Standard Drainage Language for Short Plats
The propecty owners within this plat sh311 be held responsibte for keeping open nnd mnintaining the surface palh
of nahuM or mnn-made drainage flow over and across their respective properties. If the property owner(s) fails
to maintain the surfacc path of natural or awn-made drainage flow, or the drainage swale, a notice of such failure
may be given to the property owner(s). lf not corrected within the period indicated on said notice, Spokane
County has the right to correci the maintenance failure, or have it corrected, at the expense of the property owner.
Any natural drainagc channels, creeks with intermittent or constant Aow, or well-dcfined natwral draws
pcriodically subject to concentrated flow of stormwater, shaU be ptaced within an easement gcanted to Spokane
County. No bwldings shall be constructed within the ea.sement, and no GU placed within the easement without
the expressed written consent of the Spokane County Engineer. The easement sha11 be of suiricient vvidth to
encompass the stormwater itow width and atlow for emergency maintenance, but in no case shall the erisement
be less than IO Q. in width.
Thc property onvnei- or authorized r+epresentative shall inform each succeoding purchaser of all drainage easements
on the property and their cesponsibility for maintaining surface drainage paths and swales wilhin said easements.
Any build.ing that is constructed on a lot in this plat shall be set at such an elevation so as to provide positive
drainage away from any drainage entry poini to the building (including but not limited lo a window well, a
window unprotectsd by u window we11, or a doorway). Said posiNve drainage shall consist of n minimum slope
oF3% away from the building for a distaince of at least IO feet from the building. The lots shall be graded sa thnt
either a) sll runoff is routed away from the building, and conveyed over the lot to a natural drainage swaie or
approved drainage fncility, or b) drainage intercepted on the 1ot is disposed of an the lot in an Approved drainage
facility. The approved drainage facility shnll be eonstructed in accordance with any applicable accepted plans
on file at the County Engineer's OiTice. Any revisions to the accepted drainage plans must be accepted by the

l. Reimhurse Spokane Gounty for project review and inspec:tion fees as srecified in Chapter 9.14 of
the Srokane County Code. The fees will he based on actual salary casts incurred hy Spokane
County for project revietys and / or inspections ptus a ten percent aclministrative charge, and will
be bitled monthiy as accrued. Any hilling a►nounts due, inciuding any exPenses incurred in the

THIS MATTER, an application for subdivision of land, from Charlene etro, and decided
upon, pursuant to Spokane County Subdivision regulations, on the . day of April,
1996.
FINDINGS OF FACT AND CONCLUSIONS
1. The individual signing below has further been properly deiegated the responsibility for
rendering the decision by the Spokane County Director of Building and Plaaning.
2. The proposal is to divide approximately 29,800 square feet into 2 lots for residential
uses and those uses permitted in the Urban Residendal - 3.5 (UR 3.5) zone. There is
curnently ann existing house on proposed Lot 1, and aa existing manufactured home on
proposed Lot 2.
3. The proposal is located at the northwest corner of the intersection of Wellesley Avenue
and Evergreen Road, in the SE 1i4 of Section 34, Township 26 North, Range 44
E.W.M. Spokane County, Washington.
4. The existing zon.ing of the property described in the application is Urban Residential -
3.5 (UR 3.5). The subject property was previously established Agricultu.ral in 1961
(File No. S-bl) and redesignated to Urban Residential - 3.5 (UR 3.5) on January 1,
1991, pursuant to the Progra.m to Implement the Spokane County Zoning Code.
Pursuant to RCW 58.17.195 the proposal does not conform to the requirements of the
existing zone.
5. In 1990 a Conditional Use Permit for a I?ependent Relative was issued for the subject
property (CUE 19-90), whicb allowed installation and use of a manufactured home to
temporarily house a dependent relative. The permit expired on October 6, 1995, after a
renewal for the permit was not pursued by the property owner. Expiration of said
permit rendered the permit null and void and required the removal of the manufactured
home. Based on information provided by the applicant, the manufactured home was
never removed nor did the property owner apply for a new setting pemnit. To correct
the violation of the Zoning Code, the applicant is required to apply for a new setting
permit, however, said permit will not be issued until the subject short plat is finalized
and recorded with the County Auditor.
6. The Spokane County Comprehensive Plan designates this area as Urba.a. The
development and uses, as proposed and conditioned arre in compliance with this
category.
7. Surrounding uses consist of residentiai uses.
8. The required public aotice was provided for this proposal and agencies having a
potential inter+est in the project were notified and recommendations solicited. No
comments were received from adjacent pmperty owners.
9. The Spokaae County Arterial Road Plan identifies Wellesley Avenue as a Minor
Arterial with a future righi of way width of 80 feet and an existing right of way width
of 60 feet In order to implement the Plan, the County Engineer has requested that a
strip of properry 10 feet in width along the Wellesley Avenue frontage be set aside in
reserve. This property may be acquired by Spokane County at the dme when Arterial
Improvements am made to VVellesley Avenue.
The County Engineer has also designated a Minor Arterial Roadway Section for the
improvement of Wellesley Avenue which is adjacent to the proposed development.
This will reguire the addition of approximately 13.5-15.5 feet of asphalt along the
frontage of the development. The eonstruction of curbing and sidewalk is also
required. As conditioned, the proposal conforms to the Plan.
10. The Spokane Counry Arterial Road Plan identif'ies Evergreen Road as a Principal
Arterial with a future right of way width of 100 feet and an existing right of way width
of 60 feet. In order to implement the Plan, the Councy Engineer has requested that a
strip of property 20 feet in width along the Evergreen Road frontage be set aside in

reserve. This property may be acquired by Spokane Counry at the time when Arterial
Improvements are made to Evergreen Road.
The County Engineer has alsa designated'a Minor Arterial Roadway Scction for the
improvement of Evergreen Road which is adjacent to the proposed development. This
w.ill require the addition of approximately 13.5-1 S.5 feet of asphalt along the frontage
of the deveiopmenE. The construction of curbing and sidewalk is also required. As
conditionedw the proposal conforras to the Plan.
11. The site is located within the Public Transportation Benefit Area (P'MA).
12. The proposed short plat will be served by a public water system. Waste water disposal
will be as authorized by the Director of Utilities.
13. No comments were received by the East Valley School DistricL
14. Recognizing the recommended conditions and Spokane County development standards,
appropriate provisions should be made to ensure the public health, safery and generrall
welfare and that the public use aad interest will be served by platting the subdivision.
15. The subdivision proposal is generally coasistent with RCW 58.17 and the County
subdivision regulations, promoting the public health, safety and general welfare in
accordance with standards established by the state and Spokane County. The Division
of Planning has considered the provision of adequate public facilides as cited in RCW
58.17.110 (2). More specifically:
a. open spaces f. sanitary waste disposal
b. drainage ways g. pazks and recreation facilities
c. public and/or private rights-of-way h. playgrounds
d. transit i. schools and schoolgrounds
e. potable water j. sidewalks
DECISION
Based upon the above noted Findings of Fact and Canclusions, Short Plat Application
SP-1061-96 is hereby APPROVED until May 1, 2041, subject to conditions noted belnw.
Most of the cond.itions af approval shall be accomplished by the applicant and/or sponsor prior
to finalization of the short subdivision. This decision is fmal unless appeaied i.n wnting,
consistent with adopted appeal procedures.
The following conditions shall be binding on the "Applicant," which term shall include the
owner or owners of the property, beirs, assigns and successors.
COUNTY DIVISION OF BUILDING AND PLAN1vING CONDITIONS
1. The proposal and future developmenc of this property shall comply with the Urban
Residential - 3.5 (UR 3.5) zane, as amended.
2. The final plat shall be designed substantially in conformance with the preliminary plat
of record. No increase of density or number of lots shall occur without a change of
condition application submittal and approval.
3. The Planning Director/designee shall review any proposed fmal plat to ensure
compliance with these Findings and Conditions of Approval.
4. The prelimi.nary plat is given conditional approvai for five (5) years, specifically to May
1, 2001. The applicant may request an extension of time by submitting a written
request approximately forry-five (45) days prior to the above expiration date.
5. Three (3) curcent certificates of title shall be furnished to Spokane Division of
Planning prior to filing the fmal plat.
6. Appropriate uciliry easements shall be indicated on copies of the proposed fmal plat.
Wntten approval of utility easements by appropriate utiliry companies shall be received
with the submittal of tbe final plat.

7. Priar to filing of final plat, the appropriate road name(s) and street address(es) shall be
indicated.
8. The final plat map shall indicate by a clear, dashed line the required yard setbacks from
all private, "Tract X" or public roads. The dedication shall contain the following
statement:
"Side yard and rear yard setbacks shall be detemuned at the time building permits ar►e
requested unless these setbacks are specifically drafted on this final plat. The setbacks
indicated on this plat may be varied from if proper zoning approvals are obtained."
9. The Spokane County Division of Planning shall prepare and record with the County
Auditor a Title Notice specifying a future land acqwsition area for road right-of-way
and utilities. The reserved future acquisition area Title Notice shall be released, in full
or in part, by the Division of Plarming. The notice should be recorded with the final
plat and shall provide the following:
a. A strip of property 14 feet in width from the existing right of way aloag the
WeUesley Avenue frontage is to be set aside as Future Acguisition Area (FAA)
for additional road right of way.
b. A strip of property 20 feet in width from the existing right of way along the
Evergreen Road frontage is to be set aside as Future Acquisition Area (FAA) for
additional road right of way.
c. Future building and other setbacks required by the Spokane Counry Zoning
Code shall be measured from the reserved future acquisition area.
d. No required landscaping, parking, '208' areas, drainfield or allowed signs
should be located within the future acquisition area for road right-of-way and
utilides. If any of the above improvements are made witb.in this area, they shall
be relocated at the apglicant's expense when roadway improvements are made.
e. The future acquisition area, u.ntil acquired, shall be private property and may be
used as allowed in the zone, except that any improvements (such as
landscaping, parking, surface drainage, drainfeld, signs or others) shall be
considered interim uses.
f. The property owner shall be responsible for relocating such "interun"
improvements at the time Spokane County makes roadway improvements after
acquiring said futuxe acquisition area.
10. A plan for water facilities adequate for domestic service and fire protection shall be
approved by the water purveyor, appropriate fire protection district, County Division of
Buildings and County Heaith District. The agencies will certify on the Water Plan,
prior to the filing of a final plat, that the plan is in conformance with their respective
needs and regulations. The Water Plan and certification shall be drafted on a
transparency suitable for reproduction and be signed by the plat sponsor.
11. The water purveyor shall certify that appropriate contractual arrangements and schedule
of improvements have been made with the plat sponsor for construction of the water
system in accordance with the approved Water Plaa. The time schedule shall provide
for completion of the water system and inspection by the appropriate health authorities
prior to apglication for building pemuts within tUe fwal plat. The arrangements or
agreements shall include a provision holding Spokane County and the purveyor
harmless from clauns by any lot purchaser refused a building permit due to the failure
of the subdivision sponsor to satisfactorily complete the approved water system.
12. The final plat dedication shall contain the following statement:
"The public water system, pursuant to the Water Plan approved by county and state
health authorities, the local fire protection district, water purveyor and Spokane County
Division of Buildings, shall be installed within this subdivision, and the applicant shall
provide for individual domestic water service as well as fire protection to each [tracVlot]
prior to sale of each [tractllot] and prior to issuance of a buildulg permit for each
[tract/lot]."
13. No building permit will be issued for any lot within the final plat until certified by a
Washington state-licensed engineer that "the water system has been installed pursuant
to the approved Water Plan for the final plat" including a signed license stamp. The

certification may be in the form of a letter, but is preferned to be certified on a copy of
the Water Plan as a schematic map showing the "as-constructed" water system.
14. The Water Plan and the above four (4) conditions of approval regarding the Water Plan
may be waived by the Planning Director/designee upon receipt of letters from the
apprapriate water purveyor and fire proteccion district stating that simple connections to
an existing, approved water system will pmvide adequate domescic and fue protection
water to ensure the public health, safety and general welfare.
15. Prior to finali.zatioa, the applicant shaU record with the County Aud.itor a maintenance
agreement for the shared driveway. A copy of said agreement shall be furnished to the
County Building and Plaaning Division for recordkeeping purposes.
16. A survey is required prior to the filiag of a final plat.
17. The applicant shall contact the Division of Building and Planning at the earliest possible
stage in order to be infonned of code requirements administered/enforced as authorized
by the State Building Code Act. Design//development concerns include: ADDRESSING,
FIRE APPAR.ATUS ACCESS ROADS; F1RE HYDRANT/FLOW; APPROVED WATER
SYSTEMS; BUII.DING ACCESSIBILITY; CONSTRUG`TION TYPE; OCCUPANCY
CLASSIFICATION; E7QTING; EXTERIOR WALL PROTECTION; AND ENERGY CODE
RfiGULATIONS. (Note: The Division of Buildiag and Planning reserves the right to
confirm the actual address at the time vf building permit.)
COUNTY DIVISION OF ENGINEERING AND RUADS CONDITION5
1. That conditional approval of the plat by the Counry Engineer is given subject to the
approval of the road system as indicated in the preliminary plat of record.
2. No construction work is to be performed within the existing or proposed Public Right-
of-Way until a pernut has been issued by the County Engineer. A11 work is subject to
inspection annd approval by the Counry Engineer.
3. The applicanC should be advised that individual driveway access germiCs are required
prior to issuance of a building permit for driveway approacbes to the Counry road
system.
4. Existing County roads providing direct access to the plat shall be paved and/or curbed
to Spokane County standards.
5. That sidewalks are required along the arterial(s) on Wellesley Avenue and Evergreen
Road.
6. The word "applicant" shall include the owner(s) of the progerty, his/tier heirs, assigns
and successors.
7. To construct the road improvements stated herein, the applicant may, with the
approval of the County Engineer, join in and be a willing participant in any petidon or
resolution whicb purposes is the formation of a Road Improvement District (RID) for
said improvements pursuant to RCW 36.88, as aznended. At such time as an RID i.s
created or any Road Improvement Project is sanctioned by Spokane County, the
improvements requined (curb, sidewalk, drainage control and paving co existing
pavement) will be at the sole expense of the undersigned owner, their heirs, grantees
and assigns. This provision is applicable to Wellesley Avenue and Evergreen Road.
8. As an altemative method of constructing the road improvement stated herein, the
applicant may, with the approval of the County Engineer, accomplish the road
improvements stated herein by joining and participating in a County Road Project
(CRP) to the extent of the required road improvement. At such time as an RID is
created or any Road Lnprovemeat Project is sanctioned by Sgokane County, the

Improvement District (RID) and to support the formation of a Road Improvement
District for improvement of the road(s) described below by requesting and authorizing
Spokane County to place their name(s) on a pedtion for the formation of a Road
Improvement District pursuant to RCW 36.88.050, or by requesting and authorizing
Spokane County to cast their ballot in favor of a RID bei.ng formed under the
resoludon method pursuant to RCW 36.88.030, and/or by not filing a protest against
tbe formation of a RID being focmed under ihe alternative resolutioa method provided
for in RCW 36.88.065 and Chapter 35.43 RCW.
If a RID is proposed for improvement of the road(s) described below, said owner(s)

10. The County Engineer has designated a Minor Arterial Roadway Section for the
irnprovement of Wellesley Avenue which is adjacent to the proposed development.
T'his w►ill require the addition of approx.imately 13.5-15.5 feet of asphalt along the
frontage of the development. The construction of curbing and sidewalk is also
required.
11. The County Engineer has designated a Minor Arterial Roadway Section for tihe
unprovement of Evergreen Road which is adjacent to the proposed development. This
wili require the addition of approximately 13.5-15.5 feet of asphalt along the frontage

12. The proposed subdivisioa shall be improved ro the standards set forth in Spokane
County Board of Comnaissioners Resolution No. 95-0498, as amended, which
resolutioa establishes regulations for roads, approaches, drainage and fees in new
construction.
13. The County Engineer has examined this development proposal and has detennined that
the impact of this proposal upon the existing Cotinry Road System warrants the
roadway improvements herein specified.
14. The County Arterial Road plan identifies Wellesley Avenue as a 80 foot Minor
Arterial. The existing right of way width of 60 feet is not consistent with rhat
specified in The Plan. In order to implement the Arterial Road Plan it is cecommended
that a sirip of property 10 feet in width along the Wellesley Avenue frontage be set
aside in reserve. This property may be acquired by Spokane County at the time whea
Arterial Improvements are made to Weltesley Avenue.

15. The County Arterial Road plan identifies Evergreen Road a.s a 100 foot Principal
Arterial. The existing right of way width of 60 feet is not consistent with that
specified in The Plan. In order to implement the Arterial Road Plan it is recommended
that a strip of property 20 feet in width along the Evergreen Road frontage be set aside
in reserve. This property may be acquired by SpQkane County at the time when
Arterial Improvements are made to Evergreen Road.
16. The applicant should be advised that there may exist utilities either underground or
overhead affecting the applicants property, including property to be dedicated or set
aside for future acquisition. Spokane County will assume no financial obligation for
adjustments or relocation regazding these utilities. The applicaat should check with the
applicable utilities and Spokane County Engineer to detennine whether the applicant or
utility is responsible for adjustment or relocation costs and to make arrangements for
any necessary work.
17. The applicant shall grant applicable border easements adjacent to Spokane County
Right of Way per Spokane County Standards.
COUNTY HEALTH DISTRICT CONDITIONS
1. The final plat shall be designed as indicated an the preliminarry plat of record aadlor any
attached sheets as noted.
2. Appropriate utility easements shall be ind.icated on copies of the preliminary plat of
record for distribution by the Planning Deparanent to the utility compaaies, Spokane
County engineer and the Spokane Counry Health District. Writtea approval of the
easements by the utility companies must be received prior to the subnuttal of the final
plat.
3. Sewage disposal method shall be as authorized by the Director of Utilities, Spokane
County.
4. Water service shall be coordinated tluough the Director of Utilities, Spokane Couaty.
5. Water service shall be by aa existing public water supply when approved by the
Regional engineer (Spokane), State Department of Health.
6. Prior to filiug the final plat, the sponsor shall demonstrate to the satisfaction of the
Spokane County Health District that an adequate and potable water supply is available
to each lot of the plat.
7. Prior to filing the final plat, the sponsor shall present evidence that the plat lies within
the recorded service area of the water system proposed to serve the plat.
8. Subject to specific application approval and issuance of permits by the Health Og"icer,
the use of individual on-site sewage disposal systems m.ay be autharized.
9. The dedicatory language of the plat will state: "Subject to specific application approval
and issuance of permits by the Health Officer, the use of individuai on-site sewage
systems may be authorized."
10. The dedicatory language on the plat shall state: "Use of private wells and water
systems is prohibited."
11. The plat dedication shall contain a statement to the effect that: "The public water
system, pursuant to the Water Plan approved by county and state health authorities, the
local fue protection distr"sct, County Building and Safety Department and water
purveyor, shall be installed within this plat, and the applicant shall provide for

COLNTY DIVISION OF UTILITIES CONDITIONS
1. Pursuant to the Board of County Commissioners Resolution No. 80-0418, the use of

in conlpliance with all rules and regulations of the Spokane County Health District and

permits by the Health District.
2. The Dedication shall state: '
A Covenant Agreement shall be signed stating: The Owner(s) or Successor(s) in
interest agree to authorize the County to place their nanae(s) on a petition for the
formation of a ULID by petition method pursuant to RCW 36.94 which the petition
includes the Owner(s) property and further not to object by signing of a protest petition
against the fonnation of a ULID by resolution method pursuant to RCW 36.94 which
includes the Owner(s) property. PROVIDED, this condition shall not prolubit the
Owner(s) or Successor(s) from objection to any assessment(s) on the property as a
result of improvements called for in the conjunction with the forlnation of a ULID by
eicher petition or resolution under RCW 36.94.
3. The Dedication shall state: Each new un.it shall be double plumbed for con.nection to
future area-wide collection systems.
4. Water service shall be provided in accardance with the Coordinated Water System Plan
for Spokane County, as amended.
TRENTWOOD IRRIGATION DISTRICT
1. Separate water service shall be installed to proposed Lot 2.
