In consideration of the approval by Spokane County of Shart Plat No. 1143 hereinafter referred
to as the "plat"), undersigned covenants and agrees that:
The praperty owners within this plat shall be held responsible for keeping open and maintaining
the surface path of natural or man-made drainage flow over aad across their respective properties.
If the nroperty owner(s) fails to maintain the surface path of natural or man-made drainage flow,
or the drainage swale, a notice of such failure may be given to the property owner(s). lf not
corrected within the period indicated on said notice, Spokane County has the right to correct the
maintenance failure, or have it corrected, at the expense of the property owner.
Any natural drainage channels, creeks with intermittent or constant flow, or well-defined natural
draws periodically subject to concentrated flow of stormwater, shall be placed within an easement
granted to Spokane County. No buildings shall be constructed within the easement, and no fll
placed within the easement without the expressed written consent of the Spokane Count_y
Engineer. The easement shall be of sufficient width to encompass the stormwater flow width and
allow for emergency maintenance, but in no case sball the easement be less than 10 R. in width.
There may exist properties located uphill and adjacent to this subdivision which periodically
discharge stormwater runoff onto individual lots within this plat. Runoff from nearby uphiU
properties should be expected, and during snowmelt periods or wet seasons the lots may be
subjected to higher amounts of stormwater runoff that what is normally observed or anticipated.
Because stormwater runoff from adjacent properties have discharged onto this plat prior to
development, stormwater runoff wiU likely continue to do so after development. It is the
responsibility nf the individual lot owners to maintain existing surface paths of runoff through
their respective lots and to grade the lots in accordance with applicable ntles and regulations, so
as to prevent property damage.
Any building that is constructed on a lot in this plat shaU be set at such an elevation so as to
provide positive drainage away from any drainage entry paint to the building (including but not
limited to a window well, a window unprotected by a window weU, or a doorway). Said positive
drainage shall consist of a minimum slope of 3% au+ay from tbe building for a distance of at least
10 feet from the building. The lots shall be graded so that either a) all runoff is routed away from
the building, and conveyed over the lot to a natural drainage swale or approved drainage facility,
or b) drainage intercepted on the lot is disposed of on the lot in an approved drainage facility.
The approved drainage facility shall be constructed in accordance with any applicable accepted
plans on file at the County Engineer's 4f~'ice. Any revisions to the accepted drainage plans must
be accepted by tbe County Engineer's Office prior to construction of said revisions.

DECISIUN
13ased upon the above noted Finclings of Fact and Cnnclusions, Short Plat Applic:ation
SP-1143-97 is hereby Al'PROVED for five (S) years, specifically to June 1, 2002 and subject lo
canditions noted below. This decision is final unless appealed in writing, consisteiit with
aclopted appeal procedures.
CONDITIONS OF APPROVAL
All lhz below conditions imposed shall be binding on the "Applicant," which tenn sliall include
the owner or owners of the property, heirs, assigns aud successors.
SPOKANEi COUNTY DIVISION OF BUILDING AND PLANNING
1. 11ie proposal shall comply with the Regional Business (13-3) zone and ntlier appliCable
Zoning Code chapters, ~s amended.
2. The iinal short plat shall be designed substantially in conformance witli the preliminary
plat of record. Nd increase of density or nwuber of tracts shall oceur without a change of
candition application submittal icmd approval.
3. The prcliniinary short plat is given conditional approval Far five (S) yelrs, specifically to
June 1, 2002. 'I'lie applicant may submit ari extension of tirne application approximately
thirty (30) days prior to the above expiration dAte. Application(s) for extenston of time
sliall be processed under the provisions of Chapter 12.100.118 (Extension of Tinie) of the
Spolcane County Subdivision Ordinance. If the applicant complies with the critc;ria of
Chapter 12.100.118, lhe preluninary approval and conditions will be changecl to retleet
the adopted policy and development regulations at the time of the extension application.
4. Priur to filing the Iinal short plat, the applicant shall subnut to the County Division of
Building and Planning Director/designee for review any proposed fiiial short plals to

1. Reimburse Spakane County for project review ancl inspection fees as specifieci in CIiapter 9.14 of
the Spokane County Cacfe. The fees will be based on actual salary costs incuned by Spnkane
County for project reviews and / or inspections plus a ten percent administrative charge, atid will
be billecf monthiy as accrued. Any biiling amounts due, including any exPenses incurred in the
collection of an overdue accaunt, muSt be paicl prior to lhe County's acceptance of the project for
filing. If a project is approved and/or filed with a balance still owing, the unpaid balance shall be
paid within 30 days of the invoice date.
2. The undersigned agrees that these fees are due and payable upon receipt of the billing as specified
abave.
3. Any invoices not paid within 30 days of the invoice date will be considered delinquent. If nny
outstanding balance on tlie account for this project is not paid within 30 days of the invoice clate,
no further reviews of the praject dacutnents wiil he conductecl until the entire account balance is
paitf. Any balance on the account for this project not paid within 65 days of the invoice date may
result in legal action or the initiation of other colleccion procedures, including referral to a
collection agency. The Sponsor will he iiahle for any and all expenses incurred by the County far
the collectian of overdue accounts.

The Spokane County Engi.neering Deparrtrnent has revriewed the above referenced application. The following
"Conditions of Approval" are submitted to the Spokane County Planning Department for inclusion in the
"Findings vf Fact, Conclusions and Order/Decision" should the request be aQproved.
1. That conditional approval of the plat by the County Engineer is given
subject to dedication of right-of-way and approval of the road system
as indicated in the preliminary plat of record.
2. That drainage plans and design calculations showing the alignment of
drainage facilities be submitted to the County Engineer for acceptance
prior to construction and/or the filing of the final plat. Drainage
plans to be prepared under the direction of a licensed Professional
Civil Engineer.
3. Approach Permits are required for any access to the Spokane County road
system.
4. The applicant shall grant applicable border easements adjacent to
Spokane County Right of Way per Spokane County Standards.
5. The proposed plat shall be improved to the standards set forth in
Spokane County Board of Commissioners Resolution No. 95-0498, as
amended, which establishes regulations for roads, approaches, drainage
and fees in new construction.

Spokane Caunty Engineering has determined this application to be technicalty incomplete for the following
reasons:
• There was no "Agreement to Pay Fees" submitted with the application package as required by Spokane
Coun~ Resolution No. 96-0293, Section .050 Determination of Completeness Paragraph (A) (5).
There ore, we will be unable to initiate the review of any of the appfication materials and any other submittal
information until we receive a properly executed, original signature (not copied or faxed) fee agreement.
We have determined that we will not require a concept drainage plan for this proposal due to the approved soils in
this area. We have no information on cntical ar+eas for this proposal.
Please inform the project sponsor of these issues as it is our desire to speed up the review process as much as
we can. Thank you for your cooperation.
