I received the above referenced project applica►tion on March 17, 1997. The Development Services Section of
Spokane County Engineering has determined this application to be technicalfy incomplete for the following
reasons:
• There was no "Agreement to Pay Fees" submitted with the application package as required by Spokane
County Resoluton No. 96-0293, Section .050 Determinatlon of Completeness Paragraph (A) (5).
We have determined that we will not require a concept drainage plan for this proposal due to the approved
soils in this area. We have no information on critical areas for this proposal.
Please inform the project sponsor of these issues as it is our desire to speed up the review process as much

SVHJBCT: DRAINAGE LLNGOAGE SP 1140-97
Any building that is conetructed on a lot in this Short Plat shall
be at such an elevation so as to provicle positive drainage fror. any
drainage enCry point to the building (including but not limited to a
window well, a window unprotected by a window well, or a doorway).
Said positive drainage ahall consist of a minimum slope of 3% away
fram the building for a distance of at least 10 feet from the
building. The lots ahall be graded so that either a) all runoff fe
routed away from the building, and conveyed over the lots ro a
natural drainage swale or approved drainage facility, or b) draiaage
intercepted on the lot ie dieposed of on the lot in an approved
drainage facility. The approved draiaage facility shall he
constructed in accordance with any applicable accepted plans on file
at the County Engineer"s Office. Any revisions to the accepted
drainage plans must be accepted by the County Engineer's Office prfor
to conatruction of 8aid revisions.
The property owners within thia Short Plat ahall be responsible for
keeping open and maintaining the surface path of natural or man-made
drainage flow over and acrosa their respective prapertiea. Each
property owner or authorized representative shall inform each
aucceeding purchaser of any drainage easemente on the property and
their responsibility for maintaining surface drainage paths and
swales within said easemeats. If the property owner(s) fails to
maintain the surface path of natural or man-made drainage flow, or
the drainage ewale, a notice of such failure may be given to rhe
property owner(s). If not corrected within the period indicated on
said notice, Spokane County has the right to correct the maintenance
failure, or have 3t corrected, at the expense of the property owner.
This short plat is located within the Aquifer Sensitive Area (ASA)
Treatment of storm runoff from driveways shall be provided. The
preferred method of treatment is to have the runoff from driveways
eheet flow over lawn turf or native-type grasses. If a ditch is to
be used to collect runoff from driveways, then the ditch ie to be
grass-lined.

drainage, signage, and other usage deemed necessary by the
Spokane County Engineer for the safety and welfare of the Public.
No fence or portion thereof will be constructed within said
easement without permission of the Spokane County Engineer, nor
,will any objects be placed in said easement that would o.batruct
the sight distance neceseary for eafe and efficient vehicular
movement. Any other easemente granted or dedicated within this
Border Easement area will be subordinate to the rights created by
this easement and are subject tp Spokane County Engineers permit
process prior to usage.

DECIStON
Based upon the above noted rindings of ract and Conclusions, Short Plat Apnlication SP-
is herehy APPROVED for five (5) years, specificAlly to May 1, 2002 and subject to conditians
noted below. This decision is final unless apnealed in writing, consistent with adonted aPpeal
procedures.
CONDITIONS OF AI'PROVAL
All tlle below conditions imposed shall be binding an the "Applicant," wliich term sliall include
the owner or owners of the property, heirs, assigns and successors.
SPOKANC COUNTY DIVISION OT I3UILDING AND PLAIVNING
i. The proPosal shall comply with the UR-3.5 zone and otlier apnlicable Zonins Code
cliapters, as amended.
2. The final sliort Plat shall be designed substantially in conformance witli the preliminary
plat of record. No increase of density or number of trACts shall occur without a change of
condition application submittal and arProval.
3. The preliminary short plat is given conditional 1Pnroval for five (5) years, specifically to
May 1, 2002. The applicant may submit an extension of iime aPplication approximately
thirty (30) days prior to the above expiration date. Annlication(s) for extension of time
shall be processed under tite provisions of Cliapter 12.100.118 (Extension of Time) of the
Spokane County Subdivision OrdinAnce. If the applicant complies witli tlle criteria of
Chapter 12.100.118, the preliminary approvAl and conditions will be changed to reflect
the adorted policy and devetopment regulations at the time of the extension annlication.
4. Prior to filins the final sliort plat, the applicant shall submit to tlle County Division of
Building and Plannins Director/designee for review any proposed final short plats to
ensure compliance witli these Findings and Conditions of Approval.

possible stage in order to be informed of code requirements ldministered/enforced as
authorized by the State Building Cocie Act. Designldevelopment concerns include:
addressing, fire arparatus access raads, fire liydranUflow, apnraved water sysiems,
buiiding accessibility, construction type, occupAncy classification, exiting, exterior wall
protection, and energy code regulalions.
12. A plan for water facilities adequAte for domestic service and fire protection shAll be
approved by the water supnlier, fire protection district, Spokane County Division of
T3iiilcling and Planning and County health aiitliorities. The agencies will certify on tlie
Water Plan, nrior to tiling the final short plat or any phase of the preliminary short plat,
lhat the plan is in conformunce witli their respectiae needs and regulations. Tlle Water
Plan and certification wiil be drafted on a transparency suitable for reprocluction and be
signed by the sponsor.
13. The purveyor will Also certify on the Water Plan that appropriate contrachial
arrangements and sclledule of improvements liave been made with the sponsar for
construction of the water system in accordance with the apnroved Water Plan. Tlle time
schedule for improvements will provide for completion of the water system and
inspection by the appropriate healtli autharities nrior to applicatian for building permits
witliin tlie final sliort plat. The arrangements or asreements wi11 include a provision
holding Spokane Cotinty and the ptirveyor harmless from claims by any tract ptirchaser
reCused a building pern»t due to the failure of the spansor to satisfactorily complete the
approved water system.
14. The final short plat dedication will contain the following statement:
"Tlie public water system, pursuant to the Water Plan approved by Cotinty and
State Health autliorities, the local fire districl, County Division of Duilding and
Planning, and water purveyor, will be instailed witliin this plat, and the apnlicant
wil! Pravide for individual domestic water service as well as fire protection to
each traet priar t4 sale of eACh tract and prior ta issuance of a btlilding permit far
eacli tract."
15. Na buildins permit will be isstieci for any tract within the final short plat until certified by
a Wasliinston State-licensed engineer that "the water system has been installed pursuant
to the apnroved Water Plan for the finat short Plat," sisned and stamped by said engineer.
The certification may be in the form of a letter, but is preferred to be certified on a cony
of the VVater Plan as a scliematic map showing the "as•built" water system.
16. The Water Pfan and the above four (4) conditions of approval regarding tlle Water Ptan
may be waived by the Cotinty Division of Building and Planning Director/desibnee uron
receipt of letters from the appropriate water purveyor and Fre nrotection district stating
that simple c4nnections to an existing apProved water system will nrovide adequAte
domestic and fire Protectian water tio ensure the public healtll, safety and general welfare.
17. The Spakane County Division of Building and Planning shall nrepare ancl recard with the
Caunty Auditor a Title Notice specifyins a Cuture land acquisilion area for roAd riglit-of-
way and utilities. Tl1e reserved fiiture acquisition area Title Notice shall be released, in
fiifl or in part, by the County Division of Building anci Planning. The notice should be
recorded the same time as the final short rlat and sllail provide the follow►ing:
a. A strip of property eqtialing 35 feet from the center line of McDonnld Raad is
reserved fnr fiiture acqtiisitian areA for adciitional raAd right-af-way along
McDonald Roud.

I received the above referenced project application on Feb. 21, 1997. The Development Services Secbon
of Spokane County Engineering has determined this applicadon to be technically incomplete for the
following reasons:
• There was no "Agreement to Pay Fees" submitted with the application package as required by
Spokane County Resolution No. 96-0293, Section .050 Determination of Completeness Paragraph
(A) (5). These are the currently adopted administrative rules to implement the requirements that are
contained in Substitute House Bill No. 1724, State of Washington. This resolution went into effect on
March 31, 1996. The relevant secbon states the following: "Counter complete status may also
include applicable fees and, in the case of the Divislon of Engineering and Roads, shall
include a signed "agr9eement to pay fees." I believe we are all in agreement, that the existing fee
agreement system for reviews, is vecy troublesome to deal with. I am working with other staff and
management in Spokane County Public Works to eliminate these agreements and replace them with a
fee of some type that can be paid at the time of application. However, until this can be accomptished,
these agreements are needed in order to reimbursement the County Engineering office for the
services that our section provides. If we do work on a project that we can not bill, the county raad
fund loses money that they can use to match with other grant money. Our net loss for each dollar
that we can not bill, could be as high as three to four dollars, that could have been used to improve
our county roads. Therefore, we will be unable to initiate the review of any of the application materials
and any other submittal information until we receive a properly executede original signature (not copied
or faxed) fee agreement.
• There was no preliminary geo-hazard evaluation submitted with the plat application as required in
Section 11.20.070 (D) (2) Geo-hazard evaluation, Preliminary Report. If the proposal also lies in
an area that has a wefland and/or a Fish and Wildlife Habitat, the appropriate mit+gation measures and
permits, if any are required from other agencies, will need to be obtained as the pfat is being flnalized.
The identified mitigaton measures must be considered and used in the preliminary plat layout. The
des;gn of roads, utiliqes, and drainage improvements must properly incorporate any recommended
mitigation measures in the preliminary layout and any concept plans that may be required. The
Development Services Section of Spokane County Engineering will be unable to propedy evaluate
any applicable land use application, unfil this report is received with a valid fee agreement. If the
Division of Building & Planning's waives the requirement for a preliminary Geahazard
evaluation and report, we request immediate notification with the reason why such waiver is
being granted. We will then continue our review of the application without the above referenced

1. Reimburse Spokane County for project review and inspection fees as specified in Chapter
9.14 of tlie Spakane Cuuiity Code. Thc fees will be basecl oii actual salary cnsts incurreci
by Spakane County far praject reviews and / nr inspections plus a ten percent
adininistrative charge, ancl will be billed monthIy as accruecl. Any billing ainaunts due,
including any expenses incurred in the collection of an nverclue account, must be paid
prior td the C'ounty's acceptance r,f the prnject far filing. if a project is apPraved and/or
filed wilh a balAnce stiU owing, tiic unpaid balance shall be paid withiii 30 clays of llie
invoice date.
