That the inclividuals and parties natned herein as having an intecesl in the above described praperty or prvject agree
to the following:
l. Reimburse Spakane Caunty for project review and in,spection fees as speeified in Chapter 9.14 of
ttic Spokane County Code. The fees will be based nn actual salary cUSts incurred by Spokalle
County for project reviews and / or inspections plus a ten percent administrative charge, and will
be billed montlily as accrued. Any billing amounts due, including any expenses incurred in tlle
collection of an overdue account, must be paid prior to the Caunty's acceptance af the project for
filing. If a project is appravetl and/or filecl witli a batance still owing, the unpaid balance shall be
paid within 30 days of the invnice date.
2. The uiidersigned dgrees lhat these fees are due and payable upon receipt of tlie billing as specifierl
above.
3. Any invoices not paid within 30 days of tlie invoice date will be considered delinqueiit. If any
outstanding balance nn the accaunt for this project is not paid within 30 days of 1he invoice date,
no further reviews of the project documents will be conduc;ced until lhe entire account balance is
paid. Any balance on the account for this project not paid within GS days of the invoice date may
result in legal aclion or the initiatinn of odier callectian procedures, including referral ta a
collection ageney. 1'lie Sponsor will be liable for any and all expeoses incucred by the Cotanty for
the collection of overdue accounts.

SHORT PLAT NO. SP-1087-96 ) CONCLUSIONS AND
DECISION
THIS MATTER, an application for subdivision of land from Vera Limited Partnership bas
been received and decided upon, pursuant to Spokane County Subdivision regulations, on the
~I"' day of August, 1996.
FINDINGS UF FACT AND CONCLUSIONS
1. The individual signing below has further been properly delegated the responsibiliry for
rendering the decision by the Spokane County Director of Building and Planning.
2. The proposal is to divide approximately 1.2 acres into 4 residenaal tracts and those uses
permitted in the Urban Residendal-22 (UR-22) zone.
3. The proposal is located north of and adjacent to 20th Avenue and approximately 100
feet east of Blake Road in the NE 1/4 of Secdon 27, Township 25 North, Range 44
E.W.M. Spokane Counry, Washington.
4. The existing zoning of the property described in the application is Urban Residenrial-22
(UR-22), previously established as Muldple Family Suburban (MFS) (file # ZE-228-
79) zoning in 1980 and redesignated to UR-22 on January 1, 1991, pursuant to the
Program to Implement the Spokane Counry Zoning Code. Pursuant to RCW
58.17.195 and the Spokane County Short Plat Ordinance, the proposal does not
conform to the requirements of the existing UR-22 zone. Presendy, the UR-22 zone
dces not allow duplexes. However, a propose amendment to the Spokane County
Zoning Code is pending, which if approved wiU permit the use of duplexes in the UR-
22 zone. Although, the applicant has indicated duplexes as a proposed use, this
decision is only approving the division of land and not any uses, which is determined
by the UR-22 zone, as amended.
5. The Spokane County Comprehensive Plan designates this area as Urban. The
development and uses, as pr+oposed and conditioned, are in compliance with this
category.
6. Surround.ing uses are primarily single and multifamily residences.
7. The Spokane County Arterial Road Plan icientifies 20th Avenue as a Local Access Road
with a future right of way width of 60 feet. The exisdng right of way width is 45 feet.
In order to implement the Arterial Road Plan, a strip of property 10 feet in width along
the 20th Avenue frontage is to be set aside as a Future Acquisition Area. Therefore, as
conditioned (such as improvements and acquisition areas) the proposal conforms to the
Road Plan.
8. The site is located within the Public Transportation Benefit Ar+ea (PTBA). The Spokane
Transit Authority (STA) VaUey / 24th Avenue Route 21 provides connecting services to
the site.
9. The proposed short plat will be served by a public water system. Waste water disposal
will be as autharized by the Director of Udlides.
10. The required public notice was provided for this proposal and agencies having a
potential incmst in the project were nodfied and recommendations solicited.
11. No written comments were received from any adjoining property owners.
12. Recognizing the recommended condiaons and Spokane County development standards,
the proposed short plat makes appropriate provisions for the public health, safety and
general welfare and that the public use and interest will be served by platting the
subd.ivision.
The subdivision proposal is generally consistent with RCW 58.17 and the County
subdivision regulations, promoang the public health, safety and general welfare in

accordance with standards established by the state and Spokane County. The Building
and Planning Division has considered the provision of adequate public facilities as cited
in RCW 58.17.110 (2). More specifically:
a. open spaces f. sanitary waste disposal
b. drainage ways g. parks and recreation faciliries
c. public and/orprivate rights-of-way h. playgrounds
d. rra.nsit i. schools and school grounds
e. potable water j. sidewalks
13. The project is exempt from environmental review under the State Environmental Policy
Act pursuant to WAC 197-11-800 (6) (a).
14. The Central Valley School District has commented on the proposed Short Plat. 1'he
District has indicated that exisdng school facilities are inadequate to serve the proposed
short plat and wishes to negotiate with the owner to provide adequate capital facilities as
required by the Revised Code of Washington (RCV) 58.17.110. Review by County
legal counsel indicates the condition requested by the School District can be required for
developrnents. Approval of this short plat should include condidons requiring that
provisions for appropriate facilities be in place prior to recording the final short plat in
the form of a written agreement between the owner and the school district.
DECISION
Based upon the above noted Findings of Fact and Conclusions, Short Plat Application SP-
1087-96 is hereby APPROVE D for five (5) years, specifically to September 1, 2001 and
subject to condiaons noted below. This decision is final unless appealed in writing, consistent
with adopted appeal procedures. Ali the below conditions imposed shall be binding on the
"ApplicaAt", which term shall include the owner or owners of the property, heirs, assigns and
successors.
COUNTY DIVISION AF BUILDING AND PLANNING CONDITIONS
1. The proposal shall comply with the UR-22 zone, as amended.
2. The final plat shall be designed substandally in conformance with the preliminary plat
of record. No increase of density or number of tracts shall occur without a change of
condition application submittal and approval.
3. The Building and Planning Direcctor/designee shaU review any proposed final plat to
ensure cocnpliance with these Findings and Conditions of Approval.
4. The preliminary plat is given conditional approval for five (5) years, specifically to
September 1, 2001. The applicant may submit an extension of dme applicarion
approximately forty-five (45) days prior to the above expiradon date. Application(s)
for extension of time shall be processed under the provisions of Secdon G of Chapter
III of the Spokane County Subdivision Ordinance. If the applicant Gomplies with the
criteria of Secaon G, the preliminary approval and conditions will be changed to r+eflect
the adopted policy and development reguladons at the dme of the extension application.
5. Three (3) current certificates of title shall be furnished to the Building and Planning
Division prior to filing the final plaG
6. Appropriate utility easements shall be indicated on copies of the pmpased final plat.
Written approval of uality easements by appropriate utility companies shall be received
with the submittal of tbe final plat.
7. Prior to filing of final plat, the appr+opriate road name(s) and street address(es) shall be
indicated.
8. The final plat map shall indicate by a clear, dashed line the required yard setbacks from
all private, "Tract X" or public roads. The dedicadon shall contain the following
statement:
"Side yard and rear yard setbacks shall be deternuned at the time building pernnits are
requested unless these setbacks are specifically drafted on this final plat. The setbacks
indicated on this plat may be varied from if proper zoning approvals are obtained."

the County Auditor a Tide Notice specifying a fijture land acquisition area for road
right-of-way and utilities. Tfie reserved future aoquisition arrea Title Notice shall be
released, in full or in part, by the Building and Planning Division. The notice should
be recorded the same time as the final plat and shall provide the following:
a. A strip of property 10 feet in width from the existing right of way is nesenred
for future acquisition area for additional road right-of-way along 20th Avenue.
b. Future building and other setbacks required by the Spokane County Zoning
Code shaU be measured from the reserved future acquisirion area.
c. No required landscaping, parking, '208' areas, drainfield or allowed signs
should be located within the futnne acquisition area for road right-of-way and
utilides. If any of the above improvements are made within this area, tbey shall
be relocated at the applicant's expense when roadway improvements are made.
d. The future acquisition area, until acquired, shall be private property and may be
used as allowed in the zone, except that any improvements (such as
landscaping, parking, surface drainage, drainfield, signs or others) shall be
considered interim uses.
e. The property owner shall be responsible for relocating such "interim"
improvements at the time Spokane County makes roadway improvements after
acquiring said future acquisirion area.
10. No water plan is required, only a simple connection will be needed prior to the sale of
each tract and prior to issuance of a building pemmit for each tract.
11. The owner shall negotiate with Cenval Valley School District and submit a recorded
copy of a voluntary agreement making provisions for public schools prior to
finalization and recording of the plat. The agreernent shall pnovide a written description
of the subject property to which the agreement applies and also state the dollar amount
and any other agreed to mitigating measures.
The owner shall also notify any potential purchasers who have made an agreement to
purchase property within said plat pursuant to the Revised Code of Washington (RCW)
58.17.205, that adequate provisions for school facilities must be made conditioned on a
future agreement between the plattor and school district.
Voiuntary agraements between the owner and school district shall confonn to the
requirements of RCW Chapter 82.02.
