PROJECT AND SITE DESCRIPTION
Short Plat No. SP-1054-95 is a 3 lot residential short plat
situated on approximately 1.00 acre in central Spokane County. The
site is situated south of and adjacent to Sprague Road, and
approximately 160 feet east of Moen Street in the Northeast quarter
of Section 19, Township 25 North, Range 45 East, W.M., Spokane
County, Washington. The property is surrounded by developed
subdivisions.
The proposed site is relatively flat, sloping slightly to the
north. The slopes on the site run between 0% and 3$. The soil in
this area is mainly comprised of Garrison gravelly loam (GgA).
This soil is excessively well drained and has moderately rapid
permeability. Surface run-off is slow and the hazard of erosion is
slight.

METHOD OF MANAGEMENT
The stormwater analysis criteria used for this site considered the
following factors:
1. The lots in this plat are served by a private driveway
serving 3 lots or less.
2. The site for this project does lie within the Aquifer
Sensitive Area, therefore stormwater treatment swales and
drywells will be used.
3. The site for this project lies inside the PM-10 zone as
established by the Spokane County Air Pollution Control,
Authority (SCAPCA), therefore the private driveway will
be paved with asphalt concrete.
4. The site is relatively flat with slopes between 0$ and 31
and have been field verified by site inspection by an
engineer in our office.
5. Stormwater will consist of mainly on-site due to the
topography and development of the area. The property is
surrounded by developed subdivisions.
Calculations were made to determine a relationship between existing
conditions and the proposed developed conditions. All factors used
in determining the numbers for the developed conditions are very
conservative, allowing for the maximum developed condition to be
calculated. A pre-developed "Q" was calculated to be 0.60 cfs, and
the developed "Q" calculated to be 0.71, for an increase of 0.11
cfs, or 18%. By treating the run-off from the private road, 0.37
cfs of the overall basin will be contained and disposed of and the
developed run-off will be less than the existing.

STATEMENT OF AGREEMENT •
Dorothv Price ,(Sponsor) has entered into a contractual agreement
with J. PAUL RAMER & ASSOCIA2ES, INC. ("ENGINEER") for construction
engineering services for Spokane County Project #SP-1054-96 .
1. The minimum scope of these construction engineering services
includes, but is not limited to:
A) Daily observation and reporting of •construction
activities on this project;.
B) Maintenance of all construction records related to this _
project, to include, but not limited to daily inspection
reports, manufacturer's certifications, material test

METHOD OF MANaGEMENT
The stormwater analysis criteria used for this site considered the
following factors:
1. The lots in this plat are served by a private driveway
serving 3 lots or less.
_ 2. The site for this project does lie within the Aquifer
Sensitive Area, therefore stormwater treatment swales
will be used.
3. The site for this project lies inside the PM-10 zone as
established by the Spokane County Air Pollution Control
Authority (SCAPCA), therefore the private driveway will
be paved with asphalt concrete.
4. The site is relatively flat with slopes between 0t and 3%
and have been field verified by site inspection by an
engineer in our office.
5. Stormwater will consist of mainly on-site due to the
topography and development of the area. The property is
surrounded by developed subdivisions.
Calculations were made to determine a relationship between existing =
conditions and the proposed developed conditions._ All factors used •
x in determining the numbers for the developed conditions are very conservative, allowing for the maximum developed condition to be
calculated. A pre-developed "Q" was calculated to be 0.60 cfs, and
the developed "Q" calculated to be 0.71, for an increase of 0.11
cfs, or 18t. By treating the run-off from the private road, 0.37
cfs of the overall basin will be contained and disposed of and the
developed run-off will be less than the existing._
A temporary swale will be constructed 3n the northwest corner of
this site to collect and dispose of stormwater. At the time that
the existing trailor along the west property line of Tract "A" is
no longer needed and is removed and the temporary easement is
vacated, the driveway will be constructed to extend along the
- westerly property line and the swal.e will be reconstructed to be in -
• alignment with said driveway. _ - O

CORBIN PARK TO GREENACRES
_ The Company hereby reserves and the Purchaser does hereby grant
unto the said Company the rights of way now or hereafter deemed
necessary by said Company for the construction and maintenance
of irrigation f lumes, ditches and pipe lines over and across
the above described land for the irrigation of said land as well
as other lands, with the rights and privileges to enter upon said
land for survey, location, construction and repair of said irri-
gation conduits, either by the Company, or by the owner or owners
of lands served by them.
This deed is also made upon the express condition that this deed and
the lands herein described are subject to all the rights, privileges,
duties, liabilities and obligations of the parties to this deed as
the same are now contained in a certain contract dated July 5, 1923,
made between the Spokane Valley Farms Company, a corporation, as
party of the first part, and the Community Service Company, a corp-
oration, as party of the second part, now of record in the office
of the Auditor of Spokane County, Washington, in Volume "X" of
Miscellaneous Records, at page 282 thereof, and that all subsequent
deeds conveying said land shall be made subject to said contract
and said contract shall run with this land with the same force
and effect as if the said contract were expressly written in such
deed.
Every sale of land in Corbin Addition to Greenacres shall carry with
it as a part of such transaction, stock in the Community Service
Company at the rate of one (l) share of stock for each acre of land
sold, provided that in sales of less than one acre a full share of
stock shall be issued for each tract. And the party of the first
part hereby agrees to transfer to the party of the second part
with delivery of deed 3.03 shares of stock in Said Community Service
Company. _
All the covenants, terms and conditions, rights, privileges and
burdens herein mentioned shall inure to the benefit of, extend to
andbe binding upon the parties hereto, their heirs, executors,
administrators, grantees, successors and assigns respectively.
Provisfons common to lots in Corbin Addition to Greenacres imposed
- prior to February 15, 1950, as follows:
1. That all buildings built on Lots 17 to 34 inclusive in Block
12, and Lot 24 to 46 inclusive in Block 15, shall be constructed of
brick or fire-proof material.
2. No property sold in Corbin Addition to Greenacres shall be used
for business purposes of any kind prior to January 1, 1929, except
the property specified in paragraph one preceding and except Lot 1
to 10 inclusive in Block 12, Lots 1 to 10 inclusive in Block 15 and
Lots 1 to 23 inclusive in Block 23, provided however, that this
shall not prevent the owner of any tract of land in said Addition
form selling the products raised by such owner on said tract.
3. No dwelling shall be erected or permitted to remain on safd
land of less cost than $1,500.00; however a temporary house may be
built and used for not to exceed two years. All buildings must be
painted or stained. At least one-half of said land shall be
improved within two years from date of purchase.

THIS MATTER, an applicadon for subdivision of land, from Dorothy Price and decided
upon, pursuant to Spokane County Subd.ivision reguladons, on the . day of March,
1996.
FINDINGS OF FACT AND CONCLUSIONS
1. The individual signing below has further been properly delegated the r+esponsibility for
rendering the decision by the Spokane County Director of Building and Plaaning.
2. The proposal is to divide approximately 1 acre into 31ots for r+esidential uses and those
uses permitted in the Urban Residential - 3.5 (UR 3.5) zone. There is currently an
existing house, aad an earisting trailer (Dependent Relative Pe,rmit CLJE-53-89), on
Parcel l.
3. The proposal is located in the Spokane Valley, south of aad adjacent to Sprague
Avenue between Moen Street and Greenacres Road, in the NE 1/4 of Section 19,
Township 25 North, Range 45 E.W.M. Spokane County, Washington.
4. The existing zoning of the property described in the application is Urban Residendal -
3.5 (UR 3.5). The subject property was previously establisbed Agricultural in 1957
(File No. 286-57) and redesignated to Urban Residential - 3.5 (UR 3.5) on January 1,
1991, pursuant to the Frogram to Implement the Spokane Counry Zoning Code.
Pursuaat to RCW 58.17.195 the proposal does confarm to the requirements of the
existing zone.
5. The Spokane County Comprehensive Plan designates thi.s area as Urban. The
development and uses, as proposed and conditioned are in compliance with this
category.
6. Surrounding uses consist of residendal uses.
7. The required public notice was provided for this proposal and agencies having a
potential interest in the project were norified and recommendations solicited. No
comments were received from adjacent property owners.
8. The Spokane County Arterial Road Plan identifies Sprague Avenue as a Minor Arterial -
with a future right of way width of 80 feeG The existing right of way width is 60 feet.
In order to impiemeat the Plan, the County Engineer has requested that a strip of
property 10 feet in width along the Sprague Avenue frontage be set aside in reserve.
This property may be acquired by Spokane County at the time when Arterial
Improvements are made to Sprague Avenue. As condidoned, the proposal conforms to
the Plan.
The County Engineer has also designated a Minor Arterial Roadway Section for the
improvement of Sprague Avenue. This will reqaire the addition of approximately 13-
15 feet of asphalt along the frontage of die development The construction of curbing
aad sidewallk is also required.
9. The site is located within the Public Transportation Benefit Area (PTBA).
10 The proposed short plat will be served by a public water system, requi.ring only simple
connections. Waste water disposal will be as authorized by the Director of Utilities.
11. The locadon of an existing "dependent relative" trailer on Parcel A resulted in having a
temparary 15 foot wide driveway easement 15 feet from the existing house, which does
not comply with setback standards. To compensate for the setback, the applicant was
required to record a document with the County Auditor stating that the said driveway
easement is temporary and subject to closure given specific conditions. In addition, a
15 foot wide easement to serve as permanent access for Parcels 2 and 3 was established
along the east property line of Parcel l, thereby in the long term meeting setback
standards. More specifically, the recorded document (Auditar's Recording
#9642220213) states the following:

A 15 foot temporary driveway easement shall be established thmugh Parcel 1 to
temporarily serve Farcels 2 and 3. Said easement shall be physically closed and
vacated when either of the following apply:
a) the Dependent Reladve Pernut is no longer valid; or
b) the existing property owner sells Parcel 1 of Short Plat 1054-96.
In the event that either occur, the existing property owner of Parcel l shall, prior to the
amsfer of dde of Parcel l:
a) remove the existing trailer on Parrel l;
b) physically close to parcels 2 and 3 and vacate the 15 foot wide temporary
easement;
c) niake the roquired physical improvements to the pesmanent 15 foot wide
easement tio serve as pennanent access for Parcels 2 and 3; and d) record with the County Auditor a document that renders the temporary easement
null and void. Said document shall reference Auditor's Recording
#9602220213 assigned to the temporary easement document. In addition, a
copy of said docwnent shall be fumished ta the Division of Building and
Planning for file number SP-105496 for recordkeeping purposes.
12. The Central Valley School District has commented on the proposed Short Plat. The
District has indicated that acisting school facilities are inadequate to serve the proposed
short plat and wishes to negotiate with the owner to provide adequate capital facilides as
required by the Revised Code of Washington (RCV) 58.17.110. Review by County
legal couasel indicates the condition requested by the School District can be required for
developments. Approval of this short plat should include conditions requiring that
provisions for appropriate facilities be in place priar w recording the final short plat in
the fonn of a wntten agreement between the owner and the school district.
13. Recognizing the recommended conditions (that the driveway easement serving Parcels
2 and 3 is temporary only) and Spokane County development standards, appropriate
provisions should be made Lo ensure the public health, safety and general welfare and
that the public use and interest will be served by platting the subdivision.
14. The subdivision proposal is generally consistent with RCW 58.17 and the County
subdivision regulations, promoting the public health, safety and general welfare in
accorriance with standands established by the state and Spoka.ne County. The Division
of Planning has considered the provision of adequate public facilities as cited in RCW
58.17.110 (2). More specifically: -
a. open spaces f. sanitary wasLe disposal b. draLaage ways g, parks and recreation facilities .
c. public and/or private rights-of-way h. playgrounds
d• tca.nsit i. schools and schoolgrounds
e. potable water J. sidewalks
DECISION
Based upon the above nored Findings of Fact and Coaclusions, Short Plat Application
SP-1054-96 is hereby APPROVED nntil April l, 2001, subject to conditions noted below.
Most of the conditions of appmval shall be accomplished by the applicant and/or sponsor prior
to finalization of the short subdivision. This decision is final unless appeaied in writing,
consistent with adopted appeal pr+ocedures.
The following conditions shall be binding on the "Applicant", which term shall include the
Qwner or owners of the property, heirs, assigns and successors.
COUNTY DIVISION OF BUILDING AND PLANNING CONDITIONS
1. The groposal aad future development of this pzoperty shall comply with the Urban
Residential - 3.5 (UR 3.5) zone, as amended.
2. The f nal plat shall be designed substantially in conformance with the prelimiaary plat
of record. No inerease of density or number of lots shall occur without a change of
condition application submittal and approval.

3. The Planning Director/designee shall review any proposed final plat to ensure
compliance with these Findings and Conditions of Approval.

~ 4. The preliminary plat is given conditional approval for five (5) years, specifically to
April 1, 2001. The applicant may request an extension of time by submitting a written
request approximately forty-five (45) days prior to the above expiradon date.
5. Three (3) current certificates of title shall be furnished to Spokane Division of
Planning prior to filiag the final plat.
6. Appropriat,e utility easements shall be ind.icated on copies of the proposed final plat.
Written approval of utility easements by appmpriate utility companies shall be received
with the submittal of the final plat.
7. Prior to filing of final plat, the appropriate road name(s) and street address(es) shall be
indicated.
8. T'he final plat map shall indicate by a clear, dashed line the required yard setbacks from
all private, "Tract X" or public roads. The dedication shall contain the following
statement:
"Side yard and rear yard setbacks shall be deternlined at the time building permits are
requestei unless these setbacks are specifically drafted on this final plat. Tlie setbacks
indicated on this plat may be varied from if proper zoning approvals are obtained."
9. A survey is required prior to the filing of a final plat
10. The final glat map shall reference the 15 foot wide temporary driveway easement to
Auditor's Recording #9602220213.
11. The dedication shall contain the following statement:
"The 15 foot wide temporary driveway easement (Auditor's Recording #9602220213)
established to temporarily serve Parcels 2 and 3 shall be physically closed and vacated
when either af the following apply:
a) the Dependent Relative Pennit is ao longer valid; or
~ b) the existirig property owner sells Pancel 1.
In the event that either occur, the exisring property owner of Parcel l shall, prior to the
transfer of tide of Parcel 1:
a) remove the existing trailer on Parcel l;
b) physically close to parcels 2 and 3 and vacate the 15 foot wide temporary
easement;
c) make the required physical improvements to the permanent 15 foot wide
easement to serve as permanent access for Parcels 2 and 3; and
d} record with the County Auditor a document that renders the temporary easement
null and void Said document shall reference Auditor`s Recording
#9602220213 assigned to the temgorary easement document. In add.idon, a
copy of said document shall be fumished to the Division of Buiiding and
Planning for file number SP-105496 recordkeeping purposes."
12. The owner shall negodate with the Central Valley School District and submit a recorded
copy of a voluntary agreement making provisions for public schools prior to
finalization and recording of the plat The agreement shall provide a written description
of the subject property to which the agreement applies and also state the dollar amount
and any oiher agreed to midgating measures. ;
The owner shall also notify any potential purchasers who have made an agreement to
purchase property within said plat pursuant to the Revised Code of Washington (RCW)
58.17.205, that adequate provisions for school facilides must be made conditioned on a
future agreement between the plattQr and school district.
Voluntary agreements between the owner and school d.istrict shall conform to the
requirements of RCW Chapter 82.02.
13. The applicant shall contact the Division of Building and Planning at the earliest possible
stage in order to be informed of code requirements administered/enforced as authorized
by the State Building Code Act. Design/development concerns include: ADDRESSING,
FIltE APPARATUS ACCESS ROADS; FIRE HYDRANT/FLOW; APPROVED WATER
SYSTEMS; BUILDING ACCESSIBILTfY; CONSTRUCTTON TYPE; OCCUPANCY
CLASSIFICATTON; EXITING; EXTERIOR WALL PROTECIION; AND ENERGY CODE

REGULATIONS. (Note: The Division of Building and Planning reserves the right to
confirm the actual address at the time of building permit.)
CQUNTY DIVISION OF ENGINEERING AND RnADS CONDITIONS
1. Th.at conditional approval of the plat by the Connty Engineer is given subject to approval
of the road system as indicated in the preliminary plat of record.
2. That drainage plans and design calculations showing the alignment of drainage facilities
be submitted to the County Engineer for acceptaace prior to construction and/or the filing
of the final plat, Drainage plans to be pr+epared under the direction of a licensed
Professional Civil Engineer.
3. No construction work is to be perfonned within the existing ar proposed Public Right-of-
Way until a permit has been issued by the County Engineer. All work is subject to
inspection and approval by the County Engineer.
~ 4. The applicant should be advised that individual driveway access permits are required
' prior to issuance of a building pennit for driveway approaches to the County road
system.
5. Existing County roads providing direct access to the plat shall be paved and/or curbed to
Spokane County standands.
6. That sidewalks are required along the arterial on Sprague Avenue.
7. The word "applicant" shall include the owner(s) of the property, bis/her heirs, assigns
and successors.
To construct the road improvements stated herein, the applicant may, with the approval of
the County Engineer, jain in and be a willing participant in any petition or resolution
which purposes is the fonnation of a Road Improvement District (RID) for said
improvements pursuant to ReW 36.88, as amended. At such time as an RID is created
or any Road Improvement Project is sanctioned by Spokane Connty, the improvements
required (ctrb, sidewalk, drainage control and paving to existing pavement) will be at the
sole expense of the nndersigned owner, their heirs, grantees and assigns. This provision
is applicable to Sprague Avenue.
9. As an alternative method of constructing the road improvement stated herein, the
applicant may, with the approval of the County Engin@er, accomplish the road
improvements stated herein by joining and participating in a County Road Project (CRP)
to the extent of the mquired road improvement At such time as an RID is created or any
Road Improvement Project is sanctioned by Spokane County, the improvements required
(curb, sidewalk, drainage control and paving to existing pavement) will be at the sole
expense of the undersigned owner, their heirs, grantees and assigns. This provision is
applicable to Sprague Avenue.
10. That the following statement shall appear within the dedica.tory language of the final pIat:
That in consideration of Mutual Benefits now or to be hereafter derived, do for
themselves, their heirs, grantees, assigns and successor (s) in interest hereby request and
autharize Spokane County to include the above described property in a Road
Improvement District (RID) and to support the formatian of a Road Improvement Distdct
£or improvement of the road(s) described below by requesting and authorizing Spoka~ne
County to place their name(s) on a petition for the farmadon of a Road Improvement
District pursuant to RCW 36.88.050, or by requesting and authorizing Spokane County
to cast their ballot in favor of a RID being formed under the resolution method pursuant
to RCW 36.$8.030, and/or by not filing a protest against the formation of a RID being
fonned under the alternative resoludon method provided for in RCW 36.88.065 and
Chapter 35.43 RCW.
If a RID is proposed for improvemeat of the road(s) described below, said owner(s) and
successor(s) further agree: (1) that the improvements or construction contemplated within
the proposed RID are feasible, (2) that the benefits to be derived from the fomiation of
the RID by the property included therein, together with the amount of any County
participauon, exceeds the cost and expense of fonnation of the RID, and (3) that the
property within the proposed RID zs sufficiendy developed; provided, themselves, their
heirs, grantees, assigns and successor(s) shall retain the right, as authorizcd under RCW

36.88.090, to object to any assessment(s) on the property as a result of the improvements
called for in coajunction with the formarion of a RID by either petition or resolution
method under Chapter 36.88 RCW, and to appeal to the Superior Court the decision of
the Board of County Commissioners confimning the final assessment roll; provided
further, it is recognized that actual assessnnents may vary from assessment estimate so
long as they do not exceed a figiue equal to the increased true and fair value
improvement(s) add(s) to the property.
It is further acknowledged and agreed that at such tune as a RID is created or any County
Road Improvemeat project is authorizeti by Spokane County, the improvements required
shall be at the sole expense of the owner(s) of praperty within the RID or served by the
improvements without any monetary participation by Spokane County.
The RID waiver contained in this agreement shall expire after ten (10) years from the date
of execution below. This provision is applicable to Sprague Avenue.
11. The County Engineer has designated a Minor Arterial Raadway Section for the
improvement of Spi°ague Avenue which is adjacent t+o the pmposed develapment. This
will require the additioA of approximately 13-15 feet of asphalt along the frontage of the
dlevelopment- The construction of curbing and sidewaik is also required.
12. The proposed subdivision shaU be improved to the standards set forth in Spokane County
Board of Commissioners Resolution No. 95-0498, as amended, which resolution
establishes regulations for roads, approaches, drai.nage and fees in new construction.
13. The County Engineer has examined this development proposal and has determined that
the impact of tZiis proposal upon the existing County Road System warrants the
dedication of additional Right of Way and the roadway improvements herein specified.
14. The County Arterial Road plan identifies Sprague Avenue as a 80 foot Minor Arterial.
The existing right of way width of 60 feet is not consistent with that specified in The
Plan. In order to implement the Aroerial Road Plan it is recommended that a strip of
property of IO feet in width along the Sprague Avenue frontage be set aside in reserve.
This pmperty may be acquined by Spokane County at the time when Arterial
Improvements are made to Sprague Avenue.
15. The applicant should be advised that there may exist utilities either underground or -
overhead affecdng the applicants property, including property to be ded.icated or set aside
for future acquisition. Sgokane County will assume no financial obligation for
adjustime,nts or relocation regarding these utilities. The applicant should check with the
applicable utilides and Spokane County Engineer to determine whether the applicaat or
utility is responsible for adjustment or relocation costs and to make arrangements for any
aecessary wark.
16. The applicant shaU grant applicable border easements adjacent to Spokanne County Right
of Way per Spokane County Standards.
COUNTY HEALTH DISTRICT CONDTTIONS
1. The final plat shaU be designed as ind.icated on the preliminary plat of record andlor any
attached sheets as noted.
2. Appropriate utiliry easements shall be indicated on copies of thc preliminary plat of
reconi for distribution by the Planning Departrnent to the utility companies, Spokane
County engineer and the Spokane County Health District. Writt,en approval of the
easements by the utility companies must be reoeived prior to the submittal of the final
plat.
3. Sewage disposal method shaU be as authorized by the Director of Utilities, Spokane
County.
4. Water service shaU be cooniinated through the DirectAr of Utilities, Spokane County.
5. Water senrice shall be by an existing public water supply when appraved by the
Regioaal engineer (Spokane), State Deparanent of Health.

6. Pnor to filing the final plat, the sponsor shall demonstrate to the satisfaction of the
Spokane County Health District that an adequate and potable water supply is available
to each tract of the plat.
7. Prior to filing the fuial plat, the sponsor shall present evidence thw the plat lies within
the recor+ded service area of the water system proposed to serve the plat,
8. Prior to filing the final plat, the sponsor shall demonstrate to the sadsfaction of the
Spokane County Health District that suitable sites for on-site sewage disposal systems
are available on ParceLs 2 aad 3. Testholes indicate soils that require 18,000 square feet
for Parcel 1 and a minunum of 12, 500 square feet for Parcels 2 and 3.
9. Prior to filing the final plat, the sponsor shall demonstrate to the satisfacdon of the
SpQkane County Health District that the existing system serving the residence Iocated
on Parcel l is wholly located within the boundaries of the parcel, or proper easements.
10. Subject to specific application appr+aval and issuance of permits by the I3ealth Officer,
the use of individual on-site sewage disposal systems may be authoriz,ed.
11. The dedicatory language of the plat will state: "Subject to specific application approval
and issuance of pernuts by the Health 4ffioer, the use of individual on-sit,e sevsrage
systems may be authorized."
12. The dedicatory language on the plat shall state: "Use of private wells and water
systems is grohibited."
13. The plat dedir,ation shall contain a statement to the effect that: "The public water
system, pursuant to the Water Plan approved by county anci state health authorities, the
local5re protection d.istrict, County Building and Safety Department and water
ptn veyor, shall bc installed within this plat, snd the appiicant shall provide for
individual domestic water service as well as fire protection to each tract prior to sale of
each tract and prior tio issuance of a building permit for each ticact."
COUNTY DIVISION OF UTILITIES CONDITIONS
1. Pursuant to the Board of Couaty Commissioners Resoiudoa No. 80-0418, the use of
on-site sewer disposal syst,ems is her+eby anthorized. This authorizadon is condidoned
in compliance vcrith all rules and reguladons of the Spokane County Health District and
is further couclitioned and subject to specific application approval and issuance of
permits by the Health DistricL
2. The Dedication shall state! A Covenant Agreement shall be signed stating: The
Owner(s) or S uccessor(s) in interest agree to authorize the County to place their
aame(s) on a petition for the for~mation of a ULID by peddon method pursuant to RCW
36.94 whicb the petidon includes the Owner(s) property and further not to object by
sigaing of a protest petition against the formatioa of a iJLID by resoludon method
pursuant to RCW 36.94 which includes the Owner(s) gr+operty. PROVIDED, this
condition shall not prohibit the Owner(s) or Successor(s) from objection to any
assessment(s) on the property as a result of improvements called far in the conjunction
with the formadon of a ULID by either petition or resolution under RCW 36.94.
3. Each new unit shall be double plumbed for connection to futune area-wide collection
systenas. 4. Water seivice shall be provided in accordance with the Coordinated Water System Plan
for Spokane County, as anaended.

1. The Spokane Yalley F'ire Deparament's standards in regards to the turnaround must be
met.

Chapter 35.43 RCW.
Zf a RID is proposed for improvemeat of the road(s) described below, said owner(s) and
succesaor(s)further agree: (l) that the improvements or construction contemplated
within the proposed RID are feasible and (2) that the benefits to be derived from the
formation of the RID by the property included therein, together with the amount of any
County participation, exceeds the cost and expense of formation of the RID, and (3)
that the property within the proposed RID is sufficiently developed; provided,
themselves, their heira, grantees, assigns and successor(s) shall retain the right, as
, authorized under RCW 36.88.090, to object to any assessment(e) oa the property as a
result of the improvements called for in conjunction with the formation of a RID by
either the petition or resolution method under Chapter 36.88 RCW and to appeal to the
Superior Court the decision of the Board of County Commiesionera confirming the final
assessment roll; provided further, it is recognized that actual assessments may vary
frvm assessment estimate so long as they do not exceed a figure equal to the increased
true and fair value improvement(s) add(s) to the property. '
It is further acknowledged and agreed that at such time as a RID is created or any
County Road Improvement project is authorized by Spokane County, the improvements
required shall be at the sole expense of the owner(s) of property within the RID or
served by the imprvvements without aay monetary participation by Spokane County.
The RID waiver contained in this agreement shall expire after ten (10) yeara from the
date of exeeutioa below. This proviaion is applicable to Sprague Avenue.
E24 The County Engineer has designated a Minor Arterial Roadway Section for the improvement
of Sprague Avenue which is adjacent to the proposed development. This will require the
addition of approximately 13-15 feet of asphalt along the frontage of the development.
The construction of curbing and sidewalk is also required.
E32 The proposed plat shall be improved to the standards set forth in Spokane County Board
of Commiseioners Resolution No. 95-0498, as amended, which establishes regulationa for
roade, approaches, drainage and fees in new construction.
E33 The County $ngineer has examined this development proposal and has determined that the
imgact of this proposal upoa the existing County Road System warrants the roadway
improvements herein specified.
E61 The County Arterial Road plan identifies Sprague Avenue as a 80 foot Minor Arterial.
The exieting right of way width of 60 feet is not consistent with that specified in The
Plan. In order to implement the Arterial Road Plan it is recommended that a strip of
property 10 feet ia width along the Sprague Avenue frontage be set aside in reserve. This property may be acquired by Spokane County at the time when Arterial Improvements
are made to Sprague Avenue.
E90 The applicant should be advised that there may exist utilities either underground or
averhead affecting the applicants praperty, including property to be dedicated or set
aside future acquisition. Spokane County will assume no fi.naacial obligation for j
adjustments or relocation regarding these utilities. The applicant ahould check with
the applicable utilities and Spokane County Engineer to determine whether the applicant or utility is responsible for adjustment or relocation costs and to make arrangemente
for any neceasary work.
SPECIAL CONDITION: The applicant shall grant applicable border easements adjacent to Spokane
County Right of Way per Spokane County Standards.
