The individuaI sagning below has further been properly delegated the respoasibility for rendering the decision by the Spokane County Director of Building and Planning. 2. The proposal is to divide approximately 4.77 acres into 3 residential tracts and those uses pernvtted in the Urban Residential-3.5 (UR-3.5) zone. 3. The proposal is located south of and adjacent to Sprague Avenue and approximately 630 feet west of Barker Road in the NE 1I4 of Section 19, Township 25 North, Range 45 E.W.M. Spokane County, Washington. 4. The existing zoning of the property described in the application is Urban Residential- 3.5 (UR-3.5), previously established as Agricultural (A) (file # 376-58) zoning in 1958 and redesignated to UR-3.5 on January 1, 1991, pursuant to the Program to Implement the Spokane County Zoning Code. Pursuant to RCW 58.17.195 the proposal does conform to the requirementc of the existing UR-3.5 zone. 5. The Spokane County Comprehensive Plan designates this area as UItBAN. The development and uses, as proposed and conditioned are in compliance with this category. 6. The Spokane County Arterial Road Plan identifies Sprague Avenue as a Minor Arterial with a future right of way width of 80 feet. The existing right of way width is 60 feet. In order to implement the Arterial Road Plan, a strip of property 8 feet in width along che Sprague Avenue frontage is to be set aside as a Future Acquisition Area. In addition, the County Engineer has requested a dedicauon of 2 feet of additional right of way along Sprague Avenue. Therefore, as conditioned, (such as improvements, dedication, sidewalks and acquisition areas) the proposal conforms to the Road Plan. 8. The site is located within the Public Transportation Benefit Area (PTBA). The Spokane Transit Authority (STA) East Sprague Route # 9 provides connecting services to the site. 9. The proposed short plat will be served by a public water system. Waste water disposaJ will be as authorized hy thc Director af Utiiities. 10. The required public notice was provided for this proposal and agencies having a potential interest in the praject were notified and recommendatians solicited. 11. No written comments were received from any adjoining property owners. 12. Recognizing the recommended conditions and Spokane County deveiopment standards, the proposed short plat makes appropriate provisions for the public health, safety and general weifare and that the public use and interest will re served by plattincr the subdivision. The subdivision proposal is generalIy consistent with RCW 58.17 and the County subdivision regulations, promoting che public health, safety and general welfare in accordance with standards established by the state and Spokane County. The Building and Planning Divisian has considered the provision of adequate public facilities as cited in RCW 58.17.110 (2). More specifically: a. open spaces f. sanitary waste disposal b. drainage ways g. parks and recrzation facilities d . c. public and/or private rights-of-way h. playgrounds d. cransit i. schools and schoolgrounds e. potable water j. sidewalks 13. The project is exempt from environmental neview under the State Environmental Policy Act pursuant to WAC 197-11-800 (6) (a). 14. The Central Valley School District has commented on the proposed Short Plat. The District has indicated that existing school facilities are inadequate to serve the propoced short plat and wishes to negotiate with the owner to provide adequate capital 'facilities as required by the Revised Code of Washington (RCW) 58.17.110. Review by County legal couasel indicates the condition requested by the SchoAl District can be required for developments. Approval of this short plat should include conditions requiring that provisions for appropriate facilities be in place prior to recording the final short plat in the form of a written agreement between the owner and the school district. DECISION Based upon the above noted Findings of Fact and Conclusions, Short Plat Application SP- 1076-96 is hereby APPROVED for five (5) years, specifically to July 1, 2001 and subject to conditions noted below. This decision is final unless agpealed in writing, consistent with adopted appeal procedures. All the below conditions imposed shall be binding on the "Applicant", which term shall include the owner or owners of the property, heirs, assigns and tuccessors. COUNTY DIVISION OF BUILDING AND PLANNING CUNDITI0NS I. The praposal shall comply wi[h the Urban Residential-3.5 (CJR-3.5) zane, as amended. 2. T'he final plat shal] be designed substantially in conformance with the preliminary plat of record. No increase of density or number of tracts shall occur without a change of condition applicatian submittal and approval. 3. The Building and Plann:r.g Directer,~de.s:gaev shall review any proYosed fct-iai ptat to ensure compliance with these Findiags and Conditions of Appraval. 4. The preliminary plat is given conditional approval for five (5) years, specifically to 3uly 1, 2001. Three (3) eurrent certificates of title shall be furnished to the Building and Planning Division prior to filing the final plat. 6. Appropriate utility easements shall be indicated on copies of the proposed final plat. Written approval of utility easements by appropriate utiiiry companies shall be received with the submittal of the final plat. 7. Prior to filing of final plat, the appropriate road name(s) and street address(es) shall be indicated. 8. The final plat map shall indicate by a ciear, dashed line the required yard setbacks from all private, "Tract X" or public roads. The dedication shall contain the following statement: "Side yard and rear yard ,Setbacks shall be determined at the time building perm;ts are requested unleas these setbackx are specifically drafted on this final pIat. The setbacks indicated on this plat may be varied from if proper zoning approvals are obtained." 9. T'he Spokane County Divisian of Building and Planning shall prepare and record with the County Auditor a Title Notice specifying a future land acquisition area for road right-of-way and utilities. The neserved future acquisition area Tide Notice shall be released, in full or in part, by the Building and Ptanning Division. The notice should be recorded the same time as the final plat and chall provide the following: a. A strip of property 8 feet in width from the existing right of way is reserved for future acquisition area for additional road right-of-way along Sprague Avenue. Findings and Decision SP-1076-96 2 b. Futuce building and other setbacks required by ehe Spokane County Zoning Code sball be measured from the reserved future acquisition area. c. No required landscaping, parking, '208' areas, drainfield or allowed signs should be located widun the futum acquisition area for road right-of-way and utilities. If any of the above improvements are made within this area, they shall be relocated at the applicant's expense when roadway improvements are made. d. The future acquisition area, until acquired, shall be private property and may be used as allowed in the zone, except that any improvements (such as • landscaping, parking, surface drainage, drainf'ield, signs or others) shall be considered interim uses. e. The property owner shall be responsible for relocating such "interim" improvemens at the time Spokane County malces roadway improvements after acquiring said future acquisition area. 10. 1Vo water plan is required, only a simple connection will be needed prior to the sale of each tract and prior to issuance of a building permit f4r each tract. 11. 1'he owner shall negotiate with Central Valley Sehool District and submit a recorded copy of a voluntary agreement making provisions for pubiic schools prior to finalization and recording of the plat. The agreement shall provide a wntten description of the subject property to which the agreement applies and also state the dallar amount and any other agreed to mitigatinb measures. The owner shall also notify any potential purchasers who have naade an agreement to purchase property within said plat pursuant to the Revised Code of Washington (RCW) 58.17.205, that adequate provisions for sehool facilities must be made conditioned on a future agreement between the plattor and school district. (Note: The Division of Building and Planning reserves the right to confirm the actual address at the time of building permit.) COUNTY DIVISION OF ENGINEERING AND ROADS CONDITIONS 1. The conditional approval of the plat is given by the County Engineer subject to ded.ication of right-of-way and approva1 of the road system as indicated in the preliminary plat of recvrd. 2. Drainage plans and design calculations showing the alignment of drainage facilities shall be submitted to the County Engineer for acceptance prior to construction and/or the fiting of the ftnal plat. Drainage plans to be prepared under the direction of a licensed Professional Civil Engineer. 3. No construction work is to be performed within the existing or proposed public right-of- way until a permic has been issued by the County Engineer. Existing County roads providing direct access to the plat shall be paved ancUor curbed to Spokane County standards. 8. Sidewalks are required along the arterial on Sprague Avenue. 9. To constnact the road improvements stated herein* the applicant may, wich the approval of the County Engineer, join in and be a willing participant in any petition or resoluaon which purpose is the formation of a Road Improvement District (RID) for said improvements, pursuant to RCW 36.88, as amended. At such time as an RID is created or any Road Improvement Project is sancti4ned by Spokane County, the improvements required (curh, sidevvalk, drainage control and paving to eaisting pavc:ienc) wiil be at the sole exFense ai' the undersigned owaer(s), their heirs, grantees and assigns. This provision is applicable to Sprague Avenue. 10. The County Engineer has designated a Minor Arterial Roadway Section for the improvement of Sprague Avenue, which iS adjacent to the proposed development. This will r+equire the addition of approximately 18-20 feet of asphalt along the frontage of the development. The construction of curbing and sidewalk is also required. Findings and ,Decision SP-1076-96 4 13. The proposed plat shall be improved to the standards set forth in Spokane County Board of Commissioners Resolution No. 95-0498, as amended, which resolution establishes regulations for roads, approaches, drainage and fees in new construction. 14. The County Engineer has examined this development proposal and has determined that the impact of this proposal upon the existing County road system watrants the dedication of additional cight-of-way and the roadway improvements herein specified. 15. The County Arterial Road Plan identifies Sprague Avenue as a80 foot Minor Arterial. The existing right-of-way width of 60 feet is not consistent with that specified io the Plan. In order to implement the Arterial Road Plan, in addition to the required right-of•way dedicadon, a strip of property 8 feet in width along the Sprague Avenue frootage shall be set aside in reserve. This property may be acquired by Spokane County at the time when arterial improvements are made to Sprague Avenue. 16. There may exist utilities, either underground or overhead, affecting the subject property, including property to be dedicated or set aside for future acquisition. Spokane Counry assumes no financial obligation for adjustments or relocation regarding these utilities.
