I received the above referenced project application on Oct. 13, 1997.
The SCS Soils Map identifies this area as being Garrison Gravely Loam soils. The soil survey in this area is
known to be accurate. Therefore, since this is an approved soil for stormwater disposal, no concept drainage plan
is required. We have no information that says there are any critical areas on this site.
I consider this proposal to be technically complete.
No drainage plan will be required. We will have standard drainage language that will apply to the plat.

PLAT NO. SP-1144-97 ) CONCLUStONS AND
DECISION
THIS MATTER, an application for short subdivision from Habitat for Humanity has been
received and was decided upon, pursuant to Spokane County Subdivision regulations,
on the 24th day of October, 1997.
FINDINGS OF FACT AND CONCLUSIONS
1. The individual signing below has further been delegated the responsibility for
rendering the decision by the Director of the Spokane County Division of Building
and Pianning.
2. The proposal is to divide approximatefy 28,720 square feet (.65 acres) of land
into four (4) tracts for single family residences and those uses permitted in the
existing Urban Residential-12 (UR-12) zone.
3. The proposal is located north of and adjacent to Alki Avenue, approximately 150
feet east of Ella Street in the SW 1/4 of Section 18, Township 25 North. Range
44 E.W.M,. Spokane County, Washington.
4. The existing zone of the property described in the application is Urban
Residential-12 (UR-12), which was established in 1997 (file no. ZE-31-97).
Pursuant to Revised Code of Washington (RCW) 58.17.195, this proposal
confonns to the requirements of the exisfing Urban Residential-12 (UR-12) zone.
5. The Spokane County Comprehensive Plan designates this area as Urban. The
devetopment and uses, as proposed and conditioned, are in compliance with this
designation. This proposal is also compatible with the surrounding uses, which
are primarily single family residences.
6. Surrounding uses are primarily singte family residential deveiopment at medium
residential densfties.
7. The Spokane County Arterial Road Plan identifies Alki Avenue as a Local Access
Street with a planned right-of-way width of 60 feet. The existing right-of-way
width is 40 feet. No additional right-of-way dedication or Future Acquisition Area
has been requested by the Spokane County Division of Engineering and Roads.
8. The site is located within the Public Transportation Benefit Area (PTBA). The
nearest public transit service is Spokane Transit Autharity (STA) routes 15 and
17 located approximately 300 feet north of the site.
9. The proposed short ptat is located in the Hutchinson Irrigation District and will be
served by a public water system. Hutchinson trrigation District has indicated
they can supply domestic use water to the short piat upon compietion of the
appropriate agreements.
10. The required public notice was provided for this proposal and agencies having a
potential interest in the project were notified and recommendations solicited.
11. Written comments were not received from any adjoining property owners.
12. Recognizing the reoommended conditions and Spokane County development
standards, the proposed short plat makes appropriate provisions for the public
heafth, safety and generai weifare and that the public use and interest will be
served by piatting the subdivision.
The subdivision proposal is generally consistent with RCW 58.17 and the County
subdivision regulations, promoting the public heaith, safety and general welfare
in accordance with standards established by the state and Spokane County.
The County Division of Building and Planning has considered the provision of
adequate public facilities as cited in RCW 58.17.110 (2). More specifically:
a. open spaces f. sanitary waste disposal
b. drainage ways g. parks and recreation facilities
c. public and/or private right-of-ways h. playgrounds
d. transit i. schools and school graunds
e. potabie water j. sidewalks
13. The project is exempt from environmental review under the State Environmental
Policy Act pursuant to WAC 197-11-800 (6) (a).
DECISION
Based upon the above noted Findings of Fact and Conclusions, Short Plat Application
SP-1144-97 is hereby APPROVED for five (5) years, specifically to Novernber 1, 2002
and subject ta conditions noted below. This decision is final unless appealed in writing,
consistent with adopted appeal procedures.
CONDlTIONS OF APPROVAL
All the betow conditions imposed shall be binding on the "Applicant," which term shall
include the owner or owners of the property, heirs, assigns and successors.
SPOKANE COUNTY DIVISION OF BUILDING AND PLANNING
1. T'he proposal shall comply with the Urban Residential-12 (UR-12) zone and all
other applicable Zoning Code chapters, as amended.

2. The final plat shall be designed substantially in conformance with the preliminary
plat of record. No increase of density or number of tracts shall occur without a
change of condition application submittal and approval.
3. The preliminary short plat is given conditionai approval for five (5) years,
specifically to Novembec 1, 2002. The appiicant may submit an extension of
time application thirty (30) days prior to the above expiration date. Apptication(s)
for extension of time shafl be processed under the provisions of Chapter
12.100.118 (Extension of Time) of the Spokane County Subdivision Ordinance.
If the applicant complies with the criteria of Chapter 12. 100.118, the preliminary
approval and conditions will be changed ta reflect the adopted policy and
development regulations at ihe time of the extension application.
4. Prior to filing of the final short plat, the applicant shall submit to the County
Division of Building and Planning DirectoNdesignee for review any proposed final
plats to ensure compliance with these Findings and Conditions of Approval.
5. A survey is required of the subject property prior to filing of the final short plat.
6. Appropriate road name(s) and street address(es) shall be indicated on the final
plat map.
7. Appropdate utility easements shall be indicated on the finai plat map. Approval
of utility easements by utility companies must be received prior to filing of the
final piat.
8. The final short plat map shall indicate by a dashed line the required setbacks
from all private or pubtic roads. The dedication shali contain the following
statement: "Side yard and rear yard setbacks shall be determined at the time
buitding permits are requested unless these setbacks are specifically drafted on
this final plat. The setbacks indicated on this subdivision may be varied from if
proper zoning or variance approvals are obtained."
9. Four (4) current certificates of title shall be fumished to the County Oivision of
Building and Planning prior to filing of the final plat.
10. The applicant shall contact the County Division of Building and Planning at the
eartiest possible stage in order to be informed of code requirements
administered/enforced as autho(ized by the State Building Code Act.
Design/development concems include: addressing; fire apparatus access roads;
fire hydranUflow; approved water systems; building accessibility; construction
type; occupancy classification; exiting; exterior wall protection; and energy code
regulations.
11. No water plan is required, only a simple connection will be needed prior to the
sale of each tract and prior to issuance of a building permit for each tract.
12. The Spokane County Division of 6uilding and Planning shall prepare and record
with ihe Spokane County Auditor a"Title Notice" noting that the property in
question is subject to a variety of special conditions imposed as a result of
approval of a land use action. This "Title Notice" shall serve as official public

notice regarding conditions of approvai affecting the property in question. The
"Titie Notice" shall be recorded within fifteen (15) days of final disposition of the
approved land use action and shall only be extinguished by the Spokane County
Division of 6ui(ding and Pianning. The "Titfe Noace" shall generally provide as
follows:
The parcel of property legally described as (legal description and tax parcel
number) is the subject of a land use action, imposing a variety of special
devetopment condifions, by a Spokane County Administrative Official on
October 24, 1997 and as maybe amended, aitened or supplemented by
official action or as already changed. File No. SP-114497 is available for
inspection and copying in the Spokane County Division of Building and
Planning.
13. A six (6) foot high concrete, masonry, or decorative block wall, solid landscaping
or site obscuring fence shall be maintained on the north, east and west
boundaries of the subject property (pursuant to Section 14.620365 of the
Spokane County Zoning Code) unless the appropriate zoning or variance
approvals have been obtained.
SPOKANE COUNTY DIVISION OF ENGINEERING AND ROADS
1. That conditional approval of the plat by the County Engineer is given subject to
approval of the road system as indicated in the preliminary plat of record.
2. Drainage plans and design calculations showing the alignment of drainage
facilities shall be submitted to the • County Engineer for acceptance prior to
constnuction and/or the filing of the final plat. Drainage plans to be prepared
under the direction of a licensed Professiona! Civil Engineer.
3. No construction work is to be performed within the existing or proposed public
right-of-way until a permit has been issued by the Spokane County Engineer. All
work is subject to inspection and approval by the County Engineer.
4. Approach Permits are required for any access to the Spokane County road
system. Tract "A" shall use the existing approach for access. The proposed
driveway as shown on the preliminary plat of record shall serve only Tracts "B",
"C" and "D". Use of the private dnveway by any other lots shall requ+re
construction of a private road. Construction of a private road includes a 20 foot
paved road within a 40 foot easement and requires acceptance of road and
drainage ptans by the County engineer and execution of other documents as
prescribed.
5. The applicant shall grant applicable border easements adjacent to Spokane
County Right-of-Way per Spokane County Standards.
6. To construct the road improvements stated herein, the applicant may with the
approval of the County Engineer, join in and be a willing pacticipant in any
petition or resolution which purposes is the formation of a Road Improvement
Oistrict (RID) for said improvements pursuant to RCW 36.88, as amended. At

7, Ars an alternative me#hod to constructing the road improvement stated herein,
the applicant may, with the approval of tne County Engineer, accomplish the
road impravements stated herein, by joining and participating in a Caun#y Raad
Praject (GRP) to the extent of the requir+ed road impravements. At such time as
an RID is created vr any Road Improvement Project Es sanctioned by Spokane
Caun#y, the improverrtents required (curb, sidewallt, drainage control and paving
to existing pauement) will be at the sole expense of the undersigned owner, their
heirs, grantees and assigns. This provision is applicable ta Alki Avenue.
8. That the follawing staternent shall appear with the dedicatory language of the
final shar# plat:

It is further acknowledged and agreed that at such time as a RlD is created or
any Caunty Rvad Impravement project is au#horized by Spokane Countyf the
impravements required shall ae at the sote expense of the owner(s) of the

property within the RID or served by the improvements without any monetary
participation by Spokane County.
The RID waiver contained in this agreement shall expire after ten (10) years from
the date of execu#ion below. This provision is applicable to Alki Avenue.
9. The County Engineer has been designed a Local Access Roadway Section for
the improvement of Atki Avenue which is adjacent to the proposed development.
This will require the addition of approximately 6-8 feet of asphalt atong the
frontage of the development. The construction of curbing and sidewalk is also
required.
10. The proposed plat shall be improved to the standards set forth i9n the Spokane
County Board of County Commissioners Resolution No. 95-0498, as amended,
which establishes regulations for roads, approaches, drainage and fees in new
construction.
11. The County Engineer has examined the development proposal and has
determined that the impact of this proposat upon the existing County Road
System warrants the roadway improvements herein specified.
SPOKANE COUNTY DIVISION OF UTIL1TlES
1. A wet (live) sewer connection to the area-wide Public Sewer System is ta be
constructed. Sewer connection permit is required.
2. Applicant shaN submit expressly to Spokane County Utilities Department "under
separate cover", only thase plan sheets showing sewer plans and specifications
for the public sewer connections and facilities for review and approval.
3. The plans shall be submitted prior to the finalization of the project. '
4. Arrangements for payments of applicable sewer charges must be made for prior
to issuance of sewer connection permit.
5. Any water service for this praject shall be provided in accordance with the
Coordinated Water System Plan for Spokane County, as amended.
SPOKANE REGIONAL HEALTH DISTRICT
1. The final plat shall be designed as indicated on the preliminary plat of record
and/or any attached sheets as noted.
2. Appropriate utility easements shall be indicated on copies of the preliminary plat
of record for distribution by the division of Building and planning to Uti9lity
Companies, Spokane County Engineer, and the Spokane Regional Health
District. Written approval of the easements by the utility companies shall be
received prior to the submittal of the final plat.
3. Sewage disposal method sha!l be as authorized by the Director of Utilities,
Spokane County.

4. Water service shall be coordinated through the Director of Utilities, Spokane
County.
5. Water service shall be by an existing public water supply when approved by the
Regional Engineer (Spokane), State Department of Health.
6. Prior to filing the final plat, the sponsor shall demonstrate to the satisfaction of
the Spokane Regionai Heaith District that an adequate and potable water supply
is available to each tract of the plat.
7. Prior to filing the final plat, the sponsor shall present evidence that the plat lies
within the recorded service area of the water system proposed to serve the site.
8. A public sewer system will be made availabie for the plat and individual service
will be provided to each tract prior to sale. Use af individual on-site sewage
disposal systems shall not be authorized.
9. A statement shall be placed in the dedication to the effect that: "A public sewer
system wi11 be made avaitabte for the plat, and individuai service will be provided
to each tract prior to sale. Use of individuai on-site sewage disposal systems
shail not be authodzed."
10. The dedicatory language on the plat shall state: "Use of private wells and water
systems is prohibited."
11. The final plat dedication shall contain the following statement: "The public water
system, pursuant to the Water Plan approved by counfy and state heafth
authorities, the local fire protection district, County Division of Building and
Ptanning and water purveyor, shall be installed within this subdivision and the
applicant shall provide for individual domestic water service as well as fire
protection to each tract prior to the sale of each tract and prior to the issuance of
a building permit for each tract."

1. That conditional approval of the plat by the County Engineer is given
subj ect to approval of the road system as indicated in the prel iminary
plat of record.
2. That drainage plans and design calculations showing the alignment of
drainage facilities be submitted to the County Engineer for acceptance
prior to construction and/or the filing of the final plat. Drainage
plans to be prepared under the direction of a licensed Professional
Civil Engineer.
3. No construction work is to be performed within the existing or proposed
Public right-of-way until plana have been accepted by the County
Engineer and a permit has been iasued by the County Engineer. All work
is subject to inspection and approval by the County Engineer.
4. Approach Permits are required for any access to the Spokane County road
system. Tract "A" shall use the existing approach for acceas. The
proposed driveway as shown on the preliminary plat of record shall
serve only Tracts "B" "C" and "D". Use of the driveway by any other
lots shall require construction of a private road. Construction of a
private road includes a 20 foot paved road within a 40 foot easement
and requires acceptance of road and drainage plans by the County
Engineer and execution of other documents as prescribed.
5. The applicant shall grant applicable border easements adjacent to
Spokane County Right of Way per Spokane County Standards.

participant in any petition or resolution which purposes ia the
formation of a Road Improvement District (RID) for said improvements
pursuant to RCW 3 6. 8 8, as amended. At such t ime as an RID is created
or any Road Improvement Project is sanctioned by Spokane County, the
improvements required (curb, sidewalk, drainage control and paving to
existing pavement) will be at the sale expense of the undersigned
owner, their heirs, grantees and assigna. This provision is applicable
to Alki Avenue.
As an alternative method of constructing the road improvement stated
herein, the applicant may, with the approval of the County Engineer,
accomplish the road improvements stated herein by joining and

If a RID is proposed for improvement of the road(s) described below,
said owner ( s) and successor (s) further agree :(1) that the improvements
or construction contemplated within the proposed RID are feasible and
(2) that the benefits to be derived from the formation of the RID by
the property included therein, together with the amount of any County
participation, exceeds the cost and expense of formation of the RID,
and (3) that the property within the proposed RID is suff iciently
developed; provided, themselves, their heirs, grantees, assigns and
successor(s) shall retain the right, as authorized under RCW 36.88.090,
to object to any assessment(s) an the property as a result of the
improvements called for in conjunction with the formation of a RID by
either the petition or resolution method under Chapter 36.88 RCW and to
appeal to the Superior Court the decision of the Board of County
Commissioners confirming the final assessment roll; provided further,
it is recognized that actual assessments may vary from assessment
estimate so long as they do not exceed a figure egual to the increased
true and f air value improvement ( s) add ( s) to the property.
It is further acknowledged and agreed that at such time as a RID is
created or any County Road Improvement project is authorized by Spokane
County, the improvements required shall be at the sole expense of the
owner(s) of property within the RID ar served by the improvements
without any monetary participation by Spokane County.
The RID waiver contained in this agreement shall expire af ter ten (10)
years from the date of execution below. This provision is applicable

9. The County Engineer has designated a Local Access Roadway Section for
the improvement of Alki Avenue which is adjacent to the proposed
development. This will require the addition of approximately 6-8 feet
of asphalt along the frontage of the development. The construction of
curbing and sidewalk is also required.
10. The proposed plat shall be improved to the standards set forth in
Spokane County Board of Commissionera Resolution No. 95-0498, as
amended, which establishes regulations for roads, approaches, drainage
and fees in new construction.
11. The County Engineer has examined this development proposal and has
determined that the impact of this proposal upon the existing County
Road System warrants the roadway improvementa herein specified.

That the individuals and Rarties natned Iierein as having nn interest in the above described rrnperty or project
agree lo the fallowing:
l. Reimiwrce Spakane County fnr project review and inspection fees as specified in Chapter
9.14 of the Spokane County Code. T'he fees witl be based on actual salary costs incurred
hy Spokane County fc►r project reviews and / vr inspections plus a ten percent
administralive charge, and will be billed montlily as accrued. /1ny billing amounts due,
including any expenses incurred in the collectian of an overdue account, must be paid
prior to the Gaunty's accePtance of the Project for filing. If aproject is apPraved and/nr
filed witli a halance still owing, the unpaid halance sha11 be paid tivithin 30 days of the
invoice date.
2. The undersigned agrees lliat these fees are clue and payahle uron reeeipt af the hilling as
srecif ed abpve.
3. Any invoices nnt paid within 30 days of the invoice date will be considered delinquent.
If any nutstanding balance on the accoulit far this prnject is nnt paid within 30 days of
the invaice date, no [urther reviews af the project documents will be canducted uniil tlle
entire account balance is paid. Any balance on the account far this project not paid
within CS days of the invoice date may result in legal aetion or the initiation of Otller
colteciiori procedures, inctuding referral ta a coltectian agency. The Spansor will be
liabte for any and all expen4eg incurred tay the Caunty► fnr the collection of overdue
accounts.
