THIS MATTER, an application for subdivision of land from Scott and Julie Van Hees h~
been rec ived and decided upoa, pursuant to Spokane County Subdivision regulations, on the
S~. day of April, 1996.
FINDINGS OF FACT AND CONCLUSIONS
1. The individual signing below has fiirther been properly delegated the responsibility for
rendering the decisioa by the Spokane County Director of Building and Planning.
2. The proposal is to divide approxiraately 2 acrres into 2 tracts for 1 existing single family
residence and 1 new additional residential tract and those uses pernutted in the Urban
Residential-3.5 (UR-3.5) zone.
3. The proposal is located between Blake Road and Mamer Road and approximately 1000
feet north of Broadway Avenue in the NE 1/4 of Section 15, Township 25 North,
Range 44 E.W.M. Spokane County, Washington.
4. The existing zoni.ng of the property described in the application is Urban Residential-
3.5 (UR-3.5), previously established as Agricultural (A) (file # 60-42) zoning in 1942
and redesignated to UR-3.5 on 7anuary 1, 1991, pucsuant to the Program to Implement
the Spokane County Zoning Code. Pursuant to RCW 58.17.195 the proposai does
conform to the requirements of the existi.ng UR-3.5 zone.
5. The Spokane County Comprehensive Plan designates this area as URBAN. The
development and uses, as propased and conditioned are in compliaace with this
category.
6. Surrounding uses are primarily single family residences on mixed urban size lots.
7. The Spokane Counry Arterial Road Plaa identifies Blake Road as a Local Access Road
with a future right of way width of 60 feet. The existing right of way width is 30 feet.
In order to implement the Arterial Road Plan, the County Engineer has requested a
dedication of 30 feet of additional right of way aloog Blake Road. In addition, The
Spokaae County Arterial Road Plan identifies Mamer Road as a Local Access Road
with a future right of way width of 60 feet. Tbe existing right of way width is 40 feet.
In order to unplement the Arterial Road Plan, a strip of property 10 feet in width along
the Mamer Road frontage is to be set aside as a Future Acquisition Area. Therefore, as
conditioned, (such as improvements, dedication and acquisition areas) the proposal
conforms to the Road Plan.
8. The site is located within the Public Transportation Benefit Area (PfiBA). The Spokane
Transit Autbority (STA) Broadway, Route # 18 provides connecting services to the
site.
9. The proposed short plat will be served by a public vvater system. Waste water dlsposal
will be as authorized by the Director of Utilities.
10. The required public notice was provided for this proposal and agencies having a
potential interest in the project were notified and recommendations solicited. No
comments or conditions were provided by the County Parks Department regarding this
proposal. Presently, the Board of County Commissioners and the Parks Department
are in the process of reevaluating the continued use of Park and Recreation Voluntary
Midgation Agreements whi.le the Parks Plan is being updated.
11. No writtea comments were received from any adjoining property owners.
12. Recognizing the recommended conditions and Spokane County development standards,
the proposed short plat makes appropriate provisions for the public health, safety and
general welfare and that the pubLc use and uiterest wilI be served by platting the
subdivision.
The subdivision proposal is generally consistent with RCW 58.17 and the County
subdivision regulations, promoting the public health, safety aad general welfare in
accordance with standards established by the state and Spokane County. The Building
and Planning Divisioa has considered the provision of adequate public facilities a.s cited
in RCW 58.17.110 (2). More specifically:
a. open spaces
b. drainage ways
c. public and/or private rights-of-way
d. transit
e. potable water
f. sanitary waste disposail
g. pazks and recreadon facilities
h . playgrounds
i . schools and schoolgrounds
j . sidewalks
13. The project is exempt from environmental review under the State Environmental Policy
Act pursuant to WAC 197-11-500 (6) (a).
14. The Central Valley School District bas conunented on the proposed Short Plat. The
District has indicated th.at existing school facilities are inadequate to serve the proposed
short piat and wishes to negotiate with the owner to provide adequate capital facilities as
required by the Revised Code of Washington (RG'`W) 58.17.110. Review by County
legal counsel indicates the cond.ition taequested by the School District can be required for
developments. Approval of this short plat should include conditions requiring that
provisions for appropriate facilities be in place prior to recording the final short plat in
the form of a wntten agreement between the owner and the school district.
DECISION
Based upon the above noted Findings of Fact and Conclusions, Short Plat Application SP-
1057-96 is hereby APPROVED for five (5) years, specifically to May 1, 2001 and subject to
conditions aoted below. This decision is final unless appealed in writing, consistent with
adopted appeal procedures. All the below conditions imposed shall be binding on the
"Applicant," which term shall inelude the owner or owners of the progerty, heirs, assigns and
successors. `
COUNTY DIVISION OF BUILDING AND PLANNING CONDITIONS
1. The proposal shall comply with the Urban Residential-3.5 (UR-3.5) zone, as amended.
2. The final plat shall be desigaed substantially iu conformance with the preliminary plat
of record. No incr+ease of density or number of lots shall occur without a change of
condition application submittal and approval.
3. The Building aad Planning Director/designee shall review any proposed final plat to
ensure compliance with these Findings and Conditions of Approval.
4. The preliminary plat is givea conditional approval for five (5) years, specifically to May
1, 2001. Tbe applicaat may reguest an extension of ame by submitting a wntten
r+equest approximately forty-five (45) days prior to the above expiration date.
5. Three (3) eurrent certifcates of tide shaU be funiished to the Building aad Plann.ing
Division prior to filing the final plat.
6. Appropriate utility easements shall be indicated on copies of the proposed final plat.
Written approval of utility easements by appropriate utility companies shall be received
with the submittal of the final plat.
7. Prior to filing of final plat, the appropriate road name(s) and street address(es) shall be
indicated.
8. The final plat map shall indicate by a clear, dashed line the required yard setbacks from
all private, "Tract X" or public roads. The dedication shall contain the following
Findings and Decision SP-1057-96 2
statement:
"Side yard and rear yard setbacks shall be determined at the ti.me building peimits are
requested unless these setbacks are specifically drafted on this final plat. The setbacks
indicated on this plat may be varied from if proper zoning approvals are obtained,"
9. The Spokane Counry Division of Building and Planning shall prepare and record with
the Counry Auditor a Title Notice specifying a future land acquisition area for road
right-of-way and utilides. The reserved future acquisition area Tide Notice shall be
released, in full or in part, by the Building and Planning Division. The notice should
be reconied the same tune as the final plat and shall provide the foUowing:
a. A strip of property 10 feet in width from the existing right of way is reserved
for futune acquisi'on azea for additional road right-of-way along Mamer Road
b. Future building and other setbacks required by the Spokane Counry Zoaing
Code shall be rrieasured from the reserved future acquisition area.
c. No required landscaping, parking, '208' areas, drainfield or allowed signs
should be located within the future acguisition area for road rigbt-of-way and
utilities. If any of the above improvements are made within this area, they shall
be relocated at the applicant's expense when roadway improvements are made.
d. 1'he future acquisition area, until acquired, shall be private properiy and may be
used as allowed in the zone, except that any improvements (such as
laadscaping, parking, surface drainage, drainfield, signs or others) shall be
considered interim uses.
e. The praperty owner shall be responsible for relocating such "interim"
improvements at the time Spokane County makes roadway improvemeats after
acqu.itwg said future acquisition area.
10. No water plan is required, and a simple tap is needed prior to sale of each tract and
prior to issuance of a build.ing pemut for each tract.
11. The owner shall negotiate with Central Va11ey School District and submit a recorded
copy of a voluntary agreement making provisions for public schools prior to
fiaalization and recording of the plat. The agreement shall provide a written description
of the subject property to which the agxeement applies and also state the dollaz amount
and any other agreed to mitigating measures.
The owner shall also notify any potential purchasers who have made an agreement to
purchase property within said plat pursuant to the Revised Code of Washington (RCW)
58.17.205, that adequate provisioas for school facilities must be made conditioned on a
future agreement between the plattor and school district.
Voluntary agreements between the ovvner and school discrict shall coafoma to the
requirements of RCW Chapter 82.02.
12. A survey is required prior to the filing of a final plat.
13. The applicant shall contact the Division of Building and Planning at the earliest possible
stage in order to be informed of code requirements administered/enforced as authorized
by the State Building Code Act. Design/development concerns iaclude:
ADDRESSING, F'IRE APPARATUS ACCESS ROADS; FIRE HYDRANT/FLOW;
APPROVED WATER SYSTEMS; BUII.DING ACCESSIBII.ITY; CONSTRUCI'ION
TYPE; OCCUPANCY CLASSIFICATION; EXITING; F.XTERIOR WALL
PROT'ECTION; AND ENERGY CODE REGULATIONS. (Note: T'he Division of
Building and Planning reserves the right to conffrm the actual address at the time of
building permit.)
COUNTY DIVISION OF ENGINEERING AND ROADS CONDITIONS
1. The conditional approval of the plat is given by the County Engineer subject to dedication
of right-of-way and approval of the road system as indicated in the preliminary plat of
record.

2. No construction work is to be performed within the existing or proposed public right-of-
way until a pernait has been issued by the County Engineer. All work is subject to
inspection and approval by the County Engineer.
3. Individuai driveway access penruts are required prior to issuance of a building permit for
driveway approaches to the county road system.
4. Dedication of 30 feet of add.itional right-of-way along Blake Road is required.
5. Existing County roads providing direct access to the plat shall be paved annd/or curbed to
Spokaue County standards.
6. To construct the road unprovements stated herein, the applicant may, with the approval of
the County Engineer, join in and be a willing participant in any pedtion or resolution which
purpose is the formation of a Road Improvement District (RID) for said improvements,
pursuant to RCW 36.88, as amended. At such time as an RID is created or any Road
Improvemeat Project is sanctioned by Spokane County, the improvements required (curb,
sidewalk, drainage control and paving to existing pavement) will be at the sole expense of
the undersigned owner(s), their heirs, grantees and assigns. This provision is applicable to
Mamer Road and Blake Road.
7. As an alternative method of constructing the road improvements stated herein, the applicant
may, with the approval of the County Engineer, accomplish the road improvements stated
herein by joining and participating in a County Road Project (CRP) to the extent of the
required road improvements. At such time as an RID is created or any Road Improvement
Project is sanctioned by Spokane Counry, the improvements required (curb, sidewalk,
drainage control and paving to existing pavement) will be at the sole expense of the
undersigned owner(s), their heirs, grantees and assigns. This provision is applicable to
Mamer Road and Blake Road.
8. The following statement shall be placed in the plat dedication:
In consideration of Mutual Benefits now or to be hereafter derived, do for themselves, their
heirs, grantees, assigns and successor(s) in interest hereby request and authorize Spokane
County to include the above described property in a Road Improvement District (RID) and
to support the formation of a RID for improvemsnt of the road(s) described below by
requesting and authorizing Spokane County to place their name(s) on a petition for the
formation of a RID pursua.nt to RCW 36.88.050, or by requesting and authorizing
Spokane County to cast their ballot in favor of a R.ID being formed wader the resolution
method pursuant to RCW 36.88.030, and/or by not filing a protest against the formation of
a RID being formed under the alternative resolution method provided for in RCW
36.88.065 and Chapter 35.43 RCW.
If a RID is proposed for improvement of che road(s) described below, said owner(s)

derived from the formation of the RID by the property included therein, together witb
the amount of any County participation, exceeds the cost and expense of formation of

provided, themselves, their heirs, grantees, assigns and successor(s) shall retain the
nght, as authorized under RCW 36.88.090, to object to any assessment(s) on the
property as a result of the improvements called for in conjunction with the formation
of a RID by either the petition or resolution method under Chapter 36.88 RCW and to
appeal to the Superior Court the decision of the Board of County Commissioners
confuming the fmal assessment roll; provided fcuther, it is recognized that actual
assessments may vary from assessment estimate so long as they do not exceed a
figvr+e equal to the increased true and fair value improvemeat(s) add(s) to the
property.
It is further acknowledged and agreed that at such time as a RID is created or any
County Road Improvement project is authorized by Spokane County, the
improvements required sball be at the sole expense of the owner(s) of property within
the RID or served by the improvements without any monetary participation by
Spokane County.
The RID waiver contained in this agreement shall expire after ten (10) years from the
date of execution below. This provision is applicable Co Mamer Road and Blake
Road.

9. The County Engineer has designate.si Local Access Roadway Section for Che improvement
of Mamer Road, which is adjacent to the proposed development. This will reyuire the
addition of approximately 4-6 feet of asphalt along the frontage of the development. The
construction of curbing and sidewalk is also required.
10. 'I'he County Engineer has designated Local Access Roadway Section for the improvement
of Blake Road, which is adjaceat to the proposed development. This will require the
addieon of approximately 27 feet of asphalt along the frontage of the development. The
construction of curbing and sidewalk is aLso required.
11. The groposed plat shall be improved to the standards set forth in Spokane County Board of
Commissioners Resolution No. 95-0498, as amended, which resolution establishes
regulations for roads, approaches, drainage and fees in new construction.
12. The County Engineer has examiaed this developmenl proposal aad has determined that the
impact of this proposal upon the existing county road system warrants the dedication of
additional right-of•way aad the roadway improvements herein specified.
13. There may exist utilities, either underground or overhead, affecting the subject groperty,
including property to be dedicated or set aside for future acquisition. Spokane Counry
assumes no financial obligatioa for adjustments or relocation regarding these utilities.
Applicant(s) should check with the applicable utility purveyor and the Spokane County
Eagineer to deteanine whether applicant(s) or the utility is responsible for adjustmeat or
relocation costs and to make arrangements for any necessary work.
14. The apglicant shall grant the applicable border easemeat adjacent to Spokane County Right
of Way per Spokane County Standards.
15. Prior to the release of a building penmit for Tract "B", the applicant shal.l sign and record a
"Spokane County Notice To Public No. 4", which will a11ow the construction of a private
driveway witbin the Blake Road Right of Way.
COUNTY DIVLSION OF UTILiTIES CONDITIONS
1. Pursuant to the Board of County Commissiooers Resolution No. 80-0418, the use of
on-site sewer disposal systems is hereby authorized. This authorization is conditioned
in compliaace with all rules aad regulations of the Spokane County Health District and
is further conditioned and subject to specific application approval and issuance of
permits by the Health District.
2. The following statement shall be placed in the plat dedication:
"The owner(s) or successor(s) in interest agree to authorize the County to place their
name(s) on a petition for the formation of ULID by petition method pursuant to RCW
36.94, which petition includes the owner(s)' property; and further not to object by the
signing of a protest petition against the foimation of a LTLID by resolutioa method
pursuant to RCW Chapter 36.94 which includes the owner(s)' property. PROVIDED,
this condition shall not prolubit the owner(s) or successor(s) from objecting to any
assessmeni(s) on the property as a result of improvements called for in conjunction
with the formation of a ULID by either petition or resolution under RCW Chapter
36.94."
3. The dedicatory language on the plat shall state: "Each aew dwelling unit shall be
double-plumbed for connection to future area-wide collection systems."
4. Any water service for ihis praject shall be provided in accardance with the Coordinated
Water System Plaa for Spokane County, as amended.
COUNTY H.EALTH DISTRICT CONDITIONS
1. The final plat shall be designed as indicated on the preli.minary plat of record and/or any
attached sheets as noted.
2. Appropriate utility easements shall be indicated on copies of the preliminary plat of
record for distribution by the Building and Planning Division to the utility compazues,
Spokane County Engineer and the Spokane County Health District. Written approval
of the easements by the utility companies must be received prior to the submittal of the
final plat.

3. Sewagz disposal method shall be as authorized by the Director of the Spok,ane Counry
Division of Utilities.
4. Water service shall be coordinated through the Spokane Counry Division of Utilities.
5. Water service shall be by an existing public water supply when approved by the
Regional Engineer (Spokane), State Department of Health.
6. Prior to filing the final plat, the sponsor shall demonstrate to the satisfactian of the
Spokane County Health District that an adequate and potable water supply is available
to each lot of the plat.
7. Prior to filing the final plat, the sponsor shaU present evidence that the plat lies within
the recorded service area of the water system proposed to serve the plat.
8. Prior to filing the final plat, the spoasor shall demonstrate to the satisfaction of the
Spokane Couaty Health District that suitable sites for on-site sewage disposal systems
are available on Tract B.
9. Prior to fiiing the final plat, the sponsor shall demonstrate to the satisfaction of the
Spokane County Health District that the existing on-site sewage disposal system
serving the r+esidence located on Tracc A is wholly located wirhin 1he boundaries of the
tract.
10. Subject to specific application approval and issuance of pernuts by the Health Off'icer,

The following "Conditions of Approval" for the above referenced subdivision
are submitted to the Spokane County Planning Department for inclusion in the
"Findings and Order" should the short plat be approved.
E 1 That conditional approval of the plat by the County fingineer is given subject to
dedication of Right-of-Way and approval of the road system as indicated in the
preliminary plat of record.
E 6 No construction work is to be performed within the exieting or proposed Public
Right-of-Way until a permit has been iasued by the County Engineer. Al1 work is
subject to inapection and approval by the County Engineer.
E12 The applicant should be adviaed that individual driveway access permits are required
prior to issuance of a building permit for driveway approaches to the County road
system.
E13 Dedication of 30 feet of additiona.l Right-of-Way along Blake Road.
E16 Fxisting County roads providing direct access to the plat shall be paved
and/or curbed to Spokane County atandards.
E19 The word "applicant" shall include the owner(s) of the property, his/her heirs, assigns
and successors.
E20 To conatruct the road improvements stated herein, the applicant may, with the approval
of the County Engineer, join in and be a willing participant in any petition or

E22 That the following statement shall appear within the dedicatory language of the final
plat:
That in coneideration of Mutual Benefits now or to be hereafter derived, do for
themselves, their heira, grantees, assigns and successor(s) in interest hereby request
and authorize Spokane County to include the above described property in a Road
Improvement District (RID) and to support the formation of a Road Improvement District
for improvement of the road(s) described below by requesting and authorizing Spokane
County to place their name(s) on a petition for the formation of a Road Improvement
District pursuant to RCW 36.88.050, or by requesting and authorizing Spokane County to
caet their ballot in favor of a RID being formed under the resolution method pursuant
to RCW 36.88.030, and/or by not filing a protest against the formation of a RID being
formed under the alternative resolution method provided for in RCW 36.88.065 and
Chapter 35.43 RCW.
