I received the above referenced project concept drainage plan on Nov. 5, 1997.
The concept drainage plan does not define the upstream drainage basins as required and only addresses
the new innpervious areas on the new lots. Please submit the plan to the Liberty Lake Sewer District for
review of the9r standards for concept approval and resubmit the plan addressing the guidelines for
concept drainage plans submittal to Spokane County. Approval from Liberty Lake of their standards is
necessary before Spokane County can conclude its review.
This praposal in technicaliy incomplete at this point in time.

be billecf mantitly as accrued. Any billing amounts due, including any expenses incurred in the

4. The existing zoning of the property described in the application is Urbasi R.esidential-3.5
(UR-3.5), which v+ras esta6lished in 1991. Fursuaat ta Revised Code of Washington
(RCW) 58.17.195, this proposal confvrms to the requirements of the existing [JR-3.5
zone.
5. fihe Spokane County Comprehensive Plan designates this area as Urban. The
development and uses, as proposed an,d conditioned, are in compliance with the Urban
eategory.
6. Surraunding uses are pri.marily singIe family residences an mixed urbaa size lots.
7. 1'he Spakane Cauaty Arlerial Raad Plan identifies Sinto Avenue and Boone Avenrue as a
Lacal Access Roads with a future right-of way width of 60 feet. The existing right-of-
way widthh is 50 feet and 40 feet respectively. In order ta implement the Arterial Road
Plan, a sfirip of prvperty 5 feet i.n width along the Sinto Avenue frontage and a strip of
property 10 feet along #he Baane Avenue firontage is to be set aside as aFuture
Acquisition .Area. Therefore, as canditiQned (such as impravements and acquisitian
areas) the progosal co,nforms to the Road Flan.
S. The praposed site is Iocated within the Public Transpartation Benefit Area (PTBA). The
Spokane Transit Authonty (STA) ValIey ! Trentwoad Rou#e 20 provides conneciing
services to the site.
9. The propased shor# plat w7i11 be served by a public water system. VVaste water tiisposai
will be as aufihorized by the Director of Spokane County Division of Utilities.
10. The required public notice was provided for thig praposa] and agencies having a patential
interest in the project were notified and recammendations solicited.
11. Written comments were rcceived from an adjaini.~g property owner who is concerned
about access to the praFosed short plat.
12. In response ta the above comments, the Caturty Engineer has Gonditioned this proposal to
ensure adeyuate and proper access is pr+ouided to each proposed tract.
13. Recagnizing the recommended conditions and Spokane County development standards,
the propased short plat makes appropriate pravisians far the public health, safety and
geaer$1 welfare and that the public use aad interest vvill be served by platting the
subdivision.
The subdivision pragosai is generally corisisient with RCW 58.17 and the County
subdivision regulativns, promoting the public health, safety and general welfare in
accordance with standards established by the State and Spokarie Caunt}►. The County

Division of Building and Planning has considered the provision of adequate public
facilities as cited in RCW 58.17.110 (2). More specifically:
a. open spaces f. sanitary waste disposal
b. drainage ways g. parks and recreation facilities
c. public and/or private right-of-ways h. playgrounds
d. transit i. schools and school grounds
e. potable water j. sidewalks
14. The project is exempt from environmental review under the State Environmental Policy
Act pursuant to WAC 197-11-800 (6) (a).
15. The Central Valley School District has commented on the proposed Short Plat. "I'he
District has indicated that existing school facilities are inadequate to serve the proposed
short plat and wishes to negotiate wifih the owner to provide adequate capital facilities as
reyuired by the Revised Code of Washington (RCW) 58.17.110. Review by County
legal counsel indicates the condition requested by the School District can be required far
developments. Approval of this short plat should include c:onditions requiring that
provisions for appropriate facilities be in place prior to recording the final short plat in the
form of a written agreement betvveen the ow►aer and the school district.
DECISION
Based upon the above noted Findings of Fact and Conclusions, Short Plat Application
SP-1135-97 is hereby APPROVED for five (5) years, specifieally to March 1, 2002 and subject
to conditions noted below. This decision is final unless appealed in writing, consistent with
adopted appeal procedures.
CONDITIONS OF APPROVAL
All the below conditions imposed shall be binding on the "Applicant," which term shall include
the owmer or owners of ihe property, heirs, assigns and successors.
SPOKANE COUNTY DIVISION OF BUILDING AND PLANNING
1. The praposal shall comply with the Urban Residential-3.5 (UR-3.5) zone and other
applicable Zoning Code chapters, as amended.
2. The final short plat shall be desigied substantiaUy in conformance with the preliminary
plat of record. No inerease of density or number of traets sball occur without a change of
condition application submittal and approval.
3. The preluninary short plat is giyen conditional approval for five (5) years, specifically to
March 1, 2002. The applicant may submit an extension of time application
approximately thirty (30) days prior to the above expiration date. Application(s) for
extension of time shall be processed under the provisions of Chapter 12.100.118
(Exteasion of Time) of the Spokane County Subdivision Ordinance. If the applicant
complies with the criteria of Chapter 12.100.118, the preliminary approval and conditions
will be changed to reflect the adopted policy and development regulations at the time of
the extensioa application.
4. Prior to filing the final short plat, the applicant shall submit to the County Division of
Building and Planning Directorldesignee for review any proposed final short plats to
ensure compliance with these Findings and Gonditions of Approval.
5. A survey is required of the subject property priar to filing the final short plat.
6. Appropriate road name(s) and street address(es) shall be indicated on the final short plat
map.
7. Appropriate utility easements shall be indicated on the final short plat map. Written
approval of utility easemenis by utility companies rnust be received prior to filing the
final short plat.
8. The final short plat map shall indicate by a dashed line the required setbacks from all
private or public roads.

9. The dedication shaIl contain the following statement:
"Side yard and rear yard setbacks shall be determ.i.ned at the time building permits
are requested unless these setbacks are specifically drafted on this final short plat.
The setbacks indicated on this subdivision may be varied from if proper zoning or
variance approvals are obtained."
10. Three (3) current Gertificates of Title shall be furnished to the County Division of
Bu.ilding and Planning prior to filing the final short plat.
11. The applicant shall contact the County Division of Building and Planning at the earliest
possible stage in order to be informed of code requirements administered/enforced as
authorized by the State Building Code Act. Design/development concerns include:
addressing, fire apparatus access roads, f re hydrant/flow, approved water systems,
building accessibility, construction type, occupancy classification, exiting, exterior wall
protection, and energy code regulations.
12. A plan for water facilities adequate for domestic service and fire protection shall be
approved by the water supplier, fire protection district, Spokane Gounty Division of
Building and Planning and County health authorities. The agencies will certify on the
Water Plan, prior to filing the final short plat or any phase of the preliminary short plat,
that the plan is in conformance with their respective needs and regulatians. The Water
Plan and ceriification will be drafted on a transparency suitable for reproduction and be
signed by the sponsor.
13. The purveyor will also certify on the Water Plan that appropriate cantractual
arrangements and schedule of improvements have been made vvith the sponsor for
construction of the water system in accordance with the approved Water Plan. The time
schedule for improvements will provide for completion of the water system and
inspection by the appropriate health authorities prior to application for building pennits
within the final short plat. The arrangements or agreements will include a provision
holdi.ng Spokane County and the purveyor hamiless from claims by any tract purchaser
refused a building pennit due to the failure nf the sponsor to satisfactorily coniplete the
approved water system.
14. The final short plat dedication will contain the following statement:
"The public water system, pursuant to the VI/ater Plan approved by County and
State Health authorities, the local fire district, County Division of Building and
Planning, and water purveyor, will be installed within this plat, and the applicant
vrrill provide for individual domestic water service as well as fire protectian to
each tract prior to sale of each iract and prior to issuance of a building permit for
each tract."
15. No building permit will be issued for any tract within the final short plat until certified by
a Washington State-licensed engineer that "the water system has been installed pursuant
to the approved Water Plan for the final short plat," signed and stamped by said engineer.
The certification inay be in the form of a letter, but is preferred to be certified on a copy
of the Water Plan as a schematic map showing the "as-built" water system.
16. The Water Plan and the above four (4) conditions of approval regarding the Water Plan
may be waived by the County Division of Building and Plan.aing Director/designee upon
receipt of letters from the appropriate water purveyor and fire protection district staling
that simple connections to an existing approved water system will provide adequate
domestie and fire protection vvater to ensure the public health, safety and general welfare.
17. The Spokane County Division of Build.ing and Planning sha11 prepare and record with the
County Auditor a Title Notice specifying a future land acquisiiion area for road right-of-
way and utilities. The reserved future a.cquisition area Title Notice shall be releaseda in
full or in part, by the County Division of Building and Planning. The notice should be
recarded the same time as the final short plat and shall provide the following:
a. A strip of property 5 feet fram the existing right-of-way is reserved for future
acquisiiion area for additional road right-of-way along Sinto Avenue.
b. A strip of property 10 feet from the existing right-of-way is reserved for future
acquisition area for additional road right-of way along Boone Avenue.

Voluntary agreernents between the ov+rner and schooI district shall con.form to #he
requirements of RCVV' Chapter 82.02.
SPUKANE COUNTY DIVISIQN OF ENGINEERING AND ROADS

improvements stated herein by joining and part.icipating in a County Rnad Project (CRP)
to the exteat of the required road improvement. At such time as a RID is created or any
Road Improvement Project is sanctioned by Spokane County, the improvements required
(curb, sidewalk, drainage control and paving to existing pavement) will be at the sole
expense of the undersigned owner, their heirs, grantees and assigns. This provision is
applicable to Sinto Avenue and Boone Avenue.
8. That the following statement shall appear within the dedicatary language of the final
shori plat:
"That in consideration of Mutual Benefits now or to be hereafter derived,, do for
themselves, their heirs, grantees, assigns and successor(s) i.n interest hereby
request and autborize Spokane County ta include the above described property in
a Road Improvement District (RID) and to support the formatiou of a Road
unprovement District for improvement of the road(s) described belaw by
requesting and authorizing Spokane County to place their name(s) on a petition
for the fonnation of a Road Improvement District pursuant to RCW 36.88.054, or
by requesting and authorizing Spokane County to cast their ballot in favor of a
RID being formed under the resolution method pursuant to RCW 36.88.030,

9. Z`he County Engineer has designated a Local Access Roadway Section for the
improvement of Sinto Avenue which is adjacent to the proposed development. This will
require the addition of approximately 38 feet of asphalt along the frontage of the
development. The construction of curbing and sidewalk is also required.
10. The County Engineer has desigaated a Local Access Roadway Section for the
improvement of Boone Avenue which is adjacent to the proposed development. This will
require the addition of approximately 5-7 feet of asphalt along the &ontage of the
development. The construction of curbing and sidewalk is also required.
11. The proposed plat shall be improved to the standards set forth in Spokaue County Board
of Commissioners Resolution No. 95-0498, as amended, which establishes regulations for
roads, approaches, drainage and fees in new construction.
12. Tbe Gounty Engineer has examined this development proposal and has determined that
the impact of this praposal upan the existing County Road System warrants the
dedicarion of additional right-of-way and the roadway improvements herein speciFed.

SPOKANE COUNTY DIVISION OF UTILITIES
1. Pursuant to the Board of Gounty Commissioners Resolution No. 80-0418, the use of on-
site sewer disposal systems is hereby authorized. This authorization is conditioned in
compliance with a11 rules and regulations of the Spokane Regional Health District and is
further conditioned and subject to specific application approval and issuance of pernuts
by the Health District.
2. The dedicatory language an the final short plat shall state:
"The owner(s) or successor(s) in interest agree to authorize the County to place
their name(s) on a petition for the formation of ULID by petition method pursuant
to RCW 36.94, which petition includes the awner(s)' groperty; and further not to
object by the signing of a protest petition against the formation of a ULID by
resolution method pursuant to RCW Ghapter 36.94 which includes the ovrnier(s)'
property. PROVIDED, this condition shall not prohibit the owner(s) or
successor(s) from objecting to any assessment(s) on the property as a result of

SPOKANE REGIONAL HEALTH DISTRICT
1. Sewage disposal method shall be as authorued by the Director of the Spokaae Countv
Division of Utilities.
2. Water service shall be coordinated through the Spokane County Division of Utilities.
3. Water service sha11 be by an existing public water supply when approved by the Regional
Engineer (Spokane), State Department of Health.
4. Prior to filing the final short plat, the sponsor shall demonstrate to the satisfaction of the
Spokane Regional Health District that an adequate and potable water supply is available
to each txact of the plat.
5. Prior to filing the final short plat, the sponsor shall present evidence that the plat lies
within the recorded service area of the water system proposed to serve the plat.
6. Prior to filing the final shorti plat, the sponsor shall demonstrate ta the satisfaction of the
Spokane Regional Health District that suitable sites for on-site sewage disposal systems
are available on Tract B.
7. Subject to specific application approval and issuance of permits by the Health Officer, the
use of individual on-site sewage disposal systems may be authorized.
