TI-IIS MATTER, an applicadon for subdivision of land from Timothy and Kathleen Scribner
has been r+eceived and decided upon, pursuant to Spokane County Subdivision reguladons, on
theaol"''day of August, 1996.
FINDINCS OF FACT AND CONCLUSIONS '
1. The individual signing below has further been properly delegated the responsibility for
rendering the decision by the Spokane County Director of Building und Planning.
2. The proposal is to divide approximately 31,050 sq. ft. (.71 acres) into 2tracts for 1
exisdng single family residence and 1 new addidonal r+esidenrial tract and those uses
permitted in the Urban Residential-3.5 (UR-3.5) zone.
3. The proposal is located adjacent and between Boone Avenue and Desmet Avenue and
approximately 500 feet east of Greenacres Road in the NE 1/4 of Section 18, Township
25 North, Range 45 E.W.M. Spokane County, Washington.
4. The exisdng zoning of the prope»y described in the applicadon is Urban Residential-
3.5 (UR-3.5), previously established as Agricultural (A) (file # 225-57) zoning in 1957
and redesignated to UR-3.5 on January 1, 1991, pursuant to the Pr+ogram to Implement
the Spokane County Zoning Code. Pursuant to RCW 58.17.195 the proPcasal daes
conform to the requirements of the existing UR-3.5 zone.
5. The Spokane County Comprehensive Plan designates this area as Urban. The
development and uses, as proposed and condiuoned, are in compliance with this
category.
6. Surrounding uses are primarily single family residences.
7. The Spokane County Arterial Road Plan idencifies Boone Avenue as a Local Access
Road with a future right of way width of bQ feet The existing right of way is 40 feet
double width (20 feet on both sides) divided by a 40 foot vacated railroad right of way,
which is available as addidonal County right of way. In addition, the Spokane County
Arterial Road Plan identifies Desmet Avenue as a Local Access Road with a future right
of way width of 60 feet. The existing right of way width is 40 feet. In order to
implement the Arterial Road Plan, a sorip of property 10 feet in width along the Desmet
Avenue frontage is to be set aside as a Future Acquisition Area. Therefore, as
conditioned (such as improverrients and acquisition azeas) the proposal conforms to the
Road Plan.
8. The site is located within the Public Transportadon Benefit Area (PTBA). The Spokane
Transit Authority (STA) East Sprague, Route 9 provides connecting services to the site.
9. The proposed short plat will be served by a public water system. Waste water disposal
will be as authorized by the Director of Udlities.
10. The required public nodce was provided for this proposal and agencies having a
potential inter+est in the project were nodfied and recommendarions solicited.
11. No written comments were received from any adjoining property owners.
12. Recognizing the recommended condidons and Spokane County development standards,
the proposed short plat makes apnropriate provisions for the public health, safety and
general welfare and that the public use and interest will be served by platting the
subdivision.
The subdivision proposal is generally consistent with RCW 58.17 and the County
subdivision regulations, promodng the public health, safery and general welfare in
accordance with standards established by the state and Spokane County. The Building
and Planning Division has considered the provision of adequate public facilities as cited
in RCW 58.17.110 (2). More specifically:
a. open spaces f. sanitary waste disposal
b. drainage ways g. paxks and recneation facilities
c. public and/or private rights-of-way h. playgrounds
d. trransit i. schools and schoolgrounds
e. potable water j. sidewalks
13. The project is exempt from environmental review under the State Environmental Policy
Act pursuant to WAC 197-11-800 (6) (a).
14. The Cenhral Valley School District has commented on the proposed Short Plat. The
District has indicated that exisdng school facilides are inadequate to serve the proposed
short plat and wishes to negodate with the owner to provide adequate capital facilides as
required by the Revised Code of Washington (RCW) 58.17.110. Review by County
legal counsel indicates the condition requested by the School District can be required for
developments. Approval of this short plat should iaclude conditions requiring that
pnovisions for appropriate facilities be in place prior to recording the final short plat in
the form of a written agreement between the owner and the school district.
DECISIQN
Based upon the above noted Findings of Fact and Conclusions, Short Plat Application SP-
1086-96 is hereby APPROVED for five (5) years, specifically to September 1, 2001 and
subject to Gondiaons noted below. This decision is final untess appealed in writing, consistent
with adopted appeal procedures. All the below conditions imposed shall be binding on the
"Applicant", which ternn shall include the owner or owners of the property, heirs, assigns and
successors.
COUNTY DIVISION OF BUILDING AND PLANNING CONDITIONS
1. The proposal shall comply with the Urban Residential-3.5 (UR-3.5) zone, as amended.
2. The final plat shall be designed substandally in conformance with the preliminary plat
of record. No increase of density or number of tracts shall occur without a change of
condition application submittal and approval.
3. The Building and Planning Director/designee shall review any proposed final plat to
ensure compliance with these Findings and Conditions of Approval.
4. The preliminary plat is given conditional approval for five (5) years, specifically to
September 1, 2001. The applicant may submit an extension of time application
approximately forty-five (45) days prior to the above expiradon date. Application(s)
for extension of dme shall be processed under the provisions of Section G of Chapter
III of the Spakane County Subdivision Ordinance. If the applicant complies with the
criteria of Section G, the pr►eliminary appmval and conditions will be changed to reflect
the adopted policy and development regulations at the cime of the extension applicadon.
5. Three (3) current certificates of title shall be furnished to the Building and Plenning
Division prior to filing the final plat.
6. Appropriate utility easements shall be indicated on copies of the proposed final plat. ~
Written appmval of udlity easements by appropriate utiliry companies shall be received
with the submittal of the final plat.
7. Prior to filing of finai plat, the appropriate road name(s) and street address(es) shall be
indicated.
8. The final plat map shall indicate by a clear, dashed line the required yard setbacks from
aU private, "Tract X" or public roads. The dedication shall contain the following
statement:
"Side yard and rear yard setbacks shall be determined at the time building permits ane
requested unless these setbacks are specifically drafted on this final plat. The setbacks
indicated on this plat may be varied from if proper zoning approvals are obtained."

9. The Spokane Counry Division of Building and Planning shall prepare and record with
the County Auditor a Tide Notice specifying a future land acquisition area for road
right-of-way and utilities. The reserved future acquisition area Title Notice shall be
I released, in full or in part, by the Building and Planning Division. The notice should
be recorded the same time as the final piat and shall provide the foUowing:
a. A strip of property 10 feet in width from the existing right of way is reserved
for future acquisieon area for addidonal road right-of-way along Desmet
Avenue
b. Future building and other setbacks required by the Spokane County Zoning
Code shall be measur+ed from the reserved future acquisidon area.
c. No required landscaping, parlcing, '2U8' areas, dminfield or allowed signs
should be located within the future acquisidon area for road right-of-way and
udliaes. If Any of the above improvements are made within this area, they shall
be relocated at the applicant's expense when roadway improvements are made.
d. The future acquisition area, until acquired, shall be private property and may be
used as allowed in the zone, except that any improvements (such as
landscaping, parlcing, surface drainage, drainfield, signs or others) shall be
considered interim uses.
e. The property owner shall be responsible for relocating such "interim"
improvements at the time Spokane County makes roadway improvements after
acquiring said future acquisidon azea.
10. No water plan is required, only a simple connection will be needed prior to the sale of
each tract and prior to issuance of a buiiding permit for each tract.
11. The owner shall negotiAte with Centrnl Valley School District and submit a necorded
copy of a voluntary agreement making provisions for public schoots prior to
finalization and recording of the plat. The agreement shall provide a written descrippon
of the subject property to which the agreement applies and also state the dollar amount
and any other agreed to mitigating measures.
The owner shall also notify any potentiai purchasers who have made an agrrement to
purchase properry within said plat pursuant to the Revised Code of Washington (RCV)
58.17.205, that adequate provisions for school facilities must be made conditioned on a
future agrcement between the plattor and school district.
Voluntary agreements between the owner and school district shall canform to the
requirements of RCW Chapter 82.02.
12. A survey is required prior to the filing of a final plat.
13. The applicant shall contact the Division of Building and Planning at the earliest possible
stage in order to be informed of code requirements adnunister+erd/enforced as authorized
by the State Building Code Act. Design/development concerns include:
ADDRESSING, FIRE APPARATUS ACCESS ROADS; FIRE HYDRANT/FLOW;
APPROVED WATER SYSTEMS; BUILDING ACCESSIBILITY; CONSTRUCTION
TYPE; OCCUPANCY CLASSIFICATION; EXITING; E;XTERIOR WALL
PROTECfION; AND ENERGY CODE REGULATIONS. (Note: The Division of
Building and Planning reserves the right to confinn the actual address at the time of
building permit.)
COUNTY DIVISIAN QF ENGINCERING AND RUADS CONDITIONS
1. The conditional approval of the plat is given by the County Engineer subject to Approval of
the ruad system as indicated in the preliminary plat of record.
2. No construction work is to be performed within the existing or proposed public right-of-
way undl a permit has been issued by the County Engineer. All work is subject to
inspecdon and approval by the County Engineer. 3. Individual driveway access permits are re9uired prior to issuance of a building peRnit for
driveway approaches to the County Road System.

4. Exisdng County roads providing direct access to the plat shall be paved and/or curbed to
Spokane County standards.
5. To construct the road improvements stated berein, the applicant may, with the approval of
the County Engineer, join in and be a wiUing participant ia any petition or resolution which
purpose is the formation of a Road Improvement District (RID) for said improvements,
pursuant to RCW 36.88, as amended. At such ame as an RID is created ar any Road
Improvement Project is sanctioned by Spokane County, the improvements requined (curb,
sidewalk, drainage control and paving to existing pavement) will be at the sole expense of
the undersigned owner(s), their heirs, grantees and assigns. This provision is applicable to
Boone Avenue and Desmet Avenue.
6. As an alternaave method of constructing the road improvements stated herein, the applicant
mAy, with the approval of the County Engineer, accomplish the road improvements stated
herein by joining and participadng in a Couaty Road Project (CRP) to the extent of the
required rioad improvements. At such time as an RID is created or any Road Improvement
Project is sancdoned by Spokane County, the improvements required (curb, sidewalk,
drainage control and paving to existing pavement) will be at the sole expense of the
undersigned owner(s), their heirs, grantees and assigns. This provision is applicable to
Boone Avenue and Desmet Avenue.
7. The following statement shall be placed in the plAt dedication:
In considffadon of Mutual Benefits now or to be hereAfter derived, do for themselves, their
heirs, grantees, assigns and successor(s) in interest hereby request and authorize Spokane
County to include the above described properry in a Road Improvement District (RID) and
to support the formadon of a RID for improvement of the road(s) described below by
requesting and authorizing Spokane County to place their name(s) on a peddon for the
formadon of a RID pursuant to RCW 36.88.050, or by requesting and authorizing
Spokane County to cast iheir ballot in favor of a RID being formed under the r+esoludon
method pursuant to RCW 36.88.030, and/or by not filing a protest against the formation of
' a RID being fornzed under the alternadve resolution method provided for in RCW
36.88.065 and Chapter 35.43 RCW.
If a RID is proposed for improvement of the road(s) described below, said owner(s)
and successor(s) further agree: (1) that the improvements or construcaon
contemplated within the proposed RID are feasible and (2) that the benefits to be
derived from the fonnadon of the RID by the property included therein, together with
the amount of any County participation, exceeds the cost and expense of formadon of
the RID, and (3) that the property within the proposed RID is sufficiently developed;
prAVided, themselves, their heirs, grantees, assigns and successor(s) shall retain the
right, as authorized under RCW 36.88.090, to object to any assessment(s) on the
property as a result of the improvements called for in conjunction with the formation
of a RID by either the petidon or resolution method under Chapter 36.88 RCW and to
appeal to the Superior Court the decision of the Board of County Commissioners
confirming the final assessment roll; provided further, it is recognized that actual
assessments may vary from assessment estimate so long as they do not exceed a
figure equal to the increased true and fair value improvement(s) add(s) to thc
property.
It is further acknowledged and agreed that at such time as a RID is cneated or any
County Road Improvement project is authorized by Spokane County, the
improvements required shall be at the sole expense of the owner(s) af property within
the RID or served by the improvements without any monetary participation by
Spokane County.
The RID waiver contained in this agreement shall expire after ten (10) years from the
date of execution below. This provision is applicable to Boone Avenue and Desmet
Avenue.
8. The County Engineer has designateri Local Access Roadway Sechon for the improvement
of Boone Avenue, which is adjacent to the proposed development. This will require the
addition of varying amounts of asphalt alang the fiontage of the development. The
construcdon of curbing and sidewalk is also nequired. ,

9. 1'he County Engineer has designated Local Access Roadway Section for the improvement
of Desmet Avenue, which is adjacent to the proposed development. This will require the
addition of appcoximately 27 feet of asphalt along the frontage of the development. The
construction of curbing and sidewalk is also required.

10. The proposed plat shall be improved to the standards set forth in Spokane County Board of
Commissioners Resolution No. 95-0498, as amended, which resoludon establishes
regulations for roads, approaches, drainage and fees in new construcdon.
11. The County Engineer has examined t6is development proposal and has determined that the
impact of this proposal upon the existing Countyroad system warrants the roadway
improvements herein specified.
12. The applicant shall grant applicable border easements adjacent to Spokane County Right of
Way per Spokane County Standards.
COUNTY DIVISION OF UTILITIES CONDITI4NS
1. Pursuant to the Board of County Commissioners Resolution No. 80-0418, the use of
on-site sewer disposal systems is hereby authorized. This authorization is conditioned
in compliance with all rules and regulations of the Spokane County Health District and
is further conditioned and subject to specific application approval and issuance of
permits by the Health District.
2. The following sratement shall be placed in the plat dedication:
"T'he owner(s) or successor(s) in interest agree to authorize the County to place their
name(s) on a petition for the formation of ULID by petition method pursuant to RCW
36.94, which petition includes the owner(s)' property; and further not to object by the
signing of a protest petition against the fomnation of a ULID by resolution method
pursuant to RCW Chapter 36.94 which includes the owner(s)' property. PROVIDED,
this condition shall not prohibit the owner(s) or successor(s) from objecting to any
assessment(s) on the pnoperty as a result of improvements called for in conjuncaon
with the formaaon of a ULID by either petition or resoludon under RCW Chapter
36.94."
3. The dedicAtory language on the plat shall state: "Each new unit shall be double-
plumbed for connection to future area-wide collecdon systems."
4. Any water service for this pro,ject shall be provided in acxordance with the Coordinated
Water System Plan for Spokane County, as amended.
COUNTY HEALTH DTSTRICT CONDITIONS
1. The final plat shall be designed as indicated on the preliminary plat of record and/or any
attached sheets as noted.
2. Appr+opriate utiliry easements shall be indicated on copies of the preliminary plat of
record for distribudon by the Building and Planning Division to the udliry companies,
Spokane County Engineer and the Spokane County Health District. Written approval
of the easements by the utility companies must be received prior to the submittal of the
final plat.
3. Sewage disposal method shall be as authorized by the Director of the Spokane Counry
Division of Utilities.
4. Water service shail be coordinated through the Spokane County Division of Udliaes.
5. Water service shall be by an existing public wuter supply when approved by the
Regional Engineer (Spokane), State Department of Health.
6. Prior to filing the final plat, the sponsor shall demonstrate to the sadsfaction of the
Spokane County Health District that an adequate and potable water supply is available
to each tract of the plat.
7. Prior to filing the final plat, the sponsor shall present evidence that the plat lies within the recorded service area of the water system proposed to serve the plat.
8. Prior to filing the final plat, the sponsor shall demonstrate to the saasfaction of the
Spokane County Health District that suitable sites for on-site sewage disposal systems
are available on Lot 2.

9. Prior to filing the final plat, the sponsor shall demonstrate to the satisfacdon of the
Spokane County Health Distcict that the exisdng on-site sewage disposal system
serving the residence located on Lot 1 is wholly located within the boundaries of the
lot.
10. Subject to specific applicaeon approva1 and issuance of permits by the Health Officer,
the use of individual on-site sewage disposal systems may be suthorized.
11. The dedicatory language of the plat will state: "Subject to specific application approval
and issuance of pemuts by the Health Officer, the use of individual on-site sewage
systems may be authorized."
12. The dedicatory language on the plat shall state: "Use of private wells and water
systems is prohibited."
13. The plat dedication shall contain a statement to the effect that: "The public water system
shall be installed within this plat, and the applicant shail provide for individual domestic
water service as well as fire protection to each tract prior to sale of each tract and prior
to issuance of a building permit for each tract."

1. Prior to filing of the final plat, the Spokane Valley Fire Department will require the

participation, exceeds the cost and expense of formation of the RID,
. and (3) that the property within the proposed RID is aufficiently
developed; provided, themselves, their heirs, grantees, assigns and
successor(s) shall retain the right, as authorized under RCW
36.88.090, to object to any assessment (s) on the property as a reeult
of the improvements called for in conjunction with the formation of a
RID by either the petition or resolution method under Chapter 36.88
RCW and to appeal to the Superior Court the decision of the Board of
County Commissioners confirming the final assessment roll; provided
further, it is recognized that actual assessments may vary from
assessment estimate so long as they do not exceed a figure equal to
the increased true and fair value improvement(s) add(s) to the
property.
It is further acknowledged and agreed that at such time as a RID is
created or any County Road Improvement project is authorized by
Spokane County, the improvements required shall be at the sole expense
of the owner(s) of property within the RID or served by the
improvements without any monetary participation by Spokane County.
The RID waiver contained in this agreement shall expire after ten
(10) year3 from the date of execution below. This provision is
applicable to Boone Avenue and Desmet Avenue.
24 The County Engineer has designated a Local Access Roadway Section for
the improvement of Boone Avenue which is adjacent to the proposed
development. This will require the addition of varying amounts of
asphalt along the frontage of the development. The construction of
curbing and sidewalk is also required.

development. This will require the addition of approximately 27 feet
' of asphalt along the frontage of the development. The construction of
curbing and sidewalk is also required.
32 The proposed plat shall be improved to the standards set forth in
Spokane County Board of Commissioners Resolution No. 95-0498, as
amended, which establishes regulations for roads, approaches, drainage
and fees in new conatruction.
33 The County Engineer has examined this development proposal and has
determined that the impact of this proposal upon the existing County
Road System warrants the dedication of additional Right of Way and the
roadway improvements herein specified.
SPECIAL CONDITION: The applicant shall grant applicable border easements
adjacent to Spokane County Right of Way per Spokane County Standards.
