3. The proposal is located at dhe southeast corner of Flora Road and Euclid Avenue in the
NW'/. of Section 7, Tnwnship 25 North, Range 44 E.W.M., Spokane County,
Washington.
4. The existing zoning of the property is Heavy Industrial (I-3), originally established as
Agricultural (A) zoning in 1956, rezoned to Restricted Industrial in 1983 (ZE-56-83),
rezoned again to Manufacturing in 1985 (ZE-15-85), and redesignated to Hcavy
Indusirial (I-3) on January 1, 1991 consistcnt with the Program to Implement the Spnkane
Cnunty Zoiung Code. Pursuant to Revised Code of Washington (RCW) 58.17.195, this
proposal conforms to the requirements of the existiug I-3 zone.
5. The Spokane County Comprehensive Plaui designates this arrea as Industrial. The
development and uses, as proposed and conditioned, are in compliance with the Industrial
category.
6. Surraunding Iand uses are primarily industrial. T1ie lat to ilie east has a dwelling nn it
(residendal), while the lots to the norih and west are vacant.
7. 1'his short plat project is exempt from environmental review under the Slalc
Environnlental Policy Act pursuant to WAC 197-11-800 (6) (a). A"Determination nf
N n n- s i g a i f i c a n c e" was issued to tbis site under ZE-15-85 on A pril 12, 1985.
8. Thc Spokane County Arterial Rnad Plan identifies Flora Road as a Principal Arterial
(without controlled access) with a future right-of-way width of 100 feet. The existing
right-of-way width adjacent to this property is 75 feet. The subject parcel lies 45 feet
from ceater, having previously dedicated an additional 15 feet to the County. Tl1c
Ai-terial Road Plan alsn identifies Euclid Avenue as a Minor Arterial with a future right-
of-way widtli of 80 feet. The existing right-of-way width adjacent to this property is 50
fect. The subject parcel lies 30 feet &om center of right-of-way having previously
dedicated an additional 10 feet to the Couniy. In order to unplement the Arterial Road
Plan, a strip of property 5 feet in widtli along the Ftora Road frontage is tv be set asidc as
a Future Acquisition Area. Therefore, as conditioned (such as improvenients, dedicatinn,
sidewalks and acquisition areas) the proposal confonns to the Arterial Road Plan.
9. The proposed site is located within the Public Transportation Benefit Area (PTI3A).
Spokane Transit Authority (STA) Route 18 provides connecting services to the site per
the Spokane Transit System Map, Winter 199611997.

DECISION
Based upcan the above noted Findings of Fact and Conclusions, Short Plat Application
SP-1138-97 is hereby APPROVED for five (5) years, specifically to May l, 2002 and subject to
conditions noted below. This decision is final unless appealed in writing, consistent with
adogted appeal procedures.
CONDITIONS UF APPRQVAL
All ilie bclow conditions imposed shall be binding on the "Applicant," which term shall include
the owner or owners of the property, heirs, assigns aiid successors.
SPOKANE COUNTY DIVISION OT BUILDING AND PLANNING
1. The proposal shall comply with the Heavy Industrial (I-3) zone and other applicable
Zoning Code chapters, as amended.
2. The final short plat shall be designeci substantially in conformance with the preliminary
plat of record. No increase of density or number of tracts shall occur without a change of
condition application submittal and approval.
3. The preliminary short plat is given conditional approval for five (5) years, specifically tn
May l, 2002. The applicant may subrtiit an extension of time application approximately
lhirty (30) days prior to the above eKpiration date. Application(s) for extension of time

i received the above referenced project appiication on Feb. 26, 1997. The Development Services Secbon of
Spokane County Engineering has detemnined this application to be technically incomplete for the following
reasons:
• There was no "Agreement to Pay Fees" submitted with the applicatlon package as required b Spokane
County Resolubon No. 96-0293, Section .050 Determination of Completeness Paragraph ~A) (5). These are
the cuRently adopted administrative rufes to implement the requirements that are contained in Substitute
House Bill No. 1724, State of Washington. This resolution went into effect on March 31, 1996. The relevant
section states the following: "Counter comptete status may also include applicable fees and, in the
case of the Dtvision of Engineering and Roads, shall include a signed "agr+eement to pay fees." I
believe we are all in agreement, that the exisfing fee agreement system for reviews, is very troublesome to
deal with. I am working with other staff and management in Spokane County Public Works to eliminate fhese
agreements and replace them with a fee of some type that can be paid at the time of application. However,
unbl this can be accomplished, these agreements are needed in order to reimbursement the Counry
Engineering office for the services that our section provides. If we do work on a project that we can not bill,
the county road fund loses money that they can use to match with other grant money. Our net loss for each
dollar that we can not bill, could be as high as three to four dollars, that could have been used to improve our
county roads. Therefiore, we will be unable to infiate the review of any of the application materials and any
other submittal information until we receive a properly executed, original signature (not copfed or faxed) fee
agreement.
• There was no preliminary geo-hazard evalua6on submitted with the plat application as required in Section
11.20.070 (D) (2) Geo-hazard evaluation, Preliminary Report. If the proposal also lies in an area that has a
wetland and/or a Fish and Wldlife Habitat, the appropnate mitigation measures and permits, if any are
required from other agencies, will need to be obtained as the plat is being finalized. The identified mitigation
measures must be considered and used in the preliminary plat layout. The design of roads, utilities, and
drainage improvements must properly incorporate any recommended mitigation measures in the preliminary
layout and any concept plans that may be required. The Development Services Section of Spokane County
Engmeering will be unable to properly evaluate any applicable land use application, until this report is received
with a valid fee agreement. If the Division of Building & Planning's waives the requirement for a
preliminary Geo-hazanl evaluation and report, we request immediate notificatlon with the reason why
such waiver is being granted. We will then continue our review of the application without the above
referenced report if we have a fee agreement as stated above.
Please inform the project sponsor of these issues as it is our desire to speed up the review process as much as
