SP-1057-96 ) CONCLUSIONS AND RftDECISION ~ED APR p o 1996 THIS MATTER, an application for subdivision of land from Scott and Julie Van Hees h~ been rec ived and decided upoa, pursuant to Spokane County Subdivision regulations, on the S~. day of April, 1996. FINDINGS OF FACT AND CONCLUSIONS 1. The individual signing below has fiirther been properly delegated the responsibility for rendering the decisioa by the Spokane County Director of Building and Planning. 2. The proposal is to divide approxiraately 2 acrres into 2 tracts for 1 existing single family residence and 1 new additional residential tract and those uses pernutted in the Urban Residential-3.5 (UR-3.5) zone. 3. The proposal is located between Blake Road and Mamer Road and approximately 1000 feet north of Broadway Avenue in the NE 1/4 of Section 15, Township 25 North, Range 44 E.W.M. Spokane County, Washington. 4. The existing zoni.ng of the property described in the application is Urban Residential- 3.5 (UR-3.5), previously established as Agricultural (A) (file # 60-42) zoning in 1942 and redesignated to UR-3.5 on 7anuary 1, 1991, pucsuant to the Program to Implement the Spokane County Zoning Code. Pursuant to RCW 58.17.195 the proposai does conform to the requirements of the existi.ng UR-3.5 zone. 5. The Spokane County Comprehensive Plan designates this area as URBAN. The development and uses, as propased and conditioned are in compliaace with this category. 6. Surrounding uses are primarily single family residences on mixed urban size lots. 7. The Spokane Counry Arterial Road Plaa identifies Blake Road as a Local Access Road with a future right of way width of 60 feet. The existing right of way width is 30 feet. In order to implement the Arterial Road Plan, the County Engineer has requested a dedication of 30 feet of additional right of way aloog Blake Road. In addition, The Spokaae County Arterial Road Plan identifies Mamer Road as a Local Access Road with a future right of way width of 60 feet. Tbe existing right of way width is 40 feet. In order to unplement the Arterial Road Plan, a strip of property 10 feet in width along the Mamer Road frontage is to be set aside as a Future Acquisition Area. Therefore, as conditioned, (such as improvements, dedication and acquisition areas) the proposal conforms to the Road Plan. 8. The site is located within the Public Transportation Benefit Area (PfiBA). The Spokane Transit Autbority (STA) Broadway, Route # 18 provides connecting services to the site. 9. The proposed short plat will be served by a public vvater system. Waste water dlsposal will be as authorized by the Director of Utilities. 10. The required public notice was provided for this proposal and agencies having a potential interest in the project were notified and recommendations solicited. No comments or conditions were provided by the County Parks Department regarding this proposal. Presently, the Board of County Commissioners and the Parks Department are in the process of reevaluating the continued use of Park and Recreation Voluntary Midgation Agreements whi.le the Parks Plan is being updated. 11. No writtea comments were received from any adjoining property owners. 12. Recognizing the recommended conditions and Spokane County development standards, the proposed short plat makes appropriate provisions for the public health, safety and general welfare and that the pubLc use and uiterest wilI be served by platting the subdivision. The subdivision proposal is generally consistent with RCW 58.17 and the County subdivision regulations, promoting the public health, safety aad general welfare in accordance with standards established by the state and Spokane County. The Building and Planning Divisioa has considered the provision of adequate public facilities a.s cited in RCW 58.17.110 (2). More specifically: a. open spaces b. drainage ways c. public and/or private rights-of-way d. transit e. potable water f. sanitary waste disposail g. pazks and recreadon facilities h . playgrounds i . schools and schoolgrounds j . sidewalks 13. The project is exempt from environmental review under the State Environmental Policy Act pursuant to WAC 197-11-500 (6) (a). 14. The Central Valley School District bas conunented on the proposed Short Plat. The District has indicated th.at existing school facilities are inadequate to serve the proposed short piat and wishes to negotiate with the owner to provide adequate capital facilities as required by the Revised Code of Washington (RG'`W) 58.17.110. Review by County legal counsel indicates the cond.ition taequested by the School District can be required for developments. Approval of this short plat should include conditions requiring that provisions for appropriate facilities be in place prior to recording the final short plat in the form of a wntten agreement between the owner and the school district. DECISION Based upon the above noted Findings of Fact and Conclusions, Short Plat Application SP- 1057-96 is hereby APPROVED for five (5) years, specifically to May 1, 2001 and subject to conditions aoted below. This decision is final unless appealed in writing, consistent with adopted appeal procedures. All the below conditions imposed shall be binding on the "Applicant," which term shall inelude the owner or owners of the progerty, heirs, assigns and successors. ` COUNTY DIVISION OF BUILDING AND PLANNING CONDITIONS 1. The proposal shall comply with the Urban Residential-3.5 (UR-3.5) zone, as amended. 2. The final plat shall be desigaed substantially iu conformance with the preliminary plat of record. No incr+ease of density or number of lots shall occur without a change of condition application submittal and approval. 3. The Building aad Planning Director/designee shall review any proposed final plat to ensure compliance with these Findings and Conditions of Approval. 4. The preliminary plat is givea conditional approval for five (5) years, specifically to May 1, 2001. Tbe applicaat may reguest an extension of ame by submitting a wntten r+equest approximately forty-five (45) days prior to the above expiration date. 5. Three (3) eurrent certifcates of tide shaU be funiished to the Building aad Plann.ing Division prior to filing the final plat. 6. Appropriate utility easements shall be indicated on copies of the proposed final plat. Written approval of utility easements by appropriate utility companies shall be received with the submittal of the final plat. 7. Prior to filing of final plat, the appropriate road name(s) and street address(es) shall be indicated. 8. The final plat map shall indicate by a clear, dashed line the required yard setbacks from all private, "Tract X" or public roads. The dedication shall contain the following Findings and Decision SP-1057-96 2 statement: "Side yard and rear yard setbacks shall be determined at the ti.me building peimits are requested unless these setbacks are specifically drafted on this final plat. The setbacks indicated on this plat may be varied from if proper zoning approvals are obtained," 9. The Spokane Counry Division of Building and Planning shall prepare and record with the Counry Auditor a Title Notice specifying a future land acquisition area for road right-of-way and utilides. The reserved future acquisition area Tide Notice shall be released, in full or in part, by the Building and Planning Division. The notice should be reconied the same tune as the final plat and shall provide the foUowing: a. A strip of property 10 feet in width from the existing right of way is reserved for futune acquisi'on azea for additional road right-of-way along Mamer Road b. Future building and other setbacks required by the Spokane Counry Zoaing Code shall be rrieasured from the reserved future acquisition area. c. No required landscaping, parking, '208' areas, drainfield or allowed signs should be located within the future acguisition area for road rigbt-of-way and utilities. If any of the above improvements are made within this area, they shall be relocated at the applicant's expense when roadway improvements are made. d. 1'he future acquisition area, until acquired, shall be private properiy and may be used as allowed in the zone, except that any improvements (such as laadscaping, parking, surface drainage, drainfield, signs or others) shall be considered interim uses. e. The praperty owner shall be responsible for relocating such "interim" improvements at the time Spokane County makes roadway improvemeats after acqu.itwg said future acquisition area. 10. No water plan is required, and a simple tap is needed prior to sale of each tract and prior to issuance of a build.ing pemut for each tract. 11. The owner shall negotiate with Central Va11ey School District and submit a recorded copy of a voluntary agreement making provisions for public schools prior to fiaalization and recording of the plat. The agreement shall provide a written description of the subject property to which the agxeement applies and also state the dollaz amount and any other agreed to mitigating measures. The owner shall also notify any potential purchasers who have made an agreement to purchase property within said plat pursuant to the Revised Code of Washington (RCW) 58.17.205, that adequate provisioas for school facilities must be made conditioned on a future agreement between the plattor and school district. Voluntary agreements between the ovvner and school discrict shall coafoma to the requirements of RCW Chapter 82.02. 12. A survey is required prior to the filing of a final plat. 13. The applicant shall contact the Division of Building and Planning at the earliest possible stage in order to be informed of code requirements administered/enforced as authorized by the State Building Code Act. The conditional approval of the plat is given by the County Engineer subject to dedication of right-of-way and approval of the road system as indicated in the preliminary plat of record. Findings and Decision SP-1057-96 3 2. No construction work is to be performed within the existing or proposed public right-of- way until a pernait has been issued by the County Engineer.
