In consideration of approval by Spokane County of
(hereinafter raferred to as the "Development), the undereigned covenants and agrees
that:
l. Ariy building that is constructed on a loG in this Short Plat shall be at such an
elevation so as to provide positive drainage fram any drainage pntry point to the
building (including but not limited to a window well, a window unprotected by a
window well, or a doorway). Said positfve drainage shall consist of a minimum
slope of 3% away from the building fQr a distance of at least 10 feet from the
building. The lote shall be graded so that either a) all runoff is rvuted away from
the building, and conveyed over the lots to a natural dsainage awale or approved
drainage facility, or b) drainage intercepted on the ldt is dispoaed of on the lot
in an approved drainage facility. The approved drainage €acility shall be
constructed in accordance with any applicable accepted plans on file at the County
Engineer's Office. Any revisiong to the accepted drainage plans must be accepted by
the County Engineer's Office prior to construction of said revisions.
2. The property owners within this Short Plat shall be responsible for keeping open
and maintaining the surface path oE natural or man-cnade drainage flow over and
across their respective properties. Each property owner or authorized
representative shall inform each succeeding purchaser of any drainage easements
on the property and their responsibility for maintaining surface draittage paths and
swales within said easements. If the property owner(s) fails to maintain the
surface path of natural or man-made drainage flow, or the drainage awale, a notice
of such failure may be given to the property owner(e). If not corrected within
the period indicated on said notice, Spokane County has the right ta correct the
maintenance failure, or have it corrected, at the expense of the property owner.
3. This short plat is located within the Acquifer Sensitive Area (ASA) Treatment of
storm runoff from driveways shall be provided. The preferred method of treatment is
to have the runoff from driveways sheet flow over lawn turf or native-type grasses.
If a ditch is to be used to collect runoff from driveways, thern the ditcb is to be
grass-lined.
4. This covenant and agreement shall run with the land and shall be hinding upon the
owner(s), their heirs, successors or assign

This letter is provided as a follow-up to dhe phone conversation wc had earGer this month regarding SP-
1077, which is a two lot short plat located betwzen South R.iver Wav road and ihe Spokane River, near the
to~%m of MiUwood.
This short plat has several conditions which coUectively occur infrequendy within the County. First, the
sire is located adjacent to the Spokane River. Second, the site will be adding only oAe residentiai Iot (as
statvd in the Examiner's Report). And finally, you stated that the road &ontage improvements are not
going to be done, instead the Sponsor has chosen the RID process option (as is outlined in the Examiner's
Conditions 9-11 For these coUective reasons, a drainage plan %vill not be needed for this project.

pursuant to Spokane County Suhdivision regulations, an the -<< day of July. 1996.
FI?VDINGS OF FACT AND CONCLUSIONS
1. The individual signing helow has further been properly delegated the responsibility fnr
rendering the decision by the Spokanc County Director of Building and Planning.
The proposal is to divide approximately 1 acre into 2 lots for 1 existing residence and 1
new residential lot or those uses pcrmitted in the Urban Residential-3.5 (UR-3.5) zone.
3. The proposal is located sauth of and adjacent to the Spokane River, at the northea..~t
corner of the intersecUoo of South River Way and Center Road, in the SW 1/4 of
Section 6, Township 25 North, Range 44 E.W.M. Spokane County, Washington.
4. Tbe existiag zoning of the property described in the application is Urban Residential-
3.5 (UR-3.5) zone. The subject property was Previously established as Agriculturll
Suburban in 1956 (File N0. 202-56), dnd redesignated to LJrban Residential-3.5 (LTR-
3.5) on January 1, 199 1, pursuant to the Program to Implement the Spoklne Couaty
Zoning Code. Pursuant ta RCW 58.17.195 the proposal daes con.form to the
requirementS of the existing zone.
5. The Spokane County Comprehensive Plan designates this area as Urban. The
development and uses, as propased and conditioned are in conlpliance with this
caeegary.
b. The Spokane County Sharelines Managenlent Program designates this area as "Urban."
The proposa] and future development shall comply with che regulltians for residential
development for "Urban" Areas of the Shorelines Management Progi•am. as amended.
7. Surrounding uSeS consist of residential uses.
8. The required public natice was provided for this proposal anci ageneies having a
potential interest in the project were notified and recommendations solicited. N0
comments were received fram adjacent property owners.
9. The Spnkane Countv Arterial Road PI1n identifies South River Way as a Local Access
with a future right of way width of 60 feet. The existing right of way width of 34.5
feet is not consistent with that specified in the Plan. In order to implement the Arterial ~
Road Plan, a s[rip of property 12.75 feec in width along the South River Way frontage
shall be set aside in reserve as Future Acquisition Area (FAA). This property may be ~

acquired by Spohane Gounty at the time when Arterial Imprdvements are made to Sixth
Avenue.
The Counry Engineer has requested declication of 1.75 feet of additional right of way
aIang South River Way. Also, the County Engineer ha.s designated a Local Access
Roadway Section for the improvement of South River Way. This will requ.ire the ~ O
addition of approximately 6-8 fcet of a.sphalt along the frantage of the development.

The eonswction of curbing and sidewalk is also required. As conditioned, the
proposal conforms to the Plan.
10. The site is located wichin the Puhlic Transportatinn Benefit Area (PTBA).
11. The proposed shon plat will be served by a public water system. Waste water disposal
will be as authnrized hy the Directoc of Utilities.
12. No comments were received bv the West Va.lley Sehool District.
13. A State Environmental Policy Act (SEPA) Environmental Checklist was submitted by
the spansoc• of SP 1077-96 and reviewed by the County Divisipn of Builciing, and
Planning. The review considered the specifics of the proposal: other available
information; the Generalized Comprehensive Plan; the Spokane County Shorelines
Management Program; other County pnlicies and guidelines; and County Ordinances,
and other regulations and laws. The Division of Building and Planning cletermined that

"no probable significant adverse impacts" would result from the proposal being
develoged as conditioned and as regulated under presen( local and state regLilatipns, and
therefore, issued a Determination of NonSignificance ("DNS") on June 19, 1996. The
lune 19, 1996, "DNS" was circulated to 10 other agencies of jurisdiction and ather
agenciesldepartments affected by the future developm.ent for review and comment. The
"DNS" comment period ended 3uly 5, ] 99b.
14. Recognizing the recommended conditions and Spokane County development standards,
appropriate provisions should be made to ensure the public health, safety aad general
welfare and that the public use and interest will be served by platting the subdivision.
15. The subdivision prAposal is generally cansistent with RCW 58.17 and the Caunty
subdivision reguldtions, promoung thc public health, safety and general wclfare in
accordance with standazds establisbed by the state and Spokane County. The Division
of Planning has considered the provision of adequate pubfic facilities as cited in RCW
58.17.110 More specifically:
a. open spaces f. sanitary waste disposal
b. drainage ways g. parks and recreation facilities
c. public andJor private rights-of-way h. playgrounds
d. transit i. schools and schoolgrounds
e. potable water j. sidewalks
DECISION
Based upon the above noted Findings of Fact and Conclusions, Short Plat Application
SP-107?-9b is hereby APPROVED for f ve (5) years, specifically to August 1, 2001, subject
to conditions noted below. This decision is final unless appealed in writing, consistent with
adopted appeal procedures. All below conditions imposed shall be binding on the "Applicant."

COUNTY DIVISIAN OF I3UILDING AND PLANNING (;UNDITIONS
1. The proposal and future development of this property shall comply with the Urban
Residential-3.5 (UR-3.5) zone, as amended. In addition, the prapasal and future
development shall comply witb the regulations for residential development for "iaTrban"
Areas af the Sharelines Management Program, as amended.
2. The Fnal plat shall be designed substantially in conformance with the preliminary plat
of record. No increase af density or number of lots sha11 occur without a change of
condition application submittal and approval.
3. The Planning Directorldesignee shall review any proposed final plat ta ensure ~
campliance with these Fiadings and CondiUons of Approval.
4. The preliminary plat is given canditianal appraval for five (5) years, specifically to
Augvst l, 2001. The applicant may request an extension of time by submitting a
written request approxi.cnately forty-five (45) days prior to the above expiration date.
Application(s) for extensiQn of time shall be processed under the provisions of Seccion
G of Chapter III of the Spokane County Subdivision Ordinance. If the applicant
complies with the criteria of Section G, the preliminary approval and condatians wil] be
changed to reflect the adopted policy and develapment regulatiAns at the time af the
extension application.
5. Three (3) current certificates of title shall be furnished to Spokane Division of
Plannin~ pcior to fling the final plat.
6. Appropriate utility easements shall be indicated on copies of the pcoposed final plat.
Writtea approval of utility easements by appropriate utility campanies shall be received
with the submittal of the final plat.
7. Prior to filing of final plat, the apprapriate road name(s) and su•eet address(es) shall be
indicated.

8. The final plat map shall indicate by a clear, cashed line the requued yard sctbacks from
all ptivate, "Tract X" or public raads. The dedicatioa shall contain the following
statement:
"Side yard and rear yard setbacks shall be deternuned at the time building permits are
requested unless the$e setbacks are specifically drafted on this final plat. The setbacks
indicated on this plat may be varied from if proper zoning Approvals are obtained."
9. The Spokane County Divisioa of Planning shall prepare and recocd with the County
Auditor a Title Notice specifying a future land acquisition area for road right-of-way
and utilities. The reserved future acquisition area Title Notice shall be released, in full
or ia part, by the Division of Planning. The notice should be recorded with the final
plat and shall provide the follawing:
a. A s(rip of property 12.75 feet in widch from the existing right of way along the
South River Way frontage is to be set aside as Furure Acquisition Area (FAA)
for additional road right of way.
b. Future building and other setbacks required by the Spokane Couoty Zoning
Code shall be mea.sured from the reserved future aequisition area.
c. No required landscaping, parking, '248' areas, drainfield or allowed signs
should be located within the future acquisition area for road right-of-way and
utilities. If any of the above improvements are made within this area, they shall
be relocated at the applicant's expense when roadway improvements are made.
d. The future acquisition area, until acquired, shalt be private property and may be
used as allowed in the zone, except that any impravements (such as
landscaping, parking, surface dXainage, drainfield, sigrs or others) shaU be
cansidered interim uses.
e. The property awner shall be nesponsible for relocating such "interiin"
improvements at the time Spokane County niakes roadway improvements after
acquiring caid future acquisition area.
10. A plan for water facilities adequate for domestic service and fue protection shall be
approved by the water purveyor, appropriate fire protection district, County Division of
Buiidings and County Health District. 1'he agencies will certify on the 1~Vater Plan,
prior to the f ling nf a final plat, that the plan is in conformanre with their respective
needs and regulations. 1'he Water Plan and certification shall be drafted on a
transparencv suitable for reproduction and be signed by the plat sponsor.
11. The water purveyor shall certify that appropriate cantraccual arrangements and schedule
of improvenients have been made with the plat Spoator for construction of the water
system in accordance with the approved Water Plan. The time schedule shal] provide
for completion of the water system and inspection by the appropriate health authorities
prior to application for building permits wathin the finai plat. The arrangemenLs or
agreements shall include aprovision holding Spokane County and the purveyor
harm.tess from claims by any lot purchaser refused a building permit due to the failure
of the subdivision sponsor ta satisfactorily complete the approved water system.
12. The linal plat dcdieation shall contain the following statement:
"The public water system, pursuant to the Water Plan approved by counry and state
health authorities, the local fire protection district, water purveyor and Spodane County
Division of BuilcJings, shall be installed within this subdivision, and the applicant Shall
provide for individual domestic water service as well as fire protectian to each [tracVlot]
prior ro sale of each [tracVlot] and prior to issuance af a building permit for each
[tracVlot]."
13. No building permit will be issued for any lot within the final plat until cerciiied by a
Washington state-licensed engineer that "the water system has heen installed pursuant
to the approved Water Plan foi• the final plat" including a signed license stamp. The
certification may be in the form of a letter, but is preferred to be certified on a copy of
the Water Plan a.s a schematic map shawing the "as-consenicted" water system.
14. The Water Plan and the above four (4) rooditions of approval regarding the Water Plan
may be waived by the Planning Director/designee upon receipt of lecters from che
appropriate water purveyor and fire protection district stating that simple connections co
an existing, approved water system will provide adequate domestic and fire proteetion
water to ensure the public health, safery and general welfare.

15. The applicant shall contacc the Division of Building and Planning at the earliest possible
stage in order to be informed of code requirements administereci/enforced a.s authorized
by the State Building Code Act. Design/development coACerns include: ADDRESSING,
FIRE APPARATUS ACCESS ROADS; FIRE HYDRANT/FLOW; APPROVED WATER
SYSTEMS; BUILDING ACCESSIBILIT'Y; CONSTRUCT[ON TYPE; OCCUPANCY
CLASSiFICATION; EXITING; EXTCRIOR WALL PRO'I'ECT10N; A1vD ENERGY CODE
REGULAT[ONS. (Note: The Division of Building and Flanning reserves the right to
confirm the actual address at the time of building permit.)
COUNTY DIVISION OF ENGINEERING AND ROADS CONDITIOIV'S
l. That conditional approval of the plat by the County Engineer is given subject to
dedication of right of way and approval of the road system as indicated in the
preliminary plat of record.
2. That drainage plans and design calculations showing the alignment of drainage
facilities be submitted to the County Engineer for acceptance prior to construcCion
and/or the filing of the final plat. Drainage plans to be prepared under the direction of
a licensed Professianal Civil Engineer.
3. That the regulations of the National Flood Insurance Program be observed since the
proposed plat i.s affected by a Flood Hazard Zone. A developinent permic shall be
obtained from the County Engineer before construction or development begins within
any area of sgecial flood hazard (reference Spokane County Ordinance 88-0521
That the following staEement shall appear within the dedicatory language of the plat:
"Development within this subdivision shall confoctn to the requiremenLs of the
National Flood Insurance Probram and Chapter 3.24 of the Spokane County Code.
Purchasers of the property within this subdivision are warned of possible flooding or
ponding and the potential requiremeat to purchase Flood Insurance. This warning
shall be carried in each and every deed dravvn to transfer ownership of any and all
propeity within the plat in lhe area of Special Flood Hazard."
This condition is applicable to driveway approaches, driveways and private roads
constructed on the site for access.
4. No construction work is to be performed within the existing or proposed Public Right-
of-Way until a pennit has been issued by the County Engineer. All work is subject to
inspection arid approval by the County Engineer.
5. The applicant should be advised chal individual driveway access permits are reguired
prior to issuance nf a building permit for driveway approaches to the County road
system.
6. Dedication of 1.75 feet of additional right of way along South River Way.

resolution which purposes is the formation of a Road Irnprovement District (RID) for
said improvements pursuant to RCW 36.88, as amended. At such time as an RID is
created or any Road Improvement Projecc is sanctioned by Spokane Caunty, the
improvemenL% required (curb, sidewatk, drainage control and paving to existing
pavement) will be at the sole expense of the undersigned owner, tlzeir heirs, grantees
and assigns. This provision is applicable to South River Way.
10. As an alternaUve rnethod of constructing the road improvement stated herein, the
applieant may, with the approval of the County Engineer, accomplish the road
improvements stated herein by joining and participating in a County Roacl Project
(CRP) to the extent of the required road improvement. At such time as an RID is
created or any Road Improvement Project is sanctioned by Spokane County, the

and assigns. This prnvision is applicable to South River Way.
11. That the following statement shall apPear within the dedicatory language of the final
plat:
That in consideration of Mutual Benefits now or to be hereafter derived, do for
themselves, their heirs, grantees, assigns and successar (s) in interest hereby request
and authorize Spakane County to include the above described property in a Road
Improvement District (RID) and to support the formation of a Road Improvement
District for improvement of the road(s) described below by reguesting and authorizing
Spokane County to place their name(s) on a petition for the formation of a Road
Improvement District pursuant to RCW 36.88.050, or by requesting and authorizing
Spokane County to cast their ballot in favor of a RID beinb formed under the
resolution method pursuant to RCW 36.88.030, ancUor by nat filing a protest against
the formation of a RID being formed under the 1lternative rescalution method provided
for in RCW 36.88.065and Chapter 35.43 RCW.
If a RID is proposed far improvement of the road(s) described below, said owner(s)
and successor(s) further agree: (1) that the improvements or construction contemplated
wichin the proposed RID are feasible, (2) that the benefits to be derived from the
formation of the RID by the property includcd therein, together w ith the amount of anx
Caunty participation, exceeds the cost and expense of formation of the RID, and (3)
thac the property within the proposed RID is sufficiently dzvcloped; provided,
themselves, their heirs, grantees, assigns and successor(s) sball reca.in the right, as

vary from assessment estimate so long a.s they do not exceed a figure equal ro the

It is filrther acknowledeed and agreed that at such time as a RID is created or any
County Road tmprovement project is authorized by Spokane County, the
improvements required shall be at the sole expense of the owner(s) of propertv within
the RID or served by the improvements without any monetary participation by
Spokane County.
The RID waiver eontained in this agrzement shall expire after ten (10) yeai-s from the
date of execution belaw. This pi•ovision is applicable to Soutli Ri4er Way.
12. The County Engineer has designated LocaJ Access Roadway Section for the
improvement of South River Way which is adjacent to the proposed development.
This wiil require the addition of approximately 6-8 feet of asphalt along the frontage of
the development. The construction of curbing ~ancl sidewalk is alsc~ required.
13. The proposed plat shall be improved to the standards set forth in Spokane Gounty
Board af Cmmniissionerr Resolutian Nn. 95-0498, as amendcd, which retinlution
establishes regulalions far rnads, approaches, drainage and fees in new construction.
14. The Couoty Engineer ha.s examined this development proposal and has determined thac
the irnpact of this prapUSal upon the exititing Caunty Road System warrants the
dedication of additianal right of way and the roadway improvements herein specified.
15. The applicant should be advised tbat there may exiSt utilities either underground ar
overhead affecting the applicant's property, including property to be dedicated or set
aside future acquisition. Spokane County will atisume no financial obligation for
adjustments or relocation regarding these utiliCies. The applicant should check with the
applicable utilicies and Spokane Gounty Engineer ta decermioe whether the applicant or
utility is responsible fnr adjustment ar relocatian costs and to make arrangementti for
any necessary work.
16. The applicant shall grant applicable border easements adjacent to Spokane County

CQUNTY HEALTH DISTRICT CONDITIONS
1. The final plat shall be designed as indicated on the preliminary plat of record and/or any
attached sheets as nated.
2. Appropriate utility easements shall be indicated on copies of the preliminary plat of
record for distribution by the Planning Department to the utility companies, Spokane
Counry Engineers and the Spokane County Health District. Written approval of the
easemeam by the utility companies must be received Prior to the submittal of the final
plat.
3. Sewage disposal meihod shall be a.s authorized by the Director af Utilities, Spokane
County.
4. Water service shall be coordinated through the Director of Utilities, Spokane County.
5. Water service shall be by an existing public water supply when approved by the
Regional engineer (Spokane), Statc Department of Health.
6. Prior to filing the final plat, the spansor shall demonstrate to the Satisfaction of the
Spokane Counry Health District that an adequate and potable water supply is available
to each tract of the plat.
7. Priar to filing the final plat, the sponsor shall present evidence that the plat lies within
the recorded service ai•ea of the water system propased to serve the plat.
8. Pc•ior to filing the final plat, the sponsor shall demonstrate to the satisfaction of the
Spokane County Health District that a suitable site for an on-site sewage dispasal
system is available on Tract B.
9. Prior to filing the final plat, the sponsor shall demonstrate to the satisfaction of the
Spokane County Health District that the existing system serving the residence located
on Traet A is wholly located within the boundaries af the tract.
10. Subject to speciFc application approval and issuance of permits by the Health Officerr,
cthe use of individual on-site sewage disposal syscems may be authorized.
11. The dedicatory language af the plat will state: "Suhject to specific application approval
dnd issuance of permits by the Health Officer, the use of individual on-site sewage
disposal svstems may be luthorized."
12. The dedicatory language on the plat shall state: "LJse of private wells and water
systems is prohibiced."
13. 'I'he plat dedication shall contain a statement to the effect that: "The public water
system, pursuant to the Water Plao approved by county and state health authorities, the
local firz protection district, County Building and Safery Deplrtment and water
purveyor, shall be installed within this plat, and the applicant shall provide for
individual domestic water service as well as fire protection to each tract prior to sale of
each tract and prior lo issuance of a building permit For eaeh tract."
COUNTY DIVISION nF UTILITIES CONDITIONS
1. Pursuant to the Board nf County Comnussioners Resolution No. $0-0415, the use
of on-site sewer disposal system is hereby authorized. This autharization is
conditioned in compliance with all rules and regulations of the Spakane County
Health Disuict and is further conditioned and subject to specific applicatipn
apProval and insurance of permits by the Health District.
2. The dedication shall state:
The Owaer(s) or Successor(s) in iitterest agree to authorize the County to place their
name(s) on a petition for the formation of a ULiD by petition method pursuant to
RCW 36.94 which the petition includes the Owner(s) property and further not to
object by signing of a protest petition against the formation of a LTLID by resolution
method nursuant to RCW 36.94 which includes the Owner(s) property.
PROVIDED, this condition shall not prohibit the Owner(s) or Successor(s) from
objection to any assessment(s) an the praperty as a result of impravements called

3. Each new unit shall be double plumbed for connection to future area-wide collection

6 No construction wark is to be performed within the existing or
proposed Fublic right-of-way until a permit has been issued by the
County Engineer. All work is subject to inspection and approval by
the County Engineer.
12 The applicant should be advised that individual driveway access
permits are required prior to issuance of a building permit for
driveway approaches to the County road system.
13 Dedication of 1.75 feet of additional right-of-way along South River
Way.
16 Existing County roads providing direct access to the plat shall be
paved and/or curbed to Spokane County standards.

successor(s) shall retain the right, as autharized under RCW
36.88.090, to obj ect to any assessment ( s) on the property as a result
of the imnrovements called for in conjunction with the formation of a
RID by either the petition or resolution method under Chapter 36.88
RCW and to appeal to the Superior Court the decision of the Board of
County Commissioners confirming the final assessment roll; provided
further, it is recognized that actual assessments may var-f from
assessment estimate so long as they do not exceed a figure equal to
the increased true and fair value improvement(s) add(s) to the
property.
It is further acknowledged and agreed that at such time as a RID is
created or any County Road Improvement project is authorized by
Spokane County, the improvements ::equired shall be at the sole expense
of the owner(s) of property within the RID or served by the
improvements without any monetary participation by Spokane County.
The RID waiver contained in this agreement shall expire after ten
(10) years from the date of execution below. This provision is
applicable to South River Way.
24 The County Engineer has designated a Local Access Roadway Section for
the improvement of South River Way which is adj acent to the proposed
development. This will require the addition of approximately 6-8 feet
of asphalt along the frontage of the development. The construction of
curbing and sidewalk is also required.
32 The proposed plat shall be improved to the standards set forth in
Spokane County Board of Commissioners Resolution No. 95-0498, as
amended, which establishes regulations for roads, approaches, drainage
and fees in new construction.
