and Planning reserves the right to
confinn the actual address at the time of building permit.)

CAUNTY DIVISION OF ENGINEERING AND ROADS CONDITIUNS
1. That conditional approval of the plat by the County Engineer is given subject to
dedication of Right-of-Way and approval of the road system as indicated in the
preliminary plat of mcord.
2. No consavction work is to be performed within the existing or proposed Public Right-of-
Way until a pernut has been issued by the County Engineer. All work is subject to
inspection and approval by the County Engineer.
3. The applicant should be advised that individual driveway access pennits are required
prior to issuance of a building permit for driveway approaches to the Counry road
system.
4. DedicaCion of 7.5 feet of add.itional Right-of-Way along Eighth Avenue.
5. Dedication of 7.5 feet of additional Right-of-Way along Adams Road.
6. Applicant shall dedicate the applicable rad.ius on Eighth Avenue and Adams Road.
7. Existing County roads providing direct access to the plat shall be paved and/or curbed to

10. The word "applicant" shall include the owner(s) of the property, his/her heirs, assigns
and successors.
11. T4 construct the road improvements stated herein, the applicant may, with the approval of
the County Engineer, join in and be a willing participant in any petition or resolution
which purposes is the fonnadon of a Road Improvement District (RID) for said
improvements pursuant to RCW 36.88, as amended. At such time as an RID is created
or any Road Improvement Project is sanctioned by Spokane County, the improvements
required (curb, sidewalk, drainage control and paving to existing pavement) will be at the
sole expense of the undersigned owner, their heirs, grantees and assigns. This provrsion
is applicable to Eighth Avenue and Adams Road.
12. As an alternative method of constructing the road improvement stated herein, the
applicant may, with the approval of the County Engineer, accomplish the road
unprovements stated herein by joining and participating in a Couaty Road Project (CRP)
to the extent of the required road improvement. At such time as an RID is created or any
Road Iinprovement Project is sanctioned by Spokane County, the improvements required
(curb, sidewalk, dra.inage conmol and paving to existing pavement) will be at the sole
expense of the undersigned owner, their heirs, grantees and assigns. This provision is
applicable to Eighth Avenue and Adams Road.

13. That the following statement shall appear within the dedicatory language of the final plat:
That in considerarion of Mutual Benefits now or to be hereafter derived, do for
themselves, their heirs, grantees, assigns and successor (s) in interest hereby request and
authorize Spokane County to include the above described property in a Road
Improvement Disn-ict (RID) and to support the formation of a Road Ivaprovement District
for improvement of the road(s) described below by requesting and authorizing Spokane
County to place their name(s) on a petition for the formadon hf a Road Improvement
DistriCt pursuant to RCW 36.8$.050, or by recluesting and authorizing Spokane County
to cast their ballot in favor of a RID being formed under the resolurion method pursuant
to RCW 36.88.030, andlor by not filing a protest against the formation of a RID being
formed under the alternative resolution method provided for in RCW 36.88.065 and
Chapter 35.43 RCW.
If a RID is proposed for improvement of the road(s) described below, said owner(s) and
successor(s) further agree: (1) that the improvements or construction contemplated within
the proposed RID are feasible, (2) that the benefits to be derived &om the fotmation of
the RID by the property included therein, together with the amount of any County
participation, exceeds the cost and expense of formation of the RID, and (3) that the

property within the proposed RID is sufficiently developed; provided, themselves, their
heirs, grantees, assigns and successor(s) shall retain the rigbt, as authorized uader RCW
36.88.090, to object to any assessment(s) on the property as a result of the improvements
called for in conjuncdon with the formation of a R.ID by either petition or resoludon
method under Ghapter 36.88 RCW, and to appeal to the Superior Court the decision of
the Board of County Commissioners confinming the fiaal assessment roll; provided
further, it is recognized that actual assessments may vary fnom assessment estimate so
Iong as they do noi exceed a figure equal to the increased true and fair value
improvement(s) add(s) to the property.
It is further acknowledged aad agreed that at such time as a RID is creaied or any County
Raad Improvement project is authorized by Spokane County, the ixnprovements required
sha11 be at the sole expense of the owner(s) of property within the RID or served by the
improvements without any monetary pardcipation by Spokane County.
The RID waiver contained in this agreement shall expire after ten (10) years from the date
of executioa below. This provision is applicable to Eighth Avenue and Ada.ms Road.
14. The Counry Engineer has designated a Minor Arterial Roadway Section for the
improvement of Adams Road which is adjacent to the proposed developmenL This will
recYuire the addition of approximately 16.5-18.5 feet of asphalt along the frontage of the
developmenL The construcdon of curbing and sidewalk is also required.
15. The Counry Engineer has designated a Minor Arterial Roadway Section for the
impmvement of Eighth Avenue which is adjacent to the proposed development. This v►+ill
require the addition of approximately 16.5-18.5 feet of asphalt along the frontage of the
developmenL The constnicdon of curbing and sidewalk is also required.
16. The proposed subd.ivision shall be improved to the standards set forth in Spokane County
Board of Commissioners Resoludan No. 95-0498, as a.mended, which resolution
establishes regulations for roads, apprvaches, drdinage and fees in new construcrion.
17. The County Engineer has exainined this development proposai and has determined that
the impact of this proposal upon the eacisting County Road System warrants the
dedication of addi.tional Right of QVay and the roadway unprovements herein specified.
18. The County Arterial Road plan identifies Eighth Avenue as a 80 foot Minor Arterial. The
existing right of way width of 50 feet is not consistent with that specified in The Plan. In
order to implement the Arterial Road Plan it is recommended that in addition to the
required right of way dedication, a strip of property 12.5 feet in width along the Eighth
Avenue frontage be set aside in reserve. Tfiis property may be acquir+ed by Spokane
Counry at the timme when Arterial Impmvements are made to Eighth Avenue.
19. The County Arterial Road plan identifies Adams Road as a 80 foot Minor Arterial. The
existing right of way width of 45 feet is not consistent with that specified in The Plan. In
order to implement the Arterial Road Plan it is recommended that ia addition to the
required right of way dedication, a strip of property 12.5 feet in width along the Adams
Road frontag+e be set aside in reserve. This property may be acquired by Spokane
County at the time when Arterial Improvements are made to Adams Road.
20. The applicant should be advised that there may e}dst utilities either underground or
overhead affecting the applicants property, including property to be dedicated or set aside
for future acquisition. Spokane County will assnme no financial obligation for
adjustments or relocation regarding these udliues. The applicant should check with the
applicable utilides and Spokane County Engineer to deternrine wbether the applicant or
utility is responsible for adjustrnent or relocation costs and to make arrangements for any
necessary work.
2 1. ne applicant shall grant applicable border easements adjacent to Spokane Counry Right
of Way per Spokane County Standards.
COL'tiTY HEALTH DISTRICT CONDITIONS
1. The final plat shall be designed as indicated on the preliminary plat of record and/or any
atca.ched sheets as noted.
2. Apprapriaie utiliry easements shall be indicated on copies of the preliminary plat of
record for distribution by the Planning Department to the utility companies, Spokane

County engineer and the Spokane County Health District. Written approval of the
easements by the utility companies must be received prior to the submittal of the final
plat.
3. Sewage disposal method shall be as authorized by the Director of Utilities, Spokaae
County.
4. Water service shall be coordinated through the Director of Utilities, Spokane County.
5. Water service shall be by an exisdng public water supply when approved by the
Regional engi.aeer (Spokane), State Deparoment of Health.
6. Prior to filing the final plat, the sponsor shall demonstrate to the satisfaction of the
Spokane County Health District that an adequate and potable water supply is available
to each lot of the plat.
7. Prior to filing the final plat, the sponsor shall present evidence that the plat lies within
the recorded service area of the water system proposed to serve the plat.
8. Prior to filing the final plat, the sponsor shall demonstrate to the satisfaction of the
Spokane County Health District that a suitable sites for on-site sewage disposal systems
is available on Lot 2.
9. Prior to filing the final pla4 the sponsor shall demonstrate to the sadsfaction of the
Spokane County Health Disaict that the existing systern serving the residence located
on Lot 1 is wholly located within the boundaries of the lot.
10. Subject to specific application approval and issuaace of permits by the Health Officer,
the use of indi'vidual on-site sewage disposal systems may be authorized.
11. The dedicatory language of the plat will state: "Subject to specific application approval
and issuance of permits by the Heaith Officer, the use of individual on-site sewage
systems may be authorized."
12. 1'he dedicatory language on the plat shall staoe: "Use of private wells and water
systems is prohibited."
13. The plat dedication shall contain a statement to the effect that: "The public wacer
system, pursuant to tbe Water Plan approved by county and state health autllorities, the
Iocal fire protecdon district, County Building and Safety Departaient and water
purveyor, shall be installed within this plat, and the applicannt shall provide for
individual domestic water service as well as fire protection to each tract prior to sale of
each tract and prior to issuance af a building per,mit for each tract."
COUN'TY DIVISION OF UTILITIES CONDITIONS
1. Pursuant to the Board of Couaty Commissioners Resolurion No. 84-0418, the use of
on-site sewer d.isposal systems is hereby authorized. This autharizadon is condidoned
in compliance with all rules and regulations of the Spokane County Health Distriet and
is further coaditianed and subject to specific application approval and issuance of
permits by the Health District.
2. The Ded.icadon shall state:
A Covenant Agreement shall be signed stating: The Owner(s) or Successor(s) in
interest agree to authorize the County to place their name(s) on a petidon for the
formarion of a ULID by pedrion method pursoant to RCW 36.94 which the petition
includes the Owner(s) property and further not to object by signing of a protest perition
against the fonnation of a ULID by resolution method pursuant to RCW 36.94 which
includes the awner(s) property. PROYIDED, this condition shall not probibit the
Owner(s) or Successor(s) from objection to any assessment(s) on the nroperty as a
result of improvements called for in the conjunction with the fonniiuun of a L'LID by
eidher petivon or resolution under RCW 36.94.
3. The Dedicavon shall state: Each new unit shall be double plumbed for ronnection to
fumm area-Aide collection systems.
